Department: Public Works Est. Operating Impact: $0
Est. Start Date: Ongoing Original Budget Ongoing
Est. Completion Date: Ongoing Revised Budget $5,384,121

Project Description and
Purpose:

The water system contains several dozen miles of aged and/or undersized water mains that need to be upgraded, replaced or abandoned. Certain development projects located throughout the City require minor water main upgrades in the form of upsize(s), replacement(s), new installation(s), and/or abandonments (when applicable) to be completed as the need arises or when coordinating with local development projects is possible. There is mutual benefit when the City can coordinate certain water main upgrades as development projects evolve.

This fund is intended for minor water main upgrades (when applicable) for portions of the system that are contiguous and/or adjacent to development (i.e. not intended to subsidize or supplant developer obligations), and contains the estimated costs for minor water main projects as the need arises.

This is an ongoing project; therefore an original budget is not applicable.

Project Status and
Outlook:

Distribution Systems Improvements will be identified and performed as the need arises.

Project Title: Transmission Valve Rehab/Replacement
Department: Public Works Est. Operating Impact: $0
Est. Start Date: Ongoing Original Budget Ongoing
Est. Completion Date: Ongoing Revised Budget $7,600,000

Project Description and
Purpose:

The City's water system contains hundreds of transmission main valves that are used to control the flow of water for planned and unplanned water system shutdowns. Reliable transmission main valve operation is critical to reducing water service outage and minimizing customer service interruptions.

Transmission main valves are critical valves within the system because an inoperable transmission main valve could mean that a large geographical area within the City is out of water until the repair is completed. Many of these valves are aging and require replacement due to age or rehabilitation to preserve operability.

This is an ongoing project; therefore an original budget is not applicable.

Project Status and
Outlook:

Transmission main valve assessment will occur to determine whether valves require rehabilitation or replacement and will be performed as the need arises.

Discussion and Direction Regarding Landscape Oversight Committee Recommendation s for a Landscaping and Lighting Maintenance District Proposition 218 Balloting Process

Funding Source: N/A

Contact: Chris Lewis, (707) 428-7089

RECOMMENDED ACTION
Receive report, open discussion, and provide direction to staff.

STATEMENT OF ISSUE
The Landscape Oversight Committee (LOC) recommends that the City conduct a Proposition 218 balloting process for Landscaping and Lighting Maintenance District (LLMD) No. 5 – Smith Ranch, LLMD No. 7 – Rolling Hills, and any third LLMD for which at least 10% of district property owners provide a written request for a Proposition 218 balloting process.

DISCUSSION

Background
In 2023, the City conducted a community engagement and balloting process in accordance with Article XIII D of the California Constitution (also known as Proposition 218) to increase assessment rates in nine LLMDs that were projected to have a structural budget deficit.

The ballot was passed by property owners in the Gateway and Paradise Valley communities , resulting in the formation of LLMDs No. 2023 -1 (Gateway) and No. 2023 -11 (Paradise Valley).

However, the ballot was not passed by property owners in t he remaining seven LLMDs: No. 3 – Waterman Highlands, No. 5 – Smith Ranch (Rancho Solano), No. 6 – Peppertree, No. 7 – Rolling

Page 240 of 258 ends

Hills, No. 8 – Kolob Estates, No. 12 – Downtown Business District, and No. 13 – North Cordelia.

As a result, services were reduced in these communities.

Some property owners in these districts expressed their concerns to the LOC and the City Council Subcommittee to the LOC (Subcommittee) regarding the declining landscape in their neighborhoods and their desire for another Proposition 218 balloting process to increase their assessment rates.

On January 25, 2025, at the annual City Council Retreat, the council directed staff to pause all LLMD Proposition 218 balloting efforts for these seven districts.

The LOC and Subcommittee held a joint meeting on February 27, 2025, at which 34 members of the public attended. Eight members from these communities submitted public comment cards and requested that the council reconsider the decision on January 25, 2025. The LOC and Subcommittee affirmed their support.

At the March 4, 2025, City Council meeting, Vice Mayor and Subcommittee Member Pam Bertani requested to reconsider the decision agreed upon on January 25, 2025, to pause LLMD Proposition 218 balloting efforts for these seven districts to be added to a future council agenda.

At the April 1, 2025, City Council meeting, the council deliberated on the matter and agreed to consider moving forward with a balloting process for three of the seven districts. Due to limited staffing and City resources, the remaining four districts may be considered for a second balloting process in future years. The council directed the LOC to provide a recommendation of three LLMDs that should be considered for another Proposition 218 balloting process.

LOC Recommendations
At the April 17, 2025, LOC meeting, staff conveyed the council directive to the LOC and provided members with an example timeline to form new replacement LLMDs with increased assessment rates effective fiscal year (FY) 2026-2027. The example timeline provided to the LOC and the 2026 LLMD Proposition 218 Timeline provided in Attachment 2 (Timeline) are nearly identical, except that the request for qualifications (RFQ) related activities listed between May 2025 to July 17, 2025, have been updated in Attachment 2 as new information emerged.

The Timeline allows six months, from September 202 5 through February 2026, for the development of the Engineer’s Reports. An Engineer’s Report is a technical document required by California law that outlines the details of a proposed assessment district and includes a boundary map, a financial analysis of district revenues and expenditures, and describes the methodology for the apportionment of costs to all benefitting parcels.

Approximately one month after the Engineer’s Reports are finalized and released to the public, the City will begin the legislative process on March 3, 2026, by requesting that the council adopt a Resolution of Intent to form new districts and levy assessments in FY 2026-2027. Ballots will be mailed to property owners on March 4, 2026 . A public hearing regarding the formation of the

Page 241 of 258 ends

new districts with increased assessment rates will be held on April 21, 2026, and ballot tabulation results will be announced on May 5, 2026. If the ballot for any proposed district is not approved by property owners or the council, the City will begin regular annual proceedings in June 2026 to levy FY 2026-2027 assessments in the respective existing LLMD.

Staff advised the LOC that the Timeline is very similar to the timeline followed during the 2023 Proposition 218 balloting process. While there is sufficient time to develop the Engineer’s Reports and complete all legislative requirements, the LOC may not have sufficient time to conduct the desired level of community engagement activities between the completion/release date of the Engineer’s Reports and the date ballots are mailed to property owners.

While community engagement activities may commence at any time, many property owners stated that engagement was less effective without the Engineer's Reports during the 2023 ballot process. Additionally, many property owners did not think there was enough time (approximately two months) between the release of the Engineer's Reports and the mailing of the ballots to thoroughly consider their options during the 2023 process.

The LOC moved to recommend to the council that LLMD No. 5 – Smith Ranch and LLMD No. 7 – Rolling Hills be considered for a balloting process. The LOC also recommended that a third LLMD be considered if at least 10% of district property owners provide written requests to be included in a balloting process by August 1, 2025.

Staff advised that, upon the council’s approval, the City will move forward with developing the Engineer’s Reports based on the landscaping and lighting maintenance scope of work that was in effect for each district prior to the service reductions in 2020 -2023. Some modifications may apply based on existing conditions and recommendations from th e Landscape Maintenance Manager. If property owners in any proposed district desire other modifications to the scope of work, the LOC must notify the City by July 17, 2025, to allow staff sufficient time to obtain cost estimates. The LOC agreed that change s to district boundaries would likely require in -depth research and an extended and substantial community engagement effort, which is not achievable at this time due to the Timeline.

LLMD No. 13 – North Cordelia Community Meeting
On May 1, 2025, Councilm ember Williams hosted an LLMD No. 13 – North Cordelia community meeting at the Cordelia Library to determine if North Cordelia property owners were interested in participating in a Proposition 218 balloting process to increase their assessment rates. The meeting was attended by approximately 20 North Cordelia property owners, Vice Mayor Bertani, LOC Chair Johnson, LOC Member Smith, and Public Works staff.

City staff presented an overview of the existing district boundaries, scope of work, budget, and assessment rates, the 2023 balloting process, and the proposed balloting process requirements and timeline.

Page 242 of 258 ends

The majority of North Cordelia property owners in attendance agreed to defer a balloting process until they confirm community support through their homeowner’s association networks, district- specific subcommittees (to be formed separate from the LOC), community surveys, and other relevant means of engagement.

Assessment Engineering Consultant Request for Qualifications Upon the council’s approval, the City will release an RFQ to procure an assessment engineering consultant to develop the Engineer’s Reports and assist the City with the Proposition 218 balloting process.

At the April 17, 2025, LOC meeting, staff requested that the LOC appoint two representatives to serve on the ad hoc RFQ Review Panel. The panel will consist of three City staff members and two LOC-appointed representatives. It will be res ponsible for evaluating all RFQ submittals and recommending the most qualified assessment engineering consultant.

The Committee appointed LOC Chair Rick Johnson and Paradise Valley property owner and resident, Carol Haddock. Ms. Haddock is a long -standing and very active member of the LLMD community who frequently participates in relevant community meetings and contributed to the 2023 balloting process as a community engagement working group member.

RFQ submittals will be due to the City by June 17, 2025. The RFQ Review Panel will independently review and score all submittals, then convene on June 25, 2025, to discuss and identify the consultant(s) with the highest scores.

After the consultant selection, staff will negotiate contract terms and bring th e contract to the council for approval in August 2025. The consultant will commence work in September 2025.

Council Direction
Staff requests the council’s direction regarding the LOC’s recommendations that the City conduct a Proposition 218 balloting process for LLMD No. 5 – Smith Ranch, LLMD No. 7 – Rolling Hills, and any third LLMD for which at least 10% of district property owners provide written requests by August 1, 2025, for a Proposition 218 balloting process to form new replacement LLMDs with increased assessment rates effective FY 2026-2027.

RECOMMENDED ACTION
Receive report, open discussion, and provide direction to staff.

STATEMENT OF ISSUE
The City Council established the Rockville Citizens Advisory Committee (RCAC) and Guidelines with Resolution No. 2007-319 (Exhibit B) in November 2007. The RCAC’s purpose is to assist the City in making major decisions that affect the Rockville Hills Regional Park (Park).

In early 2023, the council requested the R CAC to provide a n updated recommendation to Ordinance No. 2020-04 (Exhibit C) regarding the use of electric bicycles (E-Bikes) in the park.

During RCAC’s research on E-Bikes, discussions for funding centered on efforts to amend eligible expenditures of Co mmunity Facilities District 4A (CFD 4A) to allow for administrative and maintenance expenditures in addition to currently restricted uses for only a cquisition of open space.

DISCUSSION
The 633-acre Park is located on Rockville Road west of Suisun Valley Ro ad. The Park provides recreation opportunities for local residents and visit ors, including walk ing, hik ing, run ning,

Page 246 of 258 ends

cycling, and other outdoor activities. The Park also serves as an educational resource, often hosting a variety of students and youth organizations.

Due to the delicate nature of the single -track trail systems in the Park and safety concerns for fellow trail users, the council adopted Ordinance No. 2020-04, amending Chapter 12B, Parks and Recreation of the Fairfield Municipal Code, to p rohibit the riding or operation of E-Bikes in the Park.

In early 2023, the council requested that the RCAC revisit the use of E-Bikes in the Park based on increased interest and advocacy from some residents and park users. Though the RCAC historically mee ts quarterly, special meetings were held to start discussions and develop a recommendation.

The following efforts assisted RCAC in formulating their recommendation , though RCAC welcomes discussion with the council to fully formulate their final recommendation:

 Creating and distributing a park user preference survey, with an emphasis on questions regarding the allowance of E-Bike usage.
o From the survey, nearly 1,400 responses were received and are summarized in Exhibit D.
 Discussion with Directors from S kyline Wilderness Park in Napa County and East Bay Regional Park Districts in Alameda and Contra Costa Counties to understand the expected and actual impact as both organizations currently allow Class 1 E-Bikes in the parks.  Listening to the Community during the RCAC meetings.
 Significant discussions amongst the seven-member Committee.

RCAC could not come to a unanimous decision on allowing E -Bikes on the Park. However, RCAC did come to a decision to recommend to the council three options for allowing E -Bikes into the Park:

 Allow Class 1 E-Bikes into the Park
 Allow Class 1 E-Bikes into the Park if minimum staffing is available  Allow Class 1 E -Bikes into the Park contingent on securing f unding for the Management Plan

Community Facilities District 4A
One of the sticking points for RCAC has been the limited availability of Park Ranger personnel as well as funding for ongoing maintenance requirements in the park. In exploring options for increasing funding to implement the management plan, RCAC discussed the opportunity to amend CFD4A to allow funds to be used for the maintenance and administration of open space.

On September 17, 1991, the City Council adopted Resolutions 91 -251 through 91-255, establishing CFD4A, a Mello -Roos Open Space District for Fairfield. The resolutions addressed

Page 247 of 258 ends

district formation, setting the bonded debt limit and special tax, calling a special election, and announcing the results. CFD4A was created with the intent that future residential developments within the City would annex to the district, with funds specifically authorized for open space acquisitions as outlined in the formation document.

CFD4A is limited in what funding generated can be used for. Specifically, funding is limited to the acquisition of open space lands by the City. It does not specifically allow for funding to be used for the maintenance of open space lands or for the costs of administering those lands and/or CFD4A. It appears to be the only CFD in the City that does not allow administration and maintenance as an eligible expense.

CFD4A includes approximately 2,886 parcels within the district, most of which are in pockets of parcels that are not contiguous. Attachment A includes a map of the district parcel areas. CFD4A generates approximately $550,000 in revenue annually from a special assessment levied on properties within the boundaries of the district.

The RCAC discussed the process for amending the formation document to include administrative and maintenance costs as eligible expenditures under CFD4A . An amendment would provide funding sufficient to administer the necessary components of the Rockville Hills Management Plan, including adding necessary staffing, such as an additional Par k Ranger, and provide some funding for maintenance of other open space areas in the City.

The RCAC acknowledges that this amendment would require voter approval through the Prop 218 process, but believes it is a necessary measure to support the long -term sustainability and protection of the Park. To amend the district would require the following:

 A CFD report prepared by a consultant
 Issuance of a Notice of Intent (NOI) by City Council – note: if 50% or more of registered voters residing within the district file written protests, then it cannot be considered again for one year
 Public Hearing within 30 to 60 days (min/max) of the NOI  Mail ballots to eligible voters within the district for an election to be held between 90 and 180 days (min/max) after the Public Hearing
 Requires 2/3 approval of the total votes cast

FINANCIAL IMPACT
If the City Council authorizes proceeding with the Prop 218 process to amend CFD4A, the CFD will incur costs associated with the balloting process. Staff will provide a cost estimate if directed to move forward.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
Community engagement efforts were carried out through multiple channels, including a visitor survey and presentations from two additional organizations.

Please provide any additional comments as they relate to the park.

The overwhelming majority of responses were related to e-bike usage given the previous two survey questions were specific to e-bikes. Therefore, the summary below is mostly specific to the allowance of e-bikes in the park.

It's important to note that the opinions expressed in the responses are varied and reflect the diverse perspectives of the park users. Some are supportive of E-Bikes, emphasizing accessibility and benefits for certain groups, while others have concerns abo ut safety, trail impact, and potential conflicts between different trail users.

Page 257 of 258 ends

Reasons Given in Favor of E-bikes:

A. Promote & enable outdoor activity and accessibility/inclusivity. o Allows certain demographics the ability to enjoy biking outdoors, such as the elderly or those with disabilities, who typically would be unable to. o Enhanced park experience and exploration for all, but especially those above.

B. Comparison to mountain bikes, which are already allowed in the park. o Many people indicate that e-bikes will not result in much difference.

C. E-bikes are supportive of youth and mountain biking team activities.

D. Suggestions to set rules for safe e-bike use and specify the allowed e-bike types.

E. Would be great for Solano Search & Rescue training – suggested by the Captain of SSR.

F. Perceived risks and misunderstandings given by non-bikers is frequently mentioned by people in favor of e-bikes; that those ‘against’ do not have a proper understanding.
o Some ‘against’ survey responses showcase this, as it seems that some people think e-bikes are like motorcycles or motorized dirt bikes.

Reasons Given Against E-bikes:

A. Safety of pedestrians and environmental impact concerns of more bikes. o Negative impact on the experience of non-bikers & general preference for a non-biking environment.
o Fear of negative impact on wildlife and damage to the trail and natural environment/habitats in the area.
