Professional standards require that we provide you with information about our responsibilities under generally accepted auditing standard s, Government Auditing Standards, and the Uniform Guidance, as well as certain information related to the planned scope and timing of our audit. We have communicated such information in our letter to you dated July 16, 2025. Professional standards also require that we communicate to you the following information related to our audit.
Significant Audit Findings
Qualitative Aspects of Accounting Practices
Management is responsible for the selection and use of appropriate accounting policies. The significant accounting policies used by the City are described in Note 1 to the financial statements.
No new accounting policies were adopted and the application of existing policies was not changed during the fiscal year. We noted no transactions entered into by the City during the year for which there is a lack of authoritative guidance or consensus. All significant transactions have been recognized in the financial statements in the proper period.
Accounting estimates are an integral part of the financial statements prepared by management and are based on management’s knowledge and experience about pa st and current events and assumptions about future events. Certain accounting estimates are particularly sensitive because of their significance to the financial statements and because o f the possibility that future events affecting them may differ significantly from those expected. T he most sensitive estimates affecting the financial statements were:
Management’s estimate of the fair value of investments is based on information provided by financial institutions. We evaluated the key factors and as sumptions used to develop the fair value of investments in determining that it is reasonable in relation to the financial statements as a whole.

Management’s estimate of capital assets depreciation is based on historical estimates of each capitalized item’s useful life. We evaluated key factors and assumptions used to develop the estimated useful lives in determining that they are reasonable in relation to the financial statements as a whole.
Management’s estimate of the net pension and net OPEB liabilities are based on actuarial information provided by the California Public Employee Retireme nt System’s (CalPERS) actuarial office, and other sources. We evaluated the key factors and assumptions used to develop these liabilities in determining that the estimated liabilities are reasonable in relation to the financial statements as a whole.
Certain financial statement disclosures are particularly sensitive because of their significance to financial statement users. The most sensitive disclosure affecting the financial statements were:
The disclosure of the fair value of investments in Note 2 to the financial statements represents amounts susceptible to market fluctuation.
The disclosure of accumulated depreciation in Note 5 to the financial statements is based on estimated useful lives which could differ from actual useful lives of each capitalized item.
The disclosures for the net pension and net OPEB liabilities in Notes 8 and 9, respectively, to the financial statements are based on assumptions for discount rates, etc., which could differ from actual experience. The notes disclose the differenc es in these liabilities if different assumptions are used in estimating these liabilities.
Difficulties Encountered in Performing the Audit
We encountered no significant difficulties in dealing with management in performing and completing our audit.
Corrected and Uncorrected Misstatements
Professional standards require us to accumulate all known and l ikely misstatements identified during the audit, other than those that are trivial, and communicate them to the appropriate level of management. The following material misstatements detected a s a result of audit procedures were corrected by management:

Disagreements with Management
For purposes of this letter, a disagreement with management is a financial accounting, reporting, or auditing matter, whether or not resolved to our satisfaction , that could be significant to the financial statements or the auditor’s report. We are pleased to report that no such disagreements arose during the course of our audit.
Management Representations
We have requested certain representations from management that are included in the management representation letter dated September 16, 2026.
Management Consultations with Other Independent Accountants
In some cases, management may decide to consult with other accountants about auditing and accounting matters, similar to obtaining a “second opinion” on certain situations. If a consultation involves application of an accounting principle to the City’s financial statements or a determination of the type of auditor’s opinion that may be expressed on those statements, our professional standards require the consulting accountant to check with us to determine that the consultant has all the relevant facts. To our knowledge, there were no such consultations with other accountants.
Other Audit Findings or Issues
We generally discuss a variety of matters, including the applic ation of accounting principles and auditing standards, with management each year prior to retention as the City’s auditors. However, these discussions occurred in the normal course of our professi onal relationship and our responses were not a condition to our retention.
Findings and Recommendations:
In addition to our audit opinion on the financial statements, we issued our “Independent Auditor’s Report on Internal Control Over Financial Reporting and on Compliance and Other Matters Based on an Audit of Financial Statements Performed in Accordance wit h Government Auditing Standards” dated September 16, 2026, in which we identified a significant deficiency in internal controls.
Other Matters
We applied certain limited procedures to management’s discussio n and analysis and other required supplementary information, as listed in the table of c ontents, which are (is) required supplementary information (RSI) that supplements the basic financial statements. Our procedures consisted of inquiries of management regarding the methods of p reparing the information and comparing the information for consistency with management’s responses to our inquiries, the basic financial statements, and other knowledge we obtained dur ing our audit of the basic 3

financial statements. We did not audit the RSI and do not expre ss an opinion or provide any assurance on the RSI.
We were engaged to report on the Measure U schedule, combining statements and individual fund statements, which accompany the financial statements but are not RSI. With respect to this supplementary information, we made certain inquiries of managem ent and evaluated the form, content, and methods of preparing the information to determine that the information complies with accounting principles generally accepted in the United States of America, the method of preparing it has not changed from the prior period, and the information is appropriate and complete in relation to our audit of the financial statements. We compared and reconciled the supplementary information to the underlying accounting records used to prepar e the financial statements or to the financial statements themselves.
We were not engaged to report on the introductory and statistical sections, which accompany the financial statements but are not RSI. Such information has not been subjected to the auditing procedures applied in the audit of the basic financial statemen ts, and accordingly, we do not express an opinion or provide any assurance on it.

Report on Internal Control Over Financial Reporting
In planning and performing our audit of the financial statement s, we considered the City’s internal control over financial reporting (internal control) as a basis for designing audit procedures that are appropriate in the circumstances for the purpose of expressing our opinions on the financial statements, but not for the purpose of expressing an opinion on the effectiveness of the City’s internal control. Accordingly, we do not express an opinion on the effectiveness of the City’s internal control.
A deficiency in internal control exists when the design or operation of a control does not allo w management or employees, in the normal course of performing the ir assigned functions, to prevent, or detect and correct, misstatements on a timely basis. A material weakness is a deficiency, or a combination of deficiencies, in internal control, such that there is a reasonable possibility that a material misstatement of the entity’s financial statements will not be prevented, or detected and corrected on a timely basis. A significant deficiency is a deficiency, or a combination of deficiencies, in internal control that is less severe than a material weakness, yet important enough to merit attention by those charged with governance.
Our consideration of internal control was for the limited purpose described in the preceding paragraph of this section and was not designed to identify all deficiencies in internal control that might be material weaknesses or significant deficiencies and therefore, material weaknesses or significant deficiencies may exist that were not identified. Given these limitations, during our audit we did not identify any deficiencies

Report on Compliance and Other Matters
As part of obtaining reasonable assurance about whether the City’s financial statements are free from material misstatement, we performed tests of its compliance with certain provisions of laws, regulations, contracts, and grant agreements, noncompliance wit h which could have a direct and material effect on the determination of financial statement amo unts. However, providing an opinion on compliance with those provisions was not an objective of our audit, and accordingly, we do not express such an opinion. The results of our tests disclosed no instances of noncompliance or other matters that are required to be reported under Government Auditing Standards.

Government Auditing Standards requires the auditor to perform limited procedures on the City’ s responses to the findings identified in our audit and described in the accompanying schedule of findings and questioned costs. Condition:
While performing audit procedures, we identified and proposed several material adjusting entries to the City’s accounting records. Furthermore, Statements on Auditing Standards No. 115, ”Communicating Internal Control Related Matters Identified in an Audit” states that “indicators of material weaknesses in internal control include: identification by the auditor of a material misstatement of the financial statements under audit in circumstances that indicate the misstatement would not have been detected by the entity’s internal control.”
Criteria:
The City’s management is responsible for establishing and maintaining effective internal controls over financial reporting to help ensure that appropriate goals and objectives are met. This responsibility includes the selection and application of accounti ng principles, ensuring that financial information is reliable and properly recorded, and evaluating and monitoring ongoing activities.
Cause of Condition:
Adjustments identified through the audit process.
Potential Effect of Condition:
Internal controls not established to identify material misstatements to the financial statements and ultimately could result in material misstatement to the financial statements.
Recommendation:
Therefore, in order to maintain the integrity of the accounting and financial reporting system, and to ensure timely reporting, we recommend that all balance sheet accounts and other selected accounts be analyzed on a monthly, quarterly or other periodic basis as appropriate. We suggest a schedule of accounting functions to be performed monthly, quarterly, etc., be prepared with the provision for signing off by date and initials when the procedure is complete.

The City acknowledges the audit finding and recognizes the importance of maintaining effective account reconciliation, year-end close, and supervisory review procedures to ensure the accuracy and timeliness of its financial reporting.

The implementation required significant staff resources for system configuration, data conversion and validation, testing, troubleshooting, training, and the reconciliation of financial information between the City's legacy and new financial systems. These responsibilities substantially reduced the staff capacity available to perform certain routine monthly reconciliations and the level of detailed year -end review that would ordinarily occur prior to the audit.

These measures are intended to improve the accuracy and timeliness of financial reporting, strengthen internal controls, and reduce the likelihood of material audit adjustments in future periods.

The City has agreed to and acknowledged that the procedures performed are appropriate to meet the intended purpose of meeting the requirements set forth in Secti on 1.5 of Article XIIIB of the California Constitution. These procedures, which were suggested by the League of California Cities and presented in the publication entitled Agreed-Upon Procedures Applied to the Appropriations Limitation Prescribed by Article XIII-B of the California Constitution, were performed solely to assist you in meeting the requirements. This report may not be suitable for any other purpose. The procedures performed may not address all the items of interest to a user of this report and may not meet the needs of all users of this report and, as such, users are responsible for determining whet her the procedures performed are appropriate for their purposes.
The procedures performed and the associated findings were as follows:
1. We obtained the completed worksheets and compared the limit and annual adjustment factors included in those worksheets to the limit and annual adjustment factors that were adopted by resolution of the City Council. We also compared the population and inflation options included in the aforementioned documents to those that were selected by a recorded vote of the City Council.
Finding: No exceptions were noted as a result of our procedures, except that the City initially adopted resolution 2024-109 for the GANN Limit for FY 2024-25 using fac tors that were not in accordance with the attached schedule. This was subsequently corrected through the calculation of the GANN Limit for FY 2025-26 with the adoption of resolution No. 2025-0 74 using the appropriate adjustment factors.
2. For the accompanying Appropriations Limit worksheet, we adde d last year’s limit to total adjustments and agreed the resulting amount to this year’s limit.
Finding: No exceptions were noted as a result of our procedures, except as indicated in 1. above.

EXECUTIVE SUMMARY:
Transparent California is a publicly accessible website that publishes California public employee compensation information obtained through annual Public Records Act requests, which the City prepares using calendar-year payroll data. As part of an ongoing review with the City's independent auditor, Finance staff is refining the reporting methodology to exclude allocated CalPERS Unfunded Accrued accurately more to benefits employee (UAL) from costs Liability reflect individual compensation and benefits attributable to active employees.
BACKGROUND/ANALYSIS:
Transparent California is a publicly accessible website that compiles and publishes compensation and pension information for California public employees. The website provides members of the public with access to salary and benefit information for employees of cities, counties, special districts, school districts, and other public agencies throughout the State.
Transparent California obtains compensation information from public agencies, including the City of Hemet, through annual requests made pursuant to the California Public Records Act (PRA). In response to the annual request, the City generates and provides employee compensation data report for the applicable calendar year.
16.C.
The purpose of this report is to describe the City's process for preparing and reviewing the compensation information provided in response to Transparent California's annual PRA request and to explain a refinement to the methodology used to report CalPERS pension costs attributable to individual employees.
DISCUSSION:
PREPARATION OF EMPLOYEE COMPENSATION DATA
The City reports employee compensation information on a calendar-year basis. Following the conclusion of each calendar year, Finance staff extracts the applicable employee compensation data from the City's payroll software system.
The report contains basic employee and position information, including employee number, employee name, position number and title, home department, and the annual salary range for the position.

Base Pay: Regular wages earned by the employee during the calendar year. Overtime: Compensation paid for overtime worked during the calendar year. Other Pay: Compensation paid in addition to regular and overtime pay, including applicable lump-sum payments, negotiated premium pay, and other forms of additional compensation. Benefits: Employer-paid benefits, including CalPERS defined benefit pension contributions, deferred compensation, and health, dental, and vision benefits. Total Pay: The combined amount of Base Pay, Overtime, and Other Pay. Total Pay and Benefits: Total Pay plus employer-paid benefits.
The report also identifies the applicable CalPERS defined benefit pension formula for each employee.
These categories allow the detailed information extracted from the City's payroll system to be organized in a manner consistent with the compensation categories presented on Transparent California's website.
Once the data is extracted from the payroll system, Finance staff reviews the report for completeness and reasonableness. Following completion of the review, the report is provided to the City Clerk's Office.
Transparent California submits an annual Public Records Act (PRA) request to the City seeking employee compensation information. Staff in the City Clerk's Office coordinates the City's response and provides the applicable calendar-year report to Transparent California for publication on its website.
CALPERS PENSION COSTS
An important component of the employee benefit information contained in the report is the City's contribution toward retirement benefits through the California Public Employees' Retirement System (CalPERS).
16.C.
The City's required CalPERS pension contributions generally consist of two separate components:
the normal cost associated with pension benefits currently being earned by active employees and payments toward the City's Unfunded Accrued Liability (UAL).
The normal cost represents the actuarially determined cost of pension benefits earned by active employees during the current period. Because these contributions are directly associated with benefits being earned through an employee's current service, they are appropriately reported as part of the benefits attributable to the individual employee.
The UAL represents the portion of pension obligations for benefits already earned for which sufficient assets are not currently available to fully fund those obligations. In simplified terms, it is the difference between the actuarially determined value of previously earned pension benefits and the assets set aside to fund those benefits.
Unlike the normal cost, the UAL is not solely associated with pension benefits currently being earned by active employees. The liability reflects pension obligations resulting from prior service and includes obligations associated with active employees, retirees receiving pension benefits, and former employees who have earned benefits but may not yet be receiving them.
Accordingly, the City's annual UAL payment is more appropriately characterized as an employer-level payment toward an existing pension liability rather than a current benefit provided exclusively to an individual active employee.
HISTORICAL ALLOCATION OF UAL
Historically, the City has budgeted its CalPERS UAL payments within employee salaries and benefits.
For purposes of allocating personnel costs throughout the City's departments, funds, and programs, the UAL has been incorporated into the City's employee benefited rates.
Under this methodology, the City's anticipated UAL payment is converted into an allocation that becomes a percentage of the total benefited rate associated with each applicable employee position.
This approach allows the City to distribute its overall pension costs throughout the organization for budgeting and cost-allocation purposes.
Because the UAL allocation is incorporated into employee benefited rates, the allocated amount has historically also been included within the employee benefit information extracted from the payroll system and ultimately provided as part of the City's annual compensation report.
Through its ongoing review of the City's compensation reporting methodology, staff identified that the historical allocation methodology, while providing a mechanism for distributing pension costs for budgeting and cost-allocation purposes, can overstate the benefits attributable to active employees when applied to individual employee compensation reporting.
The UAL amount allocated to an employee through the City's benefited-rate methodology is not directly attributable to pension benefits earned by that individual employee during the reporting year.
Rather, it represents an allocated share of the City's broader pension obligation associated with pension benefits earned over prior periods by both current and former employees.
For example, an active employee's reported pension benefit under the historical methodology may include both the employer contribution attributable to the pension benefit the employee is currently

earning and an allocated portion of the City's UAL payment. Presenting both amounts as an individual employee benefit may therefore create the appearance that the City provided a greater level of retirement benefits to that employee during the calendar year than was actually attributable to the employee's current service.
Illustrative Example (Hypothetical)
For illustrative purposes, assume an employee earns $100,000 in regular salary during the calendar year. The City's CalPERS employer contribution directly attributable to the pension benefits earned by that budgeting historical City's the under addition, In $15,000. is year the during employee methodology, $20,000 of the City's UAL payment is allocated to the employee's position through the benefited rate.
Under the historical reporting methodology, the employee's reported defined benefit pension amount would include both components:

Although $35,000 would be reflected as an employer-paid pension benefit associated with the employee, only $15,000 represents the employer pension contribution directly attributable to benefits earned through that employee's current service. The additional $20,000 represents an allocated portion of the City's broader UAL obligation, which includes pension liabilities associated with previously earned service for active employees, retirees, and former employees.
Under the refined reporting methodology, the employee's reported defined benefit pension amount would therefore be $15,000 rather than $35,000. The $20,000 difference does not represent a reduction in the employee's compensation or retirement benefit, nor does it reduce the City's obligation to CalPERS. It reflects only the removal of the allocated UAL from the amount attributed to the individual employee for compensation reporting purposes.
REVIEW AND REFINEMENT OF REPORTING METHODOLOGY
Over the last several years, Finance staff has worked in consultation with the City's independent auditor to evaluate the methodology used to prepare employee salary and benefit information, including the appropriate treatment of employer pension costs. The objective of this review has been to improve the accuracy and consistency of the City's reporting and to ensure that amounts attributed to individual employees appropriately represent compensation and benefits associated with those employees.
As part of this ongoing review, staff determined that the treatment of the CalPERS UAL should be distinguished between the City's internal budgeting process and its external reporting of individual employee compensation.
Under the refined reporting methodology, CalPERS pension contributions directly attributable to an active employee will continue to be included in the employee's reported benefits. These amounts

represent the City's employer contribution toward pension benefits earned through the employee's current service.
The City's UAL payment, however, will be excluded from the pension benefit amount attributed to individual active employees for purposes of the annual compensation report provided in response to Transparent California's PRA request.
BUDGETING VERSUS EXTERNAL COMPENSATION REPORTING
As part of the refined methodology, the City will separately budget its CalPERS UAL payments from the regular CalPERS employer contributions associated with active employees. The UAL will no longer be incorporated into individual employee benefited rates and will instead be separately budgeted as an employer-level pension obligation.
This approach provides a clearer distinction between two different components of the City's pension costs. Regular CalPERS employer contributions represent the cost of pension benefits associated with active employees' current service, while UAL payments represent the City's obligation to fund pension liabilities associated with benefits earned through prior service.
Consistent with this distinction, the City's external employee compensation reporting will include CalPERS pension contributions directly attributable to an active employee but will exclude UAL payments from the benefit amount attributed to individual employees.
Separately budgeting and reporting the UAL does not change the City's CalPERS obligations, reduce its pension costs, or alter the amount the City is required to pay CalPERS. Rather, the revised methodology provides greater clarity by separately identifying the City's current employee pension costs and its payments toward previously accrued pension liabilities.
IMPACT OF THE REVISED METHODOLOGY
Implementation of the revised methodology will result in the UAL being separately budgeted as an employer-level pension obligation and excluded from the pension benefit amount reported for individual employees.
As a result, the pension benefit amount reported for individual employees will be lower compared with the City's historical reporting methodology. This reduction does not represent a decrease in employee compensation or retirement benefits. Rather, it reflects the removal of the UAL amount previously allocated to individual employee benefit totals.
The City will continue to make all required CalPERS normal cost and UAL payments. The revised methodology changes how these costs are budgeted, allocated, and presented but does not change the City's underlying pension obligations.
Beginning with calendar year 2026 compensation data, the refined methodology will be used prospectively for employee compensation reporting. This approach provides a more accurate representation of compensation and benefits attributable to individual employees while separately identifying the City's broader UAL obligation. The revised methodology preserves transparency regarding the City's total pension costs while avoiding the attribution of an employer-level pension liability to individual active employees as though it were a current employee benefit.

DISCUSSION:
Ordinance No. 2081 was first introduced at the September 8th, 2026, City Council meeting following a duly noticed public hearing. The purpose of the ordinance is to amend Chapter 58, Article IV of the Hemet Municipal Code to implement the updated Stephens' Kangaroo Rat Habitat Conservation Plan mitigation fee schedule established through the 2026 Nexus Study adopted by the Riverside County Habitat Conservation Agency.
The ordinance increases the mitigation fee for applicable development from $500 to $900 per gross acre, maintains the existing $250 fee for qualifying individual single-family residential development, simplifies the agricultural development fee to $500 per gross acre, and continues the existing 75 percent fee reduction for qualifying nonprofit organizations. The ordinance also provides for annual Consumer Price Index adjustments beginning July 1, 2027.
Pursuant to Government Code Section 66017, the updated mitigation fee schedule will become effective 60 days following adoption of the ordinance.

EXECUTIVE SUMMARY:
The Riverside County Habitat Conservation Agency (RCHCA) Board of Directors adopted the 2026 Stephens' Kangaroo Rat (SKR) Habitat Conservation Plan Nexus Study on July 9, 2026. The Nexus Study evaluates the costs associated with implementing the regional Habitat Conservation Plan and recommends revisions to the existing mitigation fee schedule.
As a participating member agency, the City of Hemet must adopt the updated fee schedule through a local ordinance before the revised fees may be implemented. The proposed ordinance amends Chapter 58, Article IV, Habitat Conservation, of the Hemet Municipal Code in its entirety to incorporate the updated mitigation fee schedule and revise the City's provisions governing the SKR mitigation fee, including the agricultural fee calculation, qualifying individual single-family residential development, fee adjustments, and related findings and administrative provisions. These

amendments will maintain consistency with the regional SKR Habitat Conservation Plan and the 2026 Nexus Study.
BACKGROUND/ANALYSIS:
The Stephens' Kangaroo Rat Habitat Conservation Plan (SKR HCP) is a regional conservation program a provides that Agency Habitat Conservation Riverside the by administered County comprehensive framework for mitigating impacts to Stephens' Kangaroo Rat habitat while allowing eligible development projects within the SKR Plan Area to proceed under federal and state incidental take authorizations.
The City of Hemet participates in the regional program through Chapter 58 of the Hemet Municipal Code, which establishes mitigation fees collected from qualifying development projects. These fees are remitted to RCHCA and support implementation of the Habitat Conservation Plan, including habitat acquisition and management, biological monitoring, administration, and other conservation activities necessary to maintain the regional permitting program.
On July 9, 2026, the RCHCA Board of Directors adopted the 2026 Stephens' Kangaroo Rat Habitat Conservation Plan Nexus Study, which evaluated the costs associated with implementing the Habitat Conservation Plan and recommended updated mitigation fees. As a participating member agency, the City must adopt the updated fee schedule locally before the revised fees may be collected.
The proposed ordinance is included as Attachment 1. The clean version of Chapter 58, Article IV, Habitat Conservation, is provided as Attachment 3, and the corresponding redline version identifying the proposed amendments is provided as Attachment 4. The 2026 Stephens’ Kangaroo Rat Habitat Conservation Plan Nexus Study prepared for the Riverside County Habitat Conservation Agency is included as Attachment 5. Pursuant to California Government Code sections 66016 and 66016.5, the City provided public notice of the proposed fee update and made the 2026 Nexus Study and supporting documentation available for public review at least 30 days prior to the public hearing.
Notice of the public hearing was published in The Press-Enterprise on August 7, 2026. A copy of the publication notice is included as Attachment 2.
DISCUSSION:
The proposed ordinance amends Chapter 58, Article IV of the Hemet Municipal Code, including Section 58-97, to implement the updated mitigation fee schedule recommended by the 2026 Stephens' Kangaroo Rat Habitat Conservation Plan Nexus Study. The original SKR mitigation fee was established at $1,950 per acre in 1988 and was reduced to $500 per acre in 1996. The fee has remained unchanged since that time, with no inflation adjustments applied over the intervening 30 years.

*Previously, the agricultural fee was calculated as $100 or 1% of the building valuation, whichever was greater, with a maximum of $500 per gross acre. Consistent with the Nexus Study's findings, the calculation typically resulted in the maximum fee; therefore, the fee has been simplified to a flat rate of $500 per gross acre.
**Surface mining is subject to a separate fee calculation established under Section 58-99 of the Hemet Municipal Code and is not subject to the $900 per gross acre rate.
In addition to updating the mitigation fee amount for applicable development, the ordinance maintains the existing $250 mitigation fee for qualifying individual single-family residential development, continues the existing 75 percent fee reduction for qualifying nonprofit organizations, and simplifies the agricultural development fee calculation without changing the effective fee amount.
Adoption of the proposed ordinance will maintain the City's participation in the regional SKR Habitat Conservation Plan and ensure consistency with the updated mitigation fee schedule recommended by the 2026 Nexus Study and adopted by the Riverside County Habitat Conservation Agency. The updated fee will continue to support implementation of the regional Habitat Conservation Plan, including habitat acquisition and management, biological monitoring, administration, and other conservation activities necessary to maintain the regional permitting program.
Following introduction at this meeting, the ordinance will return to the City Council for second reading and adoption at the September 22, 2026, City Council meeting. Pursuant to Government Code section 66017, the updated mitigation fee schedule will become effective 60 days following adoption of the ordinance. Beginning July 1, 2027, the mitigation fees will be subject to annual adjustment based on the Consumer Price Index, as provided in the ordinance. Following adoption, staff will update the City's fee schedule, development review procedures, and permitting materials, and notify the Riverside County Habitat Conservation Agency of the ordinance's adoption and implementation date.
PREVIOUS COUNCIL ACTION:
On June 25, 1996, the City Council adopted Ordinance No. 1546 as an urgency measure. The ordinance repealed Ordinance No. 1353 (which had imposed a $1,950-per-acre fee) and established the current SKR mitigation fee structure of $500 per gross acre (with the $250 per unit rate for certain single-family residential development and the agricultural fee calculation that remain in effect today).

Section 1531 et. seq., which was downlisted to threatened on March 21, 2022.
(c) Following the federal listing of the Stephens' Kangaroo Rat as a threatened species, occupied habitat of the species may not be altered without a Section 10(a) permit issued by the Secretary of the Interior. All requests for a Section 10(a) permit must be accompanied by a Habitat Conservation Plan approved by the U.S. Fish and Wildlife Service. Said permit will then allow for the loss of occupied habitat due to development on the basis that the Habitat Conservation Plan will provide protection for the species and guarantee its survival.
(d) Development within the historic range of the Stephens' Kangaroo Rat has resulted in loss and degradation of occupied Stephens' Kangaroo Rat habitat, increased isolation of Stephens' Kangaroo Rat populations, reduction of potential habitat areas for future colonization, and elimination of corridors which allow the species to relocate as environmental conditions warrant. (e) The Stephens' Kangaroo Rat's survival cannot be insured on small, isolated acreages surrounded by, or in close proximity to, development or human populations.
(f) Impacts to the Stephens' Kangaroo Rat are not limited to loss or degradation of actually occupied habitat only.
(g) The successful completion and implementation of a Habitat Conservation Plan for the Stephens' Kangaroo Rat would be jeopardized by not implementing a

(h) Each proposed development project shall be reviewed to determine the most appropriate course of action to ensure the survival of the species through one or more of the following: (1) on-site mitigation of impacts to the Stephens' Kangaroo Rat through the reservation or addition of lands included within or immediately adjacent to a potential habitat reserve site, or (2) payment of the Mitigation Fee set by this Article or (3) any combination of (1) and (2) consistent with the intent and purpose of this Article. A proposed development project may be referred, for review, to Federal and State resource agencies based upon criteria which may be established and agreed upon by the City and said agencies.
(i) A program providing for off-site project mitigation in accordance with the development of a Habitat Conservation Plan will provide a mechanism for establishing sufficient habitat areas which can be effectively protected and managed for the Stephens' Kangaroo Rat's survival and recovery.
The Stephens’ Kangaroo Rat Habitat Conservation Plan provides a regional (j) conservation and permitting framework necessary to allow development within the SKR Plan Area. All Mitigation Fees collected pursuant to the provisions of this Article shall be used for the development, preparation and implementation of a Habitat Conservation Plan for the Stephens' Kangaroo Rat, including, but

(k) Adoption of this Article will provide mitigation for projects within the historical range of the Stephens' Kangaroo Rat allowing said projects to proceed during the implementation of the updated Habitat Conservation Plan for the Stephens' Kangaroo Rat, provided said projects are not located in areas identified as and meeting the criteria for potential habitat reserve sites needed for the conservation of the species. The approval of such development projects could jeopardize the survival of the species and therefore would be inconsistent with a Habitat Conservation Plan, even if the Mitigation Fee is paid.
(l) Adoption and implementation of this Article demonstrates the City’s intent to cooperate with federal and state agencies to provide for the survival of the Stephens' Kangaroo Rat.
(m) The passage of this Article is intended to be consistent with the requirements of state and federal environmental legislation, including the California Environmental Quality Act.
(n) The Riverside County Habitat Conservation Agency Board of Directors adopted the 2026 SKR Habitat Conservation Plan Nexus Study on July 9, 2026.

Sec. 58-93 PURPOSE
The purpose of this Ordinance is to fund implementation of the Updated Stephens’ Kangaroo Rat Habitat Conservation Plan to maintain incidental take authorization for development within the SKR Plan Area. It is the further purpose of this Article to provide a method for mitigation of impacts to the Stephens' Kangaroo Rat caused by the loss of its habitat due to development during the implementation of the Updated Habitat Conservation Plan and provide for habitat mitigation to be identified in the Habitat Conservation Plan. Mitigation of impacts to the Stephens' Kangaroo accomplished Rat will be through the review of each proposed development project within the Fee Assessment Area to determine whether on-site mitigation through the reservation or addition of lands included within or immediately adjacent to a potential habitat reserve site or payment of the Mitigation Fee or a combination of both is appropriate and furthers the ultimate Habitat Conservation Plan objectives. Sec. 58-94 DEFINITIONS
As used in this ordinance, the following terms shall have the following meanings:
(a) City Council. The City Council for the City of Hemet. (b) Certificate of occupancy. "Certificate of occupancy" shall mean a certificate of occupancy as defined by the ordinances of the city, or if no definition therein exists, as defined by the laws of the State of California. (c) City. The City of Hemet.
(d) Development Permit. An on or offside grading, building, or surface mining permit, or mobile home installation permit, or mobile home site preparation permit, or any other permit or authorization which permits or authorizes the disturbance of land.
(e) Fee Assessment Area. All real property located within the area as described in Section 58-95 of this Article.
(f) Final Inspection. “Final Inspection” shall mean a final inspection as defined by the Hemet Municipal Code or state law.
(g) Habitat Conservation Plan. A plan prepared pursuant to Section 10(a) of the Federal Endangered Species Act of 1973, 16 U.S.C. Section 1539. (h) Mitigation Fee. The fee imposed pursuant to the provisions of this Article.

(k) Section 10(a) Permit. A permit issued by the Secretary of the Interior pursuant to Section 10(a) of the Federal Endangered Species Act of 1973, 16 U.S.C.
Section 1539.
(l) Stephens’ Kangaroo Rat. An animal species known as Dipodomys Stephensi. (m) Grading Permit. "Grading Permit" shall mean a grading permit as defined by Ordinance No. 457, provided, however, that for purposes of this Article, 'grading permit' shall not include the following:
(1) A grading permit wherein grading was previously performed pursuant to a grading permit issued within one (1) year prior to November 15, 1988, and subsequently inspected and approved by the City of Hemet Department of Building and Safety. In addition, the area to be graded pursuant to said permit shall be the same or substantially the same area previously graded.
(2) A grading permit for real property upon which a detached or attached second unit will be constructed pursuant to Chapter 67 of the Hemet Municipal Code.

Sec. 58-96. LAND DISTURBANCE REPORTS.
(a) Until the city has been notified by the RCHCA that those certain core reserves as identified in the SKRHCP have been completed, the city, from information provided by the applicant for the development permit, shall complete and deliver to the RCHCA a land disturbance report for all development permits issued for real property located within the boundaries of the plan area which shall set forth the location of the land disturbed, the number of acres within the parcel to be developed, the amount of the impact and mitigation fee paid, if any, and the number of acres occupied by Stephens' Kangaroo Rats which have been disturbed, if any, as described in a biological survey, if required. (c) The city shall cause all land disturbance reports and all core reserve land disturbance reports to be forwarded to the RCHCA no later than the 15th day of each month.
Sec. 58-97. MITIGATION FEE.
All applicants for development permits within the boundaries of the Fee Assessment Area who cannot satisfy mitigation requirements through on-site mitigation as determined through the environmental review process shall pay a Mitigation Fee of $900.00 per gross acre of the parcels proposed for development. However, for single- family residences on a single legally created lot, where the building permit is issued to an individual property owner and is not part of a subdivision, tract development, or any coordinated multi-unit residential development, a Mitigation Fee of $250.00 shall be paid; and for agricultural development which requires a development permit excluding the construction of single family residences in connection with said agricultural development, a Mitigation Fee of $500 per gross acre shall be paid.
Sec. 58-98. IMPOSITION OF FEE.
No Development permit for real property located within the boundaries of the Fee Assessment Area shall be issued or approved except upon the condition that on-site mitigation will be provided as determined through the environmental review process or the

Sec. 58-99. PAYMENT OF FEE.
The Mitigation Fee shall be paid upon issuance of a grading permit or a certificate of occupancy or upon final inspection, whichever occurs first. Payment of the Mitigation Fee shall comply with City conditions of approval previously placed on development permits with regard to impact mitigation for the Stephens' Kangaroo Rat which have not been previously satisfied and no further review and approval pursuant to the provisions of this Article shall be required.
For a parcel subject to a surface mining permit, the Mitigation Fee due pursuant to the provisions of this Article shall be paid upon submission of an application for a special inspection permit under Ordinance No. 555 prior to the commencement of the mining operation or in the alternative, may be paid in increments upon submission of an application for a special inspection permit under Ordinance No. 555 prior to the commencement of each phase of the mining operation authorized by the surface mining permit. Each increment of payment shall be equal to $1,950.00 multiplied by the sum of (1) the total number of surface acres of land within the applicable phase pursuant to the surface mining permit and (2) the quotient which results from dividing the total number of acres of land covered by the surface mining permit and subject to this Article, which are prohibited from disturbance or designated as setback or buffer areas pursuant to the

The total number of surface acres of land within each phase shall be determined through a physical survey prepared by a licensed surveyor or registered civil engineer. (a)Deferral of payment of the fee. At the option of the applicant for a grading permit, payment of the Mitigation Fee may be deferred until the issuance of the first building permit within the parcels proposed for development. Prior to issuance of the grading permit, an instrument shall be recorded by the applicant in the City of Hemet Public Works / Engineering Department which gives notice that prior to issuance of the first building permit, the entire Mitigation Fee as calculated prior to issuance of the grading permit shall be required to be paid.
Sec. 58-100. REDUCTION FOR NON-PROFIT ENTITIES.
The fees required pursuant to Section 58-97 shall be reduced by 75 percent for non-profit entities. For purposes of this section, non-profit entities shall be defined as those entities identified in 26 U.S.C. Section 501(c)(3).
Sec. 58-101. EXEMPTIONS.
For purposes of this article, the following types of development shall not be required to pay Mitigation Fee unless such development voluntarily participates in order to mitigate the disturbance of land occupied by the Stephens' Kangaroo Rat habitat. (a) Reconstruction of any structure damaged or destroyed by fire or other natural causes.

(c) Development of any parcel for which the California Department of Fish and Game and the United States Fish and Wildlife Service has approved other mitigation procedures; this Article
(d) Development of any parcel used by local, state, or federal governments for governmental purposes (i.e. public works, schools).
(e) Development of any parcel for which a Mitigation Fee has been previously paid. However, in instances where the fee previously paid was the fee for single-family residential development, wherein all lots within the development were greater than one-half gross acre in size, and the applicant for a development permit subsequently requests an increase in residential density or a change from a residential to a non-residential use, or in instances where the parcel has been previously developed for agricultural purposes and the applicant for a development permit subsequently requests a change from an agricultural to a residential, commercial, or industrial use, the fee shall be recalculated for the new density or use pursuant to the provisions of this article.
Any difference between the recalculated fee and the previously-paid fee shall be required to be paid by the applicant. Development of any parcel for which approval of an amendment, minor change or revision to a tentative tract map or tentative parcel map is sought; or development of any parcel for which approval of a request for substantial conformance or a revised conditional use

Sec. 58-102. REFUND.
(a) In the event that the fee provided for by the final Habitat Conservation Plan is Less than the Mitigation Fee paid, the current property owner of record may apply for a partial refund of said fee. The amount of any refund due shall be determined by the City Council in its sole discretion after review of said application and shall be limited to the funds collected in excess of any amount received as a credit against the Habitat Conservation and Open Space Land Bank Fee pursuant to the provisions of Ordinance No. 659. (b) If an applicant for a grading permit has paid the Mitigation Fee pursuant to the provisions of this Article and said fee would not have been required to be paid, had Subsections (m)(l) and (2) of Section 4 of Ordinance No. 663 been in effect at the time of payment, the applicant may apply for a refund of the Mitigation Fee paid. The Building Director shall make the determination as to whether the applicant is entitled to a refund of the fee paid and shall provide a refund, if appropriate.

FEE ADJUSTMENT.
The Mitigation Fee shall be that amount established by the Riverside County Habitat Conservation Agency Board of Directors, as may be amended from time to time, consistent with Government Code sections 66000 et seq. The City Council hereby authorizes implementation of such fee as adopted by the RCHCA Board. The dollar amounts set forth in Section 58-97 reflect the fees currently established by the RCHCA and are subject to adjustment as provided in this Section.
Beginning July 1, 2027, and annually thereafter, the fee shall be adjusted automatically based on the Consumer Price Index for All Urban Consumers (CPI-U) for the Los Angeles-Riverside-Orange County region, or a successor index.
Any increases adjustment to the mitigation fee that the fee beyond an authorized annual inflation adjustment shall be supported by findings consistent with Government Code section 66001 and shall be based upon an adopted or updated nexus study where required by law. Prior to adoption of any such adjustment, the nexus study and supporting data shall be made publicly available in accordance with Government Code section 66016, including posting at least thirty (30) days before the public hearing. Any substantive increase in the mitigation fee shall become effective adoption, consistent sixty following with days than earlier no (60) Government Code section 66017.
Adjustments to the Mitigation Fee shall be prospective only and shall become effective with resolution, on the date specified in the adopting consistent Government Code section 66017. The amount of the Mitigation Fee applicable to

Nothing herein shall preclude the City Council from considering changes in projected development levels, anticipated revenues, availability of other funding sources, or updated cost information in determining the appropriate Mitigation Fee amount.
Sec. 58-104. FEE ADMINISTRATION.
All Mitigation Fees collected pursuant to the provisions of this Ordinance shall be deposited into a Mitigation Fee Account.
Funds in said account shall be expended solely for the development, preparation and implementation of a Habitat Conservation Plan for the Stephens' Kangaroo Rat, including the acquisition of habitat reserve sites, and for the application for a Section 10(a) permit under the Federal Endangered Species Act of 1973..
Sec. 58-105. VALIDITY.
This article and the various parts, sections, and clauses thereof are hereby declared to be severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid, the remainder of this article shall not be affected thereby. If any part, sentence, paragraph, section, or clause of this article or its application to any person or entity is adjudged unconstitutional or invalid, such unconstitutionality or invalidity shall affect only such part, sentence, paragraph, section, or clause of this article, or person or entity; and shall not affect or impair any of the

Sec. 58-106. CREDIT.
Where a development project is subject to the provisions of a Development Agreement entered into with the City pursuant to the provisions of Government Code Section 65864 et seq. and the project involves the construction of residential units, the Mitigation Fee required to be paid pursuant to the provisions of this Article shall be reduced by $175.00 per residential unit.
Sec. 58-107. EFFECTIVE DATE.
Pursuant to Government Code section 66017, this Ordinance shall take effect sixty (60) days following adoption. The Mitigation Fee is a required component of the Updated Habitat Conservation Plan for the Stephens' Kangaroo Rat. The City Council declares that this ordinance shall be construed as a continuation of existing Ordinance No. 663 and not as a new enactment, except as to any provisions of this ordinance which are inconsistent therewith. Any development permit previously issued pursuant to Ordinance No. 663 and complying therewith shall be deemed to comply with this ordinance.
