TO:
Honorable Mayor and Members of the City Council
APPROVED BY:
Suja Lowenthal, City Manager
PREPARED BY:
Nam Tran, PE, QSP/QSD, Associate Engineer
SUBJECT:
AWARD OF CONTRACT TO USA CONSTRUCTION LLC. FOR THE
LYNWOOD NATATORIUM POOL RESURFACING PROJECT (CIP
PROJECT NO. 4011.68.113)
Agenda Item # 10.6.
Recommendation:
Staff recommends that the City Council adopt the attached resolution:
1 .
Awarding a contract to USA Construction, Inc. for the Lynwood Natatorium Pool Resurfacing Pool Resurfacing Project (CIP Project No. 4011.68.113); 2 .
Authorize the Mayor to execute the agreement; and
3 .
Authorize the City Manager to approve agreement amendments related to the project.
Executive Summary:
The Lynwood Natatorium Pool Resurfacing Project was originally bid and awarded based on specifications utilizing pool paint as the finished surface. Following contract award, the City was informed that pool paint is no longer permitted for public swimming pools under the current requirements of the Los Angeles County Department of Public Health. As a result, the original construction contract was terminated, the project specifications were revised to require white pool plaster and tile finishes, and the project was rebid.
On March 24, 2026, City Council authorized staff to advertise a notice inviting rebid under
revised specifications calling for white pool plaster and tile finishes, consistent with current County requirements.
On May 28, 2026, the bid opening for the Lynwood Natatorium Pool Resurfacing Project was City Council City Council Special Meeting 201
held, and staff determined that USA Construction LLC. was the lowest responsible and responsive bidder.
Staff recommends that the City Council award the construction contract to USA Construction, Inc. in the amount of $386,170. The total estimated project cost, including contingency, construction management and inspection, labor compliance, and project management, is $502,021, which is within the approved project budget. No additional appropriation is required. (PW) Background:
The Lynwood Natatorium is one of the City's premier recreational facilities, serving residents of all ages through swim lessons, aquatic fitness programs, and community swimming—including as the home pool for the Lynwood Merlin swim team. The City has undertaken a comprehensive renovation and repair effort at the Natatorium under a total approved project budget of $5,000,000. To date, $1,549,360 has been expended on emergency repairs and facility improvements, including installation of a chain-link fence, emergency repairs to panoramic windows and broken doors, expansion joint repairs, electrical work, gas and sewer line relocation, plumbing repairs, and preliminary pool-related work. The remaining balance as of the end of March 2026 is $3,450,640, designated for continued improvements including pool resurfacing, pool equipment replacement, room and office remodeling, and exterior painting.
The pool resurfacing component addresses surface cracks, staining, and general wear that have accumulated over time. Completing this work is essential to reopening the pool to the public and restoring full aquatic programming at the facility.
Original Bid and Contract Award
In November 2025, staff contacted the Los Angeles County Department of Public Health to confirm the applicable resurfacing requirements for the Natatorium pool. Based on a phone consultation at that time, staff was advised that because the pool had previously been painted, repainting with the same material would meet current requirements. Relying on that guidance, the City proceeded with the eBid process with specifications for pool paint resurfacing.
On January 20, 2026, the City Council awarded the construction contract to National Pools, Inc. in the amount of $229,500, and a pre-construction meeting was held on January 26, 2026.
Change in County Requirements and Contract Termination
At the pre -construction meeting, the contractor informed staff that pool paint is no longer an approved finish under the Los Angeles County Department of Public Health's current standards. Subsequent confirmation with the County verified that only white pool plaster or tile finishes are now acceptable for public pools, as pool paint can chip once the pool is filled, creating health hazards for swimmers.
The contractor submitted a change order of $254,600 to substitute the paint specification with white plaster and ceramic tile. This amount exceeds the original contract value of $229,500. On February 5, 2026, the City Manager notified the City Council of this development and the anticipated impact on the project timeline via a written update.
Staff consulted with the CIP Ad Hoc Committee and the City Attorney to evaluate the appropriate path forward. Both the City Attorney and staff concluded that approving the change order was not appropriate.
The substitution of pool paint with plaster and tile represents a material change in project scope, not a routine modification, and approving it would confer an unfair competitive advantage on the current City Council City Council Special Meeting 202
contractor, whose original bid was based on paint specifications. Other qualified contractors could reasonably assert that they would have submitted different or more competitive bids had the project originally been specified with plaster and tile.
Furthermore, the City Attorney determined that the original contract could not legally proceed, as the paint specifications upon which it was based are no longer permissible under County requirements. On March 10, 2026, the City formally terminated the Construction Contract Agreement with National Pools, Inc., citing the inability of enforcing the original contract under current County public pool plan approval requirements. The City remains responsible for payment of any work reasonably completed by National Pools, Inc. prior to termination, which is approximately $3,800.
On March 12, 2026, the City Manager issued a second written update to the City Council explaining the basis for the termination decision and confirming that staff would bring a formal rebid authorization item to the March 24 Council meeting.
Updated Project Scope
Staff has prepared revised specifications in full compliance with current Los Angeles County Department of Public Health requirements. The updated scope of work includes, but is not limited to:
Coordination with the Los Angeles County Department of Public Health to ensure compliance with all applicable health and safety requirements Removal of the existing interior pool coating through sandblasting
Replacement of damaged or deteriorated pool tiles
Application of a new white pool plaster and tile finish Preparation, repair, and plastering of the pool overflow gutter All work shall be performed in accordance with applicable industry standards, safety regulations, and the City's quality expectations to ensure the long-term durability and safety of the facility.

USA Design/Build Steps
1) Team Selection :
After carefully reading through the scope of work, USA
Construction chooses your team based on experience/skill set, quality of work, and cost. Putting together a strong team that can function independently as well as a single unit creates a strong foundation to support the following steps and project. 2) Pre-Construction
This tends to be a shorter phase within our design build process, but it absolutely critical to our success. This is the step where we will ask a great number of questions to make sure that everyone is on the same page. Expectations and reality do not always line up when designing a project and its important to get a solid picture of what is to be
expected/delivered. Here is where goals, complete scheduling, budgeting (and budgeting problems) and potential project challenges will be addressed. This is also where value
management/engineering will first appear.
3) Architectural Design
Design can begin after budget and timeline have been set.
There will be assessments for potential cost savings and ways to increase productivity and preliminary drawings are
presented to the project owner.
4) Construction
This can begin during the design phase as it is common to have timing overlap between the two depending on the project. USA tries to minimize change orders through utilizing S-curves and an agile waterfall project management techniques, but this is the phase where change orders will appear (if any).
5) Post Construction
Once completed, your team will do an overview of the project, a final site walk and various training depending on the technology utilized for your facility.

Extending horizontally from the main centerline abo ut 5 feet typical before the pool wall, it serves as a visual cue signaling that the wall is nearby. These markings help swimmers stay straight in their lanes and anticipate turns o r finishes—particularly useful for backstroke swimmers, who rely on them to time their flip turns or final strokes.
