Executive Summary: Staff recommends that the City Council approve the Plans and Specifications for the Central Park Pickleball Project, award a contract to Silicon Valley Paving, Inc. for the base bid scope amount of $378,184, plus Alternate #1 - Four Additional Pickleball Courts at Lower Courts for $96,047, Alternate #2 – Install Court Furnishings for $54,175, Alternate #3 – Electrical Conduit and Pullboxes for $24,900, plus a 15% construction contingency amount of $82,995.90, for a total construction contract amount of $636,301.90 for the Central Park Pickleball Project; reallocate of $150,000 from PWC 8501 to the project; and find that, pursuant to CEQA Guidelines Section 15301 (Existing Facilities), Section 15304 (Minor Alterations of Land), Section 15311(b) (Accessory Structures), and Section 15183 (Project Consistent with a Community Plan, General Plan, or Zoning), the project is exempt from review under the California Environmental Quality Act (CEQA).
BACKGROUND: During the community engagement process for the Parks and Recreation Master Plan and through additional communication, the community has expressed significant need for the City to provide pickleball court facilities throughout the City’s park system. These facilities are intended to meet USA Pickleball standards for both recreational and competitive level play, as determined by USA Pickleball, a national governing body for the sport. The City currently has a limited number of pickleball courts in its inventory and currently does not have dedicated courts. The 2022 updated Parks and Recreation Master Plan identified that the City should have a minimum of fifteen courts to provide the standard level of service by 2026. The Central Park Pickleball Project and its proposed location at the existing underutilized parking lot at Central Park, was identified by staff to help address the need for dedicated pickleball courts. This project will be funded under the Pickleball Court Council Staff Report (ID # 5028) Meeting of November 14, 2023 Updated: 11/8/2023 9:25 AM by Susan Gauthier Page 2
Conversion Throughout Parks (PWC 9067) that was initially funded in the (CIP) FY 2021/22 – 2025/26 Capital Improvement Program.
DISCUSSION/ANALYSIS: The project includes the construction of eight standard pickleball courts at an existing under-utilized parking lot at the Central Park. The project scope includes demolition and removal of existing asphalt and concrete surfacing; removal of existing chain link fencing, concrete curbs and gutters; protection of existing asphalt pavement to use as a base for new asphalt paving and Plexipave acrylic pickleball court surfacing. The new improvements include perimeter fencing, ADA accessible path of travel, handicap parking stalls, site furnishings, including in-ground pickleball nets and posts, benches, trash and recycling receptacles and drinking fountain.
Anticipated construction for this project is scheduled to begin in December 2023 and to be completed by Spring 2024, barring unforeseen conditions and weather delays.
Bid Results: The project was advertised for bid on September 12, 2023 with a second advertisement on September 19, 2023. On October 4, 2023, the City received and opened seven bids. The lowest bid, submitted by Silicon Valley Paving, Inc., was $378,184 (Base Bid). The Bid Results are as follows:
Bidder Base Bid Amount
1. Silicon Valley Paving, Inc. $378,184.00
2. Foundry Construction, Inc. $455,195.00
3. Interstate Grading and Paving, Inc. $457,461.00
4. Radius Earthwork, Inc. $485,743.50
5. B&M Builders, Inc. $563,569.00
6. Guerra Construction Group $583,124.00
7. Frontline General Engineering Construction, Inc. $610,299.31*
* Bid is mathematically corrected
City Estimate $465,650
* The $610,328.90 total Base Bid listed by bidder, Frontline General Engineering Construction, Inc., did not reflect the unit cost listed in their Bid Schedule for several bid items. The instructions on the Bid Schedule states that, “in case of a math error or ambiguity, the unit cost listed for any bid item will prevail over the extended amount listed for that bid item.” Based on this mathematical correction, Frontline General Engineering Construction, Inc.’s total base bid equals $610,299.31.
Add Alternates: The City received favorable bids for the Add Alternates from the lowest responsible bidder, Silicon Valley Paving, Inc., and staff recommends including these into the construction contract. Including these alternates will double the number of courts built from four to eight, including the installation of preferred site furnishings to the facility, and allow for underground electrical conduits for future utilities. Installing electrical conduit now will allow for future lighting improvements to occur without impacting court use, in the event the City choses to install future sports court lighting.
Add alternates are as follows:
1. Alternate #1 - Four Additional Pickleball Courts at Lower Courts Council Staff Report (ID # 5028) Meeting of November 14, 2023 Updated: 11/8/2023 9:25 AM by Susan Gauthier Page 3
a. Add Alternate Bid: $96,047
b. City Estimate: $101,933
2. Alternate #2 - Install Court Furnishings
a. Add Alternate Bid: $54,175
b. City Estimate: $47,050
3. Alternate #3 - Electrical Conduit and Pullboxes
a. Add Alternate Bid: $24,900
b. City Estimate: $32,400

FISCAL IMPACT: The Pickleball Court Conversion Throughout Parks project (PWC 9067- 540) was funded in the FY 2021/22–2025/26 Capital Improvement Plan. The Capital Replacement for Parks project (PWC 8501-501) receives funding annually from the General Fund. The FY 2023/24 budgeted transfer was $2,250,000.
ENVIRONMENTAL REVIEW: The proposed improvements identified in the Central Park Pickleball Project are exempt from the requirements of the California Environmental Quality Act (CEQA) per, without limitation, each on a separate and independent basis:
Council Staff Report (ID # 5028) Meeting of November 14, 2023 Updated: 11/8/2023 9:25 AM by Susan Gauthier Page 4
(1) CEQA Guidelines Section 15301 (Existing Facilities), as the project would involve minor alterations to an existing park facility, involving a negligible expansion of use. The proposed alterations would not expand the boundaries of the park site and would be contained within previously improved areas of the park. The introduction of pickleball facilities would not be an expansion of use as the park has been historically utilized for recreational activities.
(2) CEQA Guidelines Section 15304 (Minor Alterations of Land), as the project would involve the minor alteration of improved park land, replacing existing parking lot asphalt with a sports court surface.
(3) CEQA Guidelines Section 15183 (Projects Consistent with a Community Plan, General Plan, or Zoning), as the proposed project is consistent with the development densities and policies in the general plan and existing zoning for which a final Environmental Impact Reports (EIRs) was previously certified: Fremont General Plan EIR (SCH#2010082060).
The project would not create significant effects more severe than analyzed in the prior EIR because the project does not substantially alter the physical characteristics or use of the site. The proposed park improvements would involve the construction of a small number of pickleball courts within the existing park boundaries.
There would not be the potential for environmental effects peculiar to the project or to the project site. The improvements to the site would take place in previously improved and disturbed areas of the park that are currently utilized for parking and site circulation. The programming of active uses (pickleball) would be a negligible expansion of the existing park use.
In summary, there are no previously identified significant effects which are substantially more severe than analyzed in the prior EIR nor any peculiar significant effects that were not previously analyzed or discussed as significant effects in prior EIR or that cannot be substantially mitigated by the imposition of uniformly applied development policies or standards applied on a citywide basis. None of the circumstances necessitating preparation of a subsequent EIR pursuant to CEQA Guidelines Section 15162 are present. The improved park would be consistent with existing park operations in the General Plan. As discussed above, no substantial changes in circumstances have occurred that were not fully envisioned in the General Plan EIR and no new information of substantial importance exists that suggests that there would be a new or more substantial environmental effect.
