contacted to provide lockers. Due to the potential health concerns with prolonged mold exposure, it was determined that this was an emergency purchase and exempt from the usual competitive purchasing process.

Under Montebello Municipal Code Chapter 3.20.050A, Conformance with bidding procedures, the City may proceed with an emergency purchase of items/services. The previous municipal code chapter states:

Purchases of supplies and equipment for city use shall be made and accomplished in conformity with Section 3.20.080 or Section 3.20.090 except:

Emergency Procurement: When an emergency, as determined by the purchasing agent with the approval of the city manager in writing, is deemed to require that an order be placed with the nearest available source of supply.

Furthermore, City Council approval is required because the combined total of all purchases from ULine during the current Fiscal Year 2021 - 2022 will exceed the City Manager’s authority of $50,000.

SUMMARY
A recent assessment of the police facility found that a portion of the building is potentially at risk of exposing police personnel to mold. As a result, the City is taking extensive steps to close a part of the facility to mitigate exposure and begin the remediation process. To ensure police personnel has sufficient locker room space, the Human Resources/IT and Finance Departments have initiated an emergency purchase from ULine with the approval of the City Manager.

Emergency Purchase Request - Uline, Inc. and A Tech
Consulting Inc.

It is requested that the City Manager approve an emergency purchase of items and services from Uline, Inc. (Uline) and A Tech Consulting Inc. in the amount of $38,430.22.

After several Police Department employees observed an unusual odor, an inspection of the police building was initiated. An assessment was required to determine if mold or other harmful contaminants were present. The assessment found that the building had what is believed to be mold in various areas on the first level. As a result of this discovery, a portion of the police building must be temporarily closed while abatement measures are in place. This closure will prohibit employees from using specific locker room areas. To ensure police employees have sufficient facilities, it is recommended that emergency purchase orders are established with Uline and A Tech Consulting Inc. Both vendors were contacted by the City's Human Resources - Risk Manager and confirmed that all necessary items are available and in stock. ULine will provide and deliver locker rooms for $36,010.22, and A Tech Consulting Inc will provide a follow up report of air samples for $2,420.00 on a different site of the Police Department. Both items will be delivered and invoiced upon receipt of purchase orders.

The Finance Department and Risk Manager are working to identify other items that will be needed in support of the abatement efforts. Other agreements/purchase orders will be established as needed.

CITY OF MONTEBELLO

CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and Members of the City Council
FROM: René Bobadilla, City Manager
BY: Paul Espinoza, Chief of Police
Michael A. Solorza, Director of Finance
SUBJECT: Authorize the Payment of Invoices from Montebello Tire Pros and Increase Existing Purchase Orders with Chevy of Montebello and Ford of Montebello
DATE: June 22, 2022
RECOMMENDATIONS:

It is recommended that City Council take the following actions:
1) Authorize the payment of invoices from Montebello Tire Pros in the amount of $28,602; and
2) Authorize the City Manager to approve up to an additional $15,000 for any new invoices received from Montebello Tire Pros for purchases through June 30, 2022; and
3) Authorize increasing Purchase Order No. 22 – 476 with Chevy of Montebello by $10,000 (PO Total - $50,000) for additional services through June 30, 2022; and 4) Authorize increasing Purchase Order No. 22 – 477 with Ford of Montebello by $40,000 (PO Total - $80,000) for additional services through June 30, 2022; and 5) Take such additional, related action(s) that may be desirable.

FISCAL IMPACT
The total amount of invoices due from Montebello Tire Pros is $28,602. The invoices are for services conducted on vehicles from multiple City departments. In addition, $15,000 is requested for any outstanding invoices for services that might be incurred prior to June ITEM #___ 35

30, 2022. Once City Council approves, the Finance Department will conduct a final review of all invoices before payment to ensure the correct department is charged.

Furthermore, the Police Department’s purchase orders with Chevy of Montebello and Ford of Montebello will be increased by a total of $50,000 ($10,000 for Chevy and $40,000 for Ford). Sufficient funding exists in the various department vehicle maintenance budgets (i.e., Transit, Police, Public Works, etc.) to pay for the remaining work completed through June 30, 2022. Therefore, no budget amendment is needed for Fiscal Year 2021-22.

Staff will present new blanket purchase orders for FY 2022-23 at a subsequent City Council meeting, establishing new PO’s with these vendors in amounts sufficient to cover services rendered for next fiscal year.

BACKGROUND
The City of Montebello uses the services of various vehicle maintenance and repair shops to provide vehicle services when needed.

Most of the shops used are within the city limits to ensure convenience and promote the City's objective to promote and support local businesses. The service provider list includes Montebello Tires Pros (located at 830 West Whittier Boulevard), Chevy of Montebello (310 West Whittier Boulevard), and Ford of Montebello (2747 Via Campo).

When needed, multiple city departments use these shops for maintenance services (e.g., oil changes, filter replacement, tire rotations) and repairs.

In April and May 2022, Staff observed that Montebello Tire Pros had not submitted invoices in several weeks. Shortly after receiving notice, Montebello Tire Pros sent 83 invoices, some dating back to January 2021. Compared to accounts payable records, a review of the invoices found that 43 were previously paid and the remaining 40 were pending payment. In most cases, the outstanding invoices were never sent to the Department requesting services or the Finance Department's Accounts Payable division for processing. As a result, there are $28,602 in outstanding invoices pending payment.

Due to the year-to-date expenditure amount with Montebello Tire Pros exceeding the City Manager's approval authority ($49,999), City Council approval is requested to authorize payment of the invoices in the total amount for remainder of FY 2021-22.

To ensure any other invoices from Montebello Tire Pros for services rendered prior to June 30, 2022, it is requested that the City Manager be granted the authority to pay up to an additional $15,000.

It is also requested that City Council authorize increasing Purchase Order No. 2022 – 476 with Chevy of Montebello by $10,000 and Purchase Order No. 2022 – 477 with Ford of Montebello by $40,000. The Police Department currently uses the service center at the dealerships mentioned above to maintain and repair some of their vehicles. The existing purchase orders have a remaining balance of $29,811; however, the Police Department CITY COUNCIL AGENDA REPORT – MEETING OF JUNE 22, 2022
Authorize the Payment of Invoices from Montebello Tire Pros and Increase Existing Purchase Orders with Chevy of Montebello and Ford of Montebello

Page 3 of 3 ends

has vehicles scheduled for significant repair services, and it is anticipated the work will exceed the balance remaining. By approving this action, the Police Department will have sufficient funds to complete the repair work, and both service centers will be paid in a timely manner.

Staff is currently in the process of identifying methods to improve the efficiency and effectiveness of the process of maintaining vehicles. The improvement efforts commenced earlier this year with the release of a Request for Proposals (RFP) seeking service provider(s) for city-wide fleet vehicle maintenance and repair services (RFP 22 – 4). In addition, the staff plans to research new applications and methods for asset management that include maintenance and repair tracking.

SUMMARY
Various City Departments use local vehicle shops to conduct routine maintenance work and repairs on city vehicles. The shops used include Montebello Tire Pros, Chevy of Montebello, and Ford of Montebello. The City currently has pending invoices and anticipated work that will be invoiced prior to June 30, 2022. For this reason, it is requested that City Council authorize the payment of invoices from Montebello Tire Pros in the amount of $28,602 and increase purchase orders with Chevy of Montebello and Ford of Montebello by a total of $50,000.

CITY OF MONTEBELLO

CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and Members of the City Council
FROM: René Bobadilla, City Manager
BY: James Enriquez, Director of Public Works
SUBJECT: Authorize the Payment of Invoices from Johnson Controls, Inc.

DATE: June 22, 2022
RECOMMENDATIONS:

It is recommended that City Council take the following actions:
1) Authorize the payment of invoices from Johnson Controls, Inc. (Johnson Controls) in the amount of $54,168.91; and
2) Take such additional, related action(s) that may be desirable.

FISCAL IMPACT
The total amount of the outstanding invoices for Fiscal Year 2021-22 from Johnson Controls is $54,168.91. If approved, payment of these invoices will be applied to Account No. 100-70-510-6040.60 (General Fund – Parks and Recreation – Government Building Maintenance – Building Maintenance/Repairs). Sufficient funding exists in the Parks and Recreation Department FY 2021-22 budget to pay these outstanding invoices, therefore a budget amendment is not necessary.

BACKGROUND
In April 2018, the City of Montebello issued Request for Proposals (RFP) 18-44 for Heating, Ventilation, and Air Conditioning (HVAC) Maintenance and Repairs. Through this process, the City selected Johnson Controls. Since being awarded, Johnson Controls has consistently provided satisfactory services.

DISCUSSION
At the beginning of Fiscal Year 2021-22, Public Works established Purchase Order No. 22-63 with Johnson Controls for annual HVAC maintenance and repair in the amount of $127,900. During the year, additional, unanticipated maintenance and repair services were required to ensure the HVAC system was functioning correctly, operating efficiently to conserve energy and reduce the City's carbon footprint, and air filters were regularly changed to reduce the spread of the COVID-19 virus. As a result, the City incurred invoices beyond the purchase order limit totaling $54,168.91. City Council approval is required to process and pay these invoices.

SUMMARY
Staff requests that the City Council authorize payment of invoices from Johnson Controls in the amount of $54,168.91.

CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: René Bobadilla, P.E., City Manager
BY: Michael Solorza, Director of Finance
SUBJECT: Adopt Resolution No. 22-53 to Approve City’s Annual Investment Policy
DATE: June 22, 2022
RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. 22-53 approving the Investment Policy Statement for the City and Successor Agency as required by Government Code Section 53601 et al.

FISCAL IMPACT
Approval of the updated Investment Policy Statement has no immediate fiscal impact.

State Government Code requires annual review and approval of the investment policy by a City’s governing body, even if no changes are made to the policy.

The attached Policy remains unchanged from the June 23, 2021 version approved by the City Council. Staff is bringing the policy for City Council review and approval so this process is aligned with the annual budget development and adoption.

BACKGROUND
State Government Code requires cities to have a City Council approved investment policy that guides the investment of idle cash. The policy is intended to provide specific criteria for the prudent investment of City and Successor Agency funds. The ultimate goal of the policy is to enhance the economic status of the City while protecting funds under management and meeting daily cash flow needs.

The City of Montebello has an investment policy statement most recently reviewed, approved and updated on June 23, 2021 (and prior to that, August 19, 2019 and October 28, 2020). Government Code requires an annual review and approval of the investment ITEM #_37___

policy statement – even if no changes are made. The 2019 approval was the first time the City’s investment policy was updated since 2011, with a previous update done in 2007. The irregular nature of review and updating of the policy required a much more thorough updating as part of October, 2020. The June 23, 2021 update was routine, as the review process is aligned on an annual basis and coincides with budget review and adoption (or follows shortly thereafter, as is the case with this approval).

The updated version of the City’s investment policy was submitted to the California Municipal Treasurers Association (CMTA) for consideration of their investment policy review and award program in 2021. The CMTA investment policy program utilizes public treasury officials to review public agency policies to ensure they comply with best practices and Government Code. For the first time in the City’s history, the City’s policy was submitted and passed the review with flying colors. Having passed this review process is one more indication of the progress made in achieving fiscal sustainability in Montebello.

There are no changes to the attached award winning policy for Fiscal Year 2022-23.

However, given the irregularity of prior reviews and approval, Staff is aligning this process to coincide with annual budget development and adoption. The plan going forward will be to present the investment policy, as required by Government Code, annually in June.

The policy (Attachment B) fully incorporates Government Code Section 53601 et al allowable investments. Having the ability to further diversify funds, and improve safety and liquidity while also gaining some yield is a prudent move. Staff will work with the City Treasurer and Fiscal Accountability and Investment Committee to further diversify the City’s investment portfolio, improving overall financial management and responsiveness of the portfolio to changing economic conditions.

SUMMARY
The City Council is being asked to adopt a resolution approving the Investment Policy Statement of the City and Successor Agency. There are no changes to the investment policy, and it remains identical to the version adopted on June 23, 2021. This approval will continue the re-alignment of investment policy consideration so that it occurs annually in June.

Investment Policy Statement
Adopted June 22 , 202 2

1. INTRODUCTION
This Statement of Investment Policy (“Investment Policy” or “Policy”) is intended to provide specific criteria for the prudent investment of City and Successor Agency funds. The ultimate investment goal is to enhance the economic status of the City while protecting funds under management and meeting the daily cash flow demands of the City and Successor Agency. This investment policy has been prepared in conformance with all pertinent existing laws of the State of California including California Government Code Sections 53600, et seq. (NOTE: throughout this Policy, it is understood that any reference to “City” is inclusive of the “Successor Agency.”)

2. SCOPE
This investment policy applies to all of the City's idle cash invested in various vehicles and encompasses all monies under the direct oversight of the City Treasurer and Director of Finance and include the General Fund, Reserve Funds, Special Revenue Funds, Debt Service Funds, Capital Project Funds, Permanent Fund, Proprietary Funds, Trust and Agency Funds, including the Successor Agency to the Dissolved Montebello Redevelopment Agency, and any other funds that may be created.

These funds are accounted for in the City of Montebello’s Comprehensive Annual Financial Report (CAFR).

3. DELEGATION OF AUTHORITY
Authority to manage the City of Montebello’s investment program is derived from California Government Code Section 53601 et al. The authority of the City Council to invest or reinvest monies of the City has been delegated by the City Council to the City Treasurer and Director of Finance until such time the delegation is revoked. No person may engage in an investment transaction except as provided under the terms of this policy and the procedures established by the Director of Finance.

4. ETHICS AND CONFLICTS OF INTEREST
Officers and employees involved in the investment process shall refrain from personal business activity that conflicts with proper execution of the investment program or that impairs their ability to make impartial investment decisions. Employees and investment officials shall disclose any material financial interests that could be related to the performance of the City's investment policy annually with the California Fair Political Practices Commission or as necessary under the Political Reform Act and Government Code Section 1090 et seq.

5. PRUDENCE/PRUDENT INVESTOR STANDARD
The City's pooled investment program operates under the Prudent Investor Standard, Government Code Section 53600.3, and applicable State laws. When investing, reinvesting, purchasing, acquiring, exchanging, selling, and managing public funds, responsible/delegated officials shall act with care, skill, prudence, and diligence under the circumstances then prevailing, including, but not limited to, the general economic conditions and the anticipated needs of the City, that a prudent person acting in a like capacity and familiarity with those matters would use in the conduct of funds of a like character and with like aims, to safeguard the principal and maintain the liquidity needs of the City.

Within the limitations of this section and considering individual investments as part of an overall strategy, investments may be acquired and sold as authorized by law. This affords a broad spectrum of investment opportunities so long as the investment is deemed prudent and permissible by the State of California, various bond indentures and this policy. It is the goal of officials so authorized under this Policy to strive to invest 100 percent of idle funds.

6. INTERNAL CONTROLS
The Director of Finance and/or his/her designee shall establish procedures that separate the internal responsibility for management and accounting of the investment portfolios. An analysis by an external independent auditor shall be conducted annually to review internal controls, account activity and compliance with policies and procedures.

7. INVESTMENT OBJECTIVES
The City's cash management system is designed to accurately monitor and forecast revenues and expenditures, thus enabling funds to be invested to the fullest extent possible. A diversified portfolio is maintained to accomplish the primary objectives in the order of safety, liquidity, and yield.

Safety: The safety/risk associated with an investment refers to the potential loss of principal, accrued interest or a combination of these. Credit risk is mitigated by monitoring financial institutions with which he/she will do business, and by careful scrutiny of the credit worthiness of the investment instruments as well as the institutions. Such resources as nationally recognized statistical-rating organization (NRSRO) services are utilized for this review. Mitigation of interest rate risk is sought through diversification of instruments as well as maturities.

Liquidity: The portfolio will be structured with sufficient liquidity to allow the City to meet anticipated cash requirements. This will be accomplished through the purchase of a diversity of instruments to include those with active secondary markets, those that can match maturities to expected cash needs, and the State Local Agency Investment Fund (LAIF) with immediate withdrawal provisions.

Yield: A competitive market rate of return is the third objective of the investment program after the fundamental requirements of safety and liquidity have been met. The portfolio shall be managed to consistently attain a market rate of return throughout budgetary and economic cycles. Whenever possible, and consistent with risk limitations and prudent investment management, the City will seek to augment returns above the market average rate of return through the implementation of active portfolio management strategies.

8. PERFORMANCE EVALUATION
Investment performance is continually monitored and evaluated by the City. Investment portfolio reports are generated on a monthly and quarterly basis and submitted to the City Council, City Manager, and Investment Committee. A quarterly Treasurer’s report is also presented to the City Council and Investment Committee.

9. DIVERSIFICATION
The City will diversify use of investment instruments to avoid unreasonable risks inherent in over-investing in specific instruments, individual financial institutions, or maturities.

Market price volatility shall be controlled through maturity diversification, as well as ensuring adequate liquidity is available to meet cash flow requirements, thereby precluding the need to sell instruments at a market loss.

Risk of default will be controlled by acquiring instruments such as Government Securities, or by diversifying the portfolio within the constraints and parameters of Section 17 of this Policy, Authorized and Suitable Investments.
4 | Page
Investment Policy Statement
Adopted June 22 , 202 2

10. PORTFOLIO SEGREGATION
Within the overall funds managed, bond proceeds held by fiscal agents or trustees shall also be segregated and invested in accordance with each indenture.

The primary purpose of any separately managed bond proceeds is to structure investment maturities to meet current and future liabilities. The preservation of principal and the maintenance of liquidity are the most important factors regarding the investment of bond proceeds. Portfolio yield is not a primary factor since the portfolio structure, eligible investment assets and maturity restrictions are governed by draws and expenditure schedules of the issues. Performance will be based upon maximizing permitted positive arbitrage within the context of principal preservation as a first priority (pre-1986 Tax Reform Act issuances) or minimizing or eliminating negative arbitrage (yield-restricted issues).

11. BOND ISSUANCE ARBITRAGE REBATE
The U.S. Tax Reform Act of 1986 requires the City to perform annual arbitrage calculations and rebate excess earnings to the U.S. Treasury for investment returns that exceed the allowable interest earnings limit of each bond issue. The arbitrage calculation process must be conducted for the investment of proceeds of bond issues sold after the effective date of this law. This arbitrage calculation will be contracted out to provide the necessary technical expertise to comply with this regulation. The City's investment position relative to the interest rate arbitrage restrictions is to have safety and the highest permitted return the law allows as the highest priority while ensuring the preservation of principal and liquidity.

12. QUALIFIED DEALERS
The City shall transact business only with Registered Investment Advisors, national or state-chartered banks, savings and loans, and broker dealers. The dealers should be primary dealers regularly reporting to the New York Federal Reserve Bank, or approved regional or secondary market dealers that qualify under the Securities and Exchange Commission Rule 15C3-1 (uniform net capital rule).

Authorized officials of the City may direct a fiscal agent or trustee to execute investment transactions on behalf of the City for funds held by that fiscal agent or trustee.

The City will monitor broker/dealers and their firms to ensure they are in good standing with the appropriate regulatory agencies.

13. SAFEKEEPING OF SECURITIES
To protect against losses caused by the collapse of individual securities dealers, all securities owned by the City, including collateral for repurchase agreements, shall be held in safekeeping by a third party bank trust department acting as agent for the City under the terms of a custody agreement or, in the case of funds held by the fiscal agent or trustee, the fiscal agent or trustee shall segregate and report securities held on the City's behalf. Any trade executed by a dealer is required to settle on a delivery versus payment basis with the City's safekeeping agent.

Fiscal agents or trustees in receipt of City of Montebello bond proceeds will settle security transactions on a delivery versus payment method based upon instructions provided by the authorized City official or the City's investment advisor. The fiscal agents or trustees will issue monthly custodian statements evidencing securities held in safekeeping, including the receipt of interest and maturity proceeds, the disbursement of funds for the purchase of securities, and the receipt of any sale proceeds. 5 | Page
Investment Policy Statement
Adopted June 22 , 202 2

14. COLLATERALIZATION
All demand deposits, time deposits and repurchase agreements are to be fully collateralized with securities authorized by the California Government Code and the City.  The cost value (book value) of collateral pledged for demand deposits must at all times be equal to or greater than the amount on deposit, plus accrued interest, in accordance with the following ratio:
o U.S. Treasury Securities: 110%
 The cost value (book value) of collateral pledged for repurchase agreements must at all times be equal to or greater than the par amount, plus accrued interest, with the following ratios:
o U.S. Treasury Securities: 102%
o U.S. Government Agencies: 102%
 It is the policy of the City to require reports at least on a quarterly basis from institutions with which the City has pledged security interest. The adequacy of collateralization shall be monitored to ensure that balances are collateralized in accordance with the ratios approved herein.
 With regard to repurchase agreements, it is the policy of the City to initiate a margin call in the event pledged collateral falls below the appropriate ratio.  Collateralized investments and deposits often require substitution of collateral. Any broker or financial institution requesting substitution must contact the City for approval in the event the counterparty to the transaction is not authorized under agreement with the City to make substitutions.

15. MAXIMUM MATURITIES
In accordance to California Government Code Section 53601, The City will not invest in any securities maturing more than five (5) years from the settlement date of purchase. If there is a desire to make investments longer than five years, express authority to make those investments, either specifically or as part of an investment program, must be approved by the City Council no less than three months prior to the investment.

16. INVESTMENT POOLS/MONEY MARKET MUTUAL FUNDS
A thorough investigation of any government sponsored pool and/or mutual fund is required prior to investing and on a continual basis. There shall be a questionnaire completed which will provide the following information:
• A description of eligible investment securities, and a written statement of investment policy and objectives.
• A description of interest calculations and how it is distributed, and how gains and losses are treated.
• A description of how the securities are safeguarded (including the settlement processes), and how often the securities are priced and the program audited. • A description of who may invest in the program, how often and what size of deposits and withdrawals are allowed.
• A schedule for receiving statements and portfolio listings. 6 | Page
Investment Policy Statement
Adopted June 22 , 202 2
• A description of how the pool/fund utilizes reserves, retained earnings, etc. • A fee schedule, including when and how fees are assessed. • The eligibility of the pool/fund to invest in bond proceeds and special district funds, and a description of its practices.

17. AUTHORIZED AND SUITABLE INVESTMENTS
The City is governed by the California Government Code, Sections 53600 et seq. Within the context of these limitations and based on the cost at the time of purchase, the following investments are authorized:

Various investment types will be categorized and grouped in the same structure as the qualified investment categories identified in this policy. The 10 | Page

portfolio report shall include a statement certifying the ability of the City to meet its expenditure requirements for the next six months, or provide an explanation as to why sufficient money shall, or may, not be available.

The investment portfolio report shall include market value information for all investments. A monthly market value will be obtained for each security owned by the City. For purposes of reporting, the market value of each security may be obtained from the City’s custodian bank or other pricing source(s) utilized by the City’s designated investment management firm (registered investment advisor).

The City shall record interest revenue on a modified accrual basis of accounting that is typical for reporting and recording of interest earnings. Securities held by a fiscal agent or trustee shall also be recorded on a modified accrual basis of accounting. CITY OF MONTEBELLO

CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and Members of the City Council
FROM: René Bobadilla, City Manager
BY: Michael A. Solorza, Director of Finance
SUBJECT: Authorize Issuing a Request for Proposals to Hire a Consultant to Conduct an Asset Inventory Update
DATE: June 22, 2022
RECOMMENDATIONS:

It is recommended that City Council take the following actions:
1) Authorize the issuing of a Request for Proposals (RFP) to hire a consultant to conduct an asset inventory review and update; and
2) Take such additional, related action(s) that may be desirable.

FISCAL IMPACT
Issuing this RFP does not have a direct cost associated. At this point, the exact cost of service is unknown. Once the selection process is complete, staff will return to City Council requesting approval of a professional services agreement if the total cost of service is $50,000 or more. If the service price is less than $50,000, the Department will seek the City Manager’s approval to proceed (Montebello Municipal Code Chapter 3.20 – Purchasing System).

BACKGROUND
Montebello is a full-service city that provides various services to meet the needs of residents, business owners, and visitors. As part of delivering services to the community, the City regularly obtains necessary supplies and equipment to ensure services are provided efficiently and effectively. Equipment with a value over a specific dollar amount (typically $5,000) and/or acquired under particular conditions (e.g., grant funds, donations) must be tracked in the City's asset management system, which is maintained by the Finance Department with the assistance of other city departments.

ITEM #____ 38
CITY COUNCIL AGENDA REPORT – MEETING OF JUNE 22, 2022
Authorize Issuing a Request for Proposals to Hire a Consultant to Conduct an Asset Inventory Update

Page 2 of 2 ends

DISCUSSION
The City currently uses an asset inventory tracking system that involves using the asset tracking module in New World Systems (i.e., the City’s financial system) and spreadsheets. The existing system has been an effective tool to meet the City’s needs; however, conducting an independent, comprehensive inventory would improve the current system and better position the City as it acquires more assets to handle increased service demand.

The primary objectives of this project are: 1) reviewing existing equipment lists to ensure accuracy; 2) ensure all city-owned equipment is tagged correctly under existing policy guidelines; 3) locate any equipment that is not included on the existing equipment list and update it as necessary; and 4) receive input on and update policy guidelines associated with asset tracking as necessary.

The City must maintain accurate and complete asset records to ensure proper reporting in financial statements issued to external reporting agencies and the public. For this reason, the consultant hired will be required to provide asset records that:

1. Comply with Generally Accepted Accounting Principles (GAAP);

2. Comply with local, state, and grant provisions; and

3. Meet the requirements of GASB 34 financial reporting.

While the aforementioned services could be conducted internally, it is believed that doing so would require a significant amount of time to complete. And it would not be in the City's best interest to assign a group of individuals this task as collateral duties to conduct as time presents. An independent third-party firm conducting the assessment will yield impartial results and would serve the most benefit. For this reason, it is recommended that City Council authorize issuing the RFP for these services.

The services associated with this RFP will focus only on physical assets with a depreciation schedule (e.g., buildings, vehicles, heavy machinery). Later, staff will consider seeking to inventory other items not previously included.

SUMMARY
The Finance Department requests approval to issue an RFP to hire a consultant to conduct an asset inventory review and update. The objective is to obtain a complete and accurate count of all of the City’s depreciable assets to ensure all items are accounted for properly and reported accurately in any financial statements.

Capital Asset Physical Inventory

RFP XX-XX
Introduction
The City of Montebello is seeking proposals from qualified consulting firms to assist with conducting a comprehensive asset physical inventory. All capital asset records currently reside in the Assets module of New World Systems from Tyler Technologies and Microsoft Excel schedules maintained primarily by the Finance Department. Assets are assigned tag numbers.

The primary objectives of this project are:

Improving financial reporting
The City is responsible for maintaining accurate and complete capital asset records to properly report capital asset information in financial reports issued to external reporting agencies and the public. Capital asset records must be adequately maintained to ensure financial statements:

1. Comply with Generally Accepted Accounting Principles (GAAP);

2. Meet the requirements of GASB 34 financial reporting.

3. Comply with grant provisions (if applicable);
Improving accountability and control
The City has a responsibility to establish systems, procedures, and controls to safeguard assets from loss or theft; capital asset records must be sufficient to control the movement and disposition of capital assets and establish accountability for any loss or theft.

Scope of Work/Services
Through this RFP, the City is seeking the following services:
1) Review the City’s current asset and control policies. Make recommendations as necessary. 2) Consultant will provide a physical inspection and inventory of City capital assets and will prepare accounting records for the following capital asset categories:

1. Equipment (All City departments and divisions)

2. Vehicles (All City departments and divisions)

3. Grant Funded Items (Including assets under the City threshold of $5000 but valued over $500)

4. Leased vehicles and equipment
3) Property accounting records should include the following information for each capital asset:
a. Asset Description
b. Manufacturer
c. Make
d. Model
e. Asset/ Tag Number
f. Serial Number
g. Asset Location (Department, Building, Room, etc.)
h. Responsible Department / Division
i. Valuation of Asset
i. Fair Market Value

ATTACHMENT A
ii. Replacement costs
j. Useful Life (for depreciation calculation)
k. Asset Class (Classification Codes provided by the City) l. Funding Source (if Grant Funded)
4) The consultant will be responsible for providing the capital assets inventory data on a flash or cloud drive in a file format to upload data into the City's capital asset system (New World Systems Capital Asset database).
5) The consultant will complete the physical inventory reconciliation to the general ledger and New World Systems Capital Assets database.
6) Identify and report on other matters that come to attention in the course of your evaluation that, in your professional opinion, the City should consider. 7) Present findings to the City’s Finance Department group. 8) Prepare a final report.
9) The City may elect to hire the consultant to conduct updates as needed to ensure records are up-to-date and accurate.

Accounting/Asset Control Policies
Under the City's capitalization (accounting and reporting) policy, all capital assets with a unit cost of over $5,000 and a normal life of more than one (1) year will be included in the inventory. In addition, under the City's accountability and control objectives, all Information Technology (IT) and grant funded equipment with a unit cost of $500 or more will be included in the inventory and subject to tracking.

Equipment Tagging
The selected consultant firm will be responsible for applying bar code tags to machinery and equipment under the City's control policy and objectives and including the tag numbers in the capital asset accounting records. Placement of the tags must be applied in consistent locations with procedures formalized with the City prior to beginning.

May 2, 2022: Special City Council Meeting Minutes Page 2 of 2 Councilmember Melendez thanked the demographer, staff, and the community who participated in this process. He stated the residents overwhelmingly chose to have 5 districts through their input from emails, comments and highlighted Demographer Map No. 3b because it creates the most equitable green space, keeps La Merced community together, and it’s been the most favored by the community. He asked to move forward with Demographer Map 3b and stated that this is what the community wanted.

Councilmember Peralta thanked demographer and staff. She expressed her preference for Demographer Map No. 3 because it falls along the lines of main streets and keeping community of interests in tact. She stated she is not opposed to Demographer Map 3b but noted that it has weird cut offs. Councilmember Peralta advocated for Demographer Map 5C because it keeps the La Merced area intact, gives South Montebello more representation at the Council level with an additional seat, and the ability to vote for an at large Mayor.

Mayor Pro Tem Jimenez thanked demographer and staff. She noted that Demographer Map 3b received a lot of traction from the community and most residents liked this map. She expressed her support for Demographer Map 3b and stated that she hoped to vote on this tonight.

Hello Honorable Mayor and City Council,
My name is Jose Madera, long time Montebello resident, and I represent the Madera household residents on 12th Street. I write in support of Demographer Map 3B.

This more than makes sense to me.

Thank you.

Subject: Public Comment Submission for Special Meeting 5/2/22 Hello City of Montebello,
I have been a longtime resident of Montebello, with my family having lived in the city for over 15 years.

I want to thank the city for all they have done in walking the community through this process of redistricting.

As someone who rents in the Via Altamira stretch, my needs are vastly different than that of homeowners within the city. After seeing the maps, I am in favor of Map 3B because it amplifies the voice of the renter by keeping the large cohort of apartment complexes within the same district. It brings me great peace of mind to know that my family and I will have the same representative as our extended family living in the Park Victoria Apartments.

I hope you approve of keeping renters together because it makes the most sense for us, the residents.

Respectfully,
Gilbert Juarez

Hello,
My name is Jesse Montes and I live on Holger Drive. I support Map 3B and I hope you do too because it brings representation to different parts of Montebello that many times were overshadowed by the busier parts of the city. We have five city elected’s responsible for hearing us out and listening to what we have to say and I think Map 3B gives everyone, no matter where you live in the city, a fair shot at being represented.

Thanks,
Jesse Montes

Subject: CVRA Public Comment
Good Evening,
I am submitting this public comment to express my full endorsement of a district map, that in my eyes, provides equity and equal representation of all Montebello residents.

I support the idea that similar communities within the city should be kept whole in districts and that there be one directly elected representative to be the voice and champion for that area. Map 3B provides the most proportioned segments of the city districts while keeping community interests intact.

I hope the city council will agree in further considering and adopting Map 3B tonight.

Thank You Kindly,
Valerie Cabral

As a longtime resident of Montebello I'm emailing today in regards to districting. I support map 3B because it provides the most equitable districts in all of the maps that were presented.

Staff did a good job with getting the message out there and by hosting all of the public hearings and open houses.

Thank you to the whole council for hearing our concerns and issues regarding this whole process.

Hello Mayor and Council,
I'm writing today in support of map 3B. The map looks like it'll provide the best from of representation. I also like the current form of government that we have here in the City of Montebello and to keep a rotational Mayor. Thank you to the council and staff for all your time in this!

Subject: Districting Public Comment for Special Meeting Members of the Montebello City Council,
My name is Dr. Alberto Pimentel Jr and I am submitting this public comment in support of Demographer Map 3B. Last year, my heart broke when only 4 of the 5 council members voted to transition to districting. My heart broke again when members of the AAPI community residing in Montebello shared their disappointment in the lack of direct communication with council members, many have felt that their voices continue to go unheard (except for election season).

I’ve spent months conversing with AAPI residents in North Montebello and other parts of the city and based on these conversations, the following has been shared consistently: many of our AAPI neighbors are offended by insensitive comments that have been made, the fact that some believe that one or two AAPI council members in Montebello’s long history are enough, and the heartbreaking reality that districting has become politicized. The nasty and intolerant comments that flood social media pages have minimized the relative absence of AAPI representation on the council. Along with my AAPI and non-AAPI neighbors, we are disheartened by the fact that we have observed social media posts, slogans, and gatherings that celebrate the AAPI community while at the same time, we’ve heard about reservations that some council members have and the subsequent delay to the adoption process. The AAPI community’s representation in Montebello is not a bargaining chip and if we are all truly committed to equity, diversity, and inclusion, then no one on the council should hold any reservations.

In speaking with AAPI neighbors, the issue is clear, you either stand with the AAPI community and support AAPI representation through districting, or you present a facade that is rooted in selfishness, self-preservation, and a level of comfort with exclusion. I cannot tell you how to vote today, but I will encourage all of you to respect the AAPI community and stand on the right side of history.

Peace and Love, Al

The Montebello-Pico Rivera Democrats are excited to support Demographer Map 3B. After a close examination of all of the initial and updated maps, we believe Map 3B adheres to the guidelines of the California Voting Rights Act and will empower the Asian American Pacific Islander community and create a pathway for greater AAPI representation on the city council.

Mayor and City Council:

The time and date of tonight's meeting was not communicated in advance of the 24-hour notice period. The posting of the agenda, very near the 24-hour notice deadline, was the first time I became aware of the details. Accordingly, I did not have the ability to provide proper Brown Act notice of attendance by teleconference to participate. Please excuse my absence this evening.

As comment on considering maps 3b, 3c, 5b and 5c, I would like to thank Mr. Thornton for being an advocate for the La Merced community and embodying the importance of public participation. From his comments, maps 5b and 5c were adjusted to ensure his community will not be divided. I would also like to thank our demographer, Mr. Gallegos, for making time to work with me on adjusting these two maps shortly after the April 23 public hearing, and with a quickly approaching deadline to submit and consider any map revisions.

I would also offer my concern for maps 3b and 3c. In these two maps, the southern alignment of District 1 along Lincoln Blvd. has been altered, among other changes. This alteration from the demographers original map places properties belonging to the mayor in the same district. As a reminder to my colleagues: maps should be drawn without respect to where an incumbent or candidate lives, may live, or may claim to live. I hope in this process council considers the best interest of the city over the next decade until lines are redrawn, not personal political motivations for the 2022 election.

Warm regards,
David N. Torres, Councilmember

Please have this submission given to them in time to read by each city council member before meeting! From Margot Eiser-resident address on file.

Please continue consideration of Demographer Map 5 B with the possibility of having one more district added to it! We the citizens people residents tax payers voters need to have more of a chance to communicate with and make sure that our supposed representatives will give us what WE need and wantbecause they live in our neighborhoods. For example, they would know what streets are actually dangerous and need repaving instead of having people who do not live here arbitrarily decide and needlessly spend money. We also need to have our PUBLIC GOLF COURSE returned to our control so it can benefit us! And eliminate no bid contracts.

P.S. All good people have got to come together and do all that is necessary to stop and get rid of the corrupted, crazy, cruel GOP and the vampire capitalists which support it!!! ---

2. PRESENTATION BY OUTSIDE COUNSEL AND DISCUSSION REGARDING THE RESULTS OF THIRD PARTY INVESTIGATOR’S FINDINGS ON COUNCILMEMBER TORRES’ CONDUCT Presentation was given by, Nancy P. Doumanian, Esq. Nancy Law Group/Doumanian & Associates, into the administrative investigation for City of Montebello of Council Member David Torres regarding his conduct. The presentation included an overview on the following: City Council members as elected officials and their behavior expectations; the #MeToo movement and how it has changed the work environment; workplace etiquette in today’s society; how other cities have handled Council Members who engage in harassing, hostile and retaliatory conduct towards city employees; potential liability to the City of Montebello; employers obligations under the law on hostile work environment and workplace harassment; and Councilmember Torres’ investigation findings.

Ms. Doumanian also presented the scope of the investigation, methodology, strategy, scope of the allegations, and assessing witness credibility. She then proceeded to present the findings of the 17 witnesses who came forward to testify to Councilmember Torres’ conduct and presented Councilmember Torres responses to the investigators.

Councilmember Melendez stated that today is not a discussion of Councilmember Torres’ character, but a plea from staff to stop this behavior. He also noted that he was disappointed in the lack of respect shown during this presentation and the mockery that was going on.

Councilmember Peralta expressed her disappointment by the presentation and spoke in favor of Councilmember Torres and commended his work as a Councilmember.

Councilmember Torres stated that he was not given a chance to present evidence during his investigation and encouraged City to release his emails and text messages with staff to the public because all communication was within his duties as Councilmember. He also noted that it was never his intent to cause any concern or harm May 3, 2022: Special City Council Meeting Minutes Page 3 of 3 and apologized for his behavior, but also acknowledged that everything he’s done has been in his scope as a Councilmember.

Mayor Pro Tem Jimenez asked for a 5 minute recess to make right decision. Council recessed and the Mayor reconvened the meeting at 9:08 p.m.

Councilmember Melendez addressed Councilmember Torres’ previous comments and commended him on his apology, stating that this is a step towards a healing process.

Councilmember asked City Manager and City Attorney to craft something and bring it back in a month to assure that Councilmember Torres will continue to have his first amendment rights as a Councilmember but also that there are procedures in place to remedy this situation and assure that employees are safe. Councilmember Melendez made a motion to have this come back in a month and have a deeper discussion at that time.

Councilmember Peralta expressed her concerns on why there aren’t procedures put into place internally with our HR department to serve our employees out of respect and their protection. She also noted that she would like the Fire Chief’s harassment claim against the Mayor to be addressed prior to any action taken tonight.

Mayor Pro Tem Jimenez seconded the motion made by Councilmember Melendez, asking that the City Council direct the City Manager and City Attorney to craft something and bring it back in a month to assure that Torres continue to have his First Amendment rights as a Councilmember but also that there are procedures in place to remedy this situation and assure that employees are safe.

Hello council.

Hope all are well, I wish I could be there but I’m sick so I hope this letter is read verbatim.

For the Map decision I hope that when voting residents are considered so they have representation. The new maps would leave me without a council person. As for including which map I hope it is map 2 so I can have Either Peralta representing me and other constituents. Other maps I’m either not having representation or Jeminez and from the last interaction with her, and her threats, I know I couldn’t work with her to better our community. 2nd point I would like to bring up is the MOU, residents and certain council spoke up to the point of having the old documents with the new before beginning negotiations. Now currently if you back up some will say it’s in bad faith. This is why before voting it is important to read documents in their entirety. I’m first for helping Fire and Police getting what is needed. How ever the current MOU minimum staffing for an engine, or minimum stations is being removed.  This is a danger to them and our community considered the apartment complex that caught fire. South side typically be the one most effected. Another section about being EMT certified and a 3% bump. Can it be reworded and just 3% across the board? I ask because minimum requirements from a academy you must have be certified EMT.   Can the section with staffing be held over and the rest approved. We resident fought for Measure M to keep our services local.

Thank you for your time
Sincerely
Will Cervera
