CITY COUNCIL STAFF REPORT ITEM NO. 7.1
DATE: January 27, 2025
TO: Honorable Mayor and City Council
FROM: Marianna Marysheva, City Manager
SUBJECT: Creation of a City Council ad-hoc subcommittee for the upcoming Planning Commissioner interviews.

RECOMMENDED ACTION
Staff recommends that the City Council appoint an ad-hoc subcommittee to create interview questions, review applications, and determine the number of qualified Planning Commission applicants to be interviewed by the full City Council on March 3, 2025.

SUMMARY
The Planning Commission consists of five members who are interviewed and appointed by the City Council. As of March 1, 2025, two seats will be vacant. City staff conducted a recruitment from December 13, 2024, to January 27, 2025. Candidate interviews will take place at the March 3, 2025, Special City Council meeting at 5:00 p.m. Staff recommends that the City Council appoint an ad-hoc subcommittee to select interview questions and, if necessary, review applications to create a list of qualified applicants to interview.

DISCUSSION
The Planning Commission consists of five members who are interviewed and appointed by the City Council. Members are limited to serving two consecutive four-year terms, after which they may be appointed to the Planning Commission following a two-year break in service. Preference is for at least two members to have demonstrated ability in the area of design by virtue of avocation, vocation, talent and interest in design, architecture, landscape architecture, or a related field.

As of March 1, 2025, there will be two vacant seats. The recruitment for these vacancies began December 13, 2024, with advertisements being published in The Independent newspaper, on the City's website, Peach Jar, posters downtown, and distributed across the City's social media platforms. An informational meeting was held on January 21, 2024, and interested applicants were encouraged to attend. The application period closed January 27, 2025, at 5:00 pm. Staff will provide the final number of applicants during the presentation of this item.
1750
Candidate interviews are scheduled for March 3, 2025, at 5:00 pm. Staff recommends the City Council appoint an ad-hoc subcommittee to create the interview questions. In addition, if there are a large number of applications, staff recommends the ad-hoc subcommittee review applications and select up to six candidates to participate in the interview process.

Municipal Code Chapter 2.55 describing the Planning Commission's membership, duties, and responsibilities, is attached for reference.

Livermore City Council
Public Hearings

6.1 Cornerstone development
I am sending my comments concerning the Cornerstone development since I am out of town and cannot attend the January 27 Council Meeting.

The Cornerstone development in the Isabel area of north Livermore has several waivers that affect housing in Livermore.

A waiver should not be given so that the Scenic Corridor will be violated with a 70-foot, 5-story housing building.

Also, the City is not following the rules for Inclusionary Housing that sets standards for Affordable housing. Even though there is need for more affordable housing, how far is the City going to lower its housing standards when approving housing?
Inclusionary housing, by its very name, means including affordable units within market rate units, integrating affordable residents with market rate residents and not separating affordable residents in separate housing.

The affordable housing in Cornerstone does not follow those Inclusionary standards. Following the standards, there is to be no difference in the units so that Affordable units are integrated with the Market housing. Eleven waivers were granted. Four waivers are related to building design and view protection, and seven waivers are related to comparability of the affordable for-rent and for-sale units with the forsale market rate units.

In Cornerstone, the affordable rental housing is isolated by itself in below standard housing.

The rules on minimum gross floor areas as well as requirements that affordable units be comparable in unit mix and type, economically equivalent to a project’s market rate homes, and integrated throughout the development are not being implemented.

A waiver was given that the 50 sq. ft. of private open space in the Affordable housing is not required.

Item 6.1
Public Comment
1776
2 For the Affordable units, the size of the units, number of bedrooms and number of bathrooms do not match the Market units.

Proportion of bathrooms per bedrooms for all affordable units is not equal to the Market units.

The Affordable housing does not have equivalent parking and laundry facilities.

The Neighborhood Open Space is not located to maximize the visual and functional benefits as required. It should be centered between the Market and Affordable housing for equal access by both.

Affordable housing massing is not varied, as the Market buildings are, with recessed porches, bay windows and varying planes and setbacks. All that is mentioned for Affordable housing is different painting colors.

There is inequity in the parking for the affordable units.

For Market rate housing, the ratio of parking spaces/units is approximately 2/1.

For the Affordable units, the ratio of parking spaces/units is approximately .5/1, which is the required “minimum”. Since when is the “minimum” good enough?
Where are the Affordable residents and guests going to park? How many waivers is the City going to give that violate our design standards? The Council should not support this development as it is presently proposed with all the waivers.

Do not “Dublinize” our town?
Thank you.

Good evening City Council tt/embers:

Livermore Airport ( LVK) is now offering UL 94. This is a small step towards eliminating the impacts of leaded aviation pollution on several residential developments, and schools close to the airport. Unfortunately, UL 94 cannot be used in all piston engine aircraft.

Clearly, the most important next step is for Five Rivers Aviation FBO Pete Sandhu to start selling GAMI G100UL --- an unleaded aviation fuel that can be used in any plane. The Livermore City Council has the authority to direct the FBO to offer GAMI G100 UL.

GAtVll G100UL is FAA approved, and insurable. lt is my understanding that Reed-Hillview airport has received FAA permission to sell GAMI G100UL. Could the city manageror [Vlr. Spence provide an update on any steps being taken to offer GAt\41 G100 UL at LVK ?
Hopefully, the new Livermore City Council will show leadership and a willingness to protect our children from leaded aviation fuel pollution and join Reed-Hillview by offering GAMI G100 UL.

The continued sale of leaded aviation fuel poses a significant health risk to minors living and participating in outdoor activities near the airport. .

We urge the new city council to work with FBO Pete Sandhu and GAMI officials to ensure GAMI G100UL is available at LVK as soon as possible.

Sincerely,
S-u*rv*-

Re: Proposed Housing Development Project “Cornerstone”

Dear Livermore City Council,
The California Housing Defense Fund (“CalHDF”) submits this letter to remind the Council of its obligation to abide by all relevant state laws when evaluating the proposed 253-unit housing development project, including six moderate-income units and 110 lower-income units, located at the at the northwest corner of the Collier Canyon Road and Constitution Drive intersection. These laws include the Housing Accountability Act (“HAA”), the Density Bonus Law (“DBL”), and California Environmental Quality Act (“CEQA”) guidelines.

The HAA provides the project legal protections. It requires approval of zoning and general plan compliant housing development projects unless findings can be made regarding specific, objective, written health and safety hazards. (Gov. Code, § 65589.5, subd. (d.).) The HAA also bars cities from imposing conditions on the approval of such projects that would render the project infeasible unless, again, such written findings are made. (Ibid.) As a development with at least two-thirds of its area devoted to residential uses, the project falls within the HAA’s ambit, and it complies with local zoning code and the City’s general plan.

Increased density, concessions, and waivers that a project is entitled to under the DBL (Gov.

Code, § 65915) do not render the project noncompliant with the zoning code or general plan, for purposes of the HAA (Gov. Code, § 65589.5, subd. (j)(3)).

CalHDF also writes to emphasize that the DBL offers the proposed development certain protections. The Council must respect these protections. In addition to granting the increase in residential units allowed by the DBL, the Council must not deny the project the proposed 360 Grand Ave #323, Oakland 94610

waivers and concessions with respect to the Scenic Corridor height limit for the five-story apartment building and some of the three-story townhomes, the distribution of affordable units throughout the project, comparability of affordable units with market-rate units, and minor deviations from design standards, unless it makes written findings as required by Gov. Code, § 65915, subd. (e)(1) that the waivers would have a specific, adverse impact upon health or safety, and for which there is no feasible method to satisfactorily mitigate or avoid the specific adverse impact. Of note, the DBL specifically allows for a reduction in required accessory parking in addition to the allowable waivers and concessions. (Gov. Code, § 65915, subd. (p).) In addition, the California Court of Appeal has ruled that when an applicant has requested one or more waivers and/or concessions pursuant to the DBL, the City “may not apply any development standard that would physically preclude construction of that project as designed, even if the building includes ‘amenities’ beyond the bare minimum of building components.” (Bankers Hill 150 v. City of San Diego (2022) 74 Cal.App.5th 755, 775.) Additionally, the project is exempt from state environmental review under CEQA Guidelines § 15182 (c), Projects Pursuant to a Specific Plan, and CEQA Guidelines § 15183, Projects Consistent with a Community Plan, General Plan, or Zoning. And recent caselaw from the California Court of Appeal affirms that local governments err, and may be sued, when they improperly refuse to grant a project a CEQA exemption or streamlined CEQA review to which it is entitled. (Hilltop Group, Inc. v. County of San Diego (2024) 99 Cal.App.5th 890, 911.) As you are well aware, California remains in the throes of a statewide crisis-level housing shortage. New housing such as this is a public benefit: it will provide badly-needed affordable housing; it will bring new customers to local businesses; and it will reduce displacement of existing residents by reducing competition for existing housing. While no one project will solve the statewide housing crisis, the proposed development is a step in the right direction. CalHDF urges the Council to approve it, consistent with its obligations under state law.

CalHDF is a 501(c)3 non-profit corporation whose mission includes advocating for increased access to housing for Californians at all income levels, including low-income households.

Sincerely,
Dylan Casey
