A couple of excavations maybe 3 feet long, 2 feet wide, and to the bottom of the footings is sufficient for the footings scan, the wall is easier with no other requirements. The footings excavations in the parking lot will require the concrete to be cut for the r-scan technician to perform the test. This r-can test will determine the following criteria: rebar size, rebar lap, rebar horizontal spacing, rebar vertical spacing. I’ve talked to a local firm qualified to do the test and the price is in the $1,200.00 range- not included is concrete cutting for the parking lot/footing and repair.

The City hired Mr. Rose as its Building Inspector because of his knowledge and expertise concerning the Building Code and construction. He has affirmatively stated his position that an R-scan is required to inspect the rebar in both the block wall and the concrete footings for this wall, although some minor excavation work will also be necessary for the footings (but not the wall). Staff agrees that this is a reasonable request and not unreasonably costly. Mr. Rose states that an R-scan can be obtain for approximately $1,200.00, which is very reasonable compared to the costs of the excavations that would otherwise be required for Mr. Rose to ascertain if the building permit can be issued. Mr. Rose does not provide an estimate of the costs of the minor excavations of the footings, but these costs should also not be excessive.

Finally, it should be noted that the City Council is prevented by law from directing Mr. Rose to accept the photographs provided by the applicant to demonstrate that the rebar complies with the Building Code as opposed to Mr. Rose’s request for an R-scan (and minimal excavation work). There may be some ways for the applicant to “appeal” Mr. Rose’s directions, but none of these options would involve the City Council. There is no need to get into detail about this as this report is intended to provide information to the City Council about the progress (or lack thereof) being made by the responsible parties towards compliance. Should it become necessary to provide information to the City Council about the various options available to the responsible parties if they absolutely refuse to comply with Mr. Rose’s directions, staff will provide this information to the Council at the next Council meeting (or as otherwise directed by the Council). For present purposes, it is sufficient for staff to inform the Council that the building permits required for the responsible parties to obtain compliance as directed by the Compliance Order will not be issued by the City’s Building Inspector unless an R-scan is performed (along with some limited excavation work for the concrete footings).
