Change Order 2 – Sewer System Master Plan/Harbor Hills
25201, but still needs an easement for the remaining 77-foot segment of that sewer and five other sewer segments totaling approximately 770 linear feet plus four manholes in LACDA property (total linear footage of six segments, including portion in Tract 25201, is approximately 1,020).

Psomas would propose to continue working with the City and the County agencies to get the above recommendations accomplished in support of City staff. The major tasks envisioned to be accomplished by Psomas would be:

1. Continue communication and coordination with County agencies and City staff.

This is more complicated than it seems due to the fact that, even though it’s all Los Angeles County we’re dealing with, there are multiple County agencies involved including Public Works (engineering), CSMD (maintenance), and LACDA (property ownership). Since the County is turning over property (sewers and manholes) and granting easements this may even involve other agencies of the County. This task is envisioned to involve meetings and numerous emails with various County agencies throughout this process, which could take many months.

Cost: $11,600

2. Prepare a memorandum, on behalf of the City, requesting that LACDA cause to have the sewer segments and manholes in question CCTV inspected per NASSCO specifications and provide the videos and logs of such inspections to the City and County Public Works (on behalf of CSMD) for review. That memo will also request that LACDA prepare a document transferring ownership of the sewers in question along with a 20-foot wide easement granted to the City for access and maintenance purposes.

Cost: $4,000

3. Review the CCTV videos and logs on behalf of the City and compile a list of improvements needed, if any, to bring the sewers up to acceptable standards for City acceptance. Review County Public Works’ comments on their review of the videos and coordinate both sets of recommended improvements, if any.

Cost: $4,800

4. If improvements are needed such as root or calcium removal, point repairs, and/or lining, review the post-construction videos to ensure the improvements are acceptable.

Cost: $2,000

Change Order 2 – Sewer System Master Plan/Harbor Hills

5. Review and provide comments on easement and ownership transfer documents.

City to have separate legal counsel review, as necessary.

Cost: $2,500
Optional services Psomas could provide would be preparation of the easement legal descriptions and conducting the CCTV inspections of the sewers and manholes using a subconsultant. However, as stated earlier, our initial position is that these tasks should be the responsibility of LACDA, in exchange for getting these sewers off their books as far as future maintenance and replacement.

We propose to accomplish this work effort on a time and materials basis in accordance with our current contract (Agreement No. 2023-33 dated July 18, 2023), for a total fee of $24,900, which will not be exceeded without prior approval from the City.

We would also request that the term of the subject agreement be extended for a period of three (3) years to December 31, 2027.

Please feel free to contact me at (714) 481-7979 or on my cell at (949) 683-5812 if you have any questions regarding this proposal.

Sincerely,
Michael D. Swan, P.E.

Acceptance of payment shall be any negotiation of CITY’S check or the failure to make a written extra compensation claim within ten (10) calendar days of the receipt of that check. However, approval or payment by CITY shall not constitute, nor be deemed, a release of the responsibility and liability of CONTRACTOR, its employees, sub-Contractors and agents for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by CITY for any defect or error in the work prepared by CONTRACTOR, its employees, sub-Contractors and agents.

23. CORRECTIONS. In addition to the above indemnification obligations, the CONTRACTOR shall correct, at its expense, all errors in the work which may be disclosed during the CITY’S review of CONTRACTOR’ S report or plans. GENERAL INFORMATION
A. INTRODUCTION / BACKGROUND
The City of Lomita is requesting proposals from qualified and experienced Civil Engineering firms to provide Engineering Services to conduct and prepare the City’s Sanitary Sewer System Master Plan. Included in the scope of work for the project, the selected Consultant shall recommend, produce and calibrate a Sewer System Hydraulic Model for the City’s sewer infrastructure.

The City of Lomita is an urban, densely populated 1.97 square miles (total area is 1,261 acres), located at the base of the Palos Verdes Peninsula in the Los Angeles Basin, Los Angeles County, 26 miles south of downtown Los Angeles and bounded by the City of Torrance on the north and west, the Harbor Region of Los Angeles to east, and the City of Rolling Hills Estates on the southwest; and the City of Rancho Palos Verdes and unincorporated Los Angeles County area to the southeast. The City is almost completely developed with mostly residential neighborhoods and commercial units.

The City’s sanitary sewer collection systems serves a population of approximately 20,000 residents and consists of roughly 36 miles of gravity sewer lines. The City’s legal authority to own and operate the sanitary sewer system is derived from its incorporation as a City. The City, on June 30, 1964, granted the County of Los Angeles the consent and jurisdiction to annex portions of the sewer system into the Consolidated Sewer Maintenance District ( CSMD). By that action, the City has entrusted the management, operation, and maintenance of its local sanitary sewer system the CSMD. The City, however, maintains ownership of the sewer system, and is responsible for ensuring that the public sewer infrastructure is correctly designed, adequately sized, and easily maintained.

B. PROJECT DESCRIPTION
The purpose of the Sanitary Sewer System Master Plan is to analyze and assess the City’s existing sewer infrastructure to address capacity deficiencies in the system. Deficiencies will be identified and prioritized in a specific list of projects, a 10-year Capital Improvement Plan (CIP) that will look to replace, rehabilitate, and maintain the sewer facilities and infrastructure. The selected Consultant will also be responsible for the recommendation, development and calibration of a sewer hydraulic model that will validate the recommendations made in the Master Plan and used by the City for future analysis.

1 TO: City Council
FROM: Andrew Vialpando, City Manager
PREPARED BY: Trevor Rusin, City Attorney
MEETING DATE: November 5, 2024
SUBJECT: Report on Impact of City of Grants Pass v. Johnson U.S. Supreme Court Ruling (Grants Pass Decision) Regarding Camping/Sleeping in Public Areas

RECOMMENDATION
Receive and file and provide direction to staff on next steps.

BACKGROUND
After the recent ruling of the U.S. Supreme Court regarding the City of Grants Pass v.

Johnson, the City Council directed City staff to return with a report discussing the decision, the City’s municipal code, and potential revisions to the City’s municipal code to address camping/sleeping in public areas. Following this direction, the City Manager and City Attorney met with members of the Los Angeles County Sheriff’s Department (LASD) including Lomita Station Captain Kristine Guerrero, Lieutenant Michael White, and Special Enforcement Deputy Jeremy Kellogg.

This report discusses the Grants Pass decision and the City’s municipal code below, and then addresses issues discussed with LASD and seeks direction from the Council on next steps.

DISCUSSION
City of Grants Pass, Oregon v. Johnson, No. 23-175 (U.S. June 28, 2024) In this recent ruling, the Supreme Court held that enforcement of three city laws restricting camping in public spaces was constitutional under the Eighth Amendment’s Cruel and Unusual Punishment Clause. Opinion of the Court, at 21. The city prohibited sleeping “on public sidewalks, streets, or alleyways,” “[c]amping” on public property, and

CITY COUNCIL REPORT
Item No. SCH 8a

2 “[c]amping” and “[o]vernight parking” in city parks. Grants Pass Municipal Code §§

5.61.030, 5.61.010(A)–(B), 6.46.090(A)–(B). Initial violation of these ordinances may result in a fine. Id. §§ 1.36.010(I)–(J). Multiple citations may lead to an order of a 30-day bar from city parks. Id. §§ 6.46.350. Violating the order can further lead to a $1,250 fine and a maximum of 30 days imprisonment for criminal trespass. Ore. Rev. Stat. §§ 164.245, 161.615(3), 161.635(1)(c) (2023).

The Court reasoned that because the laws only prohibited specific actions which the state deemed unlawful, and did not criminalize a particular status (i.e. being homeless), it was neither cruel nor unusual to subject violators to such moderate and commonplace penalties. Opinion of the Court, at 17. And even if a homeless individual were to illegally camp, the court mentioned that defenses such as “necessity,” “insanity, diminishedcapacity, and duress” could be applicable in precluding conviction. Id. at 24. Moreover, “[s]tates and cities are free . . . to add additional substantive protections” like “law[s] specifically addressing how far . . . municipalities may go in regulating public camping” or “declining to criminalize public camping altogether.” Id. at 24 (citing Ore. Rev. Stat. § 195.530(2) (2023)). In holding enforcement of the Grants Pass laws constitutional, the Court refused to extend the narrow holding of Robinson v. California, 370 U.S. 660 (1962), where a state law effectively criminalized the “status” of being addicted to narcotics. Opinion of the Court, at 18. And according to the Court, status alone could not result in “involuntary” violation of the laws at issue, if the violator had met the requisite mens rea and actus reus. Id. at 22–23 (citing Powell v. Texas, 392 U.S. 514 (1968)). The Court thus held that it should be left to the “broad power” of state governments, and not courts, to decide whether violating the laws was “involuntary” whenever there were not enough “adequate” and “practically available” shelter beds to accommodate local homeless populations. Id. at 34.

However, the Court left room for and did not decide on concerns relating to due process and selective prosecution. Id. at 21, fn. 5. The dissent stressed these concerns, as well as the potential for unconstitutionality through statutory vagueness or Fourth Amendment property violations. Dissent, at 28–29 (Sotomayor, J., dissenting). Highlighting the main point of disagreement with the majority, Justice Sotomayor maintained that “[t]he Eighth Amendment prohibits punishing homelessness by criminalizing sleeping outside when an individual has nowhere else to go.” Id. at 29.

Lomita Municipal Code
The following section in the Lomita Municipal Code is available, but does not specifically address camping or the erection of encampments:

Section 4-3.07 (Disorderly) of the Lomita Municipal Code provides:
“No person shall lie and sleep on any of the sidewalks, streets, or other public places within the city, or appear therein in such a state of intoxication or drunkenness as to be unable to take proper care of himself, or disturb the peace or quiet of any person, family or neighborhood, by drunkenness or by making loud and unusual noises, or by violent or offensive language, or by boisterous, tumultuous or offensive conduct, or by the Tuesday, November 05, 2024 Reg CC MTG, Page *1215
3 threatening, traducing, quarreling, fighting or offering or challenging to fight, or in any other way or manner whatever disturb the peace, quiet and decency of any person, street or neighborhood.” (emphasis added)
As in Grants Pass, violation of this Section results in commonly moderate penalties that the municipalities may choose not to enforce if circumstances require. It also does not expressly criminalize homelessness, and applies to anyone who violates the Section.

Thus, enforcement of this Section would likely not be found to violate the Cruel and Unusual Punishment Clause of the Eighth Amendment under Grants Pass.

However, whether enforcement could potentially implicate other constitutional considerations such as due process or Fourth Amendment search and seizure, are open questions beyond the scope of Grants Pass. Under Grants Pass, the more specific the statute is with its mens rea and actus reus, the more common and moderate the associated penalties, and the broader the statute’s applicability, the higher the likelihood of Eighth Amendment constitutionality. Greater predictability in the constitutionality of these and similar statutes will develop as the Court continues to refine its jurisprudence on this issue.

Partnership with LASD
As mentioned above, the City Manager and City Attorney met with LASD Captain Guerrero and Lomita deputies to discuss the implications of the Grant’s Pass decision, the Department’s approach to dealing with individuals experiencing homelessness and those camping/sleeping without permission in the City. Also discussed was the scope and impact of these types of issues in Lomita.

At this point in time, the LASD has not changed its general approach which involves first seeking to provide services to individuals experiencing homelessness and helping to connect them with housing and shelter. LASD has a team specially dedicated to handling these types of situations. County counsel and the LASD are currently evaluating their approach, particularly in light of Governor Newsom’s Executive Order of July 25, 2024, directing state agencies to adopt policies to address encampments on State property and encouraging local agencies (such as Lomita) to “take action with the urgency this crisis demands to humanely remove encampments from public spaces, prioritizing those encampments that most threaten the life, health, and safety of those in and around them.” During the meeting Staff asked if the LASD recommended that the City adopt any changes to its municipal code to assist the LASD in addressing the above issues. LASD did not have any recommendations or requests at that time. They did state that they were happy to review any potential changes internally and with County Counsel.

It is important that any changes to the municipal code be enforced by the LASD.

Provisions that conflict with the approach of the LASD or that are constitutionally fraught are unlikely to be regularly enforced or assist the City and LASD in addressing the above issues.

Tuesday, November 05, 2024 Reg CC MTG, Page *1216
4 Next Steps
Should the City Council desire to add additional provisions to the Municipal Code to specifically address camping and storage of possessions in the public areas of the City, staff will work with the LASD to provide suggested modifications to the City’s code and return with a draft ordinance. As an example, staff could bring back an ordinance that makes it unlawful for any person to camp or maintain an encampment in or upon any public property, including in any street, sidewalk, or park. Such an ordinance could not prohibit a person from sitting on a sidewalk or in a public area, but it could prevent the erection of structures and other items that pose a danger to the public.

Staff requests that the City Council provide direction if such an ordinance is desired, and any priorities for the City which it wants addressed in such an ordinance.

FISCAL IMPACT
There are no financial implications resulting from this recommendation.

OPTIONS

1. Receive and file report; and

2. Direct Staff to return with an update upon any significant developments in the law or LASD policy; or,

3. Direct Staff to return with a draft ordinance addressing camping and storage of possessions in public areas of the City; or,

4. Provide alternative direction.

PREPARED BY: Lina Hernandez, Deputy City Manager/Public Works Director MEETING DATE: November 5, 2024
SUBJECT: Allocation of Additional Funds for Upgrades and Maintenance of the Cypress Water Production Facility

RECOMMENDATION
Appropriate an additional $400,000 plus 10% contingency for unexpected costs in the amount of $40,000 for a total not to exceed $440,000, inclusive of previously approved funding, from the Water Capital Fund for upgrades and maintenance of the Cypress Water Production Facility.

BACKGROUND
The City operates several facilities related to the production or distribution of water for the City’s water system. These include the Cypress Water Production Facility (CWPF), Harbor Hills Storage Tank, multiple import water connections, and a pump station. Historically, the CWPF provided a mixture of treated groundwater and imported surface water to Pressure Zone 1 (portion of the City north of Pacific Coast Highway); however, the CWPF was taken off-line in May 2019 due to the detection of benzene at the City’s only well. Since then, the City has been importing 100 percent of its water from the Metropolitan Water District (MWD).

Following the detection of benzene, the City has since embarked on a large-scale upgrade of the facility, including the addition of Granular Activated Carbon (GAC) vessels to ensure complete removal of benzene. The City Council awarded this project to R.C.

Staff is recommending an additional appropriation of $400,000 plus 10% contingency for unexpected costs in the amount of $40,000 for a total not to exceed $440,000 from the Water Capital Fund to the Cypress Project budget. These funds will also cover the purchase and installation of new parts, additional testing, and maintenance tasks and upgrades to the power generator, security cameras and other features to enhance safety and security. Staff is working closely with the State Division of Drinking Water, Hazen and Sawyer and multiple other specialized contractors to obtain the operating permit to startup the water treatment plant and see the project to completion.

FISCAL IMPACT
If approved, $400,000 plus a 10% contingency for unexpected costs in the amount of $40,000, for a total not to exceed $440,000 will be appropriated to the Cypress Water Production Facility CIP Project from the Water Capital Fund. The City anticipates a reimbursement of $2,000,0000 through the WRD grant following the completion of the project in accordance with the approved reimbursement agreement.

PREPARED BY: Adrian Fernandez, Community and Economic Development Director
MEETING DATE: November 5, 2024
SUBJECT: Discussion and Consideration to Adopt an Ordinance to Incorporate by Reference the Amended Title 32 of the Los Angeles County Fire Code

RECOMMENDATION
Read by title only and introduce a first reading of Ordinance No. 864; and schedule a public hearing and second reading of the Ordinance for the November 19, 2024, City Council meeting.

BACKGROUND
On January 17, 2023, the City Council adopted Ordinance No. 843, adopting by reference the 2022 Los Angeles County Building Code. The City has been adopting the Fire Code at the same time the Building Code is adopted. However, as of December 20, 2022, the County had yet to adopt the 2022 Fire Code. In the meantime, the 2022 California Fire Code (Title 24, Part 9) has been in effect since January 1, 2023.

On January 31, 2023, the Los Angeles County Fire Code 2022 Edition (Part 9 of Title 24 of the California Code of Regulations) went into effect on March 2, 2023, for Los Angeles County and Supplement 9 went into effect on July 1, 2024.

DISCUSSION
The attached draft Ordinance adopts the Los Angeles County Fire Code (Title 32) as the City’s Fire Code. Further, it ratifies building standards relating to fire and life safety, which are more restrictive than those contained within the California Building Standards Code.

California law requires building standards adopted by local jurisdictions that are more restrictive than those adopted by the State to be enacted by ordinance within 180 days after the state adopts the California Building and Fire Code. California Health and Safety Code Section 13869.7 authorizes the County Fire District to adopt these more stringent

2 standards but requires ratification by the City where these standards will apply. The findings made by the County supporting these changes begin on Page 273 of the Los Angeles County Ordinance.

The City of Lomita contracts with the County of Los Angeles Fire District for enforcement of the City’s fire code, the general supervision of conditions and equipment which aid in the control of fire, and the abatement of fire hazards and dangerous conditions. In the past, the City has adopted earlier versions of these codes by reference. The County codes have been revised to comply with the California Fire Code, and the International Fire Code with certain changes and modifications due to local conditions, adopted by the County.

FISCAL IMPACT
There are no financial implications resulting from this recommendation.

ORDINANCE NO. 864

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOMITA, CALIFORNIA, AMENDING SECTION 3-1 (FIRE PREVENTION) OF TITLE 3 OF THE LOMITA MUNICIPAL CODE; ADOPTING BY REFERENCE TITLE 32 (FIRE CODE) OF THE LOS ANGELES COUNTY CODE INCORPORATING BY REFERENCE THE 2022 EDITION OF THE CALIFORNIA FIRE CODE WITH CERTAIN CHANGES AND AMENDMENTS THERETO; AND FINDING

THE ACTION EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL

QUALITY ACT

THE CITY COUNCIL OF THE CITY OF LOMITA DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. Findings.

A. California law requires that on January 1, 2023, all portions of the 2022 California Code of Regulations Title 24 will be effective within the City.

B. The City may amend the provisions of the California Code of Regulations Title 24 provided express findings for each amendment, addition or deletion is made based upon climatic, topographical or geological conditions.

C. The City receives fire prevention, plan review and inspection services from the County of Los Angeles. The Los Angeles County Fire Prevention Division has recommended modifying certain parts of California Code of Regulations Title 24 due to local climatic, topographical and geological conditions in the City of Lomita.

D. The findings supporting the necessity for the amendments to building standards herein are contained in Exhibit 1 to this Ordinance in accordance with California Health and Safety Code Section 18941. 5 and are incorporated by reference herein.

E. The City of Lomita City Council hereby finds, determines and declares that those certain amendments to the State Code are appropriate and necessary to meet local conditions existing in the City of Lomita, and this Council hereby further finds, determines and declares that each such change is required for the protection of the public safety and is reasonably necessary because of local climatic, geological conditions.

Section 2. Section 3-1.01 of Title 3 of the City of Lomita Municipal Code is amended to read as follows:

3-1.01. County fire code adopted.

Except as hereinafter provided, Title 32, Fire Code, of the Los Angeles County Code, as amended and in effect on March 2, 2023, adopting the California Fire Code, 2022 Edition (California Code of Regulations Title 24, Part 9) and supplement – 9 in effect on July 1, 2024, is hereby incorporated herein by reference as if fully set forth herein, and shall constitute and may be cited as the Fire Code of the City.

In the event of any conflict between provisions of the California Fire Code, 2022 Edition, Title 32 of the Los Angeles County Code, or any amendment to the Fire Code contained in the City of Lomita Municipal Code, the provision contained in the latter listed document shall control.

A copy of Title 32 of the Los Angeles County Code and the California Fire Code, 2022 Edition, has been deposited in the office of the City Clerk and shall be at all times maintained by the City Clerk for use and examination by the public.

Section 3: Ratification of Building Standards. Pursuant to Health and Safety Code section 13869.7, subdivision (a), as part of its amendments to Title 32 (Fire Code), the Consolidated Fire Protection District of Los Angeles County proposed building standards relating to fire and panic safety that are more stringent than those building standards adopted by the State Fire Marshal and contained in the California Building Code. Pursuant to Health and Safety Code section 13869.7, subdivision (c), by adoption of this ordinance, the City Council hereby ratifies the building standards included within the ordinance amending Title 32 (Fire Code) as amended and in effect on March 2, 2023.

The City Council hereby finds that the more restrictive building standards contained in the District Fire Code are reasonably necessary due to the local climatic, geological, or topographical conditions in the City and adopts by reference the specific findings made by the Los Angeles County Board of Supervisors regarding these local conditions, a copy of which is attached as Exhibit 1.

Accordingly, the City Council finds the modifications in this Ordinance to the State Fire Code to be necessary for the protection of the public health, safety, and welfare.

Section 4. To the extent the provisions of this ordinance are substantially the same as previous provisions of the Lomita Municipal Code, these provisions shall be construed as continuations of those provisions and not as new enactments.

Section 5. Adoption of this ordinance is exempt from the California Environmental Quality Act (CEQA) in that it can be seen with certainty that there is no possibility that the ordinance may have a significant effect on the environment pursuant to State CEQA Guidelines Section 15061(b)(3). The adoption of the proposed ordinance is covered by the general rule that CEQA applies only to projects that have the potential for causing a Tuesday, November 05, 2024 Reg CC MTG, Page *1223

significant effect on the environment. As the proposed ordinance adopts local amendments to the California Building Standard Code reasonably necessary to mitigate threats to the public health and safety posed by local climatic, geological, or topographical conditions, the City’s adoption is largely administrative in nature and designed to improve environmental quality; therefore, the action poses no potential of causing significant adverse effects to the environment.

Section 6. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this ordinance or any part thereof. The City Council of the City of Lomita hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.

Section 7. Effective Date. This ordinance shall take effect thirty (30) days after the date of its passage; and prior to fifteen (15) days after its passage, the City Clerk shall cause a copy of this ordinance to be published in accordance with the provisions of the law. The City Clerk shall certify the adoption of this ordinance. The City Clerk shall file a certified copy of this ordinance with the California Building Standards Commission.

FINDINGS IN SUPPORT OF ADOPTION OF MORE RESTRICTIVE BUILDING STANDARDS.

The provisions of this ordinance contain various changes, modifications, and additions to the 2022 California Fire Code. Some of those changes are administrative in nature in that they do not constitute changes or modifications to requirements contained in the building standards adopted by the State Fire Marshal and published in the California Building Standards Code. Pursuant to Health and Safety Code Sections 17958.5, 17958.7, and 18941.5, the Board of Supervisors hereby expressly finds and determines that all of the changes and modifications to requirements contained in the building standards published in the California Building Standards Code, contained in this ordinance, which are not administrative in nature, are reasonably necessary because of local climatic, geological, or topographical conditions in the County of Los Angeles and in the Consolidated Fire Protection District of Los Angeles County (“District”).  This expressed finding is supported and based upon the following more specific determinations:

CLIMATIC – The County of Los Angeles/District is located in an area subject to climatic conditions with long periods of low humidity and hot weather, combined with unpredictable seasonal high winds (Santa Ana wind conditions), resulting in increased exposure to fire risk. This combination of events creates an environment that is conducive to rapidly spreading fires. Control of such fires requires rapid response.

Exhibit 1 - Findings
Tuesday, November 05, 2024 Reg CC MTG, Page *1225
HOA.103903238.11 274
With the time that is required to deal with potential obstacles from the wind, such as fallen trees, street lights, and utility poles, in addition to the time required to climb 75 feet vertically up flights of stairs, the ability to respond rapidly is negatively impacted.

Additionally, there is a significant increase in the amount of wind at 60 feet above the ground. Use of aerial-type firefighting apparatus above this height would place rescue personnel at increased risk of injury. High winds will also cause burning embers to become airborne resulting in the rapid spread of a fire to nearby structures. Immediate containment of a fire is the only method by which it can be controlled during high wind conditions. In high fire severity zones, a unique combination of low humidity, strong winds, and dry vegetation exists.

GEOLOGICAL – The County of Los Angeles/District is located in the middle of the seismically active area identified as Seismic Zone 4. The viability of the public water system would be questionable at best after a major seismic event. Tall buildings would become vulnerable to uncontrolled fires due to a lack of available water and an inability to pump sufficient quantities of any available water to floors above the 55-foot level. A severe seismic event has the potential to negatively impact any rescue or fire suppression activities because it is likely to create significant physical obstacles and logistical challenges. With the probability of strong aftershocks, there exists a need to provide increased protection for anyone on upper floors.

Geological conditions created by the numerous faults will result in increased fire danger to structures, delayed Fire Department response, and unique rescue challenges.

Seismic events of sufficient magnitude will cause substantial damage to structures.

These damages are likely to be accompanied by a substantial number of fires that may Tuesday, November 05, 2024 Reg CC MTG, Page *1226
HOA.103903238.11 275
exceed the Fire Department suppression capabilities. Accordingly, built-in fire suppression systems provide the only adequate measure to mitigate the potential hazards from and damage caused by such fires.

The County of Los Angeles/District is subject to occasional severe rainstorms.

The impacts from these rainstorms are exacerbated if hillside areas have been burned by wildland fires because significant mud and debris flows can occur. Mud and debris flows can impair Fire Department access or delay response times if access roads are obstructed by mud or debris.

TOPOGRAPHICAL – The topographical conditions of the County of Los Angeles/District includes many mountains, hills, and canyons which tend to accelerate the periodic high-velocity winds by means of a Venturi effect. These canyon winds and the significant growth of vegetation of a combustible nature increase the fire danger. Additionally, long periods of dry, hot weather, combined with unpredictable seasonal winds (Santa Ana wind conditions) result in increased exposure to fire risk.

The hillside areas have access roads that are narrow, steep, and contain many sharp curves, all of which makes timely response by large fire apparatus difficult.

The specific sections of this code that constitute more restrictive building standards are identified in the table set forth below. The more restrictive building standards contained in this code and identified in the table below shall be applicable only in those cities served by the District which have ratified the aforesaid sections in accordance with California Health and Safety Code Section 13869.
