RESOLUTION NO. 2025-
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA PALMA CALIFORNIA,
AMENDING THE FEE SCHEDULES
BY ADJUSTING AND ADDING USER FEES
WHEREAS, the City provides, maintains and operates a variety of programs and services for the public; and
WHEREAS, state law and provisions of the City of La Palma City Code authorize the collection of fees to defray the costs of providing certain City programs and services; and WHEREAS, for the convenience of the public, it is desirable to gather in a single document a comprehensive list of fees and service charges imposed by the City for City programs and services; and WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City is authorized to adopt and implement fees, rates, and charges for municipal services provided that such fees, rates and charges do not exceed the estimated reasonable cost of providing such services; and,
WHEREAS, the City of La Palma has conducted an extensive and exhaustive analysis of its services, the costs reasonably borne of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and, WHEREAS, in November of 2024, the City engaged Revenue Cost Specialists (RCS) to conduct an independent Cost Allocation Plan and Citywide Fee Study to determine the appropriate costs for service fees. In August 2025, the Cost Allocation Plan and Citywide Fee Study was completed, which included a thorough analysis of the total cost of providing services, including applicable direct and indirect costs associated with specific services, a copy of which is maintained on file with the City Clerk; and,
WHEREAS, the City Council has reviewed the proposed fees and found them adequate to recover actual costs plus overhead related to the provision of the specific service.
NOW, THEREFORE, the City Council of the City of La Palma does hereby resolve as follows:
SECTION 1. Adoption of Recitals. Based upon all evidence provided, the City Council hereby finds that the new and the amended fees set forth in Exhibit “A,” Schedules No. 1, 2, 3, 4, and 5 of the Fee Schedule attached hereto and incorporated herein by reference, will not exceed the estimated reasonable cost of providing the services for which the fees are charged.
SECTION 2. Adoption of Schedule of Fees. The City Council hereby adopts the Amended Fee Schedule, and authorizes the collection of the fees set forth therein. In addition, the City Council authorizes the collection of the direct costs associated with the processing of credit card transactions.
SECTION 3. This Resolution supersedes all prior resolutions concerning the same fees specified in the exhibit hereto.
SECTION 4. Environmental Exemption. The City Council finds that the adoption of this Resolution does not constitute a project for purposes of the California Environmental Quality Act, and, therefore, no environmental assessment is required.
SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Resolution is, for any reason, held to be invalid by a final judgment of a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have adopted this Resolution, and each section, subdivision, sentence, clause, phrase, or portion of this Resolution irrespective of the fact that one or more provisions may be declared invalid.
SECTION 6. Effective Date. The fees in the resolution shall become effective on January 1, 2026.
APPROVED AND ADOPTED by the City Council of the City of La Palma at a regular meeting held on the 7th day of October 2025.
