SUMMARY:

On August 10, 2026, the City Council approved a construction contract with Hale Construction, Inc. ( Hale) for the Lathrop Animal Center, CIP GG 23- 11 (Project).

Construction began in late September 2026.

In preparation for construction, staff identified a conflict between the proposed temporary sewer and storm drain connections and future Pacific Gas and Electric Company ( PG& E) infrastructure. The temporary connections must be eliminated and the permanent infrastructure constructed to maintain essential public services to the Project. Staff requested a proposal from Hale to construct the revised sewer and storm drain facilities for an amount not to exceed $ 1, 061, 715 plus a 15% contingency of $ 159, 258.

The Project also requires specialized construction engineering services, including Stormwater Pollution Prevention Plan ( SWPPP) services and inspection of topside and underground construction. Staff requested proposals from ENGEO, Inc. (ENGEO), under the City' smaster agreement for construction engineering services approved on August 5, 2025.

Staff recommend that the City Council approve Emergency Change Order No. 1 ( ECO No. 1) with Hale in an amount not to exceed $ 1, 220, 973 and approve the associated budget amendment. Staff also recommend that the City Council approve Task Orders No. 1-4 with ENGEO in a combined amount not to exceed $ 368, 500 to provide construction engineering services for the Project.

BACKGROUND:

On January 9, 2023, the City Council approved the creation of the Project. LDA Partners prepared the plans and specifications, and the Project was advertised for 179

bids on June 26, 2026. On August 10, 2026, the City Council approved a construction contract with Hale, and construction began in late September 2026.

The Project design included temporary sewer and storm drain connections behind the westerly sidewalk instead of installing the permanent, larger pipes in Stanford Crossing Drive. Those larger pipes are intended to serve future development in the Central Lathrop Phase 2 Specific Plan area ( CLSP Phase 2), north of Dos Reis Road.

As staff coordinated the Project' s electrical connections with PG& E, staff identified a spatial conflict between the proposed temporary sewer and storm drain connections and future PG& E service infrastructure. Accordingly, ECO No. 1 will replace the temporary connections with permanent, larger sewer and storm drain pipes in Stanford Crossing Drive to maintain essential public services to the Project.

Hale proposed to construct the revised sewer and storm drain facilities for an amount not to exceed $ 1, 220, 973. Because the facilities in Stanford Crossing Drive will also benefit future development in CLSP Phase 2, staff anticipates that the City will be reimbursed for the costs associated with ECO No. 1 when that area develops.

The Project requires specialized construction engineering services, including SWPPP services and inspection of topside and underground construction. The City maintains a master agreement with ENGEO for construction engineering services on City capital improvement projects. Staff requested proposals from ENGEO for the services needed to support this Project.

FISCAL IMPACT:

Staff is requesting that the City Council approve a budget amendment totaling 1, 220, 973 for ECO No. 1, which includes the construction of the required infrastructure to maintain essential public services to the Project including water, sewer, and storm drain services. The costs are as follows:

Future development will reimburse the City for its proportionate share of these infrastructure costs as development occurs.

Sufficient funds are available in the Water Operating Fund ( 5620) and Sewer Connection Fee Fund ( 6030) to cover their respective costs. However, the Storm Drain Connection Fee Fund ( 2280) does not have sufficient funds to cover the $ 665, 488 storm drain cost. Staff is therefore recommending that the General Fund ( 1010) temporarily fund the storm drain shortfall, with the understanding that future development will reimburse the City for its proportionate share.

Additionally, on January 9, 2023, the City Council approved Resolution 23- 5205, authorizing $ 7, 498, 000 for the Lathrop Animal Center. The Municipal Services Fund currently has sufficient funds to reduce the outstanding interfund loan by $ 665, 488.

This reduction will offset the amount of General Fund funding needed for the storm drain shortfall.

RESOLUTION NO. 26-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LATHROP TO APPROVE EMERGENCY CHANGE ORDER NO. 1 WITH HALE CONSTRUCTION, INC. AND TASK ORDER NO. 1-4 WITH ENGEO, INC. FOR THE LATHROP ANIMAL CENTER, CIP GG 23- 11 AND ASSOCIATED BUDGET AMENDMENT WHEREAS, on January 9, 2023, the City Council approved the creation of CIP GG 23- 11, Lathrop Animal Center ( Project). LDA Partners prepared the plans and specifications, and the Project was advertised for bids on June 26, 2026. On August 10, 2026, the City Council approved a construction contract with Hale Construction, Inc. (Hale), and construction began in late September 2026; and WHEREAS, the Project design included temporary sewer and storm drain connections behind the westerly sidewalk instead of installing the permanent, .larger pipes in Stanford Crossing Drive. Those larger pipes are intended to serve future development in the Central Lathrop Phase 2 Specific Plan area ( CLSP Phase 2), north of Dos Reis Road; and
WHEREAS, as staff coordinated the Project' selectrical connections with Pacific Gas & Electric ( PG& E), staff identified a spatial conflict between the proposed temporary sewer and storm drain connections and future PG& Eservice infrastructure.

Accordingly, Emergency Change Order No. 1 ( ECO No. 1) will replace the temporary connections with permanent, larger sewer and storm drain pipes in Stanford Crossing Drive to maintain essential public services to the Project; and WHEREAS, Hale proposed to construct the revised sewer and storm drain facilities for an amount not to exceed $ 1, 061, 715 plus a 15% contingency of 159, 258 for a total cost of $ 1, 220, 973. Because the facilities in Stanford Crossing Drive will also benefit future development in CLSP Phase 2, staff anticipates that the City will be reimbursed for the costs associated with ECO No. 1 when that area develops; and
WHEREAS, the Project requires specialized construction engineering services, including SWPPP services and inspection of topside and underground construction.

The City maintains a master agreement with ENGEO for construction engineering services approved on August 5, 2025. Staff requested proposals from ENGEO for the services needed to support this Project. The proposed task orders and associated costs are:

WHEREAS, sufficient funds for ENGEO' sservices have been included in the adopted Fiscal Year 2026/7 budget for CIP GG 23- 11; therefore, no budget amendment is required for special inspections, only approval of the task orders; and WHEREAS, staff is requesting that the City Council approve a budget amendment totaling $ 1, 220, 973 for ECO No. 1, which includes the construction of the required infrastructure to maintain essential public services to the Project including water, sewer, and storm drain services. The costs areas follows:

WHEREAS, sufficient funds are available in the Water Operating Fund ( 5620) and Sewer Connection Fee Fund ( 6030) to cover their respective costs. However, the Storm Drain Connection Fee Fund ( 2280) does not have sufficient funds to cover the 665, 488 storm drain cost. Staff is therefore recommending that the General Fund 1010) temporarily fund the storm drain shortfall, with the understanding that future development will reimburse the City for its proportionate share; and WHEREAS, on January 9, 2023, the City Council approved Resolution 23- 5205, authorizing $ 7, 498, 000for the Lathrop Animal Center. The Municipal Services Fund currently has sufficient funds to reduce the outstanding interfund loan by $ 665, 488.

This reduction will offset the amount of General Fund funding needed for the storm drain shortfall; and

Additional Scope of Services: As requested, we have prepared this Request for Task Order ( RFTO) for stormwater pollution prevention plan ( SWPPP) services for the City of Lathrop Animal Center project The purpose of our SWPPP services is to satisfy State Water Resources Control Board (SWRCI3) Order WQ 2022. 0057- DWQ (General Permit) for stormwater discharges from sites with a disturbed area greater than tacre.

We will provide the required SWPPP monitoring and reporting services, including QSD and QSP site inspections, weekly delegate inspections, and storm -related delegate inspections, in accordance with the CGP. Our estimated number of site inspections is based on an approximately 60 -week construction schedule, from September 2026 to November 2027.

The actual number of inspections will be .determined by the forecasted precipitation events, project schedule, and Notice of Termination ( NOT) approval timeframe.

Based on the estimated construction schedule and a preliminary risk level assessment, we assume this project SWPPP will be designated as Risk Level 1. This proposal is based on the requirements of Order WQ 2022- 0057- DWQ and includes the following minimum SWPPP tasks:

A final Risk Level Determination will be performed based on the sediment and receiving water risk using the SWRCB- provided GIS Maps and Environmental Protection Agency ( EPA) rainfall erosivity calculations. Once the final Risk Level has been determined; a project -specific SWPPP will be preparedin accordance with the General Permit requirements by an ENGEO Qualified SWPPP Developer. (QSD): Our project -specific SWPPP will include an Erosion and Sediment Control Plan ESCP).

We assume that the project is not subject to Total Maximum Daily Load ( TMDL) requirements specified in the General Permit. We assume that construction dewatering discharge, active treatment systems.

ATS), and passive treatment systems ( PTS) will not be required for this project. If construction dewatering discharge, ATS, or PTS are required, a revision to our scope and fee may be needed.

By September 1, and continuing annually every year the permit is active, we will prepare an Annual Compliance Report ( ACR) and upload it to SMARTS. The ACR will contain the minimum required elements described in the General Order. We will prepare and upload the ACR for the applicable reporting years ( 2026-027 and 2027-028) for LRP certification.

5. Notice of.

Termination
After construction is complete and disturbed areas have been stabilized, we will prepare a Notice of Termination ( NOT) and submit to SMARTS for LRP certification. The NOT will include a description of the' basis of termination, final QSP inspection report, and photographs documenting the post -construction stabilization, if applicable.

TASK 6 CONSULTATION
Consultation
We will provide additional as -needed consultation for specific requests, such as performing non -routine site inspections, attending meetings, preparing SWPPP Amendments and Changes of Information, sampling for non -visible pollutants and/ or construction dewatering discharges, and other SWPPP needs on a time -and -expense basis.

CONSULTANT shall be paid any uncontested sum due and payable within thirty 30) days of receipt of billings containing all information pursuant to Paragraph 5 below. A Notice to Proceed shall not be issued until all necessary documents and insurance have been received. 1. SWPPP
Development
A final Risk Level Determination will be performed based on the sediment and receiving water risk using the SWRCB- provided GIS Maps and Environmental Protection Agency (EPA) rainfall erosivity calculations. Once the final Risk Level has been determined, a project -specific SWPPP will be prepared in accordance with the General Permit requirements by an ENGEO Qualified SWPPP Developer ( QSD). Our project -specific SWPPP will include an Erosion and Sediment Control Plan ESCP).

We assume that the project is not subject to Total Maximum Daily Load ( TMDL) requirements specified in the General Permit. We assume that construction dewatering discharge, active treatment systems ATS), and passive treatment systems ( PTS) will not be required for this project. If construction dewatering discharge, ATS, or PTS are required, a revision to our scope and fee may be needed.

Following completion of the SWPPP and other Permit Registration Documents ( PRDs), we will file the Notice of Intent ( NOI) to the SWRCB' sSMARTS website for Owner certification. Following NOI approval, we will prepare -one hard copy of the SWPPP document for field use. 204

4) Compensation
CITY hereby agrees to pay CONSULTANT hourly rates and other ch` arges not to exceed $ 150, 00 for provide construction testing and observation services described in Exhibit " A" of Task Order No. 4 pursuant to the Master Agreement dated August 5, 2025. CONSULTANT shall be paid any uncontested sum due and payable within thirty ( 30) days of receipt of billings containing all information pursuant to Paragraph 5 below. SUMMARY:

On April 13, 2026, City Council approved the creation of Seventh Street Parking Rehabilitation, Capital Improvement Project ( CIP) PS 26- 31 (Project) to reconstruct street parking and sidewalk along the southwest corner of the Seventh and K Street intersection.

The plans and specifications for the Project were prepared by GDR, Inc. (GDR) and advertised for bid on August 25, 2026 pursuant to bidding procedures in California Public Contract Code 22037 and Lathrop Municipal Code 2. 36. 060.

The City Clerk received and opened fifteen ( 15) bids on September 15, 2026, all determined to be responsive and from responsible bidders. The bid results are summarized in Table 1 below:

Following review and evaluation of the bids, the responsible bidder with the lowest responsive bid for the Project was determined to be Hensley' s Paving and General Engineering, Inc. (Hensley' sPaving) with a bid of $ 249, 69.

Staff request that City Council award a contract to Hensley' s Paving for the construction of the Project in the amount of $249, 69. Staff request that City Council approve a 20% construction contingency of $ 49, 940 and authorize staff to spend up to the amount of the contingency as necessary to achieve the goals of the Project.

BACKGROUND:

This project was initiated following a referral made by a council member at the Regular City Council meeting on October 13, 2025. Following Council direction, staff evaluated the situation and requested design proposals from qualified civil engineering firms for the required infrastructure improvements. GDR submitted the highest ranked proposal, and the City entered into contract with GDR for the current design.

REASON FOR RECOMMENDATION:

The Project will replace damaged asphalt paving and concrete sidewalk and construct a curb to improve pedestrian safety along the southwest corner of the Seventh and K Street intersection. To ensure compliance with accessibility standards and maintain pedestrian connectivity, the project will also construct an ADA- compliant curb ramp and a marked crosswalk across K Street.

FISCAL IMPACT:

Sufficient funding for the construction contract ($ 249, 69) and the 20% contingency 49, 940), totaling $ 299, 639, was allocated in the adopted Fiscal Year 2026-7 Budget to CIP PS 26- 31; therefore, no budget amendment is necessary.

SEVENTH STREET PARKING REHABILITATION CONSTRUCTION CONTRACT CIP PS 26- 31

CONSTRUCTION CONTRACT
This Contract, dated October 12, 2026 is entered into by and between the City of Lathrop City"), a municipal corporation of the State of California ( City), and Hensley' sPaving and General Engineering, Inc. ( Contractor), whose Taxpayer Identification Number is For and in consideration of the following covenants, terms and conditions, City and Contractor ( the parties) agree:

1. Term. This Contract shall commence on, and be binding on the parties on, the date of execution of this Contract, and shall expire on the date of recordation of the Notice of Substantial Completion, or, if no such notice is required to be filed, on the date that final payment is made hereunder, subject to the earlier termination of this Contract.

2. General Scope of Project and. Work. Construction Documents for Seventh Street Parking Rehabilitation, CIP PS 26- 31 (Project). Contractor shall furnish labor, services, materials and equipment in connection with the construction ofthe Project and complete the Work in accordance with the covenants, terms and conditions of this Contract to the satisfaction of City.

The work to be performed under this contract includes all work contained in the Construction Documents, as detailed in Paragraph 3 below, including, but not limited to removal of existing asphalt pavement and concrete sidewalk, removal and replacement of a drain inlet and storm drain piping, and placement of new aggregate base, asphalt pavement and concrete sidewalk and any task necessary to accomplish the aforementioned tasks.

The work shall be completed within fifty ( 50) Working Days following issuance of Notice to Proceed.

The Work shall be complete, and all appurtenant work, materials, and services not expressly shown or called for in the Construction Documents which may be necessary for the complete and proper construction of the Work in good faith shall be performed, furnished, and installed by the Contractor as though originally specified or shown. The Contractor will be compensated for actual work performed in accordance with the unit prices and provisions contained in these Construction Documents.

Base Bid Total: $ 249, 68. 07 — Two Hundred Forty -Nine Thousand Six Hundred Ninety -Eight dollars and 7 cents.

3. Construction Documents. This Contract shall include the Construction Documents which are on file with the Public Works Department and are hereby incorporated by reference i.e. Project Specifications, Project Plans, addenda, performance bond, labor and materials bond, certification of insurance, workers compensation certification, and Warranty Bond Acknowledgement) and the Bid Documents submitted by Hensley' sPaving and General 224

Engineering, Inc._ on September 15, 2026. For the purposes of construing, interpreting and resolving inconsistencies between the provisions of this Contract, these documents and the provisions thereof are set forth in the order of precedence described in Article 3 of the General Conditions.

4. Compensation. In consideration of Contractor' sperfoinuance of its obligations hereunder, City shall pay to Contractor the amount set forth in Contractor' sBid in accordance with the provisions of this Contract and upon the receipt of written invoices and all necessary supporting documentation within the time set forth in the Construction Documents.

Contractor hereby shall not be permitted to invoice the City nor accept compensation for work not yet complete. In no event, shall the Contractor be entitled to payment for work not included in the approved scope of work, a written task order, or change order signed by the City' s
Public Works Director prior to commencement of any work.

5. Insurance. On or before the Date of Execution, Contractor shall obtain and maintain the policies of insurance coverage described in Section 5. 2 of the General Conditions on terms and conditions and in amounts as may be required by the City. City shall not be obligated to take out insurance on Contractor' spersonal property or the personal property of any person performing labor or services or supplying materials or equipment under the Project.

Contractor shall furnish City with the certificates of insurance and with original endorsements effecting coverage required under this Contract on or before the Date of Execution. The certificates and endorsements for each insurance policy shall be signed by a person who is authorized by that insurer to bind coverage in its behalf. Proof of insurance shall be mailed to the Project Manager to the address set forth in Section 15 ofthis Contract.

6. Indemnification. Contractor agrees to protect, defend, indemnify and hold City, its City Council members, officers, employees, engineer, and construction manager harmless from and against any and all claims, demands, liabilities, losses, damages, costs, expenses, liens, penalties, suits, or judgments, arising in whole or in part, directly or indirectly, at any time from any injury to or death of persons or damage to property as a result of the willful or negligent act or omission of Contractor, or which results from Contractor' snoncompliance with any Law respecting the condition, use, occupation or safety of the Project site, or any part thereof, or which arises from Contractor' sfailure to do anything required under this Contract or for doing anything which Contractor is required not to do under this Contract, or which arises from conduct for which any Law imposes strict liability on Contractor in the performance of or failure to perform the terms and conditions of this Contract, except as may arise from the sole willful or negligent act or omission of City or any of its City Council members, officers, employees. This indemnification shall extend to any and all claims, demands, or liens made or filed by reason of any construction, renovation, or remodeling work performed by Contractor under this Contract at any time during the term of this Contract, or arising thereafter.

7. Assumption of Risk. Contractor agrees to voluntarily assume any and all risk of loss, damage, or injury to the property of Contractor which may occur in, on, or about the Project site at any time and in any manner, excepting such loss, injury, or damage as may be caused 225

by the sole willful or negligent act or omission of City or any of its City Council members, officers, or employees.

8. Waiver. The acceptance of any payment or performance, or any part thereof, shall not operate as a waiver by City of its rights under this Contract. A waiver by City of any breach of any part or provision of this Contract by Contractor shall not operate as a waiver or continuing waiver of any subsequent breach of the same or any other provision, nor shall any custom or practice which may arise between the parties in the administration of any part or provision of this Contract be construed to waive or to lessen the right of City to insist upon the performance of Contractor in strict compliance with the covenants, terms and conditions of this Contract.

9. Com fiance with Laws. Contractor shall comply with all Laws now in force or which may hereafter be in force pertaining to the Project and Work and this Contract, with the requirement of any bond or fire underwriters or other similar body now or hereafter constituted, with any discretionary license or permit issued pursuant to any Law of any public agency or official as well as with any provision of all recorded documents affecting the Project site, insofar as any are required by reason of the use or occupancy of the Project site, and with all Laws pertaining to nondiscrimination and affirmative action in employment and hazardous materials.

DEPARTMENT OF INDUSTRIAL RELATIONS- COMPLIANCE MONITORING UNIT DIR Registration.
a) Contractor and Subcontractor Com- iliance. Strict compliance with DIR registration requirements pursuant to Labor Code Section 1725. 5 is a material obligation of the Contractor under the Contract Documents. The foregoing includes without limitation, compliance with DIR Registration requirements at all times during performance of the Work by the Contractor and all Subcontractors of any tier. The failure of the Contractor and all Subcontractors of every tire to be DIR registered at all times during the performance of the Work is the Contractor' sdefault of a material obligation of the Contractor under the Contract Documents.
b) No Subcontractor Perfoiniance of Work Without DIR Registration. No portion of the Work is permitted to be performed by a Subcontractor of any tier unless the Subcontractor is a DIR Registered contractor.
c) Contractor Obligation to Verify Subcontractor DIR Registration Status. An affirmative and on -going obligation of the Contractor under the Contract Documents is the Contractor' sverification that all Subcontractors, of all tiers, are at all times during performance of Work in full and strict compliance with DIR Registration requirements.

The Contractor shall not permit or allow any Subcontractor of any tier to perform any Work 226

without the Contractor' sverification that all such Subcontractors are in full and strict compliance with DIR Registration requirements.
d) Contractor Obligation to Recuest Substitution of Non- DIR Registered Subcontractor. If any Subcontractor identified in the Contractor' sSubcontractor List submitted with the Contractor' sproposal for the Work is not DIR Registered at the time of opening of proposals for the Work or if a Subcontractor' sDIR registration lapses prior to or during a Subcontractor' sperformance of Work, the Contractor shall request the CITY' s consent to substitute the non- DIR registered Subcontractor pursuant to Labor Code Section 1771.(c)( 3) and/ or Labor Code Section 1771.(d).

Certified Payroll Records
a) Compliance with Labor Code Section 1771. 4 and 1776. A material obligation of the Contractor under the Contract Documents is: (i) the Contractor' sstrict compliance with the requirements pursuant to Labor Code Section 1771. 4 and 1776 for preparation and submittal of Certified Payroll Records (" CPR"); and ( ii) the Contractor' senforcement of CPR preparation and submittal for all Subcontractors of every tier. b) Express Condition Precedent to Payment of Contract Price. Strict compliance with CPR requirements established pursuant to Labor Code Section 1776 is an express condition precedent to the CITY' sobligation to: (i) process any request for payment of any portion of the Contract Price; or ( ii) to disburse any portion of the Contract Price to the Contractor.

The Contractor shall demonstrate strict compliance with CPR preparation and submittal requirements by delivery to the CITY of electronic files or hard copies of all CPR' s submitted by the Contractor and/ or Subcontractors for Work pursuant to Labor Code Section 1771. 4 and 1776 concurrently with the submittal thereof to the Labor Commissioner. The CITY: (i) shall not be obligated to process or disburse any portion of the Contract Price; or (ii) shall not be deemed in default of the CITY' sobligations under the Contract Documents unless the Contractor' sdemonstrates strict compliance with CPR preparation and submittal requirements.
c) PWR Monitoring and Enforcement. During the Work pursuant to Labor Code Section 1771. 4(a)(), the Department of Industrial Relations shall monitor and enforce the obligation of the Construction and Subcontractors of every tier to pay the laborers performing any portion of the work the PWR established for the classification of work/ labor performed.

Record of wages paid: Inspection
Pursuant to Labor Code section 1776, Contractor stipulates to the following:
a) Contractor and each subcontractor shall keep an accurate payroll record, showing the naive, address, social security number, work classification, straight time and overtime hours 227

worked each day and week, and the actual per diem wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work under the Facilities lease and Construction Provisions. Such records shall be on forms provided by the Division of Labor Standards Enforcement or shall contain the same information of such forms. The payroll records may consist of payronata that are maintained as computer records, if printouts contain the same information as the forms provided by the division and the printouts are verified as specified in subdivision ( a) of Labor Code section 1776.
b) The payroll records enumerated under subdivision ( a) shall be certified and shall be available for inspection at all reasonable hours at the principal office of Contractor on the following basis:
1) A certified copy of an employee' spayroll record shall be made available for inspection or furnished to such employees or his or her authorized representative on request.
2) A certified copy of all payroll records enumerated in subdivision ( a) shall be made available for inspection or furnished upon request to a representative of the CITY, the Division of Labor Standards Enforcement, and Division of Apprenticeship Standards of the Department of Industrial Relations.
3)A certified copy of all payroll records enumerated in subdivision ( a) shall be made available upon request by the public for inspection or copies thereof. However, a request by the public shall be made through either the CITY, the Division of Apprenticeship Standards, or the Division of Labor Standards Enforcement. If the requested payroll records have not been provided pursuant to paragraph ( 2), the requesting party shall, prior to being provided the records, reimburse the costs of preparation by Contractor, subcontractors, and the entity through which the request was made. The public shall not be given access to such records at the principal office of Contractor.
c) Contractor shall file a certified copy of the records enumerated in subdivision ( a) with the entity that requested such records within ten ( 10) days after receipt of the written request. d) Any copy of records made available for inspection as copies and furnished upon request to the public or any public agency, by the CITY, the Division of Apprenticeship Standards, or the division of Labor Standards Enforcement shall be marked or obliterated in such a manner as to prevent disclosure of an individual' s name, address and social security number. The name and address of contractor awarded the contract or performing the contract shall not be marked or obliterated.

e) Contractor shall inform the CITY of the location of the records enumerated under subdivision ( a), including the street address, city, and county, and shall, within ( 5) working days, provide a notice of a change of location and address. f) In the event of noncompliance with the requirements of this Article, Contractor shall have ten ( 10) days in which to comply subsequent to receipt of written notice specifying in what respects Contractor must comply with this Article. Should noncompliance still be evident after such 10 -day period, Contractor shall pay a penalty of One- Hundred Dollars ($ 100. 00) to the CITY for each calendar day, or portion thereof, for each worker, until strict compliance is effectuated. Upon the request of the Division of Apprenticeship Standards or the Division of Labor Standards Enforcement, such penalties shall be withheld from the progress payment then due.

The responsibility for compliance with this Article shall rest upon Contractor.

10. Bonds. As a condition precedent to City' s obligation to pay compensation to Contractor, and on or before the date of Execution, Contractor shall furnish to the Project Manager the Bonds as required under Section 00700 -

11. Representations and Warranties. In the supply of any materials and equipment and the rendering of labor and services during the course and scope of the Project and Work, Contractor represents and warrants:
1) Any materials and equipment which shall be used during the course and scope of the Project and Work shall be vested in Contractor;
2) Any materials and equipment which shall be used during the course and scope of the Project and Work shall be merchantable and fit to be used for the particular purpose for which the materials are required;
3) Any labor and services rendered and materials and equipment used or employed during the course and scope of the Project and Work shall be free of defects in workmanship for a period of one ( 1) year after the recordation of the Notice of Substantial Completion, or, if no such notice is required to be filed, on the date that final payment is made hereunder;
4) Any manufacturer' swarranty obtained by Contractor shall be obtained or shall be deemed obtained by Contractor for and on behalf of City. 5) Any information submitted by Contractor prior to the award of Contract, or thereafter, upon request, whether or not submitted under a continuing obligation by the terms of the Contract to do so, is true and correct at the time such information is submitted or made available to the City;

6) Contractor has not colluded, conspired, or agreed, directly or indirectly, with any person in regard to the terms and conditions of Contractor' sBid, except as may be permitted by the Notice to Contractors;
7) Contractor has the power and the authority to enter into this Contract with City, that the individual executing this Contract is duly authorized to do so by appropriate resolution, and that this Contract shall be executed, delivered and performed pursuant to the power and authority conferred upon the person or persons authorized to bind Contractor;
8) Contractor has not made an attempt to exert undue influence with the Project Manager or any other person who has directly contributed to City' s decision to award the Contract to Contractor;
9) There are no unresolved claims or disputes between Contractor and City which would materially affect Contractor' sability to perform under the Contract; 10) Contractor has furnished and will furnish true and accurate statements, records, reports, resolutions, certifications, and other written infoiniation as may be requested of Contractor by City from time to time during the term of this Contract; 11) Contractor and any person performing labor and services under this Project is duly licensed as a contractor with the State of California as required by California Business & Professional Code Section 7028, as amended; and 12) Contractor has fully examined and inspected the Project site and has full knowledge of the physical conditions of the Project site.

12. Assignment. This Contract and the perfoiniance required hereunder is personal to Contractor, and it shall not be assigned by Contractor. Any attempted assignment shall be null and void.

13. Claims of Contractor. All claims pertaining to extra work, additional charges, or delays within the Contract Time or other disputes arising out of the Contract shall be submitted by Contractor in accordance with the General Conditions.

14. Audits by City. During the term of this Contract and for a period of not less than three ( 3) years after the expiration or earlier termination of this Contract, City shall have the right to audit Contractor' sProject -related and Work -related writings and business records, as such terms are defined in California Evidence Code Sections 250 and 1271, as amended, during the regular business hours of Contractor, or, if Contractor has no such hours, during the regular business hours of City.

15. Notices. All contracts, agreements, appointments, approvals, authorizations, claims, demands, Change Orders, consents, designations, notices, offers, requests and statements given by either party to the other shall be in writing and shall be sufficiently given and 230

16. Miscellaneous.
1) Bailee Disclaimer. The parties understand and agree that City does not purport to be Contractor' sbailee, and City is, therefore, not responsible for any damage to the personal property of Contractor.
2) Consent. Whenever in this Contract the approval or consent of a party is required, such approval or consent shall be in writing and shall be executed by a person having the express authority to grant such approval or consent. 3) Controlling Law. The parties agree that this Contract shall be governed and construed by and in accordance with the Laws of the State of California. 4) Definitions. The definitions and terms are as defined in these specifications. 231

5) Force Majeure. Neither party shall be deemed to be in default on account of any delay or failure to perform its obligations under this Contract, which directly results from an Act of God or an act of a superior governmental authority. 6) Headings. The paragraph headings are not a part of this Contract and shall have no effect upon the construction or interpretation of any part of this Contract. 7) Incorporation of Documents. All documents constituting the Construction Documents described in Section 3 hereof and all documents which may, from time to time, be referred to in any duly executed amendment hereto are by such reference incorporated in this Contract and shall be deemed to be part of this Contract.

Integration. This Contract and any amendments hereto between the parties constitute the entire contract between the parties concerning the Project and Work, and there are no other prior oral or written contracts between the parties that are not incorporated in this Contract.

9) Modification of Contract. This Contract shall not be modified or be binding upon the parties unless such modification is agreed to in writing and signed by the parties. 10) Provision. Any contract, covenant, condition, clause, qualification, restriction, reservation, term or other stipulation in the Contract shall define or otherwise control, establish, or limit the performance required or permitted or to be required of or permitted by either party. All provisions, whether covenants or conditions, shall be deemed to be both covenants and conditions.
11) Resolution. Contractor shall submit with its Bid a
copy of any corporate or
partnership resolution or other writing, which authorizes any director, officer or other employee or partner to act for or on behalf of Contractor or which authorizes Contractor to enter into this Contract.
12) Severability. If a court of competent jurisdiction finds or rules that any provision of this Contract is void or unenforceable, the provisions of this Contract not so affected shall remain in full force and effect.
13) Status of Contractor. In the exercise of rights and obligations under this Contract, Contractor acts as an independent contractor and not as an agent or employee of City. Contractor shall not be entitled to any rights and benefits accorded or accruing to the City Council members, officers or employees of City, and Contractor expressly waives any and all claims to such rights and benefits. 14) Successors and Assigns. The provisions of this Contract shall inure to the benefit of, and shall apply to and bind, the successors and assigns ofthe parties. 15) Time of the Essence. Time is of the essence of this Contract and each of its provisions. In the calculation of time hereunder, the time in which an act is to be 232

performed shall be computed by excluding the first Day and including the last. If the time in which an act is to be performed falls on a Saturday, Sunday, or any Day observed as a legal holiday by City, the time for performance shall be extended to the following Business Day.
16) Venue. In the event that suit is brought by either party hereunder, the parties agree that trial of such action shall be vested exclusively in the state courts of California in the County of San Joaquin or in the United States District Court for the Eastern District of California.
17) Recovery of costs. The prevailing party in any action brought to enforce the terms of this Contract or arising out of this Contract, including the enforcement of the indemnity provision( s), may recover its reasonable costs, including reasonable attorney' sfees, incurred or expended in connection with such action against the non -prevailing party.
18) Contractor and subcontractors must comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 USC 1857( h)), Section 508 of the Clean Water Act ( 33 USC1368), Executive Order 11738, and Environmental Protection Agency Regulations at 40 CFR Part 15. 19) Contractor and subcontractors must comply with the regulations imposed by California Air Resources Board (" CARB") including, without limitation, Title 13, California Code of Regulations Division 3, Chapter 9, and all pending amendments Regulation").
20) Contractors and subcontractors must comply with mandatory standards and policies relating to the energy efficiency which are contained in the State Energy Conservation Plan issued in compliance with the Energy Policy and Conservation ACT (Public Law 94- 163, 89 stat 871).
21) The Contractor shall provide access to the site for the Environmental Protection Agency and its duly authorized representatives, and the City. 22) If during the course of construction evidence of deposit of historical or archaeological interest is found, the Contractor shall cease operation affecting the find and shall notify the City, who shall notify the EPA and the State Historic Preservation Officer. No further disturbance of the deposits shall ensue until the Contractor has been notified by the City that construction may proceed. The City will issue a notice to proceed only after the state official has surveyed the find and made a determination to the EPA and the City. Compensation to the contractor, if any, for lost time or changes in construction to avoid the find, shall be determined in accordance with changed conditions or change order provisions of the Construction Documents.

23) Notice to Proceed. Prior to commencing work under this Contract, CONTRACTOR shall receive a written " Notice to Proceed" from CITY. A Notice to Proceed shall not be issued until all necessary bonds and insurances have been received. City shall not be obligated to pay CONTRACTOR for any services prior to issuance of the Notice to proceed.
24) Signatures. The individuals executing this Contract represent and warrant that they have the right, power, legal capacity, and authority to enter into and to execute this Contract on behalf of the respective legal entities of the CONTRACTOR and the CITY. This Contract shall inure to the benefit of and be binding upon the parties hereto and their respective successors and assigns.
25) This project is a public works project: Contractor shall comply with requirements of California Labor Code § 1700 and following, and prevailing wages shall be paid for work performed on this project.
26) The statutory provisions for penalties for failing to comply with the State of California wage and labor laws will be enforced, as well as that for failing to pay prevailing wages.

CERTIFICATION OF DRUG -FREE WORKPLACE REQUIREMENTS

BIDDER CERTIFICATIONS

1. The Bidder certifies that it will or will continue to provide a drug -free work place by:

A. Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the Bidder' swork place and specifying the actions that will be taken against employees for violation of such prohibition:

1. Making it a
requirement that each employee to be engaged in the performance of the contract be given a
copy of the statement.

2. Notifying the employee in the statement that, as a condition of employment under the Contract, the employee will:
a. Abide by the terms of the statement.
b. Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring in the work place no later than 5 calendar days after such conviction:
1) Notifying the Owner in writing within 10 calendar days after receiving notice from an employee or otherwise receiving actual notice of such conviction.
2) Taking 1 of the following actions, within 30 calendar days of receiving notice, with respect to any employee who is so convicted:

SUMMARY:

Old Dominion Freight Line, Inc. ( ODFL), the developer of the ODFL Stockton Expansion project located at 601 D' Arcy Parkway, has completed the public improvements associated with Encroachment Permit ( EP) No. 2021- 54. A vicinity map of the improvements is included as Attachment " B".

Staff has inspected the improvements listed in Attachment " C" and the City Engineer has deemed them complete and in compliance with the approved plans and specifications. The approximate value of the improvements constructed is 232, 659. 00, as shown in the GASB 34 Report included as Attachment " C".

A portion of the sidewalk was required to be routed around an existing street light.

To maintain the minimum sidewalk width required by City standards and the Americans with Disabilities Act ( ADA), that portion of the sidewalk was constructed outside the existing public right- of- way and onto property owned by ODFL. ODFL has offered to dedicate a sidewalk easement to the City over the affected area. The offer of dedication, together with the legal description and plat attached thereto as Exhibits A" and " B", is included in substantially the form attached hereto as Attachment " D".

ODFL has provided lien releases and a one- year warranty bond for the improvements proposed for acceptance. The warranty bond was provided in the amount of 232, 659. 00, equal to 100% of the improvement value shown in the GASB 34 Report, which exceeds the City' s
minimum requirement of 10% of the completed construction costs.

Staff requests that City Council accept the public improvements listed in Attachment C" and the offer of dedication for the sidewalk easement, in substantially the form included as Attachment " D".

BACKGROUND:

On May 20, 2021, the City of Lathrop Community Development Director approved Minor Site Plan Review No. MSPR- 21- 33 and Minor Variance No. MV -21- 65 for the ODFL Stockton Expansion, authorizing a 21, 000 -square -foot cross -dock expansion to the existing 30, 250 -square -foot cross -dock building and a 5, 800 -square -foot office at 601 D' Arcy Parkway ( APN 198- 220- 03).

The Conditions of Approval ( COAs) associated with MSPR- 21- 33and MV -21- 65 required the installation of frontage improvements along D' Arcy Parkway, including, but not limited to, a five-oot sidewalk at the existing back of curb and the reconstruction or modification of existing driveways to accommodate the sidewalk and maintain ADA compliance. The work, along with a sewer utility connection within D' Arcy Parkway, was completed under EP 2021- 54.

During construction, the sidewalk was required to be routed around an existing street light within the D' Arcy Parkway frontage. To maintain the minimum sidewalk width required by City standards and the ADA, a portion of the sidewalk was constructed outside the existing public right- of- way and onto propertyowned by ODFL. ODFL has offered to dedicate a sidewalk easement to the City over that portion of its property, included as Attachment " D". Acceptance of the offer of dedication is required for the City to accept and maintain the sidewalk as a public improvement. Upon Council acceptance, the easement will be executed and recorded with the San Joaquin County Recorder' sOffice.

Staff has inspected the public improvements associated with EP 2021- 54 as listed in Attachment " C", and the City Engineer has deemed them complete and in compliance with the approved plans and specifications.

ODFL has submitted a one- year warranty bond in the amount of $232, 659. 00, along with lien releases for the improvements proposed for acceptance. Upon acceptance, the faithful performance bond will be released and replaced with the warranty bond.

The guarantee associated with the improvements proposed for acceptance is detailed in Table 1 below:

FISCAL IMPACT:

The City' s
maintenance costs will increase to maintain the accepted improvements.

The warranty bond will cover any repairs or replacements due to defective materials or workmanship required during the one- year period beginning with this acceptance.

The future operating and maintenance costs of these improvements will be funded by the. Council approved Local Street Fund 2080.

WHEREAS, ODFL has submitted a one- year warranty bond in the amount of 232, 659. 00, along with lien releases for the improvements proposed for acceptance.

SUMMARY:

Creative Property Renewal, Inc. ( Creative Property Renewal), has completed construction of Temporary Animal Center Renovation, CIP GG 26-8 (Project).

City staff have inspected the work, and the City Engineer has determined that the improvements have been completed in accordance with the approved plans and specifications. Creative Property Renewal has submitted lien releases confirming that all subcontractors and suppliers have been paid in full. A one- year warranty bond equal to 10% of the° construction contract amount been provided for the improvements being accepted.

Staff request that City Council accept the public improvements completed by Creative Property Renewal for the Project. Staff request that Council authorize the filing of the Notice of Completion with the San Joaquin County Clerk, release of contract retention totaling $ 10,86 to Creative Property Renewal within forty-ive (45) days after the Notice of Completion is recorded and the release of performance and payment bonds associated with the Project.

Following acceptance, staff request that any unused project funds be returned to the funding source.

BACKGROUND:

On February 9, 2026, City Council awarded a construction contract to Creative Property Renewal for $ 170, 97, approved a 20% contingency of $ 34, 000 and authorized staff to spend up to the amount of the contingency as necessary to achieve the goals of the Project. The Project consisted of five main scopes of work, including replacing damaged synthetic turf and improving drainage in dog kennel areas, adding rain gutters and leaders to kennel roofs, and sealing existing concrete surfaces. 269

Creative Property Renewal has completed the Project pursuant to the contract documents dated February 9, 2026. Staff have inspected the improvements, and they have been deemed complete and in accordance with the approved plans and specifications by the City Engineer.

Creative Property Renewal has submitted a one- year warranty bond for the improvements to be accepted ( based on 10% of the construction contract) and lien releases confirming all sub -contractors and suppliers have been paid in full. The warranty bond covers any repairs or replacements that become necessary during the one- year period, beginning with this acceptance, due to defective materials or workmanship in connection with the completed improvements.

The performance bond and payment bond will be released and replaced with the oneyear warranty bond upon City Council' sacceptance of the improvements.

FISCAL IMPACT:

The awarded contract was for $ 170, 97, with an authorized 20% construction contingency of $ 34, 000, for a total construction budget of $ 204, 907. During construction, three change orders totaling $ 32, 812 were issued for a final contract cost of $ 203, 719. Sufficient funds were allocated to CIP GG 26-8 in the adopted Fiscal Year 2026-7 budget to fund all expenses and close out the Project. Following acceptance, staff request that any unused project funds be returned to the funding source.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LATHROP TO ACCEPT

PUBLIC IMPROVEMENTS CONSTRUCTED BY CREATIVE PROPERTY RENEWAL, INC. FOR TEMPORARY ANIMAL CENTER RENOVATION, CIP GG 26-8, AND

AUTHORIZE THE FILING OF A NOTICE OF COMPLETION, THE RELEASE OF

CONTRACT RETENTION, AND THE RELEASE OF PERFORMANCE AND PAYMENT BONDS
WHEREAS, on February 9, 2026, City Council awarded a contract to Creative Property Renewal, Inc. (Creative Property) for construction of Temporary Animal Center Renovation, CIP GG 26-8 (Project) in the amount of $ 170, 97, approved a 20% construction contingency of $ 34, 000 and authorized staff to spend up to the amount of the contingency as necessary to achieve the goals of the Project; and WHEREAS, the scope of work included renovating areas of artificial turf and rigid siding and decking to restore areas damaged by dogs; and WHEREAS, City staff have inspected the work, and the City Engineer has determined that the improvements have been completed in accordance with the approved plans and specifications; and
WHEREAS, Creative Property has submitted lien releases confirming that all subcontractors and suppliers have been paid in full, and a one- year warranty bond equal to 10% of the construction contract amount for the improvements being accepted; and
WHEREAS, staff request that City Council accept the public improvements constructed by Creative Property for the Project; and
WHEREAS, staff also request that City Council authorize the filing of a Notice of Completion with the San Joaquin County Clerk, the release of contract retention to Creative Property in the amount of $ 10,86 within forty-ive (45) days after the recording of the Notice of Completion, and the release of performance and payment bonds; and
WHEREAS, upon City Council' s
acceptance of the improvements, the
performance and payment bonds ( Bond No. GSA02500382) will be released and replaced with a one- year warranty bond in the amount of $ 20, 371 (Bond No.

GSA02500382); and
WHEREAS, the warranty bond ensures coverage for any necessary repairs or replacements due to defective materials or workmanship discovered within one year from the date of acceptance; and
WHEREAS, during construction, three change orders totaling $ 32, 812 were issued, bringing the final contract cost to $ 203, 719;• and 272
WHEREAS, following acceptance, staff request that any unused project funds be transferred back to the funding source.

NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Lathrop does hereby accept the public improvements constructed by Creative Property Renewal, Inc. for Temporary Animal Center Renovation, CIP GG 26-8; and BE IT FURTHER RESOLVED, that City Council authorizes the filing of the Notice of Completion with the San Joaquin County Clerk, release of contract retention to Creative Property in the amount of $ 10,86 within forty-ive (45) days after the recording of the Notice of Completion, and release of performance and payment bonds; and
BE IT FURTHER RESOLVED, that City Council authorizes the return of unused project funds to the funding source.

SUMMARY:

LaFleur Engineering, Inc. ( LaFleur), has completed construction of Capital Improvement Project ( CIP) PW 24- 12, East Lathrop Water Main and Laterals Upgrades ( Project). The scope of work included the upgrade of designated portions of the City' swater system within the area bounded by Louise Avenue, Bizzibe Street, Cambridge Drive, and " O" Street.

City staff inspected the work, and the City Engineer has determined that the improvements have been completed in accordance with the approved plans and specifications. LaFleur has submitted lien releases confirming that all subcontractors and suppliers have been paid in full. In addition, a one- year warranty bond, equal to 10% of the construction contract amount, has been provided to ensure the continued integrity of the improvements.

Staff requests that the City Council accept the improvements completed by LaFleur for the Project. Staff also requests that Council authorize the following actions:

Filing of the Notice of Completion with the San Joaquin County Clerk; and Release of contract retention totaling $ 87, 128 to LaFleur, to occur within fortyfive ( 45) days after the Notice of Completion is recorded; and Release of the performance and payment bonds associated with the Project.

BACKGROUND:

The East Lathrop Water Main and. Lateral Upgrades, Capital Improvement Project CIP) PW 24- 12 (Project) was established to upgrade designated portions of the City' s water system within the area bounded by Louise Avenue, Bizzibe Street, Cambridge Drive, and " O" Street.

On December 8, 2025, City Council approved a construction contract with LaFleur for construction of CIP PW 24- 12 East Lathrop Water Main and Lateral Upgrades. The scope of work included the replacement of approximately 4, 700 feet of 6 -inch asbestos concrete pipe with new 8 -inch PVC mains and new water service laterals.

LaFleur has completed construction of the Project. City staff conducted a final inspection, and the City Engineer has determined that all improvements were completed in accordance with the approved plans and specifications.

Staff requests City Council accept the public improvements constructed by LaFleur for the Project. Staff also requests City Council authorize the filing of a Notice of Completion with the San Joaquin County Clerk, the release of contract retention to LaFleur in the amount of $ 87, 128 within forty-ive (45) days after the recording of the Notice of Completion, and the release of performance and payment bonds.

REASON FOR RECOMMENDATION:

Upon City Council' s
acceptance of the improvements, the performance and payment bonds will be released and replaced with a one- year warranty bond in the amount of 174, 257. The warranty bond ensures coverage for any necessary repairs or replacements due to defective materials or workmanship discovered within one year from the date of acceptance.

FISCAL IMPACT:

The awarded contract amount was $ 1, 719, 237, and a 15% construction contingency of $ 257, 886 was authorized, for a total construction budge t of $ 1, 977, 123.

During construction, two contract change orders were issued in the amount of 23, 332, resulting in a final construction cost of $ 1, 742, 569. Staff request that the unused project funds be returned to the Water Connection Fee Fund 5610.

Mozingo Construction, Inc. ( Mozingo), has completed construction of McKinley Avenue Force Main Intertie, Capital Improvement Project ( CIP) WW 25-3 (Project).

City staff has inspected the work, and the City Engineer has determined that the improvements were completed in accordance with the approved plans and specifications. Mozingo has submitted lien releases confirming that all subcontractors and suppliers have been paid in full. A one- year warranty bond equal to 10% of the construction contract amount has been provided for the improvements being accepted.

Staff request that City Council accept the public improvements completed by Mozingo for the Project. Staff also request that Council authorize the filing of the Notice of Completion with the San Joaquin County Clerk, the release of contract retention totaling $ 197, 460 to Mozingo within forty-ive (45) days after the Notice of Completion is recorded, and the release of performance and payment bonds.

Following acceptance, staff request that any unused project funds be returned to the Wastewater Connection Fee Fund ( Fund 6030) and General Fund Reserve ( Fund 1010).

BACKGROUND:

On September 8, 2025, City Council adopted Resolution No. 25- 5882, approving a construction contract with Mozingo for $ 3, 758,11, a 15% construction contingency of $ 563, 807, and authorizing staff to expend contingency funds as necessary to achieve project goals. City Council also approved a budget amendment of $4, 322, 518 to fund construction of the Project.

The Project consisted of installing approximately 3, 700 linear feet of 16 -inch PVC force main, 1, 270 linear feet of 6 -inch PVC force main, and 1, 000 linear feet of 3 - inch PVC force main; a 330 -foot jack -and - bore crossing beneath existing railroad 287

infrastructure, modifications to existing pump stations; and the installation of air release valves, flushing stations, electrical conduit with pull boxes, and cathodic protection systems.

During construction, Change Order No. 1 was issued in the amount of $ 190, 481 to address railroad permit requirements for the jack -and - bore crossing, relocation of conflicting communication boxes and an existing flow meter, install a line stop, plug valve, and air release valve, and accommodate hot mix asphalt price increases. This work was funded through the approved project contingency.

REASON FOR RECOMMENDATION:

Mozingo has completed the Project pursuant to the contract documents dated September 8, 2025. Staff has inspected the improvements, and the City Engineer has determined they are complete and compliant with the approved plans and specifications.

Mozingo has submitted all required lien releases and provided a one- year warranty bond ( equal to 10% of the construction contract). The warranty bond covers any necessary repairs or replacements due to defective materials or workmanship for one year following acceptance. Upon City Council acceptance, the performance and payment bonds will be released and replaced by the one- year warranty bond.

FISCAL IMPACT:

The awarded contract was $ 3, 758,11, with an authorized 15% contingency of 563, 807, for a total budget of $ 4, 322, 518. During construction, one ( 1) change order totaling $ 190, 481 was issued, resulting in a final contract cost of $ 3, 949, 192.

Sufficient funds were allocated to CIP WW 25-3 in the adopted Fiscal Year 2026-7 budget to cover all expenses and close out the Project. Following acceptance, staff requests that all remaining unused project funds be returned to the Wastewater Connection Fee Fund ( Fund 6030) and General Fund Reserve ( Fund 1010).

WHEREAS, during construction, Change Order No. 1 was issued in the amount of $ 190, 480. 86to address railroad permit requirements for the jack -and - bore crossing, relocation of conflicting communication boxes and an existing flow meter, install a line stop, plug valve, and air release valve, and accommodate hot mix asphalt price increases, funded through the approved project contingency and bringing the final contract cost to $ 3, 949, 191. 86; and
WHEREAS, following acceptance, staff requests that all remaining unused project funds be transferred back to the Wastewater Connection Fee Fund ( Fund 6030) and General Fund Reserve ( Fund 1010).

NOW THEREFORE, BE IT RESOLVED, that .the City Council of the City of Lathrop does hereby accept the public improvements constructed by Mozingo Construction, Inc. (Mozingo) for McKinley Avenue Force Main Intertie Project, CIP WW 25-3; and
BE IT FURTHER RESOLVED, that City Council authorizes the filing of the Notice of Completion with the San Joaquin County Clerk, release of contract retention to Mozingo in the amount of $ 197, 459. 5 within forty-ive (45) days after the recording of the Notice of Completion, and release of performance and payment bonds; and
BE IT FURTHER RESOLVED, that City Council authorizes the return of all remaining unused project funds into the Wastewater Connection Fee Fund ( Fund 6030) and General Fund Reserve ( Fund 1010).

SUMMARY:

The Lathrop City Council approved four (4) School Resource Officers ( SRO) as part of the Lathrop Police Department. The Lathrop Police Department currently assigns one ( 1) SRO to Banta Unified School District public school campuses in the City of Lathrop. Having an SRO on campus enhances student and staff safety and fosters positive relationships between law enforcement and the school community.

The proposed agreement outlines the responsibilities of each party involved including indemnification to address potential liability associated with providing the SRO services.

Staff recommends City Council approve the agreement between the City of Lathrop and Banta Unified School District to provide school resource officer services for 2026- 2027 School Year through the 2028-029 School Year.

INTERAGENCY AGREEMENT BETWEEN THE CITY OF LATHROP AND BANTA

UNIFIED SCHOOL DISTRICT FOR SCHOOL RESOURCE OFFICER SERVICES This Agreement, dated for convenience this day of , 2026, is by and between BANTA UNIFIED SCHOOL DISTRICT (" District") and the CITY OF LATHROP, a California Municipal Corporation (" City"). The City and District may be referred to herein as Party" or collectively "Parties".

RECITALS
WHEREAS, the City will assign one ( 1) Lathrop Police Department Officer as School Resource Officers ( SRO) to its District public school campuses on a rotational basis; and WHEREAS, the terms and conditions of the Agreement are intended to apply for the next three (3) school years ending in June of 2029; and WHEREAS, the Parties anticipate the assigned officers' off -campus duties and travel between campuses will take the officers off -campus and result in the lack of the presence of an officer and marked vehicle during such times; and
WHEREAS, the Parties agree that the absence of the assigned officer and/ orthe patrol vehicle from a school campus shall not be considered a breach of this Agreement; and NOW, THEREFORE, in consideration of the recitals, covenants, terms, and conditions in this Agreement, DISTRICT and the CITY agree as follows:

AGREEMENT
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the City and District hereby agree as follows:

1. Defined Terms. Capitalized terms used in this Agreement are given the following meanings:
a. " City" means the City of Lathrop, a California municipal corporation and public body, its employees, agents and its invitees pursuant to applicable law. b. " District" means the Banta Unified School District, its Board of Trustees, employees ( both full and part time), students and its invitees pursuant to applicable law.
c. " Effective Date" means this Agreement shall be effective upon the date of full execution hereof by the Parties.

d. " Agreement" means this Agreement, including the Recitals and the Exhibits.
e. " SRO" means a School Resource Officer employed by the City and subject to the City' s administration, supervision and control.

2. Responsibilities of School Resource Officers.
a. Provision of SROs. At no cost to the District, the City shall provide School Resources Officers (" SROs") at the District' sschools for the days and hours described below.
b. SRO Purpose. The City recognizes the primary role and assignment for the SROs is to provide services to the District within Lathrop City limits as outlined in this Agreement. The City' s
Police Department will endeavor to ensure those officers assigned as SROs will not be routinely used to provide other law enforcement services not directly linked to the SRO program. However, both the Parties recognize and acknowledge the primary function of each officer assigned as an SRO is that of a Police Officer. As each SRO generally wears a police uniform and drives a marked police vehicle, they may often be flagged down and/ or expected to take law enforcement action by the public. The City also recognizes in many instances when an SRO may not be available to respond to a request for a call for service from the District, a Police Officer normally assigned to patrol or not routinely assigned to function as an SRO may respond. In the event both District -assigned SROs are unavailable or out of the office, the remaining SRO Team will be available to respond to any calls for service made during the course of their normal workday. The Police Department agrees to continue to ensure calls for service for the District will be handled by an officer not assigned as an SRO to maintain the peace, ensure the protection of Life and/ or property, or when delaying the call for service for an SRO would otherwise be unacceptable or impractical based on the circumstances.

Assigned SROs may be pulled from their primary role due to emergency situations, minimum staffing requirements, and to assist in patrol operations within the City. In such situations, SROs will not be replaced until the situation has abated. c. Control of SROs. The SROs shall be employees of the City and shall be subject to the administration, supervision, and control of the City. The SROs shall be subject to all personnel policies and practices of the Police Department, except as such policies or practices may be modified by the terms and conditions of this Agreement. The City' s
Police Department, in its sole discretion, shall have the power and authority to hire, discharge, and discipline SROs. District principal may request that, at the Chief of Police' sdiscretion, assign a different officer as the SRO for that school.
d. Deployment. The SROs will rotate as assigned at Lathrop High School.

e. Duty Hours. Whenever reasonably possible, it is the intent of the Parties that the SROs' duty hours shall conform to the school day. The general operation of a school day consists of Monday through Friday, 7: 30 a. m. to 4: 00 p. m., may include school events, weekends, and evenings. Overtime is the sole discretion of the Police Department. It is understood and agreed that the time spent bythe SROs attending municipal court, juvenile court, and/ or criminal cases arising from and/ or out of their employment as an SRO shall be considered as hours worked under this Agreement.
f. Absence. In the event an SRO is absent from work, the SRO shall notify his or her supervisor in the City' s
Police Department and the officers' direct contact
within the district.
g. Duties. The SROs duties will include, but not limited to, the following:
i) To be a resource for students which will enable them to be associated with a law enforcement figure and role model in the students' environment.
ii) To be a resource for teachers, parents and students for conferences on an individual basis dealing with individual problems or questions, particularly in the area of substance control. iii) The SRO will share information with the administrator about person and conditions that pertain to campus safety concerns only as allowed by law.
iv) The SRO will be familiar with helpful community agencies, such as mental health clinics, drug treatment centers, etc., that offer assistance to dependency - and delinquency -prone youths and their families. Referrals will be made when necessary.
v) The SROs will wear approved department uniform, formal business attire or business casual with appropriate logos and name badges depending on the time of school year, the type of school activity or program, and the requests of the school and/ or police department. The Chief of Police and the principal, at the Chief of Police' sdiscretion, shall jointly set expectations and resolve any disputes in this area.
vi) The SROs willweartheirdepartment authorized dutyweapons in accordance with department policy.
h. Chain of Command.
i) As employees of the City' s
Police Department, SROs will be
subject to the chain of command of the Police Department.

ii) In the performance of their duties, SROs shall coordinate and communicate with the principal or the principals' designee of the school to which they are assigned.

Transporting Students & Student Information.
i) SROs shall not transport students in City' s
Police Department
vehicles except:

A) When the students are victims or witnesses of a crime, under arrest, truant or some other emergency circumstances exist. ii) If confidential student record information is needed by an SRO, but no emergency situation exists, the information may be released only as allowed by law.

3. Insurance.
a. Liability Insurance. Each Party shall obtain and keep in place a policyor policies of general commercial liability insurance ( or acceptable selfinsurance) written on an occurrence basis, that provides coverage for damage to property and injury to any person ( including death) that arises or occurs in connection with that Party' s activities under this Agreement. This liability policy shall be deemed primary and provide coverage for any property damage, bodily injury, personal injury and/ or death which occurs or is occasioned due in whole or in part to negligence by the Licensee in conjunction with the SROs duties as defined under this Agreement. Each Party' sliability policy shall name the other Party as an additional insured and shall include a cross -liability endorsement and waiver of the insurer' srights of subrogation against the other Party. The policy limits shall be at least in an amount no less than two million dollars ($ 2, 000,00) per occurrence and four million dollars ($4, 000,0) in annual aggregate.
b. General Insurance Requirements. Each policy shall be issued by an insured licensed to do business in the State of California and having an A. M. Best Company Rating of not less than an " A" and Financial Site Category of not less than " IX". Notwithstanding the foregoing, either Party may maintain the insurance coverage required under this Agreement through a joint -powers insurance cooperative in which the Party is a member.
c. Proof of Insurance. Within fifteen ( 15) days after the Effective Date, the Parties shall furnish to each other a certificate of insurance for each policy of insurance required under this section ( each a " Certificate of Insurance") stating that the required insurance coverage is in full force and

effect and naming the other Party as an additional insured. Within sixty (60) days of the Effective Date, each Party shall provide to the other Party copies of all policies of insurance and endorsements required under this section, which the receiving Party may review for compliance with this section.. AParty that determines the other Party' sinsurance does not satisfy the requirements of this section shall provide written notice of the deficiency to the other Party, which shall have thirty (30) days to cure the deficiency. No failure by a Party to review, fully review, or adequately review any policy received from the other Party, or to provide any notice of deficiency regarding any such policy, shall be deemed or construed to constitute acceptance or a waiver of any failure bythe other Party to comply with the requirements of this section. d. Continuity of Coverage. Each Party, during the Term, must maintain in full force and effect, without any lapse in coverage, all policies of insurance that the Party must maintain under this section, whether through the original or any renewal or replacement policies. The Party whose insurance policy' sbeing cancelled, for any reason, shall also notify the other Party in writing within two business days after learning of such cancellation. e. Waiver and Release of Claims. Upon receipt by a Party of insurance proceeds attributable to any claim or liability for which the other Party is responsible, the receiving Party shall be deemed to have waived and released the other Party from such claim or liability, but only to the extent that such claim or liability is satisfied or paid by the net amount remaining after deducting the receiving Party' sreasonable costs of obtaining such proceeds, including, without limitation, any deductibles or reserves expended by
the receiving Party.
f. Motor Vehicle Insurance. Each Party shall obtain and maintain under this section a policy or policies of liability insurance, written on an occurrence basis, providing coverage for all motor vehicles owned, leased, rented, or used by a Party in undertaking any activities under this Agreement Vehicle Policy"). Each Party' s
Vehicle Policy shall name the other Party as
an additional insured and shall include a cross -liability endorsement and a standard waiver of the insurer' srights of subrogation against the other Party. Unless modified by the Insurance section of this Agreement, in no event shall a Party' s
Vehicle Policy provide coverage for damage to property
and injuryto any person ( including death) in an amount no less than two million dollars ($ 2, 000,0) per occurrence and four million, dollars 4, 000,00) annual aggregate.
g. Workers' Compensation Insurance. Each Party shall obtain and maintain under this section a policy or policies of workers' compensation insurance in compliance with Section 3700 et seq. of the

Labor Code and all other applicable requirements, including, without limitation, any laws as may be enacted or amended from time to time. Each Party' s
workers' compensation insurance policy shall include a standard waiver of the insurer' srights of subrogation against the other Party. h. Minimum Requirements. The requirements for insurance coverage in this section are to be deemed and construed as the minimum requirements for the insurance to be maintained by a Party.

Notwithstanding anything to the contrary, each Party may maintain such additional insurance coverage as such Party determines in its reasonable business judgment is required to adequately protect the interests of the Parties in connection with this Agreement.

4. Indemnification and Liability.
a. Indemnity. The District shall indemnify, defend, and hold harmless the City, its officers, officials, employees, and volunteers from and against any and all liability, claims, damage, cost, expenses, awards, fines, judgments, and expenses of litigation ( including, without limitation, costs, attorney fees, expert witness fees and prevailing party fees and cost) of every nature arising out of or in connection with the assigned officer' sperformance of work or his or her failure to comply with any of its obligations contained in the Agreement, except such loss or damage which was caused by the active negligence by the City, or the gross or willful misconduct of the assigned officer.

The City shall indemnify, defend, and hold harmless the District, its officers, officials, employees, and volunteers from and against any and all liability, claims, damage, cost, expenses, awards, fines, judgments, and expenses of litigation ( including, without limitation, costs, attorney fees, expert witness fees and prevailing partyfees and cost) of every nature arising out of the active negligence by the City or the gross or willful misconduct of the assigned, officer during the performance of work hereunder. In the event of concurrent negligence on the part of DISTRICT or any of its officers, directors, trustees, employees, agents or volunteers, and CITY or any of its officers, officials, employees, agents or volunteers, the liability for any and all such claims, demands and actions in law equity for such losses, fines, penalties, forfeiture, costs and damages shall be apportioned under the State of California' stheory of comparative negligence as presently established or as may be modified hereafter.

If the District rejects a tender of defense by the City and/ orthe assigned officer under this Agreement, and it is later determined that the City and/ or the officer breached no duty of care and/ or was immune from liability, the District shall reimburse the City and/ or officer for any and all litigation

expenses ( including, without limitation, costs, attorney fees, expert witness fees and prevailing party fees and cost). A duty of care or immunity determination may be made by a jury or a court, including a declaratory relief determination by a court after the City and/ or officer settles a liability claim, with or without participation by the District. The Parties acknowledge that it is not the intent of the Agreement to create a duty of care by the City or its assigned officer that they would not owe in the absence of the Agreement.

The Agreement does not create an affirmative duty of care ( including, without limitation, a duty to protect, a duty to deter and/ or a duty to intervene) by the City or the assigned officer and the absence of the assigned officer and/ orthe patrol vehicle is not a material breach of this Agreement. The Parties further acknowledge that by entering into this Agreement neither the City nor its assigned officer intends to waive any immunities to which they would be entitled in the absence of the Agreement.

INTEGRATION OF PRIOR TERMS AND CONDITIONS
This Agreement, including all recitals, constitutes the entire agreement of the Parties. This Agreement may be amended or modified only by the mutual written agreement of the Parties. This Agreement is invalid unless approved by the legislative body of each Party, although it may be executed by an authorized agent of each Party. An authorized agent of the City shall be a person specifically authorized by the legislative body of the City to execute this Agreement, at the level of City Manager or City Attorney or equivalent. The indemnity sections shall survive termination or expiration of this Agreement.
b. Joint Defense. The Parties may agree in writing to a joint defense of any claim, action, or proceeding arising out of the joint acts or omissions of the Parties. Any such agreement may provide that the Parties may appoint agreed -upon legal counsel to defend such claim, action or proceeding. The Parties may equally bear the cost of any such joint defense and any amount paid by the Parties in settlement of, or as a result of a court judgment, arbitration or mediation of, the claim, action or proceeding. The Parties may equally share in any amount awarded to or received by the Parties in settlement of or as a result of a court judgment, arbitration or mediation of, the claim, action or proceeding. Neither Party may bind the other Party to any settlement of a claim, action, or proceeding without the express written consent of the other Party.
c. Comparative Fault. In the event any settlement, court judgment, or arbitration, or mediation award allocates or determines the comparative fault of the Parties, either Party shall be entitled to reimbursement from the other Party, with respect to defense costs, settlement payments, judgments and awards, consistent with such comparative fault to the extent such settlement, judgment, award,

payment or costs are not paid or reimbursed through insurance coverage that a Party is required to maintain pursuant to this Agreement. d. Insurance Not a Limitation on Liability. A Party' sliability or responsibility under this Agreement shall not be limited by insurance coverage maintained by either Party.
e. Survival of Terms. With respect to any acts, omissions, and/ or incidents occurring prior to termination of this Agreement, the requirement that a Party indemnify, defend, and/ or hold the other Party harmless, or pay any amounts owing under this Agreement, shall survive.
f. No Affirmative Duty of Care/ Waiver of Immunity. The Parties acknowledge that it is not the intent of the Agreement to create a duty of care by the City or its assigned officer that they would not owe in the absence of the Agreement. The Parties agree that this Agreement does not create an affirmative duty of care (including, without limitation, a duty to protect, a duty to deter and/ or a duty to intervene) by the City or the assigned officer and the absence of the assigned officer and/ or the patrol vehicle is not a material breach of this Agreement. The Parties further acknowledge that by entering into this Agreement neither the City nor its assigned officer intends to waive any immunities to which they would be entitled in the absence of the Agreement.

5. Miscellaneous.
a. No Assignment Without Consent. Neither Party may assign any rights, duties, obligations, or privileges under this Agreement without the express written consent of both Parties.
b. Waiver of Rights and Obligations. No waiver of any right or obligation under this Agreement is effective unless executed in writing by the Party relinquishing the right or excusing the obligation. Any such waiver shall be limited to the specific right or obligation set out in the written waiver and shall not be a waiver of any other right or obligation under this Agreement. c. Non -Discrimination. No Party shall employ any discriminatory practices in its performance hereunder, including its employment practices, on the basis of sex, race, color, religion, national origin, ancestry, age, sexual orientation, or physical and mental disability.
d. Entire Agreement. All Exhibits attached hereto are incorporated in this Agreement by this reference. The written expression of this Agreement, including the recitals and the Exhibits, contains the entire understanding of the Parties with respect to this Agreement. No other statements, promises, or understandings of any kind not contained in this Agreement were made to or

by either Party.
e. Interpretation. In interpreting this Agreement, it shall be deemed to have been prepared by the Parties jointly and no ambiguity shall be resolved against either Party on the premise that it or its attorneys were responsible for drafting this Agreement or any of its provisions. f. California Law. This Agreement shall be governed by and the rights, duties, and obligations of the Parties and shall be determined and enforced in accordance with the laws of the State of California. The Parties further agree that any action or proceeding brought to enforce the terms and conditions of this Agreement shall be maintained in the county in which District' sadministrative offices are located.
g. Waiver. Failure by a Party to enforce any term, condition, restriction, or provision of this Agreement, in any certain instance or on any particular occasion, shall not be deemed a waiver of such enforcement right, with respect to that or any future breach of the same or any other term, condition, restriction or provision.
h. Successors and Assigns. This Agreement shall be binding upon and inure to the benefit of the Parties and their respective heirs, legal representatives, successors, and assigns.

Counterparts. This Agreement and all amendments and
supplements to it may be executed in counterparts, and all counterparts together shall be construed as one document.
j. Captions. The captions contained in this Agreement are for convenience only and shall not in any way affect the meaning or interpretation hereof nor serve as evidence of the interpretation hereof, or of the intention of the Parties.
k. Severability. If any provision of this Agreement shall become illegal, null or void or against public policy, for any reason, or shall be held by a court of competent jurisdiction to be illegal, null or void or against public policy, the remaining provisions shall not be affected, provided that the economic and legal substance of the transactions contemplated herein are not affected in any manner materially adverse to any Party. In the event of any such determination, holding, or finding, the Parties agree to negotiate in good faith to modifythis Agreement to fulfill as closely as possible the original intent and purposes hereof. To the extent permitted by law, the Parties hereby, to the same extent, waive any provisions of law that render any provision of this Agreement prohibited or unenforceable in any respect.

Agreement must be in writing and signed by the Parties. m. Representation of Authority. This Agreement is invalid unless approved by the legislative body of each Party, although it may be executed by an authorized agent of each Party. Each Party warrants and represents that all of the actions, steps and/ orresolutions necessary to empower the signer to make and enter into this Agreement on behalf of each of the Parties has been fully and faithfully taken so as to authorize and bind each of the respective Parties to this Agreement.
i) An authorized agent of the City shall be a person specifically authorized by the legislative body of the City to execute this Agreement, at the level of City Manager or City Attorney or equivalent. n. No Third Party Beneficiaries. The only parties to this Agreement are the City and District. This Agreement does not involve any third party beneficiaries, and it is not intended and will not be construed to benefit or be enforceable by any other person or entity. o. No Joint Venture. Neither Party is authorized to assume or create any obligation on behalf of, in the name of, or binding upon the other Party, nor shall this Agreement in any way create, give rise to, or be deemed a joint venture or partnership between the Parties.
p. Independent Contractor Status. This Agreement is by and between two independent entities and is not intended to and shall not be construed to create the relationship of agent, servant, employee, partnership, or association.
q. Incorporation of Recitals and Exhibits. The Recitals and each Exhibit attached hereto are hereby incorporated herein by reference. r. Time Is of the Essence. Time is of the essence with respect to the Parties' obligations herein.
s. Further Actions. Each Party hereto shall execute, acknowledge, and deliver such additional documents, and take such further action( s), as may be reasonably required from time to time to carry out each of the provisions, and the intent, of this Agreement.
t. Force Majeure. In addition to specific provisions of this Agreement, performance by a Party hereunder shall not be in default, and all performance or other dates specified in this Agreement shall be extended, where the Party seeking the extension has acted diligently and delays or defaults are due to events beyond the reasonable control of the Party such as but not limited to: war; insurrection; strikes; lockouts; riots; floods; earthquakes; fires; casualties; acts of God; limitation of supplies; epidemics;

Not with standing anything to the contrary in this Agreement, an extension of time for any such cause shall be for the period of the forced delay and shall commence to run from the time of the commencement of the cause, if notice by the Party claiming such extension is sent to the other Party within thirty (30) days of the commencement of the cause.

RECOMMENDATION: Council to Consider the Following:.

SUMMARY:

Based on the San Joaquin Council of Governments ( SJCOG) Board' s five- year financial model update on September 25, 2025, coupled with the annual adjustment to the San Joaquin County Multi -Species Habitat Conservation and Open Space Plan SJMSCP) development fees, the SJCOG Board is now requesting each participating jurisdiction to adopt the annual adjustment to become effective on January 1, 2027.

The final calculation of the 2027 SJMSCP development fees shows an approximate overall increase of 28.% in the most commonly impacted categories of Agricultural and Natural Habitat Classifications compared to 2026. The increase is due primarily to a rise in the land acquisition component ( Category A) for agricultural land price values of comparable sales and a rise in the reported Consumer Price Index ( CPI) for Categories B and C ( which include land management and enhancement activities for on -going preserves). The following table shows the habitat categories, the last 5 years of fees, the current 2026 fees, and proposed 2027 fee adjustments ( per acre).

RESOLUTION NO. 26 -

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LATHROP

APPROVING THE ANNUAL ADJUSTMENT TO THE SAN JOAQUIN COUNTY

MULTI - SPECIES HABITAT CONSERVATION AND OPEN SPACE PLAN ( SJMSCP) DEVELOPMENT FEE FOR 2027
WHEREAS, the City Council of the City of Lathrop adopted Ordinance No. 01- 194 establishing the authority for collection of a Development Fee for the San Joaquin County Multi -Species Habitat Conservation and Open Space Plan ( SJMSCP) for all new development pursuant to the SJMSCP within the City of Lathrop; and WHEREAS, a " Fee Study" dated July 1, 2001 was prepared which analyzed and identifies the costs, funding, and cost - benefit of the San Joaquin County Multi - Species Habitat Conservation and Open Space Plan; and
WHEREAS, the purpose of the SJMSCP development fee is to finance the goals and objectives of the SJMSCP that include, but are not limited to preserve land acquisition, preserve enhancement, land management, and administration that compensate for such lands lost as a result of future development in the City of Lathrop and in San Joaquin County; and
WHEREAS, after considering the fee study and the testimony received at the public hearing, the Lathrop City Council approved said report; and further found that the future development in the City of Lathrop will need to compensate cumulative impacts to threatened, endangered, rare and unlisted SJMSCP covered species and other wildlife and compensation for some non - wildlife related impacts to recreation, agriculture, scenic values and other beneficial open space uses; and WHEREAS, an " Updated Fee Study" was prepared' in 2006, 2011, 2016, 2020, and 2025 which analyzed and identified the costs and funding of the SJMSCP; and WHEREAS, the SJMSCP development fees are divided into three categories:

Category A - Acquisition; Category B - Enhancement; and Category C - Land Management/ Administration; and
WHEREAS, the SJMSCP development fees for the different habitat types is shown on Attachment 3 of the staff report; and
WHEREAS, to ensure that the SJMSCP development fees keep pace with inflation, annual adjustments are made to the fees based on the method previously adopted by the Lathrop City Council; and
WHEREAS, the method of annual adjustments was modified in 2011, 2016, 2020, and 2025; and

WHEREAS, the 2026 adjustment resulted in a minor change to category " A" with removal of outlier ( three standard deviations) with an adjustment to the easement to fee title percentage used in the fee model and categories " B" and " C" with updated costs for each component.

NOW, THEREFORE, IT IS HEREBY RESOLVED, by the City Council of the City of Lathrop, as follows:

1. The City Council finds and declares that the purposes and uses of the development fee, and the determination of the reasonable relationship between the fees' uses and the type of development project on which the fees are imposed, are all established in Ordinance No. 01- 194, and remain valid, and the City Council therefore adopts such determinations.

2. The 2027 development fee for the three habitat types - natural land and agricultural lands, vernal pool habitat, and multi - purpose open space conversion, shall be as set forth in Attachment 3 of the staff report, incorporated by reference herein.

3. The fee provided in this resolution shall be effective on January 1, 2027 - December 31, 2027.
