SUMMARY
Purpose of
Report
EnviroBusiness Inc. (dba EBI Consulting) has been contracted by ExteNet to evaluate potential
environmental noise impacts for Verizon Site CA002_GLENDALE_137 located in Front Of 1544 Kenneth
Rd in Glendale, California. This report summarizes the results of EBI’s technical review of equipment specifications in relation to the
Exterior Noise Standards as outlined in the City of Glendale Municipal Code, Section 8.36, Article I,
General Provisions. Theoretical results included in this report are based on equipment and site data
provided by ExteNet on March, 19 2021. Subsequent changes to the site design may yield changes in the
projected post construction noise levels or compliance with applicable regulations and guidelines.

Statement of
Compliance
Based on the results of this study, EBI concludes that the noise produced from operation of the proposed

6.0 RESULTS AND

CONCLUSIONS
Projected noise levels from the equipment installation in Front Of 1544 Kenneth Rd were calculated using
the methodology shown in Appendix B, and equipment data provided by the manufacturer for the
proposed antennas are provided in Appendix A for the purposes of this study. The proposed installations
will not utilize any external alarms.

Sound level propagation calculations were performed to determine a minimum compliance distance for
equipment-generated noise from any residential building façade. The sources and receiver were assumed
to be at the same reference height in order to account for balconies, open windows, and changes in
elevation at adjacent properties in the site vicinity. Equipment was assumed to be operating continuously
24-hours per day. All calculations shown in Table 3 assume a free-field environment with no ground
absorption, reflecting surfaces, barriers, or other obstructions. Audible equipment noise impact varies
greatly under different ambient noise conditions.

TABLE 3 – CALCULATED SOUND LEVEL RESULTS AND

APPLICABLE LIMITS
Minimum Compliance
Distance

Façade
Source

1.3 feet
Equipment
(See <45 dBA Table 2)
The sound pressure level from operation of each 6705 unit was assumed to be 32 dBA of spherical
distribution when measured at a distance of 3.3 feet. The combined sound pressure level of the three
proposed Ericsson 6705 antennas is less than 45 dBA when measured at a distance of

1.3 feet.

The pole on which the proposed equipment will be mounted is located at least 46 feet from a residential
building façade.

Therefore, using the site design furnished by ExteNet and Verizon Small Cell and the analysis outline
above, EBI concludes that the proposed CA002_GLENDALE_137 Small Cell installation located in Front
Of 1544 Kenneth Rd in Glendale, California will comply with the acoustic requirements of the Exterior
Noise Standards as outlined in the City of Glendale Municipal Code, Section 8.36, Article I, General
Provisions.

METHODOLOGY
All sounds originate from a source. The sound energy, produced by a source, creates variations in air
pressure, which travels in all directions much like a wave ripples across the water.

The “loudness” or
intensity of a sound is a function of the sound pressure level, defined as the ratio of two pressures: the
measured sound pressure from the source divided by a reference pressure (i.e. threshold of human
hearing). Sound level measurements are most commonly expressed using the decibel (dB) scale. The
decibel scale is logarithmic to accommodate the wide range of sound intensities to which the human ear
is capable of responding. On this scale, the threshold of human hearing is equal to 0 dB, while levels above
140 dB can cause immediate hearing damage.

One property of the decibel scale is that the combined sound pressure level of separate sound sources is
not simply the sum of the contributing sources. For example, if the sound of one source of 70 dB is added
to another source of 70 dB, the total is only 73 dB, not a doubling to 140 dB. In terms of human perception
of sound, a 3 dB difference is the minimum perceptible change for broadband sounds (i.e. sounds that
include all frequencies). A difference of 10 dB represents a perceived halving or doubling of loudness.

Environmental sound is commonly expressed in terms of the A-weighted sound level (dBA). The Aweighting is a standard filter to make measured sound levels more nearly approximate the frequency
response of the human ear. Table 1 and Figure 2 show the adjustments made at each octave band
frequency to contour un-weighted sound levels (dB) to A-weighted sound levels (dBA). This frequency
response is defined in the American National Standards Institute Standard No. 5.1 and most other relevant
standards related to measurement of noise levels.

Environmental sound varies depending on environmental conditions. Some sounds California are sharp impulses
lasting for short periods, while others rise and fall over longer periods. There are various measures
(metrics) of sound pressure designed for different purposes. The Leq, or equivalent sound level, is the
steady-state sound level over a period of time that has the same acoustic energy as the fluctuating sound
that was measured over the same period. The Leq is commonly referred to as the average sound level
and is calculated automatically by the sound level meter using methods defined in ANSI S1.4-19831.

Manufacturer-provided data for noise-generating equipment typically includes a measured sound pressure
level (Lp), expressed in A-weighted decibels, taken at a specific distance from the equipment, known as a
reference distance. For the purposes of this report, L refers to the measured sound level, and r refers
1 1
to the reference distance from the
source.

Sound varies inversely as the square of the distance from the source increases. This property of sound
propagation is used to determine the sound levels at various distances from the source when L1 and r1
have been provided. In an unobstructed free-field environment, without any barriers or reflecting surfaces,
sounds pressure drops by 6 dBA with each doubling of distance. This relationship is expressed in the
following
equation: 퐿
푟1
= 퐿 − |20 ∗ log ( ) | 2 1 푟
2 Where r refers to the distance at distance 2 and L refers to the sound level in dBA at distance 2.
2 2
When multiple sound sources are combined, the LP values for each source must first be converted to
sound power (LW). 푄 퐿푊 = 퐿푃 + |10 ∗
log ( ) | 4휋 ∗
푟2
In this report, EBI has assumed Q (directionality) is equal to 1 to represent fullsphere propagation.

The resultant LW values are then added together, using logarithmic decibel addition, where 퐿∑ refers to the total sound power level, and L , L , etc. refer to the sound power of different individual sources.

퐿1 퐿2 퐿푛
퐿∑ = 10 ∗ 푙표푔10 (10
10 + 1010 +
⋯ 10

The total sound power (L ) of all proposed sources is then used to calculate the total sound pressure level (L ) at
W P
a reference distance
(r).

I. SUMMARY
Telecom Law Firm, PC (“TLF” or “We”) recommends that the City of Glendale (“City”) deem Extenet Systems Inc. (“Applicant”) application (submittal on behalf of Verizon Wireless (“Verizon”) as being MATERIALLY INCOMPLETE for the reasons set out below.

TLF recommends that the City send the incomplete notice by email no later than March 3, 2023, based on the receipt date of the project on February 21, 2023), and on the same day also sends it by First Class or Certified U.S. Mail postage prepaid.

TLF notes that the overall shot clock associated with this project is 90 calendar days given that the Applicant proposes to install a new wireless site on a replacement light standard pole (“Pole”) in the public right-of-way (“PROW”).

The list of incomplete items in this memorandum contains TLF’s observations. Under existing FCC rules, if the City is aware of other incomplete items, the City must include those other items in the same incomplete notice that also transmits this memorandum to the Applicant.

The observations and the conclusions within this memorandum apply only to the specific project identified above at the specific location indicated and do not, in any way, apply to any other proposed project(s) regardless of how similar to the instant project another project may appear.

II. DISCUSSION
The Applicant submitted this project to the City on February 21, 2023. The Applicant’s set of plans are dated January 11, 2023, (“Plans”).

III. APPLICATION COMPLETENESS REVIEW
Based on the City’s Public Works Engineering Application and Permit for Encroachment, the City’s Municipal Code, the Wireless Telecommunication Encroachment Permit Checklist (“WTEP Checklist”), and the City’s Supplemental Application Form for Wireless Projects and Distributed Antenna System (“DAS”) Projects, TLF recommends that the City deem the Applicant’s application submittal materially incomplete and issue an incomplete notice regarding the items discussed below:

SWF Supplemental Information: The applicant has not completed and submitted the information to support evaluation of whether the proposed facility qualifies as a Small Wireless Facility under 47 C.F.R. § 1.6002(l).

Plans: Missing required stamp. The Plans must be prepared, signed, and stamped by a California Registered Civil Engineer.

Site Survey: Missing required stamp. Should be prepared, signed, and wet stamped by a California Registered Civil Engineer or Licensed Surveyor.

Traffic Control Plans (“TCP”): TLF was unable to locate the TCP within the Plans.

Radio Frequency (“RF”) Report: TLF recommends that the City request that the Applicant update the RF report to demonstrate the emissions (in elevation view and plane view) in relation to the surrounding of the proposed location of the wireless application. The emissions need to be color coded and show the extent of the reach within the surrounding of the proposed Pole.

The RF report is missing the following:
• the boundaries of areas with RF exposures in excess of the uncontrolled/general population limit (as that term is defined by the FCC). • the boundaries of areas with RF exposures in excess of the controlled/occupational limit (as that term is defined by the FCC). • the outline of all structures on public or private land that are within 20 feet of the proposed WF site antennas.

Letter of Authorization (“LOA”): TLF was unable to find the LOA from the Pole owner for the replacement of the Pole.

Business License: Missing. TLF recommends that the City review and request a valid City business license number from the Applicant.

RADIO FREQUENCY PLANNING MEMORANDUM
TO: Mr. Soroush Sheikhlar and Mr. Benjamin Gonzalez
FROM: Dr. Jonathan Kramer
DATE: April 26, 2023
RE: (Glendale 237)(EP 823) Radio Frequency Review for
Proposed New Wireless Site-Mounted on Replacement
Pole near 1544 West Kenneth Road.

Applicant: Extenet Systems, CA LLC
Carrier: Verizon Wireless
Site ID: SW-CA-GLENDA-00237C

1. Summary
The City of Glendale (the “City”) requested that Telecom Law Firm, PC (“TLF”) review the Extenet Systems, CA LLC (“the Applicant”) application materials submitted on behalf of Verizon Wireless (“Verizon”) to construct a new wireless site located on a replacement light standard (“Pole”) located near 1544 West Kenneth Road. (Coordinates: LAT 34.174022°, LON 118.282517°).

The wireless application was initially submitted to the City on February 21, 2023. On March 1, 2023, the City timely issued a notice of incomplete (“NOI”) for the incomplete items in the application. On April 17, 2023, the Applicant resubmitted additional application materials. Due to the type of wireless application being a small wireless application and the City timely issuing the NOI, the shot clock reverted to day zero. Therefore, April 18, 2023, was day 1 on the overall shot clock. The project has an overall shot clock of 90 calendar days (the underlying structure is being replaced).

Verizon’s proposed facility demonstrates planned compliance with the FCC RF emissions guidelines. We recommend that the City condition any permit issuance for this project to be subject to the conditions proposed in this memorandum regarding RF emissions safety.

The observations and the conclusions within this memorandum apply only to the project identified above and do not, in any way, apply to other project proposals regardless of how similar any other project may seem.

2. Project Description
The Applicant submitted project plans dated April 12, 2023 (“Plans”) that show that Verizon proposes to remove the existing light standard to be replaced with a 25' above ground level (“AGL”) Pole. The Pole will move approximately 5 feet south from its original location. An overview of the location of the Pole can be seen in Figure 1. 578 of 642

3. Planned Compliance with RF Exposure Regulations
Under the federal Telecommunications Act, the FCC completely occupies the field with respect to RF emissions regulation. The FCC established comprehensive rules for human exposure to RF emissions (the “FCC Guidelines”).1 State and local governments cannot regulate wireless facilities based on environmental effects from RF emissions to the extent that the emissions comply with the FCC Guidelines.2
Although localities cannot establish their own standards for RF exposure, local officials may require wireless applicants to demonstrate compliance with the FCC Guidelines.3 Such demonstrations usually involve a predictive calculation because the site has not yet been built.

3.1 FCC Guidelines
FCC Guidelines regulate exposure rather than emissions. 4 Although the FCC establishes a
maximum permissible exposure (“MPE”) limit, it does not mandate any specific limitations on power levels applicable to all antennas and requires the antenna operator to adopt exposuremitigation measures only to the extent that certain persons might become exposed to the emissions. Thus, a relatively low-powered site in proximity to the general population might require more comprehensive mitigation measures than a relatively high-powered site in a remote location accessible only to trained personnel.

The MPE limit also differentiates between “general population” and “occupational” classes.

Most people fall into the general population class, which includes anyone who either does not know about potential exposure or knows about the exposure but cannot exert control over the transmitters.5 The narrower occupational class includes persons exposed through their employment and able to exert control over their exposure.6 The MPE limit for the general population is five times lower than the MPE limit for the occupational class. 1 See 47 U.S.C. § 332(c)(7)(B)(iv); see also 47 C.F.R. § 1.1307 et seq.; FCC Office of Engineering and Technology, Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, OET Bulletin 65, ed. 97-01 (1997). 2 See 47 U.S.C. § 332(c)(7)(B)(iv). 3 See In re Procedures for Reviewing Requests for Relief from State and Local Regulations Pursuant to Section 332(c)(7)(B)(iv) of the Communications Act of 1934, Report and Order, 15 FCC Rcd. 22821, 22828–22829 (Nov. 13, 2000) (declining to adopt rules that limit local authority to require compliance demonstrations). 4 See generally Human Exposure to Radio Frequency Fields: Guidelines for Cellular and PCS Sites, Consumer Guide, FCC (Oct. 22, 2014), available at https://www.fcc.gov/guides/human-exposure-rf-fields-guidelines-cellular-andpcs-sites (discussing in general terms how wireless sites transmit and how the FCC regulates the emissions). 5 See 47 C.F.R. § 1.1310, Note 2. 6 See id. 583 of 642

Telecom Law Firm PC
Lastly, the FCC “categorically excludes” certain antennas from routine environmental review when either (1) the antennas create exposures in areas virtually inaccessible to humans or (2) the antennas operate at extreme low power. As a general rule, a wireless site qualified for a categorical exclusion when mounted on a structure built solely or primarily to support FCClicensed or authorized equipment (i.e., a tower) and such that the lowest point on the lowest transmitter is more than 10 meters (32.8 feet) above ground.7 Categorical exclusions establish a presumption that the emissions from the antennas will not significantly impact humans or the human environment. Such antennas are exempt from routine compliance evaluations but not exempt from actual compliance. Under some circumstances, such as a heavily collocated tower or when in close proximity to general population members, even a categorically excluded site will require additional analysis.

3.2 Planned Compliance Evaluation and Recommendations
The FCC does not categorically exclude Verizon’s proposed facility from routine compliance review because the underlying structure was originally constructed for illumination purposes, which was not primarily built to support wireless equipment. Also, the lowest point of the proposed antennas is lower than 10 meters AGL. Therefore, an additional analysis is necessary to determine whether the proposed antennas will demonstrate planned compliance with the FCC Guidelines.

To demonstrate compliance the Applicant submitted a Radio Frequency Compliance Report prepared by EBI Consulting, stamped, and sealed December 30, 2022 (“EBI RF Report”). The EBI RF Report contains the necessary RF emissions information for TLF to carry out an independent RF analysis.

Based on the antenna power emissions, Verizon’s antennas will create a “controlled access zone” for all three sectors that extends approximately 6 feet horizontally from the face of the antennas at approximately the height of 27' AGL.

The antennas will emit into airspace and TLF agrees with the EBI Report that there are no adjacent structures with 50 feet of the antennas that exceed the FCC’s standards for RF safety, as described in Figure 6.

Figure 6: Nearest structure (Source: EBI RF Report).

The fact that the emissions would create a controlled access zone does not mean that the facility will violate the FCC Guidelines. Rather, a controlled access zone means that the carrier must affirmatively restrict public access to that area so that members of the general population (including trespassers and utility workers) cannot unknowingly enter and be exposed to radio frequency emissions in excess of those allowed by the FCC.

TLF agrees with the signage recommendations in the EBI RF Report, see Figure 7.

Figure 7: RF signage recommendations on the rooftop (Source: EBI RF Report).

To promote planned compliance with the FCC Guidelines, we recommend the City should add the following conditions of approval for this project:

1. Permittee shall ensure that all federally-required radio frequency signage be installed and maintained at all times in good condition. All such radio frequency signage be constructed of hard materials and be UV stabilized. All radio frequency signage must comply with the sign colors, sign sizes, sign symbols, and sign panel layouts in conformance with the most current versions of ANSI Z535.1, ANSI Z535.2, and ANSI C95.2 standards. All such radio frequency signage, or additional signage immediately adjacent to the radio frequency signage, shall provide a working local or toll-free telephone number to its network operations center that reaches a live person who can exert transmitter power-down control over this site as required by the FCC.

2. In the event that the FCC changes any of radio frequency signage requirements that are applicable to the project site approved herein or ANSI Z535.1, ANSI Z535.2, and ANSI C95.2 standards that are applicable to the project site approved herein are changed, 585 of 642

CITY OF GLENDALE, CALIFORNIA

REPORT TO THE CITY COUNCIL

AGENDA ITEM
Report: Fifth Public Hearing Regarding the Composition of Council Districts Related to the City's Proposed Transition to District-Based Councilmember Elections and Discussion of Potential Amendments to City Charter

1. Motion Directing Staff Regarding Council Districts

2. Motion Directing Staff Regarding Potential Charter Amendments

COUNCIL ACTION
Item Type: Public Hearing
Approved for November 7, 2023 calendar

EXECUTIVE SUMMARY
This matter is the fifth public hearing on city council districts. Staff seeks additional direction on the narrowing of maps for further stakeholder outreach, as well as additional input on a narrowed group of charter amendments. At a study session on October 24, 2023, the Council reduced the number of maps for consideration to seven maps. The City’s demographer, National Demographic Corporation (NDC), has also prepared three variations of one of those maps based on Council feedback. The Council also decided on October 24, 2023 that it will not move forward to put a selected map and proposed charter amendments to implement an expanded council, council districts and directly elected mayor on the ballot for the March 2024 election, leaving open the possibility of putting the matters on the November 2024 ballot. There are some charter amendments not dealing with districts and Council governance that the Council wanted to consider and they are presented here. 587 of 642
2 b 9

RECOMMENDATION
That the Council hold the public hearing and provide direction on districts and potential charter amendments.

ANALYSIS
On May 2, 2023, the Council adopted Resolution No. 23-55 declaring its intent to initiate the process to transition from at-large to district-based councilmember elections pursuant to Elections Code section 10010. The Council directed staff to commence the process to transition to council districts by way of amendment to the City Charter, to include a proposal to transition to six (6) council districts and a directly elected mayor who would be a voting member of the Council. In addition to numerous public workshops, pop-ups and additional outreach, the Council has held five (5) public hearings on Council districts. Through this process, 39 draft maps were submitted to or prepared by the City for the Council’s consideration.

Districts
At the October 24, 2023 study session, the Council studied alternative voting methods and further studied the draft maps. The Council asked NDC to focus on seven (7) maps at this public hearing: Maps 106b, 107, 120b, 122, 124, 125 and 126. NDC has also prepared variations of Map 126 based on feedback at the October 24, 2024 study session (Maps 126b, 126c and 126d). These focus maps are attached as Exhibit 1 and can also be found on the City’s districting website as well as on the interactive map viewer: https://mapglendale.org/draft-maps/
District Criteria
In accordance with Elections Code section 21601, the Council must draw districts that satisfy the following criteria:
• Council districts must be substantially equal in population based on the total population of residents of the city as determined by the most recent census with adjustments mandated by the State of California.
• Council district boundaries must comply with the United States Constitution, the California Constitution, and the federal Voting Rights Act. • The Council shall adopt district boundaries using the following criteria as set forth in the following order of priority:
(i) To the extent practicable, council districts shall be geographically contiguous. (ii) To the extent practicable, the geographic integrity of any local neighborhood or local community of interest shall be respected in a manner that minimizes its division. A “community of interest” is a population that shares common social or economic interests that should be included within a single district for purposes of its effective and fair representation. Communities of interest do not include relationships with political parties, incumbents, or political candidates. 588 of 642
3 b 9
(iii) Council district boundaries should be easily identifiable and understandable by residents. To the extent practicable, council districts shall be bounded by natural and artificial barriers, by streets, or by the boundaries of the city. (iv) To the extent practicable, and where it does not conflict with the preceding criteria, council districts shall be drawn to encourage geographical compactness in a manner that nearby areas of population are not bypassed in favor of more distant populations.
• The Council must not draw district boundaries for the purpose of favoring or discriminating against a political party.

Potential Charter Amendments
As noted, the Council’s direction is to pursue additional stakeholder outreach on a district plan with the understanding the plan will not be submitted to the voters in March 2024. To that end, Council directed a hold on the charter amendments that would create a directly elected mayor position, council districts, an expanded council, and amendments to City Council compensation, which may be considered at a later time.

Council directed that staff provide an update on the remaining potential charter amendments for consideration for the March 2024 election. The proposed amendments are set forth in Exhibit 2 and are summarized below.

Contracts
Staff is proposing a revision to Article VI, Section 9 that would allow the Council to adopt the standards and procedures for awarding contracts in light of best practices in contracting procurement and provide more flexibility to utilize contract delivery systems that are alternative to traditional design-bid-build, lowest-responsible-bid contracts, such as design-build and construction manager at risk methodologies. In that regard, the existing provision would be amended to provide: “The council shall by ordinance establish standards, procedures, rules or regulations relating to all aspects of the award and performance of contracts, including contracts for the construction of public improvements, including, but not limited to, compensation paid for performance of such work.”
Civil Service System
The City Charter establishes and, along with Civil Service Rules and Regulations (“Rules”), governs the City’s civil service system, which is overseen by the Civil Service Commission (“Commission”). The Council has inquired about updating the civil service system to provide more flexibility in the available methods for recruitment, hiring and promotions, among other potential revisions to the civil service system. Currently, the Charter provides that the Rules can be revised if approved by both the Council and the Commission. However, some requirements of the civil service system are also requirements imposed by the City Charter, meaning those requirements cannot be amended except by also amending the Charter, which requires approval by the voters. 589 of 642

One example of this is the “Rule of Three” – the rule in the Charter that establishes eligible lists for open positions, and requires the appointing authority to pick from only the top 3 individuals on the list. Other jurisdictions use other methods as an alternative to the Rule of Three in their hiring decisions. Other rules embedded in the Charter include rules regarding “open and promotional” exams and rules limiting probationary periods to 12 months.

Generally, amendments to Charter provisions and Rules governing hiring and promotional procedures and other civil service requirements are deemed to affect terms and conditions of employment subject to bargaining (“meet and confer”) under the Meyers-Milias-Brown Act, Government Code sec. 3500 et. seq. As such, prior to submitting any charter amendments affecting the civil service system to the voters, the City will need to engage in the meet and confer process with the employee associations.

One suggestion that has been made is to propose a change to the Charter that would replace the existing extensive Charter provisions with a provision that provides that the Civil Service System will be governed by Council ordinance and that the existing Rules would remain in place until the City has followed the legal procedures to adopt an ordinance including the meet and confer process. For example, Burbank’s City Charter simply provides: “The Council shall provide for the establishment of a Civil Service System in the City of Burbank based on merit and suitability.” Such an amendment would provide flexibility to make future changes to the Civil Service System, while engaging in meet and confer discussions with the associations as changes are proposed. Possible language in this regard is provided in Exhibit 2.

Nevertheless, revising the Charter in the manner described above will still require bargaining, which requires the City to negotiate in good faith with all of the recognized bargaining units and utilize state-mandated impasse procedures if the parties cannot agree on a proposal to submit to the voters. Staff’s assessment, based on preliminary feedback from the associations it has discussed the matter with to date, is that there is insufficient time to complete the process in time to place this matter on the March 2024 ballot. In addition to input from the associations, staff is of the opinion that the Civil Service Commission’s input on this matter should also be solicited before moving forward. For these reasons, staff recommends incorporating this discussion into any discussion involving Charter amendments for the November 2024 ballot. Staff seeks further direction from Council on this matter.

Miscellaneous Changes
• Urgency Ordinances. The Charter requires ordinances to be introduced at one meeting and adopted at a subsequent meeting in which at least five days have elapsed. The Charter provides an exception where in the cases of an “extraordinary epidemic of disaster” the Council may introduce and adopt an emergency ordinance at the same meeting. Staff is proposing another exception for “urgency” ordinances where there is “a current and immediate threat to the 590 of 642
5 b 9
public peace, health, safety or welfare.” The most common urgency ordinance is a moratorium which most cities adopt on the same night as it is introduced, and which is permitted by state law. Creating this additional exception would permit the Council to enact these moratoria at one and the same meeting for the immediate preservation of public peace, health, safety or welfare. • Location of Council meetings. The Charter currently requires Council meetings to take place in Council chambers unless there is an emergency and it is unsafe to meet in chambers. There is another exception that allows meetings off-site to take testimony but any formal action of the Council must take place in the chambers.

Staff proposes a revision that would allow Council to meet in chambers or any other place prescribed by ordinance or resolution, or if the Council is compelled to meet elsewhere due by reason of emergency or “temporary unavailability of the regular meeting place.” (Article VI, Section 2)
• Obsolete References. The Charter calls for the establishment of a Maintenance Services Administrator and the Building Official to be officers of the City and to be established in the Department of Public Works. The Maintenance Services Administrator is not a job classification in the City any longer and the Building Official is not a part of the Public Works Department, instead housed in the Community Development Department. Staff proposes removing these obsolete references. (Article IV, Section 1 and Article XXI, Sections 1, 3 and 4). • Councilmembers Holding Other Offices During or Within two Years After Council Service. The Charter prohibits members of council from being employed by the City or from holding any other office while on Council or for two years after stepping off of Council. Staff proposes a change in language to confirm that the prohibition on serving in office or employment for two years after stepping off Council applies to appointed offices or employment only, and not to an office that is an elected position, such as Council, Clerk or Treasurer, regardless of whether an individual is elected or appointed (in the case of a vacancy) to such a position. This issue has been the subject of disputes (and even litigated) in the past and this confirmation is declaratory of the position the City has historically taken and that was upheld by the Attorney General and the courts. (Article VI, Section 12).

STAKEHOLDERS/OUTREACH
The stakeholder and public outreach conducted to date is discussed in the October 10, 2023 staff report attached as Exhibit 3. At Council’s direction, staff will conduct additional focused outreach with stakeholder groups upon the Council’s further narrowing of focus maps.

Persons employed to render professional, scientific, technical or expert service of an occasional and exceptional character.

Sec. 8. Tenure of officers and employees in present employment.

All persons in the classified service, whose appointments have become complete, shall be discharged only for cause as herein provided.

Sec. 8.1. (Repealed).

Sec. 9. Procedure as to removal, suspension and reduction in rank.

Any person employed in the classified service may be removed, suspended or reduced in rank or grade after appointment or promotion is complete by the appointing agency, for cause, by an order in writing stating specifically the reasons therefor. Said order shall be filed with the commission and a copy thereof served upon the employee so removed, suspended or reduced. Any person so removed, suspended or reduced may, within five (5) days after presentation to him of a copy of the order of removal, suspension or reduction, appeal to the commission from such order. The commission or its authorized representative shall, within two (2) weeks after the filing of said appeal, commence a proceeding to fully hear and determine the matter. If an authorized representative of the commission hears the appeal, any proposed determination shall be presented to the commission with a report of the proceedings and the commission shall review the same and make its determination adopting or modifying or revoking the determination made by the authorized representative. The commission’s determination shall be final.

Sec. 9b. Abolishment of positions.

When a position in the classified service is abolished, the reduction and termination of all persons affected thereby shall be in accordance with the rules and regulations of 625 of 642
the commission adopted for that purpose which shall follow as closely and practicable the reverse order of the lines of promotion and give credit according to seniority.

Sec. 10. Procedure as to appointments.

The person or persons having authority of appointment shall notify the commission of any appointment made, and the commission shall certify such fact to the director of administrative services. The director of administrative services shall not approve any salary or compensation for services to any person holding or performing the duties of a position in the classified service until the appointment shall have been so certified.

Sec. 11. Severability clause applicable to article; remedying defects caused by unconstitutionality.

If any section, subsection, sentence, clause, or phrase of this article is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this article. The electors hereby declare that they would have passed this article, and each section, subsection, sentence, clause, and phrase hereof, irrespective of the fact that any one (1) or more other sections, subsections, sentences, clauses, or phrases are declared unconstitutional. If any portion of this Charter relating to civil service should be held to be unconstitutional, the council shall by ordinance provide for a substitute for such portion in such manner as to remedy the defect.

Such position or positions, while filled by such temporary appointments, shall be in the unclassified service. The date of termination of a war or emergency, for the purposes of this section, shall be as fixed by proclamation of the President of the United States, or by concurrent resolution of the two (2) Houses of Congress of the United States, or by resolution of the council of the City of Glendale, whichever date is earliest. 626 of 642

Approved for October 10, 2023 calendar

EXECUTIVE SUMMARY
The Council has initiated the process to transition from its at-large council election system to council districts. This matter is the fourth public hearing to solicit public input on the council districts. In accordance with legal requirements, the City has also undertaken an extensive public outreach process, including public hearings, public workshops, pop-up events, press releases, social media and advertising.

Thirty-nine (39) draft maps have been submitted by members of the public or the City’s demographer; of those, four are not population balanced. The Council should take public input and discuss whether to identify a district map for adoption (subject to voter approval of the map and necessary charter amendments), identify two to three maps, if possible, for discussion at a future hearing, request the demographer to make modifications to one or more existing draft maps for future discussion, take an alternative action, or take no action. If the Council introduces the ordinance or provides direction regarding the narrowing or modification of maps, the City Attorney’s Office will also present the draft Charter amendments to implement the transition to a directly elected Mayor and Council district electoral system, along with other requested charter amendments including amendments relating to Council compensation, City contracts and other miscellaneous changes.

COUNCIL PRIORITIES
Improve Operations and Efficiency of City Government: Establishing City Council districts may improve operations and efficiencies by improving constituent services as councilmembers will have more day-to-day interaction with the residents and issues affecting particular neighborhoods.

RECOMMENDATION
That the Council conduct the fourth public hearing pertaining to the composition of council districts related to the City’s proposed transition to district-based elections and (i) identify a district map for adoption (subject to voter approval of the map and necessary charter amendments), (ii) identify a number of focus maps, such as two to three maps, for discussion at a future hearing, (iii) request the demographer to make modifications to one or more existing draft maps for future discussion, (iv) take an alternative action, or (v) take no action.

BACKGROUND
On May 2, 2023, the Council adopted Resolution No. 23-55 declaring its intent to initiate the process to transition from at-large to district-based councilmember elections pursuant to Elections Code section 10010. The Council directed staff to commence the process to transition to council districts by way of amendment to the City Charter, to include a proposal to transition to six council districts and a directly elected mayor who would be a voting member of the Council. The Council adopted Resolution No. 23-89 on June 13, 2023, revising the timeline set forth in Resolution No. 23-55. This hearing is the fourth public hearing the Council will hold regarding the composition of council districts.

ANALYSIS
Public Hearing
Pursuant to Elections Code section 10010, the Council is required to hold at least four public hearings The City held its first three public hearings on June 13, 2023, July 11, 2023 and August 15, 2023.

In addition to this public hearing, public hearings are scheduled for October 24, 2023 and, if necessary, November 7, 2023. The principal purpose of this fourth public hearing is for the City’s demographer, National Demographics Corporation (NDC), to provide an overview of the maps submitted by members of the public and those prepared by NDC, including those submitted by the second map submittal deadline of September 28, 2023.

District Criteria
In accordance with Elections Code section 21601, the Council must draw districts that satisfy the following criteria:
• Council districts must be substantially equal in population based on the total population of residents of the city as determined by the most recent census with adjustments mandated by the State of California.

3 a
• Council district boundaries must comply with the United States Constitution, the California Constitution, and the federal Voting Rights Act.

Draft District Maps
There are currently 39 draft maps that have been submitted to the City or prepared by the City’s hired demographer. Of the 39 maps, four are not population-balanced. The draft maps are attached as Exhibit 1 and can also be viewed using an Interactive Review Map available at https://mapglendale.org/draft-maps/. NDC will provide a review during the public hearing.

Sequencing of Districting Elections
Elections Code § 10010 contains provisions governing the sequencing of elections in the new districts:
1) The draft districting plans made available during the second round of public hearings include a “potential” sequencing of elections for each draft plan as required by Elections Code section 10010(a)(2).
2) Elections Code section 10010(b) specifies two criteria for “consideration” in setting the sequencing. Those criteria are “consideration to the purposes of the California Voting Rights Act” and “tak[ing] into account the preferences expressed by members of the districts.” The sequencing of elections published with the draft plans, however, is only proposed sequencing. The sequencing of elections in the districts of the finally adopted new districting plan is at the discretion of the Council. In addition to the considerations required by Section 10010(b), cities commonly consider:

a. Completion of the terms of incumbents elected at-large. For example, a councilmember whose term ends in 2028 serves out the full four-year term even if that member resides in the same district as an incumbent whose term ends in 2026 and that district is placed on the 2026 ballot.
b. Scheduling elections in a particular district based on the expiration of the term of office of the incumbent who resides in the district. For example, a district in which an incumbent resides with a term ending in 2026 could be placed on the ballot in 2026. A district in which two incumbents reside with respective terms ending in 2026 and in 2028 could be placed on the ballot in 2026 or 2028. If in 2028, the incumbent with a term ending in 2026 would be out of office after the 2026 elections, but he or she could run again in 2028 for the district seat in which he or she resides.
c. If the district seat were placed on the ballot in 2026, an incumbent with the term ending in 2028 would serve out the full four-year at-large term to which elected, and then could seek election in 2028 for the district seat. Alternatively, that incumbent could run for the district seat in 2026 and, if elected, resign from the at-large seat on the City Council, creating a vacancy to be filled in accordance with the city’s laws. d. Scheduling elections in a district in which no current incumbent resides at the earlier election cycle consistent with maintaining the appropriate number of Council Members.

As noted in a prior report, these iterations aside, with an expanded Council, it would appear that three district seats for four-year terms would be up for election in 2026, along with a two-year seat. In 2028, three four-year district seats would be up for election, and then three four-year seats would be up for election every two years after that, assuming no vacancies.

STAKEHOLDERS/OUTREACH
The City has conducted an extensive public outreach process. In addition to five public hearings to date, the City has held 14 public workshops and six pop-ups. The City has utilized social media, advertising, and press releases. The outreach has been in multiple languages – English, Armenian, Spanish, Korean, and Tagalog. A website dedicated to the districting effort, which includes the draft maps and pertinent updates, has been established at https://mapglendale.org. Between June 1, 2023 and October 4, 2023, there have been 15,000 new users and 91,000 in event count. An event is a user's specific action on the site, such as clicking a button, playing a video, or submitting a form. The public comments received through the various fora, including comments provided at workshops and sent to the website, are included in Exhibit 2.

Although the deadline to submit draft maps has expired, residents and stakeholders are welcome to submit public comments on the process by sending a direct email to 630 of 642
