WHEREAS, on May 25, 2022, the City Council held a duly noticed public hearing to consider whether to revoke County Resolution No. 97-276 designating JCSD as a public agency able to receive land dedications and fees for park and recreational facilities pursuant to Section 130.20.020 of the Eastvale Municipal Code.
2689

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EASTVALE DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:

SECTION 1. Findings. The City Council makes the following findings based upon the evidence presented at the public hearing on May 25, 2022, including but not limited to the staff report and all written and oral and testimony:

A. The foregoing recital are true and correct and incorporated herein as findings.

B. The adoption of this resolution is not a project subject to review under the California Environmental Quality Act (CEQA) because “project” is defined to exclude organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. The revocation of Resolution No. 97-276 does not change the dedication and fee requirements applicable to projects subject to Section 130.20.020 of the Eastvale Municipal Code. The revocation of Resolution No. 97-276 solely impacts JCSD’s ability to receive said dedications and fees.

C. JCSD has not complied and is not complying with the requirements of Section 130.20.020 of the Eastvale Municipal Code applicable to it as a public agency designated able to receive land dedications and fees pursuant thereto in that: (i) JCSD adopted a new community parks and recreation plan (Master Plan) in 2012 and amended the Master Plan in 2019 but neither the adoption or amendment of the Master Plan was submitted to the City Council for review and approval as required by paragraph (g)(3)-(4) of Section 130.20.020; (ii) JCSD has not held annual public hearings before its governing board to consider the need for amendments to the Master Plan as required by paragraph (g)(4) of Section 130.20.020; (iii) JCSD has not submitted annual reports to the City pursuant to paragraph (j) of Section 130.20.020.

SECTION 2. Revocation of County Resolution No. 97-276. The City Council hereby revokes and supersedes Resolution No. 97-276 of the Riverside County Board of Supervisors.

County Resolution No. 97-276 shall be of no further force and effect within the City of Eastvale.

SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Resolution is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have adopted this Resolution and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared unconstitutional.

SECTION 6. Effective Date. This Resolution shall become effective immediately upon adoption.

PASSED, APPROVED AND ADOPTED this 25th day of May, 2022. 2690

CITY COUNCIL BUSINESS
Agenda Item No. 13.1
May 25, 2022
City Branding and Landscaping Along Interstate 15 Corridor Prepared By:

Jimmy Chung, City Engineer
Recommended Action(s)
Staff recommends that the Council approve the proposed phasing of branding and landscaping along the Interstate 15 corridor.

Summary
During the August 25, 2021 City Council Mee%ng, Council directed staff to inves%gate the design and implementa%on cost es%mates to improve landscaping and branding along the Interstate 15 corridor.

Staff inves%gated several design and beau%fica%on concepts, phasing concepts, localized and focused improvement locations, and branding options.

Any work along the freeway will require a permit from California Department of Transporta%on (CalTrans) and improvements will require a maintenance agreement with CalTrans. The maintenance agreement dura%on depends on the level of improvement, meaning basic improvements require maintenance of such improvements by the City for 2 years. While more elaborate level of improvements will require a maintenance agreement in excess of 12 years.

Based on discussions with and direc%on from Real Property Ad Hoc Commi4ee, staff proposes spli5ng the beau%fica%on project into four (4 )phases. The following is a list of the improvements proposed and required maintenance agreement duration for each phase:

Phase 1 - Trees planted from Silverlakes to Bellegrave at mixed density and spacing (average 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752
951.361.0900 | eastvaleca.gov
2693
spacing of approximately 35 feet) plus mulch and irriga%on. Maintenance agreement dura%on is maximum 3 years.

Phase 2 - Trees planted from Bellegrave to 60/15 interchange (Riverside Drive overpass).

Maintenance agreement duration is maximum 3 years.

Phase 3 - Branding monument at 60/15 interchange southbound I15 slope. Maintenance agreement duration needs to be negotiated with CalTrans.

Phase 4 - Ground cover bushes and shrubs at Cantu Galleano I15 on/off ramp. Maintenance agreement duration is 2 years.

To implement the phasing plan, future contracts with vendors and contractors, and any required amendment to the CalTrans Maintenance Agreement will be brought to the City Council for approval.

Background
On October 25, 2017, the City of Eastvale and the State of California entered into a Maintenance Agreement (A4achment 1 - 2017 Freeway Maintenance Agreement) for maintenance responsibilities on and near the freeway, overpass, and interchanges.

The Limonite Interchange construc%on is essen%ally complete and the project is nearing close out.

The City has taken over the maintenance responsibili%es effec%ve September 2021 for landscaping and watering of the interchange landscape improvement area. City Maintenance responsibili%es are generally near the overpasses and near the interchanges but not within the the Interstate 15 freeway corridor within the freeway right of way along the private/state property line.

During the January 8, 2020 Strategic Workshop, two of Council's Ac%on/Schedule as part of Priority #2, Target #2, Goal #4, was to "Develop branding and iden%ty for Eastvale"; and Target #6, Goal #6, was to "Create appealing signage/landscaping at entry/exit points in the City to welcome residents and guests to Eastvale". On July 13, 2021, we received an amendment to the Maintenance Agreement request from the Riverside County Transporta%on and Land Management Agency (RCTLMA) with an expanded scope for maintenance. Although the City is not obligated to agree to an expanded scope it provided a segue to start the dialogue with California Department of Transporta%on (CalTrans) to improve landscaping along the Interstate 15 corridor from the 15 freeway and the 60 freeway interchange to the southern city limit near Silverlakes Sports Park.

CalTrans was open to the idea and provided steps and requirements to proceed with the review and approval of the landscape plans by CalTrans and the maintenance terms (A4achment 2 - Maintenance Terms).

Environmental
The proposed inves%ga%on is not a project as defined by the California environmental Quality Act (CEQA) and as such, no environmental review is required.
