Background:

The property owners have requested, in writing, annexation of property (Annexation No. 14- 469) into the County Sanitation District No. 14 (District) in order to receive off-site disposal of sewage. The annexation process requires that a resolution for property tax revenue exchange be adopted by all the affected local agencies before an annexation may be approved. For any jurisdictional change which will result in a special district providing new service not previously provided to an area, the law requires the governing bodies of all local agencies that receive an apportionment of the property tax from the area to determine by resolution the amount of the annual tax increment to be transferred to the special district (Revenue and Taxation Code Section 99.01).

Subject: Appropriate Funds for the Department of Housing & Urban Development (HUD) for Home American Rescue Plan (HOME-ARP)
Recommendation:

1. Appropriate additional HOME-ARP funds in the amount of $3,662.00 for expenditure in accordance with the HOME-ARP Grant Agreement.

2. Authorize the City Manager, or his designee, to sign all documents as it relates to these funds.

Background:

During recent quality control reviews, the U.S. Department of Housing and Urban Development (HUD) identified an administrative error in the City’s HOME-ARP allocation that resulted in an under-allocation of $3,662. HUD has since corrected this error and increased the City’s HOME- ARP award accordingly, bringing the revised total award amount to $2,454,186. Upon Council approval, staff will submit reimbursement requests under the HOME-ARP program.

HOME-ARP funds are reimbursable; therefore, the City will allocate the additional funding to existing eligible programs and seek reimbursement through HOME-ARP. The City has until September 2030 to fully expend all HOME-ARP funds.

The City receives HOME-ARP funding to support individuals and families within qualifying populations, including those who are homeless; at risk of homelessness; fleeing or attempting to flee domestic violence, dating violence, sexual assault, stalking, or human trafficking; other populations for whom assistance would prevent homelessness or address the greatest risk of housing instability; and veterans and families that include a veteran household member who meet one or more of these criteria.

HOME-ARP Grant Agreement

April 30, 2025

The Honorable R. Parris
Mayor of Lancaster
City of Lancaster
44933 Fern Avenue
Lancaster, CA 93534-2461

Dear Mayor Parris:

In 2021, the Department of Housing and Urban Development’s (HUD or the Department) Office of Community Planning and Development (CPD) allocated $5 billion appropriated by the American Rescue Plan Act (ARP) of 2021 to HOME Investment Partnerships Program participating jurisdictions. These funds, known as “HOME-ARP,” are intended to give you the financial tools to assist your most vulnerable citizens by providing housing, shelter, tenant-based rental assistance, and supportive services for persons experiencing or at risk of homelessness, fleeing or attempting to flee domestic violence, dating violence, sexual assault, stalking, or human trafficking, and other populations at greatest risk of housing instability.

While conducting recent quality control efforts, the Department discovered an administrative error in the allocations of the HOME-ARP funds. This error resulted in your jurisdiction inadvertently being allocated less HOME-ARP funds than it was legally entitled to receive. Specifically, the Department determined that your jurisdiction received $3,662.00 less in its HOME-ARP allocation than it should have. This letter notifies you of the corrected amount of your HOME-ARP award.

Attached is an amended HOME-ARP grant agreement for your agency’s signature, indicating the additional amount you are entitled to and your final corrected amount. Please sign this agreement and return it to your CPD Representative. Please note: Build America, Buy America provisions continue to be waived for HOME-ARP.

Additionally, you must amend your HOME-ARP allocation plan to include the correct amount of HOME-ARP funds in accordance with HUD Notice CPD-21-10 and your citizen participation plan.

Depending upon the criteria for substantial amendments established in your citizen participation plan, you may be required to develop a substantial amendment to the HOME-ARP allocation plan.

Docusign Envelope ID: 51C7812A-29DE-46B7-A3F0-15C3EBA6FA0B 2 The requirements for substantial amendments can be found in section V.C.6 of HUD Notice CPD-21-10. The Department can assist you in determining what may be required to be included in a substantial amendment.

The Department regrets this error and apologizes for any inconvenience it may cause.

We are working hard to make this process as seamless as possible for all affected recipients. If you or your staff wish to discuss this correction or have any questions about HOME-ARP, please contact your local HUD Field Office or HUD’s Office of Affordable Housing Programs at [email protected].

Sincerely,

Claudette Fernandez

Subject: Adopt Resolution Authorizing Application for State of California Prohousing Incentive Program Funds
Recommendation:

1. Adopt Resolution No.___, authorizing the submittal of an application to the California State Department of Housing and Community Development (HCD) for funding under the Prohousing Incentive Program (PIP); the execution of a standard agreement if selected for such funding and any amendments thereto; and any related documents necessary to participate in the Prohousing Incentive Program.

2.If funded, accept the Prohousing Incentive Program grant award funds, and appropriate said funds into a Prohousing Incentive Program Fund account number, to be created by Finance.

3.Authorize the City Manager, or their designee, to allocate any awarded funds—up to $1,140,000—in alignment with the Prohousing Incentive Program.

4.Find that this item is not a project pursuant to the California Environmental Quality Act.

G.C. Section 84308: No
Fiscal Impact:

None at this time. Should Lancaster be awarded funds from this competitive grant program, the City will receive up to $1,140,000.00 to fund predevelopment costs for the development of 200 affordable first-time homebuyer condominiums for workforce households at the HNR-3 former Antelope Valley Fairgrounds site in the City of Lancaster (Northeast corner of Division and Avenue I). Direct staff time is an eligible grant-funded cost. 2 2
7 5
Background:

The PIP complements the Prohousing Designation Program by incentivizing jurisdictions that adopt Prohousing Policies to achieve a Prohousing Designation. Through this program, grants are offered to support a wide range of planning and implementation efforts focused on housing and community development.

The program goal is to enable moderate-income households earning no more than 120 percent of Area Median Income (AMI), currently $127,900 per year for a family of four in Los Angeles County, to access affordable rental or ownership housing.

HCD issued a Notice of Funding Availability (NOFA) on September 30, 2025, for several PIP activities, with applications due by March 31, 2026. Funding under this NOFA is provided from California’s Building Homes and Jobs Trust Fund. The maximum application amount is $1,140,000, and HCD will provide funding to cover activity delivery fees (administrative costs) of up to 5 percent of the total award amount.

PIP award funds are based on jurisdiction size and Prohousing Designation Program score (as codified in the California Code of Regulations Title 25, Division 1, Chapter 6, Subchapter 6.6, Sections 6600 through 6608). The City of Lancaster had a Prohousing Designation Program score of 39, and as a newly designated Prohousing City, it is highly competitive for these PIP funds.

If the application is approved, funding will become available once the City Manager executes a Standard Agreement with HCD. This process has historically taken five to six months following the award announcement. The City will request $1,140,000 through the Prohousing Designation Program; however, the final award amount may be less than requested but will not exceed this amount. Should the grant be awarded, all activity delivery costs will be fully covered by the grant.

Funding from the PIP award will be allocated to cover predevelopment expenses for the HNR-3 first-time homebuyer condominium project through a loan structure. This funding will take the form of a soft subordinate loan, evenly distributed across all units within the development. The loan will become due if a unit is no longer owner-occupied or undergoes a cash-out refinance; otherwise, it will be forgiven at the end of a 30-year term. By functioning as a long-term subordinate loan, these funds help offset development financing costs, ultimately reducing the financial burden for each first-time homebuyer.

In March 2019, the City of Lancaster entered into a funding agreement with the Los Angeles County Metropolitan Transportation Authority (LACMTA) to construct the Lancaster Health District Project, which includes improvements that will improve service to the region that serves the Antelope Valley Hospital.

In April 2022, the Lancaster Health District Project was split into multiple phases to better accommodate current developments in the area and position the City for strategic partnerships with Developers in the future.

In October 2022, the City of Lancaster awarded the construction bid of Lancaster Health District – Phase 1, to Nationwide Contracting Services, Inc. of Fountain Valley, which included approximately 3,650 feet of sewer pipeline, 2,000 feet of storm drain, 55,000 square feet of temporary construction access pavement, and the associated intersection improvements. The Phase 1 improvements were funded by the LACMTA grant and exhausted all available grant funds.

Lancaster Health District Phase 2 will include 1.75 miles of new complete streets within the City of Lancaster near the Antelope Valley Hospital, in an area bounded by Avenue J to the north, 20th Street West to the west, 15th Street West to the east, and Avenue J-8 to the south. Subject: Resolution Submitting a Measure to the Voters to Amend Section 201 of the Lancaster Charter
Recommendation:

Approve Resolution No. _____approving the submission of a measure to the voters at the General Municipal Election on April 14, 2026, to amend Section 201 of the Lancaster Charter to authorize the City Council to enact an ordinance to (I) increase the number of Council Members from 4 to 5, (II) add the office of Vice Mayor, and (III) transition from at-large to district-based elections for Council Members consistent with the California Voting Rights Act of 2001.

G.C. Section 84308: No
Fiscal Impact:

The costs associated with submitting the ballot measure have been allocated in the Election Budget, Account No. 101.12000.5313.

Background:

The Lancaster City Charter generally provides that the City shall be governed by, and all powers of the City shall be vested in, a mayor and city council consisting of four council members, all elected to office from the City at-large. However, the California Voting Rights Act of 2001, Cal.

Elec. Code §§ 14025-14032 (“CVRA”), provides that an at-large method of election may not be used if it impairs the ability of a protected class to elect candidates of its choice or its ability to influence the outcome of an election, as a result of the dilution or the abridgment of the rights of voters who are members of a protected class (Cal. Elec. Code § 14027). 2 2
7 3
The City has been notified of an allegation that its current at-large method of election violates the CVRA and, although it generally denies the existence of such alleged violation, has determined it is in its best interest and will further the purpose of the CVRA to consider initiating the process of transitioning from its current at-large method of election to a district-based method of election.

The general law provides an expedited process for general law cities to transition to a district- based method of elections by merely enacting an ordinance, without voter approval; however, that expedited process is not available to the City because the City must first amend section 201 of its Charter.

On October 28, 2025 and December 9, 2025, two public hearings were held as required by the Elections Code to consider whether to submit a ballot measure to voters to amend section 201 of its Charter to authorize the City Council to enact an ordinance to (i) increase the number of council members from 4 to 5, (ii) add the office of vice mayor, and (iii) transition from at-large to district- based elections for council members consistent with the California Voting Rights Act of 2001. The last step requires the approval of a resolution to submit the measure to the voters at the General Municipal Election on April 14, 2026.

At the Lancaster City Council meeting held on October 28, 2025, the City Council also approved resolutions calling for the April 14, 2026 general municipal election; establishing procedures to conduct the April 14, 2026 election, and requesting specified services from the County to administer the election.

Staff requests that Council approve the proposed resolution approving the submission of a measure to the voters at the General Municipal Election on April 14, 2026, to amend Section 201 of the Lancaster Charter to authorize the City Council to enact an ordinance to (I) increase the number of Council Members from 4 to 5, (II) add the office of Vice Mayor, and (III) transition from at-large to district-based elections for Council Members consistent with the California Voting Rights Act of 2001.

10.04.040 of the Lancaster municipal code relating to vehicular cruising, requiring those sections to be repealed to remain consistent with state law.
