Contractor further agrees to pay or cause to be paid for the indemnified parties’ benefit for any of this agreement. e) Non-Waiver and Non-Exhaustion of City’s Further Rights and Remedies. No aspect of this provision shall in any way limit or effect the rights of the Indemnified Parties against the Contractor under the terms of this Agreement or otherwise. The indemnification provisions shall apply regardless of whether this Agreement is executed after Contractor begins the work and shall extend to claims arising after this Agreement is performed or terminated, including a dispute as to the termination of Contractor. The indemnity obligations of Contractor shall continue until it is determined by final judgment that the claim against the City and any Indemnified Parties is determined by final judgment and after exhaustion of any rights of appeal.
f) Limitations on Scope of Indemnity. Notwithstanding the foregoing, Contractor shall not be responsible for indemnification for claims or losses caused solely by the negligence or intentional wrongdoing of Indemnified Parties. Further, the indemnity provided shall be interpreted as broadly as permitted under California law and as to agreements between Service Contract

J. Award Contract to Techstrata for Network Hardware Support and Maintenance for $28,254 (Information Systems) [CC]
This is a standard renewal for support coverage of the City's networking hardware.

Meeting
Tuesday, August 12, 2025, 7:00 PM
Agenda Group
Consent Calendar Item: 4J.

From
Kyle MacGavin, Information Systems Manager
RECOMMENDATION:

It is recommended that the City Council:

1. Award the contract to Techstrata Inc. for network hardware support and maintenance in the amount of $28,254 for services commencing July 1, 2025, to June 30, 2025 and with up to three (3) one-year time extensions to be approved by City Council, subject to any revisions deemed necessary by the City Attorney in regards to the agreement; and

2. Authorize the City Manager or his designee to execute all necessary documents.

BACKGROUND:

Network hardware is expected to be operating at full functionality, with no errors, all day and night long. The City has many networking devices across all sites, all of them are required to be operating 24/7. The constant operation of these devices means wear, unexpected breaks, faults, and certain functionalities to diminish over time. To address these issues and to maintain the City’s production moving forward, a support contract is required to keep network equipment functioning, consistent, and up to date.

ANALYSIS:

The City has been utilizing the vendor Techstrata for renewals, hardware support, and numerous various projects for over a decade.  Techstrata has been chosen due to their familiarity with city practices and Loma Linda’s IT environment.

ENVIRONMENTAL IMPACT:

There is no environmental impact associated with this action.

FINANCIAL IMPACT:

Funds have been budgeted for Fiscal Year 2025-2026 and are allocated to the city-wide Contracts account (51830).

To
City Council
From
Dan Harker, Fire Chief
Via
Tom Ingalls, Fire Marshal
RECOMMENDATION:

It is recommended that City Council accept the $75,000 Inland Empire Resource Conservation District (IERCD) SubGrant award, authorize execution of the funding agreement (pending City Attorney review), and approve a $75,000 supplemental appropriations to the Miscellaneous Grant Fund revenues/expenditure accounts as well as approve a supplemental appropriation in the amount of $35,000 from General Fund reserves to hire a consultant for a Community Wildfire Protection Plan (CWPP)
BACKGROUND:

Loma Linda Fire Department submitted a pre-proposal for funding to produce a CWPP to the March 2025 solicitation for the IERCD Forest and Fire Community Capacity Sub-Grant Program.  Our project was selected to prepare a full application by May 23, 2025.  With assistance from the Townsend Grant Team, our department was notified on June 16, 2025 that our organization was awarded the grant maximum amount of $75,000.

ANALYSIS:

A Community Wildfire Prevention Plan (CWPP) is a pivotal strategic planning document in guiding the activities and operations for wildfire mitigation, particularly those in wildland-urban interface (WUI) areas where the risk of wildfire is higher. The CWPP is a crucial document for long-term sustainability and effectiveness in wildfire resilience and prevention. Furthermore, CWPP’s are often a prerequisite for federal and state wildfire mitigation grants, and the city plans to utilize the completed CWPP in future applications for demonstration projects like fuel abatements, defensible space, and other physical preventative measures. Supporting this project will give the city the base on which to build capacity for future hazard prevention. Total cost of the project is estimated at $150,000.  The City will provide matching funds totaling $75,000 over the course of two years.  Costs anticipated for Fiscal Year 2025-2026 will be $35,000, and the remaining amount will be budgeted in the Fiscal Year 2026-2027 budget.

5. Approve a supplemental appropriation of $8,200.00 from Fund Balance for the Engineering Technician II/GIS Administrator and Engineering Technician I Salaries Regular and Personnel Benefits Expenditure Accounts; and

6. Approve a supplemental appropriation of $126,000.00 from Professional Services Account for the Information Technology Specialist Salaries Regular and Personnel Benefits Expenditure Accounts.

BACKGROUND:

As the City continues to grow and adapt to evolving service demands, staff periodically evaluates organizational capacity to ensure departments and divisions are equipped to deliver quality services effectively and efficiently.

Through this review, it has been determined that additional staffing is needed in both the Engineering Division of the Public Works Department and the Information Technology (IT) Department to meet current and anticipated service needs.

In the Engineering Division, the scope and complexity of work has expanded significantly in recent years, particularly with the increased use of Geographic Information Systems (GIS) to support citywide infrastructure planning and data access. Historically, the division operated with two key support roles, an Engineering Aide and an Engineering Technician I. However, the Engineering Aide position has remained largely vacant since 1993. Since that time, the City’s infrastructure, regulatory obligations, and reliance on  GIS and digital data have grown substantially.

In order to meet these expanded responsibilities in Engineering, staff recommends two actions:
(1) Reclassifying the current Engineering Technician/GIS Analyst to Engineering Technician II/GIS Administrator to reflect the advanced level of work currently performed. (Exhibit A) (2) Establishing a new Engineering Technician I classification to replace the outdated Engineering Aide role, which no longer meets the technical requirements of the division. (Exhibit B) In the IT Department, staffing limitations have affected the City's ability to manage daily operations and large scale projects efficiently. The Information Technology Manager is currently spending a significant amount of time on lower level technical tasks, which limits their ability to focus on the high level, complex, and highly specialized work that only they are qualified to perform. Several major projects, including the Loma Linda Connected Community Program (LLCCP) have required significant time and troubleshooting, while an unfilled contractor role has caused delays. The department also lacks sufficient backup personnel, raising concerns about succession planning and the ability to maintain operations in the event of staff turnover. Cybersecurity demands have increased, and consistent after hour support has placed a burden on current staff. These challenges highlight the need for an additional full time position to support operations, reduce overtime costs, and improve organizational resilience.

Additionally, as part of this review, it has been determined that the classification of Customer Support Technician no longer fully aligns with the evolving needs of the department. To better reflect the duties and responsibilities of this position, the role will be reclassified to Help Desk Technician.

In order to meet these operational demands in IT, staff recommends the following:
(1) Establishing a new Information Technology Specialist classification to support the expanding responsibilities of the department. (Exhibit C)
(2) Update the current Customer Support Technician position to Help Desk Technician, updating the job description and corresponding duties to reflect current IT support needs. (Exhibit D) ANALYSIS:

The proposed staffing changes in the Engineering Division and the Information Technology Department are necessary to address increased workloads, support succession planning, and align staff capacity with the complexity of current operations. These staffing recommendations reflect a proactive approach to maintaining service quality and supporting the City’s operational and strategic goals.

O. Adopt Council Bill #R-2025-32 - A Resolution to Submit a Grant Application to the Land and Water Conservation Fund to Construct Two Pickleball Courts at Leonard Bailey Park (PW) [CC] Meeting

RECOMMENDATION:

It is recommended that the City Council to:

1. Adopt Council Bill No. R-2025-31, a resolution authorizing the submission of a grant application to the Land and Water Conservation Fund, a State Park Grant, in the amount of $275,000, for the construction of two pickleball courts at Leonard Bailey Park; and

2. Authorize the City Manager or his designee to sign the appropriate application documents.

BACKGROUND:

The Land and Water Conservation Fund provide monies to state, federal and territorial agencies for recreational purposes. The money allocated to the states may be used for planning, acquiring and developing outdoor recreation areas and facilities.

The program, administered by the National Park Service (NPS), became effective in January 1965 and has been authorized and extended for this grant application cycle. For California, the Director of the State Department of Parks and Recreation has designated the State Liaison Officer (SLO) for this program under the California Outdoor Recreation Resources Plan Act of 1967. Therefore, fund expenditures are considered and authorized by the SLO.

ANALYSIS:

Leonard Bailey Park has long been a vital recreational destination for the Loma Linda community. In recent years, there has been a marked increase in demand for facilities that support multi-generational use, particularly for active youth and older adults. Among the most requested amenities has been the expansion of pickleball facilities.

Currently, the park features two existing pickleball courts, which have become a highly popular attraction and are frequently in use by residents of all ages. In response to continued public input, community surveys, and recreational trends, the addition of two new outdoor pickleball courts has emerged as a priority.

The proposed project will involve grading and site preparation, installation of a concrete slab over an asphalt base, application of specialized pickleball surfacing and striping, perimeter fencing, ADA-compliant access improvements, bench seating, signage, and lighting to support extended play hours. The courts will be located on an underutilized area of the park and thoughtfully integrated into the existing natural and recreational environment to enhance usability and aesthetics.

The new courts are expected to:

Serve both casual and league-level play.

Offer scheduled open play times and community events.

Increase activation of the park during daytime and evening hours.

Align with the City's wellness, sustainability, and recreation goals.

ENVIRONMENTAL IMPACT:

N/A
FINANCIAL IMPACT:

The proposed project will be funded 100% through the Land and Water Conservation Fund grant. The City initially planned to construct four pickleball courts but completed only two due to budget limitations. This grant request of $275,000 would fund construction of the remaining two courts, completing the original vision without requiring additional City funds.

RECOMMENDATION:

It is recommended that the City Council approve the Second Amendment to the Agreement with TKE Engineering, Inc., for Consultant Services for City-related services, subject to any revisions deemed necessary by the City Attorney. The Agreement will be retroactive to July 12, 2025, as the Contractor has been providing services since the start of the new fiscal year.

BACKGROUND:

The City and Consultant previously entered into an original City of Loma Linda Agreement for Consultant Services dated May 14, 2024 (the “Original Agreement”) for delivery of services during the period of July 1, 2023 through June 30, 2024 (the “Term”). Pursuant to the Original Agreement, during the Term the Consultant was tasked with providing a wide-variety of development services to the City (the “Consultant Services”), as more particularly described within Exhibit “A” to the Original Agreement, on an as needed, time and materials basis subject to a financial allocation of $11,000.

On July 9, 2024, the City and Consultant entered into that certain First Amendment to the Original Agreement for the purpose of extending the Term of the Original Agreement through June 30, 2025 and to provide a supplemental financial allocation of $24,500.

The purpose of the Second Amended Agreement is to extend Consultant’s service delivery period by one-year through June 30, 2026 and to provide a supplemental financial allocation of $24,500  to fund the costs of Consultant Services that the City may require during the period of July 1, 2025 through June 30, 2026.  Consultant has satisfactorily provided the requested Consultant Services to the City and it is projected that additional substantially similar services are required for an additional year.

During period of July 1, 2024 through June 30, 2025, the Consultant has provided professional services related to the preparation of continuing disclose reports required by the Municipal Securities Rulemaking Board (the “MSRB”), disclosure reports required by Government Code Section 53083 for economic development subsidies, Loma Linda Connected Community Program economic feasibility analyses and outdoor advertising policy analysis and other matters as may be assigned.

ANALYSIS:

The City has a successful working relationship with the Consultant, who has provided professional services to the City for many years. Their expertise and familiarity with the City’s operations and needs have contributed to the timely and effective completion of previous projects.

Continuing services under the proposed agreement will ensure consistency and efficiency, as the Consultant is already knowledgeable about the City’s processes and requirements. The Agreement is proposed to be retroactive to July 12, 2026, to align with the start of the new fiscal year. The Contractor has been providing services since that date to ensure continuity of operations and to avoid any disruption to ongoing projects. Formalizing the Agreement retroactively will authorize compensation for work already performed and ensure the Contractor’s services remain uninterrupted for the duration of the fiscal year.

ENVIRONMENTAL IMPACT:

Pursuant to § 15060 (c) (3) of the California Environmental Quality Act (the “CEQA”) Guidelines (i.e., California Code of Regulations, Title 14, Division 6, Chapter 3, §§ 15000-15387), approval of the attached Agreement is exempt from CEQA because the actions described therein will not result in a direct or indirect physical change in the environment and the actions described therein are not a “Project”, as defined within§ 15378 of the CEQA Guidelines.

FINANCIAL IMPACT:

The Second Amended Agreement provides that TKE will carry out the Scope of Services (as described within Exhibit “A” to the Original Agreement) that the City may require during the period of July 1, 2025, through June 30, 2026, subject to a supplemental financial allocation of $24,500.

RECOMMENDATION:

It is recommended that the City Council authorize supplemental appropriations in the amounts of $53,300 from the General Fund Balance, $434,800 from the Major Street Arterial Subprogram (MSART) Fund Balance, $275,700 from the Traffic Mitigation Fund Balance, $6,800 from the Water Enterprise Fund, and $802,200 from the Water Acquisition Fund Balance for projects and items that were not completed or received by the end of Fiscal Year 2025.

BACKGROUND:

During Fiscal Year 2024–25, funds were encumbered for the purchase of goods and construction services, with some projects having been awarded by City Council. However, unanticipated delays prevented the receipt of certain goods and completion of some construction services before the fiscal year ended.

The following amounts are requested to be re-appropriated:
$30,000 – Purchase of 26 street name signs (0013030-51300) $23,300 – Purchase of three replacement battery backup systems for traffic signals (0013030-51300) $434,800 – Completion of CIP 23-118, California Street Widening, Phase 3 (approved by City Council January 14, 2025) (1275345-58500)
$275,700 – Completion of CIP 23-118, California Street Widening, Phase 3 (approved by City Council January 14, 2025) (3122340-58500)
$6,800 - Remaining balance of industrial laptop for the Richardson Treatment Plant (4657010-58220) $802,200 – Completion of CIP 20-656, 1.6 MG Reservoir Construction (approved by City Council March 14, 2023) (4387200-58500)
ANALYSIS:

The requested supplemental appropriations represent unspent funds, including contingency amounts, from Fiscal Year 2025 for the above-listed projects and purchases. Approval of this action will allow the City to carry forward the necessary funding to complete the work as originally approved.

RECOMMENDATION:

It is recommended that the City Council accept this project as substantially complete and authorize the City Clerk to file the Notice of Completion.

BACKGROUND:

Installation of a fan and ventilation in the battery storage cabinet was required at the 600,000 gallon reservoir. The project was completed below budget and completed satisfactorily.

Attached is the Notice of Completion for the subject project.  Upon City Council authorization, the City Clerk will submit the Notice of Completion for recordation.  The one (1) year warranty provided by the contractor will commence from the date of recordation.
