RECITALS
A. DEVELOPER desires to construct off-site water improvements for the extension of its water mains as well as guarantee the satisfactory completion of such work for a project
Report of changes to the Development Services Procedural Guidelines (Rey... Page 456 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D known as the “_________________________________” pursuant to the provisions of the Subdivision Map Act of the State of California (“Subdivision Laws”) and the applicable City of Indio ordinances and IWA requirements.
B. Pursuant to Resolution No. ______ (“Resolution of Approval”), Tentative Parcel Map _______ (PM __________ ) has been approved, subject to the Subdivision Laws and the requirements and conditions contained in the Resolution of Approval, for property located at Assessor Parcel Numbers _____________ through ___________ and ___________ through ___________ (“PROJECT”) and as further described in the legal description attached as Exhibit “A”. The Resolution of Approval is on file in the Office of the IWA and is incorporated into this Agreement by reference.
C. The Subdivision Laws establish as a condition precedent to the approval of a final map that DEVELOPER must have complied with the Resolution of Approval and must complete certain water improvements, among others, in compliance with City of Indio (“City”) and IWA standards.
D. In consideration of this Agreement and other good and sufficient consideration, DEVELOPER agrees to enter into this Agreement and promises to install and complete, at DEVELOPER’S own expense, the off-site water improvement work required by IWA in connection with the proposed subdivision. DEVELOPER has secured this Agreement by improvement security required by the Subdivision Laws.
E. Complete improvement plans for the construction, installation and completion of the improvements described herein have been prepared by DEVELOPER and approved by the IWA Engineer. The improvement plans are on file in the Office of the IWA and are incorporated into this Agreement by this reference (“Improvement Plans”). All references in this Agreement to the Improvement Plans shall include reference to any specifications for the improvements as approved by the IWA Engineer.
F. An estimate of the cost of construction of the improvements according to the Improvement Plans has been made and has been approved by the IWA Engineer. The estimated amount is stated on Page 1 of this Agreement.
G. The City and IWA have adopted standards for the construction and installation of said improvements. The Improvement Plans have been prepared in conformance with applicable City and IWA standards in effect on the date of approval of the Resolution of Approval.
H. DEVELOPER recognizes that by approval of the final map for this subdivision, the City has conferred substantial rights upon DEVELOPER, including the right to sell, lease, or finance lots within the subdivision, and has taken the final act necessary to subdivide the property within the subdivision. As a result, the City and IWA will be damaged to the extent of the cost of installation of the improvements by DEVELOPER’S failure to perform its obligations under this Agreement, including, but not limited to, DEVELOPER’S obligation to complete construction of the improvements by the time established in this Agreement. The City and IWA shall be entitled
Report of changes to the Development Services Procedural Guidelines (Rey... Page 457 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D to all remedies available to it pursuant to this Agreement and the Subdivision Laws in the event of a default by DEVELOPER. It is specifically recognized that the determination of whether a reversion to acreage or rescission of the SUBDIVISION constitutes an adequate remedy for default by the DEVELOPER shall be within the sole discretion of the City.
NOW THEREFORE, in consideration of the recitals set forth above, DEVELOPER and IWA agree as follows:
1. IWA Approval of Application for Extension of Water Mains.
Pursuant to an application made to IWA by DEVELOPER and in consideration of this Agreement, IWA hereby agrees to extend its water mains from the presenting existing mains or allow such an extension by DEVELOPER subject to the terms and conditions set forth in this Agreement.
2. DEVELOPER’S Obligations to Construct Improvements. DEVELOPER shall:
a. At its sole cost and expense, provide construction management, construction staking, design of water plans and construct and install the off-site public water system improvement together will all other appurtenances as set forth in Exhibit “B” to this Agreement (the “Improvements”) based upon preliminary engineering plans and studies and the Improvement Plans submitted to IWA. This description is intended to roughly outline the scope of the works and improvements to be designed and constructed in connection with this Agreement. The exact works and improvements comprising the Improvements may change as a result of site requirements, changes in construction standards, geologic conditions, ability to locate adequate source of water pressure and supply, engineering constraints, or other factors. The IWA Engineer, in his or her reasonable discretion, may approve substitute works and improvements to replace some or all of the works and improvements set forth in Exhibit “B” to this Agreement, if such substitute works and improvements would provide the PROJECT services of a similar nature to those provided by the works and improvements set forth in Exhibit “B” to this Agreement.
b. Complete by the time established in Exhibit “C” of this Agreement and at DEVELOPER’S own expense, the Improvements in conformance with the Improvement Plans and the IWA standards.
c. Construct such Improvements in full compliance with the approved Improvement Plans and the requirements of this Agreement, and in accordance with any other applicable IWA or City of Indio requirements and conditions, subject to inspection and approval by IWA. Such work shall be undertaken by a qualified California licensed contractor.
Report of changes to the Development Services Procedural Guidelines (Rey... Page 458 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D d. Furnish the necessary materials for completion of the Improvements in conformity with the Improvement plans and IWA standards.
e. Prevailing Wages. Pursuant to the requirements of Labor Code Section 1720, DEVELOPER shall pay prevailing wages for all work performed for the construction, alteration, demolition, installation, or repair for the Street Improvement Work required by this Agreement. In accordance with the provisions of Section 1773 of the Labor Code of the State of California, the IWA has obtained the general prevailing rate of per diem wages and the general rate for holiday and overtime work in this locality for each craft, classification, or type of workman needed to execute under this Agreement from the Director of the Department of Industrial Relations. These rates are on file with the Office of the IWA. Copies may be obtained at cost at the Office of the IWA. DEVELOPER shall post a copy of such wage rates at the job site and shall pay the adopted prevailing wage rate as a minimum. DEVELOPER shall comply with the provisions of Sections 1773.8, 1775, 1776, 1777.5, 1777.6 and 1813 of the Labor Code and other applicable laws and regulations with respect to the payment of prevailing wages. Pursuant to the provisions of 1775 of the Labor Code, DEVELOPER shall forfeit to the IWA, as a penalty, the sum of $25.00 for each calendar day, or portion thereof, for each laborer, worker, or mechanic employed, paid less than the stipulated prevailing rates for any work done under this Agreement, by it or by any subcontractor under it, in violation of the provisions of the Agreement or in violation of any applicable laws or regulations pertaining to the payment of prevailing wages. f. Acquire and dedicate, or pay the cost of acquisition by IWA, of all right-of-way, easements and other interests in real property for construction or installation of the Improvements, free and clear of all liens and encumbrances. The DEVELOPER’S obligations with regard to acquisition by IWA of off-site right-of-way, easements and other interests in real property shall be subject to a separate Agreement between DEVELOPER and IWA. DEVELOPER shall also be responsible for obtaining any public or private drainage easements or authorizations to accommodate the PROJECT.
g. Comply with all requirements of the Resolution of Approval and any amendments thereto, and with provisions of the Subdivision Laws.
3. Acquisition and Dedication of Easement of Right-of-Way. If any of the public improvement and land development work contemplated by this Agreement is to be constructed or installed on land not owned by DEVELOPER, no construction or installation shall be commenced before:
a. The offer of dedication to IWA of appropriate right-of-way, easements or other interest in real property, and appropriate authorization from the property owner to allow construction or installation of the improvements or work, or
Report of changes to the Development Services Procedural Guidelines (Rey... Page 459 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D b. The dedication to, and acceptance by, the IWA of appropriate right-of-way, easements or other interests in real property, as determined by the IWA Engineer, or
c. The issuance by a court of competent jurisdiction pursuant to the State Eminent Domain Law of an order of possession. DEVELOPER shall comply in all respects with the order of possession.
Nothing in this Section 3 shall be construed as authorizing or granting an extension of time to DEVELOPER.
4. Security. DEVELOPER shall at all times guarantee DEVELOPER’S performance of this Agreement by furnishing to IWA, and maintaining, good and sufficient security as required by the Subdivision Laws on forms approved by IWA for the purposes and in the amounts as follows:
a. To assure faithful performance of this Agreement in regard to said improvements in an amount of 100% of the estimated cost of the improvements; and b. To secure payment to any contractor, subcontractor, persons renting equipment, or furnishing labor materials for the improvements required to be constructed or installed pursuant to this Agreement in the additional amount of 100% of the estimated cost of the improvements; and
c. To guarantee or warranty the work done pursuant to this Agreement for a period of one year following acceptance thereof by IWA against any defective work or labor done or defective materials furnished in the additional amount of 10% of the estimated cost of the improvements.
The securities required by this Agreement shall be kept on file with the Office of the IWA.
The terms of the security documents referenced herein are incorporated into this Agreement by this reference. If any security is replaced by another approved security, the replacement shall be filed with the Office of the IWA and, upon filing, shall be deemed to have been made a part of and incorporated into this Agreement. Upon filing of a replacement security with the Office of the IWA, the former security may be released.
5. Alterations to Improvement Plans.
a. Any changes, alterations or additions to the improvement plans and specifications or to the improvements, not exceeding 10% of the original estimated cost of the improvements, which are mutually agreed upon by the IWA and DEVELOPER, shall not relieve the improvement security given for faithful performance of this Agreement. In the event such changes, alterations, or additions exceed 10% of the original estimated cost of the improvements, DEVELOPER shall provide improvement security for faithful performance as required by Paragraph 4 of this
Report of changes to the Development Services Procedural Guidelines (Rey... Page 460 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D Agreement for 100% of the total estimated cost of the improvement as changed, altered, or amended, minus any completed partial releases allowed by Paragraph 7 of this Agreement.
b. The DEVELOPER shall construct improvements in accordance with the IWA standards in effect at the time of adoption of the Resolution of Approval. IWA reserves the right to modify the standards applicable to the PROJECT and this Agreement, when necessary to protect the public health, safety and welfare.
6. Inspection.
a. DEVELOPER shall at all times maintain proper facilities and safe access for inspection of the Improvements by the IWA inspector and to the businesses or residences wherein any work is in progress. IWA shall have the right to enter any construction site at any time to inspect the work or the progress of construction of the Improvements that are the subject of this Agreement. Upon completion of the work the DEVELOPER may request a final inspection by the IWA Engineer, or the IWA Engineer’s authorized representative. If the IWA Engineer, or the designated representative, determines that the work has been completed in accordance with this Agreement, then the IWA Engineer shall certify the completion of the Improvements for acceptance by IWA. No improvements shall be finally accepted unless aspects of the work have been inspected and determined to have been completed in accordance with the Improvement Plans and IWA and if applicable City standards. DEVELOPER shall bear all costs of inspection and certification.
The inspection by IWA of the construction for conformance with the Improvement Plans shall not be deemed to confer liability on IWA or the City or otherwise place the responsibility for properly constructing and inspecting the Improvements upon IWA.
b. IWA is not responsible and does not own the Improvements until they are inspected and approved and accepted by IWA and all fees and charges associated with the construction of the Improvements and/or other fees owed by Developer to the IWA are paid in full. Until such time, DEVELOPER is responsible for the Improvements and is liable for all damage to said facilities. The Developer shall indemnify IWA, its governing board, officers and employees for any and all claims of any kind relating to the construction of the Improvements incurred prior to the IWA’s acceptance of said facilities.
c. At no time during construction or prior to IWA’s acceptance of the Improvements constructed by DEVELOPER shall DEVELOPER, its agents or employees, populate or use the Improvements for any unauthorized purpose, or populate the Improvements with non-potable water or any other chemical or substance not authorized in writing by IWA.

7. Release of Securities. Subject to approval by the IWA Board, the securities required by this Agreement shall be released as follows:
a. Security given for faithful performance of any act, obligation, work or agreement shall be released upon the final completion and acceptance of the act or work, subject to the provisions of subsection (b) hereof.
b. The IWA Engineer may release a portion of the security given for faithful performance of improvement work as the improvement progresses upon application therefore by the DEVELOPER; provided, however, that no such release shall be for an amount less than 25% of the total improvement security given for faithful performance of the improvement work and that the security shall not be reduced to an amount less than 10% of the total improvement security given for faithful performance until final completion and acceptance of the improvement work. In no event shall the IWA Engineer authorize a release of the improvement security, which would reduce such security to an amount below that required to guarantee the completion of the improvement work and any other obligation imposed by this Agreement.
c. Security given to secure payment to the contractor, his or her subcontractors and to persons furnishing labor, materials or equipment shall, six months after the completion and acceptance of the work, be reduced to an amount equal to the total claimed by all claimants for who lien have been filed and of which notice has been given to the legislative body, plus an amount reasonably determined by the IWA Engineer to be required to assure the performance of any other obligations secured by the Security. The balance of the security shall be released upon the settlement of all claims and obligations for which the security was given. d. No security given for the guarantee or warranty of work shall be released until the expiration of the warranty period and until any claims filed during the warranty period have been settled. As provided in paragraph 12, the warranty period shall not commence until final acceptance of all the work and Improvements by the IWA Board.
e. The IWA may retain from any security released an amount sufficient to cover costs and reasonable expenses and fees, including reasonable attorney’s fees. f. Any statute of limitations with respect to the obligations of DEVELOPER shall not apply to any bonds or other forms of security provided pursuant to this Agreement.
The Surety’s liability under any bonds or other forms of security provided pursuant to this Agreement shall be released only upon final completion and IWA’s acceptance of the work required pursuant to this Agreement. The expiration of any statute of limitations with respect to DEVELOPER shall not bar an action against the Surety under the bond or any other form of security provided pursuant to this Agreement.

8. Injury to Public Improvements, Public Property or Public Utility Facilities.
DEVELOPER shall replace or have replaced, or repair or have repaired, as the case may be, all public improvements, public utility facilities and surveying or subdivision monuments which are destroyed or damaged as a result of any work under this Agreement. DEVELOPER shall bear the entire cost of replacement or repairs of any and all public or public utility property damaged or destroyed by reason of any work done under this Agreement, whether such property is owned by the United States or any agency thereof, or the State of California, or any agency or political subdivision thereof, or by the IWA or any public or private utility corporation or by any combination of such owners. Any repair or replacement shall be to the satisfaction, and subject to the approval, of the IWA Engineer.
9. Limitations of Damages. Until such time as all Improvements required by this Agreement are fully completed and accepted by IWA, and IWA authorizes connection of all or any part of the PROJECT to IWA’s water system, DEVELOPER shall not allow or request permits for occupancy of the PROJECT or any portion thereof. IWA shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or damage, regardless of the cause, happening or occurring to any third parties in privity with the DEVELOPER prior to the authorization by IWA to connect the PROJECT or any unit or portion thereof to IWA’s public water system, in accordance with IWA’s rules and regulations. All such risks shall be the responsibility of and are hereby assumed by DEVELOPER.
10. Permits. DEVELOPER shall, at DEVELOPER’S expense, obtain all necessary permits and licenses for the construction and installation of the improvements, give all necessary notices and pay all fees and taxes required by law.
11. Default of DEVELOPER.
a. Default of DEVELOPER shall include, but not limited to, DEVELOPER’S failure to timely commence construction of this Agreement; DEVELOPER’S failure to timely complete construction of the Improvements; DEVELOPER’S failure to timely cure any defect in the Improvements; DEVELOPER’S failure to perform substantial construction work for a period of twenty (20) calendar days after commencement of the work; DEVELOPER’S insolvency, appointment of a receiver, or the filing of any petition in bankruptcy either voluntary or involuntary which DEVELOPER fails to discharge within thirty (30) days; the commencement of a foreclosure action against the PROJECT or a portion thereof, or any conveyance in lieu or in avoidance of foreclosure; or DEVELOPER’S failure to perform any other obligation under this Agreement.
b. The IWA reserves to itself all remedies available to it at law or in equity for breach of DEVELOPER’S obligations under this Agreement. The IWA shall have the right, subject to this section, to draw upon or utilize the appropriate security to mitigate IWA damages in event of default by DEVELOPER. The right of IWA to
Report of changes to the Development Services Procedural Guidelines (Rey... Page 463 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D draw upon or utilize the security is additional to and not in lieu of any other remedy available to IWA. It is specifically recognized that the estimated costs and security amounts may not reflect the actual cost of construction or installation of the improvements and, therefore, IWA damages for DEVELOPER’S default shall be measured by the cost of completing the required improvements. The sums provided by the improvement security may be used by IWA for the completion of the Improvements in accordance with the Improvement Plans and specifications contained therein.
c. In the event of DEVELOPER’S default under this Agreement, DEVELOPER authorizes IWA to perform such obligation twenty (20) days after mailing written notice of default to DEVELOPER and to DEVELOPER’S Surety, and agrees to pay the entire cost of such performance by IWA.
d. At the sole discretion of IWA, IWA may take over the work and prosecute the same to completion, by contract or by any other method IWA may deem advisable, for the account and at the expense of DEVELOPER, and DEVELOPER’S Surety shall be liable to IWA for any excess cost or damages occasioned IWA thereby; and, in such event, IWA, without liability for so doing, may take possession of, and utilize in completing the work, such materials, appliances, plant and other property belonging to DEVELOPER as may be on the site of the work and necessary for performance of the work.
e. Failure of DEVELOPER to comply with the terms of this Agreement shall constitute consent to the filing by IWA of a notice of violation against all the lots in the PROJECT, or to request that the City rescind the approval or otherwise revert the SUBDIVISION to acreage. The remedy provided by this Subsection c is in addition to and not in lieu of other remedies available to IWA. DEVELOPER agrees that the choice of remedy or remedies for DEVELOPER’S breach shall be in the discretion of IWA.
f. In the event that DEVELOPER fails to perform any obligation, hereunder, DEVELOPER agrees to pay all costs and expenses incurred by IWA in securing performance of such obligations, including costs of suit and reasonable attorney’s fees.
g. The failure of IWA to take an enforcement action with respect to a default, or to declare a breach, shall not be construed as a waiver of that default or breach or any subsequent default or breach of DEVELOPER.
12. Warranty. DEVELOPER shall guarantee or warranty the work done pursuant to this Agreement for a period of one year after final acceptance by the IWA Board of the work and Improvements against any defective work or labor done or defective materials furnished. Where certain improvements are to be constructed in phases or sections, the one year warranty period shall commence after IWA acceptance of the last completed
Report of changes to the Development Services Procedural Guidelines (Rey... Page 464 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D improvement, If within the warranty period any work or improvement or part of any work or Improvement done, furnished, installed, constructed or caused to be done, furnished, installed or constructed by DEVELOPER fails to fulfill any of the requirements of this Agreement or the Improvement Plans and specifications referred to herein, DEVELOPER shall without delay and without any cost to IWA, repair or replace or reconstruct any defective or otherwise unsatisfactory part or parts of the work or structure. Should DEVELOPER fail to act promptly or in accordance with this requirement, DEVELOPER hereby authorizes IWA at IWA’s option, to perform the work twenty (20) days after mailing written notice of default to DEVELOPER and to DEVELOPER’S and agrees to pay the cost of such work by IWA. Should the IWA determine that urgency requires repairs or replacements to be made before DEVELOPER can be notified, IWA may, in its sole discretion, make the necessary repairs or replacement or perform the necessary work and DEVELOPER shall pay to IWA the cost of such repairs.
13. DEVELOPER Not Agent of IWA. Neither DEVELOPER nor any of DEVELOPER’S agents or contractors are or shall be considered to be agents of IWA in connection with the performance of DEVELOPER’S obligations under this Agreement.
14. Injury to Work. Until such time as the improvements are accepted by IWA, DEVELOPER shall be responsible for and bear the risk of loss to any of the improvements constructed or installed. Until such time as all improvements required by this Agreement are fully completed and accepted by IWA, DEVELOPER will be responsible for the care, maintenance of, and any damage to such improvement. IWA shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or damage, regardless of cause, happening or occurring to the work or Improvements specified in this Agreement prior to the completion and acceptance of the work or improvements. All such risks shall be the responsibility of and are hereby assumed by DEVELOPER.
15. Other Agreements. Nothing contained in this Agreement shall preclude IWA from expending monies pursuant to Agreements concurrently or previously executed between the parties, or from entering into Agreements with other DEVELOPERs for the apportionment of costs of water and sewer mains, or other improvements, pursuant to the provisions of the IWA ordinance providing therefore, nor shall anything in this Agreement commit IWA of any such apportionment.
16. DEVELOPER’S OBLIGATION TO WARN PUBLIC DURING CONSTRUCTION.
Until final acceptance of the Improvements, DEVELOPER shall give good and adequate warning to the public of each and every dangerous condition existent in said improvements, and will take all reasonable actions to protect the public from such dangerous condition.
17. Vesting of Ownership. DEVELOPER shall promptly dedicate or grant to IWA, without charge, any and all rights, rights-of-way or other property interests necessary to IWAs
Report of changes to the Development Services Procedural Guidelines (Rey... Page 465 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D ownership and control of the Improvements to be constructed pursuant to this Agreement, which are on property owned or controlled by DEVELOPER. Upon acceptance of the work on behalf of IWA and recordation of the Notice of Completion, ownership of the improvements constructed pursuant to this Agreement shall vest in IWA. DEVELOPER shall execute any documents to effectuate this provision.
18. Final Acceptance of Work. Acceptance of the work on behalf of IWA shall be made by the IWA Board upon recommendation of the IWA Engineer after final completion and inspection of all improvements. The IWA Board shall act upon the Engineer’s recommendation within thirty (30) days from the date the IWA Engineer certifies that the work has been finally completed, as provided herein, or at such other time deemed reasonable. Such acceptance shall not constitute a waiver of defects by IWA.
19. Indemnity/Hold Harmless. IWA or any officer or employee thereof shall not be liable for injury to persons or property occasioned by reason of the acts or omissions of DEVELOPER, its agents or employees in the performance of this Agreement.
DEVELOPER agrees to defend, indemnify and hold harmless IWA, its officials and employees from any and all claims, demands, causes or action, liability or loss of any sort, because of, or arising out of, acts or omissions of DEVELOPER, its agents or employees in the performance of this Agreement, including all claims, demands, causes of action, liability, or loss because of, or arising out of, in whole or in part, the design or construction of the Improvements. This indemnification and agreement to hold harmless shall extend to injuries to persons and damages or taking of property resulting from the design or construction of said SUBDIVISION, and the Improvements as provided herein, and in addition, to adjacent property owners as a consequence of the diversion of waters from the design or construction of public drainage systems, streets and other public improvements.
Acceptance by the IWA of the Improvements shall not constitute an assumption by the IWA of any responsibility for the design or construction of the SUBDIVISION or the Improvements pursuant to the approved Improvement Plans or map, regardless of any negligent action or inaction taken by the IWA in approving the plans, unless the particular improvement design was specifically required by IWA over written objection by DEVELOPER submitted to the IWA Engineer before approval of the particular improvement design, which objection indicated that the particular improvement design was dangerous or defective and suggested an alternative safe and feasible design. After acceptance of the Improvements, the DEVELOPER shall remain obligated to eliminate any defect in design or dangerous condition causes by the design or construction defect, however DEVELOPER shall not be responsible for routine maintenance. The provisions of this paragraph shall remain in full force and effect for ten years following the acceptance by the IWA of Improvements. It is the intent of this action that DEVELOPER shall be responsible for all liability for design and construction of the Improvements installed or work done pursuant to this Agreement and that IWA shall not be liable for any negligence, nonfeasance, misfeasance or malfeasance in approving, reviewing, checking, or correcting any plans or specifications or in approving, reviewing or inspecting any work or
Report of changes to the Development Services Procedural Guidelines (Rey... Page 466 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D construction. The improvement of security shall not be required to cover the provisions of this paragraph.
20. Sale or Disposition of Project. Sale or other disposition of this property will not relieve DEVELOPER from the obligations set forth herein. If DEVELOPER sells the property or any portion of the property within the PROJECT to any other person, the DEVELOPER may request a novation of this Agreement and a substitution of security. Upon approval of the novation and substitution of securities, the DEVELOPER may request a release or reduction of the securities required by this Agreement. Nothing in the novation shall relieve the DEVELOPER of the obligations under this Agreement for the work or improvement done by DEVELOPER.
21. Time of the Essence. Time is of the essence of this Agreement.
22. Time for Completion of Work/Time Extension. DEVELOPER shall complete construction of the improvements required by this Agreement in accordance with the schedule of performance attached as Exhibit C hereto and incorporated herein (“Schedule of Performance”). The IWA, in his or her sole discretion, may authorize acceptance of individual Improvements to accommodate phasing of PROJECT development; provided, however, that production, storage and transmission needs must be complete and adequate for each phase of PROJECT development before they are considered for acceptance. In no instance will water service be provide by IWA to the PROJECT, or any part or phase thereof, without corresponding sewer service. IWA will not approve or accept any on-site improvement, or permit any connection to the Improvements, until all related improvements have been completed and accepted by IWA. In the event good cause exists as determined by the IWA Engineer, the time for completion of the improvements hereunder may be extended. The extension shall be made by writing executed by the IWA Engineer. Any such extension may be granted without notice to DEVELOPER’S Surety and shall not affect the validity of this Agreement or release the Surety or Sureties on any security given for this Agreement. The IWA Engineer shall be the sole and final judge as to whether or not good cause has been shown to entitle DEVELOPER to an extension.
Delay, other than delay in the commencement of work, resulting from an act of IWA, or ‘by an act of God’, which DEVELOPER, could not have reasonable foreseen, or by storm or inclement weather which prevent the conducting of work, and which were not caused by or contributed to by DEVELOPER, shall constitute good cause for an extension of time for completion. As a condition of such extension, the IWA Engineer may require DEVELOPER to furnish new security guaranteeing performance of this Agreement as extended in an increased amount as necessary to compensate for any increase in construction costs as determined by the IWA Engineer.
23. Legal Responsibilities. The DEVELOPER shall keep itself informed of all local, State and Federal Laws and regulations which in any manner affect those employed by it or in any way affect the performance of its obligations pursuant to this Agreement. The DEVELOPER shall at all times observe and comply with all such laws and regulations.
Report of changes to the Development Services Procedural Guidelines (Rey... Page 467 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D The IWA, and its officers and employees, shall not be liable at law or in equity caused by failure of the DEVELOPER to comply with this section.
24. No Vesting of Rights. Performance by DEVELOPER of this Agreement shall not be construed to vest DEVELOPER’S rights with respect to any change in any capacity or service fee or regulation of IWA.
25. Non-disturbance of Maps and Obligations. This Agreement does not rescind, replace, or otherwise affect any obligation that the DEVELOPER may have under any map recorded pursuant to the Subdivision Laws to complete the design and construction of any improvements, nor does it alter any obligation to the DEVELOPER may have under any such map to dedicate or otherwise transfer any real property or improvements to IWA or to any other public entity. Performance by DEVELOPER of this Agreement shall not be construed to vest DEVELOPER’S rights with respect to any change in any capacity or service fee or regulation of IWA.
26. Assignment. This Agreement may not be assigned by DEVELOPER in whole or in part without the prior written consent of the IWA. If assigned by DEVELOPER pursuant hereto, this Agreement shall apply to, bind and inure to the benefit of the Parties and their respective successors and assigns.
27. Non-Liability of Officials and Employees of IWA. No official, representative, agent, attorney, consultant or employee of IWA shall personally be liable to the DEVELOPER in the event of any default by IWA under the terms of this Agreement.
28. Notices. All notices required or provided for under this Agreement shall be in writing and delivered in person or sent by mail, postage prepaid and addressed as provided in this Section. Notice shall be effective on the date it is delivered in person, or, if mailed, on the date of deposit in the United States Mail. PLAN CHECKING PROCEDURES FOR GRANT OF EASEMENT
Date: December 9, 2014
A. PURPOSE OF EASEMENT
In general, easements are granted to either the City of Indio and/or the Indio Water Authority for purposes of gaining access to private property to construct, maintain, and operate a variety of improvements. In the case of Indio Water Authority (IWA), they are granted for the purpose of constructing, operating and maintaining water facilities with restrictions or conditions for their use and the time frame when the lease is in force or in effect.
The Grantor is the property owner(s) who grants the easement, and the Grantee is the Indio Water Authority as it relates to water system improvements.
The Development Procedural Guidelines, Section 3.7, provides the requirements by the IWA for easements. (See attached Exhibit A)
In addition to the conditions described in the Development Procedural Guidelines, other conditions of the easement may be required and vary depending on the purpose and/or intent of the easement. The conditions are described in a typical Lease Agreement Document. (See example on file for the Habiby property easement.) Finally, one alternative to filing separate easements for the IWA is to include easements with their descriptions and conditions as part of a recorded tract or parcel map. This precludes the necessity of filing and recording separate easement documents.
The information provided below involves an explanation of the documents required to submit for review and approval, record and file separate easements not included with a recorded tract or parcel map.
B. DOCUMENTS REQUIRED FOR SUBMISSION, REVIEW, APPROVAL,
RECORDING AND FILING
a. Submission Requirements:
In order to adequately review easements, the developer or the developer’s representative needs to submit for review the following documents:
Report of changes to the Development Services Procedural Guidelines (Rey... Page 490 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D
1. Legal Description describing a starting point (usually referencing a tract map or plat that has been recorded) to the starting point of the boundary of the easement (True Point of Beginning) and continuing with a description of the area that the easement encompasses. The description is commonly described in metes and bounds. By definition, Metes is defined as the measurement of a straight or circular curved run (normally to the nearest one-hundred of a foot for both straight or tangent runs and circular curves expressed in radii) between terminal points with the orientation (normally described as either a bearing or azimuth) to the nearest second of a degree, always oriented in relationship to true or magnetic north.) By definition, Bounds is a general boundary description such as a known roadway intersection, an existing building, etc. The legal description should end with a description of the total encompassed area of the easement, expressed in either or both square feet or acres.
The metes and bounds description must close accurately, meaning that the closure from the starting point (Point of Beginning) around the boundary of the easement back to the ending point, which is the Point of Beginning, should close accurately since it is a paper or theoretical closure. Because the distances are rounded off to the nearest one-hundred of a foot and the bearings or azimuths are rounded off to the nearest second of a degree, it will never close precisely. Depending on several factors, i.e., the length of the boundary that the easement encompasses, extent that distances and bearings are rounded off, etc., the closure precision will vary, but usually no less than a ratio of 1:50,000, meaning one foot closure in 50,000 feet in the case of our English units. That is why the legal description usually says, in part, “consisting of an area of xxx more or less.”
The remaining component of the legal description is the land surveying seal and signature usually placed at the bottom of the last page of the Legal Description. This consists of the land surveying licensing seal, date of expiration of the license, signature certifying that the signatory has responsible charge of the work, and the date the document is signed by the licensed land surveyor. (See example on file for the Habiby property easement.)
2. Exhibit(s) is a pictorial description (line drawing), preferably to scale, of the easement indicating; 1) the starting point for the legal description such as a section corner, quarter-corner, etc. usually originating from a referenced subdivision or tract map that has been recorded; 2) the True Point of Beginning (TPOB) which is the starting point on the boundary of the easement for which the legal description is initiated and 3) the boundary of the easement, usually expressed in bearings and distances. Bearings are divided into four quadrants, i.e., northeast, southeast, southwest and northwest respectfully, rotated in a clockwise direction. Distances are expressed to the nearest one hundred of a foot. Azimuths are rarely used to describe orientation but are the
Report of changes to the Development Services Procedural Guidelines (Rey... Page 491 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D clockwise rotational angle from zero (0) degrees to 360 degrees with zero (0) degrees representing either the true north or magnetic north position. The metes and bounds information should be easily discernable and can be either written on each segment of the boundary of the easement or in table format. Sometimes a Vicinity Map is included with the exhibit(s) but not mandatory.
The exhibit provides stamps or seals, signature and date of the California License Surveyor in responsible charge of the work. (See example on file for the Habiby property easement.)
Closure Report needs to be included to indicate that the metes and bounds description closes. This report consists of the traversed bearing and distance with the northerly and easterly coordinates for each corner segment of the easement boundary, curve data if involved, error of closure expressed in the northerly and easterly coordinate differential between the starting point and ending point as well as the precision of closure, i.e. 1:50,000 as an example. Finally, the closure report specifies the area that the easement encompasses, expressed in either or both square footage and acres. (See example on file for the Polo IWA Clubhouse easement.)
3. Grant of Easement form. This form includes the items discussed above and includes 1) terms and conditions for both the Grantor and Grantee; 2) a template heading acknowledging that the Grantee (IWA) requests that the easement be filed and recorded and return to the IWA; and 3) notarized signature and date of the Grantor. The heading also has space for the recorder’s stamp formerly acknowledging to both the Grantor and Grantee that the easement has been filed and recorded. (See example on file for the Habiby property easement.)
C. CHECK LIST
Note:
Place “√” if easement conforms.
Leave Blank if the subject matter does not conform or place “NA” if the subject matter is not applicable.
1. Legal Description: (See example on file for the Habiby property easement.) The written legal description begins with a reference to a previously recorded map, such as a tract map or subdivision plat.
Based on title research of referenced recorded map (usually available from existing City of Indio archives or available at the County Recorder’s office, verify that the map(s) exists and accurately represents the described legal description.
Report of changes to the Development Services Procedural Guidelines (Rey... Page 492 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D The legal description culminates with the total area encompassed by the easement expressed in either or both square feet or acres and when applicable, the term “more or less” is inserted.1
The legal description begins with a recorded map, referencing a starting corner monument2 or similar physical evidence, and continues using metes and bounds format to the beginning corner on the easement boundary (True Point of Beginning), then circumventing the easement boundary, expressed in metes and bounds, culminating back to the True Point of Beginning.
When comparing the easement description with the line drawing Exhibit(s), the two documents, i.e. written legal description expressed in metes and bounds, and drawing boundary lines and figures, expressed in metes and bounds, are both identical.
2. Exhibit(s): (See example on file for the Habiby property easement.) The exhibit(s) line drawing(s) accurately reflect the metes and bounds legal description as provided in the GRANT OF EASEMENT document.
North arrow.
Scale bar or scale notation.
Legend indicating symbols used for the drawing or map.
Adjacent parcel information (both interior and exterior boundaries).
The location of the beginning point of origin, (e.g., recorded tract or parcel map corner), accurately reflecting the legal description as provided in the GRANT OF EASEMENT document.
Exhibit shows adjacent roadways and their names.
Title block including Consultants name and address, date, page number; title of easement, such as a portion of the leading paragraph in the meters and bounds description (Legal Description). Example would be “A PORTION OF LAND SHOWN AS PARCEL B AND RECORDED ON MARCH 31, 2005, AS
INSTRUMENT NO. 2005-0252245” etc.
The exhibit provides the stamp or seal, signature and date of the California License Surveyor in responsible charge of the work.
1 There are a few exceptions where “more or less” does not apply, such as a rectangular shaped easement boundary where the boundary distances are whole numbers (no fractions of a foot) such as 10.00 foot x 20.00 foot dimensions.
For this example, the total area of 200 square feet is exact. 2 Sometimes the starting point from a known recorded corner is described as the Point of Beginning (POB) and the starting point for the beginning corner of the easement, is described as the True Point of Beginning (TPOB).
Report of changes to the Development Services Procedural Guidelines (Rey... Page 493 of 1774 Development Services Procedural Guidelines, Updated January 2025 Appendix D
3. Closure Report: (See example on file for the Polo IWA Clubhouse easement.) The closure report includes the northerly and easterly coordinates, bearings and distances for each segment sequentially from the Point of Beginning to the ending point.
The closure report includes the error of closure expressed in bearing and distance between the starting point and ending point coordinates.
The closure report includes the precision of closure as a ratio of one (1) foot to XXX feet. It should be no less than 1:50,000 feet.
4. Grant of Easement Form: (See example on file for the Habiby property easement).
The Grant of Easement form should be consistent with the “standard IWA form” which includes the following elements:

Maximum Applied Water Allowance (MAWA)
Using the following formula:
MAWA = [(ETo) x (0.45) x (LA) x (0.62)] / (748)
MAWA = Maximum Applied Water Allowance (CCF or hundred cubic feet) ETo = Reference Evapotranspiration (inches per year)
0.45 = ET adjustment factor
LA = Landscaped Area (square feet)
0.62 = Conversion Factor (to gallons per square foot)
748 = Conversion Factor (to hundred cubic feet)
MAWA = 75.0 (ETo) x (0.45) x (LA) x (0.62) / (748) = [75.0(.45) (60,000) (0.62)] / (748) MAWA = 1,678 CCF
ETWU total of 1,632 CCF is < the MAWA of 1,678 CCF

Recycled Water Checklist
1. Obtain coverage under the general waste discharge requirements for discharge of recycled water for golf course and landscape irrigation Order No. 97-700 or equivalent version of this permit from the California Regional Water Quality Control Board of the Colorado River Basin Region (Regional Board) by submitting a Notice of Intent to the Regional Board and paying application/annual fees.
2. Enter into an agreement with IWA for receiving non-potable water for golf course and landscape irrigation. The agreement between discharger and IWA must be provided to the Regional Board within 90 days of receiving coverage under the permit referenced above in item #1.
3. Landscape and Irrigation system plans must meet regulatory requirements of Order 97¬700 or equivalent version of this permit, the State Board’s Recycled Water Policy, and California Department of Public Health (CDPH) Statutes and Regulations related to recycled water, such as the Health and Safety Code, the Water Code, Title 17 and Title 22 Code of Regulations. These requirements include but are not limited to the following:
a. An air-gap separation, a vertically measured distance between supply pipe and receiving vessel must be present and meet the required distance for the size of the supply pipe.
b. The appropriate type of backflow protection is to be installed for auxiliary water supplies and recycled water.
c. The required separation distance between recycled water lines and impoundments and application area; and domestic wells and water lines is maintained and approved by CDPH.
d. The design of the irrigation system shall not cause the occurrence of ponding anywhere in the reuse area, and overspray or mist around dwellings, outdoor eating areas and/or food handling facilities is eliminated. Irrigation runoff shall be confined to the recycled water use area unless authorized by CDPH. e. Drinking fountains will be protected from spray, mist or runoff by use of a drinking fountain cover or shelter approved for this purpose. f. Hose bibs are not allowed on portions of the recycled water systems accessible to the general public. Quick couplers that differ from those used on the potable water system are allowed.
g. Signs are posted in areas that the public has access to that are no less than 4 inches high by 8 inches wide and include “RECYCLED WATER—DO NOT DRINK” and the international do not drink symbol as indicated in CCR Title 22 Division 4 Chapter 3 Article 4 Section as figure 60310-A. The number and locations of these signs will be approved by CDPH.
h. The recycled water irrigation system is able to be operated during a time of day that will minimize contact with the public.
i. All pipes installed above or below ground on or after June 1, 1993 designed to carry recycled water are to be colored purple or wrapped in purple tape. j. Golf course pump houses utilizing recycled water are appropriately tagged with warning signs with proper wording of sufficient size to warn the public that

City Council
July 16, 2025
STAFF REPORT
To: City Council
From: Bryan H. Montgomery, City Manager
Prepared by: Reymundo Trejo, P.E., IWA General Manager
Subject: Report of Fee Structure changes to the Indio Water Authority Customer Service Policy
RECOMMENDATION:
Staff recommends that the City Council/Indio Water Authority (IWA) Board receive and file the revised Customer Service Policy for the Indio Water Authority.
SUMMARY:
The Indio Water Authority (IWA) has completed a comprehensive revision of its Customer Service Policy, formerly titled the Finance and Customer Service Policy, which was originally adopted on March 3, 2015. This updated policy defines the scope of services provided to customers and clarifies the conditions under which those services are delivered. It also incorporates the most current IWA fee structure approved by the City Council and IWA Board on May 7, 2025. The revised policy reflects operational changes, legal requirements, and organizational restructuring resulting from the consolidation of finance departments between IWA and the City of Indio. These updates are designed to streamline internal processes and enhance transparency and consistency in customer service practices.
BACKGROUND INFORMATION:
The City Council adopted the original Finance and Customer Service Policy on March 3, 2015. This policy established procedures for applying customer service fees and charges, outlined guidelines for waivers and billing adjustments, and supported consistent, high-quality service for IWA customers. On September 28, 2018, the State of California enacted Senate Bill 998, the Water Shutoff Protection Act, which requires all water agencies to adopt a separate policy on the discontinuation of residential water service. In response, IWA created the Policy on Discontinuation of Residential Service for Nonpayment, which the City Council approved on January 15, 2020. This policy replaced the residential discontinuation provisions previously included in the 2015 version and now functions as a stand-alone document used wherever required by law. In June 2024, IWA staff began revising the Customer Service Policy to reflect internal restructuring and refocus it on customer service operations. The updated policy also incorporates the new water rate structure approved by the City Council and IWA Board on May 7, 2025, and effective July 1, 2025. Staff worked closely with the City’s legal team to ensure the policy aligns with current operational standards and legal requirements. Staff recommend that the City Council/IWA Board receive and file the revised Customer Service Policy.

1. Introduction
The Indio Water Authority (“Authority”) recognizes the importance of adopted policies relative to Customer Service. Customer service policies are prudent fiscal management tools and are a cornerstone of operating policy and philosophy. A written and adopted Customer Service policy (“Policy”) ensures consistency in the application of practices and procedures while administering customer related matters. For this policy, a customer shall be defined as any person, property owner, tenant, firm, corporation, association or agency who uses or desires to obtain Potable Water Service from the Authority. This Policy identifies specific policies for addressing Authority water service-related fees and charges to its utility customers. It is the intent of this policy to clearly identify policies that are consistent with the Authority’s mission statement, the uniqueness of the Authority, and the philosophy of the Authority’s Board of Directors. This policy shall be known and may be cited as the Indio Water Authority Policy.
2. Objectives
This Policy has been developed to consider and appropriately address the following:
I. To ensure the consistent application of policies to Authority customers while administering water-related service fees and charges.
II. To provide established guidelines on the application and waiver of fees, charges, and adjustments.
III. To maintain and enhance customer service relationships with the customers of the Authority.
IV. To maintain a written Indio Water Authority Policy.
3. General
This section sets forth the terms and conditions under which the Authority will provide water service to its customers and is subject to change from time to time at the discretion of the Executive Director of the Authority. For the purposes of this policy, Customer shall be defined as any person, property owner, tenant, firm, corporation, association or agency who uses or desires to obtain Potable Water Service from the Authority. The Executive Director of the Authority has the right to interpret the policy on any point that is not specifically covered herein.
The Authority endeavors to provide water service without discrimination and in accordance with sound business principles; that rates will be uniform to all customers within classifications and that water service pricing shall be based on the actual cost of service to customers without special rate categories for selected social or economic classes of customers.
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 585 of 1774 July 2, 2025 Page 5
This Policy is intended to provide guidance to Authority customers and staff and remain consistent in servicing customers.
4. Service Conditions
The Authority will provide water service if an application for such water service is completed in the manner hereinafter provided. Unless otherwise determined by the Board of Directors, Will Serve letters will sunset if the project does not commence within three years from the date of issuance of said letter.
5. Service Area
The Authority may only serve land within its boundaries; however, the Board of Directors may authorize the sale of surplus water to other entities, through exchange agreements, and under special conditions and rates as set.
6. Service Connections and Meters
A. Installation. The Authority will meter all water services and apply the rate schedule thereto. Except as otherwise provided by written agreement, the Authority will furnish and install, at the applicant's expense (and in accordance with all applicable Residential and Commercial Rates and Service Fees, adopted by resolutions or ordinances), service connections and meters of such size and at such locations as an applicant requests; provided, however, that the Authority reserves the right to make the final determination as to the size and location of each service connection and meter.
Service connections and meters will be connected to the Authority's distribution system and shall be contained within the Authority's (or public) right-of-way or easement.
B. Payment of Connection Fees. The Applicant shall pay the connection fee at the time of application for service. Upon acceptance and approval by the Authority, the applicant will be authorized to connect into the water system for a period of one year from the date of approval. If the connection is not made within one (1) year of application of service, a new application, including fees and charges in effect on the date of that application, is required. Fees and charges previously paid by the applicant will be credited toward the fees and charges due. If the applicant fails to update his/her application, the application status will be revoked and a refund, minus any applicable administrative charges, will be issued.
C. Change in Meter Location/Tampering.
1. Meters or service laterals moved for the convenience of the customer will be relocated at the customer’s expense. Meters or service laterals moved for Authority purposes will be moved at the Authority's expense. A customer requesting relocation will be billed based on actual time and materials necessary to perform the relocation. Reconnection to the customer’s side of the meter shall be at the customer’s expense.
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 586 of 1774 July 2, 2025 Page 6
2. Meters, meter boxes, and service laterals are Authority property and are not to be tampered with or relocated by non-Authority personnel. If in the opinion of the Authority a meter or service lateral has been affected or altered in any manner, or if the meter or service lateral has been damaged, or in any way defaced, the customer will be notified and held financially responsible for the unauthorized tampering of the meter.
D. Change in Meter Size and/or Classification.
1. If the customer requests that an existing meter be
replaced with a meter of a different size, the cost for the change will be the actual cost of the new meter plus the cost of labor and parts to install a new service line, if any. All costs are at the customer’s expense.
2. If a customer with an existing active meter subdivides the parcel, the customer will be eligible to receive credit for the amount actually paid at the time of original application. The credit shall only be applied to meter services within the area of the original parcel and cannot be used on other properties. Meters that have been placed on “In-Active” status for a period exceeding five years are not eligible for credits. Credit shall not be given for the meter, service lateral, or related materials.
3. Authority services are available during posted business hours and are subject to certain fees as listed in the Rates Fees and Charges, any service request to be performed for the convenience of the customer that results in overtime for Authority staff, will be charged an after-hours fee in accordance with Residential and Commercial Rates and Service Fees (Attachment No. 1). For Consistency purposes of this policy, requests made after 5:00 pm on the business day will be considered after hours.
E. Ownership. The service connection and meter are the property of the Authority, and the Authority reserves the right to repair, replace, and maintain them, as well as to remove them upon discontinuance of service. The Agency’s facilities include pipe, fittings, meter, meter box and check valve or backflow prevention device and shutoff valve, extending from the Authority’s potable or recycled water main to the outlet of the shut-off valve downstream of the meter, check valve or backflow prevention device.
F. Maintenance. The service connection, including the meter and meter box, will be repaired and maintained by the Authority at its expense, except when damage occurs due to the negligence of the customer, or of the customer's family, guests, invitees, or agents, in which case the customer will pay for repairs made by the Authority. The customer shall also be financially responsible for the replacement of any meter and or meter box that is stolen or removed from the property. The Authority is not responsible
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 587 of 1774 July 2, 2025 Page 7
for the installation or maintenance of valves, regulators, filters, or any water lines, or equipment extending beyond the discharge end of the meter.
G. Obstruction of Meter Boxes. No person shall cause or place, dispose, or allow the placement, disposal or deposit of oil, toxic, hazardous, or contaminated liquid or waste, trash, soil, building materials, or other substances, objects, or obstructions in, on, or around meter boxes or other Authority facilities. No person shall allow or permit meter boxes or other Authority facilities to be obstructed or obscured by trees, shrubs, and plants or in any other manner so as to impede their intended use or access.
Upon notification from the Authority, the customer shall have fifteen (15) calendar days to clean, trim and/or otherwise remove any obstruction(s) that impede the use or access to Authority meters or services.
If such substances, objects or obstructions are not cleaned and removed, the Authority will accomplish the cleaning and/or removal of any substances or objects at the customer’s expense. Charges for these services will be included on the customer bill during the next billing cycle.
H. Access to Facilities. By accepting service, the customer agrees to grant to the Authority an irrevocable license to enter onto customer property for purposes of installation, operation, maintenance, reading, repairing, replacement, or removal of the service, including the meter and meter box. Failure to grant access is sufficient cause for service termination.
7. Description of Service
A. Supply. The Authority will exercise reasonable diligence and care to deliver a continuous and sufficient supply of water to its customers and to avoid any shortage or interruption in the delivery provided.

Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 590 of 1774 July 2, 2025 Page 10
A. Requirements. Applications for water service or installation of a water meter will require signature by the customer of the property to be served.
Applicants are responsible for payment of all Charges for Services and Domestic Water Rates and must comply with the Authority’s Rules and Regulations. A non-refundable Water Service Establishment Fee of $20 will be billed whenever a customer establishes, transfers, or reactivates service as outlined in the Residential and Commercial Rates and Service Fees. Applicants must provide all information necessary to make a determination regarding service requirements or credit worthiness.
Applications for service (Attachment 2), excluding new service connections, shall be made a minimum of two business days in advance of desired activation date. When there is no continuity of service, the applicant starting service shall be responsible for the restore service charge, and any applicable after-hour charges, as outlined in Residential and Commercial Rates and Service Fees. For the purpose of starting new services, the Same Day Service Turn on Fee of $64 will be applied regardless of service being turned on during or after business hours.
B. Account ownership and Property Classification. Upon applying for water service, applicant shall specify the property type and indicate whether the occupant is:
• property owner
• tenant
• property management
Service can be initiated at any location.
C. Tenants are required to provide property owner contact information when requesting to initiate service.
D. Responsibility for fire detector or fire services is limited to property owners, and any changes in ownership of such services necessitate proof of ownership and verification by the Authority before initiating or transferring accounts.
E. Service Previously Rendered to Applicant. Service will not be provided unless payment in full has been made for service previously rendered to the applicant by the Authority and all applicable connection, capital impact fees, installation charges, fees, deposits, fines, and penalties have been paid in full.
Service can be provided in the case of the transfer of service from one location to another provided that the applicant executes a form for transfer of service to transfer the balance from one location to another.
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 591 of 1774 July 2, 2025 Page 11
F. Restrictions. Water service is restricted to the premises and/or parcels reflected in the application. A new, separate application for service and water meter is required for any parcel split off of the original parcel.
G. Water Use Without Authority Application. A person taking possession of a premise and using water without submitting a fully executed application for water service will, in addition to applicable fines outlined in Residential and Commercial Rates and Service Fees, be held liable for the cost of water delivered from the date of the last recorded meter reading. If the meter is found to be inoperative, the quantity consumed will be estimated based on an average of the prior three years usage for the corresponding time period. If less than three years of information is available, then a comparison using other customers receiving the same class of service during the same period of time will be used to estimate the bill.
H. Individual Liability for Joint Service. Two or more parties who make an application for a single service will be jointly, and separately, liable for the expenses incurred in connection with such service. All monthly bills are addressed to both/all parties who are financially responsible for all charges. If not paid, the charges will be sent to a collection agency with both/all parties named.
I. Changes in Customer Equipment or Usage of Water on Premises.
Customers anticipating material changes in the size, character, or extent of the equipment or operations using water service, or where the change in operations may result in a substantial increase in the use of water, must give the Authority advanced written notice of the nature of the change.
The terms “material changes” and “substantial increase” are deemed to mean that point at which a larger meter, capacity, and/or additional facilities are required at the discretion of the Authority. Additionally, a customer anticipating changes must have prior approval from the Authority. Failure to do so may result in termination of water service.
Upon such notification or discovery, and verification by the Authority of changed equipment or usage, the Authority may change conditions of water service including, but not limited to, water type/source, service line size, meter size, cross connection control equipment, and billing frequency. In the event that an increase in water use has resulted in failure of metering equipment, the Authority, in addition to installing the appropriate size meter, will estimate the water used based on an average of three years usage for the corresponding time period. If less than three years of information is available, then a comparison with the use of other customers receiving the same class of service during the same time will be used to estimate the bill. All costs associated with equipment or change in water use or service will be borne by the customer as per other applicable provisions of this policy.

A. Meter Reading and Billing. Meters are read at regular intervals, or as required for the preparation of opening bills, closing bills, and special bills. Bills will be issued on a periodic basis to the mailing address for the customer of record. In addition to being mailed, customers who have signed up for paperless billing will receive an E-notification that their bill is available online for viewing.
D. Due Date. Each statement issued by the Authority for such charges shall be due and payable on the date of mailing or other presentment to the customers.
E. Final Payment Date. All charges in each statement must be paid on or before the final payment date shown on the statement, which shall be at least twenty five (25) calendar days following the date of mailing or presentment of the statement.

The customer is responsible for ensuring that the Authority receives payment in a timely manner. If a check payment has been made and returned by the financial institution, a returned item processing fee will be applied, as outlined in the Residential and Commercial Rates and Service Fees Furthermore, if a credit card payment transaction is not processed due to an expired card, declined payment, or incorrect account number, a return item fee will not be charged but the account will still be subject to delinquent penalties. The bill returned item fee and all outstanding charges will be evaluated as if no payment had been made, to determine if a delinquent fee should be applied, or service discontinued. A deposit may be required before restoration of service.
The Authority reserves the right to establish the means or form of payment (cash, money order, bank cashier’s check, etc.) from any customer that has previously tendered a dishonored check or gives indication that funds are not sufficient to cover any check tendered.
If a residential customer issues a payment to avoid water service termination and that payment is later returned by the financial institution, the Authority may terminate service upon giving a five (5) business day notice to the customer.
G. Delinquent Bills. Bills not paid within twenty-five (25) days after mailing are considered delinquent and will incur applicable delinquent charges (10% of outstanding bill) as outlined in the Residential and Commercial Rates and Service Fees.
H. Upon Vacating Premises. Customer discontinuing water service must notify the Authority prior to vacating the premises. Unless discontinuance of service is requested, the customer will be held liable for all charges whether or not any water is used.
I. Delinquent Charge Removal. Charges for delinquencies may be removed from a customer’s account according to the adjustment policy.
J. Disputed Bills. Customer may initiate an inquiry or request an investigation relating to billed charges by presenting their inquiry or request to the Authority via a Customer Appeal Form received by the Authority. Customer Inquiry forms are available on the Authority’s website or may be obtained at the customer service counter during normal business hours.
Any customer who has requested an investigation, or who has made a request for extension of the payment period of a bill asserted to be beyond the means of the customer to pay in full during the normal period for payment, will be given an opportunity for review by the Executive Director of the Authority or his/her appointed designee.
The review may include consideration of whether the customer will be permitted to amortize the unpaid balance of the account over a reasonable period of time.

K. Bill Amortization. Consent to amortize an outstanding water bill may be considered. Customers requesting payment arrangements will be allowed to have as many payment plans as long as all previous payment plans have been satisfied.
Bill amortization is available to customers with:
• No more than three failed payment plans
The Authority will not terminate service as long as the customer maintains the account in good standing during the term of the agreement.
In the case of extreme hardships, the Executive Director of the Authority or his/her appointed designee may authorize an extended amortization plan to allow the customer a chance to deal with the hardship while making steady payments to the Authority. In these very rare cases the Executive Director of the Authority, or his/her appointed designee, will determine the length of the payment arrangement and a suitable amount as well.
If a customer fails to adhere to the terms of the payment arrangements, the Authority may terminate service upon giving a five calendar (5) day notice to the customer.
This notice does not entitle the customer to further investigation by the Authority.
15.Authority Initiated Termination of Service
• The policy regarding the discontinuation of residential water services has been superseded by the 2020 policy on the discontinuation of water services due to nonpayment.(Attachment 3) A. Notice of Termination of Service. Notice of service termination will be mailed at least fifteen calendar days (15) before termination of water service for nonpayment of a delinquent account. The Authority will make a reasonable, good faith effort to contact an adult person residing at the premises of the customer by mail, Enotification and telephone at least 5 business days prior to any termination of service. An additional turn off for non-payment fee, and after-hours service restoration, if required, will be charged as outlined in the Residential and Commercial Rates and Service Fees.
B. Exceptions. Notwithstanding any other provision of this policy, the Authority will not terminate residential service for nonpayment of a water bill in any of the following situations apply:
1. During a pending investigation by the Authority of a customer dispute or complaint.

2. When a customer has been granted an extension of the due date for payment of a bill.
3. Upon written certification by a licensed physician that to do so will be life threatening to the customer.
4. Initiated on any Friday, Saturday, Sunday, legal holiday, or at any time during which the business office of the Authority is not open to the public.
C. Multiple-Residential Accounts.
1. Whenever the Authority furnishes residential water through a master meter, the Authority will make a good faith effort to inform the actual user of the services when the account is delinquent, and service is scheduled for termination. Notice will be provided fifteen (15) calendar days prior to service termination and will inform said users of the right to become customer without being required to pay the amount due on the delinquent account. If one or more actual users are willing and financially able to assume responsibility for the entire account to the satisfaction of the Authority, or if there is a physical means legally available to the Authority, of selectively terminating service to those actual users who have not met the requirements of the Authority's rules and regulations, service will be made available to actual users who do meet the Authority’s requirements for obtaining new service.
2. When prior service for a period of time is a condition for establishing credit with the Authority, residency and proof of credit worthiness is required.
D. Non-Residential Customer. Non-residential customers failing to pay a bill on time are subject to termination after a fifteen calendar (15) day notice is served for the service address following the due date.
E. Multiple Accounts. If a customer has more than one account with the Authority, and the bill for service at any one is not paid within twenty five (25) calendar days after mailing, water services at that location may be terminated. Residential service, however, will not be terminated for non-payment of bills for other non-residential services.
F. Conditions for Restoration of Service. Restoration of service will be made upon payment of all delinquencies, deposits, regular bills, administrative fees, damages to locks, meters, AMI radio read devices, and meter boxes. Restoration can also be made with an approved payment arrangement with the Authority.
G. Subsequent Tenants. Where the Authority has not been paid for furnishing water for residential use to a tenant, it will not seek to recover the amount of the delinquency and any related charges from a subsequent tenant as a condition of service.
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 599 of 1774 July 2, 2025 Page 19
H. Wrongful Termination. Any service wrongfully terminated by the Authority will be restored without charge.
I. Authority Remedies. After a bill has been delinquent for more than twenty five (25) calendar days, the Authority is authorized to do any one or more of the following:
1. Withhold any Authority services to the customer provided, however, termination of water service will only be affected in accordance with the foregoing provisions.
2. Take any other action the Executive Director of the Authority, or his/her appointed designee, deems appropriate to protect the interests of the Authority.
16.Discontinuance of Service for Other Than Delinquency A. Unsafe Apparatus.
1. The Authority may refuse to serve water and may discontinue service to any premises where apparatus or equipment using water is dangerous, unsafe, or not in compliance with the Authority’s Rules and Regulations or with law.
2. The Authority does not assume liability for inspecting apparatus or equipment on the customer property. The Authority does reserve the right of inspection, however, if there is reason to believe that unsafe apparatus or equipment is in use.
B. Service Detrimental to Others. The Authority may refuse to furnish water to any premises where excessive demand by one customer is or may be detrimental to the service furnished to other customers, or will result in inadequate service to others.
C. Fraud or Abuse. The Authority has the right to refuse or discontinue water service to any premise to safeguard against fraud, abuse, or unauthorized use of water or facilities.
D. Non-Compliance. The Authority may discontinue water service to a customer for non-compliance with the Authority’s Policy if a customer fails to comply within ten (10) business days after receiving written notice. If such non-compliance affects matters of public health and/or safety, and conditions warrant, the Authority may discontinue water service immediately and without notice.
E. Customer Request for Service Discontinuance. A customer may request that water service be discontinued by notifying the Authority. Service will be discontinued within a 48-hour time period, excluding weekends and holidays. If notice is not given, the customer will be required to pay for water service to the premises until such notice is given.
F. Restoration-Reconnection Charges. The Authority will charge a fee for restoring water service that has been discontinued because of non-compliance with the

Administrative Code as outlined in the Residential and Commercial Rates and Service Fees.
17.Meter Error
A. Meter Certification.
1. All meters installed by the Authority have been test certified by the manufacturer, and rated as prescribed by the American Water Works Association (AWWA). Meter efficiency tests are conducted under test conditions as prescribed by AWWA.
2. Meter Test.
a. A customer may, by giving the Authority at least ten business (10) days written notice, request the Authority to test the meter serving the customer premises.
b. The Authority will require the customer to place a cash deposit of $117 to cover the cost of the test. Meters over three (3) inches will be charged based on time and materials.
c. Any such deposit will be returned and the meter will be replaced if the meter does not conform to AWWA Standards. The
deposit will be applied by the Authority to cover the cost of the test if the meter does conform to AWWA Standards.
d. A written report giving the results of the test will be available to the customer within ten (10)business days after the Authority has received the results.
B. Adjustment of Bills for Meter Error.
1. Fast Meters. When, after testing, a meter is found to be registering above AWWA Standards, the Authority will refund to the customer the full amount of the overcharge, based on corrected meter readings for the period, not exceeding three years that the meter was in use.
2. Slow Meters. When, after testing, the meter is found to be registering below AWWA Standards, the Authority may bill the customer for the amount of the undercharge, based on corrected meter readings for the period, not exceeding one year that the meter was in use.
3. Non-Registering Meters. The Authority may bill the
customer for water delivered to the customer while the meter was not registering. The bill will be estimated based on an average of the prior three years usage for the corresponding time period. If less than three years of information is available, then a comparison with
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 601 of 1774 July 2, 2025 Page 21
the use of other customer receiving the same class of service during the same period of time will be used to estimate the bill.
18.Customer Account Information
The names, addresses, and records of the Authority's customer and taxpayers are not available to the public, except to the extent required by law. No mailing list compiled from the records of the Authority will be made available to the public by any of the Authority's officers or employees. Disclosure of specific account information is made in accordance with customer consent or in the absence of customer consent, disclosure may occur pursuant to a court order, or if the disclosure is otherwise in accordance with federal or state law. The Authority may make customer records available to third party agencies on a regular basis in connection with the establishment and management of customer accounts, or in the event such accounts are delinquent.
It is the responsibility of the customer to provide the Authority with accurate, up-todate contact information.
19.Bill Adjustment Due to Leak.
Customer can qualify for an adjustment for leaks. The Customer must submit a “Customer Account Adjustment” form and meet all the qualifications to be eligible for an adjustment.
For the purposes of this policy, a leak may be defined as a gradual loss of water due to device malfunctions or a compromised water supply.
An adjustment can be made on an account once every two (2) years due to a leak for three (3) months of high bills (this does not include billing or internal errors).
The adjustment is made by moving the consumption from the higher tier(s) into tier 2 at a lesser rate. If a customer account has consumption history that is normally in Tier 1, then the adjustment will be made at the Tier 1 rate.
A credit adjustment request for a leak must be made by filling out the Customer Account Inquiry Form (Attachment 4) and the leak must be repaired within 60 days of discovery. Customer must show proof of repair and must not be on the IWA leak report, or show that consumption has decreased and is now consistent with the average consumption on the account.
20. Other Adjustments
Customers requesting an adjustment for all other IWA fees (See the Residential and Commercial Rates and Service Fees) will be reviewed on a case-by-case
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 602 of 1774 July 2, 2025 Page 22
basis by the Executive Director of the Authority or his/her appointed designee and upon request, IWA will only adjust an IWA fee once every two (2) years.
Tampering fees are NEVER adjusted, unless approved by the Executive Director of the Authority or his/her appointed designee.
1. A water establishment fee is NEVER waived or adjusted as that is a nonrefundable establishment fee to set up the account.
2. Deposits are waived based on credit history.
3. Fees or charges caused by error in billing are internally adjusted and do not count towards the two (2) year credit adjustment.
4. All other adjustments are made on a case-by-case basis by the Executive Director of the Authority, or his/her appointed designee.
5. If the Authority has billed a customer in error, and the error is in the favor of the Authority, upon discovery the Authority will refund the overcharge, based on the corrections, for up to three years that the service has been provided.
6. If the Authority has billed a customer in error, and the error is in the favor of the customer, upon discovery the Authority will bill the undercharge, based on the corrections, for up to one year that the service has been provided.

Policy on Discontinuation of Residential Water Service for Nonpayment on a cumulative balance. A payment arrangement on a previously delinquent balance will not remove late fees already charged.
3. Small Balance Accounts: Any balance on a bill of $15 or less may be carried over, and added to, the next billing period without being assessed a late fee or incurring further collection action.
4. Waiver of Late Fee: IWA will waive the delinquency charge once every twelve (12) months automatically; no action is required from a customer for the waiver.
II. Policy Provisions to Avoid Discontinuation of Service Due to Non-Payment (Health & Safety Code § 116906)
1) Alternative Payment Arrangements: Any customer who is unable to pay for water service within the normal payment period may request an alternative payment arrangement to avoid discontinuation of service. IWA shall not discontinue water service for nonpayment if a customer has requested and entered into an alternative payment arrangement.
a) Time to Request an Alternative Payment Arrangement: A customer may request alternative payment arrangement within ten (10) calendar days of the date of the written notice of discontinuation of service. Such request will be reviewed by the Manager of Finance and Customer Service. IWA decisions regarding alternative payment arrangements are final and are not subject to appeal to the City Council.
b) Alternative Payment Plan: Payment arrangements that extend into the next billing period are considered an alternative payment plan, which must be in writing and signed by the customer. A down payment of twenty percent (20%) of the customer’s outstanding balance will be due at the time of signing. The alternative payment plan will spread the remaining unpaid balance over a period not to exceed twelve (12) months from the original date of the bill. The monthly payments will be combined with, and subject to the due date of the customer’s regular bill. The customer must comply with the terms of the payment plan and remain current as charges accrue in each subsequent billing period. The customer may not request further payment “amortization” of any subsequent unpaid charges while paying delinquent charges pursuant to a payment plan.
In the case of extreme hardships, the General Manager may authorize an extended payment plan to allow the customer/user a chance to deal with the hardship while making steady payments to the Authority. In these very rare cases, the General Manager, in consultation with the Manager of Finance and Customer Service will determine the length of the payment arrangement and a suitable amount as well.

Policy on Discontinuation of Residential Water Service for Nonpayment c) Failure to Comply: The customer must comply with the terms of alternative payment arrangements and remain current as charges accrue in each subsequent billing period. Failure to comply with the terms will result in the issuance of a written discontinuation notice and termination of service after five (5) business days of such notice. The final notice will not entitle the customer to any further investigation or review by IWA. 2) Formal Mechanism to Contest or Appeal a Bill: Customer/user may initiate an inquiry or request an investigation relating to billed charges by presenting their inquiry or request to IWA via a Customer Appeal Form. Customer Appeal forms are available on the IWA website or may be obtained at the Customer Service counter during normal business hours.
Any customer/user who has requested an investigation, or who has made a request for extension of the payment period of a bill asserted to be beyond the means of the customer/user to pay in full during the normal period for payment, will be given an opportunity for review by the General Manager or designee. Water service shall not be discontinued while an account review or appeal is pending. a) Time to Initiate Complaint or Request an Investigation: A customer may initiate a complaint or request an investigation in writing regarding the amount of a bill within fifteen (15) calendar days of receiving the bill. For the purposes of this section, a bill shall be deemed received by a customer seven (7) calendar days after mailing.
b) Review and Determination by IWA: A timely complaint or request for investigation shall be reviewed by the Manager of Finance and Customer Service or designee, who shall provide a written determination to the customer. The review may include consideration of whether the customer/user will be permitted to amortize the unpaid balance of the account over a reasonable period of time. The General Manager will provide final review and consideration of all issues, investigations and requests made in accordance with this subsection, and the determination will be final. 3) Customer Service Contact Phone Number: Please call Customer Service at (760) 391-4038 to discuss options for averting discontinuation of residential water service for nonpayment.
4) Medical Provision: Service will not be terminated for nonpayment if the Customer, or a tenant of the Customer, demonstrates that he or she is financially unable to pay within the normal billing cycle, enters into an alternative payment plan with respect to all delinquent charges and submits a certification from a primary care provider, as defined in Welfare and Institutions Code Section 14088(b)(1)(A), that the discontinuation of water service would be life threatening or pose a serious threat to the health and safety of a resident of the premises.

Policy on Discontinuation of Residential Water Service for Nonpayment a) Service may be terminated regardless of a medical provision exception if notice of disconnection is posted in a prominent and conspicuous location at the property at least five (5) business days prior to the termination date and either (i) Customer fails to comply and is at least 60 days delinquent on the alternative payment plan; or (ii) Customer fails to pay current residential service charges for 60 days or more while participating in an alternative payment plan.
PROCEDURES TO IMPLEMENT POLICY
III. Discontinuation of Water Service for Nonpayment (Health & Safety Code § 116908) If a bill is delinquent for at least sixty (60) calendar days, IWA may discontinue water service to the service address following the procedures outlined below. 1) Delinquent Notice (First Notice/Past Due Reminder): Upon a bill becoming delinquent, IWA shall give the person or entity responsible for payment of the bill (hereinafter referred to as “Customer”) a notice of delinquency by mail. The notice will be issued on Day 29 to allow for the processing of payments received on the 25th day after the bills were issued. This notice is not required by SB 998; it is IWA’s courtesy past due reminder.
2) Intent to Disconnect (Second Notice): This is the first formal notice required by SB 998. IWA will provide a mailed notice to the customer of record at least fifteen (15) calendar days before discontinuation of service. If the mailing address and the address of the property to which water service is provided are different, a second notice will be mailed to the service address and addressed to “Occupant”.
The written notice will include in a clear and legible format:
i) Customer’s name and address.
ii) Amount that is past due.
iii) Date by which payment or arrangement for payment is required in order to avoid discontinuation of residential service.
iv) Description of the process and procedure by which a customer may request an alternative payment plan to pay the delinquent charges. v) Description of the procedure to petition for bill review and appeal. vi) Customer Service phone number and a web link to this policy.
Special Notices:
a) Notice to Residential Tenants/Occupants in an Individually Metered Residence IWA will make a reasonable, good faith effort to inform the occupants, by means of written notice, when the water service account is in arrears and subject to disconnection at least fifteen (15) days before water service is shut off.
Report of Fee Structure changes to the Indio Water Authority Customer Se... Page 612 of 1774
Policy on Discontinuation of Residential Water Service for Nonpayment The written notice will advise the tenant/occupant they have the right to become customers of IWA without being required to pay the amount due on the delinquent account, as long as they are willing to assume financial responsibility for subsequent charges for water service at the address.
In order for the amount due on the delinquent account to be waived, the tenant/occupant must provide verification of tenancy in the form of a rental agreement, proof of rent payments or other legal document. b) Notice to Tenants/Occupants in a Multi-Unit Complex Served through a Master Meter
IWA will make a reasonable, good faith effort to inform the occupants, by means of written notice hung on the door of each residence, when the water service is in arrears and subject to disconnection at least fifteen (15) days before water service is shut off.
The written notice shall further inform the residential occupants that they have the right to become IWA customers, to whom the service will then be billed, without being required to pay any amount which may be due on the delinquent account, as long as they are willing to assume financial responsibility for subsequent charges for water service at the address(es) served by the master meter.
If one or more of the occupants are willing and able to assume the responsibility for the subsequent charges for water service to the satisfaction of IWA, or if there is a physical means, legally available to IWA, of selectively terminating service to those occupants who have not met the requirements for service, IWA will make service available to the occupants who have met those requirements.
If an adult at the residence appeals the water bill to IWA, IWA will not discontinue residential service while the appeal is pending.
3) Posting of Notice at Service Address (Third Notice): If the written disconnection notice is returned through the mail as undeliverable and IWA is unable to make contact with the customer or an adult occupying the residence by telephone, IWA will make a reasonable, good faith effort to visit the residence and leave in a conspicuous place a notice of discontinuance for nonpayment at least seven (7) business days before discontinuation of service.
IV. Circumstances under Which Service Will Not Be Discontinued (Health & Safety Code § 116910)
IWA will not discontinue residential water service for nonpayment under the following circumstances:

b) If a public health or building officer certifies that termination would result in a significant threat to the health or safety of the residential occupants or the public.
c) If one or more of the occupants are willing and able to assume the responsibility for the subsequent charges for water service to the satisfaction of IWA, or if there is a physical means, legally available to IWA, of selectively terminating service to those occupants who have not met the requirements for service, IWA will make service available to the occupants who have met those requirements.

4. Reestablishment of Service After Business Hours: Service restored after 5:00 p.m.
Monday through Friday, weekends, or holidays will be charged an after-hours reestablishment fee. Service will not be restored after regular business hours unless the customer has been informed of the after-hours reestablishment fee and has signed an agreement acknowledging the fee.
5. Returned Payments: If a residential customer/user issues a payment to avoid water service termination and that payment is later returned by the bank/financial institution, IWA may terminate service upon giving a five (5) business day notice to the customer/user.
VI. Special Programs for Low-Income Customers
1. Reconnection Fee Limits and Waiver of Interest: SB 998 requires IWA to set limits on reconnection fees and waive interest on delinquent bills once every 12 months for customers whose household income is below 200 percent of the federal poverty line. SB 998 limits the reconnection fee to $50 for reconnection during normal operating hours, and $150 for reconnection during nonoperational hours, but not to exceed the actual cost of reconnection if it is less. However, IWA does not charge interest and will apply the following reconnection limits and waiver of fees to all customers, regardless of income.
a) IWA will charge the actual cost of reconnection up to the limit allowed by SB 998. The limits are subject to an annual adjustment for changes in the Bureau of Labor Statistics’ Consumer Price Index for All Urban Consumers (CPI-U) beginning January 1, 2021.
b) Waive the late fee on delinquent bills once every twelve (12) months. IWA will apply the waiver to any late fees that are unpaid at the time of the waiver.
VII. Other Remedies. In addition to the discontinuation of service, IWA may pursue other remedies available in law or equity for nonpayment of water service charges, including, but not limited to: securing delinquent amounts by filing liens on real property, filing a claim or legal action, or referring the unpaid amount to collections.

STAFF REPORT
To: City Council
From: Bryan H. Montgomery, City Manager
Prepared by: Brian Tully, Chief of Police
Conflict: No
Subject: Accept a Fiscal Year 2026 California Highway Patrol (CHP) grant under the Cannabis Tax Fund Grant Program (CTFGP) in the amount of $186,342 and Adopt Resolution No. 10508 designating and authorizing the City Manager or his designee to execute all necessary grant documents on behalf of the City of Indio.
RECOMMENDATION:
Staff recommends that the City Council accept a Fiscal Year 2026 Cannabis Tax Fund Grant Program (CTFGP) from the California Highway Patrol (CHP) in the amount of $186,342; adopt Resolution No. 10508 designating and authorizing the City Manager or his designee to execute all necessary grant documents on behalf of the City of Indio, and direct the Finance Department to adjust appropriations and estimated revenue as reflected in the financial details section of this staff report.
SUMMARY:
The Indio Police Department was awarded $186,342 for Fiscal Year 2026 by the California Highway Patrol to support impaired driving enforcement efforts. The grant award funds overtime for enforcement activities, travel expenses for advanced DUI enforcement training, equipment, and supplies for the enforcement of impaired driving.
BACKGROUND INFORMATION:
California voters passed the Control, Regulate, and Tax Adult Use of Marijuana Act (Proposition 64) in 2016, which allowed for the recreational use and personal cultivation of cannabis. Among the regulatory components of Proposition 64 is a specific earmark for the California Highway Patrol (CHP) to award competitive grants to local governments, aimed at increasing enforcement efforts to address impaired driving, with the ultimate goal of reducing impaired driving accidents.
The Indio Police Department was awarded $186,342 to support enforcement activity and advanced training. This funding will support the Department's Traffic Unit efforts in enforcing impaired driving and also provide the opportunity to purchase more equipment and supplies. This grant is in addition to a $127,626 grant award within the same program, which will focus on community engagement around the dangers of impaired driving.
