Executive Summary: Staff and SpectraTurf have been working through the inventory of resurfacing playground locations and have identified several locations which require full removal and replacement rather than seal and coat resurfacing. Consequently, staff recommends that the City Council authorize the approval of the first Amendment to the Facilities Maintenance Agreement for Playground Maintenance and Safety Resurfacing at multiple City locations increasing the amount of the contract by $279,885.75 for a total not to exceed amount of $1,171,229.80.
BACKGROUND: The City has successfully completed playground maintenance and safety resurfacing at several sites over the last few years, including:
• Agua Caliente
• Always Dream
• Blacow
• Booster
• Brookvale
• David Jones
• Frank Fisher
• Irvington
• Karl Nordvik
• Lone Tree
• Lowry
• Peregrine
• Sylvester P. Harvey
• Westridge
DISCUSSION/ANALYSIS: A competitive process (RFP #22-017) was completed for additional playground maintenance and safety resurfacing work at various City locations.
On July 12, 2022, the City Council approved the SpectraTurf contract award and terms with a total amount not to exceed $891,344 through June 30, 2027.
The playground maintenance and safety resurfacing scope of work consists of the following:
Council Staff Report (ID # 5023) Meeting of November 14, 2023 Updated: 11/7/2023 3:28 PM by Susan Gauthier B Page 2
• Full Removal and Replacement
• Patch, Seal and Coat
• Re-Top
• Seal and Coat
Staff and SpectraTurf have completed additional evaluations and determined that seal and coat resurfacing work for Irvington, Karl Nordvik and Lowry parks will not address the safety and maintenance needs of the playground sites. Staff and SpectraTurf are recommending a full removal and replacement due to the accelerated deterioration of the existing surfacing at these three playgrounds.
The type of maintenance work to be performed, from seal and coat to full removal and replacement, are all services included in the contract scope of work. This adjustment will increase the total not to exceed amount of the contract by $279,885.75 to $1,171,229.80.
FISCAL IMPACT: All City costs associated with this agreement are covered by the budget adopted through the bi-annual CIP process (PWC 8770 Poured in Place Area Surfacing) and there will be no impact to the General Fund.
ENVIRONMENTAL REVIEW: The project activities to be undertaken are exempt from review under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15301, Existing Facilities, as the project consists of repairing and maintaining existing park facilities. Prior to commencement of ground disturbing activities, the requirements of Fremont Municipal Code Section 18.218.050(b)(1) (Standard Development Requirements for Burrowing Owls) will be met.
ATTACHMENTS: None.
RECOMMENDATIONS:
1. Authorize the City Manager or her designee to execute the first amendment to the Facilities Service Agreement with SpectraTurf, Inc., increasing the not to exceed amount of the contract by $279,885.75 to $1,171,229.80.
2. Find that the agreement for repairs and maintenance to existing park facilities is exempt from California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15301.
