FISCAL IMPACT:

Sufficient funds are budgeted in Fiscal Year (FY) 2025-26 to cover the cost for these agreements.

The primary funding source for these agreements will be funded by the Fleet Fund and secondary funding sources will include outside service agreements such as fire service contracts and StanRTA. An increase is being recommended for the new agreements due to anticipated inflation increases as well as new fleet vehicles that will be added to the City’s inventory with the addition or increase of City programs funded through Measure H which required the purchase of new vehicles. The proposed vendors will provide maintenance and repair on the new fleet vehicle transmissions.

Below is a summary of the last five years of spending for the three vendors which includes both parts and services.

The overall agreement total was calculated by forecasting CPI percentage increases based on an average of the CPI index over the last 12 months. City staff project annual increases based on this estimated forecast. Annual increases will be calculated using the current CPI index at the time of the requested increase. Estimated spending across all three vendors is anticipated to average $150,000 annually.

CITY OF MODESTO

COUNCIL AGENDA REPORT
DATE OF MEETING:

February 24, 2026
Date: January 20, 2026
TO: Mayor and City Council
THROUGH: Joseph P. Lopez, City Manager
FROM: Patrick Crowley, Interim Public Works Director
SUBJECT: First Amendment to the Agreement for Material Hauling Services CONTACT: John Chavez, Integrated Waste Manager, [email protected], 209-577-5453
DESCRIPTION:

Consider approving the First Amendment with California Material Inc. for Material Hauling Services, increasing the Agreement amount by $621,746 to a new total amount not to exceed $1,246,746 over the term of the Agreement. (Funding Source: Compost Fund) STRATEGIC PLAN ELEMENT:

The recommended action is consistent with the City of Modesto 2025-2026 Strategic Plan Element: “Economic Vitality”, Goal H: “Achieve long-term financial sustainability.”; Strategies No. One: “develop a strategy for long-term financial sustainability,” and No. Two: “reduce general liability exposure claims.”
BACKGROUND:

The Public Works and Utilities Departments require material hauling services for asphalt, dirt, asphalt grindings, rock, road base material, and concrete. Compost, sewer, storm drain, water, and street construction operations generate large amounts of materials that must be transported to and from the jobsite. This usually requires multiple large tractor-trailer end dumps to haul the material away where it is stockpiled for recycling or reallocation. These services are also needed for the delivery of new materials to the jobsite. City departments do not have the trucks or the staffing to haul large amounts of materials when needed.

Due to the unpredictable nature of the work, it is not always possible for the divisions to know what their immediate need is. Departments assume the highest-need scenarios when estimating annual amounts needed for hauling. The current agreement includes Water, Wastewater, and Storm Drain Divisions from the Utilities Departments, along with Compost, Solid Waste, and Streets Divisions from the Public Works Department.

On December 5, 2023, by Resolution 2023-530, Council approved a two-year agreement with three one-year extension options with California Materials Inc. of Stockton, CA, for a total not to #14..

exceed $625,000 over five years. Compost projected its share of the city-wide agreement at $75,000 annually, representing $375,000 of the $625,000 originally approved by Council.

Since the initial costs were estimated, the City has received four violations from the Central Valley Water Board, as documented in the April 16, 2025, inspection report. This amendment will support the correction of two of these violations. The first violation is that the Compost Facility’s 10-Acre Final Product Storage Area contained significant undulations and depressions, which could lead to extensive ponding. The second violation is that the southern portion of the active compost pad, which only contains a soil-improved pad, appeared to be in poor condition with notable undulations that could lead to ponding. Similar conditions were noted in a previous Notice of Violation (NOV) issued February 21, 2024. Following the February NOV, the City was initially given until September 30, 2024 to submit a work plan to make permanent facility improvements. The City asked for an extension which was granted, moving the due date to December 1, 2025, with the stipulation that, if not achieved, the penalties would be enforced as of the initial due date in September 2024.

DISCUSSION:

Increasing waste hauling services will help address these violations by enabling the Compost Facility to remove contaminants more rapidly, thereby freeing operational space and allowing necessary surface repairs to proceed. Achieving compliance will require completion of these surface repairs to meet Water Board standards. A follow-up inspection is scheduled for February 4, 2026, at which time the Water Board will evaluate facility conditions and provide an update on corrective actions.

This action plan is already underway and will continue until compliance is achieved. The City is currently reviewing affected areas to evaluate potential remediation options, including the possible addition of a blacktop surface; however, existing material would need to be removed prior to any such improvements. The Facility has begun processing significant volumes of material and has removed approximately seven stockpiles, each estimated at 3,000 to 4,000 tons. An additional fifteen stockpiles remain pending processing.

The increased level of waste hauling services is expected to continue at this higher rate.

Ongoing annual hauling needs are anticipated to exceed previous projections due to increased green waste volumes being delivered to the Compost Facility.

Modesto Municipal Code Section 8-3.203 generally requires purchases exceeding $100,000 for materials, equipment, or contractual services to be formally bid. However, Section MMC 8-3.204 allows exceptions to the formal bidding process when the Purchasing Manager determines it is appropriate to amend an existing agreement to include additional, similar goods or services, of limited quantity or scope, to increase efficiency and avoid delays or disruptions to City services.

FISCAL IMPACT:

The City has submitted its response, which includes a plan to coordinate with the Streets Division to initiate repairs and reconstruction on the east side of the Compost Facility. If additional details, such as a more comprehensive repair proposal or construction schedule, are required they will be submitted as soon as practicable. #14..

First Amendment to the Agreement for Material Hauling Services

Page 3 of 4 ends

The original due date of September 30, 2024, remains in effect for purposes of calculating enforcement penalties. Minimum enforcement penalties are $1,000 per day of noncompliance, which could result in penalties exceeding $473,000 and increasing daily.

The overall agreement total was calculated by forecasting Consumer Price Index (CPI) percentage increases based on an average of the CPI index over the prior twelve months. City staff project annual increases based on this estimated forecast. Annual increases will be calculated using the current CPI index in effect at the time of the requested increase.

The original agreement includes an estimated annual spend of $125,000, of which $75,000 was allocated for annual hauling services for the Compost Facility (account string 4890-56030- 53300), for a total of $375,000 over the life of the agreement. If approved, this Amendment would increase the annual estimate from $125,000 to $280,437 for years two through four, and to $280,435 for year five. The additional $621,746 would be allocated to Compost Facility expenses using account string 4890-56030-53300 (Compost Fund), resulting in a total agreement amount of $996,746 for the Facility over the life of the agreement.

COMMITTEE RECOMMENDATION:

On December 17, 2025, the Finance Committee reviewed this item and recommended it be forwarded to Council for approval.

CITY OF MODESTO

COUNCIL AGENDA REPORT
DATE OF MEETING:

February 24, 2026
Date: January 20, 2026
TO: Mayor and City Council
THROUGH: Joseph P. Lopez, City Manager
FROM: William Wong, Director of Utilities
SUBJECT: Award Highway 99 Water Main Crossings Improvements Project I Street, G Street, and Sierra Drive
CONTACT: David A. Felix, Associate Engineer, [email protected], 209-577-5488 DESCRIPTION:

Consider approving the Plans and Specifications for the Highway 99 Water Main Crossings Improvements Project, accepting the Bid and Awarding a Construction Contract to Rolfe Construction Inc., of Atwater, CA in the amount of $1,436,035, authorizing 20% in contingency (if needed), for a total payment amount not to exceed $1,723,242. (Funding Source: Water Fund) STRATEGIC PLAN ELEMENT:

The recommended action supports the 2025-2026 City of Modesto Strategic Plan Initiatives, Goal D: Provide safe, efficient, and reliable infrastructure through proactive community investment, maintenance, and sustainability efforts.

BACKGROUND:

The Highway 99 Water Main Crossings Improvements Project will replace approximately 1,240 linear feet of outdated water mains that are prone to leaks and low water pressure to meet current City standards along the following streets:

I Street 5
th Street to 6th Street
G Street 5
th Street to 6th Street
Sierra Drive 5
th Street to 6th Street
The Project will also include reconnecting and restoring service laterals, appurtenances, hydrants, and system connections. These upgrades will improve system reliability and increasing fire flow capacity.

Page 2 of 4 ends

DISCUSSION:

The Project was advertised for bid on November 7, 2025; Bids were publicly opened on December 30, 2025, pursuant to City Charter Section 1307 and Rolfe Construction Inc., of Atwater, CA, was the responsible bidder with the lowest responsive bid.

Bid Analysis:

Number of Bids Received 5
Number of Bids within 10% of Engineer’s Estimate 4
Number of Bids Above the Engineer’s Estimate 1
Number of Bids Below the Engineer’s Estimate 4
Percent Low Bid is Below the Engineer’s Estimate 24.97% Staff reviewed the low bid and determined pricing reflects favorable market conditions and the contractor’s familiarity with similar work, with no scope omissions identified. Bidder competition and participation was evident as the City received five bids.

Modesto Municipal Code Section 8-3.203 generally requires all purchases, which meet or exceed $100,000 for material, equipment, or contractual services to follow the formal bid procedures. The award of a Contract for the construction of the Highway 99 Water Main Crossings Improvements Project to Rolfe Construction, Inc., of Atwater, CA, conforms to the Modesto Municipal Code because the City complied with the formal bid procedures and Rolfe Construction Inc., was the lowest responsible and responsive and bidder.

The City’s “Change Order Approval Policy” enacted by Council Resolution No. 1994-443 on July 19, 1994, revised on July 9, 2019, by Council Resolution No. 2019-326, and revised a second time on September 12, 2023, by Council Resolution No. 2023-405 established a Contract Change Order authority of 10% for Construction Contracts of this dollar value. However, after reviewing the plans and specifications, and given the nature of this Project where unforeseen conditions may exist when dealing with existing construction, and other unaccounted for issues may arise, it is likely that this Project could exceed the Director’s Authority of 10% ($143,604) of the Construction Contract amount of $1,436,035. Therefore, staff is requesting that the Director’s authority to issue change orders be increased to 20% ($287,207) of the Construction Contract amount.

While the contingency policy is utilized for each Construction Contract awarded by the City, it is not written into the Contract, nor is it a guaranteed amount included in the final compensation to the contractor.

FISCAL IMPACT:

The total estimated cost for the Construction Phase of this Project is $1,974,287. Expenses associated with this effort are housed in the following Capital Improvement Program Project:

Project ID #: 2026-07
Account #: 101557
Vault ID #: 12-D-0567
Bid Opening: 12/30/2021 at 11:00 AM

Project Description: This project will replace three aging water mains that run across CA Highway 99 within three bridge overcrossings at I Street, G Street, and Sierra Drive.

The water mains include 12-inch cast iron pipe (CIP) carrier pipe inside 18-inch steel at each bridge location. The project will replace existing 12-inch carrier pipe inside the casing with 12-inch ductile iron pipe (DIP) keeping the casing in place. Outside the bridges, the direct buried portion of existing 6-, 8- and 12-inch CIP mains will be replaced with PVC C900 pipe. The project also includes reconnecting and restoring service laterals, appurtenances, hydrants, and system connections with the existing mains.
