Chapter 14.31 EXPEDITED AND STREAMLINED PERMITTING PROCESS FOR

ELECTRICAL VEHICLE CHARGING STATIONS

14.31.010 - Purpose.

This chapter implements Government Code Section 65850.7 for the purpose of promoting and encouraging the use of electric vehicles by creating an expedited, streamlined permitting process for electric vehicle charging stations while promoting public health and safety and preventing specific adverse impacts in the installation and use of such charging stations.

14.31.020 - Definitions.

A. “A feasible method to satisfactorily mitigate or avoid the specific, adverse impact” includes, but is not limited to, any cost-effective method, condition, or mitigation imposed by a city, county, or city and county on another similarly situated application in a prior successful application for a permit.

B. "Electric vehicle charging station" or "charging station" means any level of electric vehicle supply equipment station that is designed and built in compliance with Article 625 of the California Electrical Code, as it reads on the effective date of this Chapter, and delivers electricity from a source outside of an electric vehicle into a plug-in electric vehicle.

C. "Specific adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete.

D. "Electronic submittal" means the utilization of one or more of the following:

1. Electronic mail or email.

2. The internet.

14.31.030 - Expedited permitting process.

The Building Official, or designee, will adopt a checklist of all requirements with which electric vehicle charging stations shall comply with in order to be eligible for expedited review. The expedited, streamlined permitting process and checklist may refer to the recommendations contained in the most current version of the "Plug-In Electric Vehicle Infrastructure Permitting Checklist" of the Zero-Emission Vehicles in California: Community Readiness Guidebook as published by the Governor's Office of Planning and Research.

14.31.040 - Permit application processing.

A. The City’s adopted checklist and any other application documents required for the submission of an Electric Vehicle Charging Station Permit will be made available on the City's website and at City Hall.

B. Applicants may submit the required permit application and documents by electronic submittal. An applicant’s electronic signature will be accepted on all forms, applications, and other documentation in lieu of a wet signature.

C. Prior to submitting an application for processing, the applicant must verify that the installation of an electric vehicle charging station will not have specific, adverse impact on the public health and safety or building occupants. Verification by the applicant includes, but is not limited to: electrical system capacity and loads;

Page 2 of 3 ends

electrical system wiring, bonding and overcurrent protection; building infrastructure affected by charging station equipment and associated conduits; areas of charging station equipment, and vehicle parking.

D. If the Building Official deems the application incomplete, a written correction notice detailing all deficiencies in the application and any additional information or documentation required to be eligible for expedited permit issuance will be sent to the applicant within ten days after submission of the application.

14.31.050 - Permit review; Appeals.

A. It is the intent of this Chapter to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations so long as the action does not supersede the Building Official's authority to address higher priority life-safety situations.

B. Review of an Electric Vehicle Charging Station Permit application is limited to whether the application meets local, state, and federal health and safety requirements, and whether the charging station poses any specific, adverse impact on public health or safety. If the application meets the requirements of the approved checklist and standards, and the proposed charging station does not pose any specific, adverse impact upon public health or safety, the Building Official must approve the application and issue any required, nondiscretionary permits.

C. If the Building Official makes a finding based on substantial evidence that the electric vehicle charging station could have a specific adverse impact upon the public health or safety, as defined in this Chapter, the city may require the applicant to apply for a use permit.

D. An application for an Electric Vehicle Charging Station Permit may only be denied if the Building Official finds that (i) the proposed installation would have a specific, adverse impact upon the public health or safety, and (ii) there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact. These findings must be made in writing, must include the basis for the rejection of potential feasible alternatives of preventing the adverse impact, and must be based upon substantial evidence in the record.

E. The Building Official may not condition the approval for any Electric Vehicle Charging Station Permit on the approval of such a system by an association, as that term is defined by Civil Code Section 4080.

F. The decision of the Building Official may be appealed to the Planning Commission. The appeal must be made on a form made available by the city. Appeals must be filed with the Building Official within ten calendar days following the date of the Building Official’s decision. If the last day to file falls on a city-recognized holiday or on a Saturday or Sunday, the following business day shall be deemed the last day to act.

14.31.060 - Electric vehicle charging station installation requirements.

A. Electric vehicle charging station equipment must meet the requirements of the California Electrical Code, the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing laboratories such as Underwriters Laboratories, and rules of Southern California Edison Company.

B. Installation of electric vehicle charging stations and associated wiring, bonding, disconnecting means and overcurrent protective devices must meet the requirements of Article 625 and all applicable provisions of the California Electrical Code.

C. Installation of electric vehicle charging stations must be incorporated into the load calculations of all new or existing electrical services and shall meet the requirements of the California Electrical Code. Electric vehicle charging equipment must be considered a continuous load.

D. Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations must meet the requirements of the California Building or Residential Code as applicable per occupancy, and the provisions of the manufacturer's installation instructions. Mounting of charging stations may not adversely affect building elements.

Page 3 of 3 ends

14.31.070 - Electric vehicle charging station permit application fee.

The applicant must pay to the City an application fee for an electric vehicle charging station permit, the amount of which will be fixed and established by the City Council from time to time by resolution.

CITY OF DELANO

STAFF REPORT
April 20, 2026
Agenda Item: 16
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Brandon Rodriguez, PE, City Engineer
SUBJECT: A Resolution authorizing Acceptance of Interests in or Easements Upon Real Property by the City Manager on behalf of City Council and Introduction of an Ordinance to authorize the City
Manager to Grant Certain Easements

RECOMMENDATIONS

1. Adopt a Resolution delegating authority to accept grants of interests in or easements upon real property to the City Manager or authorized designee.

2. Waive the first reading, read by title only, and introduce an ordinance amending the Delano Municipal Code to authorize the City Manager to grant certain easements in real property on behalf of the City;

3. Direct staff to schedule the second reading of the ordinance at the next City Council meeting; and/or

4. Alternatively, discuss and take other action related to this item.

BACKGROUND/DISCUSSION
Authority to Accept Interests in or Easements Upon Real Property Public improvements, such as road widening and utility installations, at times, require easements from private landowners to ensure orderly development. Currently, all easements dedicated to the City are presented to the City Council for formal acceptance.

The formal easement acceptance process can be time-consuming and may delay projects while also using valuable staff time for staff report preparation.

State law provides that a governmental agency may authorize one or more of its officers or agents to accept and consent to deeds or grants conveying an interest in or easement upon real property for public purposes (Gov. Code §27281(b)). Delegation speeds development and streamlines the easement acceptance process. The attached Resolution would delegate the City Council’s authority to accept interests in or easements upon real property to the City Manager or their designee.

Authority to Grant Easements
Currently, all proposed agreements for the granting of easements in real property are presented to the City Council for approval. Similar to the formal acceptance process of easements, the approval process for granting easements required for public improvements takes time and may delay projects from obtaining permits and certificates of occupancy.

The attached Ordinance amends the City Manager’s powers under Section 2.12.050 to authorize the City Manager to enter into and execute agreements for granting certain easements on behalf of the City without approval from the City Council. Such easements must be (1) necessary to a previously approved project by the City Council and (2) no more than [five hundred square feet or five hundred linear feet that is no more than ten feet wide]. Easements that do not satisfy these conditions must be approved by the City Council.

ENVIRONMENTAL (CEQA) REVIEW
The adoption of the proposed ordinance and resolution are exempt from review under the California Environmental Quality Act (Pub. Resources Code, § 21000 et seq., “CEQA”) and CEQA Guidelines (14 Cal. Code of Regs., § 15000 et seq., “CEQA Guidelines”) because adoption of the ordinance and resolution is not a project pursuant to State CEQA Guidelines section 15378(b)(5) as an organizational and administrative activity of government and pursuant to State CEQA Guidelines sections 15060(c)(2) and 15061(b)(3) because it will not result in a direct or reasonably foreseeable physical change in the environment.

FISCAL IMPACT
There is no fiscal impact with this item.

CITY OF DELANO

STAFF REPORT
April 20, 2026
Agenda Item: 17
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Ricardo G. Chavez, City Clerk
SUBJECT: Discussion and direction regarding City properties, monuments and streets named or depicted after Cesar E. Chavez
Recommendation
Staff recommends the following in respect to the four actionable items:

1. Rename Cesar Chavez Park to Ellington Park - According to records, the property previously had a park and was referred to as Ellington Street Park prior to the City of Delano’s ownership of the property.

Recommended Action: Rescind City Council’s June 7, 1993 action to renaming Ellington Park to Cesar Chavez Park.

2. Rename Cesar Chavez Lane to Chavez Lane: The recommendation would be to change it to “Chavez Lane.” The reasoning would be to minimize disruption for the residents that live on the street.

Recommended Action: Authorize staff to proceed in the process of renaming the street to “Chavez Lane.”

3. Ellington Community Center Mural: The mural at the Ellington Community Center was part of a 2009 communitywide project with KaBoom Playground Community Partner where the City of Delano worked on a community-built playground project. The mural was simply a projection on the wall and various residents contributed to the mural.

Recommended Action: Direct staff to paint over the mural and look for grant opportunities for replacing the mural with a new grant funded arts project.

4. Downtown Breezeway Mural (Main Street): The mural at the Delano Downton Breezeway project is a commissioned artwork painted by Carlo L. De Guzman. Due to various reasons, in modifying a piece of artwork, there are issues that prohibit anyone else other than the artist themselves from making such modifications on their artwork.

Recommended Action: Direct staff to reach out to the artist Carlo L. De Guzman and request him to modify the artwork at his discretion, while removing Cesar Chavez.

Background
The City of Delano’s Naming of Municipal Facilities Policy objective is to define the City's method for naming City parks and municipal facilities pursuant to Resolution No. 2005-100. The creation of a Policy/ Procedure to guide the naming of City parks and facilities is intended to enable the process to be applied in an equitable and consistent manner.

The naming of the street Cesar Chavez Lane was submitted with Tract Map No. 5793 when it was approved by the City Council on December 5, 1994.

The City of Delano acquired Ellington Park property in 1961 from Delano Union School District.

The mural at the Ellington Community Center was playground project in 2009.

The mural down Main Street was subject to a grant in which the City of Delano collaborated with Kern Council of Arts for the Delano Downtown Breezeway project and commissioned the project to Carlo L. De Guzman.

Discussion
At the April 6, 2026 Council Meeting, Council Member Osorio requested this matter be placed on the next upcoming council meeting agenda to explore whether there is support here on the council for launching a public process to rename our local Cesar Chavez Park with community input.

Fiscal Impact
The fiscal impact is undetermined costs will be assessed as the project scope is defined. Staff will return with cost estimate cased on the direction provided by Council.
