City of Hemet
City Council Meeting

STAFF REPORT

Meeting: City Council Meeting - Feb 11 2025
Department: Public Works
Submitted by: Mark Prestwich, City Manager
Daniel Cortese, Environmental Services Manager;

☐ Receive and File ☐ Consent Calendar ☒ Business Item ☐ Public Hearing

TITLE:

A Resolution of the City Council of the City Of Hemet, California, Approving the Sierra Dawn Median Beautification Project; Approving an Agreement Between The City and The Sierra Dawn Estates Home Owners Association (HOA) Regarding the Construction, Funding, and Subsequent Maintenance of The Project in the Final Form and Format Approved by the City Attorney; Authorizing the City Manager to Execute the Agreement; and Authorizing the Administrative Services Director to Appropriate $215,000 from General Fund Reserves to the Project

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Adopt a Resolution of the City Council of the City Of Hemet, California, Approving the Sierra Dawn Median Beautification Project; Approving an Agreement Between The City and The Sierra Dawn Estates Home Owners Association (HOA) Regarding the Construction, Funding, and Subsequent Maintenance of The Project in the Final Form and Format Approved by the City Attorney; Authorizing the City Manager to Execute the Agreement; and Authorizing the Administrative Services Director to Appropriate $215,000 from General Fund Reserves to the Project.

BACKGROUND:

Historically, the HOA has maintained certain public areas and facilities within the Sierra Dawn Estates. These areas include the roadway medians located on West Johnston Ave. between South Lyon Ave. and South Elk St.; South Elk St. between Vista Grande Dr. and West Whittier Ave.; South Palm Ave between West Johnston Ave. and West Whittier Ave; San Juan Dr. at Palm Ave; San Juan Dr. at Lyon Ave; and Camino Del Sol Dr. at Johnston Ave. While a written agreement between the HOA and the City has not been located, it appears that an informal arrangement or understanding has been in place since the early 1990s.

The HOA General Manager approached the City with the desire to partner with the City and coordinate an improvement project to improve the roadway medians within and visible to the collector roads traversing the Sierra Dawn Estates community, as identified above. The beautification concept

Page 1 of 19 ends

18.B

Page 679 of 703 ends

was then added as a High Priority Action Item to the current fiscal year strategic work plan, and staff began working on putting together the project details over the past few months.

ANALYSIS:

The proposed project would remove the existing box bush plants and vegetation in the medians identified above, install new decomposed granite (DG), drought-tolerant plants, and convert the irrigation system to an efficient drip system controlled by state-of-the-art weather-based irrigation controllers.

The proposed agreement between the City of Hemet and the Sierra Dawn Estates HOA provides a partnership and defines responsibilities related to the construction of the roadway median improvements, and the subsequent operations and maintenance of the improvements. Under the proposed agreement, the City would construct the improvements and provide subsequent operations and maintenance on the roadway's updated drought tolerant medians. The HOA will contribute $100,000 toward the construction over three years and provide the water and electricity for the subsequent operation and maintenance.

DISCUSSION:

The City typically utilizes special assessment districts to fund enhanced landscaping in parkways and roadway medians. There is an old landscape maintenance district that includes the Sierra Dawn Estates. However, it is a very old district that was likely formed in the 1960s or 1970s and does not have a mechanism for increases to keep up with inflation over time. Therefore, it cannot provide sufficient funding for maintaining these facilities. The assessments have covered the costs for palm tree trimming within the medians but will need to be supplemented to fund the proposed maintenance of the improvements that are contemplated.

The proposed agreement allows for an option that the City could split up the project into three phases over three years to coincide with the funding contributions from the HOA. However, due to the relatively small size of the project and the increased costs that would be anticipated with this approach, staff is recommending approval to construct as one immediate project.

PREVIOUS COUNCIL ACTION:

None.

STRATEGIC PLAN INTEGRATION:

GOAL ONE: QUALITY OF LIFE:

To ensure that Hemet is safe, clean, attractive and comfortable for all who live, work, and visit.

Objective 1: Enhance the visual appearance of the community to make it attractive and reduce blight.

GOAL THREE: COMMUNITY ENGAGEMENT
To connect and participate in a constant dialogue between members of the community, City staff, and elected officials to promote togetherness and positivity.

Objective 3: Increase the community's pride within the City.

Page 2 of 19 ends

18.B

Page 680 of 703 ends

GOAL FOUR: PARTNERSHIP & COLLABORATION
To pursue partnerships that will increase the opportunities available to the community, including our businesses, unemployed, and youth populations.

Objective 3: Develop programs to offer support to the community's businesses

FISCAL IMPACT:

The proposed project and associated agreement would initially require an appropriation of $215,000 from General Fund reserves. Additionally, the updated median maintenance is estimated to cost approximately $2,000 to $3,000 per month to supplement the existing special assessments in the area.

ALTERNATIVE(S):

1. Choose to conduct the project in three phases over three years instead of one immediate project.

2. Do not approve the Sierra Dawn Estate roadway median beautification project.

3. Provide alternative direction to the City Manager.

AGREEMENT FOR

THE SIERRA DAWN ROADWAY MEDIAN BEAUTIFICATON PROJECT

AND SUBSEQUENT MAINTENANCE
THIS AGREEMENT (“Agreement”) is made and entered into as of this ___ day of ____ 2025, by and between the City of Hemet (“City”), a California municipal corporation and the Sierra Dawn Estates Homeowners Association (hereinafter referred to as the “HOA”). City and HOA are sometimes hereinafter referred to as “Party” and hereinafter collectively referred to as the “Parties.”

RECITALS
WHEREAS, historically, the HOA has maintained certain public areas and facilities within the Sierra Dawn Estates including the roadway medians located on West Johnston Ave. between South Lyon Ave. and South Elk St.; South Elk St. between Vista Grande Dr. and West Whittier Ave.; South Palm Ave between West Johnston Ave. and West Whittier Ave; San Juan Dr. at Palm Ave; San Juan Dr. at Lyon Ave; and Camino Del Sol Dr. at Johnston Ave (“Roadway Medians”), as illustrated in Exhibit A, incorporated hereto and set forth herein; and WHEREAS, a written agreement between the HOA and the City has not been located; however, it appears that an informal arrangement or understanding has been in place since the early 1990s; and
WHEREAS, the City typically utilizes special assessment districts to fund enhanced landscaping in parkways and roadway medians and there is currently not a district with sufficient funding for this particular location; and
WHEREAS, the Parties desire to beautify the Roadway Medians within the specified area as shown in Exhibit A and agree to share the responsibilities as set forth herein; and WHEREAS, the Parties mutually agree to transfer certain maintenance responsibilities outlined in this Agreement to the City to ensure long-term sustainability and improvements and for the HOA to supply the necessary water for the landscaping and electricity for the irrigation controllers; and
WHEREAS, the HOA agrees to contribute a total amount of One Hundred Thousand Dollars ($100,000) toward the construction of the City’s Roadway Median Beautification Project (“Project) over a three-year period and the City agrees to initially fund the construction of the Project to enhance the visual and functional appeal of the specified areas; and WHEREAS, the City agrees to construct the Project either all at once, or in up to three (3) phases, as outlined in Exhibit B, and to fund the difference between the HOA’s contribution and the total Project cost; and

Page 687 of 703 ends

WHEREAS, the HOA’s funding to the Project shall be allocated over a three-year period and be used exclusively for the purposes of planning, developing, and implementing the Project, or reimbursement to the City for the same, as determined by the City; and WHEREAS, the HOA’s funding commitment is an integral part of this Agreement, and the Parties agree to cooperate in good faith to ensure the successful execution of the Project in alignment with the goals of this partnership; and
WHEREAS, the HOA’s contribution will be made in three equal payments: the first payment will be due upon completion of the first phase of the Project, or upon completion of the entire Project if the City decides to complete all at once, with the remaining two payments to be made upon completion of each additional phase annually thereafter, whichever is later, based on the Project’s phase completion date.

NOW, THEREFORE, the City and the HOA agree as follows:

NOW, THEREFORE, THIS AGREEMENT WITNESSETH that in consideration of the mutual promises contained herein and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties hereto agree as follows:

1. PURPOSE
The purpose of this Agreement is to outline the terms and conditions for a Roadway Median Beautification Project and subsequent maintenance and to define the responsibilities of the Parties.

2. DEFINITIONS
The following definitions apply to this Agreement:

For purposes of this Agreement, Public Works Director includes people the City or Public Works Director have delegated to assist with the care and charge of City’s maintenances. b. “Maintenance” and “Maintain” mean preserving and keeping of Roadway Medians and Roadway Plantings, in the safe and usable condition to which they have been improved or constructed within the Subject Roadway Median. “Maintenance” and “Maintain” include special or emergency maintenance or repair necessitated by accidents or by storms or other weather conditions, or other unusual or unexpected damage to Roadway Medians and Roadway.
c. “Roadway Plantings” means trees, shrubs, or other ornamental vegetation, and includes weed control.

3. SCOPE OF AGREEMENT

The subsequent maintenance will include the cleaning, plant care and replacement when necessary, irrigation repairs and operation, water supply to the irrigation system, and electric supply to the irrigation controllers.

4. TERM
This Agreement shall remain in full force and effect indefinitely, commencing on February 11, 2025, unless amended or terminated by mutual written agreement of both Parties or as otherwise provided by law.

5. CITY’S RESPONSIBILITIES
a. Construction Improvements. City shall construct, or cause to construct, the improvements in the Sierra Dawn Estates Roadway Medians defined herein. The Project may be broken into three phases or constructed all at one time. The City will fund the initial construction and will ultimately pay the difference between the HOA contribution defined herein and the total project construction costs.
b. Sierra Dawn Estates Roadway Median Maintenance. The City shall assume control of Roadway Median maintenance with the specified areas either through the deployment of Public Works staff or by contracting with a qualified landscaping company. The City shall determine the most appropriate and efficient method for managing and maintaining the Roadway Medians to ensure their upkeep aligns with the community standards and aesthetic goals.

6. HOA’S RESPONSIBILITIES
a. Maintenance. During the term of this Agreement, as defined in Section 4, HOA shall, at its own expense, perform the following obligations:
i. HOA shall pay all costs of water usage and fees associated with the subject Roadway Medians.

The HOA agrees to provide funding to the City in a total amount of One Hundred Thousand Dollars ($100,000) over a three (3) year period to support the City in launching and executing the City’s Roadway Median Beautification Project. i. The first payment will be due upon completion of the first phase of the project, or upon completion of the entire project if the City decides to complete all three phases at once, with the remaining two payments to be made upon completion of each additional phase or annually thereafter, whichever is later, based on the project or project phase completion date.

7. GENERAL PROVISIONS
a. Land Use Regulations. The Parties will comply with the adopted regulations of the Hemet Municipal Code and all applicable Specific Plans, ordinances and resolutions adopted and altered by City from time to time and will cause all of its agents, employees, invitees and visitors to adhere to this Section.

Subject: Wildfire prevention
Greetings Council Members. On 8/27/24 I sent an email to Ms.

Kendrick asking if the residents of Park Hill are required to clear weeds. This was shortly after the fire on Menlo & Park. The response was to contact the City of San Jacinto as only a few homes were in Hemet. I've counted at least 25 homes on Park Hill within Hemet Comment or

boundary. This is roughly 5 miles in circumstance of wildfire fuel that no one seems to care is a disaster waiting to happen. Not only for those homes but the hundreds of not thousands within a short distance. Since fire creates its own weather the number of potential homes lost could be of significance. Why I this area not mandated to be mitigated? The brush is extremely dry. It could be as simple as having goats do the weed eating would be easy and environmentally beneficial. I live near the hill and have been worried for years. I hope something will be done. Can no longer has a fire season. We just continue to have fires.

Thank you.
