The contractor, City Engineer, and Inspectors shall verify that the SJVAPCD’s control measure is implemented as outlined below or equivalent to reduce fugitive dust emissions throughout all phases of construction. These measures shall be incorporated in bid documents prior to City approval. The implementation of these measures shall be verified on an ongoing basis through construction inspections: 1. Require construction equipment used at the site to be equipped with catalysts/particulate traps to reduce particulate and NOx emissions. These catalysts/traps require the use of ultra-low sulfur diesel fuel (15 ppm). At the time bids are made, contractors shall show that the construction equipment used is equipped with particulate filters and/or catalysts or prove why it is infeasible. 2. Use alternative fuels and construction equipment. 3. Replace fossil-fueled equipment with electrically driven equivalents (provided they are not run via a portable generator set). 4. Install windbreaks on windward sides of construction areas. 5. Curtail construction during periods of high ambient pollutant concentrations. This may include ceasing construction activity during peak-hour vehicular traffic on adjacent roadways, and “Spare the Air Days” declared by the District. Resources a) Have a substantial adverse effect, either directly or through habitat modifications, on any species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Game or U.S. Fish and Wildlife Service? MM BIO-01: Pre-construction Nesting Bird Clearance Surveys. If construction occurs between February 1st and August 31st, a p Pre- construction clearance surveys for nesting and protected birds and raptors should be conducted by a qualified biologist, pursuant to CDFW protocol and as delineated below within fifteen (15) days and three (3) days in advance of the start of any vegetation removal or ground disturbing activities and mobilization for the Project. Pre-construction surveys are intended to identify active nests and other evidence of protected species so that construction can completely avoid species that are protected under the MBTA and Fish, Game Code and that applicable agency protocol can be implemented so ensure that no nesting migratory birds, protected birds or raptors will be disturbed during construction. Survey Report: The biologist conducting the clearance surveys should document a negative survey with a brief letter report for each survey indicating that no impacts to active avian nests or protected species will occur or stating whether protocol surveys are warranted. If an active avian nest is discovered during the pre-construction clearance survey, construction activities should stay outside of a No Disturbance Buffer: A no-disturbance buffer or alternative method approved by CDFW that will be established by the City’s biologist to protect any species and active nests. The size of the no-disturbance buffer will be determined by the wildlife biologist and will depend on the level of noise and/or surrounding anthropogenic disturbances, line of sight between the nest and the construction activity, type and duration of construction activity, ambient noise, species habituation, and topographical barriers. These factors will be evaluated on a case-by-case basis when developing buffers and distances. Limits of construction to avoid an active nest or species take will be established in the field with flagging, fencing, or other appropriate barriers; and construction personnel will be instructed on the sensitivity of nest areas and species If construction occurs between February 1st and August 31st Prior to start of construction or mobilization City of Escalon, Project biologist, contractor

COUNCIL AGENDA ITEM
FOR OCTOBER 21, 2024
Prepared By: Jaylen French, Interim City Manager
Date: October 14, 2024
Subject: Agenda Item Request – City Councilmembers
Recommendation:

Discuss and provide direction on the Agenda Item Request from City Councilmember Strohman and Mayor Pro Tem Hagan to identify a prioritized list of programs/equipment to be submitted to the San Joaquin County District Attorney as part of the City of Escalon application for Asset Forfeiture funds.

Background and Discussion:

On June 17, 2024, Councilmember Strohman expressed desire to apply for up to $25,000 in San Joaquin County District Attorney (SJCDA). Asset Forfeiture Funds to support programs such as the Healthy Room Project and other programs/efforts and/or equipment for the youth of Escalon. Mayor Pro Tem Hagan supported bringing an item before the council to identify the preferred use of the funds to be compiled in an application and submitted to SJCDA with the hope of receiving said funds.

On July 15, 2024, the City Council discussed the matter and requested additional information on applicable uses of the identified funds. Additional information, obtained from the San Joaquin County District Attorney’s Office and from the Health and Safety Code §11489(a)(2)(A)(i), is provided below.

Fifteen percent (15%) of the funds distributed pursuant to this subparagraph shall be deposited in a special fund maintained by the county, city, or city and county of any agency making the seizure or seeking an order for forfeiture. This fund shall be used for the sole purpose of funding programs designed to combat drug abuse and divert gang activity, and shall wherever possible involve educators, parents, community-based organizations and local businesses, and uniformed law enforcement officers. Those programs that have been evaluated as successful shall be given priority. These funds shall not be used to supplant any state or local funds that would, in the absence of this clause, otherwise be made available to the programs.

It is the intent of the Legislature to cause the development and continuation of positive intervention programs for high-risk elementary and secondary school age students. Local law

Page 427 of 440 ends

enforcement should work in partnership with state and local agencies and the private sector in administering these programs.

The actual distribution of funds set aside is to be determined by a panel consisting of the sheriff of the county, a police chief selected by the other chiefs in the county, and the district attorney and the chief probation officer of the county.

The DA’s Office further shared that within their procedures, an initial eligibility determination is made by the Chief Deputy District Attorney. Then, any request is forwarded to an established panel that consists of District Attorney Ron Freitas, Sheriff Pat Withrow, Tracy Police Sekou Millington and Chief of Probation Steven Jackson. If approved, the fiscal department within the DA’s Office will arrange payment from the County Auditor and a ceremonial check presentation with Mr. Freitas is scheduled.

On August 5, 2024, City staff presented various options for Council’s consideration (as shown below). The Council discussed the various options, some which were agreeable and some which were not. Ultimately, the Council reached consensus to survey (including the desired options from below) the students in the School District to gauge what programming they would prefer to have available.

Potential Ideas Previously Raised during Council Discussions or Provided by Staff The Healthy Room Project (https://thehealthyroomproject.org/home). The Healthy Room Project was established to address the detrimental effects of dangerous living conditions and inadequate spaces on the well-being and development of underprivileged children, especially from single-parent households, by collaborating with local police officers and others to execute a one-day initiative to revamp children’s bedrooms, providing essential furnishings such as a new bed, desk, dresser, lamp, bedding, and freshly painted walls.

Sports Equipment Assistance. Help fund the necessary sports equipment purchases for those participating in Escalon recreational sports that cannot afford the equipment.

City-Owned Chromebook Laptops. To be used for non-sport youth programs/trainings at the Community Center by an approved trainer or business. Further, the laptops could be stored at and managed by the Escalon Library, with Library approval, to be available for youth when not in use for programs/trainings.

Teen Excursions / Events. Locate a provider and fund/help fund excursions and/or events for teens.

For example, a trip to a professional sporting event, camping, or state park, etc. Or help fund events at the community center. For example, karaoke events, murder mysteries, scavenger hunts, talent shows, etc.

Non-Sport Programming. Locate a provider and fund/help fund non-sport programming.

On September 9, 2024, EUSD released a four question survey to students to gather input on the youth activities they desire most. The survey closed on September 20th. 406 survey responses were received. When asked to select two activity types:

Page 428 of 440 ends

- 70% of respondents indicated they desired to see teen excursions or events, such as trips to sporting events, state parks, karaoke or scavenger hunts. - 48% desired to see after-school activities such as clubs, recreation or educational activities. - 22% preferred non-sport activities such as STEM, art or music, and - 15% preferred technology programs such as coding or robotics.

In establishing the priority list of programming as part of the San Joaquin County District Attorney’s Asset Forfeiture Grant application, should the Council desire to follow the results of the survey, City staff recommends identifying and partnering with a youth group, like the Boys and Girls Club to implement an excursion or after-school program, as these groups are currently equipped to provide this type of programming or have existing program that can be leveraged to include more students.

The Escalon Unified School District has an established partnership with the Boys and Girls Club and therefore, City staff would work with them to provide a portion of the grant funding to carry out an excursion/event for the youth of Escalon.

City staff recommends requesting $25,000 in total funding from the San Joaquin County District Attorney’s Asset Forfeiture Grant program, and utilized in three program/activities as follows:
- $8,000 for the Healthy Room Project. This funding would provide the City an opportunity to complete four (4) room renovations per year, including all material costs and associated incidentals.
- $12,000 for youth excursion(s). This funding would be provided to the Boys and Girls Club, through their partnership with the Escalon Unified School District, or another entity to provide the youth excursion.
- $5,000 for after school activities. This funding would be provided to the Escalon Unified School District, the Boys and Girls Club, the Escalon Library or another entity to administer the after school activities.

Fiscal Impact:

There is not expected to be a negative fiscal impact to the City as part of this grant program.

ITEM NO. 9

COUNCIL AGENDA ITEM
FOR OCTOBER 21, 2024
Prepared By: Jaylen French, Interim City Manager
Date: October 14, 2024
Subject: Consider Agenda Item Request from Mayor Pro Tem Hagan and Councilmember Walker Regarding Proposed Approach for Escalon Baseball/Softball Program
Recommendation:

Consider Agenda Item Request from Mayor Pro Tem Hagan and Councilmember Walker Regarding Approach for Escalon Baseball/Softball Program.

Background and Discussion:

A new concept or approach for the Escalon recreation Baseball/Softball league has been brought forward for consideration. This concept was initially introduced at the July 10, 2024 Escalon Recreation Commission meeting. At that time, the proposers, Mayor Pro Tem Hagan and Councilmember Walker, in coordination with a proposed partner, Todd Davis, presented the concept to the Recreation Commission.

In summary, the concept:
- Proposes to join the league Stanislaus County League, as opposed to the Oakdale Baseball Softball League
o Escalon would play teams from: Hart Ransom, Modesto Christian, Hughson, Red Shield, Westport, Shilo Paradise, Eisenhut and others.
- Administration of the league (registration, scheduling, jersey ordering, etc.) would be handled through a contract with Todd Davis and an established external Board OR remain with the City of Escalon.
o The Board could be comprised of volunteer parents, recreation staff, and recreation commissioners
- Proposes to offer formal coaches clinics, a coach’s guidebook and ongoing coach support - Proposes to offer child skills clinics by Todd Davis and Escalon High School staff - Could include formal travel ball opportunities after the recreation season or remain as is - Would offer greater control over league rules
The Recreation Commission had questions regarding the proposal. Those questions, summarized, are below.

Page 430 of 440 ends

- What would be the cost of the revised approach/program? - Define the nature of Todd Davis’ role in the program? - What would the travel look like in the new league?
- What would be the make up of the Board?
This item was subsequently presented to the Recreation Commission at the August 7, 2024 meeting.

At that meeting, the questions issued in the July meeting were answered as provided below. - The ultimate cost of the program would be determined upon execution of the concept, and would depend on many factors, including type of umpire utilized, quality of jersey and hat, what equipment or uniform is included, the level of off-season support by the contractor, any fundraising or subsidy by outside entity, etc. It should be noted that the cost of the current program is more than the City recuperates through registration fees and sponsorships and therefore, the cost of the program could be increased compared to current levels. - Todd would serve as the league representative to the larger Stanislaus County League Board, would sit on the Escalon League Board, would be a key administrator of the program, and would provide the coaching and athlete skills clinics.
- Travel would increase for the older age divisions, and would include trips to Hart Ransom, Modesto Christian, Hughson, Red Shield, Westport, Shilo Paradise and Eisenhut, amongst others potentially.
- The Board is currently proposed to be comprised of volunteer parents, recreation staff, and recreation commissioners, but could be established with a different composition, depending on the will of the City Council or community.

This concept was subsequently presented to the public at a workshop held on September 11, 2024, in which nearly 30 people attended. The presentation and questions from prior meetings were provided to those in attendance. Mayor Pro Tem Hagan and Todd Davis provided an outline of the proposal and how it would work and how it would address some of the issues currently experienced in the current program. Todd Davis then answered the questions of the public. Many of the same questions and topics were raised. Other questions were also raised as outlined below.

Q: Who/what would be responsible for the concerns/complaints expressed by parents? A: The Board
Q: How would this proposal address the shortage of coach issue? A: The Stanislaus County League works with coaches or would be coaches to ensure there is an adequate number.

Q: Has this been coordinated with the High School and will they be involved? A: Yes.

Q: Would this allow an opportunity to not merge age groups? A: Yes.

Page 431 of 440 ends

Q: How would children who cannot afford an increase be impacted? A: It was stated that a non-profit (Escalon Strong or others) could help subsidize those costs for those in need. It was also stated that fundraising options could be explored.

Q: Would travel ball component be parent coached?
A: Travel ball would be coached by Todd Davis or a coach would be hand-selected.

Q: Does field availability impact the league approach?
A: It should not.

On October 2, 2024, this item was presented to the Escalon Recreation Commission. There was significant public comment and suggestions regarding the concept. The major themes/concerns/questions were as follows:
- Should the travel component of the concept be a separate consideration? - Should the contractor (Todd Davis) and an external board administer the program or the City of Escalon?
- Desire for a clearer picture on the role of the contractor (Todd Davis).

Ultimately, the Recreation Commission recommended the concept be forwarded to the Escalon City Council for consideration.

For Council’s consideration, the following is information on the three themes/concerns/questions from the October 2nd Recreation Commission meeting.
- Who (what entity) administers the program?
Excerpt from Exhibit A (attached):

To ease the minds of apprehensive families; this is not a 3rd party takeover of our recreation baseball and softball from the City of Escalon. This restructuring will be a supportive and benevolent addition to our current approach like many cities have done in years prior. This would target the 9/10u division and above, unless the newly created board wanted to change this approach in the future to modify the age groupings. This means the 8U and younger kids would stay in the current format without going out of town, with the exception of some rule modifications potentially, and the addition of skills camps and coach camps, and upgraded coaching support.
- Cost of Program and Associated Benefits?
Excerpt from Exhibit A (attached):

No kids will be left behind as the nonprofit Escalon Strong is committed to helping to fund these children through fundraising, donations, and running the Snack bar. The nonprofit has provided to date L-screens, pitching machines, hundreds of new baseballs and softballs, a batting cage, and even played a big role in securing the funds for the new homerun fences. They are committed to help next season where the league needs the help, including new mounds and drag nets to come.

Paraphrase of Exhibit A

Page 432 of 440 ends

o Improved communication between parents and league, and provide opportunity for direct input o Improved practice and game scheduling

ITEM NO. 10

COUNCIL AGENDA ITEM
FOR OCTOBER 21, 2024
Prepared By: Jaylen French, City Manager
Date: October 14, 2024
Subject: Consider designating Baseball Field B at Hogan-Ennis Park as Greg Largent Field
Recommendation:

Consider designating Baseball Field B at Hogan-Ennis Park as Greg Largent Field.

Background and Discussion:

At the September 16, 2024 Escalon City Council meeting, Mayor Pro Tem Hagan suggested renaming Baseball Field B to Greg Largent Field in honor of the longtime, and highly successful Escalon High School Baseball Coach. This was supported by Councilmember Engle.

Mayor Pro Tem Hagan received verbal approval from the Hogan Family. If the name change is approved by the City Council, a plaque would be made, similar to the sign installed at Sketti Field in 2019, and installed on the backstop. Further, the City would coordinate with others to host a ceremony for the field dedication.

Fiscal Impact:

The approval of the Field name change is expected to have minimal fiscal impact.
