CITY OF DELANO

STAFF REPORT
September 15, 2025
Agenda Item: 15
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Pedro Nunez, P.E., Public Works Director
SUBJECT: Resolution Awarding Contract to Lease Servicing Center, Inc. dba NCL Government Capital for the Lease Purchase of One (1) New/Unused PB Loader Dump Body, 15 Ft 12-14 Yard with 2026 Freightliner M2 106 Chassis (58,000 lbs. GVWR) from National Auto Fleet Group, authorizing the expenditure of funds in the amount of $237,387.28 over a term of six (6) years, with annual payments of $48,108.20 and authorizing the City Manager, or her designee, to execute all required documents
Recommendation
Approve the attached resolution.

Discussion
The Streets Division of the Delano Public Works Department aims to provide for the safe and efficient vehicular movement on its city streets, maintains all paved roads and alleys, with the goal of extending the life of the structures by initiating means such as rejuvenating, crack sealing, and overlaying streets; this involves loading and unloading of construction materials, such as backfill, asphalt, and construction debris.

Due to the city's ongoing growth and the corresponding increase in infrastructure demands, the Streets Division requires the purchase of one (1) new/unused PB Loader 15-foot Dump Body (12– 14-yard capacity) mounted on a 2026 Freightliner M2 106 Chassis (58,000 lbs. GVWR). This vehicle is essential to support the division’s ability to efficiently perform street maintenance and operations citywide. The additional capacity and updated equipment will allow crews to respond more effectively to increased workloads, improve service delivery, and ensure the safety and reliability of our roadways.

The City has joined the Sourcewell (formerly National Joint Powers Alliance) member community of government agencies, educational institutions, tribal nations, and nonprofit organizations. As such, the City can avail itself of competitively solicited cooperative contracts ready for use in the government purchase of supplies, equipment, and services, through a sole source contract with a participating vendor PB Loader of Fresno, CA (Sourcewell contract # 0805521-PBL) of Fresno, CA with financing from NCL Government Capital (Sourcewell contract # 092424-NCL) was deemed the qualified vendor of One (1) New/Unused PB Loader Dump Body, 15 Ft 12-14 Yard with 2026 Freightliner M2 106 Chassis (58,000 lbs. GVWR). This purchase is in accordance with Municipal Code 3.08.090-Procurements pursuant through joint powers agreements.

Budget Impact
The purchase of One (1) New/Unused PB Loader Dump Body, 15 Ft 12-14 Yard with 2026 Freightliner M2 106 Chassis (58,000 lbs. GVWR) will have annual payments of $ 48,108.20 for a term of six years, totaling $ 237,387.28. The FY25-26 budget includes $55,000 under account 111- 90000-400-A00123 for this purchase. It is requested that with this approval, the Finance Director is authorized to reserve from Gas Tax Fund 111 the amount of $182,387.28 in subsequent fiscal years to pay the annual installments over the life of the loan.

CITY OF DELANO

STAFF REPORT
September 15, 2025
Agenda Item: 17
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Pedro Nunez, P.E., Public Works Director
SUBJECT: Resolution Awarding Contract to Lease Servicing Center, Inc. dba NCL Government Capital for the Lease Purchase of One (1) New/Unused PB Loader Model BC-5 Asphalt Patcher with 2026 Freightliner M2 106 Chassis, 33,000 GVWR from PB Loader, authorizing the expenditure of funds in the amount of $316,443.58 over a term of six (6) years, with annual payments of $64,129.52 and authorizing the City Manager, or her designee, to execute all required documents.

Recommendation
Approve the attached resolution.

Discussion
The Streets Division is responsible for providing for the safe and efficient vehicular movement throughout the city by maintaining all paved roads and alleys. Its efforts—such as crack sealing, rejuvenating, overlaying streets, and maintaining visible street markings—are essential to extending the life of city infrastructure and promoting public safety.

As the city continues to grow, so does the demand on our existing roadway network. To meet these increased demands and maintain service levels citywide, the Streets Division must procure additional equipment, including a new asphalt patcher truck. This equipment is critical for performing timely and effective repairs, reducing long-term maintenance costs, and preserving the integrity of our roadways across the entire system. Investing in this equipment now will allow us to stay ahead of deterioration, minimize disruptions to the public, and uphold the standards our residents expect and deserve.

The City has joined the Sourcewell (formerly National Joint Powers Alliance) member community of government agencies, educational institutions, tribal nations, and nonprofit organizations. As such, the City can avail itself of competitively solicited cooperative contracts ready for use in the sole source government purchase of supplies, equipment, and services.

PB Loader of Fresno, CA, (Sourcewell contract # 0805521-PBL) with financing from NCL Government Capital (Sourcewell contract # 092424-NCL) was deemed the qualified vendor of One (1) New/Unused PB Loader Model BC-5 Asphalt Patcher with 2026 Freightliner M2 106 Chassis, 33,000 GVWR. This purchase is in accordance with Municipal Code 3.08.090- Procurements pursuant through joint powers agreements.

Budget Impact
The purchase of this One (1) New/Unused PB Loader Model BC-5 Asphalt Patcher with 2026 Freightliner M2 106 Chassis, 33,000 GVWR will have annual payments of $64,129.52 for a term of six years, totaling $316,443.58. The FY25-26 budget included $70,000 under account 111- 90000-400-A00126 for this purchase. It is requested that with this approval, the Finance Director is authorized to reserve from Fund 111 Gas Tax the amount of $246,443.58 to pay annual installments over the life of the loan.

RECOMMENDATION:

Ratification of Emergency Well repair work on Well 39 by Bakersfield Well & Pump Co. in the amount of $55,366.00.

DISCUSSION:

Well 39, located at the intersection of 20th Avenue and Albany Street, was taken offline last month due to a noticeable reduction in pumping capacity. Following this, the well was pulled, and video inspected to assess its condition.

City staff has been coordinating with Bakersfield Well & Pump to complete the necessary repairs and return the well to service as quickly as possible. The drinking water supplied by Well 39 is a critical component of the water distribution system serving this area of the city.

Bakersfield Well & Pump, a contractor with a proven track record of quality workmanship, has been contacted and is available to perform the required work within a reasonable timeframe.

BUDGET/FISCAL:

The current budget has sufficient funds under account 373-95000-720-P00072 to pay for this project ($55,366.00). Authorization is also requested for the City Manager, or her designee, to execute any documents needed to carry out this project.

SUBJECT: Award of Contract to American Fabrication for Restroom Roof Enclosure at Kalibo Park in the amount of $42,434.00.

Recommendation
Award of Contract to American Fabrication for Restroom Roof Enclosure at Kalibo Park in the amount of $42,434.00.

Discussion
The existing roof structure on the restroom facility located at Kalibo Park has deteriorated over time and is no longer adequate to protect the interior from weather-related damage. Regular maintenance is no longer sufficient, and a full replacement is necessary to maintain the structural integrity and extend the service life of the facility.

The scope of work includes, complete removal and disposal of the existing roof structure, fabrication and installation of a new prefabricated steel roof system, application of a factoryapplied, weather-resistant coating to enhance durability and minimize maintenance, and all associated structural and safety components necessary for installation.

American Fabrication has demonstrated the capability, expertise, and resources to perform the work in compliance with the City’s specifications and within the project timeline. Their proposal was both responsive and cost-effective.

Budget Impact
A 10% contingency of $4,200.00 is requested to bring the grand total to $46,634.00. All costs associated with the identified improvements will be reimbursed by State Parks Grant from the Specified Grant Funds awarded to the City and authorization for the City Manager, or her designee to execute necessary contracts.

SUBJECT: Award of Contract to C&H Fencing for Ballfield Backstop Removal and Installation, Dugouts, and Shade Structures at Cesar Chavez Park in the amount of $80,050.00.

Recommendation
Award of Contract to C&H Fencing for Ballfield Backstop Removal and Installation, Dugouts, and Shade Structures at Cesar Chavez Park in the amount of $80,050.00.

Discussion
Cesar Chavez Park serves as a vital recreational facility for the community, hosting numerous youth and adult baseball games throughout the year. The existing ballfield backstop has reached the end of its service life and no longer meets safety and functionality standards. Additionally, there is a need to improve the comfort and protection of players and spectators through the installation of dugouts and shade structures.

The work includes the removal and disposal of the existing backstop, installation of a new, durable backstop meeting current safety codes and design standards, construction of player dugouts with adequate seating and shelter, installation of shade structures to provide sun protection for players and fans.

Budget Impact
A 10% contingency of $8,000.00 is requested to bring the grand total to $88,050.00. All costs associated with the identified improvements will be reimbursed by State Parks Grant from the Specified Grant Funds awarded to the City and authorization for the City Manager, or her designee to execute necessary contracts. Authorize finance to create the necessary capital project account and budget within fund 40.

TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Roman Dowling , Interim Community Development Director SUBJECT: Resolution of Initiation of Annexation and Pre-Zoning Ordinance related to PreZoning Application No. 25-0001: A request to (i) pre-zone an approximately oneacre parcel (APN 521-040-37) from the Kern County Highway Commercial (CH) zoning district to the City of Delano Industrial (I) zoning district, and (ii) pre-zone an approximately eight-acre parcel (APN 521-120-09) from the Kern County Exclusive Agriculture (A) zoning district to the City of Delano Industrial (I) zoning district. Staff has determined the project to be exempt from the California Environmental Quality Act (“CEQA”) pursuant to Section 15183 of the CEQA Guidelines (Projects Consistent with a Community Plan, General Plan, or Zoning). _____________________________________________________________________________ Recommendation
It is recommended that the City Council take the following actions:

1. Conduct the Public hearing,

2. Adopt City Council Resolution No. 2025-______ a Resolution of Application for the annexation application to the Kern Local Agency Formation Commission,

3. Approve Indemnification Agreement and authorize the City Manager to excute, and

4. Introduction and First Reading of an Ordinance prezoning approximately nine acres to (i) pre-zone an approximately one-acre parcel (APN 521-040-37) from the Kern County Highway Commercial (CH) zoning district to the City of Delano Industrial (I) zoning district, and (ii) prezone an approximately eight-acre parcel (APN 521-120-09) from the Kern County Exclusive Agriculture (A) zoning district to the City of Delano Industrial (I) zoning district as prerequisite to annexation of the site to the City of Delano.

PROJECT INFORMATION
File No. Pre-Zoning Application No. 25-0001
Applicant Brave Flower LLC and Duran Properties, LLC
Location/Acres Between Garzoli Avenue and State Route 99 at Schuster Road/Nine acres

Kern County Zoning Designation Highway Commercial and Agriculture Districts Proposed Zoning Designation Industrial
Existing Use of the Property Office, warehouse, storage yard and distribution facility
CEQA Exemption CEQA §15183, Projects Consistent with a
Community Plan, General Plan, or Zoning
Project Description
The applicant is requesting to prezone the Subject Property as shown below as a prerequisite to annexation of the site. The prezoning district will include nine acres of Industrial district.

Staff notes, the map above is simply for the purpose of reference and not to scale.

Public Hearing Notice
A Notice of Public Hearing was published in the Bakersfield Californian, a newspaper of general circulation, 24 days prior to the public hearing, and mailed to all property owners within a 300- foot radius of the subject property and required agencies; a second Notice of Public Hearing was published in the same newspaper 19 days prior to the public hearing.

California Environmental Quality Act (CEQA)
The project is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15183 of the CEQA Guidelines (14 Cal. Code Regs. § 15183) which provides that projects that are consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified shall not require additional environmental review, except as might be necessary to examine whether there are project specific
3 significant effects which are peculiar to the project or its site. The Subject Property is in the City of Delano’s sphere of influence and has been assigned the Industrial (I) land use designation in the City of Delano General Plan since 2005. An EIR for the City’s General Plan was certified on January 25, 2000 (SCH No. 1998081068). Furthermore, the existing uses on the Subject Property—an office, warehouse, storage yard and distribution facility—are all permitted uses under the proposed Industrial (I) zoning designation.

Planning Commission Review
The Planning Commission conducted a public hearing on August 13, 2025, and after discussion voted three to zero (Chairwoman Vallejo and Commissioner Vasquez absent) recommending approval of the prezoning request by adopting Planning Commission Resolution 2025-08.

Discussion
The project site is currently located outside the boundary of the Delano City limits. Current zoning consists of Kern County’s Zoning designations; Highway Commercial (CH) and Exclusive Agricultural (A) districts. The applicant proposes to prezone the subject parcels into Industrial (I) district in advance of an application for annexation into the City. Staff notes, the property must be prezoned before such application can be filed with the Local Agency Formation Commission (LAFCo). If the annexation is approved by LAFCo, as they are the lead agency for annexations into the City, the City’s zoning district will replace the Kern County’s zoning. The proposed prezoning district is consistent with the underlying general plan land use designations for the project site. The proposed annexation is consistent with the LAFCo policy regarding contiguous boundaries.

Required Findings (Municipal Code Section 20.2.40.5)

1. Finding: The proposed prezoning is consistent with the goals, objectives, policies, and programs of the General Plan and is necessary and desirable to implement the provisions of the General Plan.

Evidence: The proposed prezoning of the project site has a map code designation of Industrial within the City of Delano General Plan. The existing development and proposed use of an office, warehouse, storage yard and distribution facility are consistent with the goals, objectives, policies and programs of the map code designation of Industrial within the City of Delano’s General Plan.

2. Finding: The proposed Prezoning will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern.

Evidence: The proposed prezoning will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern as the project site will not only blend in with the surrounding uses but share the same map code designation and zoning with the parcels directly north of the project site. In addition, the project site will serve the vicinity with an Industrial use.

3. Finding: The proposed Prezoning is consistent with the purpose and intent of the remainder of this Title not under consideration.

Evidence: The proposed prezoning is consistent with the purpose and intent of both the map code designation Industrial and the Industrial district.
4 4. Finding: The potential environmental impacts of the proposed prezoning are insignificant, have been mitigated, or there are overriding considerations that outweigh the potential impacts.

Evidence: The project is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15183 of the CEQA Guidelines (14 Cal. Code Regs. § 15183) which provides that projects that are consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified shall not require additional environmental review, except as might be necessary to examine whether there are project specific significant effects which are peculiar to the project or its site. The subject property is in the City of Delano’s sphere of influence and has been assigned the Industrial (I) land use designation in the City of Delano General Plan since 2005. Hearing Notice Packet

CITY OF DELANO PLANNING COMMISSION

PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Delano will hold a public hearing on Wednesday, August 13, 2025, at 5:30 p.m. or as soon as possible thereafter, in the City Council Chambers located at 1015 Eleventh Avenue, Delano CA to consider the following actions pertaining to approximately nine acres of property located between Garzoli Avenue and State Route 99 at Schuster Road, comprised of Assessor Parcel Numbers: 521-040-37 and 521- 120-09 (together, the “Subject Property”):

Pre-Zoning Application No. 25-0001. A request to (i) pre-zone an approximately one-acre parcel (APN 521-040-37) from the Kern County Highway Commercial (CH) zoning district to the City of Delano Industrial (I) zoning district, and (ii) pre-zone an approximately eight-acre parcel (APN 521-120-09) from the Kern County Exclusive Agriculture (A) zoning district to the City of Delano Industrial (I) zoning district. The Planning Commission will consider whether to recommend that the City Council pre-zone the Subject Property as requested by the applicant.

Environmental Review: The project is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15183 of the CEQA Guidelines (14 Cal.

Please note that if you challenge the above matter in court, you may be limited to raising only those issues which you or someone else raised at the public hearing described in this notice or in written correspondence delivered to the secretary of the Planning Commission at or prior to the public hearing. All comments must be received by the secretary of the Planning Commission on or before 5:30 p.m. on August 13, 2025. All persons are invited to attend and will be given an opportunity to be heard.
