Council Meeting Agenda- April 16, 2026
INDIAN WELLS CITY COUNCIL
April 16, 2026
To: City Council
From: Community Development Department
Prepared by: Jon Berg, Community Development Director
Subject: Fairway Park Improvements
RECOMMENDED ACTIONS:
Council PROVIDES DIRECTION to Staff on moving forward with the Concept Plans for various improvements to Fairway Park; and
FINDS the project exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301, Existing Facilities, and Section 15303, Construction or Conversion of Small Structures.
DISCUSSION:
Fairway Park is the City's only publicly accessible neighborhood park, serving both residents and visitors. Use of the park has been steadily increasing, and the City is examining opportunities to further activate the park. The park incorporates desert landscaping with a central turf area flanked with palm trees, which serves as the primary public gathering location. This area is highly exposed to the sun without the benefit of much shade from the surrounding palm trees, which can be a deterrent to using the park, especially during the hotter months of the year. As one of City Council's Strategic Planning Goals, Staff was asked to work with the City's original park designer, Hermann Design Group, to develop design concepts incorporating additional shade (e.g., trees and removable shade structures) and public art concepts for consideration as future improvements to Fairway Park.
In addition, staff has identified an opportunity to enhance ADA accessibility to seating areas of the park and address concerns with irrigation overspray on existing seating. The proposed concepts also preserve the main lawn feature for small public activations. (Attachment No. 1, Existing Park Conditions).
Concept Plan No. 1
A new ADA compliant 5 -foot wide walkway that would extend from the existing semi- circular walkway at the front of the park, around the backside of the circle of palms flanking the central lawn area (Attachment No. 2 — Seating Exhibit Concept 1). This new
Council Meeting Agenda- April 16, 2026
walkway would provide a clear path to the existing tables, chairs and benches. The new pathway could also include imbedded mosaic artwork as decorative aesthetic features at key locations highlighting Indian Wells' history. In addition, this design concept proposes the addition of eight (8) new trees' mixed in with the circle of palms and lawn area to provide additional shade to the central gathering area, as well as the seated areas around the park. In lieu of trees, removable shade structures could be utilized as an alternative.
Under this concept, trees are recommended as the source of shade.
As an optional consideration for Concept Plan No. 1, the new walkway could be linked at the front of the park to provide a continuous oval walking path around the perimeter turf area, which could be used as a walking loop within the park (Attachment No. 2b).
The new path is being proposed with a concrete path that matches the existing concrete in the park. An additional alternative is to utilize a decomposed granite path looking concrete that is being proposed for the sidewalk along Fairway Drive. Staff can also work with the designer to include subtle lighting (bollards) of the new pathway if desired by City Council.
Concept Plan No. 2
Relocating the existing benches, tables, and chairs to more accessible locations near the front of the park (Attachment No. 3 — Seating Exhibit Concept 2). This would be accomplished by including two small seating area plazas at the shoulders of the existing semi -circle walkway and central lawn area. Three (3) additional trees would be added to the lawn area to provide additional shade within the central gathering area. In addition, this concept includes portable fabric shade umbrellas within the new plaza areas to provide additional shade. Similar to Concept Plan No. 1, artistic mosaic artwork could also be included in or around the new plaza areas.
CITY COUNCIL STRATEGIC GOAL:
This project is included as part of Council's 2026 Strategic Planning Goal No. 5 — Enhancing the Quality of Life. Council has requested staff to work with the original park designer to bring back some options for adding shade to Fairway Park. The two (2) concept plans attached to this Staff Report represent viable options for achieving this goal.
1 During the community meetings for the design of the park, neighboring residents expressed concern with adding trees to the park that would block views of Mount Eisenhower or produce debris that might blow into their backyards. Staff and Herman Design Group propose to use tree species that would have minimal impact on neighboring residents, nor impede on the existing palm tree canopies, or cause future concerns on the proposed concrete path.
Council Meeting Agenda- April 16, 2026
FISCAL IMPACT:
The estimated cost of the proposed park improvements for each Concept Plan ranges between:
• Concept Plan No. 1: $150,000 to $200,000*
• Concept Plan No. lb: $ 200,000 to $ 250,000*
• Concept Plan No. 2: $ 160,000 to $175,000
* Lighting can be added to the path if the city council desires.
Staff is currently working with the Coachella Valley Association of Governments and the Imperial Irrigation District, who are offering a CAL FIRE (IRA) funded Grant Program, which may provide the proposed trees at no cost to the City. In addition, any public art component would be funded by the City's Public Art Fund, including mosaic and associated concrete work. Staff spoke to Desert Recreation District on shared costs for these improvements. Further discussions needed based upon approved components.
Ongoing maintenance of the park after the improvements have been installed will continue to be performed by the Desert Recreation District.
OPTIONS:
Staff is seeking Council direction on the preferred Concept and individual design elements (e.g., type of concrete, inclusion of public art and/or shade structures, etc.). If a public art component is selected, staff also seek directions on who shall have the authority to approve the art design for installation (e.g., City Council or existing City Committee).
Once design elements are selected, staff will develop a budget for inclusion into the Fiscal Year 2026-2027 budget discussion in May. Once a budget is developed and approved, staff will bid out the project for completion in Summer/Fall 2026.
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):
This Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act ("CEQA'), the State and local CEQA Guidelines, and the environmental regulations of the City. The City, acting as Lead Agency, has determined the proposed park improvements qualify as being Categorically Exempt from CEQA under Section 15301, Existing Facilities, and Section 15303, New Construction, or Conversion of Small Structures.
CEQA Guidelines Section 15301 describes Class 1 categorical exemptions as follows:
"Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing
Council Meeting Agenda- April 16, 2026
or former use. The types of "existing facilities" itemized below are not intended to be all-inclusive of the types of projects which might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of use." The proposed improvements would be installed within the existing park and would not expand the park area or current uses at the park.
CEQA Guidelines Section 15303 describes Class 3 categorical exemptions as follows:
"Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel."
The proposed Project would result in the construction of new ADA accessible paths of travel with associated shade and seating improvements that can be considered accessory to and consistent with the existing park uses. The Project will not involve any use of hazardous substances and will consist of the instillation of limited numbers of new, small portable shade structures and trees.

Council Meeting Agenda- April 16, 2026
INDIAN WELLS CITY COUNCIL
April 16, 2026
To: City Council
From: City Manager Department
Prepared by: Chris Freeland, City Manager
Subject: Council Ad Hoc Committee Update on Historic Neighborhood Recognition Program
RECOMMENDED ACTIONS:
Council DISCUSSES and provides DIRECTION on the Ad Hoc Committee's recommendation to approve a Neighborhood Recognition Program for the City of Indian Wells; and
FINDS the action exempt from CEQA review under CEQA Guidelines section 15061(b)(3).
BACKGROUND:
The City of Indian Wells is distinguished by its rich architectural and civic heritage, including mid-century modern and other architecturally distinctive residences, established golf and tennis communities, and notable civic landmarks. Since its founding in 2002, the Indian Wells Preservation Foundation (IWPF), a 501(c)(3) nonprofit organization, has played an important role in documenting and preserving this history through initiatives.
In September 2025, the IWPF expressed interest in collaborating with the City to develop a Historic Neighborhood Recognition Program. Such a program could acknowledge architecturally and culturally significant neighborhoods through interpretive or identification signage. Potential benefits include enhanced community awareness, support for heritage tourism, and strengthened historic preservation efforts.
IWPF has requested Council's consideration of a program modeled after Palm Springs "Blade" Signs Program. Established in 2008, the Palm Springs program officially recognizes distinctive neighborhoods by installing supplemental "blade" signs on existing city street signs that recognize these distinctive neighborhoods.
At the September 4, 2025, City Council meeting, Council formed an ad hoc committee, consisting of Mayor Pro Tem Penna and Councilmember Sanders, to meet with
Council Meeting Agenda- April 16, 2026
representatives of the Indian Wells Preservation Foundation (IWPF) and staff to explore opportunities to develop a historic neighborhood recognition program.
DISCUSSION:
Over the last several months, the City Council Ad Hoc Committee has met with representatives of IWPF, staff, and residents to evaluate what steps it would take to implement a historic neighborhood recognition program; determine community support for a program; identify neighborhoods to recognize; verify the historical context of the neighborhoods; and the costs of the program.
Part of the discussion with IWPF is the ongoing research of historical significance of each community, and to display this information for the community and visitors to learn more about Indian Wells and the uniqueness of these neighborhoods. In IWPF's letter endorsing this project (Attachment No. 1), IWPF commits to ongoing research of documents and stories highlighting each neighborhood and creating a space on IWPF's website for this program. The City would also have a webpage on the City's website, linked to the IWPF website, which highlights this program.
The primary goal of the historic neighborhood program is to highlight the unique neighborhoods of Indian Wells, their importance in architectural heritage, enhance community awareness, and the value of preserving the historical significance of the community. After extensive research by IWPF, discussion with residents, and review by the Ad Hoc Committee, four distinct neighborhoods (Desert Bel Air, Indian Wells Village, Eldorado Palms, and Rancho Palmeras) have been identified through this process.
The Ad Hoc Committee supports the historic neighborhood recognition program and recommends that the City move forward, at this time, with two neighborhoods whose residents have expressed support to IWPF. As additional support for the program to expand, other neighborhoods can be added. The two neighborhoods recommended for recognition at this time are:
• Desert Bel Air - Neighborhood consisting of the following streets surrounding Fairway Park: Fairway Drive between Eldorado Drive and west of Cielito Drive, Vista Dorado, Altamira, Alta Colina Way, Painted Desert between Alta Colina Way and Cielito Dr., Villa Serena, Calle Tranquilidad, and Eldorado Drive between Fairway and Painted Desert.
• Indian Wells Village — Neighborhood consisting of the following streets near Ford Elementary School: Miles Avenue, Elkhorn Trail, Cheyenne Drive, Warner Trail, Blackfoot Drive, Dakota Trail, Arapahoe Vista, and Huntley Drive.
Aerials highlighting the neighborhoods are attached (Attachment No. 2). In addition, the other two neighborhoods will be considered for recognition at a future City Council
Council Meeting Agenda- April 16, 2026
meeting once residents in the neighborhoods have been informed of the proposed program and have had opportunity to consider the program.
It is important to note that this is a recognition, not designation program. Therefore, any additional limitations on property or landscaping that typically comes with official historical designation do not apply to this recognition program.
Blades Signage
Another important component of the program is the design of the blades designating the individual neighborhoods that are to be placed on top of the existing City street signage.
The Ad hoc Committee recommends that the signage be created by a designer that reflects the original marketing materials of the communities, versus a modern artist interpretation of the marketing materials. Below are examples of designs for Desert Bel Air utilizing original artwork and modern artwork.
In addition, examples for all four neighborhoods, original and modern versions, of proposed blade designs are attached (Attachment No. 3).

Please note that these are not final designs. Final designs will be based on the preferred design approved, proportional to existing street signs, and not likely to design elements that are outside of a normal rectangle (e.g., dye cut for sun). If that is preferred, staff can see if this level of customization is available.
Council Meeting Agenda- April 16, 2026
OPTIONS:
The City Council has several options available.
1. Approve the Ad hoc Committee recommendation approving the Historic Neighborhood Recognition Program, with the following components. a. Desert Bel Air and Indian Wells Village as the first two neighborhoods for recognition.
b. Original design for the blade signage.
c. Support promotion of program with a link to IWPF website on the City's website.
2. Approve the Ad hoc Committee recommendation with modifications to a, b, and c.
3. Determine not to move forward with the program at this time.
4. Provide alternative directions.
FISCAL IMPACT:
The fiscal impact is determinant on which option the City Council selects. To fully implement the Ad hoc Committee's recommendation, staff estimates a cost of $50,000, which includes design work for the blade signs, fabrication of signage, and installation. A final estimate, based on Council's recommendation will be added to the Councils Fiscal Year budget discussion in May 2026.
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):
The action is not a project within the meaning of Section 15378 of the State of California Environmental Quality Act ("CEQA") Guidelines, because it has no potential for resulting in physical change in the environment, directly or indirectly; and that the action is nonetheless exempt from the requirements of CEQA in that the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Council Meeting Agenda- April 16, 2026

INDIAN WELLS
PRESERVATION
FOUNDATION
April 9, 2026
To Ad Hoc Committee Members: Mayor Pro Tern Brian Penna and Councilmember Greg Sanders:
On behalf of the Indian Wells Preservation Foundation (IWPF), we respectfully request the City's support and approval for the creation of the Neighborhood Historic Recognition Sign Program. This initiative represents a significant opportunity to celebrate, preserve, and share the rich history and character of Indian Wells' distinctive neighborhoods.
The City of Indian Wells is distinguished by significant architecture set within a remarkable natural landscape -an identity shaped by thoughtful governance, visionary planners, and the individuals and families who have contributed to its evolution over time. Yet much of this history and architectural character remains unknown to both residents and visitors.
The proposed Historic Neighborhood Recognition Sign Program seeks to bridge that gap by formally recognizing architecturally unique, historically significant neighborhoods and identifying them with thoughtful street blade signage that both identifies each neighborhood and reveals its authentic story.
This program is important for several reasons. First, it fosters community pride by highlighting the heritage that defines each neighborhood. Residents develop a deeper connection to their surroundings when they know the history thus strengthening neighborhood identity and encouraging civic engagement. Additionally, the program reinforces the City's heritage and commitment to preservation in a visible and lasting way.
As an initial phase, we recommend prioritizing the neighborhoods of Desert BeI Air and Indian Wells Village — both of which embody the distinctive mid-century character, planning vision, and design integrity that that have contributed to Indian Wells' identity over time. Each community has enthusiastically advocated through meetings and written communications their support for this initiative. stions Our Foundation will work closely with the City to provide designs for the street signs based upon the original marketing materials for the neighborhoods.
By formally acknowledging neighborhoods like Desert BeI Air and Indian Wells Village, Indian Wells has the opportunity to further distinguish itself as a community that values its history while planning thoughtfully for the future. Our hope is that this program will receive the community's support to expand and eventually recognize other neighborhoods in Indian Wells.
Council Meeting Agenda- April 16, 2026
The Indian Wells Preservation Foundation is dedicated to playing an active role in ensuring the success of this program. We will continue to research, curate, and further expand historical information about each recognized neighborhood on our website, clearly defining their boundaries based upon our research. To complement this effort, we propose that the city host a dedicated page on its website with links directing residents and visitors to IWPF materials, thus ensuring access to this valuable content.
We believe this initiative aligns strongly with the City's values and long-term vision and we are excited about the opportunity to collaborate in bringing it to life. We respectfully request your support in advancing the Neighborhood Historic Recognition Sign Program and welcome the opportunity to present additional details and answer any questions you may have.
Thank you for your consideration and for your continued dedication to preserving the unique character of Indian Wells.
Sincerely,
Linda Blank, President and Board of Directors: Kevin Mead, Vice President; Ginny Whitman, Secretary; Kim Wilson, Treasurer; Katherine Mead, Creative Director; Lou Urrutia, Sponsorship Director; Donna Griffith, Director at Large Indian Wells Preservation Foundation

INDIAN WELLS CITY COUNCIL
April 16, 2026
To: City Council
From: City Manager Department
Prepared by: Angelica Avila, City Clerk
Subject: 60th Anniversary Ad Hoc Committee Update
RECOMMENDED ACTIONS:
Council REVIEWS and DISCUSSES the 60th Anniversary Ad Hoc Committee recommendations to celebrate the City's 60th Anniversary from July 14, 2026 (59th Anniversary) through July 14, 2027 (60th Anniversary); and Provides DIRECTION to staff regarding next steps, scope, and implementation of the City's 60th Anniversary celebration initiatives; and
Council CONSIDERS a proposed supplemental appropriation in the amount of $70,000 for a July 4th or July 3rd, 2026, fireworks kickoff event to lead the City's anniversary and the 250th Anniversary of the United States; and
FINDS the action exempt from CEQA review under CEQA Guidelines section 15061(b)(3).
BACKGROUND:
The City Council established a 60th Anniversary Ad Hoc Committee to assist with planning and coordinating activities to commemorate the City of Indian Wells 60th Anniversary.
The City was officially incorporated on July 14, 1967, and the upcoming anniversary presents an opportunity to celebrate this milestone, honor the City's history, and engage the community through a series of coordinated events and commemorative initiatives.
The City of Indian Wells has a rich and unique history shaped by visionary leadership, distinctive architecture, and a strong commitment to community and quality of life. Since its incorporation on July 14, 1967, Indian Wells has grown into a nationally recognized destination known for its residential character, cultural contributions, and world -class amenities.
Council Meeting Agenda- April 16, 2026
Celebrating the City's 60th Anniversary provides an important opportunity to honor the City's past, recognize the individuals and institutions that helped shape its development, and celebrate six decades of civic achievement. This milestone decade offers a meaningful moment to reflect on the City's legacy while engaging residents in a shared sense of pride and looking ahead to the future of Indian Wells.
DISCUSSION:
The 60th Anniversary Ad Hoc Committee met on March 20, 2026, to begin discussions on potential concepts, activities, and themes for the anniversary celebration. The Ad hoc Committee is providing this update and recommending that the 60th Anniversary Celebrations begin in July 2026 and continue through July 2027. The meeting focused on exploring ideas for both a signature event and yearlong programming that would incorporate the 60th Anniversary theme throughout City events and communications. The following concepts and ideas were discussed during the March 20th meeting:
Anniversary Event and Programming
• Develop comprehensive 60th Anniversary branding, including:
o Anniversary logo
o 60th Anniversary video for the State of the City
o Lapel pin
o City badges
o City banners
o Newsletters
o Resident benefit card
o Website updates
o Letterhead, e -blast templates, and other communication materials o Effectively utilize the City's newly adopted color palette in anniversary -related materials.
• Integrating the 60th Anniversary theme into all community events throughout the year, rather than limiting recognition to a single event. o Hiring a consultant to assist with planning and coordinating anniversary activities throughout the year.
o Host a large-scale anniversary event in 2027 with an estimated attendance of approximately 600 residents.
• Inviting Coachella Valley Mayors and dignitaries to participate in the anniversary celebration.
Council Meeting Agenda- April 16, 2026
• Collaboration with the Community Activities Committee and City Marketing staff as a priority.
• Develop a City of Indian Wells Arcadia Book
4th of July Kickoff Celebration
Even though the City's 59th Anniversary is not until July 14, 2026, the Committee discussed using Saturday, July 4, 2026, as the beginning of a series of 60th Anniversary -related events. This approach would allow the City's milestone celebration to coincide with the 250th Anniversary of the United States, creating a unified patriotic and community -focused theme. Hotel partners are excited about the potential to offer their guests special 4th of July packages if the Council approves this celebration. In addition, the Golf Resort will seek opportunities to activate the golf resort for special 4th of July packages.
To secure the fireworks provider and necessary permits, and to allow hotel partners and golf resort time to promote a 4th of July fireworks show, staff is recommending Council discuss the Ad Hoc Committee's recommendation and provide direction at this meeting.
At the time of this report, staff have been unsuccessful in obtaining a potential fireworks vendor, as they all have previous commitments for this year. Staff are also inquiring if Friday, July 3rd is an option.
Staff is seeking Council's consensus to host a 4th of July fireworks show on either July 3rd or July 4th, depending on vendor availability, with the preferred date of July 4th. If approved, staff is requesting a supplemental budget request of $70,000 for approximately 20 -minute firework show, and fire marshal services at the Indian Wells Golf Resort Complex.
In addition, the Committee is recommending Council consensus for a secondary fireworks show in July 2027, for the conclusion of the 60th Anniversary Celebration. If approved, staff will include costs for inclusion at your May budget discussion.
Recognition of Richard (Dick) & Jan Oliphant
The Ad Hoc Committee is also recommending the recognition of two individuals who have played a significant role in the City's history as part of the 60th Anniversary celebration.
Council Meeting Agenda- April 16, 2026
Dick Oliphant served on the City Council from 1976 to 1992, including eight years as Mayor. During his tenure, Dick Oliphant was responsible for many projects that have defined Indian Wells, including:
• Development of Indian Wells as a tourist destination. Created the partnership between the City, Renaissance, and Hyatt to develop the Indian Wells Golf Resort and the building of both resort properties.
• Instrumental in the building and development of the Indian Wells Tennis Garden. • Guiding the City through a period of financial uncertainty, where the City was facing the risk of bankruptcy, and turned the City into one of the most fiscally stable in the State.
An unknown fact is that Dick Oliphant was the City's first Fire Chief. He was also one of the original four paramedics to serve in the Coachella Valley. In this role, he responded to medical calls throughout the valley. Dick Oliphant has reflected on his role as Fire Chief to be one of his prouder moments of service to the community.
In recognition of Dick Oliphant's many years of service to the community, the Ad hoc Committee is recommending the Council name the Indian Wells fire station, the Richard Oliphant Fire Station. In addition, the Ad hoc Committee is recommending a bronze sculpture, similar to the one at the Eisenhower Memorial, be commissioned and installed in front of the fire station. If approved, an event in the Fall, commemorating the naming of the fire station in Dick Oliphant's honor will be conducted as part of the 60th Anniversary celebration.
In addition, the Ad hoc Committee recognizes the contributions that Jan Oliphant has made to the community, through her support of Indian Wells in various capacities. One such contribution is that she founded the City's Garden Club. In recognition of her achievements, the Ad hoc Committee is recommending the Indian Wells Community Garden, adjacent to the fire station, be named the Jan Oliphant Community Gardens and an appropriate bronze plaque honoring her dedication to the City be placed there.
If approved, staff will seek costs for implementing these recommendations for your May budget discussion.
City of Indian Wells Book
In addition, the Committee discussed completing the Indian Wells book during the anniversary year in collaboration with the Indian Wells Preservation Foundation (IWPF).
Council Meeting Agenda- April 16, 2026
The book would be identical to the ones produced for other Coachella Valley cities, known by the publisher as the Arcadia Books.
CITY COUNCIL STRATEGIC GOAL:
The City Council approved the development of a City of Indian Wells 60th Anniversary Celebration as one of its approved 2026 City Council Strategic Planning Goals.
FISCAL IMPACT:
The costs associated with the various 60th Anniversary activities and programs is unknown at this time. Staff will provide an initial budget for consideration during the May budget discussion, which will be dependent on direction from the City Council.
However, if the Council wishes to move forward with 4th of July Celebration, an appropriation of $70,000 is required at this time.
Subject: Mayor Taylor Request to Review Joint Council and Planning Commission Study Session Recommendation
RECOMMENDED
ACTIONS:
Council DISCUSSES prior Governance Ad Hoc Committee recommendation and provides DIRECTION on whether to proceed, modify, or discontinue the joint City Council and Planning Commission study session; and
FINDS the action exempt from CEQA review under CEQA Guidelines section 15061(b)(3).
DISCUSSION:
In 2024, the City Council established a Governance Ad Hoc Committee to review various City governance policies and procedures. As part of its review, the Ad Hoc Committee evaluated opportunities to enhance communication, coordination, and alignment between the City Council and its advisory bodies.
Among the committee's recommendations was the establishment of a Joint Study Session between the City Council and the Planning Commission. The purpose of the joint meeting was to provide an opportunity for Planning Commissioners to meet with the City Council and City staff to examine and discuss upcoming projects anticipated to come before the Planning Commission. Specifically, the Governance Ad Hoc Committee recommended:
'A Joint Study Session between the City Council and Planning Commissioners be scheduled following the City's Annual Strategic Planning Session. Planning Commissioners would have the opportunity to work with the City Council and City staff to review and discuss upcoming projects under the jurisdiction of the Planning Commission." Since the adoption of this recommendation, Mayor Taylor has requested that the City Council evaluate the joint study session between the City Council and the Planning

City Council Meeting 2026-04-16 Agenda Item J.1 Comment CAUTION: This email originated outside our organization. Be cautious with any links or attachments.
Good afternoon Mayor, and members of the Indian Wells City Council, Unfortunately, I am not able to attend the meeting, but I wanted to comment on Agenda Item J.1. As the former Vice Chair of the Indian Wells Planning Commission, I am not in favor of having a joint study session with the City Council and Planning Commissioners. The planning commission acts as an appointed advisory body to local government that is responsible for guiding a community's long- term growth through land use planning, zoning regulations, and development review. They implement the city's general plan by reviewing specific projects and making recommendations on planning policies. Planning Commissioners review project applications, like Conditional Use Permits, to ensure they comply with the City of Indian Wells municipal code and regulations. The Planning Commission holds public hearings to gather input from residents on development projects, zoning changes, and planning policies. Planning Commissioners take the information from those public hearings and use resident input to deliberate and make recommendations on matters to the City Council. Planning Commissioners spend a great deal of time researching, doing site visits, and gathering input from residents...that is the job the City Council appointed them to do. Earlier this year, the City Council changed municipal code 2.12.010 Establishment of the Planning Agency to read "the Planning Agency is established for the City as the City Council. The City Council may delegate related duties to the Planning Commission or the Building and Planning Departments, as needed." Left intact were municipal codes 2.12.020 through 2.12.060 regarding Functions of the Planning Commission and related issues. The City Council must allow the Planning Commission to remain as an independent advisory body. The City Council is still the ultimate decision -maker on any recommendation from the Planning Commission, and the current process, as defined in the Indian Wells Municipal Code, should be continued.
Respectfully,
Glenn Schubert
Former Vice Chair of the Planning Commission
