Draft LAFCo Application

SAN BENITO LOCAL AGENCY FORMATION COMMISSION
Proposal Justification Questionnaire for Out-of Agency Service Agreement Attach additional sheets as necessary)

1. Name of City or District:

City of Hollister

2. Location/Address/size of property:
3825 Union Road, Hollister, CA 95023
1,994 acres

3. APN:
018-190-023, 033, 034; 018-200-056, 057, 058; 021-140-046, 053, 054; 021- 190-006, 017, 030, 031, 031; 023-010-074.

Complete all relevant questions

4. Is the property within the agency's sphere of influence? Yes No X

5. What are the existing uses of the site? Be specific.

The existing uses on the site include San Juan Oaks Golf Club, a public 18-hole golf course, clubhouse, maintenance building, and related facilities. Portions of the site are used for cattle grazing and a limited area is used for agriculture.

Proposal Justification Questionnaire as of November 18,2013—Out of Agency Service Agreement G.2.b
Packet Pg. 553

6. If a change in use is proposed, provide a description of the change.

The San Juan Oaks Specific Plan includes 1,084 single family homes, of which 1,017 are an age restricted Del Webb community; up to 65,000 square feet of neighborhood commercial uses; up to a 200-room resort hotel; a 100-bed assisted living facility; 41 acres of agricultural preserve; 17 acres of community parks; and 1,243 acres of permanent wildlife habitat. The existing public golf course would remain.

7. What types of services are to be provided under contract? Processing of project wastewater under an extended services agreement between the Project's water service provider and the City of Hollister Urban Area Wastewater Service District

8. Discuss the justification for the service agreement. Is this an emergency health and safety situation?
This is not an emergeny health and safety situation. The property is adjacent to the City's urban area boundary for wastewater service, the City has the capacity to process the Project's wastewater, and Government Code section 56133(a) allows the City to provide such processing under agreement with LAFCO approval. Entering into an agreement with the City is consistent with addressing the RWQCB concerns about water quality by providing wastewater processing on a more regional basis.

9. Why is annexation not possible at this time?
The project area is located in the County outside the City's sphere of influence.

The projct area is not likely eligible for annexation because the area includes a conservation easement of nearly 1,200 of 1,993 total Project acres for permanent wildlife habitat includes grazing land and could never be designated for urban development. Also, a number of acres qualify as "prime agricultural G.2.b
Packet Pg. 554

land" as defined in the LAFCO statute, and approximately 41 acres will be in an on-site agricultural preserve. Under Government Code Section 56375(a)(4), prime agricultural land militates against including the Project in the City's sphere of influence since most of the Project area could never be developed, and virtually eliminates LAFCO's ability to automatically approve annexation of that land. Hence, the Project is not, nor would be eligible to be within the City's sphere of influence, and would not qualify for LAFCO approval under section 56133(b).

10. Is annexation of the territory anticipated in the future? 0 Yes No X If yes, when? If no, why not?
See no. 9 above.

11. Describe in detail how services will be extended to the property:

A. Describe needed improvements including distance for connections.

San Juan Oaks waste water will be collected onsite via gravity system and then conveyed via two onsite pump stations approximately 1.6 miles north via onsite force main along San Juan Oaks Drive, then approximately 1.3 miles via offsite force main along Union Road and San Juan Hollister Road to the City of Hollister's domestic wastewater treatment plant/water reclamation facility located just north of San Juan Hollister Road.

B. What are the costs of improvements and other start up costs? The San Juan Oaks waste water system is projected to cost approximately $5 million.

C. How is financing to occur, both capital costs and ongoing operations?
The developer(s) of San Juan Oaks shall finance the cost of and construct the onsite and offsite wastewater improvements. The developer(s) are entering into agreement with Golden State Water Company to be the owner and operator of the San Juan Oaks wastewater system subject to California Public Utilities Commission (CPUC) approval, with Golden State Water Company to operate and maintain the San Juan Oaks wastewater system upon completion of the improvements by the developer(s) prior to CPUC approval. Golden State Water Company would enter into an G.2.b
Packet Pg. 555

agreement with the City of Hollister for the City to treat wastewater generated by the San Juan Oaks project.

12. What environmental review has been conducted for the project? If exempt, please provide a copy of the agency's Notice of Exemption.

Mayor Mia Casey
City of Hollister
375 Fifth Street
Hollister, CA 95023

Dear Mayor Casey,

I am writing on behalf of the San Benito County Business Council in support of Item G 2: RESOLUTION NO. 2023-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOLLISTER ADOPTING A

WASTEWATER TREATMENT SERVICES AGREEMENT BETWEEN THE CITY OF HOLLISTER AND SAN JUAN OAKS MUTUAL WATER COMPANY.

Established in 2001, the Business Council is a 501(c) 6 non-profit member-based organization representing over 45 local and regional municipal agencies, businesses, trade organizations and major employers representing more than 6000 employees in the Monterey Bay, Central Coast and South Bay Regions.

Our current member & organizational goals include; 1) Retention, expansion, job creation and growth of existing businesses, 2) EDC 2017-2022 Comprehensive Economic Development Strategy (CEDS) Implementation, Supporting development of 2023-2028 CEDS - Supporting new business attraction, 3) Improving Infrastructure: Measure G Implementation- road and highway improvements, broadband, energy, education, housing, water & wastewater, tackling blight & litter, and 4) Building relations with elected officials, staff, regional organizations and community.

In consideration of our member goals, local and regional economic stimulus and recreational benefit, San Juan Oaks is offering a newly expanded and fully renovated public Club House, a new farm-to- table restaurant, reimagined golf lounge, pro shop, indoor and outdoor conference and event spaces, a fully redesigned water efficient, drought-tolerant golf course and highly desired housing for age- qualified individuals. The 55+ population accounts for the largest population segment in consumer spending, is the largest US cohort of volunteers and for charitable giving and comprises more than 30% of state and local tax revenues. They are currently supporting nearly 150 jobs in the region and are estimated to grow to 300 at full buildout- in phases over several years.

We feel that the City has an obligation to benefit the community and to leverage the Hollister Wastewater Treatment Plant as a public benefit, as originally intended, not to be politicized or used as an obstacle to prevent housing our support or current and future educational institutions, residents and employers.

The 2002 moratorium paralyzed our community when a gopher hole caused a levy to breach at Hollister’s aging water treatment plant, causing an environmental disaster, sending 15 million gallons of raw sewage down the San Benito Riverbed.

The Business Council then collaborated with the City of Hollister to lift the sewer building moratorium by supporting construction of the new Plant ahead of schedule, under budget and managed by a contractor. The Plant now requires your leadership to become compliant and meet the needs of our residents, employers, agencies, current and future investors.

Sincerely,
President

TITLE OF ITEM: RESOLUTION NO. 2023-134, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOLLISTER APPROVING THE RECEIPT OF $5,227,540 IN PROPOSITION 1

GRANT FUNDING FOR STORMWATER IMPROVEMENTS AT THE INDUSTRIAL

WASTEWATER TREATMENT PLANT AND BRIDGE ROAD OUTFALL

BRIEF DESCRIPTION: The City of Hollister is proposing to construct stormwater improvements at the Industrial Wastewater Treatment Plant and Bridge Road Outfall. The City has received $5.2M grant from the State Water Resources Board to construct the Bridge Road Outfall project with $5.6M in matching funds. The Resolution authorizes the Interim City Manager or designee to sign on behalf of the City, a funding agreement with the State Water Resources Control Board.

RECOMMENDATION: Authorize Interim City Manager or designee as the agent or representative to sign the funding agreement, amendments, and requests for disbursements on behalf of the City of Hollister, and to carry out other necessary Project -related activities with the State Water Resources Control Board.

DEPARTMENT SUMMARY: On June 23, 2020, the City Council approved Resolution 2020-132 authorizing staff to compete for a competitive grant from Proposition 1 funds. Wallace Group prepared the Prop 1 grant application for Round 2 Implementation Grant solicitation to fund the Bridge Road Outfall Trash Capture Project. The grant requires a 1:1 match. The requested grant was $5,227,540 with a match of $5,665,056. The City was notified on February 24, 2022, that the City was awarded the full grant. Staff has been working with the State Water B oard since on preparing the grant agreement. The State Water Board is requiring the City to sign the attached Resolution to authorize the Interim City Manager or their Designee to sign the grant agreement.

BACKGROUND: The City is under a State Water Board mandate to comply with the Trash Capture requirements at all City outfalls. This requires the City to install trash capture systems at all 18 outfalls by 2030. The Bridge Road outfall is the City’s largest outfall with a total treatment flow requirement of 205.5 cfs. The Prop 1 grant has been acquired to pay for this trash capture system which has an estimated construction and soft costs of $5.2M.

The City proposed in the grant application to match the request with stormwater improvements at the Industrial Wastewater Treatment Plant (IWWTP), in kind services, other monitoring & reporting, and education & outreach as well as stormwater improvements recently completed on 4th Street and equipment purchases previously made by the Utilities Department. O f the $5,665,056 match, approximately $2.8M has already been spent by the City leaving $2.9M remaining to be spent over the next two years.

The primary matching fund project, known as “Stormwater Improvements at the IWTP” or “Apricot Lane Improvements” will provide trash capture improvements for both the South Street storm drain (which already flows to the IWTP) and the Apricot Lane Outfall which will treat an additional 37.7 cfs of stormwater runoff. This project is at 90% design completion and is G.3
Packet Pg. 583

anticipated to go out to bid in August/September 2023. This project has an estimated construction cost of $2.4M.

TITLE OF ITEM: RESOLUTION NO. 2023-135, A RESOLUTION OF THE CITY COUNCIL OF

THE CITY OF HOLLISTER EXECUTING A LEASE AMENDMENT WITH THE STATE OF

CALIFORNIA FOR CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION (CAL FIRE) AIR ATTACK BASE TO CONSTRUCT A NEW FACILITY AT THE HOLLISTER

MUNICIPAL AIRPORT

BRIEF DESCRIPT ION: California Department of Forestry and Fire Protection (CAL FIRE) currently leases approximately 8.68 acres of unimproved land at the Hollister Municipal Airport and desires to lease approximately 6.32 additional acres of unimproved land.

RECOMMENDATI ON: A dopt a resolution authorizing the Mayor to execute the lease amendment with the California Department of Forestry and Fire Protection (CAL FIRE) for the Cal -F ire Air Attack Base.

DEPARTMENT SUMMARY: The City of Hollister (City) began its business relationship with CAL FIRE back in the 1960s when the current facility was constructed at the Hollister Municipal Airport (CVH). At that time CAL FIRE was known as the California Department of Forestry (CDF). The Air Attack Base was constructed on a lease parcel towards the south end of the main runway (Runway 13/31). The lease on this facility has been renewed multiple times in the intervening years.

The State of California's Air Attack Base at CVH has become a critical component of the state's Air Attack System. Often the CVH base records statistics that place it as one of the busiest Air Attack Bases in the state. Recognizing this, in the late 1990s, the City and CAL FIRE began planning and negotiating on expanding and relocating the current base to a more optimum location on the airfield. After more than 10 years of planning and negotiationsand in good faiththe City entered into a separate lease agreement with CAL FIRE on an approximate 8 - acre parcel for the relocated facilities. A 50-year lease was approved by the City Council in 2009.

A number of runway improvements have taken place at CVH. In particular, Runway 13/31 evolved to its current configuration with the Runway 31 Threshold relocated approximately 1,150-feet to the northwest of its original position. The 1,150-feet of former runway pavement was employed as an “in-line” taxiway. This “in-line” taxiway configuration allowed for separation of taxiing in-bound and out-bound CAL FIRE aircraft and provided an efficient level of service for CAL FIRE’s air attack tankers. This is achieved by using the parallel Taxiway A for routing in- bound aircraft to the base and using the “in-line” taxiway for routing out-bound aircraft.

The City is obligated to operate the airport in accordance with the FAA’s cur rent rules, standards, and guidelines. From time-to-time the FAA updates/modifies its rules/standards/guidelines, and so what was once deemed operationally acceptable may change. And this is indeed the case with the “in-line” taxiway configuration at CVH. Several years back the FAA advised the City of their updated conclusion that “in -line” taxiways are not G.4
Packet Pg. 588

optimized for safe runway operations and mandated the City correct the situation at CVH by closing all “in-line” taxiways to aircraft operations. The FAA provided federal grant funding through Airport Improvement Program (AIP) grant #03-06-105-21 for closing the “in-line” taxiways at Runway 24 and Runway 31. This federal funding also included for the construction of a Taxiway Design Group (TDG) III taxiway (Taxiway K) which was designed to serve the relocated CAL FIRE facility. The construction of Taxiway K and closure of “in -line” taxiway at Runway 24 has been completed. The City has obtained concurrence from the FAA to suspend construction work - for a limited time -on the closure of the Runway 31 “in-line” taxiway work.

The City anticipates the FAA will require completion of this work to clo se-out the federal grant in 2023.

The City recognizes the operational importance of the CVH Air Attack Base. However, the terms of the relocated base lease agreement stipulate the proposed base facilities must be complete and occupied before any rent is due the City. This lease also precludes the City for pursuing other development on the subject lease area. Accordingly, inaction by CAL Fire on relocating their facility to the new lease parcel is placing a financial burden on CVH, and the operation of the current configurationthe “in-line taxiwayhas the potential of jeopardizing future FAA federal funding at the airport.

This amendment will add approximately 6.32 additional acres of unimproved land for a total of approximately 15.00 acres of land.

The attached lease amendment amends the following sections of the original lease. (1) supersede the Exhibit “A” and Exhibit “B”;
(2) modify the lease commencement and expiration dates; (3) adjust the monthly rent;
(4) amend the “CPI” paragraph;
(5) replace the “Insurance” paragraph and add Exhibit E to said lease to establish the Lessor’s minimum insurance requirements;
(6) amend the “Maintenance Covenant” paragraph;
(7) amend the “Site Utilities” paragraph;
(8) add a paragraph to address a preexisting sanitary sewer traversing the Premises; (9) add a paragraph to address construction, use, and maintenance of a roadway to access the Premises; and
(10) add a paragraph to address Russia sanctions under Executive Order N-6-22.

FINANCIAL IMPACT: Increased annual rental revenues in Fund 601

SCOPE OF WORK AND COSTS
This exhibit describes the scope of services and costs for the Inclusionary Housing Refinement project to be conducted by PlaceWorks for the City of Hollister.

SCOPE OF SERVICES
Community Workshop
PlaceWorks will notice, prepare for and facilitate a bilingual, in-person Inclusionary Housing Community Workshop. The Workshop will be held on a weekday evening at a community facility in Hollister such as the Vet’s Hall. The goals of the workshop will be to:

1. Introduce community members to the purpose of an IH program, specifically that of increasing the supply of local affordable housing in a manner that does not burden or stifle private housing development overall.

2. Introduce, and solicit feedback on, approaches to the basic components of an IH ordinance, including total affordability requirement, household affordability range, applicable development types, alternative compliance techniques, threshold project size, development and/or density incentives and others.

3. Illustrate the potential “on the ground” implications of an IH ordinance that includes a local density bonus. PlaceWorks will present 10-15 visuals of multifamily housing projects generally consistent with the density bonuses included in the current Draft Inclusionary Housing Program.

PlaceWorks will develop Spanish- and English- language noticing and meeting materials for the event and will provide live Spanish-language interpretation services.

PlaceWorks will submit a Workshop Summary Memorandum with feedback results and associated potential IH Program revision strategies, for staff review.

City Council Study Session
PlaceWorks will facilitate an in-person City Council study session to review the results of the Community Workshop and the recommendations in the Workshop Summary Memorandum. We will ask Council members to consider workshop input, and ask for direction regarding core IH Program components such as:
 The total affordability requirement and affordability spread.  Very Low Income (VLI) household requirements.
 Alternative compliance methods, such as land dedication.  Inclusion and/or amount of density bonus.

G.5.b
Packet Pg. 641

Adoption
PlaceWorks will incorporate community feedback and City Council direction from the study session into a Revised Inclusionary Housing Program, which we will shepherd through the adoption process. We will present the Revised Program in-person at two (2) City Council Hearings during the adoption process. Following the first Council Hearing, we will create a Final Inclusionary Housing Program for adoption by ordinance by the City of Hollister, at the second Council Hearing.

COSTS
As shown in Table 1, the total cost of Inclusionary Housing Refinement shall be $30,165.00.
