STAFF REPORT

To: City Council
From: Kevin H. Snyder, Dir. Of Community Development
Prepared by: Kevin H. Snyder, Dir. Of Community Development Subject: Approving No. Resolution Adopt 10261 to 38241 Map Parcel Tentative Subdivide a 5 Acre Parcel into a 2 Parcel Subdivision located on Los Palos Drive between Zenda Drive and Avenue 52 (APN: 779-100-028)

RECOMMENDATION:

Adopt Resolution No. 10261 conditionally approving Tentative Parcel Map N o. 38241 (TPM 21 -09- 412) to subdivide an existing 5 acre parcel located on Los Palos Drive between Zenda Drive and Avenue 52 into one 2-acres parcel and one 3-acres parcel for single-family residential land uses.

SUMMARY:

On December 8, 2021, the Planning Commission recommended approval to the City Council for Tentative Parcel Map No. 38241 (TPM21-09-412).

BACKGROUND INFORMATION:

The Subdivision Map Act requires that, prior to any map approval, the City find that the pro posed subdivision, together with the provisions for its design and improvement of any tentative map or a parcel map is consistent with the general plan. Government Code Sections 66473.5, 66474. Pursuant to the General Plan 2040 approved by City Council on September 18, 2019 by Resolution No. 10107, the land use designation for the proposed site is Desert Estates Neighborhood (DEN), which allows the density to be up to 1.0 dwelling units per acre (du/ac).

The density of the proposed project is 0.4 dwelling unit per acre, which is under the maximum density of one (1) unit per acre as allowed by the DEN land use designation. Therefore, the applicant is able to demonstrate that the proposed project is in conformance with the City’s General Plan designation density. The zoning designation of Country Estate – 2 (CE-2). The CE-2 has a minimum lot size of two (2) acres. The DEN has a maximum density of up to 1.0 density units per acre. Therefore, the proposed amendment to Tentative Parcel Map No. 38241 (TPM 21 -09-412) meets the General Plan and zoning density.

Hello, Good afternoon. My name is Josue Mendoza. I am an Indio Police Cadet with the Indio Police Cadet Post 150. I am aware of the hearing that will be held to speak on Item Title 10.4, Discussion and Introduction of Ordinance No. 1772.

I and three other Post Members would like to give a public comment on the item to share why we are in favor of it. My three post members and I wrote personal supportive statements to show how important the decision- making behind Item Title 10.4 is to us. Here are our statements:

Josue Mendoza.

Hello, my name is Josue Mendoza. I am 18 years old and an Indio resident. I have been part of Indio Cadet post 150 for 3 years.

I support what The American Cancer Society- Cancer Action Network will bring to cities and neighborhoods.

Their mission on reducing the accessibility of tobacco products to young children is a really great cause. I have seen the bad side effects of smoking and it is not a good thing to be stuck with. It is unfortunate to see young youth get addicted on things like tobacco because that will just harm them and their future. I would like to see a city where young children and young adults are tobacco-free. The Cancer Network will help in doing that. --------------------------------------------------------------------------------------- Jesus Lopez

Hello, my name is Jesus Lopez. I am 18 years old and an Indio Resident. I have been in the Indio Police Cadet Program Post 150 for 3 years.

I support The American Cancer Society- Cancer Action Network because they want to create a safer environment for young teenagers. I have been in parks where there have been individuals smoking and it is not safe nor fair for teenagers to be exposed to those chemicals when exercising. There have been times where I’ve had to leave the park because the smell is too strong. I would love to go play at a park where many young teenagers are having fun and do not have to worry about being exposed to secondhand smoke. I truly believe The Cancer Network can help in reducing secondhand smoke. ----------------------------------------------------------------------------------- Antonio Infante

Hello, My name is Antonio Infante. I am 15 years old and an Indio resident. I have been with the Indio Police Cadet Program Post 150 for almost a year.

I support the American Cancer Society-Cancer Action Network because they are trying to make everywhere that you go safer by making everything smoke-free. I feel that this can do great on being able to get accessibility AGENDA ITEM #12.1

2 of any type of tobacco products away from young children. I have seen many places personally that used to be really nice and a lot of it has been ruined by tobacco smells. Even old tobacco that has been thrown everywhere.

It’s sad to see how everything is, but with the American Cancer Society- Cancer Action Network, I think that it can change a lot.

Alexis Armenta

Hello, my name is Alexis Armenta. I am 16 years old and a Coachella resident. I have been with the Indio cadets post 150 for almost a year

I support the American Cancer Society- Cancer Action Network because they are trying to make city parks a safer place by not letting people smoke there. I visited a lot of parks and most of them smell bad. And all because of tobacco packs and Cigarettes packs. Our parks should be clean from anything that will harm children. Having tobacco litter and being around the toxic fumes of smoking harm young children. The American Cancer Society- Cancer Action Network will help in allowing parks to be cleaner and more enjoyable.

Hello,
I am Jessica Pacheco, resident of Indio, and ACS CAN Volunteer.

Local action to protect kids from tobacco is critical. 10% of tobacco users started before the 6ht grade, 44% by the 9
th grade, and 85% by the 11th grade. Every day, youth try tobacco, lured by the flavored products like bubble gum and watermelon! Early nicotine use is correlated with a lifelong addiction. I thank you for considering a tobacco retailer licensing program. As part of an effective way to prevent youth access and uptake of tobacco, and as a concerned resident, I ask that you also remove all flavored tobacco products from the shelves of your stores in the city of Indio.

Thank you.

Dear Indio City Council:

My name is Maribel Nunez from Coachella Valley Immigrant Dignity Coalition (CVID) and Inland Equity Partnership (IEP-CV), Coachella Valley Chapter. We have Indio residents that are part of our coalition. I am emailing public comment in support for item title 10.4 Discussion and Introduction of Ordinance No. 1772 (Tobacco Retail Permitting).

Both CVID and IEP-CV's mission is regardless where one lives, regardless of race, age, and immigrant status, we believe everyone should have access, particularly youth to affordable health care, substance abuse treatment and clean air. One of the ways to achieve that is to have just public health policies that fight youth addition. WE need TRP ordinance to have our Indio youth have good qualify of life. FDA declared teen vaping an epidemic as e-cigarette use among high school students increased by 78% from 2017 to 2018. Each year e-cigarettes use is increasing. Cities have the ability to reduce youth access and addiction to tobacco by adopting a Tobacco Retailer Permitting ordinance.

We are calling Indio City Council to take action and vote Yes on this TRP Ordinance.

Feel free to contact me if you have any questions.

Best,
Maribel Nunez

Dear: Mayor Fermon and City Council Members,

I am submitting email in support of the Tobacco Retail Licensing ordinance that will be considered during the January 19th council meeting.

I live
in the City of Indio, am a mother of two young children and am concerned about the easy access youth have to tobacco products in Indio.  As a volunteer for the American Cancer Society Cancer Action Network, I know that tobacco product use among both youth and young adults has increased considerably in recent years. I want to ensure that my kids can live a healthy life in Indio – but I know that this is much more difficult to do when tobacco companies target them and try to hook them into a deadly habit
We need council to take action and put policies in place that will keep our kids safe.  We need a Tobacco retail permitting ordinances that have adequate enforcement to reduce illegal sales to youth when they are implemented and that require a minimum of one compliance check per store per year, Council should also strengthen the tobacco product definition to include all tobacco product INCLUDING e‐cigarettes and while we’re at it we should end the sale of all flavored tobacco products. The tobacco industry is luring kids with youth friendly flavors like mint, fruit and candy. They also target communities of color with flavors, most notably the black community with menthol flavor.

The council can and should expand their efforts to protect our youth. Secondhand smoke exposure is also a problem in our community in all outdoor places.   Children exposed to secondhand smoke are at risk for asthma and other respiratory illnesses

Thank you.

Thank you, City Council of City of Indio for the opportunity to comment.

Inland Empire Smoke Out (IESO), a project run by Riverside County Black Chamber of Commerce, supports the proposed Ordinance No. 1772 for Riverside County Tobacco Retail License for the City of Indio. It is our experience that implementation of Tobacco Retail License provides significant benefits to the health and well-being of the community. Youth and children who begin their tobacco addictions with flavored products find fewer opportunities to acquire cigarettes, vaping products, and smokeless tobacco. Lower income neighborhoods are less crowded with convenience stores and tobacco outlets that focus on providing ready access to discounted tobacco. By reducing the number of retail licenses issue for tobacco, City of Indio creates opportunities for healthy options, reduces the temporarily hidden costs of tobacco use and addiction and the long-term costs of health problems faced by people who smoke, vape, and chew tobacco.

The Tobacco Retail License for the City of Indio, as proposed, is part of the groundwork for creating a healthier, more vibrant, and more equitable community for citizens.

Thank you for your time.

January 19, 2022 TO: Indio City Clerk [email protected] CC: [email protected] Transmitted via electronic mail Council Chamber of Indio City Hall 150 Civic Center Mall Indio, California 92201Re: Redistricting Process Requirements Dear Indio City Council, Communities for a New California Education Fund and California Common Cause write to the Indio City Council (“City Council”) because we advocate for redistricting processes that prioritize community voices, build public trust, and result in maps that allow for fair representation over the next decade. To that end, we would like to express concerns regarding comments made by members of the City Council at the November 3, 2021 Redistricting Public Hearing. These comments conveyed an intention to (1) give undue weight to preserving existing district boundaries and (2) mischaracterize what is allowable under Federal and State rules. Federal and State laws combine to provide detailed, ranked redistricting criteria that the City Council is required to abide by when drawing and selecting its draft map recommendations for the City Council to consider. The final map must accord with the following: 1. The final map must have districts that are substantially equal in population.1 2. The final map must comply with Section 2 of the federal Voting Rights Act(“VRA”).2 3. The City must follow the required redistricting criteria laid out in the Fair and Inclusive Redistricting for Municipalities and Political Subdivisions (“FAIR MAPS”) Act in this order of priority: contiguity; keep neighborhoods and communities of interest within the city whole; follow natural and artificial boundaries; and compactness.3 1Cal. Elec. Code §§ 21608(d)(1)–(2). 2Id. § 21601(b); 52 U.S.C. § 10301. 3Id. § 21601(c).

4. The City may not adopt a map that favors or discriminates against a political party4 and cannot consider relationships with political parties, incumbents, or political candidates when assessing communities of interest.5 We are writing to express specific concern regarding the City of Indio complying with criteria number four within its current redistricting process. The City’s redistricting consultant National Demographics Corporation (“NDC”) routinely provides its client jurisdictions with a uniform presentation that includes concerning language regarding “other traditional redistricting principles,” such as “continuity in office” and “[p]reserving the core of existing districts.”6 We fear the materials provided to you do not adequately indicate the extremely limited function of these “other traditional redistricting principles” and the last-place nature of their role. As should be clear, Federal and State law’s criteria, which must be complied with comprehensively and in ranked order, do not make any mention of these “other traditional redistricting principles.” In fact, the FAIR MAPS Act instead explicitly prohibits the City from adopting a map “for the purpose of favoring or discriminating against a political party”7 and makes clear that “[c]ommunities of interest do not include relationships with political parties, incumbents, or political candidates.”8 This is for good reason -- the spirit of the FAIR MAPS Act, which California Common Cause sponsored, was to create redistricting processes that are guided by the public and their input and that center fair representation for communities. The “other traditional redistricting principles” listed by NDC serve principally to make reelection easier for incumbents. Prioritizing keeping incumbent officeholders in power is a symptom of the gerrymandering we see in other states and is something California has attempted to leave behind, through the creation of an independent citizen-run redistricting process at the State level and through the passage of the FAIR MAPS Act. Comments made by Mayor Pro Tem Waymond Fermon inquiring how the process would affect reelection campaigns9 reveal what we all know: those drawing the lines are worried about 4Id. § 21601(d). 5Id. § 21601(c)(2). 6See Indio City Council Redistricting Hearing on November 3, 2021, Agenda Item 14.1 at 07:02 - 10:29, Jeff Semineti of NDC presents slide deck with language of “Preserving the core of existing districts,” “Continuity in office,” and “future population growth,” at https://www.youtube.com/watch?v=3_ZnAMOSc6E. Elec. Code § 21601(d). 8Id. § 21601(c)(2). 9See Indio City Council Redistricting Hearing on November 3, 2021, Agenda Item 14.1 at 17:18 - 17:35, when Mayor Pro Tem, Waymond Fermon stated, “When we did this process before it says that our final map will be submitted April 2022, correct? So some of us are up for reelection, and it’s not your issue it’s ours with our campaigns, but I wanted to see how did that process play out as far as campaign-wise when we don’t know what our district is going to be until the maps are submitted until April,” at https://www.youtube.com/watch?v=3_ZnAMOSc6E.

their own interests and their own futures. But the intent of the FAIR MAPS Act is to center community needs and priorities so that communities can elect their leaders and prevent politicians from hand-picking their voters. Should the City Council choose to consider “continuity in office” and “[p]reserving the core of existing districts,” it may do so only after every single Federal and State law criteria is satisfied. If any choice to prioritize “continuity in office” and “[p]reserving the core of existing districts” imperils or jeopardizes any criteria explicitly mentioned by Federal or State law, that choice must be rejected. That may result in a City Council map that looks significantly different from the existing map, which was drawn before the FAIR MAPS Act was passed, in an era when protecting incumbents was permitted and indeed often the main point of redistricting. That era is over in California. We are additionally troubled by comments at the November 3, 2021 redistricting hearing10 mischaracterizing how the redistricting process starts. Because the FAIR MAPS Act was passed after the City last drew its council map in 2017,11 the City must now redraw its lines in compliance with new requirements that did not exist when council districts were last drawn. “[S]tart[ing] off with the current map as the baseline,” as suggested by your City Attorney, puts non-statutory principles like “preserving the core of existing districts” at the beginning of the line-drawing process, contrary to its rightful place at the end. Additionally, it suggests that an existing district map can, through minor changes, satisfy a variety of state law criteria that were not mandatory when the map was drawn. We are skeptical that this is possible. As such, we urge the City Council to resist the temptation to simply adjust, or minimally change, current district lines to address population changes and instead champion a map that follows and complies with the FAIR MAPS Act’s substantive and community-focused requirements. Finally, and on a separate topic, we ask that the Indio City Council ensure translated materials are current and accessible with the most accurate information for the public. As of January 6, 2022, the Spanish-translated announcement of the scheduled January 8, 2022 hearing remains missing.12 To promote a robust and participatory redistricting process in a community that is majority Hispanic/Latino and significantly Spanish-speaking,13 details like 10See Indio City Council Hearing on November 3, 2021, Agenda Item 14.1 at 18:35 - 18:53, where City Attorney, Roxanne Diaz states, “When you start off the mapping drawing process you start off with the current map as the baseline, and then you do this shifts based on if there was population changes. It’s not as if we’re creating all new district lines,” at https://www.youtube.com/watch?v=3_ZnAMOSc6E. See also, id. at 18:55 - 19:01, where Jeff Semineti of NDC states, “One of the things that we look at too, like we mentioned, as part of this is preserving the core of existing districts. That is something that the city had direction on at the beginning when you did the districting process if this is what you want your districts to look like.” 11See Indio News Details. Dear Indio City Council:

My name is Maribel Nunez, Execu tive Director of Inland Equity Partnership and Coachella Valley Immigrant Dignity Coalition, of which we have Indio City residents as members.

On behalf of Indio Residents members we represent, I am writing a letter for today’s Indio Redistrictin g
meeting and recommend the City of Indio to adopt Draft Map 109 "Indio Residents United Map. Draft Map 109 'Indio Residents United" Map has 4 Voting Rights Act districts. One district keeps 6% of the black population together.

According to the Mexican Amer ican Legal Defense and Educ ational Fund (MALDEF), All government entities must include required data, related to citizen votin g age population (CVAP), and other relevant information required by state and federal law as part of city’s district maps, in order to consider that data in preparing the draft maps. The Fair and Inclusive Redistricting for Municipalities and Political Subdivisions Act (FAI R MAPS Act), requires the city to comply with the federal Votin g Rights Act of 1965 (VRA), and, to the extent prac ticable, keep communities of interest to gether. The FAIR MAPS Act also requires cities to include with each draft map “information on the total population, citizenship voting age population, and racial and ethnic ch aracteristics of the citizenship votin g age population of each proposed supervisorial district. If city maps only include total population data and fail to disclose CVAP data for any of the proposed di stricts, then the city fails to comply and can risk litigation. Without the CVAP data, broke n down by racial and ethnic demo graphics, the public cannot evaluate whether the proposed maps comply with Section 2 of the VRA. Further, federal law is clear that in determining compliance under Section 2 of the VRA, “CVAP is the appropriate measure to use in determining whether an addition al effective majority-minority di strict can be created.” (Luna v.

County of Kern). The new Riverside City redistricting maps should not only contain total Census 2020 population data, population percentages and CVAP data included.
