Traffic Calming Program Cycle I project will install speed cushions and associated signage and striping on various residential street segments. This project will also install ADA compliant curb ramps at various intersections throughout the City of Modesto and install crosswalk ADA improvements on 11th Street between J Street and I Street.

DISCUSSION:

The Scenic Drive Phase II, Dry Creek Trail Phase II, Kansas Avenue, & Neighborhood Traffic Calming Cycle I project was advertised for bids on October 24, 2024. Bids were publicly opened on December 10, 2024, and Bay Cities Paving & Grading, Inc., of Concord, CA was the apparent low bidder. The bid tabulation is attached.

The bid analysis is:

Number of responsive bids received Three (3)
Number of bids within 10% of engineer’s estimated Two (2) Number of bids above engineer’s estimate One (1)
Bay Cities Paving and Grading’s bid was 1.44% below the engineer’s estimate and the other two bids ranged between 1.36% below and 14.97% above the engineer’s estimate. Staff determined that the bid is a reasonable bid for the project and bidder competition was evident, as the City received three bids.

Modesto Municipal Code Section 8-3.203 generally requires all purchases which meet or exceed $100,000 for material, equipment, or contractual services to be formally bid. The award of contract for the construction of the Scenic Drive Phase II, Dry Creek Trail Phase II, Kansas Avenue, & Neighborhood Traffic Calming Program Cycle I project, to Bay Cities Paving & Grading, Inc., of Concord, CA., conforms to the Modesto Municipal Code because the City complied with the formal bid procedures and Bay Cities Paving & Grading, Inc., of Concord, CA., was the lowest responsive and responsible bidder.

While the contingency policy is utilized with each Construction Contract awarded by the City, it is not written into the contract, nor is it a guaranteed amount included in the final compensation to the contractor.

The City’s “Change Order Approval Policy” enacted by Council Resolution No. 1994-443 on July 19, 1994, and revised on July 9, 2019, by Council Resolution No. 2019-326, and revised a second time on September 12, 2023, by Council Resolution No. 2023-405 established a Contract change order authority of 10% for Construction Contracts of this dollar value.

Due to limited staffing resources, current workloads and the size and complexity of this project, staff recommends utilizing a consultant for this project for proper project coverage and construction oversight, including Construction Management, Inspections and Materials Testing, and Public Outreach services for the anticipated 12-month construction period.

In accordance with Modesto Municipal Code 8-3.204(a), agreements for professional services are exempt from the formal bidding requirements of Modesto Municipal Code 8-3.203 if competitive proposals or quotations are sought from at least three (3) qualified entities. In compliance with this requirement, a Request for Proposals (RFP) was issued on October 29, 2024 to the City’s #2..

Task 8 Materials Testing
Task 9 Start-up, Closeout and Acceptance
From our recent experience with similar projects in the City of Modesto, we understand the value of coordinating with the design team and Surveyor during construction of ADA curb ramps. In many instances, these ramps will have a “custom” transition zone from the new ramp to the existing sidewalk. While all the elements of this project are important, properly constructing these new ramps requires continuous attention from layout to finishing. We understand that this is an interactive and iterative process that involves strong technical skills, a clear understanding of the City’s expectations, and the ability to implement those expectations during the construction phase. We will continue to bring that level of service by delivering a completed project to the City that accomplishes your goals.

Project Manager/Supervising Construction Inspector Justin Wehling will represent our team. Justin has extensive experience performing Inspection and managing high-profile projects in the City right-of-way. Justin will provide oversight of the project to ensure maintained focus on the most important technical and political elements of the project while working with local business owners, schools, transportation agency, and Modesto residents. Justin will provide daily field inspection for this roadway rehabilitation project that includes the design-build of curb ramps in accordance with the most current ADA requirements. In addition, our proposed subconsultant partner, Terracon Consultants, Inc., will provide material testing support based on the City’s quality assurance program and industry standards.

Knowing our past success working within the city of Modesto, TRC believes our team will be a seamless addition to the City's existing resources. We will assist in taking your project from design to completion while concentrating on the tasks described above to minimize cost and schedule impacts.

Should you have any questions regarding our proposed scope of work, please feel free to contact Justin Wehling directly at (916) 826- 4429, or by email at [email protected].

Respectfully submitted,

Exhibit C:

Insurance Requirements for Professional Services
Consultant shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the work hereunder and the results of that work by the Consultant, his agents, representatives, employees or subconsultants.

MINIMUM SCOPE AND LIMIT OF INSURANCE
Coverage shall be at least as broad as:

1. Commercial General Liability (CGL): Insurance Services Office Form CG 00 01 covering CGL on an “occurrence” basis, including products and completed operations, property damage, bodily injury and personal & advertising injury with limits no less than $1,000,000 per occurrence. If a general aggregate limit applies, either the general aggregate limit shall apply separately to this project/location (ISO CG 25 03 or 25 04) or the general aggregate limit shall be twice the required occurrence limit.

2. Automobile Liability: ISO Form Number CA 00 01 covering any auto (Code 1), or if Consultant has no owned autos, hired, (Code 8) and non-owned autos (Code 9), with limit no less than $1,000,000 per accident for bodily injury and property damage.

3. Workers’ Compensation: as required by the State of California, with Statutory Limits, and Employer’s Liability Insurance with limit of no less than $1,000,000 per accident for bodily injury or disease. (Not required if consultant provides written verification it has no employees)

4. Professional Liability (Errors and Omissions) Insurance appropriates to the Consultant’s profession, with limit no less than $2,000,000 per occurrence or claim, $2,000,000 aggregate.

If the Consultant maintains broader coverage and/or higher limits than the minimums shown above, the City requires and shall be entitled to the broader coverage and/or the higher limits maintained by the Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City.

Umbrella or Excess Coverage
The Consultant may use Umbrella or Excess Policies to provide the liability limits as required in this agreement.

This form of insurance will be acceptable provided that all of the Primary and Umbrella or Excess Policies shall provide all of the insurance coverages herein required, including, but not limited to, primary and noncontributory, additional insured, Self-Insured Retentions (SIRs), indemnity, and defense requirements. The Umbrella or Excess policies shall be provided on a true “following form” or broader coverage basis, with coverage at least as broad as provided on the underlying Commercial General Liability insurance. No insurance policies maintained by the Additional Insureds, whether primary or excess, and which also apply to a loss covered hereunder, shall be called upon to contribute to a loss until the Consultant’s primary and excess liability policies are exhausted.

The insurance policies are to contain, or be endorsed to contain, the following provisions:

Additional Insured Status
The City, its officers, officials, employees, and agents, are to be covered as additional insureds on the CGL policy with respect to liability arising out of work or operations performed by or on behalf of the Consultant including materials, parts, or equipment furnished in connection with such work or operations. General liability coverage can be provided in the form of an endorsement to the Consultant’s insurance with coverage equal to ISO form CG 2010. If Completed Operations endorsement is required, a separate endorsement equal to ISO form CG 2037 is required.

Primary Coverage
The Additional Insured coverage under the Consultant’s policy shall be “primary and non-contributory” and will not seek contribution from the City’s insurance or self-insurance and shall be at least as broad as CG 20 01 04 13. The City does not accept endorsements limiting the Consultant’s insurance coverage to the sole negligence of the Named Insured.

Notice of Cancellation
Each insurance policy required above shall provide that coverage shall not be canceled, except with notice to the City.

Waiver of Subrogation
Except for Professional Liability Insurance, Consultant hereby grants to City a waiver of any right to subrogation which any insurer of said Consultant may acquire against the City by virtue of the payment of any loss under such insurance. Consultant agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not the City has received a waiver of subrogation endorsement from the insurer.

Self-Insured Retentions
All Self-insured retentions must be disclosed to Risk Management for approval and shall not reduce the limits of liability. The City may require the Consultant to purchase coverage with a lower retention or provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention.

Any and all deductibles and SIRs shall be the sole responsibility of Consultant or subconsultant who procured such insurance and shall not apply to the Indemnified Additional Insured Parties.

Acceptability of Insurers
Insurance is to be placed with insurers with a current A.M. Best’s rating of no less than A:VII, unless otherwise acceptable to the City.

Claims Made Policies (applicable to Professional Liability only) If any of the required policies provide claims-made coverage:

3. If coverage is canceled or non-renewed, and not replaced with another claims-made policy form with a Retroactive Date prior to the contract effective date, the Consultant must purchase “extended reporting” coverage for a minimum of three (3) years after completion of work.

Verification of Coverage
Consultant shall furnish the City with original certificates and amendatory endorsements or copies of the applicable policy language effecting coverage required by this clause and a copy of the Declarations and Endorsements Pages of the CGL and any Excess policies listing all policy endorsements. All certificates and endorsements are to be received and approved by the City’s Risk Manager before work commences. However, failure to obtain the required documents prior to the work beginning shall not waive the Consultant’s obligation to provide them. The City reserves the right to require redacted copies of Declaration Pages of all required insurance policies, including endorsements required by these specifications, at any time.. Failure to exercise this right shall not constitute a waiver of right to exercise later.

Subconsultants
Consultants shall require and verify that all subconsultants, or other parties hired for this work, purchase and maintain coverage for indemnity and insurance requirements as least as broad as specified in this agreement to the extent they apply to the scope of the subconsultant’s work with the same certificate of insurance requirements and naming as additional insureds all parties to this contract.

Special Risks or Circumstances
City reserves the right to modify these requirements, including limits, based on the nature of the risk, prior experience, insurer, coverage, or other special circumstances and Consultant shall be reimbursed for any increased premiums for such added coverage.

Proper address for mailing certificates, endorsements and notices shall be:

DISCUSSION:

The Coffee Road Strengthen & Replace Water Mains Project has been identified through the 2017 WMP and developed under CIP Project 101331. This project aims to improve the water system in the area bounded by Briggsmore Avenue to the North, Coffee Road to the East, Locke Road to the South, and Ramona Avenue to the West.

The existing water mains along Coffee Road, from East Fairmont Avenue to Brighton Avenue and in the surrounding area are aging, undersized steel pipes that are prone to leaks and low water pressure.
