Carol Lenoir expressed her disagreement with the contract as presented and stated the County needs to pay its fair share.
Alice asked the council to protect fire personnel and listen to the voters.
Suzanne Howard asked the Council to listen to the Fire Department staff because they are the experts and know how to keep residents safe.
Joe would like the council to consider that there is a spectrum of options to choose from, and this does not feel like the right choice.
Kelly Monroe is discouraged by the lack of communication; she stated that no one is acting in the best interest of everyone else. She asked the agencies to communicate and cooperate with one another.
Jonathan Casey asked the council to review the 2019 discussion regarding this topic to see the similarities. He also asked them to reconsider the payment escalator in the current contract.
There being no more speakers, public comment was closed.
3 Council Member Morales proposed adding wording to the contract that states that there would be three firefighters on an engine, without changing the dollar amount. She also asked that we add an exit strategy just in case something does not work.

City Manager David Mirrione provided the staff presentation.
Councilmember Morales requested and received information regarding the potential impact of eliminating vacant positions on the City's operations and staff. Councilmember Morales requested an analysis at a future meeting on the potential impact of cutting employee positions that work in positions that generate revenue for the City.
Mayor Stephens opened the public hearing at 6:52 p.m.
Jay Donato, representing SEIU Unit 521, spoke regarding the need to focus on employee retention due to the tight budget and low staff morale.
Mr. Donato asked the City to protect the City's vacancies but not fund them in the upcoming budget to allow them to be filled more easily when funding is available. Mr. Donato opposed a pay cut for City employees because employees may leave for other organizations.
Eva Kelly, representing the Mid-Management Association, provided information regarding vacant positions not included in the information presented, whose responsibilities are being covered by members of the Mid-Management Association and which vacancies represent almost $3.1M in unfilled positions. Ms. Kelly reviewed various positions that the City previously agreed to review in a salary study and positions fun ded
3 with below average salaries. Ms. Kelly reported on various benefits given to members of the Mid-Management Association below that of other City bargaining units, a hiring and recruitment freeze for Mid-Management Association vacancies, and various proposals offered by the Mid- Management Association that were rejected by the City. Ms. Kelly recommended the City fill currently contracted positions with City employees to reduce costs and commented on the costs associated with the 2025 Hollister Independence Rally. Ms. Kelly described various revenue opportunities for the City, such as annual fee increases, enforcement of code enforcement fines and deadlines, and avoiding implementation of new programs that require ongoing staff to implement.
Finally, Ms. Kelly urged the City Council to continue negotiations with the City of San Juan Bautista and County of San Benito County regarding fire contract services, consider cancelling the 2025 Hollister Independence Day Rally due to associated costs, and consider staff furloughs over staff layoffs.
Ambur Cameron, representing the Mid-Management Association, expressed concern regarding the incorrect information presented by the City related to City vacancies and recruitment efforts. Ms. Cameron spoke regarding stagnant wages and lack of upward mobility opportunities for Mid-Management Association members. Ms. Cameron expressed concern regarding additional vacancies that will likely be created without support from the City.
Mayor Stephens closed the public hearing at 7:26 p.m.
The members of the City Council thanked staff for their work to support the City, for coming to the meeting, and for sharing their concerns with the City Council.

STAFF REPORT
HOLLISTER CITY COUNCIL
MEETING DATE: June 16, 2025
REPORT # City Manager-2025-40
AGENDA ITEM: A RESOLUTION APPROVING THE FISCAL YEAR 2025-26
COMPREHENSIVE USER FEE SCHEDULE
DEPARTMENT: Adminstrative Services
DEPARTMENT HEAD: David Mirrione, City Manager
STAFF CONTACT: David Mirrione, City Manager
RECOMMENDED ACTION: Adopt a resolution approving the Fiscal year (FY) 2025-26 Comprehensive User Fee Schedule with an increase based on the Consumer Price Index (CPI).
DISCUSSION: The City of Hollister takes great pride in delivering a variety of services to our community. Most of these services are available with no additional expense to users. However, when a specific service benefits an individual, rather than the broader community, the user of that service may be required to cover some or all the City’s costs associated with the delivery of that service. These costs are commonly known as “user fees.”
The City has the legal authority to collect user fees to offset the cost-of-service delivery, which also provides an opportunity for the City to uphold efforts associated with transparency and financial responsibility.
In establishing user fees, the City prioritizes the following tenets:
Not overcharging fee payers; and
Establishing the true costs of programs and services; and Providing legal support for any fee set by the City to ensure compliance with state law.
The City of Hollister also has Fiscal and Budget Policies that guide how user fees are established. These policies require that fees are reviewed on an ongoing basis to ensure that they keep pace with changes in the cost-of-living and with changes in methods or levels of service delivery.
This policy also identifies user fee cost recovery levels, including high cost recovery services and low cost recovery services. When considering cost recovery methodologies, City policy evaluates the following factors:
1. Community-wide vs. Special Benefit
2. Service Recipient vs. Service Driver
3. Effect of Pricing on the Demand for Services
4. Feasibility of Collection and Recovery
In evaluating these variables, the City’s low cost recovery services include instances
where there is a clear community benefit and no intended relationship between the cost of delivering a service and the amount paid by a user of the service. For example, almost all social service programs are low cost recovery services. The City’s policy also identifies many public safety services, access to parks, small-scale licenses, and instances where collecting fees would discourage compliance with regulatory requirements as low cost recovery services that should have user fees benchmarked at a level lower than the true cost of providing those services. The policy announces that the primary funding for these services should be general revenues and not user fees.
The same policy identifies methodologies for high cost recovery services by identifying these services in several different categories including services that are similar to those services offered in the private sector, the use of the service is generally discouraged (i.e. police response to a disturbance, false alarm call-outs, etc.), for demand management purposes, and/or if the service is regulatory in nature (i.e. building permits, plan checks, subdivision review fees, etc.).
The City’s Fiscal and Budget Policies also have specific user fee cost recovery rules for the following different categories:
Recreation Programs
o Youth/Teen/Senior Programs (Low-Range Cost Recovery)
o Community Classes (Mid-Range Cost Recovery)
o Adult Programs (High-Range Cost Recovery)
Development Review Programs
o Policy states cost recovery should be in the high range for related services in Planning, Building, Engineering, and Fire categories. o Policy states that in most instances, cost recovery should be 100%.
City policy further states that user fees for services in Enterprise Funds shall be set at levels which fully cover all direct and indirect costs. These services include the following enterprises: Water, Sewer, Street Sweeping, Briggs Building, Airport.
The City’s Fiscal and Budget Policies also require the City to conduct a comprehensive analysis of City costs and fees at least every five years. City staff completed portions of this comprehensive analysis (also known as a fee study) of the City’s fees and the master fee schedule was updated in February 2025. However, the City’s policy also allows the City to adjust fees using a Consumer Price Index (CPI) each fiscal year. The proposed FY 2025-26 Comprehensive User Fee Schedule recommends adjusting fees based on the region’s CPI. In this case, the City is using the San Francisco Area Consumer Price Index (CPI) as published periodically by the United Stated Bureau of Labor Statistics.
The CPI is based on prices of food, clothing, shelter, and fuels, transportation fares, charges for doctors' and dentists' services, drugs, and the other goods and services that people buy for day-to-day living. Each month, prices are collected in 75 urban areas across the country from about 6,000 housing units and approximately 22,000 retail establishments—department stores, supermarkets, hospitals, filling stations, and other types of stores and service establishments. All taxes directly associated with the purchase and use of items are included in the index. Based on this information, the Bureau of Labor Statistics published the following report to summarize the changes:
Based on this information, staff recommends the City Council adopt the FY 2025 -26 Comprehensive User Fee Schedule that increases fees at, or close to, the region’s 12- month CPI that captures CPI growth over the last year. This action would allow the City’s cost-recovery abilities to more closely align with the increase in costs to provide services while also complying with the principles discussed in the City’s Fiscal and Budget Policies.
Impact Fees that were not part of the February 2025 comprehensive analysis will be brought to City Council at a later date, through a separate process.
The attached draft fee schedule includes staff’s recommendation to increase fees based on CPI in the amount of 1.3%.
Further, as demands for public services regularly evolve it may be necessary for the City to charge a user fee that is not currently listed in the draft Fee Schedule being presented tonight. Therefore, staff is also recommending that the City Council delegates authority to the City Manager, in coordination with the City Attorney, to establish any necessary user fee based on the fully burdened hourly rates directly associated with the delivery of a City service.
Finally, Section 66017 of the California Government Code requires a 60 -day “waiting period” before any development fee increase can be effective. If the City Council adopts the FY 2025-26 Comprehensive User Fee Schedule on June 16, 2025, the fees will become effective on Friday, August 15, 2025.
FISCAL IMPACT: Adopting the FY 2025-26 Comprehensive User Fee Schedule with an increase based on CPI will increase revenues and allow the City to enhance cost recovery efforts associated with providing various services to the community, partially offsetting its operational costs.
While it is not necessarily a 1-for-1 correlation to an increase in fees and an increase in revenues collected as the increase in fees could deter certain users from receiving services, including discretionary services, every 1% increase to user fees is estimated to increase City revenues by between $40,000 - $45,000.

HOLLISTER CITY COUNCIL
MEETING DATE: June 16, 2025
REPORT # Community Development-2025-40
AGENDA ITEM: A RESOLUTION APPROVING THE RENEWAL OF A CANNABIS
REGULATORY PERMIT FOR HIGHER LEVEL OF CARE HOLLISTER FOR DISPENSARY OPERATIONS AT 1802 SHELTON DRIVE FOR 2025/2026
DEPARTMENT: Community Development
DEPARTMENT HEAD: Rod Powell, Assistant City Manager
STAFF CONTACT: Maria C. Mendez, Cannabis Affairs Manager
RECOMMENDED ACTION: Adopt a resolution approving the renewal of a Cannabis Regulatory Permit for Higher Level of Care for dispensary operations at 1802 Shelton Drive for 2025-2026 term subject to applicable Conditions of Approval.
DISCUSSION:
Higher Level of Care Hollister currently holds one of only two cannabis dispensary permits authorized by the City of Hollister. It is presently the only legally operating and revenue - generating dispensary within city limits.
On June 9, 2025, staff presented a report to the City Council seeking direction on the renewal of Higher Level of Care’s Cannabis Regulatory Permit, due to the business’s non- compliance with required payment obligations under the Hollister Municipal Code and failure to comply with a previously established payment plan.
After discussion, the City Council directed staff to return with a Resolution approving the permit renewal, subject to regulatory and financial compliance Conditions of Approval as presented by staff.
In recognition of the Council’s review and discussion of the permit holder’s current financial circumstances and existing total arrears of $275,209.23 owed to the City, the Council considered various repayment options and in lieu of requiring full payment of the outstanding balance, approved a modified payment plan inclusive of monthly payments of $25,000, effective immediately. This arrangement allows the permit holder to retain its permit and an operational status supportive of revenue generation and fulfillment of the approved payment plan.
In accordance with the Council’s direction, staff have prepared a Resolution approving the permit renewal for 2025/2026, subject to the following Conditions of Approval:
1. Full Payment of Past Due Amounts:
The permit holder shall pay all outstanding cannabis-related fees and taxes, including the current balance of $275,209.23, in full and in accordance with agreed upon payment plan provisions.
2. Monthly Payment Plan:
The permit holder shall comply with all provisions of the payment plan as approved
by the City Council at its regular meeting on June 9, 2025 , as stipulated in the attached authorizing resolution, requiring monthly payments of $25,000, effective immediately, until the outstanding balance is paid in full. Payments shall be made directly to the City in accordance with instructions provided by the Cannabis Affairs Division.
3. Timely Payment of Future Fees:

The permit holder shall continue to comply with all applicable provisions of the Hollister Municipal Code, including but not limited to Chapter 5.42, and all state and local laws governing the operation of cannabis businesses.
FISCAL IMPACT: Higher Level of Care Hollister currently owes the City a total of $275,209.23 in outstanding cannabis business tax liabilities and regulatory fees. This amount includes unpaid balances from the third and fourth quarters of 2024, as well as the first quarter of 2025. These funds are intended to offset the City’s costs associated with administering and enforcing its cannabis regulatory program.
Non-payment of these obligations directly impacts the City’s General Fund by reducing expected revenue from cannabis-related activities. The Council has provided staff with direction to include a Condition of Approval on the regulatory permit related to implementation of a payment plan to allow for recovery of currently owed monies
PREVIOUS COUNCIL OR COMMISSION ACTION: At its June 9, 2025, meeting, the City Council considered Higher Level of Care’s renewal application. Following discussion, the Council directed staff to return with a resolution approving renewal of the Cannabis Regulatory Permit, subject to specific conditions intended to ensure regulatory and financial compliance.
CEQA: Categorical Exemption – Existing Facilities (Class 1)
The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301, Class 1 – Existing Facilities. The project involves the renewal of a regulatory permit for an existing business relocating to a previously developed commercial site with no expansion of use or significant alterations. The proposed activity does not involve any expansion of the existing or former use and will not result in any significant environmental impacts.

DEPARTMENT: Community Development
DEPARTMENT HEAD: Rod Powell, Assistant City Manager
STAFF CONTACT: Maria C Mendez, Cannabis Affairs Manager
RECOMMENDED ACTION: Adopt a resolution approving the Cannabis Regulatory Permit renewal for Faultline Manufacturing for the 2025-2026 term at 1785 San Felipe Road subject to applicable Conditions of Approval.
DISCUSSION:
On June 18, 2018, the City Council approved Resolution 2018 -0156, granting Faultline Manufacturing a Cannabis Regulatory Permit to operate a manufacturing facility in the City of Hollister. Since then, Faultline has annually sought and received permit renewals.
However, its most recent permit expired on March 19, 2025, due to unresolved code violations at its site and the City’s need to consult with the applicant, property owner, and other departments regarding a path forward.
To date, despite holding a permit since 2018, Faultline has not completed the necessary site improvements to begin operations or generate revenue. The current location at 1785 San Felipe Road remains unimproved and is subject to multiple code violations related to unpermitted construction and non-compliance with both the California Building Code and Hollister Municipal Code.
On June 9, 2025, the City Council reviewed the application and approved issuance of a 2025/2026 Cannabis Regulatory Permit, subject to the Conditions of Approval presented by staff. The approval includes the following conditions:
1. Initiation of Operations
The facility must become operational within one (1) year of permit renewal.
2. Code Violations Compliance
All code violations must be corrected no later than December 4, 2025.
3. Land Use and Construction Compliance
All construction and land use activity must comply with applicable city and state codes.
4. Timely Payment of Fees and Taxes
All taxes and fees must be paid in full and on time.
5. Permit Revocability
The Cannabis Regulatory Permit shall remain revocable for cause as set forth in Section 5.42.120 of the Hollister Municipal Code.
FISCAL IMPACT:
Faultline Manufacturing remains non-operational since its initial permit approval in 2018 resulting in no associated revenues for the City of Hollister.
PREVIOUS COUNCIL OR COMMISSION ACTION:
On June 9, 2025, the City Council reviewed Faultline Manufacturing’s request for approval to issue a 2025/2026 Cannabis Regulatory Permit. Following discussion, the Council directed staff to return with a resolution approving the renewal, subject to specif ic conditions intended to ensure site compliance and timely commencement of operations.

Should Lessor elect to re-enter as herein provided, or should it take possession pursuant to legal proceedings or pursuant to any notice provided by law, it may either terminate this Lease or it may, from time to time, without terminating this Lease, re-let said Premises or any part thereof for such term or terms (which may be for a term extending beyond the term of this Lease) and at such rental or rentals and upon such other terms and conditions as Lessor, in its sole discretion, may deem advisable, with the right to make alterations and repairs to said Premises. as an election on their part to terminate this Lease unless a written notice of such intention be given to Lessee or unless the termination thereof be decreed by a court of competent jurisdiction. Notwithstanding any such re-letting without termination, Lessor may at any time thereafter elect to terminate this Lease for such previous breach. Should Lessor at any time terminate this Lease for any breach, in addition to any other remedy that it may have, it may recover from Lessee all damages it may incur by reason of such breach, including the cost of recovering the Premises, and including the worth at the time of such termination of the excess, if any, of the amount of rent and charges equivalent to rent reserved in this Lease for the remainder of the stated term over the then reasonable rental value of the Premises for the remainder of the stated term, all of which amounts shall be immediately due and payable from Lessee to Lessor.
Notwithstanding anything to the contrary herein, Lessor shall use commercially reasonable efforts to mitigate its damages in the event of any breach or default by Lessee, including by making reasonable efforts to re-let the Premises on terms that are commercially reasonable under the circumstances. Any amounts received by Lessor from such re-letting shall be applied in accordance with applicable law to reduce the damages recoverable from Lessee. Lessee shall not be liable for any rent or other amounts that could reasonably have been avoided by such mitigation efforts.

Notwithstanding any such re-letting without termination, Lessor may at any time thereafter elect to terminate this Lease for such previous breach.

On each such reletting (a) Lessee shall be immediately liable to pay to Lessor, in addition to any indebtedness other than rent due hereunder, the cost and expenses of such re-letting and of such alterations and repairs, incurred by Lessor, and the amount, if any, by which the rent reserved in this Lease for the period of such re-letting, (up to but not beyond the term of this Lease) exceeds the amount agreed to be paid as rent for the Premises for such period on such reletting; or (b) at the option of Lessor, rents received by the Lessor from such reletting shall be applied; first, to the payment of any indebtedness, other than rent due hereunder from Lessee to Lessor; second, to the payment of any costs and expenses of such reletting and of such alterations and repairs; third, to the payment of rent due and unpaid hereunder; and the residue, if any, shall be held by Lessor and applied in payment of future rent as the same may become due and payable hereunder. Such deficiency shall be calculated and paid monthly. No such re-entry or taking possession of said Premises by Lessor shall be construed as an election on their part to terminate this Lease unless a written notice of such intention be given to Lessee or unless the termination thereof be decreed by a court of competent jurisdiction.
