RECOMMENDATION:

It is recommended that the City Council, as the Successor Agency to the Redevelopment Agency, adopt City Council Bill #R-2025-39, waiving the reading of the Resolution in its entirety and read by title only, and approving the Successor Agency’s ROPS and administrative budget for the period of July 1, 2026 through June 30, 2027.

Resolution title:

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SUCCESSOR AGENCY TO THE LOMA LINDA REDEVELOPMENT AGENCY APPROVING THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE 26-27 A & B AND THE ADMINISTRATIVE BUDGET FOR THE PERIOD OF JULY 2026 THROUGH JUNE 2027 AND

APPROVING CERTAIN RELATED ACTIONS
BACKGROUND:

Pursuant to Health and Safety Code (“HSC”) § 34172 (a) (1), the Loma Linda Redevelopment Agency was dissolved on February 1, 2012.  Consistent with the provisions of the HSC, the City Council of the City of Loma Linda previously elected to serve in the capacity of the Successor Agency.  Per HSC § 34179, the Successor Agency previously established the Loma Linda Oversight Board to assist in the wind-down of the former redevelopment agency through June 30, 2018, at which time it was dissolved by operation of law.  Consistent with HSC § 34179 (j), on July 1, 2018 the San Bernardino Countywide Oversight Board (the “CWOB”) was established to assist in windingdown the dissolved redevelopment agencies within the County of San Bernardino.

ANALYSIS:

Per HSC § 34177 (o) (1), the Successor Agency is required to prepare a ROPS before each twelve-month fiscal year period and submit it to the CWOB, which is inclusive of the Auditor-Controller, for approval.  Pursuant to HSC § 34180 (g), CWOB approval is required for the establishment of each ROPS.  Per HSC § 34177 (j), the Successor Agency is also required to prepare a proposed administrative budget for ROPS 26-27 A & B and submit it to the CWOB for its approval. Pursuant to HSC § 34177 (o) (1), a CWOB-approved ROPS 26-27 A & B for the period of July 2026 through June 2027 must be submitted to the State Department of Finance (the “DOF”) not later than February 1, 2026 (the “Submission Deadline”).  The CWOB is scheduled to consider approval of the Successor Agency’s ROPS 26-27 A & B on January 12, 2026.  The Successor Agency’s approval of the establishment of ROPS 26-27 A & B will ensure that ROPS 26-27 A & B is filed by the Submission Deadline.

ENVIRONMENTAL IMPACT:

Pursuant to § 15060 (c) of the California Environmental Quality Act (the “CEQA”) Guidelines (i.e., California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000-15387), approval of this Resolution is exempt from CEQA because the actions described herein are administrative in nature and will not result in a direct or indirect physical change in the environment and the actions described herein are not a “Project”, as defined within § 15378 of the CEQA Guidelines.

FINANCIAL IMPACT:

Pursuant to HSC § 34177, the Successor Agency is legally required to continue to make payments due for enforceable obligations.  The Successor Agency’s and the CWOB’s approval of the ROPS 26-27 A & B will ensure that the Successor Agency has the authority to continue to pay its enforceable obligations.  ROPS 26-27 A & B will be submitted to DOF by the Submission Deadline.

6 The Continuing Disclosure Services are required by S.E.C. Rule 15c2-12, which was incorporated into the agreements associated with the 2016 A & B Refunding TARBs and are typical for all TABs (or TARBs) issued by former California redevelopment agencies and successor agencies. Consequently, DOF has routinelyapproved such expenses as separate enforceable obligations that are not considered administrative expenses. 15 The terms of the City/Agency Loan are as specified in the Settlement Agreement by and between the City, the Successor Agency, the State Department of Finance and the State Controller's Office. Pursuant to the Settlement Agreement, the Successor Agency is required to pay the City $1,639,148 during each ROPS cycle, which is divided into two $819,574 increments for each A and B ROPS cycle. This loan was repaid in full during ROPS 2025-26. 27 The amount shown in the ROPS includes the Successor Agency's commitment to reduce its Administrative Allocation by $20,000 each ROPS period.47 Annual debt service on the 2016A TARBs.48 Pursuant to the 2016 A Refunding TABs Indenture, the Successor Agency is required to obtain during the B ROPS cycle each year one-half of the annual principal reduction payment (which is due during the next following A ROPS cycle each year). 49 Annual debt service on the 2016B TARBs.50 Pursuant to the 2016 B Refunding TABs Indenture, the Successor Agency is required to obtain during the B ROPS cycle each year one-half of the annual principal reduction payment (which is due during the next following A ROPS cycle each year). 51 This item is for annual securities servicing by the trustee bank. Every 5th year, this item will also include costs for arbitrage rebate services.

RECOMMENDATION:

It is recommended that the City Council Adopt Council Bill #R-2025-41 waiving the reading of the Resolution in its entirety and read by title only; approving the permanent outsourcing of Code Enforcement services through a contracted service provider (currently Willdan Engineering); approving to permanently eliminate the Code Compliance Officer position from the City’s classification plan; and approving to update the City City’s Salary Schedule to remove the Code Compliance Officer classification. Resolution title:

A RESOLUTION OF THE LOMA LINDA CITY COUNCIL, ELIMINATING THE CODE COMPLIANCE OFFICER

POSITION AND APPROVING AN UPDATED SALARY SCHEDULE
BACKGROUND:

The City of Loma Linda has utilized contracted Code Enforcement services through Willdan Engineering to maintain enforcement coverage while the in-house Code Compliance Officer position has remained vacant. During this interim period, Willdan staff have provided responsive, flexible, and professional Code Enforcement services that have met the City’s needs.

A review of case activity and workload over this period indicates that the City does not have a sustained volume of enforcement cases to justify a full-time, in-house position. Code enforcement demands are intermittent and fluctuate based on community activity and seasonal factors. Additionally, the scope, scheduling, and responsiveness required for effective Code Enforcement have exceeded what can be reasonably accommodated with in-house staffing.

The Code Compliance Officer position also included animal control duties, which have been reassigned to the Parking Enforcement/Animal Control Officer. To ensure sufficient operational support during regular City Hall hours, staff has adjusted this position to a 4/10 schedule, Monday through Thursday effective November 17, 2025.

A meet and confer discussion with the Teamsters Union was held on October 30, 2025. The Union expressed no objection to the permanent contracting of Code Enforcement services, elimination of the in-house position, or the schedule adjustment for Parking Enforcement/Animal Control Officer.

ANALYSIS:

Contracting Code Enforcement services through Willdan Engineering has proven to be an effective and flexible model for the City. It provides access to trained and certified Code Enforcement Officers who can respond to cases during business hours, after-hours, and on weekends as needed. This approach ensures continuous, high-quality service and improves responsiveness to community concerns.

Maintaining contracted services allows the City to align staffing levels with actual workload demand while ensuring uninterrupted coverage during absences or increased enforcement activity. The contract model also offers broader expertise and resources than can typically be maintained with a single in-house position.

Adjusting the Parking Enforcement/Animal Control Officer to a 4/10 work schedule enhances coordination with other City operations and ensures additional staff support is available during regular business hours. This change strengthens overall service delivery and operational efficiency within existing resources.

ENVIRONMENTAL IMPACT:

The action involves administrative and organizational changes that have no potential to result in a direct or reasonably foreseeable indirect physical change in the environment.

FINANCIAL IMPACT:

The estimated annual cost of employing a full-time Code Enforcement Officer, including salary, benefits, and average overtime, is approximately $152,300. The cost for contracted Code Enforcement services is approximately $107,700 annually, representing an estimated annual reduction in cost of $44,600.

The consultant provides their own vehicle, eliminating the need for a City-issued truck and associated expenses for maintenance, fuel, registration, and insurance.

Consultant fees will be allocated to Account No. 0012050-51820.

The 2025 CFC applies to all state-regulated occupancies (buildings); but, since there are occupancies, procedures and conditions that are not regulated by the state, local government may also adopt the corresponding model code upon which the CFC is based (i.e., the IFC).

At the October 14, 2025, City Council meeting, the City Council conducted a Public Hearing for the adoption of the proposed 2025 Edition of the California Fire Code and the 2025 Edition of the California Wildland Urban Interface Code, to introduce the Ordinances and setting the second hearing for November 18, 2025, for adoption.

ANAYLSIS:

Since the October 14, 2025, public hearing, no additonal public comments have been received regarding the proposed project.  There have been no new developments or concerns raised.  The staff report remains unchanged and no updates to the presentation are necessary.  Staff continues to recommend adoption of the Ordinance.

B. Approve Supplemental Appropriation and Approval of Amendment No. 37 to Contract No. 94-523 (Schedule “A”) for Law Enforcement Services with the County of San Bernardino for FY 2025–2026 (City Manager) [CC] Meeting

From

RECOMMENDATION:

It is recommended that the City Council:

1. Approve Amendment No. 37 to Contract Agreement No. 94-523, Schedule “A,” with the County of San Bernardino for law enforcement services for Fiscal Year 2025–2026, reflecting adjustments resulting from the Sheriff’s Employees’ Benefit Association (SEBA) Memorandum of Understanding (MOU) increases; and

2. Approve a supplemental appropriation of $467,200 to fully fund the FY 2025–2026 Sheriff’s Law Enforcement Services contract; and

3. Authorize the City Manager to execute two (2) original wet-signed copies (blue ink only) of Amendment No. 37 and return them to the San Bernardino County Sheriff’s Department (SBCSD) Bureau of Administration by December 1, 2025.

BACKGROUND:

On May 13, 2025, the City Council approved the FY 2025–2026 Sheriff’s Law Enforcement Services Contract (Contract No. 94-523 A-36) with the County of San Bernardino. This contract provides all regular law enforcement services for the City, including personnel salaries and benefits, liability and workers’ compensation costs, vehicles and insurance, dispatch services, body-worn cameras, and administrative overhead. A detailed breakdown of staffing and costs was provided in Schedule “A” (Attachment A).

As in previous years, the contract also includes one (1) Deputy Sheriff dedicated 24/7 to Loma Linda University Medical Center (LLUMC), which is a full pass-through cost to LLUMC. Items not included in the contract—such as fuel, maintenance, supplies, and overtime—are billed separately on a quarterly basis.

During approval of the FY 2025–2026 contract, the Sheriff’s Department noted that negotiations between the County and the Sheriff’s Employees’ Benefit Association (SEBA) were still pending. As a result, the contract was costed using salary rates effective as of January 25, 2025, with the expectation that an amendment would follow once the new MOUs were adopted.

SBCSD has now issued Amendment No. 37, which incorporates the finalized SEBA MOU salary and benefit increases for FY 2025–2026.

ANALYSIS:

The approved FY 2025–2026 contract total was $7,019,502, representing a slight decrease from the prior year due to reductions in retirement and workers’ compensation rates, partially offset by increases in City risk management insurance and Taser contract costs.

With the implementation of the newly adopted SEBA MOU, SBCSD conducted a recalculation of all Schedule “A” contract amounts for cities. The updated labor and benefit rates have resulted in an increase of $467,186 above the originally approved contract amount.

Amendment No. 37 is administrative in nature, updating personnel rates only; no changes to service levels, staffing counts, or deployment strategies are included in this amendment. All other terms and conditions of Contract No. 94-523 A-36 remain unchanged.

SBCSD requires the City to return two signed original copies (wet signatures in blue ink; no stamps permitted) by December 1, 2025, in order to process the amendment within their budget cycle.

To fully fund the updated contract amount for FY 2025–2026, a supplemental appropriation is required.

ENVIRONMENTAL IMPACT:

This action is not a project under the California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines §15378(b)(5), as it consists of administrative and financial actions that will not result in a direct or reasonably foreseeable indirect physical change in the environment FINANCIAL IMPACT:

Approval of Amendment No. 37 results in an increased contract cost of $467,200 for FY 2025–2026, attributable to SEBA MOU salary and benefit adjustments.

A supplemental appropriation of $467,200 from the General Fund into account 0012000-51830 is necessary to cover the revised contract total.

C. Follow-up Report on the City’s Repair Work at 25625 State Street (Public Works) [CC] Meeting

Old Business Item: 6C.

To
City Council
From
T Jarb Thaipejr, City Manager
RECOMMENDATION:

Following the investigation and work performed by the City Water Crew, no leak was found at the property.

Therefore, it is recommended that the tree not be removed and that no further action regarding the tree is required.

REPORT OF REPAIR:

On October 16, 2025, the City Water Department crew removed the sidewalk and the meter box in front of the property at 25625 State Street in order to investigate the suspected water leak. The property owner was on-site during the City's investigation.  Upon exposing the meter, the Water Crew observed the following:

No visible signs of water running, leaking, or rising.

The flow indicator arrow on the meter shows no movement, confirming that no water is currently flowing through the line.

During the original investigation, the meter’s flow indicator arrow was showing continuous flow, 24 hours a day.

This triggered an alert to the Customer Service Department, which then notified the homeowner of a possible water leak.

When the City Water Crew first arrived on site, they turned off the house valve. Despite this, the flow arrow continued to show water movement, indicating a potential leak between the meter and the home.

As of October 16, 2025:

The flow indicator arrow is no longer showing movement.

This change could be due to one of the following:

1. The house valve was not fully shutting off water during the initial inspection, which would explain the continued flow.

2. The leak is located inside the home, possibly due to a dripping faucet, a showerhead, or a malfunctioning toilet flapper.

On October 16, 2025, when the City Water Crew turned off the house valve, the home’s water lines were partially drained. Once they turned the valve back on, water rushed back into the home, further suggesting a leak or running fixture inside.

The City Street Crew trimmed the trees along State Street.

CONCLUSION:

There was no leak between the meter and the home, including in the yard or near the tree.

The Water crew did discover a significant amount of root growth surrounding the meter box and the homeowner’s service line. While root intrusion is common throughout Loma Linda, in this case, there are no leaks or prior records of leaks at this address.

It is likely that the service line is encased in a galvanized sleeve, which has protected the water line from root intrusion and leaks.

D. Authorize City Manager to Negotiate Leasing of Heritage Park Complex to Inland Temporary Homes (Administration) [CC]
Meeting
Tuesday, November 18, 2025, 7:00 PM
Agenda Group
Old Business Item: 6D.

To
City Council
From
T Jarb Thaipejr, City Manager
RECOMMENDATION:

It is recommended that City Council authorize the City Manager to negotiate the lease of the Heritage Park Complex to Inland Temporary Homes.

BACKGROUND:

Beginning in 2018, the City has leased various portions of Heritage Park, 25964 Mission Road, to Inland Temporary Homes (ITH), a non-profit organization housing homeless women and children. The City has a long relationship supporting ITH through the Community Development Block Grant program. Since the inception of the park, developers have relocated historic structures there, including several homes, a railroad engine, wind turbine (currently not restored) and a replica water tower. Over the years, City Council has dedicated funding for individual restoration projects. Having an active use at the site will deter vandalism and crime in addition to the financial considerations associated with a lease.

ANALYSIS:

ITH has found substantial funding to commit to a public/private partnership for a major rehabilitation and maintenance project of the historic home sites that still need upgrading. However, they desire City commitments for continued and more robust support as well as long term leasing. This request is to allow the City Manager to investigate the details of ITH abilities, desires and potential commitments. The results will be brought back to City Council for consideration.
