City of Gardena Ordinance No. 1493 specifies the policies and procedures to be used to ensure that all purchases, contracts, and services are obtained through fair and open competition. The Purchasing Officer has the authority and the responsibility to ensure that all procurement is in compliance with this policy. The Purchasing Officer shall also ensure that all prospective proposing Contractors are informed of the procedures to file a “Proposal Protest”.
Should any individual, organization or group believe that these policies have been violated they may make an appeal in writing to the Purchasing Officer who is obligated to investigate the protest and provide an official response to the protest.
Protests shall be submitted within ten (10) working days of notification that a proposal has been awarded. All protests shall state specifically:
• The Proposal title, opening or award date, purchase order or other identifying data; • The specific policy that is alleged to have been violated; • The adverse effect alleged to have resulted from the policy violations; • The corrective action being sought as a remedy.
The Purchasing Officer will respond in writing to the protester no later than ten (10) working days from receipt of the protest. The response shall include:
• Review of the policy as applied in the transaction being questioned. • Response to each material issue raised in the protest. • Statement of whether a violation has indeed occurred. • Corrective action to be taken if any is warranted.
A copy of the complaint and the response will be forwarded to the City Manager for review prior to submittal to the protester. According to City policies, the decision of the Purchasing Officer is appealable to the City Manager. If no appeal has been received in the office of the City Manager, the decision of the Purchasing Officer shall be considered final on the fifth working day following the date of notification to the protester. Should an appeal be received by the City Manager, a response will be provided to the protester within five (5) working days and shall be considered final.
Whenever possible, the award of procurement will not be made final until all Proposal protests have been satisfactorily resolved. Final award will not be made until five (5) days after notification of protest decision has been provided to the protesting parties. The City does reserve the right to proceed with the award pending the resolution of the proposal protest when it is determined that:

DESIGN AND BUILD A RENEWABLE ENERGY AND STORAGE SYSTEM Page | 33 SECTION 6 – SCOPE OF WORK
6.1 General
Design documents shall be prepared and conform to applicable codes, design professional standards and standards of care. Awarded Contractor shall perform, diligently prosecute and complete the work in a good and workmanlike manner within contract time, and in strict conformity with all design documents. The design-builder shall produce required documentation in sufficient detail to obtain all regulatory approvals requested for design, construction and operation of the system, including but not limited to all federal, state, and local permits. Securing all approvals, all permits and paying all fees shall be the sole responsibility of design-builder. To that end, the Contractor shall provide a design acceptable to the state, county and local authorities having jurisdiction over this project. The proposed design shall be suitable for construction under the guidelines and regulations in effect at the time the agreement is executed. GTrans will not accept responsibility for cost increases or delays resulting from inaccurate interpretation of existing codes and standards at the time of submittal to the appropriate Authority Having Jurisdiction (AHJ) for approval.
The scope of this Project is all-inclusive and includes planning, engineering, labor, materials, delivery, installation, as well as maintenance as described below. Contractor shall apply for and obtain all necessary permits from applicable regulatory agencies including federal, state, and local jurisdictions.
If additional due diligence identifies deficiencies with a potential site, Contractor must address this issue in their Proposal and present potential solutions to GTrans. It is the responsibility of Contractor to perform sufficient due diligence to determine what will be required for proper implementation at each site.
In addition to collaborating with GTrans to maximize grant, incentive and tax rebate (e.g. Investment Tax Credit (ITC)) eligibility, the Contractor will be responsible for strategically leveraging this financial incentive to optimize project costs and overall project outcomes. This involves a thorough understanding of the eligibility requirements for each, which typically applies to renewable energy projects such as solar installations.
The Contractor will work closely with GTrans to assess the project scope, budget, and timelines to determine the most advantageous approach to utilizing additional grants, incentives and tax rebates.
This may involve conducting a detailed analysis of the potential tax savings and evaluating the implications of either retaining the tax credit for themselves or assisting GTrans in filing for the credit through the direct pay option.
If the Contractor opts to take grants, incentives or tax rebates themselves for an equivalent reduction in project cost, they must ensure compliance with all relevant tax laws and regulations. This may involve coordination with financial advisors or tax professionals to navigate the complexities of claiming the tax credit and optimizing the financial benefits for all parties involved.
Alternatively, if the Contractor assists GTrans in filing for specific grants, incentives or tax rebates which involve a direct pay option, they will be responsible for guiding GTrans through the application process, providing necessary documentation, and ensuring timely submission to maximize the financial benefit.
This involves meticulous attention to detail and proactive communication to ensure a smooth and efficient process.
Ultimately, the Contractor's expertise in managing grant, incentive or rebate eligibility and tax credit GTrans RFP 2024-07
DESIGN AND BUILD A RENEWABLE ENERGY AND STORAGE SYSTEM Page | 34 applications will play a crucial role in maximizing cost savings, enhancing project affordability, and achieving overall project success for GTrans. By effectively navigating the complexities of the additional external funding process, the Contractor can contribute to the financial viability and sustainability of the project while supporting GTrans in their decarbonization and energy efficiency goals.
6.2 Solar PV and BESS
GTrans intends to hire a design-build Contractor to design and construct a turnkey solar PV and BESS system on the Project Site to generate energy and offset electrical loads from both on-site electrical meters serving existing facilities and the CNG fueling station. Contractors may also propose upgrading/replacing existing solar PV and supporting infrastructure (inverter, DAS, etc) if financially prudent. GTrans is seeking Proposals that include a direct purchase of the project using non-federal grant funding. The Contractor shall consider the Site’s available solar resources; Site electrical switchboard bus ampacity(s); shading impacts of nearby obstacles; geotechnical, structural and load constraints; available space; utility interconnection requirements; ADA accessibility compliance; applicable Federal, California state, and local ordinances and codes; budget constraints; environmental issues and other relevant factors. Contractor will be responsible for all activities related to interconnection and metering through Southern California Edison (SCE) and City of Gardena. For bidding purposes, two different approximate system sizes are envisioned:
• Existing Meter + EV Load: 550kW Solar PV, 700kW/1400kWh BESS • CNG Meter + Bldg A Load: 440kW Solar PV, 450kW/900kWh BESS
6.3 Natural Gas Generator
GTrans intends to hire a design-build Contractor to design and construct all infrastructure to integrate a natural gas generator into the site. The existing CNG storage design and installation project included provisions for a 1250KVA natural gas generator but did not procure or install the generator as part of that scope of work. The Contractor shall consider CNG compression and fueling loads as well as Building A loads to validate the generator size and suitability. While GTrans will be responsible for the procurement of the generator using Federal grant dollars, the Design-Builder will be responsible for generator installation, civil improvements, electrical connections and tie-in to existing manual transfer switch, procurement and installation of the Automatic Transfer Switch (ATS), and repowering of Building A from the new CNG Main Switchboard. Design-Builder should review CNG plans and attachments to understand existing work. It is the intent of this RFP that the Design-Builder will instruct GTrans on the appropriate generator to procure and design, install, and commission a fully functional backup generation system. This part of the scope should be prioritized (within 90 days of project kick off) due to long lead times of generator equipment procurement.
Upon inspection of the installation, GTrans has already noted that there is no conduit from the main CNG switchgear to the generator location for the block heater and battery tender. The Design-Builder should account for adding this in their design and pricing.
6.4 Selected Solar PV Sites and Supporting Information
Attachment 1 – Site Overview provides preliminary solar array locations for the Site as well as the approximate annual electricity usage for the applicable loads. Contractors may use this data as a reference for further design of the turnkey solution.
Attachment 6 – Supporting Documents contains additional information to be used as a guide in developing proposed PV system sizes. Should Contractors disagree with or want to further refine the GTrans RFP 2024-07
DESIGN AND BUILD A RENEWABLE ENERGY AND STORAGE SYSTEM Page | 35 estimated meter loads provided, please include your assumptions used when creating simulated load profiles for both meters.
Contractors shall submit pricing for the system sizes prescribed above and are encouraged to submit alternative system designs should their experience indicate there is a materially different system size which maximizes financial net benefit to GTrans under NEM 3.0 rules, using solar and battery technology to minimize uncompensated exports. Full as-built documents for the CNG installation and the existing site are included as part of Attachment 6, Supporting Documentation.
Contractors must submit a schedule for design and installation of the Site. It is anticipated that construction of the Project will occur year-round, and that the Contractor will prioritize work to minimize disturbance to GTrans operations with construction phasing plans and parking closures approved by GTrans before proceeding.
6.5 General Design and Service Requirements of the Solar PV And BESS The successful Contractor will be responsible for completing “turnkey” PV and BESS Systems on the sites, including design/engineering, permitting, procurement, construction, installation and equipment commissioning/start-up, permitting, and ongoing operations and maintenance. The Contractor will act as the primary liaison with permitting and licensing agencies.
Contractors are expected to specify equipment control systems (Solar Data Acquisition Systems, Battery Storage Control, EV Charger Control) which are able to provide real time operational data and accept control signals via commonly accepted open protocols standards. As part of this work, Contractors will be expected to coordinate with GTrans and their existing site control vendors to figure out the best way for all systems to communicate together and operate in a way which maximizes the benefit to GTrans.
Products, components, construction, and installations must comply with applicable codes, standards, and rating methodologies. Minimum requirements of a general nature are outlined in Attachment 2 – General Design Requirements; the requirements described are not intended to be complete or comprehensive. Further detail for specifications can be found in the latest edition of Greenbook:
Standard Specifications for Public Works Construction. Attachment 2 and Greenbook are intended to provide Contractors with an overview of the general requirements; the following do not modify, limit or waive requirements established by the Agreement or GTrans’ General Conditions as awarded.
6.6 Additional Charging Infrastructure Scope of Work
GTrans intends to electrify its Microtransit fleet as well as provide EV charging for its employees’ vehicles. With the cutover of Building A to their CNG meter, additional electric capacity will be freed up on their existing site meter which GTrans would like to dedicate to installing Level 2 EV charging for the above vehicle types. See Attachment 1 – Site Overview for an illustration regarding this plan. As GTrans’ Microtransit fleet is still under transition, GTrans envisions that the Contractor will install eight (8) 80A Level 2 EVSE to serve their Microtransit fleet, with provisioning for eleven (11) more stalls along the eastern wall inside their transit yard. On the other side of this wall, and potentially sharing the same infrastructure, GTrans would like to install an additional five (5) 40A Level 2 EVSE for their employees and guests. As they would like to disrupt employee parking once in the near term future, they would also like the contractor to install conduit for another nineteen (19) chargers for employee and visitor parking. The stalls under consideration for EV charging in the main lot are not assigned stalls, but they are reserved for staff and GTrans visitors only. They are not open to the general public.
As these growing EV charging loads are envisioned to be served by GTrans’ main existing meter, a GTrans RFP 2024-07
DESIGN AND BUILD A RENEWABLE ENERGY AND STORAGE SYSTEM Page | 36 charge management system should be proposed to ensure charging demand does not exceed the existing switchgear capacity, and that charging demand can be limited during high peak rate times. EV Chargers should be able to communicate via SIM card and not need GTrans’ local network for communication.
Security lighting should be added to areas where vehicles will be plugging in and appropriate provisions for ADA stalls (Van accessible and standard) should also be made in the employee parking lot which connect to existing paths of travel.
