It is the sole responsibility of CITY to immediately notify COUNTY of any discrepancy between relevant ordinances maintained by CITY and those maintained by COUNTY.

OC Animal Care
Animal Services Cost Estimate
City of Los Alamitos
In order to calculate the most accurate net cost estimate of providing Animal Care services to a noncontract city, OC Animal Care would need 12 months of service volume statistics and user fee revenue totals from that city. If that data is not immediately available, the alternative would be to find a contract city that has similarities with the non-contract city and use that contract city as a calculation base.

For this estimate calculation, three contract cities have been identified as having similarities with the City of Los Alamitos.

1. The City of Cypress – Similar in location

2. The City of San Juan Capistrano – Similar in population density

3. The City of Villa Park – Similar in population density The preliminary estimates for the City of Los Alamitos are calculated by taking the amount billed for Animal Care services provided to each of above contract cities during fiscal year 2024-25 and multiplying it by the percentage difference in population. An average of those calculations is then used to estimate what the net cost of Animal Care services would have been for the City of Los Alamitos during fiscal year 2024-25, which results in a total of $84,301.

The estimate for fiscal year 2024-25 is then adjusted using the cost increase percentages from fiscal years 2025-26 and 2026-27.

The end result is a net cost estimate of $92,476 for providing Animal Care services to the City of Los Alamitos during fiscal year 2026-27.

Please note, if a new city requests to participate in the Animal Care services program, and the County elects to provide services, that city will be required to pay the costs of any necessary shelter expansion to accommodate the anticipated use of the shelter. If the County determines that no expansion is needed, the city will pay an additional 5% of its annual Notice of Intent estimate each year for the fiveyear contract term for shelter maintenance and repair, which will be used towards the cost of capital projects. For the City of Los Alamitos, the additional 5% would be $4,624.

RE: OC Animal Care - Notice of Intent
Greetings:

Enclosed for your reference are three copies of the new Animal Care Notice of Intent (NOI).

This notice includes a list of the Animal Care services that the County of Orange (County) intends to provide for your City during the upcoming fiscal-year, which spans from 07-01- 26 through 06-30-27, at an estimated Net Cost of $92,476.

For fiscal-year 2026-27, the Net Cost estimate for all Contract Cities and the County has increased by 3.07% to $21,523,232. This is primarily due to salary increases approved by the County in labor negotiations with all unions and the continual need for OC Animal Care to fill critical positions in order to provide the high-quality services expected. While a total of 126 filled positions and 17 vacancies is projected for the upcoming fiscal-year, please note that number may be adjusted mid-year in order to meet the current demands for service. The increase is also caused by the rising cost of many essential Animal Care items, which include pharmaceuticals, feed, and general animal supplies.

As stated in the Agreement for Provision of OC Animal Care Services, each City shall be billed either in equal installments based on its Notice of Intent for that year, or based on actual utilization for the period, whichever is greater for the first three quarters of the year with the final, fourth quarter billed on actual utilization for the full year of services.

Therefore, your City’s actual Net Cost for the entire fiscal-year may be higher or lower than the estimate provided. Also, if any of the previous Contract Cities no longer request services from OC Animal Care or if any new Cities request services, the year-end estimate will be recalculated and an updated version will be provided.

Please note, if a new city requests to participate in the Animal Care Services program, and the County elects to provide services, that city will be required to pay the costs of any necessary shelter expansion to accommodate the anticipated use of the shelter. If the County determines that no expansion is needed, the city will pay an additional 5% of its annual Notice of Intent estimate for shelter maintenance and repair each year for the fiveyear contract term, which will be used towards the cost of capital projects. For the City of Los Alamitos, the additional 5% for fiscal-year 2026-27 is $4,624 Please review the enclosed NOI, obtain the signature of your City’s authorized representative on all three copies, and return them to:

CITY COUNCIL AGENDA REPORT
MEETING DATE: June 15, 2026 ITEM NUMBER: 12A
To: Mayor Tanya Doby & Members of the City Council
Presented By: Windmera Quintanar, City Clerk
Matthew Lightner, Management Analyst
Subject: Consideration of the Process for City Council Submission of a Ballot Argument in Favor of a Los Alamitos Hotel Tax (TOT Measure)

SUMMARY
The City is considering placing a ballot measure regarding the Los Alamitos Hotel Tax (TOT Measure) at the November 3, 2026, election. If the measure is placed on the ballot, the arguments for and against the measure must be submitted to the City Clerk by June 30, 2026.

Accordingly, the City Council must decide whether some or all of the Council Members would like to submit an argument in favor of the ballot measure and, if so, draft and approve the text of a ballot argument. Due to the constraints of the Brown Act, the development or approval of a ballot argument by more than two Council Members must occur at a noticed public meeting.

Accordingly, advance consideration of the process for developing and approving arguments will help avoid a last-minute crisis or missed opportunity.

RECOMMENDATION

1. Consider whether to submit a ballot argument signed by all five Council Members, or by two or less Council Members in favor of the proposed ballot question; or,

2. Provide direction to Staff concerning whether to schedule a future agenda item regarding the development and/or approval of the ballot measure argument.

BACKGROUND
The Elections Code: For matters placed on the ballot by the City Council, Elections Code § 9282 authorizes the Council, its members, or “any individual voter who is eligible to vote on the measure, or bona fide association of citizens, or any combination of voters and associations” to file a written ballot argument. Elections Code § 9283 provides that up to five authors may sign a ballot argument, so long as each files the written certification required by Elections Code § 9600. If more than five authors sign the argument, only the first five will be printed. The argument may not exceed 300 words in length.

When some or all of the City Council Members submit an argument that argument has priority under the Elections Code. Specifically, when a legislative body places a measure on the ballot and the body, or one or more of its authorized members, submits a ballot argument, Election Code § 9287 requires the elections official to print that argument, instead of any competing arguments, in the voter materials. The Elections Code ranks the order of preference for competing ballot arguments by authors and signatories as follows:

Page 454 of 466 ends

1. The legislative body, or member or members of the legislative body authorized by that body.

2. The individual voter, or bona fide association of citizens, or combination of voters and associations, who are the bona fide sponsors or proponents of the measure.

3. Bona fide associations of citizens.

4. Individual voters who are eligible to vote on the measure.

Therefore, the Council has an opportunity to designate its own members as the authors of the argument in favor of the measure. If the Council does not do so, one of the competing arguments (if any) will be selected by the City Clerk using the order of preference listed above and any other local rules implemented by the City Clerk. (Many elections officials print the earliest received argument if required to choose between arguments of the same status in the statutory priority list.)
Authoring the arguments in favor of the measure will give the Council or Council Members it designates control over the argument. However, because there are five Council Members, no names will appear in support of the argument other than those of the designated Council Members.

Per the Elections Code, once ballot arguments are submitted, the City Clerk, as the elections official for the City, is required to maintain confidentiality as to all ballot arguments until the deadline for submitting arguments has passed, at which time the arguments become open to public inspection. However, once a document has been circulated to the Council in connection with a public meeting, it becomes public (unless privileged). Thus, any proposed ballot argument would become public once disseminated to the Council.

The Brown Act: Ballot measures and the subjects they cover are within the jurisdiction of the City Council, the Brown Act requires that any decision or discussion by more than two members of the Council concerning ballot measure arguments take place at a public meeting.

Thus, discussion and action concerning ballot measure arguments should be limited to no more than two Council Members outside of a public meeting. Discussion and action concerning the ballot measure arguments amongst more than two Council Members may only occur at a public meeting.

History
November 5, 2024 - Measure X (Charter Amendment): Mayor and Mayor Pro Tem authored the argument in favor. Mayor, Mayor Pro Tem, and two community members signed the argument.

November 3, 2020 - Measure Y (Sales Tax): Mayor Pro Tem and Council Member authored the argument in favor. Four of five Council Members signed the argument during a special Council meeting.

November 6, 2012 - Measure DD (Telephone Users Tax (TUT)): Mayor Pro Tem and Council Member authored the argument in favor. Four of five Council Members signed the argument during a Council meeting.

DISCUSSION

Page 455 of 466 ends

The City Council has the opportunity to author the ballot argument in support of the proposed Charter Amendment. To avail itself of this opportunity, it is recommended that the City Council either:

1. Designate two Council Members to draft and sign a ballot argument (with or without signatures from up to three additional members of the community) and with no further action by the full City Council; or,

2. Designate two Council Members to draft an argument for consideration and signature by all five Council Members and direct that an item be placed on a Special Meeting agenda to consider approval or modification of that argument before the June 30, 2026, submission deadline.

CITY COUNCIL AGENDA REPORT
MEETING DATE: June 15, 2026 ITEM NUMBER: 12B
To: Mayor Tanya Doby & Members of the City Council
Presented By: Chet Simmons, City Manager
Subject: Resolution No. 2026-23 - Personnel and Benefit Changes for NonRepresented Employees

SUMMARY
This report outlines and seeks consideration to approve benefit changes for Non-Represented Employees.

RECOMMENDATION
Adopt Resolution No. 2026-23, entitled, “A RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF LOS ALAMITOS, CALIFORNIA, AMENDING THE SALARIES AND BENEFITS FOR THE EXECUTIVE MANAGEMENT AND NON-REPRESENTED EMPLOYEES”.

BACKGROUND
Staff conducted a comprehensive review of the City’s overall compensation framework and identified the continued need for a competitive benefits package to support organizational stability and workforce excellence. Maintaining competitive benefits is essential to attracting and retaining qualified employees, promoting long-term engagement, and ensuring the City remains an employer of choice in a highly competitive labor market. A strong benefits package also supports succession planning by helping the organization retain skilled personnel and preserve institutional knowledge. These measures are critical to sustaining effective operations and meeting service expectations as the organization grows and evolves. This process has become more important, as members take on new job functions and roles that are outside their original duties.

The City Council has periodically updated the Salary and Benefit Resolution for Non-Represented Employees, including amendments adopted on May 26, 2026 (2026-09), April 29, 2024 (Resolution 2024-13), April 18, 2025 (Resolution 2025-28), and April 20, 2026 (Resolution 2026-03) to address organizational needs, establish or revise classifications, and update the salary schedule. The City now proposes additional amendments to the benefits for Executive Management and Middle Management Non-Represented Employees related to administrative leave, car allowance, and 401(A) contributions. The Deputy City Clerk position will be reclassified to be included as part of the Middle-Management group.

DISCUSSION
The suggested enhancements to the benefits provided to Department Heads and Managers would enhance internal equity and support competitive recruitment and retention.

Page 457 of 466 ends

For Executive Management (Department Heads), the proposed changes include increasing administrative leave from 80 to 140 hours annually (non-accruable) and providing an annual City deferred compensation contribution of $11,000. For Middle Management employees, the updates include increasing administrative leave from 80 to 100 hours annually (non-accruable) and establishing an annual City deferred compensation contribution of $7,000. In addition, Middle Management will be included in the car allowance update, which will be $300 per month, matching other current allowances.

All employees in the Executive and Middle Management classifications, excluding safety positions, will be designated as at-will.

This update reflects the benefit being extended only to Executive and Middle Management classifications.

FISCAL IMPACT
Funding for this adjustment is available within the existing FY 2026–27 departments' operational budget, utilizing unencumbered personnel appropriations. No additional General Fund appropriation is required at this time.
