Approval of Agreement with Outdoor Dimensions, LLC for Civic Center Signs
Prepared By:
Marc A. Donohue, Government Services Director/City Clerk Recommended Action(s)
It's recommended that the City Council:
1 .
Approve an Agreement for Minor Construc#on Services with Outdoor Dimensions, LLC for Civic Center Signs for an amount not to exceed $35,874.50; and 2 .
Determine compliance with the formal bidding process is not in the best interest of the City and authorize City staff to utilize the informal competitive bidding process for this purchase.
Summary
The city will u#lize high resolu#on drawings of the future Civic Center campus on two 16 by 10 signs that will sit on the corner of Limonite Ave and the future Bootsma Blvd and Hamner Ave and the future Premier Place. The size of the signs will be the same dimensions as the exis#ng New Home sign on the corner of Limonite Ave and Hamner Ave.
These proposed signs will provide a valuable marke#ng tool and transparency to the community on what is to come on the future Civic Center site.
Background
On February 7, 2025, the grant deed transferring the future Civic Center site (referred to herein as lots 5 and J) to the City was recorded by the County of Riverside. Now that the city officially owns the land on which the future Civic Center will be located, we can now promote what's to come to 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

the Eastvale community.
General contractors typically subcontract project adver#sement signs at the site of development projects. However, the city is installing the signs before the bids close and construc#on commences on the Civic Center project and the city does not currently have a general contractor on board. Due to #me constraints the formal bidding process was not u#lized. Procurement staff contacted several vendors, but were unable to obtain mul#ple quotes. The only responding vendor was Outdoor Dimensions. This vendor recently installed signs near lots 5 and J for a private developer. Should the City Council not approve the exemp#on to the formal bidding process, staff would need to complete an invita#on for bid document, adver#se the bid in a public newspaper, open the bid, and award a contract. This process would likely take eight to ten weeks to award a bid, with construc#on star#ng some#me aEer the award. Staff does not believe the price would significantly change with a formal bidding process.
Environmental
The installa#on of the two temporary signs is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines 15303 (New Construc#on of Small Structures) and 15311 (Accessory Structures).

4935-1047-8619 v1
10 9.3 Liquidated Damages . The Parties agree that City has a legitimate interest in ensuring that Contractor provides the Services (including performance of all duties and responsibilities) required under this Agreement in a consistent and reliable manner, and that Contractor’s failure to timely provide such Services or to provide them in an inadequate manner will cause City to suffer damages and that it is, and will be, impractical and extremely difficult to ascertain and determine the exact amount of damages or to calculate actual damages. Therefore, in addition to City’s right to treat such non -performance as a material breach of, and to terminate, this Agreement, the Parties agree that liquidated damages, as provided herein, repr esent a reasonable estimate of the monetary damages that reasonably could be anticipated and that proof of actual damages would be costly or impractical. The Parties sp ecifically confirm the accuracy of the statements made above and the fact that each Party has had ample opportunity to consult with legal counsel and obtain an explanation of the liquidated damage provisions at the time that the Agreement was made. Therefore, in lieu of actual damages, Contractor is subject to payment of $500 per failure to perform, per day. City may, at its election, deduct any assessed liquidated damages from payment due, or that will become due, to Contractor from City.
9.4 Excusable Delays. Contractor shall not be liable for damages, including liquidated damages, if any, caused by delay in performance of failure to perform due to causes beyond the control of Contractor. Such causes include, but are not limited to, acts of God, acts of the public enemy, acts of federal, state or local governments, acts of City, court orders, fires, floods, epidemics, strikes, embargoes, and unusually severe weather. The term and price of this Agreement shall be equitably adjusted for any delays due to such causes.
9.5 Cooperation; Further Acts. The Parties shall fully cooperate with one another, and shall take any additional acts or sign any additional documents as may be necessary, appropriate or convenient to attain the purposes of the Agreement.
9.6 Governing Law. This Agreement shall be interpreted, construed and governed according to the laws of the State of California. In the event of litigation between the parties, venue in state trial courts shall lie exclusively in the County of Riverside. In the event of litigation in a U.S. District Court, venue shall lie exclusively in the Eastern Division of the Central District of California, located in Riverside, California.
9.7 Integration. This Agreement, including the attached Exhibits “A” through “F” and other Contract Documents , is the entire, complete, final and exclusive expression of the parties with respect to the matters addressed therein and supersedes all other agreements or understandings, whether oral or written, or entered into between Contractor and City prior to the execution of this Agreement. No statements, representations or other agreements, whether oral or written, made by any party which are not embodied herein shall be valid and binding.
9.8 Severability. If a term, condition or covenant of this Agreement is declared or determined by any court of competent jurisdiction to be invalid, void or 694
4935-1047-8619 v1
11 unenforceable, the remaining provisions of this Agreement shall not be affected thereby and the Agreement shall be read and construed without the invalid, void or unenforceable provision(s).
9.9 Prohibited Interests. Contractor represents and warrants that it has not employed nor retained any company or person, other than a bona fide employee working solely for Contractor, to solicit or secure this Agreement. Further, Contractor warrants that it has not paid nor has it agreed to pay any company or person, other than a bona fide employee working solely for Contractor, any fee, commission, percentage, brokerage fee, gift or other consideration contingent upon or resulting from the award or making of this Agreement.
9.10 Amendments. No amendment to or modification of this Agreement shall be valid unless made in writing and approved by Contractor and City. The City Manager shall have the authority to approve any amendment to this Agreement if the total compensation under this Agreement, as amended, would not exceed the City Manager’s contracting authority under the Eastvale Municipal Code. All other amendments shall be approved by the City Council. The Parties agree that the requirement for amendments or modifications to be in writing cannot be waived and that any attempted waiver shall be void.
9.11 No Third Party Beneficiaries . There are no intended third party beneficiaries of any right or obligation assumed by the Parties.
9.12 Delivery of Notices. All notices required or permitted to be given under this Agreement shall be in writing and shall be given to the respective parties at the email addresses or physical addresses listed in Exhibit “D”, or at such other address as the respective parties may provide in writing for this purpose. Such notice shall be deemed made when emailed or personally delivered or forty-eight (48) hours after deposit in the U.S. Mail, first class postage prepaid and addressed to the party at its applicable address. Actual notice shall be deemed adequate notice on the date actual notice occurred, regardless of the method of service.
9.13 Binding Effect . This Agreement shall be binding upon the heirs, executors, administrators, successors and assigns of the Parties.
9.14 Waiver. Waiver by any Party to this Agreement of any term, condition, or covenant of this Agreement shall not constitute a waiver of any other term, condition, or covenant. Waiver by any Party or any breach of the provisions of this Agreement shall not constitute a waiver of any other provision, nor a waiver of any subsequent breach or violation of any provision of this Agreement. Acceptance by City of any Services by Contractor shall not constitute a waiver of any of the provisions of this Agreement.
9.15 Attorney’s Fees, Costs and Expenses . In the event litigation or other proceeding is required to enforce or interpret any provision of this Agreement, the prevailing party in such litigation or other proceeding shall be entitled to an award of 695
4935-1047-8619 v1
12 reasonable attorney’s fees and Costs and Expenses, in addition to any other relief to which it may be entitled.
9.16 Subcontracting. Contractor shall not subcontract any portion of the Services, except as expressly stated herein, without prior written approval of City.
Subcontracts, if any, shall contain a provision making them subject to all provisions of this Agreement.
9.17 Counterparts. This Agreement may be signed in counterparts, each of which shall constitute an original.
9.18 Authority to Execute. The person or persons executing this Agreement on behalf of Contractor represents and warrants that he/she/they has/have the authority to so execute this Agreement and to bind Contractor to the performance of its obligations hereunder.
9.19 Administration and Implementation. This Agreement shall be administered and executed by the City Manager or his or her designated representative.
The City Manager shall have the authority to issue interpretations and to make amendments to this Agreement, including amendments that commit additional funds, consistent with the City Manager’s contracting authority under the Eastvale Municipal Code.
IN WITNESS WHEREOF , the parties hereto have caused this Agreement to be executed the day and year first above written.

Workshop on Land Use Types: Drive-Throughs, Car Washes, Fueling Sta7on, Storage Facili7es, and Truck/Trailer Rental and Storage
Prepared By:
Allen Lim, Senior Planner
Recommended Action(s)
Staff recommends that the City Council r
eceive a presentaon and provide staff with direcon on
potential future regulation of specific land use types.
Summary
In response to increasing developer interest in construcng new mini-storage facilies and auto- oriented uses such as car washes, drive-through food and drink establishments, gasoline service staons, alternave fueling staons, and truck and trailer sales, rental, and storage, the workshop aims to facilitate a discussion and receive input from the City Council to inform and guide a potenal amendment to Title 120 (Planning and Zoning) of the Eastvale Municipal Code. These potenal amendments will provide greater clarity to staff and the development community for future development throughout the City.
Background
Over the last several years as the City has connued to be built out, the Planning Commission and City Council have expressed the importance of carefully considering the highest and best use for the limited remaining vacant land within the City. Concurrently, there has been a growing number of requests to establish and operate mini-storage facilies and auto-oriented uses such as car washes, drive-through food and drink establishments, gasoline service staons, alternave fueling staons, 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

and truck and trailer sales, rental, and storage throughout the City. Due to the growing interest in these uses, staff is iniang a discussion to obtain feedback on how these land use types should be regulated.
On January 18 2023, staff brought forward a land use discussion to the Planning Commission to gain further direcon on how to proceed with drive-through businesses. The Commission recommended that staff further pursue an approach to modify condional use permit findings to ensure land use compability with exisng shopping centers and/or their surrounding area of the proposed drive- through.
On September 18, 2024, staff brought forward a land use discussion to the Planning Commission to gain further direcon on how to proceed with drive-throughs, carwashes, gasoline staons, alternave fueling staons, mini-storage facilies, and truck and trailer rental and storage facilies.
The Commission advised staff to conduct a more in-depth analysis, taking into account the available vacant developable land within the City, the suitability of the proposed land uses within current zoning designaons, and the potenal for implemenng alternave regulaons through enhanced design and development standards.
On October 16, 2024, staff brought forward a land use discussion to the Planning Commission with updated informaon, exhibits, and various redline changes to the Zoning Code based on the input received by the Planning Commission from the September 18, 2024 discussion. The Commission was generally supporve of the changes and provided further direcon to update the code based on the examples presented.
As an implementation item of the recently adopted Eastvale 2040 General Plan
, staff is working on a
comprehensive Zoning Code update for consideraon by the Planning Commission.
Input received
from the workshop will be used to inform the Zoning Code update. If warranted, staff may bring a focused Zoning Code Amendment to address the more crical uses prior to the comprehensive update.
Staff has included details on the number of exisng locaons of each use within the City to aid in the discussion.

, Drive-in or drive-through operaons or facilies (any use) are condionally permi=ed within the C-1/C-P (General Commercial), C-P-S (Scenic Highway Commercial), and I-P (Industrial Park) Zones. As a result of drive-in and drive-through uses being condionally permi=ed, staff has historically processed a Condional Use Permit along with a Development Review applicaon for each proposed project. To ensure a drive through will not operate in a manner that would be detrimental to the health, safety, peace, morals, comfort, or general welfare of the City, staff evaluates the ancipated vehicle queueing at peak demand hours, driveway lengths, screening, as well as the locaon of menu boards related to vehicle stacking and the surrounding uses.
To determine the exisng condions, staff examined the supply of exisng and/or approved drive- throughs within the City of Eastvale and included the findings in Attachment 1 and 2
. In summary, at
the me of preparing this report, there are a total of forty-four (44) drive-through facilies throughout the City. Of the forty-four (44) drive-through facilies, a total of thirty-three (33) are operaonal, seven (7) are approved by the Planning Commission or City Council but not yet constructed, and four (4) are acvely under construcon. Analysis - Alternative Fueling Stations
As for alternave fueling staons such as electric truck charging staons and hydrogen fuel staons, the Eastvale Zoning Code does not specify these uses within Table 3.3-1 Use Matrix for Commercial,
Business Park, Industrial, and Special Purpose Zones
. Although there has been an increased interest
in alternave fueling staons, there are currently no reportable locaons within the City, with the exception of electric vehicle charging parking spaces within shopping centers throughout the City.
Analysis - Truck and Trailer Sales, Rental and Storage
Pursuant to
Table 3.3-1 Use Matrix for Commercial, Business Park, Industrial, and Special Purpose Zones of the Eastvale Zoning Code
, Truck and Trailer Sales and Rental, are permi=ed by right within the M-SC (Manufacturing – Service Commercial), M-M (Manufacturing – Medium), and M-H (Manufacturing -Heavy) Zones and prohibited in all remaining zones.
Further
Table 3.3-1 Use Matrix for Commercial, Business Park, Industrial, and Special Purpose Zones of the Eastvale Zoning Code
, as currently adopted, does not specifically idenfy truck storage as a permi=ed or condionally permi=ed use. Pursuant to
Table 3.3-1
, a similar use that may be
considered truck storage, for the purpose of an interpretaon, although unclear, would be a contractor storage yard
which is permi=ed by right in the M-SC (Manufacturing – Service Commercial), M-M (Manufacturing – Medium), and M-H (Manufacturing Heavy) Zones and prohibited in all remaining zones. Although there has been an increased interest in truck and trailer sales, rental, and storage, there are currently no reportable standalone locations within the City.
Location Discussion
Currently, there are thirteen (13) designated commercial centers throughout the City.
Attachment 5
idenfies the exisng shopping centers within the City and their associated acreage, type, and intended walkability. Of the thirteen commercial centers, there are five large shopping centers, five neighborhood centers, and two local centers in addion to the proposed downtown lifestyle center.
Three of the centers are intended to be pedestrian-oriented centers that offer a variety of retail and dining opons and feature enhanced landscaping, a=racve walkways, and other outdoor amenies. These centers include Hamner Place, The Merge, and the future Downtown area. As part of the consideraon of the above described uses, the City Council may consider the appropriateness of some of the uses in the City's commercial centers, and in parcular the appropriateness of auto- related uses within the centers designed with a pedestrian focus. 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

Planning Commission Feedback
On September 18, 2024 the Planning Commission provided the following comments with regard to each of the uses:
Carwashes:
Limit new carwashes to industrial and manufacturing zones.
Look at existing specific plans to determine appropriateness.
Drive-throughs
:
Maintain development standards and permitted locations with a CUP.
Explore distance/separation requirements for discussion.
Identify locations of existing drive-throughs and illustrate possible distance radius scenarios.
Explore enhanced design and development standards/requirements for new drive-throughs.
Mini-Storage Facilities:
Limit new mini-storage facilities to industrial and manufacturing zones.
Share results of market analysis prepared for The Ranch area.
Gasoline Service Stations:
Explore prohibing new gasoline service staons in commercial zones and limit to industrial and manufacturing zones.
There is a decreasing need in gasoline service staons with the growth of electric vehicle ownership and mandates.
Alternative Fuel Stations/EV Charging Stations
:
Disnguish between light duty vehicle charging and heavy duty (truck) charging facilies and regulate differently in the code.
Require a CUP for new alternative fuel and EV charging stations.
Consider and address safety concerns due to the extended me necessary for electric vehicle charging.
Truck and Trailer Rental and Storage:
Limit new truck and trailer rental and storage facilities to industrial and manufacturing zones.
Require a CUP for new facilities.
Consider and address safety concerns due to the long-term parking and lack of people at facilities.
On October 16, 2024 the Planning Commission provided the following addional comments with regard to each of the uses:
Drive-throughs: 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |
eastvaleca.gov
714
Connue exploring other agencies’ development standards for drive-through screening, outdoor dining, and pedestrian circulation.
Alternative Fuel Stations/EV Charging Stations:
Create new land uses which disnguishes light duty, medium duty, and heavy-duty electric vehicle charging facilities as consistent with state requirements.
Light duty charging facilies shall be permi=ed in every zone or as required by state requirements.
Have staff explore the feasibility of requiring DC fast charging for light duty vehicles in non- residential zones.
Consider the requirement of allowing Level 2 charging and DC Fast charging for light duty facilities in park space and public facilities.
In general, the Planning Commission provided guidance to begin the process of amending the Zoning Code with regard to all of the uses discussed. Although the Commission expressed support for connuing to allow all of the uses and connuing to require condional use permits, there was a general consensus to limit new carwashes, mini-storage facilies, truck and trailer rental/storage facilies, and possibly gasoline service staons to be located strictly within industrial and manufacturing zones. The Commission was generally supporve of connuing to allow drive- throughs in the commercial, industrial, and manufacturing zones and also suggested adding electric vehicle charging staons for light duty passenger vehicles within the commercial and industrial zones.
A@achment 9
includes the General Plan Land Use map and
A@achment 10
includes the
Zoning map as reference to aid in idenfying where these zones are. Staff will also be reviewing some of the specific plans to idenfy what changes may need to be made for these uses.
Attachment 11
illustrates the location of the specific plans throughout the City.
The Commission also recognized the limited availability of vacant, developable land and expressed a desire to gain a be=er understanding of market demand to support the highest and best use for remaining developable parcels.
Attachment 8
includes an inventory of the remaining vacant lands as
of the publishing of this report.
There was a general concern about the proliferaon and overconcentraon of vehicle-oriented businesses such as carwashes, drive-throughs, and gasoline service staons. One strategy discussed to address over-concentraon of specific uses is to include a minimum separaon requirement for like uses within the code. As such, staff has prepared
A@achments 6 and 7
which illustrate potenal
separaon distances from exisng drive-throughs and gasoline service staons, respecMully. The maps illustrate 1/4 mile, 1/2 mile, 3/4 mile and 1 mile radiuses from the exisng facilies to aid in visualizing possible scenarios, should the Commission wish to recommend a minimum separaon requirement for future carwashes and gasoline service stations.
In addion to locaon-related standards, the Commission was recepve to exploring enhanced design standards to address aesthec concerns with vehicle-oriented businesses, parcularly drive- throughs. Staff is currently exploring best pracces from other jurisdicons to idenfy possible enhancements to the development standards for these types of uses which may include, but are not
limited to, site orientation, landscaped berms, structural screening, and dense landscape screening.
Finally, the Commission emphasized the importance of addressing safety and security for uses such as long-term electric vehicle charging and truck and trailer rental/storage uses. Staff will work 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

closely with the Riverside County Sheriff's Office to develop strategies to address safety and security within the development standards for these uses.

Review Public Safety Commission Meeting Schedule for 2025 Prepared By:
Johnny Terfehr, Director of Community Safety
Recommended Action(s)
Staff recommends that the Public Safety Commission review and discuss the mee ng schedule for
2025, poten

Summary
The Eastvale Municipal code requires the Public Safety Commission to meet at least once, but not more than three

Some of those items include fire safety informa

outreach and resources informa
on, 4th of July fireworks safety informa
on, holiday safety
information, department updates, traffic safety information, bicycle safety information, and more.
Business items also come before the Public Safety Commission for review and recommenda on. For
the years 2023 and 2024, these items included Flock Safety cameras, implementa on of a 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

on of
increased hours and/or staffing for public safety, and discussion of possibly procuring a ladder truck for the City.
Due to the low number of business items before the commission from 2022 to present, staff is asking the commission to evaluate if monthly mee
ngs are s
ll appropriate. If the commission
chooses to schedule quarterly mee
ngs, and if business items were to increase substan
ally, the
commission would retain the op
on to reconvene monthly mee
ngs on an as needed basis. If an
urgent issue arose, the Public Safety Commission can also call a special or emergency mee ng with
as little as 24 hour notice.
There is a significant impact on staff

and a;end Public Safety Commission mee
ngs. If there are rou
nely no business items on the
agenda it may be a be;er use of resources to combine items into fewer mee ngs annually. This
evalua

First Amendment to City Manager Employment Agreement
Prepared By:
Erica Vega, City Attorney
Recommended Action(s)
It is recommended that the City Council approve the First Amendment to the Employment Agreement for the posi
on of City Manager and authorize the Mayor to execute the First Amendment.
Summary
The First Amendment to the Employment Agreement between the City of Eastvale and Mark Orme proposes to extend the term of City Manager Orme's employment with the City for an addi onal
three years with an op
on to extend for two more years (for a total poten
al increased term of five
years) and increases City Manager Orme's gross base salary to $305,000 per year. The First Amendment further provides that City Manager Orme will forego the next scheduled Cost of Living Adjustment (COLA) for City employees, which is set to take effect on July 1, 2025, but will be eligible for future COLAs consistent with the terms of the Employment Agreement.
Background
The City and Mark Orme entered into an Employment Agreement dated November 16, 2022, with an effec
ve date of November 28, 2022, which is when Mark Orme commenced serving as the City Manager. The Employment Agreement has a three year term and is set to automa cally expire on
November 28, 2025 unless extended by the par
es. The Employment Agreement provides that
performance-based compensa
on adjustments will be considered by the City Council "in the first half of odd-numbered years beginning in year 2025."

Fiscal Impact
The increase to the City Manager's base salary results in a fiscal impact to the City's General Fund.
The City Manager's current base salary is $258,232.52, and was set to increase to $267,270.66 on July 1, 2025 with the 3.5% COLA adjustment the City Council approved for all City employees. The First Amendment increases the City Manager's base salary to $305,000 but provides that the City Manager will not receive the 3.5% COLA adjustment other City employees will be receiving on July 1, 2025.
