AGENDA STAFF REPORT
DATE:
January 18, 2022
TO:
Honorable Mayor and Members of the City Council
APPROVED BY:
Ernie Hernandez, City Manager
PREPARED BY:
Thomas Thornton, Director of Public Works
Lorry Hempe, Public Works Special Projects Manager
SUBJECT:
ADOPTION OF A FIVE-YEAR CAPITAL IMPROVEMENT PLAN (FY2021-22 TO FY2025-26)
Recommendation:
Staff recommends that the City Council adopt the attached resolution entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADOPTING THE FIVE YEAR CAPITAL IMPROVEMENT PLAN.”
Background:
On July 20, 2021, the City Council adopted the City’s Biennial Budget for Fiscal Year 2021-22 (FY21-22) and Fiscal Year 2022-23 (FY22-FY23) which included a Capital Improvement Program (CIP) Budget for two years.
The proposed Five-Year Capital Improvement Plan (Five-Year CIP) includes projects incorporated in the adopted FY21-22 and FY22-23 CIP Biennial Budget, adopted projects proposed for amendments, and projects anticipated to be proposed for the FY23-24, FY24-25 and FY25-26 CIP Budgets. Staff engaged the assistance of Avant Garde to assist with the preparation of the Five-Year CIP. The Five-Year CIP addresses the City’s infrastructure needs over a five-year planning horizon. The projects proposed in the subsequent years following the adopted Biennial Budget will be used for planning purposes only. Projects to receive budget approvals will be those projects incorporated in the Biennial Adopted Budget or as amended by the City Council throughout the year on a project per project basis.
Discussion and Analysis:
The Five-Year CIP (see Exhibit A) covers a five-year planning horizon. Projects programmed in the Five-Year CIP were selected based on infrastructure needs balanced against current and forecasted revenues. The Five-Year CIP is intended be reviewed annually and adjusted as needs shift and/or revenue projections change.
The table below is the projected annual capital funding requirement for the proposed Five-Year CIP:

The City’s capital projects are long-term investments in the City’s infrastructure. The eighty four (84) projects listed in the proposed Five-Year CIP (Exhibit A) fall within the following categories: water improvements, street improvements, parks/recreation improvements, sewer improvements, facilities improvements, traffic improvements, sidewalk improvements, and other.
The Five-Year CIP contains ongoing capital projects like the Ham Park Playground, Emergency Generators at water well sites, Wright Road Street Improvement, Energy Conservation Measures, alley improvements to name a few. The Five-Year CIP also includes long awaited grant funded projects like the Fernwood Park and the Bike Trail construction. It also includes a budget for Priority 2 and Priority 3 streets, an ongoing allocation for sidewalk improvements, and traffic improvements. Of the $81.6 million budget requirement for the 5-Year CIP, Water Improvements category tops the list of the most budget allocated at 27.6 percent. The City was able to issue utility bonds to implement water and sewer improvements. Utility related projects for water and sewer combined represents 39 percent of the Five-Year CIP Budget.

Unfunded Projects
Staff has identified over $40 million worth of projects that have not been programmed within the Five-Year CIP primarily due to lack of funding. As funds become available certain projects on this list may be recommended for funding in the future. The unfunded projects can serve as a guide to apply for grant funding, seek out alternate sources of revenues; or consider increasing existing rates. As staff goes through the annual review of the Five- Year CIP Plan, the initial estimates can be further refined to ascertain the extent of the deficiencies. The unfunded projects list, does not include the repairs of all the streets identified under the Pavement Management Plan.
Fiscal Impact:
The 5-Year CIP includes eighty four (84) projects costing $81.6 million. Staff has identified twenty six (26) funding sources. An estimated 54 percent of the Five-Year CIP funding requirement has been adopted by the City Council by incorporation in the City’s Biennial City Budget. Recommendation:
Staff recommends that the Mayor and Council review and appoint delegates and alternates for the various organizations and committees, and direct staff to notify said organizations on the appointments.
Background:

As a result of the City Council’s recent reorganization, the list of appointments should be updated.
Fair Political Practices Commission (FPPC)
In March 2012, the Fair Political Practices Commission amended FPPC Regulation 18705.5 (renumbered to 18702.5 in 2015) to allow a Public Official to participate in a decision that would appoint him/herself to an external board position, under a specific condition. The conditions are set forth in FPPC Regulation 18702.5.
To implement FPPC Regulation 18705.5 (renumbered as 18702.5), in May 2012, the FPPC adopted Form 806 (Agency Report of Public Official Appointments) that may be used by the City to report additional compensation that officials receive when appointing themselves to positions on committees, boards, or commissions of a public agency, special district, and joint powers agency or authority. This form is to be completed by the City and posted on its website, and updated as changes occur.
Once mayoral appointments are made, they will be added to the Form 806, which will be posted on the City’s website.
