1. ENDANGERED SPECIES ACT SPECIES
There is a total of 7 threatened, endangered, or candidate species on this species list.
Species on this list should be considered in an effects analysis for your project and could include species that exist in another geographic area. For example, certain fish may appear on the species list because a project could affect downstream species.
IPaC does not display listed species or critical habitats under the sole jurisdiction of NOAA Fisheries , as USFWS does not have the authority to speak on behalf of NOAA and the Department of Commerce.
See the "Critical habitats" section below for those critical habitats that lie wholly or partially within your project area under this office's jurisdiction. Please contact the designated FWS office if you have questions.
NOAA Fisheries, also known as the National Marine Fisheries Service (NMFS), is an office of the National Oceanic and Atmospheric Administration within the Department of Commerce.

CULTURAL RESOURCES RECORDS SEARCH
The California Office of Historic Preservation (OHP) contracts with the California Historical Resources Information System’s (CHRIS) regional Information Centers (ICs) to maintain information in the CHRIS inventory and make it available to local, state, and federal agencies, cultural resource professionals, Native American tribes, researchers, and the public. Recommendations made by IC coordinators or their staff regarding the interpretation and application of this information are advisory only. Such recommendations do not necessarily represent the evaluation or opinion of the State Historic Preservation Officer in carrying out the OHP’s regulatory authority under federal and state law.
The following are the results of a search of the cultural resource files at the Southern San Joaquin Valley Information Center. These files include known and recorded cultural resources sites, inventory and excavation reports filed with this office, and resources listed on the National Register of Historic Places, the OHP Built Environment Resources Directory, California State Historical Landmarks, California Register of Historical Resources, California Inventory of Historic Resources, and California Points of Historical Interest. Due to processing delays and other factors, not all of the historical resource reports and resource records that have been submitted to the OHP are available via this records search. Additional information may be available through the federal, state, and local agencies that produced or paid for historical resource management work in the search area.
PRIOR CULTURAL RESOURCE STUDIES CONDUCTED WITHIN THE PROJECT AREA AND THE ONE-HALF MILE RADIUS
According to the information in our files, there have been no previous cultural resource studies completed within the project area. There have been three studies completed within the one-half mile radius:
FR-00135, 02287, and 02452.

RE: MITIGATED NEGATIVE DECLARATION FOR TRACT NO. 6499 DATED OCTOBER 22, 2025, STATE CLEARINGHOUSE NUMBER 2025101065 Dear Holly Owen,
The Department of Toxic Substances Control (DTSC) reviewed the Mitigated Negative Declaration (MND) for Tract No. 6499 (Project). Crown Construction and Development Inc. has proposed a Tentative Subdivision Map (TSM) on APN 394-021-42, a parcel of approximately 15.03 acres in size. The proposed TSM would subdivide the subject property into 44 single family residential lots, ranging from 7,000 to 12,800 square feet in size. Additionally, the proposed Project would develop a neighborhood park.
DTSC recommends and requests consideration of the following comments:
1. When agricultural crops and/or land uses are proposed or rezoned for residential use, several contaminants of concern (COCs) can be present. The Lead Agency shall identify the amounts of Pesticides and Organochlorine Pesticides (OCPs) historically used on the property. If present, OCPs requiring further analysis are dichloro-diphenyl-trichloroethane, toxaphene, and dieldrin. Additionally, any level of arsenic present would require further analysis and sampling and must meet approved local area baselines or thresholds. If they do not, remedial action must take place to mitigate them below those thresholds. Additional COCs may be Holly Owen

found in mixing/loading/storage areas, drainage ditches, farmhouses, or any other outbuildings and should be sampled and analyzed. If smudge pots had been routinely utilized, additional sampling for Polycyclic Aromatic Hydrocarbons and/or Total Petroleum Hydrocarbons may be required. These recommendations should be adhered to and become part of the environmental document. Please refer to the DTSC’s Human and Ecological Risk Office (HERO) webpage for the most recent guidance and screening levels.
2. All imported soil/fill material should be tested to assess any contaminants of concern meet screening levels as outlined in DTSC's PEA Guidance Manual.
Additionally, DTSC advises referencing the DTSC Information Advisory Clean Imported Fill Material Fact Sheet if importing fill is necessary. To minimize the possibility of introducing contaminated soil/fill material, there should be documentation of the origins of the soil/fill material and, if applicable, sampling be conducted to ensure that the imported soil/fill material are suitable for the intended land use. The soil sampling should include analysis based on the source of the soil/fill and knowledge of prior land use.
DTSC would like to thank you for the opportunity to comment on the MND for Tract 6499. Thank you for your assistance in protecting California’s people and environment from the harmful effects of toxic substances. If you have any questions or would like clarification on DTSC’s comments, please respond to this letter or via our CEQA Review email for additional guidance.
Sincerely,
Dave Kereazis

Tract No. 6499 IS/MND
INTRODUCTION
The following are the City of Kingsburg’s responses to comments received during the public review period for the IS/MND SCH No. 2025101065, dated October 2025, prepared for the Tract No. 6499 Project. The Notice of Intent to adopt an IS/MND was circulated for public review from October 22, 2025, through November 11, 2025. One (1) comment letter was received during the public review period: one (1) from the California Department Toxic Substances Control, dated October 24, 2025.
Additionally, an email was received from the State Water Resources Control Board on November 4, 2025, the dedication of Outlot C of the subdivision to the City for well facilities. The City responded that the Project will not be constructing a new well, nor is a new well required to serve the Project, the City’s existing demand, or future development in the near term as the City currently has adequate water supply to serve these demands. The dedication of Outlot C to the City for well facilities allows the City to obtain property for facilities in the future without acquiring it with the use of public funds. When the need arises for a new well based on demand within the City, the City will provide additional CEQA and NEPA analysis, if required, for the well project. The dedication of the Outlot to the City “in fee” also allows the City to develop the site for other public facilities, should the site need to be develop to serve the public in another manner. The State Water Resources Control Board responded that they would not have discretionary approval for this Project, and therefore no comment letter is needed by their agency.
Comments received during the public review period did not result in changes to the IS/MND. Although comments included recommendations and suggestions, no new unavoidable significant effects were identified, and mitigation measures were not replaced with equal or more effective mitigation measures as a result of responding to comments. Pursuant to CEQA Guidelines Section 15073.5, the IS/MND has not been substantially revised after public notice of its availability and therefore does not require recirculation.

Response to Comments
1 COMMENT LETTER A – CALIFORNIA DEPARTMENT OF TOXIC
SUBSTANCES CONTROL (OCTOBER 24, 2025)
COMMENT A/1
Commentor States: When agricultural crops and/or land uses are proposed or rezoned for residential use, several contaminants of concern (COCs) can be present. Additional COCs may be found in mixing/loading/storage areas, drainage ditches, farmhouses, or any other outbuildings and should be sampled and analyzed.
RESPONSE A/1
Comment noted. No contaminants of concern are known to exist on the Project site. Via correspondence with the applicant/developer on October 24, 2025, the applicant/developer confirmed that the Project site’s soil has been previously tested. The applicant/developer is required to conform to all local, State, and federal requirements for soil testing on reporting prior to construction of the Project. Additionally, the applicant/developer is required to prepare a Stormwater Pollution Prevention Plan and is required to meet the requirements of the National Pollutant Discharge Elimination System, ensuring that discharge of pollutants and any potentially contaminated soil that has not yet been identified is captured in a way that minimizes environmental impacts.
COMMENT A/2
Commentor States: All imported soil/fill material should be tested to assess any contaminants of concern meet screening levels as outlined in DTSC's PEA Guidance Manual.
RESPONSE A/2
Comment noted. The project applicant/developer does not anticipate the need for any fill material to be utilized for the Project. In the unlikely event that import material is required by the Project, the applicant/developer will import such material in a manner that satisfies all local, State, and federal requirements, including testing the imported material, if necessary.

CHAPTER 5 MITIGATION, MONITORING, AND REPORTING
PROGRAM
This Mitigation Monitoring and Reporting Program (MMRP) has been formulated based upon the findings of the IS/MND for the Project in the City of Kingsburg. The MMRP lists mitigation measures recommended in the IS/MND for the Project and identifies monitoring and reporting requirements.
Table 5-1: Mitigation, Monitoring, and Reporting Program presents the mitigation measures identified for the Project. Each mitigation measure is numbered with a symbol indicating the topical section to which it pertains, a hyphen, and the impact number. For example, AIR-2 would be the second mitigation measure identified in the Air Quality analysis of the IS/MND.
The first column of Table 5-1: Mitigation, Monitoring, and Reporting Program identifies the mitigation measure. The second column, entitled “When Monitoring is to Occur,” identifies the time the mitigation measure should be initiated. The third column, “Frequency of Monitoring,” identifies the frequency of the monitoring of the mitigation measure. The fourth column, “Agency Responsible for Monitoring,” names the party ultimately responsible for ensuring that the mitigation measure is implemented. The last columns will be used by the Lead and Responsible Agencies to ensure that individual mitigation measures have been complied with and monitored.

(Swainson’s Hawk and Nesting Bird Preconstruction Surveys) If activities must occur within the nesting bird season (February 1 to September 15), a qualified biologist (someone familiar with these species and nesting birds) will conduct a single pre-construction take-avoidance survey for Swainson’s hawk nests on the site and within a 0.5-mile radius outside of the site within seven (7) calendar days prior to the start of construction. The Swainson’s hawk survey must not be completed between April 21 to June 10 due to the difficulty of identifying nests during this time of year. The survey shall also include inspecting for nesting migratory birds within the site and up to 100 feet outside of the site and for nesting raptors within the site and up to 500 feet outside of the site. All raptor nests shall be considered “active” upon the nest-building stage. If no active nests are observed, no further mitigation is required.

Key Benefits
Tract Maps: Clear legal boundaries and infrastructure
layout- law is narrow as to complete applications,
requirements. If requirements are met, there are
restrictions as to response time/allowed changes
PUDs: Flexible design, efficient land use, preservation of amenities. NKSP is our base document, which allows us
to require specific items (alleys, lot size, connectivity, etc.)
Current Project: Crown Subdivision
• 44 Lots on site of previously approved parcel
• Originally approved in 2005. Market factors impacted
development. State legislation preserved tract maps.
• Council rescinded original allocations & property was sold. • New/Current owner quickly followed all requirements:
• Reapplied and was awarded allocations (2024)
• Map layout mimics what was originally approved in 2005. • Site Plan Review comments accepted
• Environmental Document
• Rapid turnaround of engineering plans
Current Project: Crown Subdivision
• Located west of 10th Ave/South of Kamm Ave; west and north of existing developments (Kings Crossing & Century Communities) • SFR lots range from 7,000 square feet (SF) in size, to 12,800 SF in size.
• Floor plans within the subdivision would range from 1,900 SF to 2,500 SF in size, and all models are single story.
• Includes alley-loaded plans per NKSP.
• Includes green/open space; dedicated park amenities served by existing Veteran’s Park.
• Will participate in Community Facilities District
Current Project: Crown Subdivision
• If PUD is approved by Council, building permits will be issued after all plans (final site plan, infrastructure) are approved (plan check)
• Council will consider the final map and development
agreement after all plans are approved
Current Project: Crown Subdivision
• An Initial Study/Mitigated Negative Declaration was prepared for the project and was available for public comment during the circulation period (October 22-November 11, 2025).
• Planning Commission reviewed and recommended approval at their November 13, 2025 meeting.
Recommendations:
1. Adopt Resolution 2025-066, approving the Initial Study/Mitigated Negative Declaration and the Mitigation Monitoring Program for a 44- lot single-family residential project on APN 394-021-42.
2. Adopt Resolution 2025-067 affirming the Planning Commission approval of the Planned Unit Development (PUD 2025-01) for the project, which involves single-family residential uses and associated open space features.
