STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: March 17, 2025
REPORT # Public Works-2025-16

AGENDA ITEM: A RESOLUTION APPROVING AN AGREEMENT WITH KNORR

SYSTEMS, INTERNATIONAL (KSI) FOR THE VALLEY VIEW PARK SPLASH PAD

UPGRADE

DEPARTMENT: Public Works
DEPARTMENT HEAD: William Via, Public Works Director
STAFF CONTACT: William Via, Public Works Director

RECOMMENDED ACTION: Adopt a resolution authorizing the City Manager to execute an agreement with Knorr Systems, International for the upgrade of the Valley View Park Splash Pad W ater Treatment System and authorizing a supplemental appropriation from Fund 205 in the amount of $20,400.

DISCUSSION: The Valley View Park Splash Pad was installed in 2005 for the enjoyment of residents of the City of Hollister during warm Summer days. The original water treatment system has outlived its useful life and needs replacing. Since the initia l installation, there have been advancements in technology for the treatment of the water used by the splash pad. The new technology offers a more reliable system with improved purifying, making the use of the splash pad safer for residents.

The item was posted on bidnetdirect.com on February 21, 2025, and was open to receive informal bids until March 7, 2025 (audit report attached). Staff received one (1) informal bid using this process. KSI’s informal bid was the only one received at $138,961. Since the total cost of the work is under the California Uniform Public Construction Cost Accounting (CUPCCA) limit of $220,000 (as of January 1, 2025), there is no requirement for a formal bid process. However, the City of Hollister's purchasing policy requires City Council Approval for the City Manager to make purchases over $100,000.

FISCAL IMPACT: Expenditures from the approved budget of $96,000 from Fund 101 (General) and $24,000 from Fund 205 (Park Dedication). The supplemental appropriation would increase the budgeted amount in Fund 205 to $44,400, which includes a contingency amount of $1,439.

PREVIOUS COUNCIL OR COMMISSION ACTION: None

CEQA: Categorical exemption per Section 15301 (Existing Facilities).

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: March 17, 2025
REPORT # Fire-2025-06

AGENDA ITEM: FIRE PROTECTION SERVICES NEGOTIATIONS AD-HOC COMMITTEE: CONTRACT AMENDMENT TERMS FOR THE COUNTY OF SAN

BENITO AND THE CITY OF SAN JUAN BAUTISTA

DEPARTMENT: Fire
DEPARTMENT HEAD: Jonathan Goulding, Fire Chief
STAFF CONTACT: Jonathan Goulding, Fire Chief

RECOMMENDED ACTION: Receive report, provide City Manager direction regarding contract amendment terms for the County of San Benito and the City of San Juan Bautista, and to return to the City Council for review and approval of contract amendments.

DISCUSSION: Since 2013, the City of Hollister has provided fire protection services via a contract to the County of San Benito and the City of San Juan Bautista. Since the inception of the first contracts, the contracts were renegotiated in 2016 and 2019. At the request of the City Council, staff provided a presentation regarding the fire services contracts on May 6, 2024. On June 4, 2024, the City Council expressed the intent to issue a notice of termination regarding the fire services contracts with the County of San Benito and the City of San Juan Bautista. To comply with Council’s direction, staff drafted the necessary resolution and notices of termination and received approval from the City Council on June 18, 2024 to issue the notices. These notices were issued on June 20, 2024 and would adjust the termination date of the contracts from December 31, 2025 to March 17, 2025. These documents fo rmally informed the respective agencies of the City’s intention to terminate the fire services contracts; however, the notices also indicated that the City was willing to work with the agencies in lieu of termination. City staff then worked with the staff from both agencies to renegotiate the terms of the contracts.

On January 7, 2025, the City Council created an ad -hoc committee to negotiate the fire protection contracts and appointed Mayor Stephens and Councilmember Resendiz to serve on the committee. On January 21, 2025, the City Council directed the City Manager to rescind both 270-day termination notices. By rescinding the notices, the contracts are now set to expire on their original expiration date of December 31, 2025.

Since the current contracts have provisions to extend an additional calendar year if the contracts are not terminated per the contract terms, the City Council will need to agree to an amendment or issue a new 270-day notice prior to April 5, 2025 to prevent the contracts from being automatically extended for one additional year.

Concurrently to the negotiations, the three jurisdictions have partnered to conduct a Fire District Feasibility Study with the City of San Juan Bautista serving as the lead agency.

The City of San Juan Bautista issued a Request for Proposals for the study and recently awarded a contract to Baker Tilly. The first meeting of the jurisdictions’ staff and the contractor is scheduled for March 14, 2025. This project will be overseen by the Fire

Page 199 of 340 ends

Protection Advisory Committee, which is comprised of two elected officials from each of the three jurisdictions.

Since the formation of the ad-hoc committee, negotiations have been actively underway. As a result of these negotiations, the ad -hoc committee has finalized a set of proposed terms for both the County of San Benito and the City of San Juan Bautista contract amendments and are included as attachments to this agenda item along with the current fire protection contracts for both agencies.

Staff will present the proposed terms of the contract amendments, receive feedback, and, if approved, will work with the County of San Benito and the City of San Juan Bautista to agendize the contract amendments for review and a vote. When the amendments are approved by both agencies, the City Manager will return to the City Council to consider the approval of the amendments.

FISCAL IMPACT: Potential increase in Fiscal Year 2024-25 General Fund Revenue of $1,250,000 with ongoing revenue increases until Fiscal Year 2027-28 per contract escalator factors and potential expenditures savings in future Fiscal Years.

PREVIOUS COUNCIL OR COMMISSION ACTION: January 21, 2025: City Council approved the rescinding of the 270-day contract termination notice for the Fire Protection contracts for both the County of San Benito and the City of San Juan Bautista.

CEQA: Not a project under CEQA.

c. Proposed Staffing and Training Levels

Section A-3 of Attachment A (“Scope of Services”) of the Agreement entitled “Proposed Staffing & Training Levels” is hereby repealed and replaced in its entirety to read as follows:

The COUNTY designated engine (“Station 3”) shall provide no less than a two (2) person response to all incidents. Staffing levels within the City of Hollister and/or any other applicable jurisdiction(s), unless otherwise contracted, shall be determined in the sole discretion of CONTRACTOR.

CONTRACTOR, in its sole discretion, may implement a “Brown Out” of Station 3. For purposes of this Agreement, a “Brown Out” means the temporary closure or reduction in operational status of a fire station, where CONTRACTOR may reassign personnel from Station 3 to other stations to maintain appropriate staffing levels throughout the service area, or CONTRACTOR may decide not to staff Station 3 for a period of time due to personnel shortages, equipment maintenance, budgetary constraints, or other operational needs. The implementation of a Brown Out shall not constitute a breach of this Agreement, nor shall it result in any reduction of compensation paid by COUNTY to CONTRACTOR under the terms of this Agreement.

d. Response Time Provisions

All response time data collected during Brown Out periods shall be excluded from any performance evaluations, metrics, or reports related to CONTRACTOR’S compliance with response time goals. COUNTY acknowledges and agrees that response times during Brown Out periods are contingent upon resource availability, distance from responding units, weather conditions, traffic, call volume, and other factors beyond CONTRACTOR’S control. Any delay in response times during Brown Out periods shall not constitute a breach of this Agreement nor serve as grounds for compensation reduction, penalties, or termination. CONTRACTOR shall have sole discretion in determining the allocation of available resources to meet service demands throughout its entire operational area, including COUNTY.

e. Termination Provisions

Section 6 of the Agreement entitled “Termination” and Section C-10 of Attachment C entitled “Termination” are hereby amended to read as follows:

Notwithstanding any other provisions in this Agreement, CONTRACTOR shall have the right to terminate this Agreement if COUNTY fails to make any payment required under this Agreement within sixty (60) days after such payment is due. Prior to such termination, CONTRACTOR shall provide COUNTY with written notice of the payment default and COUNTY shall have thirty (30) days from receipt of such notice to cure the default by making the required payment. If COUNTY fails to cure the default within the thirty (30) day period, CONTRACTOR may terminate this Agreement by providing COUNTY with written notice of termination, which shall be effective ninety (90) days after COUNTY’S receipt of such notice.

Except as provided above regarding COUNTY’S failure to pay, neither party shall have the right to terminate this Agreement prior to its expiration date as set forth in Section 1 of this Agreement, as amended.

2. Inconsistency; Conflicts. In the event of any conflict between the provisions of this Amendment and the original Agreement, the provisions of this Amendment shall control.

3. Agreement Continuance. Except as expressly modified and supplemented by this Amendment, all other terms and conditions in the original Agreement remain in full force and effect and continue to bind the parties.

4. Counterparts. This Amendment may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Digital signatures comporting with the requirements of Government Code section 16.5 shall have the same force and effect as an original “wet” signature.

Page 208 of 340 ends

• DISASTER PREPAREDNESS & RESPONSE: Ensure that the Department maintains the ability to respond to major emergencies and disasters through participation in all local exercises and training that are consistent with the County Operational Area Emergency Operations Plan. In the event of a local, state, or presidential proclaimed/declared disaster, CONTRACTOR shall follow protocols and procedures as defined in the Standardized Emergency Management System, California Emergency Services Act, San Benito County Operational Area Emergency Operations Plan, and any other applicable plan, policy, or system, including communicating/coordinating with the appropriate county official or staff for response, recovery, and mitigation activities.

A-3 PROPOSED STAFFING & TRAINING LEVELS
Staffing levels, training levels, use of auto/mutual aid agreements, unless otherwise agreed to, in writing, by the parties to this Agreement, shall be comprised of paid full time fire professionals with a ranking of one (1) Fire Chief, one (1) Battalion Chief per shift, one (1) Prevention Battalion Chief, and a combination of Fire Captains, Fire Engineers, and Firefighters to staff the four (4) engine companies covering the City and COUNTY.

Three shifts of engine companies per fire station will provide no less than a 2 (two) person response to all incidents on the CONTRACTOR staffed COUNTY designated engine and on the CONTRACTOR staffed Revised 10/30/18 Attachment A: Page 2 of 6

Page 209 of 340 ends

San Juan Bautista engine located within the San Juan Bautista city limits, and no less than a three (3) person response on all CONTRACTOR staffed engines located within the CONTRACTOR city limits (station 1 on Fifth Street and Station 2 on Union Road).

A-4 RESPONSE
Fire Companies will be dispatched from SCR911 as directed by the Fire Chief to meet the needs of the incident and provide the resources required. SCR911 provides pre-event /incident planning for calls for service and emergency medical dispatch. Fire Companies are assigned by the Chief to meet the need for each type of incident. Additional resources may be requested dependent upon the incident.

Response goals have been established to allow CONTRACTOR and COUNTY to evaluate the effectiveness of the Fire Department response times. The department has four pre-established zones (see images below for maps) based on station location. Each response zone identifies the response times that the department aims to reach to the 90th percentile. For calls that fall outside of the pre-defined response zones, such as those in the southern, rural portion of the county, adequate response times are defined using the following formula: Distance in miles from the nearest Hollister Fire Station at a rate of 35 miles per hour. For example, a call that is 35 miles from the nearest fire station should take the first apparatus 60 minutes or less to arrive. On a case by case basis, should weather, traffic, call queuing, or any other unforeseen complication to the response occur, an exemption may be granted and thus not counted towards the 90th percentile goal.

Response times are defined as the time from initial notification by dispatch to the assigned apparatus to arrival of the first unit on scene of the call for service.

A-3 PROPOSED STAFFING & TRAINING LEVELS
Staffing levels, training levels, use of auto/mutual aid agreements, unless otherwise agreed to, in writing, by the parties to this Agreement, shall be comprised of paid full time fire professionals with a ranking of one (1) Fire Chief, one (1) Battalion Chief per shift, one (1) Prevention Battalion Chief, and a combination of Fire Captains, Fire Engineers, and Firefighters to staff the four (4) engine companies covering SJB, CONTRACTOR, and COUNTY.

Three shifts of engine companies per fire station will provide no less than a 2 (two) person response to all incidents on the CONTRACTOR staffed County designated engine. On the CONTRACTOR staffed SJB engine located within the San Juan Bautista city limits, no less than a three (3) person response on all CONTRACTOR staffed engines.

Response goals have been established to allow CONTRACTOR and SJB to evaluate the effectiveness of the Fire Department response times. For example, a call that is 35 miles from the nearest fire station should take the first apparatus 35 minutes or less to arrive.

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: March 17, 2025
REPORT # City Manager-2025-20

AGENDA ITEM: CONSIDER, DISCUSS, AND PROVIDE DIRECTION REGARDING

CREATING A CITY OF HOLLISTER ENTERTAINMENT DISTRICT

DEPARTMENT: City Manager
DEPARTMENT HEAD: David Mirrione, City Manager
STAFF CONTACT: David Mirrione, City Manager

RECOMMENDED ACTION: Discuss whether the City Council would like to proceed with developing an Entertainment District and if so, provide direction to staff regarding which approach to developing an Entertainment District should be utilized.

DISCUSSION: At a recent City Council meeting, one Councilmember requested more information regarding creating an Entertainment District. Establishing an Entertainment District can be accomplished through three different avenues.

Marketing approach – Name a specific area to be a designated entertainment district.

This marketing type approach would let visitors and residents know a particular area of Hollister is the “Entertainment District” through the city website, tourisms, and perhaps physical signage. While the Council could denote naming an area by resolution, this would not be noted in code or through other more formal designations. Subsequent budget allocations would need to be made to accomplish other marketing objectives connected to the naming of the area.

Create an overlay district within the zoning code.

Overlay districts are additional zoning laid over an established zoning area or areas.

An entertainment overlay district could create additional or different regulations that could address and support concerns that would be unique to such an entertainment area. For instance, an entertainment overlay district may have different noise regulations, lighting, and aesthetic requirements. An overlay district could provide for street performances where such activities would be precluded elsewhere.

Creating an overlay district would require adopting a new zoning ordinance.

Create an assessment district.

A district could also be created through the development and creation of an assessment district. Assessment districts provide a funding mechanism to improve or provide specific services for properties or businesses within a specific area. Depending on the type of district and who will benefit, property or business, collecting the assessment is done on property tax rolls or through business license taxes. It is important to note, assessments are levied as a charge for the special benefit of a property or business that will derive from the improvement or service provided by the assessment. This assessment is not a fee or tax which has different requirements.

Page 239 of 340 ends

Establishing an assessment district is an involved process that is highly regulated. Prior to creation, those assessed cast ballots voting for or against the assessment. The notification process and timeline to establish an assessment district is involved and detailed. If Council would like to pursue establishing an assessment district, staff recommends a subsequent conversation regarding the steps and costs involved in establishing such a district, the requirements on the City for collecting the assessment, and regulation of the funds once collected.

HOLLISTER CITY COUNCIL
MEETING DATE: March 17, 2025
REPORT # Public Works-2025-23

AGENDA ITEM: A RESOLUTION APPROVING THE 2026-2030 CAPITAL

IMPROVEMENT PROJECTS PLAN

DEPARTMENT: Public Works
DEPARTMENT HEAD: William Via, Public Works Director
STAFF CONTACT: William Via, Public Works Director

RECOMMENDED ACTION: Receive report and adopt a resolution approving the 2026-2030 Capital Improvement Projects Plan.

DISCUSSION: The Five-Year Capital Improvement Project (CIP) Plan identifies projects planned to be completed in the next five years. Staff have identified numerous projects to be completed next Fiscal Year and other projects to be scheduled for either design or construction in the following four years. Many of these projects are identified in the City’s master plans, and others have been identified by staff, residents, and the Council.

Most of the projects slated for next fiscal year will be included in the budget for next year, while others will be brought back to Council when design and estimates are completed, or when other funding sources become available. The remaining four years of the plan are a “work in progress”. In summary, projects may move forward to the next year or may move back another year, depending on funding, immediate need, and other factors that may change in a year’s time. It is a living document that is updated annually.

The largest portion of the CIP plan is in Public Works. The projects listed for completion in the attached document for FY 25-26 include water, sewer, storm, streets, parks, Fire Station, and Police. Some of these projects have already been designed and are either out for bids now or are being prepared to advertise. Public Works projects include street overlays, ADA ramp upgrades, water line replacements, sewer manhole replacements, storm water line installations, and DWWTP upgrades and replacements. There are also projects included for Police, Fire, and Parks.

FISCAL IMPACT: The total cost for all projects (those with estimates) is $35,042,907 across various Funds.

PREVIOUS COUNCIL OR COMMISSION ACTION: None

CEQA: Each individual project will be analyzed for compliance with CEQA.

This project is a combination of multiple projects from the Water Master Plan that includes the replacement of cast iron in various areas. *This project was submitted for an $8.5 million federal earmark which has not been awarded. The matching portion would be $4.5 million.

Multiple water lines are undersized and made of obsolete cast iron. Replacement will improve fire flows and reduce water interruptions.

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: March 17, 2025
REPORT # Public Works-2025-22

AGENDA ITEM: DOMESTIC WASTEWATER TREATMENT PLANT OPERATIONS

OPTIONS

DEPARTMENT: Public Works
DEPARTMENT HEAD William Via, Public Works Director
STAFF CONTACT: William Via, Public Works Director

RECOMMENDED ACTION: Receive Report and provide direction.

DISCUSSION: The current contract with Veolia Water West Operating Services, Inc. (Veolia) expires on February 6, 2026. This report will summarize three (3) options for future operations of the Domestic Wastewater Treatment Plant that have been identified by staff and seek direction from Council on how to proceed.

Option 1: Extend the current contract with Veolia for the remainder of the original six (6) year term extension.

On August 2, 2010, the City entered into a professional services agreement with Veolia for operations and maintenance services of the Domestic Wastewater Treatment Plant (DWWTP). The second amendment to the original agreement extended the contract to August 2, 2024, and included an option to extend the contract for one six (6) year term at the discretion of the City (Resolution No. 2014-114 adopted June 2, 2014).

On July 30, 2024, City Council approved the Fifth Amendment (Resolution 2024-109) to the agreement, which extended the agreement for eighteen (18) months. This would leave another forty-two (42) months available from the six (6) year option; which would have an ending date of August 6, 2030. This option would cost an estimated $1.5 million for the annual contract amount for staffing.

This option offers the City the reliability of having properly certified operators since it is Veolia’s responsibility to provide them. The current contract with Veolia also requires them to replace and/or repair any item under $25,000 at their expense and other operating costs not specifically called out in the contract (office supplies, tools, parts, uniforms, etc.).

Option 2: Operate the DWWTP with City staff.

Because of the complexity of the treatment process at the DWWTP, a Grade V operator’s certificate is required of the Chief Operator and a Grade III is required of an Operator-In- Charge. The City does not currently employ any individuals with the proper certifications required to operate the DWWTP for either of these positions and wastewater operators, especially with a Grade V certificate, are in high demand. This option would require recruitment for all positions needed to operate the plant and would cost an estimated (comparing with the Cities of Watsonville and Tracy) $1.1 million for staffing once the

Page 337 of 340 ends

positions were filled. This option would also require the City to pay for all operating supplies and repairs and maintenance that are cur rently the responsibility of Veolia, as mentioned above.

Option 3: Issue a Request for Proposals (RFP)

Staff would issue an RFP to gather proposals from qualified entities to enter into a new contract to operate the DWWTP. This option would require the t ime necessary to issue the RFP, review the proposals, negotiate the contract, award the contract, and possibly transition to a new operator. The cost for this option is uncertain and depends upon any proposals that may be received. Additionally, it is recommended that staff secure a consultant to assist with the development of the procurement materials if the Council chooses to proceed with this option.

Staff recommends Option 1 at this time. This option will provide the time necessary to make any needed repairs and upgrades (solids handling, vacuum truck dumping station, etc.) to the plant prior to making any decision about staffing the plant with City staff or issuing an RFP to look for a potential new contractor. An extension to the current contract would also allow the time necessary to recruit the necessary personnel to operate the plant internally, should Council decide to do so. A hybrid of the first two options could also be considered, wherein an extension would be granted, and the City could recruit Operators-in-Training to train with Veolia Personnel in preparation for internal operations at the end of the six-year extension. If Council’s direction is to proceed with Option 1, staff will bring back to Council a contract amendment for consideration.

FISCAL IMPACT: None at this time.

PREVIOUS COUNCIL OR COMMISSION ACTION: Council adopted Resolution No. 2014-114 on June 2, 2014, amending the original agreement and extending the contract to August 2, 2024. On July 30, 2024, Council adopted Resolution No. 2024-109 approving an eighteen-month extension.

CEQA: Not a project as defined by CEQA.

ATTACHMENTS: None
