RECOMMENDATION

It is recommended that the City Council discuss and introduce by title only and waive further reading of an ordinance amending Title 8, “Health and Safety” of the Foster City Municipal Code to add a new Chapter 8.12, “Tobacco Retailer Permit” to require tobacco retailers to obtain a permit to sell tobacco products and amending Section 8.11.040, “Enforcement” within Chapter 8.11, “Regulation of the Sale of Flavored Tobacco Products and Electronic Cigarettes” relating to enforcement; and finding ordinance exempt from the California Environmental Quality Act.

EXECUTIVE SUMMARY

At the October 3, 2022 City Council meeting, a majority of the Council 115
directed staff to prepare a tobacco retail license ordinance, within approximately one month. The proposed ordinance would establish a requirement that tobacco retailers obtain a permit for the sale of tobacco products in the City and would create a process for the administration of that permitting program.

BACKGROUND

According to the Centers for Disease Control, cigarette smoking remains the leading cause of preventable disease, disability, and death in the United States.(1)

Tobacco use kills more than 480,000 people each year. (2) It causes or contributes to many forms of cancer, as well as heart and respiratory diseases, among other heath disorders. Smoking causes more deaths each year than the following causes combined:(3)
 Human immunodeficiency virus (HIV)
 Illegal drug use
 Alcohol use
 Motor vehicle injuries
 Firearm-related incidents

In 2020, 12.5% of U.S. adults (an estimated 30.8 million people) currently smoked cigarettes: 14.1% of men, 11% of women and each day, approximately 1,600 youth try their first cigarette.(4)

As a result of the foregoing, tobacco use remains a public health crisis in terms of the health impacts and loss of life it causes and the financial costs and burdens it places on our health care system.

In an effort to protect the public health and welfare of the citizens of Foster City and to strike a reasonable balance between the interests of persons who smoke and the interests of nonsmokers, the City adopted Ordinance No. 592 in 2014 (codified in Chapter 8.05) to regulate smoking within the City.

At the July 18, 2022 City Council meeting, Councilmember Gehani requested, and a majority of the Council supported, placing on a future agenda an ordinance to prohibit the sale of flavored tobacco and “vapes” otherwise known as electronic cigarettes.
116

On August 15, 2022, the City Council was presented with a draft ordinance that proposed amending Title 8 of the Foster City Municipal Code to add a new Chapter 8.11 to regulate the sale of flavored tobacco products and electronic cigarettes. After a robust discussion by the Council, the proposed ordinance was not supported by a majority and thus was not introduced.

At the September 19, 2022 City Council meeting, Mayor Awasthi requested and a majority of Council supported re-agendizing an ordinance that mirrored the provisions of Senate Bill (SB) 793 which regulates flavored tobacco and is currently the subject of a referendum and will be on the ballot in November as Proposition 31.

At the October 3, 2022 City Council meeting, Council considered a draft ordinance that mirrored the provisions prohibiting the sale of flavored tobacco in SB 793. After consideration, a majority of Council directed staff to revise the draft ordinance presented at the October 3rd meeting to add a prohibition on the sale of electronic cigarettes. Council also discussed other types of regulations, such as prohibitions on tobacco sales at pharmacies and methods of enforcement, such as establishing a requirement that retailers obtain permits for retail operations. Vice Mayor Froomin requested, and a majority of Council supported, directing staff to bring back a tobacco retail license ordinance, within approximately one month.

The Council considered a revised ordinance at the October 17, 2022 Council meeting that revised the ordinance considered at the October 3, 2022 meeting that prohibited flavored tobacco with the additional prohibition for electronic cigarettes and other conforming changes. After discussion by Council, Ordinance No. 653 was introduced, adding a new Chapter 8.11 prohibiting the sale of flavored tobacco and electronic cigarettes in the City, subject to certain exemptions. Ordinance No. 653 is scheduled to be considered for Council adoption on November 7, 2022.

Staff has prepared a new proposed ordinance for Council’s consideration this evening. Currently, Foster City does not require tobacco retailers to obtain a permit or license to sell tobacco products. At the Council meeting on October 3, 2022 in connection with the consideration of regulating tobacco retailers to prohibit the sale of flavored tobacco and electronic cigarettes, there was discussion about regulating retailers through a permit or licensing program. A regulatory permit or licensing program is often used as a way to ensure that certain businesses operate in conformance with established regulatory 117
requirements.

There are a number of cities within San Mateo County that currently require tobacco retailers to obtain a city license or permit to operate, including:

 Brisbane
 Colma
 Daly City
 East Palo Alto
 Half Moon Bay
 Menlo Park
 Millbrae
 Pacifica
 Portola Valley
 Redwood City
 San Bruno
 San Carlos
 San Mateo
 South San Francisco(5)

The San Mateo County (“County”) Environmental Health Department administers a Tobacco Retailer Permit Program. According to County staff, the Environmental Health Department currently administers and enforces the Program in unincorporated areas of the County and in approximately ten cities,’ at no cost to those cities. Funds necessary for County administration and enforcement are paid for by the tobacco retailers.

On July 1, 2022, the County notified stakeholders of the County’s intent to place an item on the July 12, 2022 agenda for consideration by the Board of Supervisors to consider updating the Tobacco Retailer Permit ordinance to include several amendments. (See Attachment). These potential amendments would include new definitions for “Tobacco Product” and “Electronic Smoking Device”, restrictions for new tobacco retailers within 1,000 feet of youth- populated areas, restrictions for new tobacco retailers within 500 feet of another tobacco retailer and increased fines for violations. The County currently prohibits sale or distribution of electronic cigarettes in Chapter 4.95 (link) and sale of flavored tobacco and the sale of any tobacco products by a pharmacy in Chapter 4.99 of its Code (link). Although a draft of the County ordinance was scheduled to be heard by the Board on July 12, 2022, that 118
item was postponed and it is anticipated that it will be considered sometime in December, 2022. County staff have not yet published a final draft version of the ordinance updating the Tobacco Retailer Permit Ordinance.

According to County staff, once the County ordinance is updated, the cities that rely on the County for administration and enforcement of tobacco retail permitting requirements will likely be required by the County to update their ordinances so that the cities' regulations mirror the revised County ordinance, which in some cases will be more restrictive than the city regulations.

ANALYSIS

Pursuant to the direction of the Council, staff has prepared an ordinance that would require a tobacco retailer to obtain a “Tobacco Retailer Permit” (“Permit”).

The proposed ordinance would identify specific definitions that apply in chapter 8.12, and include terms such as “Applicant”, “Director” and “Self- Service Display. Terms such as “Retail Location”, “Tobacco Product” and “Tobacco Retailer” mirror the definitions found in chapter 8.11 adopted through Ordinance No. 653. The proposed ordinance would also establish a requirement that Tobacco Retailers obtain a Permit, which would be valid for a period of one year and must be renewed annually if the business desires to continue to sell Tobacco Products. The proposed ordinance is currently drafted to allow existing Tobacco Retailer’s one year from the date of adoption of the ordinance to obtain a Permit.

A process for the application, issuance and renewal of the Permit is also provided in section 8.12.030 of the proposed ordinance, which would ensure that Tobacco Retailers are vetted before issuance or renewal of the Permit by the City Manager or his designee. The proposed ordinance would also provide various requirements for Tobacco Retailers, such as compliance with local, State or Federal law applicable to Tobacco Products (which would include the City’s prohibitions on Flavored Tobacco and Electronic Cigarettes in Chapter 8.11) and requirements for the display of the permit and confirmation of identification for any person that appears under the age of

21. The proposed ordinance would allow the City Manager or their designee to monitor compliance with the regulations and enforce its provisions, when necessary. The language in section 8.12.080 and elsewhere in the ordinance was written to allow maximum flexibility so that the City Manager can designate the appropriate department for enforcement. The proposed 119
ordinance would also provide that the City Manager may develop administrative internal procedures and policies necessary to monitor, including conducting periodic inspections of the Tobacco Retailers.

If a Tobacco Retailer does not comply with the requirements in the proposed ordinance, section 8.12.100 would provide a process for suspension of the Permit. The length of suspension can vary, depending on whether there are any prior violations. For example, if the Tobacco Retailer is found to have one violation, the City Manager or his designee will suspend the Permit for some period of time up to a maximum of 30 days while a Permit may be suspended for a maximum of one year if there are multiple violations of chapter 8.12. An application for renewal of the Permit may be denied if there is a suspension in effect or any outstanding fines owed to the City.

Section 8.12.110 of the proposed ordinance would also provide a number of methods for enforcement in addition to suspension of the Permit, including administrative citations or imposition of fines. The proposed ordinance would also amend section 8.11.040 relating to enforcement to make edits to mirror section 8.12.110 so that the two enforcement provisions are consistent.

The proposed ordinance is primarily modeled after the County’s current tobacco permitting requirements found in Chapter 4.98 of the County Code (link).

CEQA

The Ordinance is not a project within the meaning of Section 15378 of CEQA Guidelines because it has no potential for resulting in either a direct or a reasonably foreseeable indirect physical change in the environment, either directly or ultimately. In the event that this Ordinance is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility of having a significant effect on the environment.

FISCAL IMPACT

Adoption of this ordinance would result in increased staff time to administer the tobacco retail permit and conduct enforcement.

Dear Tobacco Retail Owner,

This letter is to inform you that the San Mateo County Board of Supervisors is considering updating the Tobacco Retailer Permit Ordinance to include several changes, including, but not limited to:

• Definition of “Tobacco Product” explicitly includes synthetic nicotine • Definition of “Electronic Smoking Device” expanded to non-nicotine products • No new tobacco retailers within 1,000 feet of youth-populated areas • No new tobacco retailers within 500 feet of another tobacco retailer • Fines doubled for violating the Ordinance

One of the major purposes of the proposed ordinance is to decrease youth access to tobacco products.

In April 2021, the San Mateo County Sheriff’s Office coordinated undercover enforcement operations and found that among 74 retailers, 11 tobacco sales to underage decoys occurred.

The Board of Supervisors will discuss the proposed ordinance at their board meeting on Tuesday, July 12, 2022 at 9:00 a.m.

The meeting will be held virtually (smcgov.org/bos) as well as in-person at the Board Chambers at 400 County Center, Redwood City, CA 94063.

You are invited to attend this meeting to learn about and provide feedback regarding the ordinance.

If you have questions about the Ordinance, please leave the Tobacco Prevention Program a voicemail at (650) 573-3777 or email them at [email protected].

Sincerely,

Heather Forshey

TO: Mayor and Members of the City Council
President and Members of the Estero Municipal Improvement District (EMID) Board of Directors

VIA: Stefan Chatwin, City/District Manager

FROM: Stefan Chatwin, City Manager

SUBJECT: CONSIDERATION OF THE ADDITION OF AN ASSISTANT CITY

MANAGER POSITION, AMENDMENT OF THE SALARY

RANGE FOR THE ASSISTANT CITY MANAGER POSITION,

AND REQUEST FOR APPROPRIATION OF ADDITIONAL
FUNDING IN THE AMOUNT OF $1,901 TO THE

CITY/DISTRICT MANAGER DEPARTMENT BUDGET FOR FY
2022-2023

RECOMMENDATION

It is recommended that the City Council/EMID Board of Directors (hereinafter referred to as "City Council") take the following actions:

1. Adopt the attached resolutions authorizing the addition of an Assistant City Manager position in the City/District Manager Department and the appropriation of an additional $1,901, from the General Fund Reserves to fund the salary and benefits for this position.

2. Adopt the attached resolutions amending the City/District Pay Plan for Fiscal Year 2022-2023, effective November 8, 2022.

133

EXECUTIVE SUMMARY

Stefan Chatwin was hired as the City/District Manager on June 21, 2022. Since that time, City Manager Chatwin has reviewed his current department structure and determined the need to reinstate the Assistant City Manager position to ensure the delivery of services to the community. Staff is requesting approval from the City Council to authorize the addition of the Assistant City Manager position in place of the Deputy City Manager position. Staff is further recommending revising the current pay plan with a new salary range for the Assistant City Manager position to encourage recruitment and retention for this high level position. The estimated amount of adding this position with the new salary range is $1,901.

BACKGROUND

The City of Foster City hired Stefan Chatwin as City Manager on June 21, 2022. Since that time, City Manager Chatwin has reviewed his department’s staffing levels, which is currently made up of a Deputy City Manager, Principal Analyst, Senior Management Analyst and Management
Coordinator. Recently, the Deputy City Manager notified staff of her departure, which will leave a large gap in covering the workload within the department.

ANALYSIS

In reviewing the current roles and responsibilities within the department as well as citywide, City Manager Chatwin reviewed options on how to address the coverage of duties and responsibilities under the City Manager’s Office oversight. Of special note is how the departure of the Deputy City Manager will leave additional gaps due to the various responsibilities that she covered. After reviewing options for those duties, as well as implementing better oversight of various programs and divisions, staff is recommending reinstating the Assistant City Manager position in place of the Deputy City Manager position in the City Manager’s Office. The Assistant City Manager will serve as the Chief Operations Officer and will oversee the departments of Community Development, Public Works, and Parks and Recreation.

To administer successful recruitment and maintain retention, staff also recommends an adjustment to the Assistant City Manager’s salary range, with the top step equating $20,833.33 per month. Below is the recommended 134
monthly salary range.

Position Step 1 Step 2 Step 3 Step 4 Step 5
Assistant City
Manager
$17,139.65 $17,996.63 $18,896.45 $19,841.28 $20,833.33

With approval by the City Council to replace the Deputy City Manager position with the Assistant City Manager position, and approval of the revised salary range, the City Manager Department general fund budget will require a budget augmentation of $1,901 from the general fund reserves. These funds would be allocated to the City Manager Department's expenditures budget for salary, benefits, and related employment taxes.

FISCAL IMPACT

As noted above, the addition of the Assistant City Manager position with the revised salary range is estimated have a fiscal impact of $1,901 in the Fiscal Year 2022-2023.

CITY COUNCIL VISION, MISSION, AND VALUE/PRIORITY AREA

These actions support the City Council's mission to deliver equitable services that are customer-focused and promote a vibrant economy. This action also supports "Staff Empowerment and Operational Excellence" Value/Priority Area, allowing the organization to focus on key outcomes of attracting and retaining high-caliber talent to support service delivery. By meeting these key outcomes, the City will continue to be able to proactively provide exceptional service within our organization and to our community.
