FACTORS TO BE CONSIDERED / FINDINGS OF FACT
CONDITIONAL USE PERMIT (PL23-0130)
(Section 33-1203 of Article 61 (Administration and Enforcement – of the Escondido Zoning Code)
With respect to the Conditional Use Permit, the City Council makes the following findings for approval:
1. A conditional use permit should be granted upon sound principles of land use and in response to services required by the community.
The Project includes development of a religious use within a residential zone. The Pro ject has been analyzed through CEQA to analyze impacts on the environment, all of which can be mitigated to less than significant impacts. The construction of the religious use in a residential neighborhood is consistent with the various religious institutions throughout the City of Escondido including but not limited to Escondido United Reformed Church located at the intersection of North Broadway and Vista Avenue and the Jehovah Witness Congregation Assembly Halls located on North Iris Lane. A religious facility was previously approved under a separate entitlement package for a larger Krishna Temple at the Project site; however, that project was never constructed and, under the proposed Project, the temple has been greatly reduced in size to service local congregants in the surrounding Northern San Diego County area. The addition of this religious use would further serve those who adhere to the Hare Krishna religion in the community without having to drive further distances to other temple locations within the greater San Diego County area.
Further, the Project is conditioned to restrict operational components that may result in nuisance behavior, such as sale and service of alcoholic beverages, outdoor events and outdoor sound.
Therefore, the proposed Project would be consistent with sound principles of land use.
2. A conditional use permit should not be granted if it will cause deterioration of bordering land uses or create special problems for the area in which it is located.
The Project is located in the northeastern area of the City, and is surrounded by residential uses to the west and south, with a commercial nursery to the north. The Project site borders County land, and is one of the last parcels within City limits on Rincon Avenue. The granting of the Conditional Use Permit would not cause deterioration of bordering land uses as the Project is conditioned to restrict operational components that may result in nuisance behavior, such as sale and service of alcoholic beverages, outdoor events and outdoor sound. Furthermore, all operational characteristics of the proposed use will be indoors, and will have significant buffers from the surrounding community that include not only physical distance, but also landscaping, and the associated residential subdivis ion further buffering the non -residential use component from existing bordering land uses.
3. A conditional use permit must be considered in relationship to its effect on the community or neighborhood plan for the area in which it is to be located.
The Project is not within a neighborhood plan; however, it is surrounded by existing residential development to the west and south. The Project has been conditioned and complies with all development standards codified in the Escondido Zoning Code. The Project has b een reviewed 310

Exhibit “C”
by the City’s Staff Development Committee and complies with all requirements of the Escondido Municipal Code, including the requirements of the Fire Department. Through the compliance with conditions of approval, and mitigation measures, the Project would not have a negative impact on the surrounding community.
Additionally, a Traffic Scoping Agreement (TSA) was prepared, and included in the Initial Study/Mitigated Negative Declaration, and approved by the Traffic Division of the City’s Engineering Division. Based on the information provided in the TSA, the Project would result in less than 197 Average Daily Trips (ADT), and is below the City’s 200 ADT screening Vehicle Miles Traveled Threshold, thus not requiring further analysis for Vehicle Miles Travel. Furthermore, as detailed in the TSA, the intersection of Rincon Avenue and Conway drive operates at a Level of Service A in the AM and PM peak hours meaning that traffic flows unimpeded and with minimal delay. The Project is eligible for a Local Mobility Analysis Waiver which is required for consistency with the General Plan Policies related the City’s Street network, and based on the estimated level of traffic, the Project would not have a negative effect on the surrounding community in which it is to be located, and most traffic would be generated on Sundays which is typical of religious uses.
DESIGN REVIEW PERMIT (PL23-0086)
(Section 33-1359 of Article 64 (Design Review – of the Escondido Zoning Code) With respect to the Design Review Permit, City Council makes the following findings for approval
1. The proposed site plan has been designed in a manner which is compatible with the natural and urban characteristics of the site and the surrounding neighborhood.
The Krishna Temple site is desi gned to be compatible with the natural topography of the site which ranges from 955’-0” above mean sea level in the middle of the site to approximately 755’ - 0” near the northwest corner of the site. The site plan avoids significant grading of the site by centralizing development towards the flatter area of the property, and avoids significant natural features ranging from ridgelines and habitat for sensitive species.
Furthermore, the site plan focuses the larger features of the building, most notably the spire, away from surrounding residential uses to the west and north. Additionally, the Tentative Map includes a residential subdivision to serve as a separation between the residential uses to the west and the proposed Krishna Temple.
2. The bulk, scale, and architectural design of the proposed structure are compatible with the character of the surrounding neighborhood.
The Krishna Temple has been designed to reflect the natural surrounding environment through the use of natural earth tones such as beige and w hite. The structure, excluding the spire, complies with the permitted height limit for the underlying residential zone for an approximate height of 23’-0”. The proposed spire may exceed the allowable height limit as pursuant to Article 56 (Miscellaneous Development Standards) of the EZC. The spire is typical of religious uses, and has been designed to be oriented away from residential development to the west and north. The bulk and scale of the proposed structures are minimized through the implementation of landscaping throughout the Project site.
3. The project incorporates landscaping, irrigation and screening which is drought tolerant, appropriate for the site, and in compliance with the landscape standards established by the city.
311
Item10.
Resolution No. 2025-145
Exhibit “C”
As discussed in the Planning Commission staff report, dated September 23, 2025, the proposed use of the site does not require a specific type of tree count; however, the Project will provide six (6) street trees as required by Article 62 (Water Efficient Landscape Regulations) of the EZC. The Krishna Temple will be screened by approximately 39 trees, inclusive of the required street trees, and based on the conceptual landscape plan, the proposed trees are in compliance with the requirements of Article 62 as it pertains to water allowance. Additionally, all manufactured slopes will be landscaped and irrigated with ornamental shrubs, groundcover, and trees as required by Article 62. The Project also includes a Fire Protection Report which prohibits specific types of trees due to its l ocation within a Very High Fire Zone. The Fire Protection Report was reviewed and approved by the City’s Fire Department as a part of the development review process.
4. All grading related to the project is in conformance to design standards set by Article 5 5, Grading and Erosion Control.
The Project includes a request for Grading Exemptions as permitted by Article 55 (Grading and Erosion Control) of the EZC. The Grading Exemption is required for cut slopes up to 32’ -0” in height, and fill slopes up to 23’ -0”, specifically a grading exemption is necessary for Lot 6 of the residential portion of the Project while a grading exemption is necessary for areas to the west and east of the Krishna Temple. As required by Article 55, all manufactured slopes in excess of 20’- 0” are required to be landscaped, and will be landscaped as shown on the conceptual landscape plan. The manufactured slopes will be screened and will not block views from surrounding properties due to the use of building placement, and landscaping. Additionally, the Project grading avoids slopes greater than 35%, and preserves natural topographic and environmental features.
5. The project has incorporated the applicable design review standards contained in the ordinance codified in this section and other applicable ordinances into the site layout and building design.
The Project has been reviewed by the Planning Division staff for compliance with the Section 33- 1357 (Design Review Standards) of Article 64 of the EZC. The structure complies with the development standards related to site design including but not limited to: setbacks, lot coverage/floor area ratio, height, etc. Furthermore, the Project avoids environmentally sensitives areas such as hillsides, rock outcroppings, ridgelines, and natural habita t for sensitive species.
As detailed in the Initial Study/Mitigated Negative Declaration, the Project would purchase credits for removal of “unoccupied” coastal sage scrub, and would result in less than significant impacts to biological resources. The grading design of the site conforms to the natural topography of the site, and avoids sensitive areas and natural slopes in exceedance of 35% by focusing the site development on the flatter portion of the lot.
The building is designed in a manner that is typical to the Hare Krishna religion while respecting the natural environment that surrounds the sites. The structure proposes muted colors such as beige and white to reflect the surrounding hillside areas. Furthermore, the architectural design avoids large bl ank expansive walls through the incorporation of architectural details. The elevations visible from the public street includes consistent materials, colors, and architectural elements.
The landscaping proposed for the Krishna Temple site includes approximately 39 trees as shown on the conceptual landscape plan; furthermore, the manufactured slopes will include additional 312

trees, shrubs, and groundcover providing further visual relief. The off-street parking areas will be screened through landscaping along Rincon Avenue, and landscape planters are included in the parking lot to provide visual relief.
No signage is proposed as part of the Project; however, any future signage will be reviewed prior to building permit issuance. Additionally, the Spire will be lighted; however, it will have a set timer, and will comply with the provisions of Article 35 (outdoor lighting).
6. The project is consistent with the goals and objectives on the city general plan As discussed in the Planning Commission staff report, dated Sep tember, 23, 2025, the Project includes development of a religious use as a conditionally permitted use within the RE-20 zoning district. The Project is consistent with Residential Development Policies including allowing non - residential development within r esidential use classifications, and Visual Resource policies that seek to reduce the impact to ridgelines, hillsides, and viewsheds.

Factors to be Considered/Findings of Fact
DEVELOPMENT AGREEMENT (PL25-0085)
(Section 33-1138 of Article 58 (Development Agreements – of the Escondido Zoning Code)
With respect to the Development Agreement, the City Council make the following findings for approval:
1. Is consistent with the objectives, policies, general land uses and programs specified in the general plan and any applicable specific plan; As detailed in the Planning Commission staff report dated, September 23, 2025, the Project is consistent with the objectives, and policies of the City’s 2012 General Plan.
The execution of the Development Agreement will ensure that development in the North Broadway Region of Influence will not impact existing deficiencies related to public facilities.
2. Is compatible with the uses authorized in, and the regulations prescribed for, the land use district in which the real property is located and all other provisions of Chapter 33 of this code;
The Project includes a Tentative Subdivision Map to subdivide existing lots into 11 lots, with 10 used for residential purposes, one for a religious use, and one lettered lot for a biofiltration basin (Lot A). The Project site is within the RE-20 zoning district which permits single-family detached dwellings, and religious uses, subject to a Conditional Use Permit. The religious use is conditioned to comply with all the requirements of Chapter 33 of the EZC, and further, the Staff Development Committee has reviewed and placed appropriate conditions to ensure compatibility with the surrounding area which is comprised of single-family residential uses, and a commercial nursery.
3. Is in conformity with public convenience, general welfare and good land use practices
The Development Agreement is necessary due to the Project’s location in the North Broadway Region of Influence. The payment of the fee is necessary for developments in this area due to a lack of adequate and safe facilities for the Influence area (e.g., streets, water, sewer, drainage facilities, etc.). Under the Development Agreement associated with this Project, the Applicant will be required to pay a fee on a per lot (residential-only) basis that the City will use for improvements throughout the general region as stipulated under Article 68, as there are no immediate deficiencies identified 347
Item10.
Ordinance No. 2025-07
Exhibit “B”
on-site or in the immediate vicinity. This allows for future development to occur in the region while ensuring that adequate facilities are provided for the purposes outlined in Article 68 (Growth Management Ordinance).
4. Will not be detrimental to the health, safety and general welfare The granting of the Development Agreement will not be detrimental to the health, safety and general welfare. The Development Agreement is required in accordance with Article 68 the EZC due to the Project site’s location within the North Broadway Region of Influence. The Development Agreement solely stipulates the requirement of collecting the fee pursuant to Article 68, and would ensure the Project’s qualifying components (i.e., residential subdivision) comply with the Growth Management Ordinance. The execution of the Development Agreement will authorize development in an area of the City that lacks adequate safe streets, water, sewer and drainage facilities, adequate schools and libraries, sufficient police and fire protection, and park and recreation facilities by memorializing the applicable fee required and found to be satisfactory for off-setting such deficiencies within the greater region of influence.
Approval of the Development Agreement would require the applicant to pay approximately $12,500 per unit prior to building permit issuance which the City will utilize to address the above-referenced region of influence area’s deficiencies.
5. Will not adversely affect the orderly development of property or the preservation of property values
The Development Agreement is for payment of a fee as detailed above in finding no. 4 of PL25-0085. The execution of the Development Agreement will not impact the orderly development of the property or the preservation of property values in that such residential development is a permitted land use pursuant to the underlying General Plan land use designation and accompanying zoning.
6. Is consistent with the provisions of Government Code Section 65864 et seq The application of a Development Agreement for the Project will provide certainty to the developer for their Project, and ensure that the development Project may proceed in accordance with the existing policies, rules and regulations, and subject to conditions of approval. The application of a fee related to the North Broadway Deficiency Region of Influence would ensure adequate public facilities are provided throughout the region and provides a vehicle for ensuring such lack of public facilities do not impede the development of new housing.

FEE INCENTIVES
THE ESCONDIDO BUSINESS ENHANCEMENT ZONE
On May 24, 2006, the City Council adopted Ordinance 2006 -12, and Resolution 2006-56 modifying the existing Business Enhancement Zone (BEZ). The ability to request incentives for development was expanded to all commercial and industrial zoned properties in the City of Escondido. In order to be considered for incentives, the development must meet one or more of the Public Benefit Criteria in the associated Council policy. Generally, the BEZ applies to new construction projects.
Contact the Planning Division at 760-839-4671 or the Economic Development Division at 760-839- 4563 for more information and the eligibility criteria. Requests for incentives must be made in writing to the Assistant City Manager and be accompanied by appropriate supporting materials. • Please refer to the Escondido Zoning Code Article 69, Sections 33-1450 through 33-1457, for the complete description of requirements and incentives http://www.qcode.us/codes/escondido/view.php?topic=33-69&showAll=1&frames=on

This policy does not apply to intensive uses such as Laundromats, car washes, breweries, etc., or to the first use in new buildings. Buildings in which the previous use was abandoned for 10 years or more are subject to development fees. (See Fee Example #9, page 28)
ACCESSORY DWELLING UNITS
Fees assessed for construction of accessory dwelling units built pursuant to Article 70 of the Escondido Zoning Code shall be calculated in the same manner as fees assessed for residential room additions. Please refer to Page A1 for Important Fee information

San Diego County Water Authority
CAPACITY CHARGE
WHO
The San Diego County Water Authority (the "Authority") was organized on June 9, 1944 for the primary purpose of importing water from the Colorado River to San Diego to augment local water supplies. The Water Authority's service area encompasses 920,472 acres (1,438 square miles).
It consists of six cities, 16 special districts, one federal agency (Camp Pendleton Military Reservation), and a member of the County of San Diego Board of Supervisors also serves as a representative to the Water Authority Board of Directors. It is governed by a 34 -member Water Authority Board of Directors representing the member agencies. The primary function o f the Water Authority is to develop, store and transport water for use by its member agencies for delivery to each residence and business. The Water Authority supplies up to 90% of the water used within the County.
WHAT
On May 26, 2005, the Board of Directors of the Water Authority adopted Ordinance No. 2005-03.
This ordinance fixes Capacity Charges on all meters purchased on or after August 1, 2005, within the boundaries of the Water Authority.
The System Capacity Charge for a meter size of one (1) inch or greater shall be the basic charge of $3,985 multiplied by a Factor that is based upon additional meter capacity:
The System Capacity Charge is the cost for the conveyance and storage facilities necessary to operate the delivery system.
The Water Treatment Capacity Charge is the cost for the connection to the 50 -mgd (million gallons per day) regional water treatment facility. The Water Treatment Capacity Charge is an additional charge of $153 for each new meter of a size less than one inc h and a corresponding increase for larger meters. The Water Treatment Capacity Charge excludes customers from the City of Escondido , the member agency whose jurisdiction cannot be serviced by the 50- mgd regional water treatment facility.
The member agency shall determine the size of the water meter to serve any property within its jurisdiction.
In the event an agency calculates the water demand by the Equivalent Dwelling Unit ("EDU") method, the Water Authority's System Capacity Charge and Water Treatment Capacity Charge will be collected based on the size of meter actually installed to meet flow demand.

WHY
The assessment of the System Capacity Charge and Water Treatment Capacity Charge on new development is a part of the overall Long Range Financing Plan to fund the Capital Improvement Program. The other major revenue sources are water rates, infrastructure access charges, property taxes and the water standby availability charges.
The System Ca pacity Charge and Water Treatment Capacity Charge represent a reasonable basis for recovery of costs associated with providing service to new connections in the Water Authority's service area through each member agency. Each member agency's rules and regulations governing the establishment of new or expanded services within its service area will be applicable to the collection of the System Capacity Charge and Water Treatment Capacity Charge for the Water Authority.
WHERE
The Water Authority's System Capacity Charge and Water Treatment Capacity Charge are to be collected from new or expanded water service on all lands within the boundaries of the Water Authority to which water is made available by the Water Authority.
The implementation of the System Capacity Charge and Water Treatment Capacity Charge is discussed in detail in Ordinance No. 2005-03, adopted on May 26, 2005. A copy of this document may be obtained from your water agency or from the San Diego County Water Authority, 4677 Overland Avenue, San Diego, CA 92123.
WHEN
Ordinance 90-2 was adopted by the Water Authority's Board of Directors with an effective date of October 1, 1990, with the provision to periodically review the rate based upon changes in the Water Authority's Capital Improvement Program. All meters for new or expanded service on or after that date are subject to Capacity Charges. The charges are collected by member agencies at the time they process and collect charges imposed by their rules and regulations for new or expanded water service. Rate adjustment, which established the current rates, was approved by the Water Authority's Board of Directors on November 30, 2006, with an effective date of January 1, 2007. Rates will increase on January 1, 2007.
