As currently written, the traffic study underestimates the traffic conditions along Ethanac Road at the I- 215 Interchange which would likely result in increased recommended improvement measures and higher fair-share contribution percentages. Furthermore, the timing and the implementation of the required improvements to mitigate the traffic impacts would have to be identified , and the extent of the improvements would have to comply with the City of Perris’ roadway designations and standards.

In summary, the City of Perris is concerned about the accuracy of the Traffic Impact Analysis (TIA) as it underestimates truck traffic along Ethanac at the I-215 freeway interchange; hence, the recommended extent of improvements and fair -share along this transportation segment would need to be evaluated.

While a TIA based upon Level of Service (LOS) is not required by CEQA, the LOS is critical to quantify traffic and determine the required improvements in order to address identified potential safety hazards including hazards resulting from incompatible uses for which the roadways and/or intersections are not designed to accommodate safely . Therefore, this project should be continued to allow the TIA to be revised and the EIR recirculated to adequately assess environmental impacts related to future truck traffic.

The City of Menifee (City) received a comment letter on the Draft Environmental Impact Report (EIR) from the Western States Regional Council of Carpenters (WSRCC) on December 20, 2023, after the close of the public review period (provided as an attachment). Although this comment letter was received late and is not included in the Final EIR, this memorandum provides a response to comments raised in the letter for consideration by the decision-making bodies of the City.

INTRODUCTION
The California Environmental Quality Act (CEQA) requires a Draft EIR to have a review period lasting at least 45 days for projects that have been submitted to the California State Clearinghouse for review (State CEQA Guidelines Section 150105(a)). As required by State CEQA Guidelines Section 15087, the City provided a public Notice of Availability (NOA) of the Draft EIR for the proposed Project at the same time it filed a Notice of Completion (NOC) with the State Clearinghouse. The Draft EIR was circulated for public review for a period of 45 days, from October 19, 2023, through December 4, 2023.

During the public review period, the City received eight comment letters on the Draft EIR.

Comments were received from regional agencies, local agencies, and organizations. Comments that address environmental issues are responded to thoroughly in the Final EIR. Comments that (1) do not address the adequacy or completeness of the Draft EIR; (2) do not raise environmental issues; or (3) do request the incorporation of additional information not relevant to environmental issues do not require a response, pursuant to Section 15088(a) of the State CEQA Guidelines. The comments received during the public review period are included in and responded to in the Final EIR.

As previously mentioned, the City received an additional comment letter on the Draft EIR from WSRCC on December 20, 2023, after the close of the public review period. Similar to the Final EIR, information provided in this memorandum clarifies or amplifies the Draft EIR based on comments provided in the WSRCC letter. No significant changes have been made to the information contained in the Draft EIR as a result of the comments received on the Draft EIR, and no significant new Item Title: 11.1

Response to Comment 2
This comment requests that the City require the use of a local workforce during construction in order to benefit the community’s economic development and environment. This comment also provides testimonies and examples as to how utilizing a local workforce would benefit the local economy and would mitigate greenhouse gas impacts, improve air quality, and reduce transportation impacts.

The City acknowledges this comment and will advise the applicant to consider the use of a local workforce during Project construction. Given that the comment does not raise any specific issues regarding the Draft EIR, or the analysis contained therein, no further response is necessary.

Response to Comment 3
This comment requests the City impose training requirements for the proposed Project’s construction activities to prevent community spread of COVID-19 and other infectious diseases, including the COVID-19 Training and Certification developed by the United Brotherhood of Carpenters and Carpenters International Training Fund and the Infection Control Risk Assessment training program developed by the WSRCC. This comment also provides recommendations related to construction site design, testing requirements, and planning requirements based upon the WSRCC’s experience with safe construction site work practices.

The City acknowledges this comment and will require the applicant to comply with any applicable regulations or requirements during Project construction to prevent community spread of COVID-19 and other infectious diseases. This comment requests the revision and recirculation of the Draft EIR by asserting that the Draft EIR fails to substantiate all of its conclusions, provide adequate mitigation measures, and fully assess all pertinent environmental factors.

The responses to specific comments raised relating to the Draft EIR’s failure to substantiate all of its conclusions, provide adequate mitigation measures, and fully assess all pertinent environmental factors are provided in Response to Comments 5 through 14 below.

Response to Comment 5
This comment states that the project alternatives discussed in the Draft EIR are legally inadequate as both build alternatives would result in similar impacts on transportation, cultural resources, wildfire, and agriculture and two of the three alternatives would result in greater transportation impacts than the proposed Project.

As summarized in the comment, an EIR must discuss a reasonable range of project alternatives which shall include those that could feasibly accomplish most of the basic objectives of the project and could avoid or substantially lessen one or more of the significant effects. Factors considered in selecting the alternatives include site suitability, availability of infrastructure, other plans or regulatory limitations, and economic viability. An EIR need not consider an alternative whose impact cannot be reasonably ascertained and whose implementation is remote or speculative.

Implementation of the proposed Project would result in significant and unavoidable impacts associated with air quality, greenhouse gas emissions, land use and planning, and transportation. All other impacts were determined to be less than significant, or less than significant with the incorporation of mitigation.

As discussed in Chapter 5.0, Alternatives, of the Draft EIR, implementation of Alternative 1 (No Project, Existing SP 301) would allow development of the existing SP 301 including 1,718 residential units, parks, and open space. SP 301 does not provide for commercial, business park, or public facility uses. This alternative would result in significant and unavoidable impacts associated with air quality, greenhouse gas emissions, and transportation, similar to the proposed Project; however, these impacts would be reduced as compared to the proposed Project. In addition, impacts associated with land use and planning would be reduced to less than significant levels. However, the elimination of the business park and commercial uses would likely increase the average vehicle miles traveled (VMT) per service population. Further, this alternative would not meet a majority of the Project objectives, including the primary objective of balancing housing needs and community amenities with job-producing uses, attracting economic investment to the City of Menifee, or providing goods, services, and job opportunities to the surrounding community and region.

Implementation of Alternative 2 (Residential/Commercial) envisions the development of 1.250 million square feet of commercial and office uses along State Route 74, open space similar to the proposed Project, and development of 1,718 dwelling units. This alternative would also result in significant and unavoidable impacts associated with air quality, greenhouse gas emissions, land use and planning, and transportation. However, the total building area on the Project site would be reduced, which could result in lower area emissions (e.g., architectural coatings) and energy Item Title: 11.1

Although the increase in commercial uses under Alternative 2 would result in a higher VMT than the proposed Project, average daily vehicle trips (mobile sources) would be reduced by approximately 6 percent when compared to the proposed Project. This alternative would meet the Project objectives of attracting economic investment to the City and providing goods, services, and job opportunities to the surrounding community and region to a lesser extent than the proposed Project. Additionally, this alternative would not meet the Project objective of providing a public facility/civic node (e.g., fire station, transit stop) on the Project site.

Implementation of Alternative 3 (Reduced Business Park) would reduce business park uses by 25 percent (approximately 1,377,500 million square feet), resulting in development of approximately 4,132,500 million square feet of business park and commercial-business park uses. The commercial, open space, roadway, and public facility/school components of the proposed Project would remain unchanged. This Alternative would also result in significant and unavoidable impacts associated with air quality, greenhouse gas emissions, land use and planning, and transportation; however, impacts associated with air quality, greenhouse gas emissions, and transportation would be reduced as compared to the proposed Project. In addition, Alternative 3 would be less impactful in the areas of energy, hazards and hazardous materials, public services, and utilities due to the reduction in business park uses. Impacts associated with land use and planning and transportation would be significant and unavoidable and similar to the proposed Project. This alternative would meet most of the Project objectives; however, by reducing business park and commercial business park uses by 25 percent, this alternative would meet the Project objectives related to attracting economic investment and providing goods, services, and job opportunities to the City and region to a lesser extent than the proposed Project.

Based on the summary above and the analysis contained in Section 5.0, Alternatives, the Draft EIR adequately discusses a reasonable range of alternatives that could lessen one or more of the significant impacts of the proposed Project as required by CEQA. Therefore, the project alternatives discussed in the Draft EIR are legally adequate and no revisions to the Draft EIR are warranted.

Response to Comment 6
This comment states that the mitigation measures contained in the Draft EIR are improperly deferred or fail to adequately mitigate the proposed Project’s impacts.

The responses to specific comments raised relating to mitigation measures are provided in Response to Comments 7 through 11 below.

Response to Comment 7
This comment states that Mitigation Measure AIR-1 appears to be illusory since it only requires the use of California Air Resources Board (CARB) certified Tier 4 or equivalent construction equipment when “reasonable available” and “to the extent feasible.” This comment also states that such language renders the measure unenforceable pursuant to CEQA and that it must be revised so it is not illusory and adequately mitigates the Project’s significant air quality impacts.

As discussed on page 4.3-35 of the Draft EIR, Mitigation Measure AIR-1 requires that during construction of the on-site improvements associated with the proposed Project, the Project Item Title: 11.1

1/4/24 (\\lsaazfiles.file.core.windows.net\projects\CIM2106 MVSP EIR\06 Final EIR\Late Comment Letters\WSRCC RTC Memo.docx) 5 contractor shall ensure all 50 horsepower or more off-road diesel-powered construction equipment is powered with CARB-certified Tier 4 Final engines or the equivalent, except where the Project applicant establishes to the satisfaction of the City that Tier 4 Final equipment is not available. As detailed in Mitigation Measure AIR-1, an exemption from these requirements may be granted by the City if the City documents that equipment with the required tier is not reasonably available within Southern California and corresponding reductions in criteria air pollutant emissions are achieved from other construction equipment to the extent feasible. As such, the commenter incorrectly states that the required mitigation would not be enforceable. The City is responsible for ensuring Project contractors use CARB-certified Tier 4 Final engines and is also responsible for granting an exception only if the City documents that equipment with the required tier is not reasonably available within Southern California and corresponding reductions in criteria air pollutant emissions are achieved from other construction equipment.

Further, as shown in Table 4.3.G, Table 4.3.H, and Table 4.3.I of the Draft EIR, with implementation of Tier 4 Final construction equipment, as required by Mitigation Measure AIR-1, construction of the on-site and off-site improvements would be below South Coast Air Quality Management District thresholds and would result in a less than significant impact related to a cumulatively considerable net increase of any criteria pollutant for which the Project region is in nonattainment under an applicable federal or State ambient air quality standard. Therefore, Mitigation Measure AIR-1 would adequately mitigate the Project’s construction-related air quality impacts and no revisions to the Draft EIR are warranted.

Response to Comment 8
This comment states that Mitigation Measure BIO-2 inaccurately defines the nesting bird season.

Specifically, it states that the Draft EIR fails to consider that raptor species may commence nesting activities in January and passerines may nest after August 31. Additionally, this comment states that Mitigation Measure BIO-3 fails to mention that the pre-construction burrowing owl survey must be compliant with the California Department of Fish and Wildlife’s 2012 Staff Report on Burrowing Owl Mitigation.

The Draft EIR is consistent with the nesting period provided in the biological technical reports (Appendices D-1, D-2, and D-8 of the Draft EIR) prepared for the proposed Project. The reports describe the February 1 through August 31 timeframe as generally being considered the nesting bird season. However, during Project approval, the City may condition the Project to extend the nesting bird season from February 1 through August 31 to January 1 through September 15, to consider species such as hummingbirds that may nest year-round.

In addition, as noted in the biological technical reports (Appendices D-1, D-2, and D-8 of the Draft EIR), the proposed Project is within the Western Riverside County Multiple Species Habitat Conservation Plan (MSHCP) boundary and will therefore be required to comply with provisions and regulations set forth by the MSHCP. As such, the pre-construction burrowing owl survey must follow accepted protocols as specified in the MSHCP. This means that the pre-construction burrowing owl survey will follow the Burrowing Owl Survey Instructions for the Western Riverside County Multiple Species Habitat Conservation Plan Area. As summarized in Section 4.4.6.1, Special Status Species, Item Title: 11.1

Therefore, Mitigation Measures BIO-2 and BIO-3 as detailed in the Draft EIR are considered sufficient and no revisions to the Draft EIR are warranted.

Response to Comment 9
This comment states that to mitigate the Project’s significant greenhouse gas (GHG) emissions, the Draft EIR imposes Mitigation Measure GHG-1, which requires design detail specification “where feasible.” This comment claims that Mitigation Measure GHG-1 is not fully enforceable and fails to specify what “energy efficient appliances” must be installed, how maximization of “interior day light” would be achieved, what “necessary infrastructure” is needed to allow use of 50 percent recycled water for outdoor irrigation, and what the “water conservation strategy” will look like.

The commenter is incorrect that Mitigation Measure GHG-1 is not enforceable. As detailed in Mitigation Measure GHG-1, the City is responsible for documenting implementation and compliance with emission reduction measures prior to issuance of building permits. Additionally, due to the programmatic nature of the proposed Project, all design elements have yet to be determined. As such, Mitigation Measure GHG-1 allows for flexibility for Project applicants to incorporate emission reduction measures that best work with future development, and the City shall review and identify implementation and compliance with the emission reduction measures to reduce the GHG emissions during Project operations. Therefore, no revisions to the Draft EIR are warranted.

Response to Comment 10
This comment states that the Draft EIR includes a mitigation measure which requires that loading trucks and bulldozers be restricted near residential structures but fails to include any noise barrier requirement to further mitigate construction noise impacts and does not contain any explanation as to why such a measure is considered infeasible.

As detailed in Section 4.13, Noise and Vibration, of the Draft EIR, the use of loaded trucks and bulldozers near residential structures associated with the construction of off-site roadway improvements would have the potential to generate vibration levels of up to 99 vibration velocity decibels (0.352 inches per second [in/sec] peak particle velocity [PPV]). This vibration level would have the potential to result in building damage because residential buildings would be constructed equivalent to non-engineered timber and masonry, and the vibration level would exceed the Federal Transit Administration’s damage threshold of 0.2 in/sec (PPV). The implementation of Mitigation Measure N-1, which would restrict the use of large bulldozers and loaded trucks or require the use of small rubber-tired dozers and light pick-up trucks within 15 feet of residential structures, would reduce construction vibration levels to 0.191 in/sec (PPV) or below. Therefore, construction vibration impacts (not construction noise impacts) from off-site roadway improvements would be less than significant with the implementation of Mitigation Measure N-1. The use of temporary construction barriers would not reduce construction vibration levels.

Although noise generated by Project construction activities would be higher than the ambient noise levels, construction noise would stop once Project construction is completed. The implementation Item Title: 11.1

1/4/24 (\\lsaazfiles.file.core.windows.net\projects\CIM2106 MVSP EIR\06 Final EIR\Late Comment Letters\WSRCC RTC Memo.docx) 7 of Regulatory Compliance Measure N-1, which would limit project construction activities within 0.25 mile from an occupied residence Monday through Saturday to between the hours of 6:30 a.m. and 7:00 p.m., except on Sunday or nationally recognized holidays pursuant to Section 8.01.010 of the City’s Municipal Code, would minimize construction noise at residential land uses to less than significant levels. Therefore, no additional measures are required to reduce noise generated from Project construction activities and no revisions to the Draft EIR are warranted.

Response to Comment 11
The comment states that the Draft EIR finds transportation impacts to be significant and unavoidable. The comment further asserts that the Draft EIR does not appear to implement all feasible mitigation or provide an explanation as to why such measures are infeasible. The comment states that additional VMT mitigation measures should be included to further reduce VMT.

The Draft EIR analyzes the proposed Project as a specific plan and evaluates the VMT impacts for the entire specific plan. Mitigation measures applicable to the entire Project have been identified in the Draft EIR. In addition, the City is requiring the proposed Project to identify additional VMT reduction measures as each phase and/or Project components are constructed. This may include vanpool/carpool for the employment-based component of the Project, or other mitigation measures that would be applicable for the residential component of the Project. As such, the Project applicant and City staff will coordinate to determine additional feasible VMT reduction measures that the Project could implement to reduce Project VMT as each phase of the Project is developed. As such, the VMT mitigation measures detailed in the Draft EIR are considered sufficient and no revisions to the Draft EIR are warranted.

Response to Comment 12
This comment states that the hydrology and water quality findings and analysis within the Draft EIR are insufficient as the Draft EIR cannot rely upon regulatory compliance in making its less than significant impact determination without assessing and providing Project-specific information and analysis. Specifically, the comment asserts that the Draft EIR fails to specify the type and quantity of sediment and pollution discharge that is expected during construction groundwater dewatering activities and relies on the proposed Project’s compliance with water discharge requirements to determine that impacts are less than significant.

No groundwater testing has been completed at this time, and the potential pollutant constituents are unknown. However, as discussed in Section 4.10, Hydrology and Water Quality, of the Draft EIR, there is clear specification in the Groundwater Discharge Permit that requires the testing of groundwater prior to construction dewatering and, if necessary, the treatment of groundwater prior to being discharged to surface waters. As such, if groundwater dewatering is required during construction due to the presence of perched groundwater, discharges to surface waters would not contain pollutant constituents that could adversely affect the surface water quality of receiving waters. Therefore, compliance with the Groundwater Discharge Permit would result in less than significant impacts on surface water quality.

In addition, as discussed in Section 4.10, construction of the proposed Project would comply with existing National Pollutant Discharge Elimination System regulations (as specified in Regulatory Item Title: 11.1

1/4/24 (\\lsaazfiles.file.core.windows.net\projects\CIM2106 MVSP EIR\06 Final EIR\Late Comment Letters\WSRCC RTC Memo.docx) 8 Compliance Measures [RCM] RCM WQ‐1, RCM WQ‐2, and RCM WQ-3), which regulate surface water quality during constriction and include preparation of a Storm Water Pollution Prevention Plan and Erosion Control Plan, and implementation of construction best management practices to target and reduce pollutants of concern in storm water runoff (e.g. soil binders, straw mulch, non-vegetative stabilization, fiber rolls, sandbag barrier, straw bale barrier, stabilized construction entrance/exit, stabilized construction roadway, and entrance/outlet tire wash). Compliance with the aforementioned regulatory requirements would ensure that impacts related to violation of any surface water quality standards or waste discharge requirements or the degradation of surface or groundwater quality during construction would be less than significant. Therefore, the hydrology and water quality findings and analysis contained in the Draft EIR are considered sufficient and no revisions to the Draft EIR are warranted.

Response to Comment 13
This comment states that the Draft EIR fails to support its findings relating to land use with substantial evidence as the Draft EIR fails to analyze the consistency of the proposed Project’s requested entitlements, including the required General Plan amendment, zone change, specific plan amendment, tentative tract map, and development plan, with the General Plan.

As stated in the Draft EIR, page 3-2, the City’s General Plan designates the Project site as “Menifee Valley Ranch SP” (SP 301). SP 301 allows for many different uses within the Project site which include parks, open space, greenbelt, and residential at various densities. However, because SP 301 does not provide for commercial, retail, industrial, or civic uses, and because the proposed Project would facilitate the development of the Project site as a mixed-use, master-planned community, a General Plan Amendment, Specific Plan Amendment, and zone change are required.

The General Plan Amendment (GPA) would revise the General Plan land use map to include the Menifee Valley Specific Plan land use designation and remove the portion of Specific Plan No. 301 (SP 301) from the Project site. The zone change is required to revise the City Zoning Map to include the Menifee Valley Specific Plan (Specific Plan No. PLN 21-0217) zone.

The approval of the Specific Plan Amendment would create the Menifee Valley Specific Plan (MVSP) on 590.3 acres. The removal of the Project site from SP 301 would reduce the size of SP 301 from 1,548.3 to 942.0 acres and would reduce the number of permitted residential units within SP 301 by 1,718 units.

The tentative tract map includes a subdivision to establish the boundaries and dimensions of streets and the proposed mass grading for the MVSP.

These discretionary actions were described in the Draft EIR Project Description (page 3-15), and the Project was thoroughly evaluated for consistency with the City’s General Plan in Table 4.11.A in Section 4.11, Land Use, of the Draft EIR. As detailed in Table 4.11.A, through current design, implementation of project design features, conditions of approval, mitigation measures, and ongoing consultation with the City of Menifee and applicable agencies, the proposed Project would be consistent with goals and policies from the City of Menifee General Plan except for Circulation Element Policy C 1.2. General Plan Policy C 1.2 identifies the aspirational levels of service (LOS) the Item Title: 11.1

However, existing or forecasted operational deficiencies cannot be fully improved to desired LOS at several intersections because of right-of-way constraints. As such, the proposed Project would not be able to improve the LOS at some intersections to meet the City’s General Plan levels the City strives to maintain (Policy C 1.2). Because this would cause a conflict with General Plan Policy C 1.2, this was identified as a significant and unavoidable impact.

Overall, the Project does not interfere with or impede the General Plan’s policies and objectives as supported by the evaluation included in Table 4.11.A of the Draft EIR. The land use analysis is considered sufficient, and no revisions to the Draft EIR are warranted.

Response to Comment 14
This comment states that the biological resource findings for Threshold 4.4-1 are unsupported as the Draft EIR concludes the proposed Project’s biological resource impacts will be less than significant without adequately supporting the conclusion. Specifically, it states that the conclusion is supported by the proposed Project’s requirement of payment of fees associated with the MSHCP.

Furthermore, the comment asserts that only 19 of the 22 special-status species are covered under the MSHCP and that each species should have an in-depth analysis.

As discussed in Section 4.4.6.1, Special Status Species, Tables 4 and 6 of Appendix D-1 of the Draft EIR discuss the potential for the 22 special-status species to occur in the Project area. Of these 22 species, 11 species are considered to have no potential to occur due to lack of suitable habitat, 3 species are considered to have a very low potential to occur due to highly disturbed habitat being present, 5 species are considered to have a low potential to occur due to disturbed suitable habitat being present, 1 species is considered to have a moderate potential to occur due to previously being observed and disturbed suitable habitat being present, and 2 species are considered present due to being observed during protocol surveys. As noted in the Draft EIR, Section 4.4.6.1, Special Status Species, appropriate field surveys were conducted throughout a variety of years in accordance with MSHCP requirements. All 22 special-status species were evaluated for their individual potential to occur within the Project area and were not assigned a blanket designation of less than significant impact simply due to the Project being located within the MSHCP boundaries.

Of the 22 special-status species, 11 of these species have an in-depth analysis within the Draft EIR.

These include California Orcutt grass (Orcuttia californica), Munz’s onion (Allium munzii), spreading navarretia (Navarretia fossalis), burrowing owl (Athene cunicularia), California horned lark (Eremophila alpestris actia), coastal California gnatcatcher (Polioptila californica californica), Cooper’s hawk (Accipiter cooperii), loggerhead shrike (Lanius ludovicianus), Dulzura pocket mouse (Chaetodipus californicus femoralis), Stephens’ kangaroo rat (Dipodomys stephensi), and Los Angeles pocket mouse (Perognathus longimembris brevinasus). Of the remaining 11 species, 8 of them have no potential to occur and are minimally discussed. The remaining 3 species not discussed in the Draft EIR have a low to very low potential to occur (Appendix D-1, Table 4). These include long- spined spineflower (Chorizanthe polygonoides var. longispina), Parry’s spineflower (Chorizanthe parryi var. parryi), and smooth tarplant (Centromadia pungens ssp. laevis). These 3 species are covered and adequately conserved under the MSHCP and have a California Rare Plant Rank of 1B, which is considered rare, threatened, or endangered in California and elsewhere. However, these 3 species are not designated as threatened or endangered under the California Endangered Species Item Title: 11.1

As discussed in the Draft EIR, Section 4.4.3.2, Plant Species, the Project is not located within the MSHCP Narrow Endemic Plant Species Survey Area (NEPSSA) or Criteria Area Species Survey Area (CASSA) for plants and focused rare plant surveys were not required.

Furthermore, the Draft EIR, Section 4.4.6.1, Special Status Species, mentions 19 of the 22 species are covered under the MSHCP. This is a typographical error, and 20 of the 22 species are actually covered under the MSHCP. Those species not covered under the MSHCP include Dulzura pocket mouse and Southern California grasshopper mouse (Onychomys torridus ramona). Section 4.4.3.3, Animal Species, and Section 4.4.6.1, Special Status Species, discuss Dulzura pocket mouse’s potential to occur, while Southern California grasshopper mouse is not discussed due to no suitable desert scrub habitats present on site (Appendix D-1, Table 6). Additionally, these 2 species are not designated as threatened or endangered under CESA or FESA; therefore, they have no formal protection under FESA or CESA.

To conclude, 8 special-status species were not further discussed in the Draft EIR as they have no potential to occur and were not observed during any of the field surveys. Long-spined spineflower, Parry’s spineflower, and smooth tarplant were the remaining 3 special-status species that were not discussed due to having a low to very low potential to occur, due to not being observed during any of the field surveys, and due to the Project not being located within an MSHCP NEPSSA or CASSA for plants.

As stated in Section 4.4.7, Cumulative Impacts, the Project would be consistent with the goals/objectives of the MSHCP with an approved Determination of Biologically Equivalent or Superior Preservation and the implementation of the proposed avoidance and mitigation measures.

Specifically, implementation of Mitigation Measures BIO-1 through 4 would reduce impacts to special-status species to be less than significant with incorporation of mitigation. This Draft EIR was completed with due diligence and as such, revisions to the Draft EIR are not warranted.

Response to Comment 15
This comment summarizes the concerns raised in the comment letter and provides concluding remarks.

The City acknowledges this comment. Given that the comment does not raise any specific issues regarding the Draft EIR, or the analysis contained therein, no further response is necessary.

On behalf of the Western States Regional Council of Carpenters (“Western States Carpenters” or “WSRCC”), my Office is submitting these comments to the City of Menifee (“City”) regarding the Draft Environmental Impact Report (“DEIR”) for the Menifee Valley Specific Plan Project (“Project”).

The 590.3-acre Project site would be developed with up to 1,711 residential units, 74,500 square feet of public facilities/civic uses, and 5,600,000 square feet of commercial business park use (commercial, retail, small-scale light industrial, warehouse/storage, and manufacturing). Approximately 39.9 acres of land would be designed for parks, open space, and recreation, and an elementary school would be developed on up to 12.0 acres
The Western States Carpenters is a labor union representing over 90,000 union carpenters in 12 states, including California, and has a strong interest in well-ordered land use planning and in addressing the environmental impacts of development projects. Individual members of the Western States Carpenters live, work, and recreate in the City and surrounding communities and would be directly affected by the Project’s environmental impacts.

The Western States Carpenters incorporates by reference all comments raising issues regarding the Environmental Impact Report (EIR) submitted prior to certification of the EIR for the Project. See Citizens for Clean Energy v City of Woodland (2014) 225 Cal.App.4th 173, 191 (finding that any party who has objected to the project’s environmental documentation may assert any issue timely raised by other parties).

I. THE CITY SHOULD REQUIRE THE USE OF A LOCAL
WORKFORCE TO BENEFIT THE COMMUNITY’S ECONOMIC

DEVELOPMENT AND ENVIRONMENT
The City should require the Project to be built using a local workers who have graduated from a Joint Labor-Management Apprenticeship Program approved by the State of California, have at least as many hours of on-the-job experience in the applicable craft which would be required to graduate from such a state-approved apprenticeship training program, or who are registered apprentices in a state-approved apprenticeship training program.

Community benefits such as local hire can also be helpful to reduce environmental impacts and improve the positive economic impact of the Project. Local hire provisions requiring that a certain percentage of workers reside within 10 miles or less of the Project site can reduce the length of vendor trips, reduce greenhouse gas emissions, and provide localized economic benefits. As environmental consultants Matt Hagemann and Paul E. Rosenfeld note:
[A]ny local hire requirement that results in a decreased worker trip length from the default value has the potential to result in a reduction of construction-related GHG emissions, though the significance of the reduction would vary based on the location a nd urbanization level of the project site.

Workforce requirements promote the development of skilled trades that yield sustainable economic development. As the California Workforce Development Board and the University of California, Berkeley Center for Labor Research and Education concluded:

[L]abor should be considered an investment rather than a cost —and investments in growing, diversifying, and upskilling California’s workforce can positively affect returns on climate mitigation efforts. In other words, well-trained workers are key to delivering emissions reductions and moving California closer to its climate targets.1
Furthermore, workforce policies have significant environmental benefits given that they improve an area’s jobs-housing balance, decreasing the amount and length of job commutes and the associated greenhouse gas (GHG) emissions. In fact, on May 7, 2021, the South Coast Air Quality Management District found that that the “[u]se of a local state-certified apprenticeship program” can result in air pollutant reductions.2 Locating jobs closer to residential areas can have significant environmental benefits.

As the California Planning Roundtable noted in 2008:

People who live and work in the same jurisdiction would be more likely to take transit, walk, or bicycle to work than residents of less balanced communities and their vehicle trips would be shorter. Benefits would include potential reductions in both vehicle miles traveled and vehicle hours traveled.3
Moreover, local hire mandates and skill-training are critical facets of a strategy to reduce vehicle miles traveled (VMT). As planning experts Robert Cervero and Michael Duncan have noted, simply placing jobs near housing stock is insufficient to achieve VMT reductions given that the skill requirements of available local jobs must match those held by local residents.4 Some municipalities have even tied local hire and

other workforce policies to local development permits to address transportation issues. Cervero and Duncan note that:

In nearly built -out Berkeley, CA, the approach to balancing jobs and housing is to create local jobs rather than to develop new housing. The city’s First Source program encourages businesses to hire local residents, especially for entry- and intermediate-level jobs, and sponsors vocational training to ensure residents are employment -ready. While the program is voluntary, some 300 businesses have used it to date, placing more than 3,000 city residents in local jobs since it was launched in 1986. When needed, these carrots are matched by sticks, since the city is not shy about negotiating corporate participation in First Source as a condition of approval for development permits.

Recently, the State of California verified its commitment towards workforce development through the Affordable Housing and High Road Jobs Act of 2022, otherwise known as Assembly Bill No. 2011 (“AB2011”). AB2011 amended the Planning and Zoning Law to allow ministerial, by-right approval for projects being built alongside commercial corridors that meet affordability and labor requirements.

The City should consider utilizing local workforce policies and requirements to benefit the local area economically and to mitigate greenhouse gas, improve air quality, and reduce transportation impacts.

II. THE CITY SHOULD IMPOSE TRAINING REQUIREMENTS FOR
THE PROJECT’S CONSTRUCTION ACTIVITIES TO PREVENT
COMMUNITY SPREAD OF COVID-19 AND OTHER INFECTIOUS

The Western States Carpenters recommend that the City adopt additional requirements to mitigate public health risks from the Project’s construction activities.

The Western States Carpenters requests that the City require safe on-site construction work practices as well as training and certification for any construction workers on the Project Site.

In particular, based upon the Western States Carpenters’ experience with safe construction site work practices, the Western States Carpenters recommends that the City require that while construction activities are being conducted at the Project Site:

Construction Site Design:
• The Project Site will be limited to two controlled entry points.
• Entry points will have temperature screening technicians taking temperature readings when the entry point is open. • The Temperature Screening Site Plan shows details
regarding access to the Project Site and Project Site logistics for conducting temperature screening.
• A 48-hour advance notice will be provided to all trades prior to the first day of temperature screening.
• The perimeter fence directly adjacent to the entry points will be clearly marked indicating the appropriate 6 -foot social distancing position for when you approach the screening area. Please reference the Apex temperature screening site map for additional details.
• There will be clear signage posted at the project site directing you through temperature screening.
• Provide hand washing stations throughout the construction site.

Testing Procedures:
• The temperature screening being used are non -contact devices.
• Temperature readings will not be recorded.

refused access to the Project Site.

meet standards that may be promulgated by the Center for Disease Control, Occupational Safety and Health
Administration, Cal/OSHA, California Department of
Public Health or applicable local public health agencies.6 The United Brotherhood of Carpenters and Carpenters International Training Fund has developed COVID-19 Training and Certification to ensure that Carpenter union members and apprentices conduct safe work practices. The Agency should require that all construction workers undergo COVID-19 Training and Certification before being allowed to conduct construction activities at the Project Site.

The Western States Carpenters has also developed a rigorous Infection Control Risk Assessment (“ICRA”) training program to ensure it delivers a workforce that understands how to identify and control infection risks by implementing protocols to protect themselves and all others during renovation and construction projects in healthcare environments.7
ICRA protocols are intended to contain pathogens, control airflow, and protect patients during the construction, maintenance and renovation of healthcare facilities.

ICRA protocols prevent cross contamination, minimizing the risk of secondary infections in patients at hospital facilities.

The City should require the Project to be built using a workforce trained in ICRA protocols.

III. THE CITY MUST REVISE THE DEIR FOR THE PROJECT
CEQA is a California statute designed to inform decision makers and the public about the potential, significant environmental effects of a project. 14 California Code of

Regulations (“CEQA Guidelines”) § 15002(a)(1).8 At its core, “[i]ts purpose is to inform the public and its responsible officials of the environmental consequences of their decisions before they are made.” Citizens of Goleta Valley v. Board of Supervisors (1990) 52 Cal. 3d 553, 564.

To achieve this purpose, CEQA mandates preparation of an Environmental Impact Report (“EIR”) for projects so that the foreseeable impacts of pursuing the project can be understood and weighed. Communities for a Better Environment v. Richmond (2010) 184 Cal. App. 4th 70, 80. The EIR requirement “is the heart of CEQA.” CEQA Guidelines, § 15003(a).

The preparation and circulation of an EIR is more than a set of technical hurdles for agencies and developers to overcome. The EIR’s function is to ensure that government officials who decide to build or approve a project do so with a full understanding of the environmental consequences and, equally important, that the public is assured those consequences have been considered. For the EIR to serve these goals it must present information so that the foreseeable impacts of pursuing the project can be understood and weighed, and the public must be given an adequate opportunity to comment on that presentation before the decision to go forward is made. Communities for a Better Environment v. Richmond (2010) 184 Cal. App. 4th 70, 80 (quoting Vineyard Area Citizens for Responsible Growth, Inc. v. City of Rancho Cordova (2007) 40 Cal. 4th 412, 449–450).

Section 15088.5(a) of the CEQA Guidelines provides that an EIR must be recirculated whenever there is disclosure of significant new information. Significant new information includes: (1) disclosure of a new significant environmental impact resulting from the project or from a new proposed mitigation measure; (2) disclosure of a substantial increase in the severity of an environmental impact unless mitigation measures are adopted that reduce the impact to a level of insignificance; and (3) disclosure of a feasible project alternative or mitigation measure considerably different from others previously analyzed which would clearly lessen the significant

environmental impacts of the project which the project proponents decline to adopt.

Id.

Additionally, an EIR must be recirculated when it is so fundamentally inadequate and conclusory in nature that meaningful public review and comment is precluded. Id. [citing Mountain Lion Coalition v. Fish & Game Com. (1989) 214 Cal.App.3d 1043].

Here, as discussed below, the DEIR fails to substantiate all of its conclusions to allow meaningful public review and comment, provide adequate mitigation measures, and fully assess all pertinent environmental factors. Accordingly, this comment letter discloses significant new information, necessitating revision and recirculation of the DEIR.

A. The DEIR’s Alternatives Are Legally Inadequate
An EIR must discuss a reasonable range of alternatives to the project, which “shall include those that could feasibly accomplish most of the basic objectives of the project and could avoid or substantially lessen one or more of the significant effects.” CEQA Guidelines § 15126.6(a)&(c). “[T]he discussion of alternatives shall focus on alternatives.... which are capable of avoiding or substantially lessening any significant effects of the project....” CEQA Guidelines § 15126.6(b). Further, an EIR is legally inadequate if it contains an overly narrow range of alternatives. Watsonville Pilots Ass’n v. City of Watsonville (2010) 183 Cal.App.4th 1059, 1087, 20190 [not considering a reduced development alternative was error].

Here, the DEIR considered a (1) no project alternative; (2) a residential/commercial office alternative; and (3) a reduced business park alternative. DEIR at 5-12. However, the DEIR notes that both build alternatives it considered would continue to result in similar transportation, cultural resource, wildfire, and agricultural impacts. Id. at 5-35.

Moreover, two of the three alternatives would result in even greater transportation impacts, an impact deemed to be significant and unavoidable. Id. Accordingly, the DEIR fails to consider a reasonable range of alternatives which could eliminate or reduce the Project’s significant impacts, as required.

B. The DEIR’s Mitigation Measures Are Insufficient
If a project has a significant effect on the environment, an agency may approve the project only upon finding that it has “eliminated or substantially lessened all significant effects on the environment where feasible” and that any unavoidable Item Title: 11.1

significant effects on the environment are “acceptable due to overriding concerns”.

CEQA Guidelines § 15092(b)(2)(A–B).

CEQA mitigation measures proposed and adopted are required to describe what actions will be taken to reduce or avoid an environmental impact. (CEQA Guidelines § 15126.4(a)(1)(B) [providing “[f]ormulation of mitigation measures should not be deferred until some future time.”].) While the same Guidelines section 15126.5(a)(1)(B) acknowledges an exception to the rule against deferrals, such exception is narrowly proscribed to situations where it is impractical or infeasible to include those details during the project's environmental review.

Here, the DEIR’s mitigation measures are improperly deferred or fail to adequately mitigate the Project’s impacts:
i. Air Quality
In order to reduce significant air quality impacts, the DEIR imposes three mitigation measures, MM-AIR-1 – MM-AIR-3. However, the first measure, MM-AIR-1, appears to be entirely illusory since it only requires the use of CA Air Resources Board certified tier 4 or equivalent construction equipment when “reasonable available” and “to the extent feasible”. DEIR at 1-15. Such language does not render the measure enforceable, as required by CEQA. (CEQA Guidelines § 15126.4(a)(2).) Thus, the measure must be revised so it is not illusory and adequately mitigates the Project’s significant air quality impacts.
ii. Biological Resources
Amongst other measures, the DEIR imposes MM-BIO-2 to protect nesting bird habitat. DEIR at 1-17. However, such measure defines the nesting period as February 15-August 31, contrary to the California Department of Fish and Wildlife’s finding that nesting may commence before and/or after this timeframe. “For example, some species of raptors (e g. owls, hawks, etc.) may commence nesting activities in January, and passerines may nest later than August 31.”9 The nesting period on the mitigation measure should be revised to account for these findings.

Moreover, with regard to the MM-BIO-3, which requires pre-construction surveys for burrowing owls, the measure fails to specify that the survey must be compliant with the Staff Report on Burrowing Owl Mitigation, State of California Natural Resource Agency, Department of Fish and Game, May 7, 2012. DEIR at 1-17.Such specification is necessary to ensure that the measure, and surveys it requires, are adequate. iii. Greenhouse gas emissions
To mitigate the Project’s significant greenhouse gas (“GHG”) emissions, the DEIR imposes MM-GHG-1, which requires design detail specification “where feasible”.

DEIR at 1-21. However, in addition to being not fully enforceable in contradiction of CEQA requirements, as discussed above, such measure also fails to specify what “energy efficient appliances” must be installed, how maximization of “interior day light” would be achieved, what “necessary infrastructure” is needed to allow use of 50% recycled water for outdoor irrigation, and what the “water conservation strategy” will look like. Id. Absent these specifications, the measure is improperly deferred. iv. Noise
In order to mitigate Project construction noise impacts, the DEIR implements a mitigation measure which requires that loading trucks and bulldozers be restricted.

DEIR at 1-24. However, the DEIR fails to include any noise barrier requirement to further mitigate construction noise impacts nor any explanation why such measure is infeasible. The mitigation measure must be revised to include such requirement or explain why such requirement is infeasible.
v. Transportation
The DEIR finds transportation impacts to be significant and unavoidable. DEIR at 1-

26. Nevertheless, the DEIR does not appear to implement all feasible mitigation, or provide an explanation as to why such measures are infeasible. For example, the DEIR does not require distribution of ride-sharing or other educational materials in order to reduce VMT or consider requiring an increase in public transit availability. The DEIR must be revised to also include these requirements or explain why such requirements are infeasible.

C. The DEIR’s Hydrology & Water Quality Findings and Analysis Are Insufficient
CEQA requires that an EIR identify and discuss the significant effects of a Project, how those significant effects can be mitigated or avoided. CEQA Guidelines § 15126.2; PRC §§ 21100(b)(1), 21002.1(a). If a project has a significant effect on the environment, an agency may approve the project only upon finding that it has “eliminated or substantially lessened all significant effects on the environment where feasible” and that any unavoidable significant effects on the environment are “acceptable due to overriding concerns”. CEQA Guidelines § 15092(b)(2)(A–B). Such findings must be supported by substantial evidence. CEQA Guidelines § 15091(b).

The DEIR at hand fails to comply with these requirements.

Specifically, the DEIR provides that the “[d]ue to the fact that groundwater levels fluctuate with the seasons and local zones of perched groundwater may be present near the surface, groundwater dewatering may be required during project construction.

Groundwater dewatering activities could affect surface water quality through the discharge of polluted groundwater to surface water bodies.” DEIR at 4.10-28.

However, the DEIR fails to specify either the type or quantity of sediment and pollution discharge is expected. Rather, the DEIR blanketly concludes that impacts will be less than significant because the Project will be required to comply with water discharge requirements. Such blanket conclusion runs afoul to CEQA because it is well established that determinations that regulatory compliance will be sufficient to prevent significant adverse impacts must be based on a project-specific analysis of potential impacts and the effect of regulatory compliance. See Californians for Alternatives to Toxics v. Department of Food & Agric. (2005) 136 Cal. App. 4th 1; Ebbetts Pass Forest Watch v Department of Forestry & Fire Protection (2008) 43 Cal. App. 4th 936, 956.

The DEIR cannot rely upon regulatory compliance in making its less than significant impact determination without assessing and providing Project specific information and analysis as to its anticipated water quality impacts.

D. The DEIR Fails to Support its Findings on Land Use with Substantial Evidence
Each California city and county must adopt a comprehensive, long-term general plan governing development. Napa Citizens for Honest Gov. v. Napa County Bd. of Supervisors (2001) 91 Cal.App.4th 342, 352, citing Gov. Code §§ 65030, 65300. The general plan Item Title: 11.1

sits at the top of the land use planning hierarchy, and serves as a “constitution” or “charter” for all future development. DeVita v. County of Napa (1995) 9 Cal.4th 763, 773; Lesher Communications, Inc. v. City of Walnut Creek (1990) 52 Cal.3d 531, 540.

General plan consistency is “the linchpin of California’s land use and development laws; it is the principle which infused the concept of planned growth with the force of law.” Debottari v. Norco City Council (1985) 171 Cal.App.3d 1204, 1213. It is well established that development projects may not be approved if they interfere with, or frustrate, the general plan’s policies and objectives. See Napa Citizens, 91 Cal.App.4th at 378-79; see also Lesher, 52 Cal.3d at 544.

Here, the DEIR fails to analyze the consistency of the Project’s requested entitlements with the General Plan. Specifically, amongst other entitlements, the Project requires a general plan amendment, zone change, specific plan amendment, tentative parcel map, and development plan approval. DEIR at 3-15. However, rather than specifically analyzing the consistency of such departures from the general plan, the DEIR merely presumes that such entitlements are consistent with the City’s general plan. See DEIR at 4.11-8. Thus, the DEIR’s less than significant finding is unsupported and, for this reason too, the DEIR must be revised and recirculated.

E. The DEIR’s Biological Resource Findings Are Unsupported Although the DEIR recognizes that the Project has the potential to impact the habitat and sustainability of 22 special and threatened species, including the Cooper’s hawk, California horned lark, Stephen’s kangaroo rat, coastal California gnatcatcher, Los Angeles pocket mouse, Burrowing Owl, and Loggerhead Shrike (DEIR at 4.4-28), it goes on to state that the Project’s biological resource impacts will be less than significant without adequately supporting such conclusion. Rather, the DEIR merely relies upon the fact that the County of Riverside developed a Multiple Species Habitat Conservation Plan (“MSHCP”), which the Project site is located within, and that the Project applicants will be required to pay mitigation fees. DEIR at 4.4-34. However, such conclusion fails since, as the DEIR recognizes, only 19 of the 22 species are covered under the MSHCP. DEIR at 4.4-30. The DEIR must be revised to provide in depth analysis as to how each species will be protected or how impacts thereto will be mitigated rather than blanketly concluding that the biological impacts will be less than significant with the payment of mitigation fees.

IV. CONCLUSION

Soil Water Air Protection Enterprise (“SWAPE”) is pleased to provide the following draft technical report explaining the significance of worker trips required for construction of land use development projects with respect to the estimation of greenhouse gas (“GHG”) emissions. The report will also discuss the potential for local hire requirements to reduce the length of worker trips, and consequently, reduced or mitigate the potential GHG impacts.

Worker Trips and Greenhouse Gas Calculations
The California Emissions Estimator Model (“CalEEMod”) is a “statewide land use emissions computer model designed to provide a uniform platform for government agencies, land use planners, and environmental professionals to quantify potential criteria pollutant and greenhouse gas (GHG) emissions associated with both construction and operations from a variety of land use projects.”1 CalEEMod quantifies construction-related emissions associated with land use projects resulting from off-road construction equipment; on-road mobile equipment associated with workers, vendors, and hauling; fugitive dust associated with grading, demolition, truck loading, and on-road vehicles traveling along paved and unpaved roads; and architectural coating activities; and paving.2
The number, length, and vehicle class of worker trips are utilized by CalEEMod to calculate emissions associated with the on-road vehicle trips required to transport workers to and from the Project site during construction.3

2 Specifically, the number and length of vehicle trips is utilized to estimate the vehicle miles travelled (“VMT”) associated with construction. Then, utilizing vehicle-class specific EMFAC 2014 emission factors, CalEEMod calculates the vehicle exhaust, evaporative, and dust emissions resulting from construction-related VMT, including personal vehicles for worker commuting.4
Specifically, in order to calculate VMT, CalEEMod multiplies the average daily trip rate by the average overall trip length (see excerpt below):
“VMTd = Σ(Average Daily Trip Rate i * Average Overall Trip Length i) n Where:
n = Number of land uses being modeled.”5
Furthermore, to calculate the on-road emissions associated with worker trips, CalEEMod utilizes the following equation (see excerpt below):
“Emissionspollutant = VMT * EFrunning,pollutant
Where:

Emissionspollutant = emissions from vehicle running for each pollutant VMT = vehicle miles traveled
EFrunning,pollutant = emission factor for running emissions.”6 Thus, there is a direct relationship between trip length and VMT, as well as a direct relationship between VMT and vehicle running emissions. In other words, when the trip length is increased, the VMT and vehicle running emissions increase as a result. Thus, vehicle running emissions can be reduced by decreasing the average overall trip length, by way of a local hire requirement or otherwise.

Default Worker Trip Parameters and Potential Local Hire Requirements As previously discussed, the number, length, and vehicle class of worker trips are utilized by CalEEMod to calculate emissions associated with the on-road vehicle trips required to transport workers to and from the Project site during construction.7 In order to understand how local hire requirements and associated worker trip length reductions impact GHG emissions calculations, it is important to consider the CalEEMod default worker trip parameters. CalEEMod provides recommended default values based on site-specific information, such as land use type, meteorological data, total lot acreage, project type and typical equipment associated with project type. If more specific project information is known, the user can change the default values and input project- specific values, but the California Environmental Quality Act (“CEQA”) requires that such changes be justified by substantial evidence.8 The default number of construction-related worker trips is calculated by multiplying the

3 number of pieces of equipment for all phases by 1.25, with the exception of worker trips required for the building construction and architectural coating phases.9 Furthermore, the worker trip vehicle class is a 50/25/25 percent mix of light duty autos, light duty truck class 1 and light duty truck class 2, respectively.”10 Finally, the default worker trip length is consistent with the length of the operational home-to-work vehicle trips.11 The operational home-to-work vehicle trip lengths are:
“[B]ased on the location and urbanization selected on the project characteristic screen. These values were supplied by the air districts or use a default average for the state. Each district (or county) also assigns trip lengths for urban and rural settings” (emphasis added). 12 Thus, the default worker trip length is based on the location and urbanization level selected by the User when modeling emissions. The below table shows the CalEEMod default rural and urban worker trip lengths by air basin (see excerpt below and Attachment A).13

4 As demonstrated above, default rural worker trip lengths for air basins in California vary from 10.8- to 19.8- miles, with an average of 16.47 miles. Furthermore, default urban worker trip lengths vary from 10.8- to 14.7- miles, with an average of 11.17 miles. Thus, while default worker trip lengths vary by location, default urban worker trip lengths tend to be shorter in length. Based on these trends evident in the CalEEMod default worker trip lengths, we can reasonably assume that the efficacy of a local hire requirement is especially dependent upon the urbanization of the project site, as well as the project location.

Practical Application of a Local Hire Requirement and Associated Impact To provide an example of the potential impact of a local hire provision on construction-related GHG emissions, we estimated the significance of a local hire provision for the Village South Specific Plan (“Project”) located in the City of Claremont (“City”). The Project proposed to construct 1,000 residential units, 100,000-SF of retail space, 45,000-SF of office space, as well as a 50-room hotel, on the 24-acre site. The Project location is classified as Urban and lies within the Los Angeles-South Coast County. As a result, the Project has a default worker trip length of 14.7 miles.14 In an effort to evaluate the potential for a local hire provision to reduce the Project’s construction-related GHG emissions, we prepared an updated model, reducing all worker trip lengths to 10 miles (see Attachment B). Our analysis estimates that if a local hire provision with a 10-mile radius were to be implemented, the GHG emissions associated with Project construction would decrease by approximately 17% (see table below and Attachment C).

As demonstrated above, by implementing a local hire provision requiring 10 mile worker trip lengths, the Project could reduce potential GHG emissions associated with construction worker trips. More broadly, any local hire requirement that results in a decreased worker trip length from the default value has the potential to result in a reduction of construction-related GHG emissions, though the significance of the reduction would vary based on the location and urbanization level of the project site.

This serves as an example of the potential impacts of local hire requirements on estimated project-level GHG emissions, though it does not indicate that local hire requirements would result in reduced construction-related GHG emission for all projects. As previously described, the significance of a local hire requirement depends on the worker trip length enforced and the default worker trip length for the project’s urbanization level and location.
