Bid Protest of the Apparent Low Bidder: VSS International Please consider this letter to be a formal protest of the bid submitted by VSS International (VSS) on April 18, 2023 for the above referenced project.
VSS International did not properly acknowledge Addendum 1 Addendum 1 was issued by the City of Fremont on April 12, 2023 and it clearly states that the "Receipt of this addendum must be acknowledged on Section 2, "Addenda" of the Bid Forms submitted with the other documents at the time of the bid opening." Section 2 Addenda also clearly states that the bidder fill in the date "Date" that the Addendum was received. VSS did not fill in the proper date that the addendum was received. Addendum 1 is a material amendment to the contract, and since VSS did not properly acknowledge the addendum, there is no way to tell if VSS considered and agreed to be bound by the terms of this addendum at the time the bid was submitted.
We request that VSS' bid be found non-responsive and that the City of Fremont award this project to the next responsible and responsive bidder.
