ORDINANCE NO.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HIGHLAND, CALIFORNIA, AMENDING CHAPTER 2. 36 (" FEES AND SERVICE
CHARGES") OF THE HIGHLAND MUNICIPAL CODE TO PROVIDE

ADDITIONAL CATEGORIES OF FEES AND CHARGES, AND TO UPDATE

AND AMEND OTHER PROVISIONS AS APPROPRIATE

THE CITY COUNCIL OF THE CITY OF HIGHLAND, CALIFORNIA DOES ORDAIN AS FOLLOWS:

Section 1. Findings, Purpose, and Intent
A. Commencingin approximately1989, in accordancewith applicable provisionsof the Government Code and the California constitution, the City Council of the City of Highland has commissioned studies and enacted user fees and service charges, in accordance with the City's statedphilosophythat the beneficiariesof servicesprovidedby the Cityshould pay the fully burdenedcost of providingthose services, and to ensure that the fees adoptedby the Cityfor servicesrendereddo not exceedthe reasonableestimatedcost for providing the services for which the fees are charged. The City' s fees and service charges are codified as Chapter 2. 36 of the Highland Municipal Code (" Chapter 2. 36").

B. The schedule of services for which the City adopts and collects fees and charges are listed in the Schedule of Fees and Service Charges set forth in Section 2.36. 040 of the Highland Municipal Code. The Schedule of Fees and Service Charges further sets forth the percentageof costs reasonablyborne to be recoveredfrom the recipientsof services providedby the City, as determinedby the CityCouncilin its reasonablediscretionand pursuant to its police powers.

C. Wherethe City Councilhas determinedto recoverlessthan the full cost of providinga service, that reduction is set forth in the Schedule of Fees and Service Charges. The City Council finds and determines that those reductions in fees and charges are adopted pursuantto the City's policepowers, to preservethe public health, safety, and welfare, and particularlyto encouragepropertyownersand residentsof the City to obtaincertain categories of permits and inspections, and to make certain services more affordable to the public.

D. Chapter 2.36 further enables the City Council to establish, by resolution, the fees and service charges to be collected for City services, pursuant to the Schedule of Fees and Service Charges, upon the recommendation of the City Manager.

E. The City Council retained the services of Revenue & Cost Specialists, LLC, to update its fees and service charges, which revised fees and charges are set forth in the " Service Cost Update for the City of Highland" ( the " Service Cost Update") dated May 4, 2025. The categories of services for which fees and charges are to be collected are set forth in the Service Cost Update.

F. TheCityCouncilfindsthatthefeesestablishedbytheServiceCostUpdatedo notexceed the estimated reasonable cost of providing the services for which the fees are charged.

G. The City Council now wishes to update its Scheduleof Fees and Service Charges pursuantto the ServiceCost Update, addingnewcategoriesof fees, and to makeother amendments to Chapter 2. 36, as set forth herein.

H. The adoption of this Ordinance does not constitute a " project" under the California Environmental Quality Act (" CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in this Resolution is categorically exempt from CEQA under CEQA guidelines Section 15273 ( a)( 1) because the approval of the User Fees is merely establishing fees to meet operating expenses.

The City has compliedwith the noticeand hearingrequirementsof GovernmentCode Sections 6062( a), 66016, 66017 and 66018, prior to adopting this Ordinance.

Section 2. Code Amendment. The City Council hereby amends Subsection A of Section

2. 36. 040 of Chapter 2. 36 of Title 2 ( Administration and Personnel) of the Highland Municipal Code to read as follows, with all other provisions of Section 2.36.040 remaining unchanged:

A. The city managerand each city departmenthead, under the directionof the city manager, shall review the fees and service charges listed as follows, and provide an adjusted fee or charge schedule to the city council for its consideration so as to recover the listed percentage of costs reasonably borne necessary to provide the listed regulation, productsor services, andto takeall actionsnecessaryto accomplishandto carryoutthe policyof the city councilestablishedby this chapter.
