located at 24401 Calle De La Louisa. Deviations are requested from the standards set forth in Laguna Hill Municipal Code Chapter 9-42 (the “Sign Ordinance”), for the monument sign (identified as ST-01-01 in the MSP) and the three building identification wall signs (identified as ST-11-01, 02, and 03 in the MSP), as follows:
• The Sign Ordinance limits monument signs to a maximum height of 4 feet. The proposed monument sign is 7 feet tall.
• The Sign Ordinance limits wall signage to a total maximum of 150 square feet per business. The total proposed sign area of the three wall signs is 336.61 square feet.
• The Sign Ordinance limits wall signs to a maximum of one square foot of sign area per lineal foot of building frontage. The proposed west elevation (facing Health Center Drive) wall sign exceeds this requirement by 45.63 square feet.

The Planning Agency may grant deviations from the Sign Ordinance standards based on design quality, creativity, and compatibility of the signage with the building architecture and surrounding land uses. As detailed herein, the proposed MSP’s monument sign and three wall signs are high quality and are compatible with building’s architecture.

The proposed MSP is consistent with the General Plan’s goals and strategies.

Furthermore, the proposed MSP complies with the City of Laguna Hills Development Code, subject to approval of the requested deviations. Therefore, staff recommends approval of Site Development Permit/Master Sign Program (SDP/MSP) No. USE-0126-2023.

AUTHORITY:

Title 9 of the Laguna Hills Municipal Code (LHMC) contains the City of Laguna Hills Development Code (also commonly referred to as the “Zoning Code” or “Code”). The Code provides the requirements for signs and advertising devices in Chapter 9-42, including thresholds for when an MSP is required (LHMC 9-42.160(A)). The process the City must follow in reviewing MSPs is found in Chapter 9-42 and Chapter 9-92 of the Code. The Planning Agency has review authority over the proposed MSP through the City’s SDP/MSP process in accordance with Table 9-92.030 of the Code. The findings for an MSP are found in Sections 9-92.080 (G) and (H) of the Code. If a sign in a proposed MSP deviates from the standards contained in the Sign Standards Matrix located in Table 9-42.090, the Planning Agency may grant a deviation based on design quality,

creativity, and compatibility of the signage with the building architecture and surrounding land uses (LHMC 9-42.180). Moreover, the Project Site is located within the Village Commercial (VC) zoning district. Staff has prepared findings demonstrating that the proposed MSP complies with the Zoning Code, VC zoning district, the Urban Village Specific Plan and the General Plan as stated in the Proposed Resolution (Attachment “A”), and based on these findings recommends approval of the MSP.

BACKGROUND:

The Project Site was approved as a ‘commercial/office/retail’ building by the Orange County Planning Commission in November 1981 (UP 81-42P/SP 81-41P). The Project Site consists of a three-story building and associated surface parking. The parking structure and three (3) two-story buildings comprise the rest of the Project Site. The two-story buildings are attached to the northern end of the parking structure.

In 2022, the City of Laguna Hills Planning Agency approved SDP No. USE-0072-2021, MemorialCare’s new Women’s Health Pavilion. This approval consisted of demolition of the existing three-story building and construction of a new medical building, redesigned parking lot, courtyard, and various hardscape and landscape improvements. Permits have been issued and the project is currently under construction.

PROPOSAL & ANALYSIS:

The Applicant requests approval of an MSP for signage related to the new MemorialCare Women’s Health Pavilion project. The City’s Sign Ordinance (LHMC Chapter 9-42) requires an MSP for any new single enterprise which proposes three or more signs.

The proposed MSP is designed with a modern appeal that blends in with the new health pavilion’s architecture, while contrasting in a unique, creative way through the application of attractive colors and materials compatible with new building architecture.

The proposed MSP includes three new building identification wall signs, two wall address identification signs, one monument sign, one parking entrance identification sign for the Women’s Health Pavilion. The proposed MSP will also include existing business’ signs located along Calle De La Louisa as well as a new business wall sign.

Sign Locations
Looking at the elevations (Attachment B, Sheet SG501), both the north elevation (facing Calle De La Louisa) and the west elevation (facing Health Center Drive), are each

proposed with a wall sign located towards the upper left corner of the elevations, above the third-story windows, and an address sign located toward the lower right corner of the elevations, at the ground level. The south elevation, visible from Health Center Drive but directly facing the surface parking lot, includes a wall sign located at the ground level.

The monument sign is proposed within a landscape strip located between Health Center Drive and the surface parking lot. Additionally, the MSP includes a parking identification sign mounted above the parking structure entrance. Sheet SG001 of the proposed MSP (Attachment “B”) describes the size and location of all proposed signs.

Deviations from Code
The proposed MSP includes three deviations from the Zoning Code; for the proposed monument sign (identified as ST-01-01 in the MSP) and proposed building identification wall signs (Identified as ST-11-01, 02, and 03 in the MSP). For signs in a proposed MSP that deviate from applicable Zoning Code standards (provided in Table 9-42.090), the Planning Agency has authority to allow the deviation based on design quality, creativity, and compatibility of the signage with the building architecture and surrounding land uses (LHMC 9-42.180). The table below breaks down the requested deviations:

Sign Type Code Requirement Proposed Deviations
West Elevation Wall
Sign Area

336.61 s.f.

Exceeds max by 186.61 s.f.

Wall Signs
The proposed building identification wall signs will be located along the North, South and West elevations of the new medical building, one wall sign per elevation. The signs will be visible from Calle De La Louisa and Health Center Drive, and will feature the MemorialCare name and logo, the donor name and Women’s Health Pavilion identification.

LHMC Table 9-42.090 limits total wall signs to a maximum of 150 square feet per

business. The Code also limits individual wall sign size to one square foot per lineal foot.

The Code’s objectives in limiting wall signage per business and wall sign size is to ensure that signs are designed and constructed proportionally with the wall area and building façade. Due to the large scale of the new medical building, the proposed signs that deviate from sign code maintain compatibility with the pavilions architecture and are oriented to be proportional to the wall area.

Monument Sign
The proposed Monument Sign is designed with a variety of materials to create a threedimensional presentation of tenant and building identification information. The Monument Sign resembles the shape of and “L” as shown below in Figure No. 1- Site Plan.

Figure No. 1- Site Plan
The proposed monument sign will replace the existing monument in the same location and add a new segment parallel to Health Center Drive. The portion of the monument sign that is parallel to the street, Health Center Drive, will feature the donor name and street address number. The portion of the monument sign facing parallel to Calle De La Louisa will feature a dual face cabinet with the MemorialCare Saddleback Medical Center logo and branding. Importantly, the monument sign complies with the Sign Code requirement for a maximum of 40 square-feet of sign area.

One of the Code’s objectives in limiting monument sign height is to eliminate potential

hazardous visual obstructions to vehicle, bicycle and pedestrian traffic, known as “sight vision area” (LHMC 9-40.160). Generally, this Code section applies to monument signs located alongside the public right of way and driveway entrances and exits. The proposed monument sign is not a hazard affecting the driveway’s sight vision area since the monument sign is not located within the 15-foot corner cut off area and is approximately seven feet behind the face of the curb.

CONCLUSION:

Staff supports the proposed MSP, as conditioned, including the deviations from the Sign Ordinance’s standards for the monument sign and wall signs. The project site’s approved layout appropriately accounts for the location and size of signage needed to serve the approved development. For example, the monument sign is located within generously-landscaped areas. The monument sign is also located outside of required sight-distance areas required by the Development Code. The signs are designed with a modern appeal that complements the building’s architecture, while contrasting in a unique, creative way through the application of attractive colors and materials compatible with building architecture. The proposed MSP complies with all other requirements of the Code, Village Commercial zoning District, the UVSP development standards and General Plan. Therefore, staff recommends approval of Site Development Permit/Master Sign Program (SDP/MSP) No. USE-0126-2023.

PUBLIC NOTICE:

A total of 24 public hearing notices were mailed, including all property owners within a 300-foot radius of the subject property. To date, no comments have been received by staff. Due to a clerical error, the public hearing notice for this project was not advertised in an adjudicated newspaper of general circulation on August 10, 2023. Therefore, staff recommends the City Council conduct the public hearing for any members of the public in attendance and continue the hearing to the regular meeting of September 12, 2023, at 7:00 p.m., or as soon thereafter as possible.

CEQA FINDINGS:

Staff has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and determined that this project is categorically exempt from CEQA pursuant to Section 15311 (Class 11, Accessory Structures) of Title 14, Chapter 3 of the California Code of Regulations. The Class 11(a) exemption consists of construction or placement of minor structures accessory to (appurtenant to)

NOW, THEREFORE, THE PLANNING AGENCY OF THE CITY OF

LAGUNA HILLS, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:

SECTION 1. The above recitals are true and correct, and are incorporated herein by reference.

SECTION 2. The Planning Agency hereby determines that the required findings by the City for approval of SDP/MSP No. USE-0126-2022 have been met and made as follows:

Site Development Permit

1. The site design complies with standards of the Development Code.

On April 12, 2022, the Planning Agency approved the development of a new 41,805 square-foot medical office building and related site improvements on the Project Site (USE-0072-2021). The design of the site, as approved by the Planning Agency, complies with the Development Code, and will not be affected by the proposed Master Sign Program.

2. The site is suitable for the proposed development.

The proposed Master Sign Program is for the new 41,805 square-foot medical office building (MemorialCare Women’s Health Pavilion) and related site improvements on a commercial property in the Village Commercial (VC) zoning district and the Urban Village Specific Plan. The proposal is compatible with approved new construction. The site’s approved layout appropriately accounts for the location and size of signage needed to serve approved development. For example, the monument sign is located within a generously landscaped area, and a portion of the monument sign is located on a decorative wall feature approved as part of the original project. The monument sign is also located outside of required sight-distance areas required by the Development Code. Therefore, the subject site is suitable for the proposed project.

3. The project is consistent with the General Plan and applicable design guidelines.

The site is located within the Village Commercial (VC) zoning district and the Urban Village Specific Plan (UVSP). The UVSP Land Use and Development Standards require signage to conform with LHMC Chapter 9-42. The Master Sign Program is consistent with these standards, although the Applicant is requesting to deviate from the Code’s maximum height for monument signs, the Code’s maximum total sign area allowed per business, and the Code’s maximum sign area allowed for one of the three wall signs. This request is made pursuant to Section 9-42.180 of the Development Code, which allows Planning Agency consideration of sign standard deviations through approval of a Master Sign Program. In light of this provision, the proposed Master Sign Program is consistent with the General Plan and applicable design guidelines.

4. The site design and structural components are appropriate for the site and function of the proposed uses.

The Applicant has provided details on how each sign will be safely and securely attached to the building or installed as a free-standing sign. Inspections will be conducted as part of the permitting process to ensure that each sign is attached in accordance with the requirements of the California Building Code. Furthermore, the proposed Master Sign Program will enhance the approved site design by allowing the restaurant tenants the opportunity to advertise their presence at the site and direct traffic safely in and around the site.

Master Sign Program

1. The design and application of the sign criteria required by the Development Code are satisfied by the proposed sign program:

The proposed Master Sign Program complies with the Development Code, including the applicant’s request to deviate from the Code’s maximum height for a monument sign, the Code’s maximum for total sign area per business, and the Code’s maximum sign area for one of the three wall signs. These requests are made pursuant to Section 9-42.180 of the Development Code, which allows deviations approved by the Planning Agency based on design quality, creativity, and compatibility of the signage with the building architecture and surrounding land uses. The proposed signs are designed with a modern appeal that blends in with all the building’s architecture, all while contrasting in a unique, creative way through the application of attractive colors and materials compatible with building architecture. In addition, the scale of the signs is appropriate for, and in proportion with, the new three-story, 41,805 square-foot building. Therefore, the proposed Master Sign Program’s deviation from the Code is warranted and appropriate.

2. The sign program provides a compatible and harmonious design between advertising, landscaping, and building design:

The proposed Master Sign Program establishes a clear differentiation between the approved buildings, while ensuring the signs will be proportionate to the building elevation they are installed on. Finally, the Master Sign Program will allow for one monument sign to help vehicular traffic navigate safely onto the property. A portion of the monument sign is incorporated into a decorative wall feature approved as part of the original project. The monument sign area complies with Sign Code standards. Therefore, the proposed Master Sign Program will provide a compatible and harmonious design between advertising, landscaping, and building design.

NOW, THEREFORE, based upon the above findings, the Planning Agency of the City of Laguna Hills does hereby approve SDPM/MSP NO. USE-0126-2022 subject to the following conditions of approval:

General

ADDITIONAL CITY CODES FOR SIGN CONSTRUCTION
9-42.060 LIGHTING REQUIREMENTS:

All lighting devices on signs, or providing illumination to a sign, shall not create glare, conflict with vehicular traœc, or spill over to adjacent land uses. Except where otherwise specified, signs may be internally or externally illuminated. Internal illumination includes any source from the interior of a sign, behind letters (back lighting), channel lighting, LED or neon, incandescent or fluorescent.

Exterior illumination must be focused to illuminate only the face of the sign. External lighting shall be designed so as not to reflect glare or visually disturb surrounding land uses.

Illumination shall be considered excessive when it prevents the normal perception of buildings or structures beyond or in the vicinity of the sign or when it is disruptive to residential zones or any public or private right-of-way. Internally illuminated signs which use the technique known as “push through” as well as individually illuminated channel lettering or halo lighting are preferred.

Externally illuminated freestanding and monument signs are preferred. The following limitations shall apply to all lighted signs:

A. Except for low intensity, internally illuminated directory or address signs, illuminated signs shall be prohibited in residential and open space zones.

B. Illuminated signs located within one hundred fifty (150) feet of any residential use shall not be illuminated between the hours of ten p.m. and six a.m.

C. Sign illumination shall not result in glare being directed toward surrounding properties or upon abutting streets.

D. Exterior lighting directed at a sign shall be shielded to ensure that the light is projected only upon the sign.

E. Flashing, twinkling, racing, rotating, or changing intensities of light value shall not be permitted on any electrical sign.

F. The intensity of any lighted sign shall not exceed a lumen value of 0.5 footcandles at ten feet from the sign or a maximum of four hundred thirty (430) milliamperes cool-white radiance or as otherwise approved by a master sign program.

G. Lighted signs shall not contain colors or symbols that create confusion or interfere with the observance of traœc safety lights or signage. (Ord. 2011-2 § 1 (Exh. A (part)): Ord. 98-8 § 2 (part): prior code § 9-25.060)
9-42.070 LOCATION OF SIGNS:

Unless otherwise permitted by a master sign program approved under provisions of this chapter, signs shall comply with the following general placement standards:

A. All signs, unless otherwise provided for in this chapter, shall be erected upon the premises or property occupied by the person or business identified by the signs.

B. No sign, except those provided for herein, such as temporary signs for city sponsored special events, holiday decorations, or special civic advertisements, shall be erected in, over, or upon a public right-of-way.

C. Except as provided herein, no sign shall be attached to any public or private utility pole, light standard, item of street furniture, fire hydrant, or similar device except those required by law to regulate the public health, safety, and welfare or as required by any federal or state law or regulation related thereto.

D. Signs should not be placed in such a manner that the visibility of a sign on adjacent properties is obscured as viewed from a public or private right-of-way.

E. Signs shall not be placed in any manner that will interfere with the visibility of traœc safety signs, traœc lights, or the sight vision distance of any intersection whether of two streets or a street and private driveway.

F. All signs shall be securely anchored, attached, or aœxed to the structure, support, or wall to which they are mounted.

G. With the exception of center identification and monument signs, no sign may be placed in any location not designated as part of the buildable area of a lot or parcel of land. No sign shall encroach upon or over the public right-of-way or extend beyond a property line, except as otherwise specified herein. Refer to Section 9-42.220 of this chapter for a discussion of monument sign provisions. (Ord. 98-8 § 2 (part): prior code § 9-25.070) 9-42.080 HEIGHT LIMITS:

Permanent and temporary signs shall meet the limitations of this section.

A. No sign shall extend above the eave line or parapet of the building on which it is located.

B. No sign shall be erected or placed upon the roof of any structure or building.

C. Signage on multiple story buildings shall be restricted to the third story ceiling level and below except for high-rise identification signs which shall not be located above the parapet or roof line upon the wall area above the highest story of the building. Refer to Section 9-42.230 of this chapter for multiple story building signage provisions.

D. Sign height shall be measured from the ground (finished grade) directly below the sign to the highest point of the sign or its supports. Berming above the existing grade solely to enhance the height of any signs, is prohibited. When signs are constructed on hillsides or embankments where the sign supports are at varying lengths, height shall be measured from the horizontal grade at the mid-point of the sign. The height of a sign will be computed as the distance from the base of the sign at grade to the top of the highest attached component of the sign including its support structure when attached to other than a building wall or awning, excluding any filling, berming, mounding, or excavating solely for the purpose of locating the sign.

E. All signs placed adjacent to, suspended above, or over walkways, trails, or pedestrian ways shall have a minimum vertical clearance of eight feet between the bottom of the sign to surface level of the walkway or trail.

F. Any sign authorized by this chapter to be suspended over any public roadway, driveway, alley or other travel way for vehicle use shall have a minimum vertical clearance of fifteen (15) feet between the bottom of the sign and surface of the travel way. (Ord. 98-8 § 2 (part): prior code § 9-25.080)

ISSUE: Introduction and First Reading of a Proposed Ordinance Establishing a Sidewalk Vending Regulatory Program
RECOMMENDATION: That the City Council:
1) Find and determine that the proposed Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment), 15060(c)(3) (the activity is not a project as defined in Section 15378) because it has no potential for resulting in physical change to the environment, directly or indirectly, and Section 15061(b)(3) (there is no possibility that the activity would have a significant negative effect on the environment); and 2) Introduce for first reading, read by title only, and waive further reading of an Ordinance entitled: “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAGUNA HILLS, CALIFORNIA, ADDING NEW CHAPTER 4-48 (SIDEWALK VENDING) TO TITLE 4 (BUSINESS REGULATIONS) OF THE LAGUNA HILLS MUNICIPAL CODE ESTABLISHING A SIDEWALK VENDING REGULATORY PROGRAM”.

SUMMARY:

At its April 11, 2023, meeting, the City Council discussed sidewalk vending and directed staff to research the issue and prepare an ordinance regulating sidewalk vendors operating within the City. Senate Bill 946 severely limits the authority of cities and counties to regulate sidewalk vendors. However, cities may regulate the time, place, and manner to which sidewalk vending is conducted, provided such regulations are directly

related to objective health, safety, or welfare concerns.

The proposed ordinance (Attachment 1) establishes a new Municipal Code Chapter 4-48, Sidewalk Vending, to include criteria for a Sidewalk Vending Permit application process, sidewalk vending location and operational requirements, a permit rescission process, and an appeal process.

BACKGROUND:

The subject of sidewalk vending was placed on the City Council’s April 11, 2023, meeting agenda by Mayor Pro Tempore Dave Wheeler. Following a presentation by the Mayor Pro Tempore, public comments, and City Council discussion, the City Council voted to direct staff and the City Attorney to research and prepare an ordinance regulating street/sidewalk vendors operating within the City in accordance with SB 946.

Senate Bill (SB) 946, signed into law and effective January 1, 2019, severely limits the authority of cities and counties to regulate sidewalk vendors. The proposed ordinance will update the City of Laguna Hills Municipal Code (LHMC) to regulate sidewalk vending, consistent with SB 946, establishing a new LHMC Chapter 4-48 (Sidewalk Vending).

DISCUSSION:

State law defines “sidewalk vendors” to include any person who sells food or merchandise from a pushcart, wagon, or other non-motorized conveyance, or from his or her person, while on a public sidewalk or other pedestrian path. A sidewalk vendor may be “stationary” or “roaming.” Stationary sidewalk vendors are those who operate from a fixed location, while roaming sidewalk vendors move from place to place and stop only to complete a transaction. The statutory requirements apply to both stationary and roaming sidewalk vendors unless otherwise indicated.

California Government Code prohibits cities from adopting regulations that do any of the following:
• Restrict the overall number of sidewalk vendors allowed to operate within the jurisdiction, except if directly related to objective health, safety, or welfare concerns.
• Require sidewalk vendors to obtain the consent or approval of any nongovernmental entity or individual before selling goods or merchandise. • Require sidewalk vendors to operate within specific parts of the public right-of7.2.1 Packet Pg. 207

way, except if directly related to objective health, safety, or welfare concerns. • Require sidewalk vendors to operate only in designated neighborhoods or areas, except if directly related to objective health, safety, or welfare concerns.

However, cities may regulate the time, place, and manner to which sidewalk vending is conducted, provided such regulations are directly related to objective health, safety, or welfare concerns. Permissible regulations, proposed in the new LHMC Chapter 4-48 (Sidewalk Vending) include, but are not limited to, the following:
• Prohibition of stationary sidewalk vendors in all areas zoned exclusively residential and limits on the hours of operation for roaming sidewalk vendors in residential zones from 9 a.m. to 6 p.m.
• Limits on the hours of operation for all sidewalk vendors in nonresidential zones from 8 a.m. to 10 p.m., or the hours of operation imposed on other businesses on the same street.
• Requirements to maintain the area in a clean, orderly and sanitary condition, and to ensure proper disposal of cooking material and waste. • Requirements to prohibit sales of alcohol, marijuana, tobacco, or adult-oriented material.
• Requirements to prohibit vending with persons in moving vehicles or illegally stopped or parked vehicles.
• Requirements to prohibit vendors from obstructing entrances to any buildings, driveways, or parking lots.
• Requirements establishing minimum distances from schools, special events, freeway on-ramps, intersections, other sidewalk vendors, bus stops, fire hydrants, benches, etc.
• Requirements limiting the vending space, including the vendor and any employees, to a maximum area of six feet by six feet, and a maximum cart height of four feet (excepting a sneeze shield and/or an umbrella). • Requirements to ensure compliance with the Americans with Disabilities Act (ADA) and other disability access standards, including maintenance of a minimum clear width of 48 inches of accessible route area for pedestrian travel on sidewalks.

• Prohibition of audible devices including, but not limited to, horns, sirens, megaphones, loudspeakers, amplified music, whistles, or bull horns to attract attention.
• Prohibition of signs that are illuminated, electrical, flashing, or animated.

SB 946 declares that perceived community animus or economic competition are not valid “objective health, safety, or welfare concerns” to justify the imposition of time, place, or manner restrictions. In addition, local authorities are precluded from prohibiting sidewalk vendors in public parks. A limited exception is allowed where a concessionaire has been granted an exclusive concession for the sale of food or merchandise. In such case, the City can only prohibit stationary sidewalk vendors, but must still allow roaming sidewalk vendors. The City may impose additional time, place, and manner restrictions to sidewalk vending in public parks, so long as the restrictions meet at least one of the following criteria:
• They are directly related to health, safety, or welfare concerns. • They are necessary to ensure the public’s use and enjoyment of the park’s natural resources and recreational opportunities.
• They are necessary to prevent an undue concentration of commercial activity that would unreasonably interfere with the park’s scenic and natural character.

Proposed LHMC Section 4-48.040 establishes minimum submittal criteria required for a Sidewalk Vending Permit application that include, but are not limited to, the following:
• A schedule of proposed hours of operations, items of sale, and locations of operation.
• Proof of all required permits from the County Health Dept., as applicable for sale of food or food products.
• A California seller’s permit number.
• A copy of the required encroachment permit issued by the City’s Public Works Department, including indemnification agreement.
• A copy of the required proof of insurance coverage.
• Applicant and employee criminal background check(s).

Sidewalk vendors cannot be cited, fined, or prosecuted for a violation of any rule or regulation that is inconsistent with SB 946. Even where a compliant sidewalk vending

program is in place, cities are precluded from imposing criminal penalties. Instead, violations may be punished with administrative citations in the amounts set forth in Government Code Section 51039. No additional fines, penalties, or other financial conditions may be assessed, including for a failure to pay an administrative fine.

However, following a fourth event violation of a local sidewalk vending regulation, a vendor’s permit can be rescinded, and the vendor shall not be eligible to apply for a new sidewalk vending permit for a period of five years. A vendor’s permit may also be rescinded for good cause, including: falsification of application information or a threat or harm to public health, safety or welfare resulting from sidewalk vending activities.

Once a citation is issued, the City is required to consider the person’s ability to pay the fine and must notify the person of his or her right to request an ability-to-pay determination. Such a request may be made even after he or she has become delinquent, or if his/her income is 125% or less of the current federal poverty guidelines, the City must accept payment of 20% as full satisfaction of the fine. For any citation, the local authority may accept community service in lieu of payment, waive the administrative fine, or offer an alternative disposition.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LAGUNA HILLS, CALIFORNIA, ADDING NEW CHAPTER 4-
48 (SIDEWALK VENDING) TO TITLE 4 (BUSINESS

REGULATIONS) OF THE LAGUNA HILLS MUNICIPAL

CODE ESTABLISHING A SIDEWALK VENDING

REGULATORY PROGRAM

THE CITY COUNCIL OF THE CITY OF LAGUNA HILLS, CALIFORNIA, DOES HEREBY FIND AND DETERMINE AS FOLLOWS:

WHEREAS, the City of Laguna Hills (“City”) is a municipal corporation, duly organized and existing under the California Constitution and laws of the State of California; and
WHEREAS, pursuant to the police powers delegated to it by the California Constitution, the City has the authority to enact reasonable laws which promote the public health, safety, and general welfare of its citizens, including sidewalk vending, as long as the laws are consistent with Senate Bill (“SB”) 946; and WHEREAS, on September 17, 2018, SB 946 was signed into law, which added Chapter 6.2 (commencing with Section 51036) to Part 1 of Division 1 of Title 5 of the California Government Code to regulate sidewalk vendors throughout the state, including within the City of Laguna Hills; and
WHEREAS, SB 946 authorizes the implementation of local sidewalk vending regulations that are directly related to objective health, safety, or welfare concerns, and that do not restrict sidewalk vendors to operate only in a designated neighborhood or area, except as specified; and
WHEREAS, pursuant to SB 946, the City Council seeks to establish a new sidewalk vending regulatory program and to implement sidewalk vending regulations in order to provide a permitting process for sidewalk vendors, as well as to impose reasonable operational requirements for sidewalk vendors in the City in order to protect the public health, safety, and welfare; and
WHEREAS, the City Council finds that, unless properly regulated, sidewalk vending business activities pose a unique risk to the public health, safety, and welfare, including, but not limited to, impacts to the flow of traffic, motorist safety, pedestrian safety, mobility, unsanitary conditions involving improper food handling and preparation, significant risks to children and to individuals with disabilities, and consumer protection; and
WHEREAS, the proposed operational standards imposed on sidewalk vendors requiring a minimum path of accessible travel are necessary to comply with the Americans with Disabilities Act and other disability access standards, and to maintain minimum safe access along public sidewalks; and

1778028.1
WHEREAS, the proposed standards for maintaining access to building entrances, and not blocking driveways, fire hydrants, parking spaces and building windows are necessary to guard the public health and safety of patrons, drivers, vendors and existing business owners and to promote fire suppression and law enforcement practices that allow the City’s first responders to observe activities within buildings and maintain access; and
WHEREAS, prohibiting sidewalk vending within 500 feet of schools is necessary to protect the public health and safety of K-12 school students because if sidewalk vendors operate closer, there is a danger that school children may run into traffic and be injured trying to reach the sidewalk vendor. Furthermore, at the end of each school day when children leave in large numbers at or around the same time, occupying a portion of the sidewalk with vending narrows the available sidewalk area for groups of students to pass, and could cause students to move into the street, subjecting themselves and the occupants of oncoming vehicles to greater risks of injury; and WHEREAS, sidewalk vending in close proximity to building entrances and exits impedes the ability for pedestrians to exit and enter buildings and may create overcrowding situations close to building entrances and exits. Therefore, sidewalk vending close to building entrances and exits require reasonable regulation; and WHEREAS, a portion of the City’s Police Services Department operates out of the Laguna Hills Civic Center, and police personnel and first responders routinely need to quickly exit and enter the Civic Center in order to respond to emergency situations. As such, sidewalk vending in close proximity to the Laguna Hills Civic Center requires reasonable regulation to ensure that law enforcement and other first responders are not impeded; and
WHEREAS, placing restrictions on sidewalk vending in City parks is necessary to ensure the public’s use and enjoyment of natural resources and recreational opportunities, and to prevent an undue concentration of commercial activity that would unreasonably interfere with the scenic and natural character of these parks or an intended specialized recreational use or amenity; and
WHEREAS, sidewalk vendors can have unsupervised direct contact with children because of the inherent nature of sidewalk vending and the ability of sidewalk vendors to be located on public streets and to move quickly from place to place in the community, including residential areas, near City parks, schools, and other places frequented by children. Therefore, the imposition of reasonable regulatory measures, including requiring criminal background checks of all sidewalk vendors, is warranted to protect the public health, safety, and welfare; and
WHEREAS, SB 946 authorizes the City to prohibit sidewalk vendors in areas located within the immediate vicinity of a permitted certified farmers’ market and a permitted swap meet, as specified, and to restrict or prohibit sidewalk vendors within the immediate vicinity of an area designated for a temporary special event permit issued by the City; and

1778028.1
WHEREAS, sidewalk vending in a manner that creates a public nuisance or danger to the public constitutes an objective harm to the public health, safety, and welfare of the City’s residents; and
WHEREAS, requiring sidewalk vendors to be present at all times while food, drink, or merchandise is on display ensures the safety of children, pedestrians, and vehicular traffic by ensuring that the sidewalk and public right-of-way remain unobstructed and sanitary, and helps ensure that the handling of food and drinks remains in compliance at all times with the requirements imposed by the Orange County Health Department; and WHEREAS, prohibiting stationary sidewalk vending and limiting roaming sidewalk vending hours of operation within areas that are zoned exclusively residential to 9:00 a.m. to 6:00 p.m. is consistent with the residential character of neighborhoods and is necessary to protect the safety of sidewalk vendors and City residents who would be more vulnerable to criminal activities during evening hours. This regulation also promotes the welfare of City residents by prohibiting commercial activities and associated noise and traffic during hours when City residents should be able to enjoy peace and quiet within their residential neighborhoods; and
WHEREAS, prohibiting sidewalk vendors from operating within 500 feet from freeway on-ramps and off-ramps will reduce unnecessary or unanticipated slowing of vehicles: (i) approaching freeway on-ramps where vehicular traffic immediately adjacent to the curb and sidewalk is most frequently crowded with vehicles, and (ii) exiting freeway off-ramps where drivers merging into on-coming traffic often have their attention focused in the direction of on-coming traffic and away from the vehicles ahead of them such that unexpected slowing of vehicles ahead is more likely to result in accidents and injuries. Prohibition of sidewalk vending within 500 feet of such areas will reduce the likelihood of such unexpected slowing in those areas and will protect the health, safety and welfare of the sidewalk vendors, customers, pedestrians, bicyclists, and motorists, as it reduces the likelihood of traffic accidents in those critical areas; and WHEREAS, prohibiting sidewalk vendors from using sound amplifying devices, such as bull horns, megaphones, whistles, and noisemakers is necessary to protect the welfare of residents and visitors to the City by preventing excessive noise from disturbing the peace and quiet of residential areas or from excessive noise in commercial and other areas. Further, sound amplifying devices cause traffic hazards by distracting drivers, resulting in traffic accidents and potential injury to pedestrians. As such, prohibiting their use is necessary for the safety of motorists and pedestrians; and WHEREAS, prohibiting the use of flashing lights or animated devices, such as laser lights, strobe lights, and LED lights by sidewalk vendors will reduce unusual visual distractions to the driving public, thus protecting the health, safety and welfare of motorists and pedestrians; and
WHEREAS, prohibiting sidewalk vendors from operating within 100 feet of any intersection of a street and sidewalk, or within 25 feet of a bus stop or bus shelter, is necessary to protect the health, safety and welfare of disabled persons by maintaining minimum access needed to comply with the Americans with Disabilities Act, as well as to

ensure that the City's residents and visitors have readily accessible pedestrian pathways in areas commonly utilized by pedestrians; and
WHEREAS, prohibiting sidewalk vendors from operating within 50 feet of a driveway, alley, or entrance to a parking lot or parking garage is necessary to protect the health, safety, and welfare of sidewalk vendors, customers, pedestrians, and motorists, as it reduces exposure to pedestrian versus vehicle contact, and ensures better sight distance and visibility for drivers of vehicles entering or exiting driveways; and WHEREAS, prohibiting sidewalk vendors from operating on any City street median, in accordance with Section 12-42.030 of the Laguna Hills Municipal Code (“LHMC”) (Pedestrians prohibited on city median islands), is necessary to protect the health, safety, and welfare of sidewalk vendors, customers, pedestrians, and motorists, as it significantly reduces exposure to pedestrian versus vehicle contact; and WHEREAS, limiting the square feet of space that may be occupied by a sidewalk vendor in conjunction with the vendor’s vending activities is necessary to protect the public health, safety and welfare, as it ensures that the public has readily accessible pedestrian pathways in areas commonly utilized by pedestrians; and WHEREAS, prohibiting sidewalk vendors from using an open flame is necessary to protect the public health, safety, and welfare, as it prevents the occurrence of fire hazards in the City; and
WHEREAS, prohibiting sidewalk vendors from selling alcohol, marijuana (including marijuana infused products such as CBD oil), adult-oriented material, tobacco products, products that contain nicotine, vaping products, or any product used to smoke/vape is necessary to protect the public health, safety, and to protect children from being exposed to such material because sidewalk vendors can have unsupervised direct contact with children due to the inherent nature of sidewalk vending and the ability of sidewalk vendors to be located on public streets and to move quickly from place to place in the community, including residential areas, near City parks, schools, and other places frequented by children; and
WHEREAS, LHMC Section 12-12.020 (Permit Authority) requires an encroachment permit for any work performed or conducted within the public right-of-way, whether permanently or temporarily, and sidewalk vending activities are considered to be work, obstructions, and/or encroachments conducted within the public right-of-way, which temporarily block, obstruct, or constrict public access to the public right-of-way; these permit requirements are consistent with the City’s existing general encroachment permit requirements for work and activities conducted in the public right-of-way; and WHEREAS, the City Council finds and determines that the installation, repair, maintenance, and removal of encroachments in the public right-of-way must be reasonably regulated in order to protect the public health, safety, and welfare and to provide for the orderly administration and maintenance of the public access ways for the benefit of the community, while at the same time allowing reasonable accommodation and cooperative flexibility for providing necessary utility and other convenience services to the community; and

WHEREAS, the City Council finds and determines that public and private persons who maintain and/or install either temporary or permanent encroachments in the public right-of-way bear a responsibility to help preserve the public right-of-way and to contribute to the administrative and liability costs incurred by the community and caused by such encroachments; and
WHEREAS, the City Council hereby finds and determines that the proposed sidewalk vendor regulations are consistent with SB 946, as they are reasonable time, place, and manner restrictions, related to objective health, safety, and welfare concerns, and are based on compliance with other generally applicable laws, including the Americans with Disabilities Act, state and federal law, and the Laguna Hills Municipal Code.

THE CITY COUNCIL OF THE CITY OF LAGUNA HILLS, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
