All cool season grasses (such as Bluegrass and Fescues) are to be cut at 2-1/2 inches during March through November and at 2 inches from December to February of each year. The mowing heights will be adjusted by the City during periods of renovation. All grass clippings will be collected and removed from the site on the same day the area is mowed. A mowing schedule will be established and maintained. This schedule will ensure that all areas will be mowed not less than once a week during the warm season of March to November and once every two weeks during the cool season of December to February. This schedule will be submitted to the City for approval.
Power Edge
With each mowing, the edge of the grass along sidewalks, curbs, shrub and flower beds, and walls shall be trimmed to a neat and uniform line. Where trees and shrubs occur in turf areas, all grass shall be removed 6 inches from the trunks of trees and away from the drip line of shrubs by use of power scythe, approved chemicals, or small mowers as required. This may include daytime watering during winter weather to prevent icy conditions and manual operation of the irrigation system during periods of windy or inclement weather.
During freezing and/or windy conditions, automatic irrigation will be discontinued.
2. In areas where wind creates problems of spraying water onto private property or road rightsof-way, the controllers shall be set to operate during the period of lowest wind velocity which would normally occur at night (between the hours of 7:00 p.m. and 6:00 a.m.)
3. The Contractor shall be responsible for monitoring all systems within the jurisdiction of this specification and correcting for coverage, adjustment, clogging of lines, and removal of obstacles, including plant materials that obstruct the spray.

5. All controllers shall be adjusted to consider the water requirements of each season, plant community, and adverse weather changes, and local watering ordinances.
6. The irrigation system will be controlled by the Contractor in such a way as not to cause an excessively wet area which could interfere with the Contractor’s ability to mow all turf.
7. The Contractor shall observe and note any deficiencies occurring from the original design and review these findings with the City, so necessary improvements can be considered.
8. The Contractor shall repair all leaking or defective valves immediately upon occurrence, or within twenty-four (24) hours following notification from the City of such a deficiency.

SUBJECT:
Rejection of bids received for the Invitation for Bids (IFB) 202425-22 James Taubert Park Construction
RECOMMENDATION:
Accept a Resolution rejecting all bids received for IFB 202425-22 for the construction of James Taubert Park
SUMMARY:
On February 26, 2025, the City released IFB 202425-22 for James Taubert Park (JTP) Construction.
Bids were due by March 26, 2025.
The City received six (6) bids, all of which far exceeded the available project budget. Thus, staff recommends that the Council reject all bids. Staff will revise the project plans, specifications, and probable cost estimate to rebid this project.
DISCUSSION:
The City was awarded $1,990,000 for constructing a new park on the vacant lot at southwest intersection of East Olive Ave. and Knox St. Funding specifically comes from Proposition 68, State of California – The Natural Resources Agency, Department of Parks and Recreation, Statewide Park Development and Community Revitalization Program of 2018 Round 4 funding. The grant performance for this project is from July 1, 2020, through June 30, 2028. Park completion must be at least three months before the end of the grant performance period.
To date, the City has contracted a design firm to assist with the engineering and design services for the preparation of project plans, specifications, probable costs, and bid descriptions. On July 20, 2022, the City awarded Request for Qualifications 202122-15 to O’Dell Engineering (ODELL) in the amount of $238,013. ODELL has since supported the City in developing the park design, staying aligned with grant objectives.
On February 26, 2025, the City released IFB 202425-22 for JTP Construction. The IFB requested bids from qualified contractors for the construction of the new park. The scope of work included, but was not limited to:
Demolition and Site Preparation
Providing Site Amenities & Features
Site Utilities
Concrete
Playground Equipment & Installation
Surfacing
Shade Structures
Planting & Irrigation
Drainage
The engineer’s opinion of the cost for this project was estimated at $1,688,924.
Bids were due by March 26, 2025, and six bids were received. Table 1 shows an overview of the bids received and the amount of each bid.
Table 1: Park Construction Bids Received and Bid Amount Bidder Amount of Bid
Cal Valley Construction, Inc. $1,874,114.38
Caliber Contracting Services, Inc. $1,924,000.00
Taylor Backhoe Service, Inc. $1,987,705.28
Clean Cut Landscape Incorporated $1,992,413.70
Harris Development Corp. dba HBC Enterprises $2,169,878.55 American Paving Co. $2,280,070.60
Engineer’s Estimate $1,688,924.00
Under Public Contract Code (PCC) 22038, the City is allowed to reject all bids, with the requirement that the City furnish a written notice to the apparent low bidder at least two days before Council action. Purchasing issued such notice to Cal Valley Construction, Inc. on April 23, 2025. Under PCC 22038, the City has the following options:
1. Abandoning the project or re-advertising for bids.
2. By passage of a resolution by a four-fifths vote of its governing body declaring that the project can be performed more economically by the employees of the public agency may have the project done by force account without further complying with this article.
It is noted that the City’s bid documents also state that the City reserves the right to reject or accept any or all bids for any reason. The City cannot perform the project internally.
Due to budget constraints, staff request authorization to reject all bids received. Staff is working on re-assessing the design plans, features & amenities, materials, and other factors that may impact receiving bids at a lower amount. Staff are working diligently with O’DELL to have the project out for rebid, anticipating doing so in the next 30-60 days.
FINANCIAL IMPACT:
The recommendation to reject bids received comes after a budgetary review of available grant funding for the project. As previously mentioned, the City was awarded $1,990,000 towards the completion of this project. The City has spent/encumbered a total of $247,061.94 to date. This leaves an available balance of $1,742,938.06. Table 2 shows a breakdown of expenditures to date.
Table 2: James Taubert Park Project Funding
Expenditure/Encumbered Description Total
O’Dell Engineering for Design Services $238,013.00
O’Dell Change Order No. 1 $2,000.00
Site Utilities Application – PG&E $6,465.47
Site Signage for Groundbreaking Event $583.47
Total Spent/Encumbered $247,061.94
Grant Total $1,990,000
Grant Balance Available $1,742,938.06
With the apparent lowest bid coming in at $1,874,114.38 total, this would require at a minimum an additional $131,177 above the grant total to move forward. This would not account for additional contingencies that may arise it the course of the project. For this reason, staff is recommending rejecting all bids received. With the grant performance period still allowing for time to complete the project, staff will work diligently in revising the scope of work, while staying within grant objectives, to rebid the project, with the intent to lower the project cost so as to not require additional funding beyond the grant award of $1,990,000.
ALTERNATIVES:
As an alternative, Council may deny the request to reject the bids received and award IFB 202425- 22 to the lowest, apparent bidder. At this point, the lowest apparent bidder is Cal Valley Construction, Inc., at the bid amount of $1,874,114.38.

Madera Subbasin Joint Groundwater Sustainability Plan Five-Year Evaluation and Update Cost Sharing Memorandum of Understanding
RECOMMENDATION:
Approve a Resolution Approving Madera Subbasin Joint Groundwater Sustainability Plan FiveYear Evaluation and Update Cost Sharing Memorandum of Understanding SUMMARY:
As part of the City Council (Council) meeting of June 5, 2024, Council provided amended direction from the April 3, 2024 Council meeting relative to participation in the cost of preparing the Madera Subbasin Joint Groundwater Sustainability Plan Five-Year Evaluation and Update Cost Sharing Memorandum of Understanding (MOU) as well as in the domestic water well mitigation program. The need for amended direction was in response to a request from the County of Madera (County) following the April 3, 2024 Council meeting that all four GSAs participate in the Five-Year Evaluation and Update (Update) cost according to only one single formula.
DISCUSSION:
As part of the June 5, 2024 Council meeting, Council indicated that it would agree to a maximum participation of $95,472.75 towards the Update. This contribution was based on a cost estimate provided by the Update consultant for all tasks along with a recommended assignment to the participating Groundwater Sustainability Agencies (GSAs). That estimate is reproduced from the June 5th meeting as Table 1.

Staff is aware three comment letters received. The County determined that it should wait until all costs were known before preparing the MOU for signature. Because actual costs of the Update were found to be below the initial estimates, the MOU was forwarded to the GSAs for signature. The actual cost assignment to the City based on invoices from the Update consultant is $94,378.56.

It is not anticipated there will be an impact to the City’s General Fund. Cost impacts associated with the Update are associated with the Water Fund.
