comply with
income and
age targets
“Development” includes:
• New construction
• Acquisition and rehabilitation
• Substantial rehabilitation
• Acquisition of long-term affordability covenants on
multifamily units
• Preservation of at-risk units whose affordable rent
restrictions would otherwise expire over the next five years Lake Elsinore Housing Successor Annual Report FY 2024-25 20 Health and Safety Code Section 34176.1
Expense Category Limits Allowable Uses
Income
Targets
Fixed Five-Year
Compliance
Period
(Current Period:

FY 2024-25 to
2028-29)
Every five years, Housing Asset Funds must meet income
targets:
• At least 30% on extremely low-income rental households (up to 30% AMI or “Area Median Income”)
• No more than 20% on low-income households (60-80%
AMI)
Moderate and above moderate-income households may not be assisted (above 80% AMI).

Failure to comply with the extremely low-income requirement in any five-year compliance period will result in having to ensure that 50 percent of remaining funds be spent on extremely lowincome rental units until in compliance.

Exceeding the expenditure limit for low households earning between 60-80% AMI in any five-year reporting period will result in not being able to expend any funds on these income
categories until in compliance.

Age Targets
Rolling TenYear Period
For the prior ten years (resets every year), a maximum of 50% of deed-restricted rental housing units assisted by the Housing Successor or its host jurisdiction may be restricted to seniors.

If a housing successor fails to comply, Housing Asset Funds may not be spent on deed-restricted rental housing restricted to seniors until in compliance.

REPORT TO SUCCESSOR AGENCY
To: Honorable Chair and Members of the Successor Agency From: Jason Simpson, Executive Director
Prepared by: Rick De Santiago, Public Works Manager
Date: April 14, 2026
Subject: Amendment No. 1 to the Agreement with Hemet Fence for Removal and Installation of New Posts and a Windscreen at Lake Elsinore Diamond Stadium
Recommendation
Approve and authorize the Executive Director to execute Amendment No. 1 to the Agreement with Hemet Fence for the removal and installation of new posts and a windscreen at Lake Elsinore Diamond Stadium to increase compensation by an additional $9,300 for a total amount not to exceed $54,300 in such final form as approved by the Agency Attorney.

Background
The Lake Elsinore Diamond Stadium requires ongoing maintenance to ensure its safety, functionality, and appearance. During a recent inspection, structural failures were identified in the perimeter fencing and windscreen support system near Pete Lehr Drive, near the Diamond Tap Room. Several fence posts were weakened due to corrosion at their footings, and a previous windstorm caused additional damage to the windscreen and support structure.

Discussion
Staff requests approval of Amendment No. 1 to perform the following improvements to restore safety and structural integrity to the affected fencing system:
• Removal of existing damaged and corroded fence posts
• Installation of new 3-inch posts designed to withstand the wind load associated with both the iron fencing and attached windscreen
• Replacement and reinstallation of windscreen material Amendment No. 1 with Hemet Fence

Page 2 of 2 ends

These updates will improve durability and wind resistance, reduce future maintenance, and ensure fencing system meets operational and safety standards.

Fiscal Impact
Funds are available in Fiscal Year 2026-27 through ROPS funding.

Contractor is not a designated employee within the meaning of the Political Reform Act because Contractor:
a. will conduct research and arrive at conclusions with respect to his/her rendition of information, advice, recommendation or counsel independent of the control and direction of the Agency or of any Agency official, other than normal agreement monitoring; and b. possesses no authority with respect to any Agency decision beyond rendition of information, advice, recommendation or counsel. (FPPC Reg. 18700(a) (2).)

12. Ability of Contractor. Agency has relied upon the training and ability of Contractor to perform the services hereunder as a material inducement to enter into this Agreement.

Contractor shall therefore provide properly skilled personnel to perform all services under this Agreement. Contractor shall indemnify, defend, and hold harmless the Agency and its officials, officers, employees, agents, and volunteers from and against any and all losses, liability, claims, suits, actions, damages, and causes of action arising out of any personal injury, bodily injury, loss of life, or damage to property, or any violation of any federal, state, or municipal law or ordinance, to the extent caused, in whole or in part, by the willful misconduct or negligent acts or omissions of Contractor or its employees, subcontractors, or agents, by acts for which they could be held strictly liable, or by the quality or character of their work. The foregoing obligation of Contractor shall not apply when (1) the injury, loss of life, damage to property, or violation of law arises from the sole negligence or willful misconduct of the Agency or its officers, employees, agents, or volunteers and (2) the actions of Contractor or its employees, subcontractor, or agents have contributed in no part to the injury, loss of life, damage to property, or violation of law. It is understood that the duty of Contractor to indemnify and hold harmless includes the duty to defend as set forth in Section 2778 of the California Civil Code. Acceptance by Agency of insurance certificates and endorsements required under this Agreement does not relieve Contractor from liability under this indemnification and hold harmless clause. CFD 2015-2 Annex 29

Page 2 of 3 ends

Background
On March 10, 2026, the City Council adopted Resolution No. 2026-27, declaring its intention to annex territory to Community Facilities District No. 2015-2 (Maintenance Services) and commence the annexation proceedings for the territory to be annexed, also known as Annexation No. 29. A public hearing was set for April 14, 2026. Following such public hearing, if there is no majority protest against the annexation and the levy of the special tax, the City Clerk will conduct an election for the landowners and to declare the results of that election.

As required by the Resolution of Intention, an annexation map was recorded on March 17, 2026, at 11:24 a.m. in Book 99, Page 18, Document No. 2026-0079990 of Maps of Assessment and Community Facilities Districts with the Riverside County Recorder.

Discussion
The City Council adopted the Resolution of Intention in response to a request by Tri Pointe Homes IE-SD, Inc. (the “Owner”) for the City to assist them in annexing territory into CFD No. 2015-2 (Maintenance Services) to cover cost associated with the maintenance of public improvements.

The improvements proposed to be maintained include items such as landscaping, lights, streets, drainage, parks, and graffiti abatement. The Applicants have agreed to the annexation into the CFD and submitted a "Consent and Waiver" form on file in the City Clerk's Office, to initiate and conduct proceedings pursuant to the Mello-Roos Act of 1982, requesting the annexation of property to CFD No. 2015-2 (Maintenance Services) and consenting to the shortening of election time requirements, waiving analysis and arguments, and waiving all notice requirements relating to the conduct of the election.

The territory proposed for Annexation No. 29, consisting of Tentative Tract Map 34249 (Canyon Hills Heights), was previously annexed into CFD No. 2015-2 (Maintenance Services) as Annexation No. 23 and is currently subject to the special tax for Tax Zone 26. However, modifications to the development plan by the Owner have resulted in changes to the public improvements and associated maintenance obligations.

Following adoption of Resolution No. 2026-27, which identified a maximum special tax of $920 per single-family residential unit, the project’s maintenance cost estimate was refined, resulting in a reduced maximum special tax of $900 per unit. The revised Rate and Method of Apportionment reflecting the lower rate is presented for consideration at the Public Hearing. This adjustment reduces the financial obligation on future property owners and remains consistent with the intent of the original proceedings. The reduction does not increase the burden on property owners and remains consistent with the intent of the original proceedings.

In order to align the special tax structure with the updated scope of services, the property is being re-annexed into the CFD as Annexation No. 29, which will establish a new Tax Zone (Tax Zone 34) applicable to 133 single-family residential units.

Upon approval of the annexation and recordation of the Notice of Special Tax Lien for Annexation No. 29, the City will record a Notice of Cessation to terminate the existing special tax lien CFD 2015-2 Annex 29

Page 3 of 3 ends

associated with Annexation No. 23 (Tax Zone 26), thereby ensuring that the property is subject only to the revised special tax structure.

To annex property to CFD No. 2015-2 under the provisions of California Government Code Section 53311 et seq., the City must adopt a series of three statutorily required Resolutions and an Ordinance which are summarized below.
• Resolution declaring City’s intent to annex territory to Community Facilities District No. 2015-2, including the boundary of the area to be annexed and the rate and method of apportionment of special taxes within the annexation area (the special tax applies only to properties within the annexation area), adopted March 10, 2026. • Resolution calling an election to submit to the qualified electors the question of levying a special tax within the area proposed to be annexed to the District. • Resolution declaring the results of the election and directing the recording of the notice of special tax lien.
• Amend the Ordinance and order the levy and collection of special taxes in the District.

With the adoption of the Resolutions and the first reading of the amended Ordinance, the second reading of the amended Ordinance would be scheduled for April 28, 2026.

Fiscal Impact
On March 1 of each year, every taxable property for which a building permit has been issued will be subject to the special taxes in the ensuing Fiscal Year. If the anticipated costs of maintaining the facilities in any given Fiscal Year, before buildout of the project, exceed the special tax revenues available from parcels for which building permits have been issued, then the special tax may also be on undeveloped property within the Tax Zone.

Once developed, the Special Tax A for Tax Zone 34 will generate $119,700 annually, plus the annual escalator for maintenance services.

CALIFORNIA, CALLING AN ELECTION TO SUBMIT TO THE QUALIFIED

ELECTORS THE QUESTION OF LEVYING A SPECIAL TAX WITHIN THE AREA PROPOSED TO BE ANNEXED TO COMMUNITY FACILITIES DISTRICT NO. 2015-2 (MAINTENANCE SERVICES) (ANNEXATION NO. 29)
Whereas, on September 22, 2015 the City Council (the “City Council”) of the City of Lake Elsinore (the “City”) approved Resolution No. 2015-078 declaring the City’s intention to establish Community Facilities District No. 2015-2 (Maintenance Services) of the City of Lake Elsinore, County of Riverside, State of California (the "CFD No. 2015-2") for the purpose of levying special taxes on parcels of taxable property therein for the purpose of providing certain services which are necessary to meet increased demands placed upon the City as a result of the development of said real property; and

Whereas, on September 22, 2015, the City Council adopted Resolution No. 2015-079 declaring the results of the special election and finding that more than two-thirds (2/3) of all votes cast at the special election were cast in favor of the proposition presented, and such proposition passed; and
Whereas, the City Council is authorized by Article 3.5 (commencing with Section 53339) of Chapter 2.5 of Part 1 of Division 2 of Title 5 of the Government Code as amended (the "Act"), to annex territory into an existing community facilities district by complying with the procedures set forth in said Article 3.5; and

Whereas, Resolution No. 2026-27 included a Rate and Method of Apportionment specifying a maximum special tax of $921 per single-family residential unit; and Whereas, Whereas, subsequent to the adoption of the Resolution of Intention, the maintenance cost estimate was refined, resulting in a reduced maximum special tax of $900 per unit, as reflected in the Rate and Method of Apportionment presented at the public hearing; and Whereas, the territory proposed to be annexed is identified in a map entitled "Annexation Map No. 29 Community Facilities District No. 2015-2 (Maintenance Services)" a copy of which was recorded, on March 17, 2026, in Book 99 of Maps of Assessment and Community Facilities Districts at Page 18, in the office of the Riverside County Recorder; and CC Res. No. 2026-_____

Page 2 of 5 ends

Whereas, pursuant to the Act and the Resolution of Intention, a noticed public hearing was convened by the City Council on April 14, 2026, not earlier than the hour of 7:00 p.m. at the City Hall located at 183 N Main Street, Lake Elsinore, California 92530, relative to the proposed annexation of said territory to CFD No. 2015-2; and
Whereas, written protests have not been filed by fifty percent (50%) or more of the registered voters residing within the CFD No 2015-2, or by fifty percent (50%) or more of the registered voters residing within the territory to be annexed, or by the owners of one-half (1/2) or more of the area within the CFD No. 2015-2, or by the owners of one-half (1/2) or more of the territory to be annexed; and
Whereas, the City Council has determined that there are fewer than twelve registered voters residing in the territory proposed to be annexed to the CFD No. 2015-2 and that the qualified electors in such territory are the landowners; and Whereas, on the basis of all of the foregoing, the City Council has determined at this time to call an election to authorize the annexation of territory to the CFD No. 2015-2 and the levying of a special tax as described in Exhibit A hereto; and
Whereas, the City Council has received a written instrument from each landowner in the territory proposed to be annexed to the CFD No. 2015-2 consenting to the shortening of election time requirements, waiving analysis and arguments, and waiving all notice requirements relating to the conduct of the election; and
Whereas, the City Clerk has concurred in the election date set forth herein.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

Section 1. Recitals. The foregoing recitals are true and correct.

Section 2. Conformation of Finding in Resolution of Intention. The City Council reconfirms all of its findings and determinations as set forth in the Resolution of Intention.

Section 3. Findings Regarding Protests. The City Council finds and determines that written protests to the proposed annexation of territory to the CFD No. 2015-2 and the levy of the special tax within such territory are insufficient in number and in amount under the Act, and the City Council hereby further orders and determines that all such protests are hereby overruled.

Section 4. Findings Regarding Prior Proceedings. The City Council finds and determines that all prior proceedings had and taken by the City Council with respect to the annexation of territory to CFD No. 2015-2 are valid and in conformity with the requirements of the Act.

Section 5. Levy of Special Tax. As stated in the Resolution of Intention, except where funds are otherwise available, subject to the approval of the qualified electors of territory proposed to be annexed to CFD No. 2015-2, a special tax sufficient to pay the costs of the Services (including incidental expenses as described in the Resolution of Intention), secured by recordation of a continuing lien against all nonexempt real property in CFD No. 2015-2, will be levied annually CC Res. No. 2026-_____

in CFD No. 2015-2. The rate and method of apportionment, and manner of collection of the special tax are specified in Exhibit A hereto.

Section 6. Apportionment of Tax. The special tax as apportioned to each parcel is based on the cost of making the Services available to each parcel, or other reasonable basis, and is not based on or upon the ownership of real property.

Section 7. Tax Roll Preparation. The office of the Assistant City Manager, 130 South Main Street, City of Lake Elsinore, is hereby designated as the office that will be responsible for annually preparing a current roll of special tax levy obligations by assessor’s parcel number and that will be responsible for estimating future special tax levies pursuant to Government Code section 53340.2. The Assistant City Manager may cause these functions to be performed by his or her deputies, assistants, or other designated agents.

Section 8. Accountability Measures. Pursuant to Section 50075.1 of the California Government Code, the City shall create a separate account into which tax proceeds will be deposited; and the Assistant City Manager annually shall file a report with the City Council that will state (a) the amount of funds collected and expended and (b) the status of the Services financed in CFD No. 2015-2.

Section 9. Special Election; Voting Procedures. The City Council hereby submits the questions of levying the special tax within the territory proposed to be annexed to the qualified electors, in accordance with and subject to the Act. The special election shall be held on April 14, 2026, and shall be conducted as follows:

The Special Tax shall be collected in the same manner and at the same time as ordinary ad valorem property taxes, provided, however, that CFD No. 2015-2 may collect the Special Tax at a different time or in a different manner if necessary to meet its financial obligations.

E. FUTURE ANNEXATIONS
It is anticipated that additional properties will be annexed to CFD No. 2015-2 from time to time. As each annexation is proposed, an analysis will be prepared to determine the annual cost for providing Services. Based on this analysis, the property to be annexed, pursuant to California Government Code section 53339 et seq. will be assigned to the appropriate Maximum Special Tax rate for the Tax Zone when annexed and included in Appendix A.

A representative(s) of CFD No. 2015-2 shall promptly review the appeal, and if necessary, meet with the property owner, consider written and oral evidence regarding the amount of the Special Tax, and rule on the appeal. If the representative’s decision requires that the Special Tax for an Assessor’s Parcel be modified or changed in favor of the property owner, a cash refund shall not be made, but an adjustment shall be made to the Special Tax on that Assessor’s Parcel in the subsequent Fiscal Year(s).

I. MANNER OF COLLECTION
The Special Tax shall be collected in the same manner and at the same time as ordinary ad valorem property taxes, provided, however, that CFD No. 2015-2 may collect the Special Tax at a different time or in a different manner if necessary to meet its financial obligations.

Background
The City of Lake Elsinore (the “City”) formed Community Facilities District No. 2025-1 of the City of Lake Elsinore (Canyon Hills Heights) (the “District”) pursuant to the Mello-Roos Community Facilities District Act of 1982. Tri Pointe Homes IE-SD, Inc., a California Corporation is the current landowner of all of the property in the District (the “Developer”). The District is located on the corner of Canyon Hills Road and Cottonwood Canyon Road (the “Property”). Collectively, the Property is approximately 76.71 gross acres with plans to be developed into 133 single family residential lots.

Home building within the District has not yet commenced. Due to increased maintenance responsibilities within the District, the Developer has requested that the District undertake proceedings to amend the Rate and Method of Apportionment of Special Taxes for the District with a First Amended and Restated Rate and Method of Apportionment attached to Resolution No. 2026-26 adopted by the City Council on March 10, 2026 (the “First Amended RMA”).

The current annual Special Tax rates to finance facilities for a single family home within the District range from $4,437 to $5,463. If the First Amended RMA is approved, the annual Special Tax rates for a single family home within the District will range from $4,417 to $5,144.

On March 10, 2026, the City Council adopted Resolution No. 2026-26 stating its intention to consider approval of the First Amended RMA and called for a public hearing to be held on the approval of such matters.

Documents to be Approved
Following the public hearing to be held, approval of the first resolution will call for an election to be held with respect to the approval of the First Amended RMA.

The City has received a certificate of the Registrar of Voters certifying that there are less than 12 Registered Voters residing within the District during the 90 days prior to the time of the public hearing. Accordingly, the election to be held will be a landowner election pursuant to which the landowners are the sole eligible voters within the District. The Developer is the sole landowner within the District and has executed a consent and waiver to certain election law requirements, which allows the election to be conducted immediately following the public hearing.

Following the holding of the election, the City Council will be asked to certify the election results and assuming approval of the First Amended RMA, introduce the Ordinance authorizing the levy of the special tax in accordance with the First Amended RMA.

Fiscal Impact
The Developer has made a deposit to pay for the costs of the change proceedings described above. The District will annually levy special taxes on all of the taxable property within the District in accordance with the First Amended RMA in order to pay for the costs of facilities, debt service on bonds, the services and administration of the District. Any bonds issued by the District are not obligations of the City and will be secured solely by the Special Taxes levied in the District.

Section 1. Each of the above recitals is true and correct.

Section 2. The City Council hereby adopts the First Amended and Restated Rate and Method as the rate and method for Community Facilities District No. 2025-1. Except where funds are otherwise available, it is the intention of the City Council, subject to the approval of the eligible voters within Community Facilities District No. 2025-1, to levy the proposed special taxes at the rates for Community Facilities District No. 2025-1 set forth in the First Amended and Restated Rate and Method on all non-exempt property within Community Facilities District No. 2025-1 sufficient to pay for (i) the Facilities, (ii) the principal and interest and other periodic costs on the bonds proposed to be issued by the District to finance the Facilities and Incidental Expenses, including the establishment and replenishment of reserve funds, any remarketing, credit enhancement and liquidity facility fees (including such fees for instruments which serve as the basis of a reserve fund in lieu of cash), administrative expenses and other expenses of the type permitted by Section 53345.3 of the Act; and (iii) the Incidental Expenses. The First Amended and Restated Rate and Method is described in detail in Attachment “A” to the Resolution of Intention which is incorporated herein by this reference, and the City Council hereby finds that the First Amended and Restated Rate and Method contains sufficient detail to allow each landowner within the District to estimate the maximum amount that may be levied against each parcel.
