City of Los Alamitos

CITY COUNCIL AGENDA REPORT
MEETING DATE: November 17, 2025 ITEM NUMBER: 10I
To: Mayor Shelley Hasselbrink & Members of the City Council Presented By: Emeline Noda, Director of Recreation & Community Services Subject: Short-Term Revocable License with Joint Forces Training Base for Sunburst Field

SUMMARY
This item recommends approval of a Short-Term Revocable License with the Los Alamitos Joint Forces Training Base (JFTB) to lease the land, also known as Sunburst Field, located at 11212 America Drive, Los Alamitos, CA 90720 for the use of expanded recreational programs, events, and additional green space.

RECOMMENDATION

1. Authorize the Mayor to execute the Short-Term Revocable License for Sunburst Field located 11212 America Drive, Los Alamitos, CA 90720 from the Joint Forces Training Base; and,

2. As part of the agreement, improvements to fields and facilities located on the property, through in-kind services (IKS), will be determined on an annual basis.

BACKGROUND
Sunburst Field, located at 11212 America Drive, has been an integral part of the community for over 62 years. The facility is located and owned by the Joint Forces Training Base (JFTB) and mainly operates as a recreational facility. Due to recent changes in regulations, the current lease with a local youth sports organization is unable to continue in its current capacity. The City of Los Alamitos was presented with an opportunity to expand green space through a oneyear lease at Sunburst Field.

DISCUSSION
Staff is recommending the establishment of an agreement with JFTB (Attachment 1) to lease the facility in exchange for in-kind services (IKS). This arrangement would provide the City with short-term (one-year) access to the property to conduct youth sports, City events, and expand other recreational programs, camps, or classes, while also providing green space for public use. The approach is expected to strengthen relationships between the City, the military base, and the local community, while preserving important recreational opportunities for the community of Los Alamitos.

FISCAL IMPACT

Page 329 of 407 ends

The Development Services Department will oversee all maintenance activities for Sunburst Field to ensure the facility is maintained in standard conditions, promoting safety and overall aesthetics. The cost of the lease will be offset through a combination of ongoing in-kind services (IKS) and Capital Improvement Projects (CIP), as well as additional IKS provided on the Base. These contributions and projects will be submitted for review and approval on an annual basis by both the Base Commander and City Council, ensuring alignment with the City’s recreational and operational goals. The staffing costs to oversee general maintenance are budgeted in the approved Fiscal Year 2025/2026 Development Services Budget.

Contracted maintenance items, such as landscaping and parking lot sweeping, will require City Council approval for any additional appropriations beyond the existing budget.

The staffing costs to conduct operations and oversee the facility are budgeted in the Recreation and Community Services Department's approved fiscal year 2025/2026 budget.

CITY COUNCIL AGENDA REPORT
MEETING DATE: November 17, 2025 ITEM NUMBER: 10J
To: Mayor Shelley Hasselbrink & Members of the City Council Presented By: Ron Noda, Assistant City Manager/Development Services Director Subject: Amendment No. 1 - Landscape Maintenance Services Agreement with EMTS, Inc.

SUMMARY
This item recommends approal of Amendment No. 1 to the Landscape Maintenance Services Agreement with EMTS, Inc. for the additional landscape maintenance of Sunburst Field Facility.

RECOMMENDATION

1. Authorize the Mayor to execute Amendment No. 1 to the Landscape Maintenance Services Agreement with EMTS, Inc. to include landscape maintenance services for the Sunburst Field Facility for an additional cost of $2,037 per month; and,

2. Authorize the City Manager to approve any additional as-needed services not to exceed 10% of the total contract amount of $426,248.19; and,

3. Appropriate $17,925.60 (8 months of services with a 10% contingency) from the General Fund to the Development Services Budget - Street Division for the FY 25/26 monthly landscape maintenance services for the Sunburst Field Facility.

BACKGROUND
On December 16, 2024, the City Council awarded a contract to EMTS, Inc. (EMTS) for landscape maintenance services following a Request for Proposal process. The contract award was for a total cost of $344,722.19 for a partial year of service during Fiscal Year (FY) 24/25, and a full year of service for FY 25/26 and FY 26/27. The City Council also approved a 10 percent contingency for any additional as-needed services.

The City is considering taking over operations at the Sunburst Field Facility, located at 11212 America Drive in Los Alamitos. Such a move will require additional landscape maintenance responsibilities. The amendment to the City's existing agreement with EMTS will provide landscape maintenance services to the facility.

DISCUSSION
In the event that the City assumes maintenance responsibility for Sunburst Field, regular landscape maintenance is necessary to maintain the facility's aesthetic and ensure safe use.

Our current contracted vendor, EMTS, is willing to provide weekly landscape maintenance

Page 346 of 407 ends

services at a monthly cost of $2,037. Assuming a start date in November, staff has estimated a total contract increase of $42,777 for the remaining duration of the contract. The change in price exceeds the original 10 percent contingency ($34,472) authorized by the City Council.

The additional EMTS services will change the current maximum compensation of the contract from $344,722.19 to $387,499.19.

In addition to an increase in the contract amount, staff is requesting a revised 10% contingency ($38,749) corresponding to the new contract total. To expedite the delivery of any as-needed services in the future, staff requests that the City Manager be authorized to amend the contract as needed, including the price and scope of work, up to the contingency amount of $38,749.92. With the new contingency dollar amount, the total contract amount will be $426,248.19.

Staff is requesting a General Fund budget appropriation of $17,925.60 to cover the expanded scope of work plus contingencies, for the Fiscal Year 25/26.

FISCAL IMPACT
The fiscal impact of adding weekly landscape maintenance services to the City's existing agreement with EMTS for the Sunburst Field facility is $2,037 per month or $42,777 for the remaining duration of the contract to June 2027. Including the 10% contingency, this would bring the total contract amount to $426,248.19. The additional $17,925.60 funding will be appropriated to the Development Services Budget - Street Division - Account 10.542.5260.

CITY COUNCIL AGENDA REPORT
MEETING DATE: November 17, 2025 ITEM NUMBER: 10K
To: Mayor Shelley Hasselbrink & Members of the City Council Presented By: Ron Noda, Assistant City Manager/Development Services Director Subject: Amendment No. 2 – Street Sweeping Services Agreement with Sweeping Corp of America

SUMMARY
This item recommends approving Amendment No. 2 to the Professional Services Agreement (PSA) with Sweeping Corp of America (SCA) to add the weekly sweeping of Sunburst Field Facility.

RECOMMENDATION

1. Authorize the Mayor to execute Amendment No. 2 to the Professional Services Agreement with Sweeping Corp of America to sweep the parking lot at the Sunburst Field Facility for an additional cost of $302.42 per month; and,

2. Authorize the City Manager to approve any additional as-needed services not to exceed 10 percent of the total contract amount of $128,916.74; and,

3. Appropriate $14,916.74 from the General Fund to the Development Services Department Budget—Street Division, for the extra sweeping services for the Sunburst Field Facility.

BACKGROUND
On January 1, 2022, the City entered into an agreement for street sweeping services with Clean Street, LLC. On December 13, 2022, the City Council approved Amendment No. 1, assigning the agreement to Sweeping Corp of America (SCA). The contract is a multi-year agreement with a monthly cost of $9,464 and an annual total cost of $113,568.

The City is considering taking over operations at Sunburst Field Sports Park, located at 11212 America Drive in Los Alamitos. Such a move would require additional maintenance responsibilities, including sweeping of the Sunburst Field parking lot.

DISCUSSION
Street sweeping is a vital service that contributes to Los Alamitos' cleanliness, aesthetics, and environmental health. Routine street sweeping removes debris, litter, sediment, and standing water from the public right-of-way, thereby preventing pollutants from entering the storm drain system and local waterways. In addition to aesthetic and environmental benefits, consistent street sweeping is a key requirement for meeting the City's Performance Evaluation Assistance (PEA) measures. Compliance with the mandated PEA standards ensures the City remains in

Page 355 of 407 ends

good standing with regional water quality regulations and displays a continued commitment to protecting natural resources.

The City anticipates absorbing the facility's use and maintenance of Sunburst Field. This will require regular sweeping of the parking lot to maintain cleanliness, enhance safety, and comply with stormwater management requirements. SCA is willing to provide weekly sweeping services at a cost of $302.42 per month. The additional parking lot sweeping services will result in an increase to the current monthly compensation from $9,464.00 to $9,766.42 and a change to the scope of work. The additional services will change the current maximum compensation for the duration of the contract from $113,568 to $117,197.04.

In addition to an increase in the contract amount, staff is requesting a revised 10% contingency ($11,719.70) corresponding to the new contract total. To expedite the delivery of any asneeded services in the future, staff requests that the City Manager be authorized to amend the contract to include an additional $11,719.70 for price and scope of work.

The total annual amended amount, including contingencies, will be $128,916.74. An appropriation of $14,916.74 is being requested to cover the extra scope of work plus contingencies for the duration of the agreement with SCA. The City Manager is requested to authorize the amendment to the contract with SCA regarding the price and scope of work for services related to street sweeping.

FISCAL IMPACT
The fiscal impact of adding sweeping services to the City's existing agreement with SCA for the Sunburst Field Facility is $302.42 per month or $3,629.04 for the duration of the contract.

Including the 10% contingency, the total contract amount would be $128,916.74. It is requested that a total of $14,916.74 be appropriated for the additional cost and contingency to the Development Services Department Budget—Street Division, account #10.542.5260.

CITY COUNCIL AGENDA REPORT
MEETING DATE: November 17, 2025 ITEM NUMBER: 10N
To: Mayor Shelley Hasselbrink & Members of the City Council Presented By: Ron Noda, Assistant City Manager/Development Services Director Stephanie Reis, Management Analyst
Subject: Resolution No. 2025-37 - Technology Replacement, Upgrade, & Sanitization Policy

SUMMARY
This item provides the City Council with a policy to guide the efficient replacement, retention, management, upgrades, and sanitization of the City's technology equipment.

RECOMMENDATION
Adopt Resolution No. 2025-37, entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF LOS ALAMITOS, CALIFORNIA, ADOPTING THE CITY OF LOS ALAMITOS TECHNOLOGY REPLACEMENT, UPGRADE, AND SANITIZATION POLICY."

BACKGROUND
The City of Los Alamitos relies heavily on technological systems and equipment to support daily operations, communication, and the delivery of public services. Over time, hardware and software components become outdated, less secure, and incompatible with evolving systems and industry standards. To maintain operational efficiency and ensure information security, it is essential that the City establishes a clear policy governing the replacement, upgrade, and sanitization of technology assets.

The Technology Replacement, Upgrade, and Sanitization Policy provides a structured approach for managing the lifecycle of City-owned technology equipment. This includes establishing replacement timelines, ensuring that upgrades align with current and future operational needs, and implementing standardized procedures for the secure sanitization and disposal of outdated or surplus technology. By adopting this policy, the City can enhance cybersecurity, improve service reliability, and reduce the risks associated with outdated or improperly handled equipment.

DISCUSSION
The proposed policy formalizes the City’s commitment to managing technology resources responsibly and efficiently. It outlines the criteria and process for evaluating when equipment should be replaced or upgraded based on age, performance, supportability, and costeffectiveness. In addition, it establishes clear procedures for data sanitization and disposal to

Page 369 of 407 ends

ensure compliance with best practices in information security and environmental sustainability.

Implementing this policy will help the City maintain a modern and secure technology environment that supports staff productivity and the delivery of high-quality public services. It also provides greater consistency and accountability in the management of City assets by defining staff responsibilities, replacement schedules, and documentation requirements.

Ultimately, the policy ensures that the City’s technology infrastructure remains reliable, secure, and capable of meeting the growing digital needs of the organization and the community.

FISCAL IMPACT
There is no fiscal impact for adoption of this policy. The policy supports efficient budgeting and cost savings by guiding timely replacement, management, and sanitization of the City's technology equipment.

City of Los Alamitos Technology Replacement, Upgrade, and Sanitization Policy

1. PURPOSE
Adequate mobile phones, computers, network hardware, and software are essential to staff communication, productivity, and efficient management of the City. With rapid advances in technology, it is critical that the City maintain a systematic plan for upgrading and replacing equipment to ensure access to reliable and secure services.

This document establishes the City of Los Alamitos’ policy for replacing City-owned technology equipment at the end of its life cycle and upgrading city-wide software as needed. It also outlines the process for media sanitization, which involves securely removing, erasing, or destroying data from storage media—including those embedded in imaging devices (such as printers, copiers, and multifunction devices)—to ensure that information cannot be reconstructed or retrieved by unauthorized individuals.

2. SCOPE
This Policy applies to all City-owned or City-leased:
• Workstations, laptop computers, and desktop peripherals (printers, scanners, copiers, projectors, monitors, and interactive whiteboards) • Network hardware (servers, switches, routers, bridges, access points, and related components)
• Cable plant and physical infrastructure
• Mobile phones (hardware and accessories), desktop phones, and two-way radios (excluding Police Department radios)
• Tablets and city-wide licensed software (e.g., Microsoft Windows, Microsoft Office Suite, Adobe, and other site-licensed desktop applications) All equipment subject to this policy must undergo approved sanitization or destruction before being reused, surplus, donated, recycled, or disposed of.

3. ROLES AND RESPONSIBILITIES
Department Heads - Each department head is responsible for identifying any exceptions (earlier or delayed replacements/upgrades) necessary to ensure an employee can effectively perform his/her job duties.

City Manager or their designee – This person is responsible for reviewing and approving requested exceptions and divisional budgets. This person is also responsible for budgeting for replacements and upgrades.

Information Technology (IT) Department—This group is responsible for generating and monitoring inventories, executing equipment replacements, and upgrading institutionPage 373 of 407 CC RESO 2025-37 – Exhibit A

Page 2 of 6 ends

wide software according to the replacement cycle. It also makes suggestions to the City Manager or their designee on equipment and software standards, upgrades, and replacements based on industry trends, software development cycles, costs, and risks to system stability.

4. POLICY STATEMENT
The City will maintain modern mobile phones, computers, network hardware, and software to support its daily operation and service to the City of Los Alamitos activities.

To accomplish this, technology hardware will be budgeted for replacement through the IT budget and replaced and upgraded according to the schedule contained in Attachment 1.

If the IT Department determines a hardware item to be irreparable or if the cost to repair exceeds the current market value of the item, the item may be replaced earlier than indicated in the table above, with all replacement costs covered by the City’s IT budget.

If a Department elects to replace an item earlier than the identified replacement cycle, both the City Manager or his/her designee and the IT Department must approve the request, and the electing Department will assume all costs for replacing the item.

If an employee damages IT hardware due to negligence, the repair or replacement of the items will be assumed by the Department to which the employee is assigned.

A. Software Upgrades
Related to software, all City systems must run the current or most recent prior (current -1) version of manufacturer-released software packages. If a city-owned system is found to be running an older version (current -2 or older) of any institution-wide software package (Microsoft Operating System, Microsoft Office Suite, Adobe, or other site-licensed desktop application), it must be upgraded promptly to maintain compatibility and security.

B. Replacement Requirements
All replacements must adhere to established standards per equipment type.

Departments must surrender a like-for-like device (mobile phone, computer, peripheral, etc.) for each device replaced. Departments may not repurpose devices to expand inventories without authorization. All enhancements to or changes from the standard that result in a cost higher than that of the standard will be charged to the requested Department’s budget.

If a Department keeps or maintains any special-purpose software or peripherals, they must remain compatible with the new equipment and all institution-wide software packages. Otherwise, the Department is required to purchase the software or peripheral upgrade with approval from both the City Manager or their designee and the IT Department.

C. Media Sanitization
i. General Requirements
All digital and non-digital media must be sanitized or destroyed prior to disposal, reuse, or transfer outside City control. The sanitization process removes information in a manner that ensures it cannot be retrieved or reconstructed by unauthorized individuals. Acceptable methods include:
• Overwriting digital media, a minimum of three times;
• Degaussing digital media prior to disposal or reuse; or • Physically destroying inoperable media (e.g., cutting, shredding, crushing).

Physical media (e.g., paper records, microfilm) shall be securely disposed of when no longer needed for operational, investigative, or security purposes, whichever is later. Destruction shall be completed by crosscut shredding or incineration.

Sanitization mechanisms must be applied at a level of strength and integrity appropriate to the security classification or sensitivity of the information contained in the media.

This control applies to all digital and non-digital system media that are subject to disposal, transfer, or reuse, whether removable or non-removable. Examples include, but are not limited to:
• Digital media in scanners, copiers, printers, mobile devices, laptops, desktops, network components, and servers.
• Non-digital media such as paper records, reports, and microfilm. ii. Printers, Copiers, and Multi-Function Devices (MFDs) To prevent unauthorized disclosure of stored data, all imaging devices must be sanitized or destroyed before being reassigned, surplus, returned, or disposed of.

Applicability: Covers all City-owned, leased, and vendor-managed devices containing onboard or removable storage (HDD, SSD, flash/eMMC, SD/CF, NVRAM, or fax memory).
iii. Standards Referenced
• California SAM §§ 3520.10 & 5365.3
• California Department of Technology MFD Guidance
• NIST SP 800-88 Rev. 1 (Media Sanitization)
• FBI/DOJ CJIS MP-6 (for Police Department devices)
iv. Sanitization Steps (IT)
• Identify all storage components (HDD/SSD, flash, NVRAM, fax memory, USB cache).
• Delete user mailboxes, address books, fax memory, credentials, and logs. • Perform vendor-supported secure erase or cryptographic purge.

Page 375 of 407 ends

CC RESO 2025-37 – Exhibit A

Page 4 of 6 ends

• Remove and retain removable media for destruction.
• Verify no recoverable data remains; conduct sample recovery test. • Complete Media Sanitization Certificate (Attachment 2) and affix “SANITIZED” label.
v. Media Sanitization Certificate (MSC) must include:
• Asset Tag, Device Type, Make/Model, Serial Numbers
• Storage components (type, capacity, serials) and sanitization method (CLEAR/PURGE/DESTROY)
• Tool/command used, firmware version
• Technician signature/date and witness (if destroyed)
• Final disposition (redeploy/surplus/recycle/return)
• Vendor certificate number (if applicable)
Lease Returns & Vendor Service Requirements:

Contracts must ensure the City either retains all removed storage or receives a vendor-signed certificate of sanitization listing serial numbers, method, and date.
vi. Prohibited Actions
• No device containing uncleared internal storage may be donated, recycled, auctioned, returned, or shipped.
• Departments shall not factory-reset or ship devices directly; all must route through IT for sanitization and release.
vii. Authorized Approvals
• IT Manager (or Designee): Approves sanitization method and MSC; authorizes release.
• Department Director (or Designee): Initiates surplus or transfer; ensures routing through IT.
• Finance Manager (or Designee): Verifies MSC inclusion in surplus packet before release.

THE CITY COUNCIL OF THE CITY OF LOS ALAMITOS, CALIFORNIA, AMENDING AND RESTATING SECTION 17.28.020 OF THE LOS ALAMITOS MUNICIPAL CODE CONCERNING THE REGULATION OF ACCESSORY DWELLING UNITS (ZOA 25-04)."

BACKGROUND
An accessory dwelling unit (“ADU”) is an attached or a detached residential dwelling unit that provides complete independent living facilities for one or more persons and is located on a lot with a proposed or existing primary residence. An ADU includes permanent provisions for living, sleeping, eating, cooking, and sanitation on the same parcel as a single-family dwelling or multifamily dwelling. A junior accessory dwelling unit ("JADU") is a small residential dwelling unit contained entirely within a single-family residence. A JADU may include separate sanitation facilities, or may share sanitation facilities with the existing single-family residence.

Section 17.28.020 of the Los Alamitos Municipal Code (“LAMC”) includes provisions regulating the development of ADUs and JADUs in the City. Section 17.28.020 was last updated in 2023 to be consistent with then-current State legislation regulating ADUs. Since that time the California Department of Housing and Community Development (“HCD”) has issued updated guidance regarding the implementation of the State ADU Law (California Government Code § 66310), and the California State Legislature has enacted further revisions to State ADU Law including Senate Bill 477 and Senate Bill 1211 (effective January 1, 2025). Furthermore, on August 12, 2025, City Staff received an inquiry from the HCD inquiring about the City’s plan to

Page 385 of 407 ends

update its ADU ordinance.

To address guidance from the HCD and the most recent revisions to State ADU Law, Staff prepared the proposed Ordinance (ZOA 25-04) included as Exhibit A.

DISCUSSION
The proposed 2025 update to the City’s ADU/JADU regulations makes minor changes to LAMC Section 17.28.020 (Accessory Dwelling Units and Junior Accessory Dwelling Units). To comply with SB 477, Statutory Numbering was changed from references to Government Code sections 65852.2, 65852.22(h)(1), 65852.26, and 65852.2(e)(1) to section 66313, 66313(d), 66341, and 66323. Table 1 provides a summary of the 2025 regulations and illustrates the other proposed changes in redline format.

An important component of the existing and proposed regulations is the differentiation between four types of ADUs, defined as follows.
• Attached ADU: an ADU that consists of new living space that is physically attached to a primary dwelling structure.
• Detached ADU: an ADU that consists of new living space that is physically separated from, but located on the same lot as, a primary dwelling structure. • Converted ADU: an ADU that consists of a re-purposed living space within an existing primary dwelling or accessory structure, including conversion of bedrooms, attached or detached garages, storage areas, or similar uses.
• Junior ADU: a unit that is no more than 500 square feet in size and contained entirely within a single-family residence or its attached garage; it may include separate sanitation facilities or may share sanitation facilities with the existing structure (as defined by Government Code section 66313(d)).

Government Code Section 66323 creates four categories of ADUs and JADUs that must be approved ministerially and are not subject to most other design and development standards such as lot coverage, setbacks, and parking. ADUs in this category are referred to as State exempt ADUs or “66323 Units”. While the City's ADU regulations have always included broad language to address State exempt units, the proposed Ordinance includes more specificity with respect to State exempt ADUs in Sections 17.28.020(B) and (H)(6).

• Permits no more than two detached ADUs to be developed on lots with a proposed multifamily dwelling; • Ensures that at least an 800 square foot ADU can be constructed that complies with fourfoot side and rear setbacks; • Clarifies no-parking requirements for ADUs with new single-family and new multifamily dwellings on the same lot;
• Clarifies that replacement of off-street parking is not required when an uncovered parking space is demolished in connection with the construction of an ADU; • Removes the restriction for short-term rentals of JADUs; and, • Clarifies that there is no requirement for off-street parking when attached garages are converted to a JADU.

SECTION 1. The foregoing recitals are true and correct and are incorporated herein by reference.

SECTION 2. Pursuant to Section 17.58.060 of the Los Alamitos Municipal Code, the following findings are made in support of this code amendment:
a) This Ordinance ensures and maintains internal consistency with the actions, goals, objectives, and policies of the General Plan, and would not create any inconsistencies with the Zoning Code.

Page 392 of 407 ends

4920-2005-5402, v. 1
ZOA 25-04 is consistent with the goals, policies, programs and land uses of applicable elements of the General Plan because the proposed Ordinance clarifies and updates the regulations for Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) in accordance with the requirements of Government Code Section 66310 et seq., which the Legislature adopted with the intent to streamline local regulations for the construction of new Accessory Dwelling Units. The State has long held that Accessory Dwelling Units are an important source of affordable housing in California. The City’s adopted General Plan Housing Element contains policies which support development of Accessory Dwelling Units, and the City’s Regional Housing Needs Allocation (RHNA) is supported by the addition of Accessory Dwelling Units to the City’s housing stock. b) This Ordinance will not be detrimental to the public convenience, health, interest, safety, or welfare of the City.

ZOA 25-04 will promote public convenience, health, interest, safety and general welfare and serve the goals and purposes of Title 17 by clarifying and streamlining the regulations applicable to development of new Accessory Dwelling Units. The proposed Accessory Dwelling Unit regulations require compliance with all applicable building and safety codes to ensure all life safety requirements are met.
c) This Ordinance has been reviewed in compliance with the provisions of the California Environmental Quality Act (CEQA) and the City’s environmental review procedures.

The City Council of the City of Los Alamitos determines that this Ordinance is exempt from CEQA per Public Resources Code Section 21080.17 and CEQA Guidelines Section 152(h), which state the adoption of an ordinance regarding second dwelling units (accessory dwelling units) to implement the provisions of Government Code Section 65852.2 are exempt from CEQA; this Ordinance is further exempt from CEQA pursuant to CEQA Guidelines Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) because it has no potential for resulting in a physical change to the environment, directly or indirectly.

SECTION 3. Section 17.28.020 of Article 4 (Regulations for Specific Land Uses and Activities) of Title 17 (Zoning) of the Los Alamitos Municipal Code is hereby amended and restated in its entirety to read as follows:

4920-2005-5402, v. 1
(b) Minimum Size. The total floor area of an attached or detached ADU shall be at least 150 square feet.
(c) Height
i. Except as provided below, the height of a detached ADU on a lot with an existing or proposed single-family or multifamily dwelling unit shall not exceed 16 feet.
ii. The height of a detached ADU located on a lot with an existing or proposed single-family or multifamily dwelling unit that is within one-half of one mile walking distance of a major transit stop or a high-quality transit corridor, as those terms are defined in Section 21155 of the Public Resources Code, shall not exceed 18 feet. However, an additional two feet of height, for a maximum of 20 feet, is allowed when necessary to align the roof pitch on the ADU to the roof pitch of the primary dwelling.

iii. The height of a detached ADU on a lot with an existing or proposed multifamily, multistory dwelling shall not exceed 18 feet. iv. The height of an attached ADU shall not exceed the height limitation of the zoning district applicable to the primary dwelling or 25 feet, whichever is lower. In no event shall any such ADU exceed two stories.

5. Applicability of Development Standards. Except as otherwise provided in this Section, all ADUs must conform to the development standards set forth in this Title 17 for the zoning district in which they are located. Notwithstanding the foregoing, when the application of a development standard related to floor area ratio, lot coverage, open-space, front setbacks, or minimum lot size would prohibit the construction of an attached or detached ADU of at least 800 square feet with fourfoot side and rear yard setbacks, such standard(s) shall be waived to the extent necessary to allow construction of such an ADU.

6. Setbacks and Spacing.
(a) Front Yard Setbacks. New attached and detached ADUs are subject to the same minimum front yard setback requirements applicable to other structures on the lot on which the ADU is located.
(b) Side and Rear Yard Setbacks. Minimum setbacks of no less than four (4) feet from the side and rear lot lines are required for new attached and detached ADUs.

Page 397 of 407 ends

4920-2005-5402, v. 1
(c) Converted ADUs. No setbacks are required for converted ADUs, provided the side and rear yard setbacks of the existing converted structure are sufficient for fire and safety, as determined by the City’s building official.

7. Off-street Parking.
(a) One off-street parking space must be provided for an attached or detached ADU. The required parking space may be permitted in setback areas, or through tandem parking on a driveway, unless specific findings are made by the Director that parking in setback areas or tandem parking is not feasible based upon specific site or regional topographical or fire and life safety concerns.
(b) When a garage, carport, covered parking structure, or uncovered parking space is demolished in conjunction with the construction of an ADU or converted to an ADU, those off-street parking spaces are not required to be replaced.
(c) Off-street parking is not required in the following instances:
i. The ADU is located within one-half mile walking distance of public transit, including transit stations and bus stations;
ii. The ADU is located within an architecturally and historically significant historic district;
iii. The ADU is part of the proposed or existing primary residence or accessory structure (i.e., a converted ADU);
iv. When on-street parking permits are required but not offered to the occupant of the ADU;
v. When there is a car share vehicle station located within one block of the ADU; and/or
vi. When a permit application for an ADU is submitted with a permit application to create a new single-family dwelling or a new multi-family dwelling on the same lot, provided that the ADU or the parcel satisfies any other criteria listed in this Section.

8. Exterior Access. An attached or converted ADU must have independent exterior access from the proposed or existing primary dwelling.

9. Passageway. No passageway shall be required in conjunction with the construction of an ADU.

Page 398 of 407 ends

4920-2005-5402, v. 1
F. JADU Requirements.

1. Footprint. A JADU may only be constructed within the walls of a proposed or existing single-family residence, including an attached garage.

2. Size. A JADU shall not be less than 220 square feet and shall not exceed 500 square feet in size.

3. Separate Entrance. A JADU located within a proposed or existing single-family residence must include a separate entrance from the main entrance of the residence.

4. Kitchen Requirements. A JADU must include an efficiency kitchen, including a cooking facility with appliances, and a food preparation counter and storage cabinets that are of reasonable size in relation to the size of the JADU.

5. Bathroom Facilities. A JADU may include separate sanitation facilities or may share sanitation facilities with the proposed or existing single-family residence in which it is located. If a JADU does not include separate sanitation facilities, the JADU must include an interior entrance to the primary dwelling’s main living area.

6. Parking. No additional off-street parking is required for a JADU beyond that required at the time the existing primary dwelling was constructed.

7. Fire Protection. For purposes of any fire or life protection ordinance or regulation, a JADU shall not be considered a separate new dwelling unit.

8. Utility Service. For purposes of providing service for water, sewer, or power, including a connection fee, a JADU shall not be considered a separate or new dwelling unit.

9. Deed Restriction. Prior to the issuance of a building permit for a JADU, the owner shall record a deed restriction against the title of the property in the County Recorder's office with a copy filed with the Director. The deed restriction shall run with the land and shall bind all future owners, heirs, successors, or assigns. The form of the deed restriction shall be provided by the City and shall provide that:
(a) The property shall include no more than one JADU.
(b) The JADU may not be sold, mortgaged, transferred separately from the primary residence; this deed restriction may be enforced against future purchasers. (c) The owner of the property shall occupy either the primary residence or the JADU as his or her domicile. In the event owner occupancy of the property ceases, the JADU shall not be used as a separate dwelling unit, and shall not be separately rented or leased for any purpose.

Page 399 of 407 ends

4920-2005-5402, v. 1
(d) A restriction on the size and attributes of the junior accessory dwelling unit that conforms with this Section.

The deed restriction may not be modified or terminated without the prior written consent of the Director.

G. Other Requirements.

1. No Separate Conveyance. Except as otherwise provided in Government Code section 66341 or by other applicable law, an ADU or JADU may be rented separate from the primary residence, but may not be sold or otherwise conveyed separate from the primary residence, and a lot shall not be subdivided in any manner which would authorize such separate sale or ownership.

2. No Short-Term Rental Permitted. An ADU that is rented shall be rented for a term that is longer than thirty (30) days. Short-term rental (i.e., 30 days or less) of an ADU is prohibited.

3. Owner Occupancy Requirements.
(a) ADUs. Owner occupancy of either the primary dwelling or ADU is not required. (b) JADUs. The property owner of the lot upon which a JADU is located must occupy either the JADU or the primary residence as his or her domicile.

H. Permit Application and Review Procedures.

1. Building Permit Required. A building permit is required prior to construction of an ADU or JADU. Except as otherwise provided in this Section or by State law, all building, fire, and related code requirements applicable to habitable dwellings apply to ADUs and JADUs. However, fire sprinklers shall not be required if they are not required for the primary dwelling.

2. Application. Prior to the issuance of a building permit for an ADU or JADU, the applicant shall submit an application on a form prepared by the City, along with all information and materials proscribed by such form. No application shall be accepted unless it is completed as prescribed and is accompanied by payment for all applicable fees.

3. Review. The Director shall consider and approve or deny a complete application for an ADU or JADU ministerially without discretionary review or public hearing within the time prescribed by law. Review is limited to whether the proposed ADU or JADU complies with the requirements of this Section. If an applicant requests a delay, the time period for the City to review of an application shall be tolled for the period of the requested delay. If the application to create an ADU or a JADU

Page 400 of 407 ends

4920-2005-5402, v. 1
unit is submitted with an application to create a new single-family dwelling on the lot, the Director may delay acting on the application for the ADU or the JADU until the City acts on the application to create the new single-family dwelling, but the application to create the ADU or JADU will still be considered ministerially without discretionary review or a hearing.

4. Zoning Conformity. The City shall not require, as a condition of approval of a permit application for the creation of an ADU or JADU, the correction of nonconforming zoning conditions.

5. Demolition Permits. A demolition permit for a detached garage that is to be replaced with an ADU shall be reviewed with the application for the ADU and issued at the same time.

6. State Exempt ADUs and Conformity with State Law. The City shall not apply any requirement or development standard provided for in this Section to an ADU or a JADU to the extent prohibited by any provision of State law, including, but not limited to Government Code section 66323. State exempt ADUs shall be approved ministerially and are not subject to the standards set forth in Government Code §§ 66314-66322. For example, and without limitation, state exempt ADUs do not have to comply with Subsection (E)(4)(a)(ii) size limits for new construction multifamily detached ADUs, Subsection (E)(6)(a) front setback requirements, Subsection (E)(6)(b) side and rear setback requirements for single-family converted ADUs and JADUs, or Subsection (E)(7) off-street parking requirements.

I. Utilities

1. ADUs. Unless otherwise mandated by applicable law or the utility provider or determined by the City’s Public Works Director to be necessary, an ADU may be served by the same water, sewer, and other utility connections serving the primary dwelling on the property, and the installation of a new or separate utility connection directly between an ADU and a utility is not required. However, separate utility connections and meters for ADUs may be installed at the property owner’s option, when permitted by the utility provider, and subject to the payment of all applicable fees.

2. JADUs. A JADU shall be served by the same water, sewer, and other utility connections serving the primary single-family dwelling in which it is located, and no separate utility meters shall be permitted for a JADU.

J. Fees.

1. No impact fee is required for an ADU measuring less than 750 square feet. Any impact fees charged for an ADU of 750 square feet of more shall be charged proportionately in relation to the square footage of the primary dwelling.

Page 401 of 407 ends

4920-2005-5402, v. 1

2. Construction of an ADU is subject to any applicable fee adopted under the California Government Code, Title 7, Division 1, Chapter 5 (commencing with § 66000) and Chapter 7 (commencing with § 66012).

3. For purposes of this Subsection, “impact fee” does not include any planning application fee, plan check fee, or building permit fee.

SECTION 4. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.

SECTION 5. The City Clerk shall certify as to the adoption of this Ordinance and shall cause a summary thereof to be published within fifteen (15) days of the adoption and shall post a Certified copy of this Ordinance, including the vote for and against the same, in the Office of the City Clerk, in accordance with Government Code Section 36933.
