City of Hemet
City Council Meeting

STAFF REPORT

Meeting: City Council Meeting - Jun 28 2022
Department: Finance
Submitted by: Eddie Pust, Acting City Manager
Lorena Rocha, Finance Director;

☐ Receive and File ☒ Consent Calendar ☐ Business Item ☐ Public Hearing

TITLE:

A Resolution of the City Council of the City of Hemet, California, Authorizing “Essential Worker” Premium Pay for Eligible Non-Represented Employees and Authorizing the Finance Director to record a Supplemental Appropriation of $60,000 in FY2022/2023 in support of this Resolution

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Adopt a Resolution of the City Council of the City of Hemet, California, Authorizing "Essential Worker" Premium Pay or One Time Bonus Payment for Eligible Non -Represented Employees and Authorizing the Finance Director to record a Supplemental Appropriation of $60,000 in FY2022/2023 in support of this Resolution.

BACKGROUND:

On March 11, 2021, the American Rescue Plan Act was signed into law, and established the Coronavirus State Local Recovery Fund and Coronavirus Local Fiscal R ecovery Funds (“SLFRF”) program. This program is designed to deliver $350 billion to support State, territorial, local, and Tribal governments in responding to the economic and public health impacts of COVID-19 and in their efforts to contain impacts to their communities, residents, and businesses.

The City of Hemet was allocated $21,674,344 in ARPA funds and has received the first half of these funds with the second payment due by May 2022.

ANALYSIS:

Prior to the disbursement of this additional pay, staff was required to meet and confer with represented bargaining groups regarding the terms and conditions of the premium pay.

Staff met with all bargaining units and Council has approved the following MOU's which include Essential Worker Premium Pay or One Time Bonus Payments:

Page 1 of 6 ends

Page 803 of 859 ends

On March 8, 2022, the City Council approved a Memorandum of Understanding with the Hemet Police Officers Association for the period of July 1, 2021 to June 30, 2024.

On April 12, 2022, the City Council approved a Memorandum of Understanding with the Hemet Police Management Association for the period of July 1, 2021 to June 30, 2024.

On May 24, 2022, the City Council approved a Side Letter to the Memorandum of Understanding with the Hemet Fire Fighters Association extending the term of the agreement to June 30, 2024.

On June 14, 2022, the City Council approved a Memorandum of Understanding with the Hemet Non - Sworn Police Employees Association for the period of July 1, 2022 to June 30, 2024.

Staff has placed the MOU's for HMMA and SEIU as well as the Management/Confidential Group Resolution on the June 28, 2022 Council Agenda for consideration.

Staff is seeking authorization to also approve the same premium pay criteria f or non -represented employees. This includes all non -represented Battalion Chiefs and At -Will Employees and the only employees who qualified for this bonus but have not been included in any of the bargaining units noted above.

DISCUSSION:

In addition to using the funds to respond to the economic and public health impacts of COVID-19, funds may be used to provide premium pay to eligible City of Hemet employees who performed essential work during the public health emergency.

Subsection (c) of Section 803 concerns the requirements regarding the use of funds by qualified cities and counties, and provides for four permissible uses of such funds, including:

To respond to workers performing essential work during the COVID –19 public health emerg ency by providing premium pay to eligible workers of the metropolitan city, non -entitlement unit of local government, or county that are performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work;

(Sec. 803(c)(1)(B), emphasis added.)

Since the purpose of such premium pay is “to respond to workers performing essential work during the COVID-19 public health emergency,” the ARPA limits eligibility for the receipt of such premium pay to employees who actually performed essential work during the public health emergency.

Subsection (g) defines “eligible workers” to mean “those workers needed to maintain continuity of operations of essential critical infrastructure sectors and additional se ctors as each chief executive officer of a metropolitan city, non -entitlement unit of local government, or county may designate as critical to protect the health and well -being of the residents of their metropolitan city, non -entitlement unit of local government, or county.”

The Interim Final Rule requires that jurisdictions justify the provision of premium pay to high -income employees:

Page 2 of 6 ends

15.T

Page 804 of 859 ends

If premium pay would increase a worker’s total pay above 150 percent of their residing state’s average annual wage for all occupations, as defined by the Bureau of Labor Statistics’ Occupational Employment and Wage Statistics, or their residing county’s average annual wage, as defined by the Bureau of Labor Statistics’ Occupational Employment and Wage Statistics, whichever is higher, on an annual basis, the State, local, or Tribal government must provide Treasury and make publicly available, whether for themselves or on behalf of a grantee, a written justification of how the premium pay or grant is responsive to workers performing essential worker during the public health emergency.

It has been determined that 50 City employees currently eligible for this premium pay have an annual wage above 150% of the state average. This includes all Department Heads, several Division Managers and most Management Positions within the City’s Public Safety Departments. Management is an essential component of City functions and ensures employees are working within the City’s Municipal Code to deliver services to the residents of the Community and ensure the Health and Safety of employees, residents, and visitors within City limits. All employees within this category have been deemed eligible since they also performed essential work during the public health emergency.

STRATEGIC PLAN INTEGRATION:

GOAL THREE: COMMUNITY ENGAGEMENT
To connect and participate in a constant dialogue between members of the community, City staff, and elected officials to promote togetherness and positivity.

Objective 2: Increase transparency for the public.

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.

TITLE:

A Resolution of the City Council of the City of Hemet, California, Awarding the Purchase for Pipeline Materials to Core and Main in the Amount of $175,000.00 for Fiscal Year 22/23 and Authorizing the City Manager to Execute a Purchase Order in Support of the Award and Change Orders up to 10%

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Adopt a Resolution of the City Council of the City of Hemet, California, Awarding the Purchase for Pipeline Materials to Core and Main in the Amount of $175,000.00 for Fiscal Year 22/23 and Authorizing the City Manager to Execute a Purchase Order in Support of the Award and Change Orders up to 10%.

BACKGROUND:

The Water Department operates and maintains water distribution infrastructure ser ving over 9,700 residential and commercial water connections and a population of approximately 32,600. The system includes City-owned wells, water storage reservoirs, main lines and service laterals, fire hydrants, valve systems, and interagency connection s. In order to safely supply water to our customers, equipment, parts, and supplies are needed in a timely manner to provide maintenance and necessary repairs to the system 24 hours a day. Having an established annual purchase order allows staff to respond immediately by securing access to adequate inventory and saves staff time by eliminating the need for performing frequent bid solicitations.

ANALYSIS:

A solicitation to obtain competitive FY 22/23 pricing was posted through Planet Bids on May 11th, 2022, and bids were opened on June 7th, 2022. A total of 45 vendors were notified through Planet Bids. The city ultimately received two responsive bids. Bid submissions were reviewed by the City’s Procurement Administrator and staff, and Core and Main were determined to be the lowest responsive bidder for Pipeline materials.

Page 809 of 859 ends

DISCUSSION:

The Water Department forecasts the materials that will be needed each fiscal year for the operation and maintenance of the related infrastructure and obtains bids through a competitive process. Once awarded and a PO issued, this process makes material acq uisitions much more efficient throughout the fiscal year for a variety of routine maintenance and emergency repairs to the system.

STRATEGIC PLAN INTEGRATION:

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.

Objective 1: Operate in a financially sustainable manner.

Objective 2: Evaluate existing practices to ensure continuity with industry best practices.

FISCAL IMPACT:

There is no General Fund impact. Funding for water material purchases is available in the FY22/23 Adopted Operating Budget for Fund 571.

TITLE:

Review the Proposed Conceptual Landscape Design for Edward J. Rodeghier Memorial Green and Provide Staff Direction in Regard to Implementing a Project to Beautify the Location from Current Conditions

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Review the conceptual landscape design for Edward J. Rodeghier Memorial Green and provide staff direction in regard to implementing a project that will beautify this City owned location from current conditions.

BACKGROUND:

The Edward J. Rodeghier Memorial Green was established in 1988 in honor of Mr. Rodeghier. Mr.

Rodeghier served on the Hemet City Council from 1971 to 1974 and was Hemet City Clerk from 1975 until his passing in 1988.

Repeated acts of vandalism to the irrigation system and electricity service at this location, has caused the turf to die and the overall appearance of the park to deteriorate.

ANALYSIS:

The Public Works Department had a conceptual drought tolerant landscape plan developed by a landscape professional for consideration and input by the City Council to bring the aesthetics of the location back up to City standards. The conceptual plan is presented as an attachment.

It is estimated that the drought tolerant conceptual plan would reduce water consumption for the location by approximately 218,000 gallons per year when compared to maintaining turf in the same capacity as when the area was established.

Page 1 of 15 ends

16.A

Page 837 of 859 ends

In addition, turf requires a weekly maintenance schedule while the proposed drought tolerant landscaping needs just bi-weekly maintenance providing additional cost savings.

DISCUSSION:

The Public Works Department has developed a plan to mi nimize future vandalism that coincides with the proposed conceptual design. This includes using irrigation controllers that can be located within in- ground locking boxes and the construction of a heavy duty cage to secure the water backflow device.

PREVIOUS COUNCIL ACTION:

STRATEGIC PLAN INTEGRATION:

GOAL ONE: QUALITY OF LIFE:

To ensure that Hemet is safe, clean, attractive and comfortable for all who live, work, and visit.

Objective 1: Enhance the visual appearance of the community to make it attractive and reduce blight.

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS

Objective 1: Operate in a financially sustainable manner.

Objective 2: Evaluate existing practices to ensure continuity with in dustry best practices.

FISCAL IMPACT:

There is currently no fiscal impact.

If staff receives direction to move forward with the project, the cost estimate for the proposed conceptual landscape design is $45,733.

Housing Element Update
Water and Maintenance Savings
Water:
• Turf uses approximately 30 gallons/ft2 per year
• There was ~8,600 ft2 of turf equating to ~258,000
gallons per year of water demand.
• Drought tolerant plants use approximately 35%
less water.
• Proposed is approximately 2,000 ft2 of drought
tolerant plants equating to ~40,000 gallons per
year of water demand.
• Approximately 218,000 gallons per year of water
savings compared to turf.

Maintenance:
• Turf needs weekly maintenance
• Drought tolerant planters need bi-
weekly maintenance
• This equates to half of the
maintenance costs for contract
services

Adopt a Resolution of the City Council of the City of Hemet, California, approving permits issued and entitlement projects extension of time for additional 12 months and 24 months respectively that expired between March 2020 to March 2022 during the Covid -19 to provide an opportunity to complete the construction phase of the project.

BACKGROUND:

The City of Hemet, like the rest of the world, experienced unprecedented impact of Covid -19 between the initial start of the pandemic to today. The City of Hemet has approved multiple entitlements for projects and issued permits prior to and during the pandemic that expired between March of 2020 and March of 2022, two (2) year period. These entitlements and permits could not be exercised due to various reasons related to Covid -19 pandemic (e.g., labor shortage, supply chain issues, lock down restrictions). Many approvals sat dormant until the Covid-19 Pandemic subsided and the city, county, country, and world slowly came back to the new normal.

On March 16, 2020, the Mayor and City Council proclaimed a local emergency in connection with the Novel Coronavirus (Covid-19 Pandemic), which involved the following:

1. Acknowledgement of the risk that the potential further spread of COVID-19 presents to the public health and safety to persons and property within the City of Hemet; and

2. Declaration of a local emergency as authorized in Government Code Sections 8630 and 54956.5, and Chapter 26 of the Hemet Municipal Code; and

3. Use of teleconferencing and other electronic means to promote and maintain social distancing among Council Members and the public while handling the City’s business; and

4. Authorization of the City Manager, as the Director of Emergency Services, to exercise his powers and duties as provided in the Hemet Municipal Code, and pursuant to the Disaster Preparedness Plan.

On June 15, 2021, the State of California fully opened the economy and terminated statewide executive orders that put into place the Stay at Home Order and Blueprint for Safer Economy. Most other executive orders put in place since March 2020 are being phased out by the State.

The State of California also issued a new public health order on June 15, 2021 rescinding all previous orders, with only limited restrictions masking and mega -events, and places serving children. The physical distancing requirements, capacity limits on businesses, and County "tier" system have been terminated.

On July 20, 2021, the City Council adopted a Resolution No. 2021-069 of The City Council of The City of Hemet, California Rescinding the Local State of Emergency Related to t he Novel Coronavirus (COVID-19).

ANALYSIS:

The City of Hemet has approved various projects that are related to residential, commercial, and industrial uses. Some projects have now expired without the opportunity to become a completed project in the bui lt environment. There are approximately 30 entitlements and 1,600 permits issued (approximately 650 were never acted on) that expired during March 2020 to March 2022. The entitlements are given 24 month expiration date from the approval date and the perm its are given 12 month from the issued date. These projects can add to the growing number of developments that are occurring in all sectors that City of Hemet have experienced in the last few year as part of the residential and commercial boom. With the extension of time, City can grow in a manner that was identified in the General Plan.

Per Hemet Municipal Code Sections 90 -42.8, 90-43.8, 90-44.8, 90-45.7, and 90-48.8, Expiration and Time Extensions, "...approval shall expire 24 months after final ap proval unless construction has commenced and is being carried on diligently to completion, or an application for a time extension is filed prior to the expiration. If an application for extension is filed prior to the expiration, the approving authority may extend the time limit up to a maximum period of three additional years." Due to the Covid-19 pandemic restrictions and supply chain issues, some projects did not have the opportunity to get the project off the ground and construct. With the understandi ng that the goal of the council is to encourage economic growth and provide resources for new businesses to enhance the customer service experience.

DISCUSSION:

The extension of time afford the opportunity to allow those projects that received entitlements and permits to be valid for additional 12 to 24 months. This would allow the builder or property owner to move the project forward without reapplying for entit lements or permits costing valuable time and money to reprocess.

STRATEGIC PLAN INTEGRATION:

GOAL TWO: ECONOMIC OPPORTUNITY
To ensure that Hemet is a hub, with access to quality jobs, shopping options, and a varied and sustained tax base.

Objective 2: Provide resources for new businesses to enhance the customer service experience. The extension of time would allow additional time for entitlements and permits to afford the opportunity to exercise the approvals.

FISCAL IMPACT:

With the approval of the extension of time as a whole, the city and the developer can benefit with additional construction of residential, commercial and industrial developments by way of providing vital residential and commercial needs in the city as well as building permit fees, inspection fees, and Development Impact Fees (DIF). These construction and the fees can enhance the development of the city and the improvements that are associated with the developments.
