Agenda Staff Report
TO: Mayor Amabile and Council Members
FROM: Nirorn Than, City Manager
Mary Lerner, City Attorney
DATE: June 3, 2026
TYPE OF REPORT: Regular Agenda
SUBJECT: Discussion and Direction Regarding Whether the Question of an Appointed City Treasurer Position Should be Placed on the November 3, 2026 General Election Ballot
______________________________________________________________________ Recommendation:

Staff recommend that Council discuss and provide direction regarding whether the question of an appointed city treasurer position should be placed on the November 3, 2026 General Election Ballot.

Background:

At the April 15, 2026 Council meeting, Council requested this item be brought back for discussion and direction. Previously, the question of whether the City Treasurer position should go from being elected to appointed position was placed on the ballot in March 2024 (Measure G). The ballot question was: “Shall the offices of city clerk and city treasurer be appointive?” A “yes” vote supported changing the offices of city clerk and city treasurer from elected positions to appointed positions. A “no” vote opposed changing the offices of city clerk and city treasurer to appointed positions. This Measure required a simple majority to pass. The election results were:
981
ITEM 9
Los B anos M easure G
Result Votes Percentage
Yes 2,027 38.44%
N o 3,246 61.56%
As such, this Measure failed and the City Treasurer position remained elective.

Discussion:

The California Government Code requires each general law city to have a City Treasurer, who is either elected or appointed. Historically, California cities have moved from elected City Treasurers to appointed staff. More than two-thirds of California cities have made this move; the City of Los Banos has not.

The only requirements to run for the elected City Treasurer is that the candidate be 18 years of age, a registered voter, and a resident within the city limits. The City Treasurer is a ministerial office whose duties are regulated by statute, resolution and ordinance.

This position is a part-time elected official with most duties performed by full-time city staff members. In recent years, these duties have become more time consuming and difficult as the governmental accounting standards have become more complex and large projects that involve state and local grant monies require specialized recordkeeping responsibilities. The position of City Treasurer is not a “political” one and it has no policy making power. Rather it is the responsibility of the City Treasurer, in conjunction with the Director of Finance, to ensure that the fiduciary responsibilities of the City are met.

Should Council give direction to place the item on the November 2026 General Election ballot, Government Code section 36509 provides the form of the question that must be used:
“36509. The question shall be printed on the ballots used at the election substantially in one of the following forms… (c) “Shall the office of city treasurer be appointive? The words “yes” and “no” shall be so printed on the ballots that the voters may express their choice.”
The City Treasurer is currently elected by the citizens of Los Banos to a 4-year term.

Lucy Lawrence ran for re-election uncontested on November 5, 2024 to fill an unexpired/partial term. As such, Ms. Lawrence’s current term expires November 2026.

Should council place the above-referenced question on the November 2026 ballot and it passes, The elected City Treasurer will serve in this position until November 2030 at which time, the City could then appoint the next City Treasurer. If the ballot measure fails, any qualified individual could run for the City Treasurer position in the November 2030 election.
