In making such determinations, consideration has been given to the fai r rental value of the improvements including but not limited to costs of operation, maintenance, taxes and insurance, the construction cost of the Project, the insured value thereof, the uses and purposes which may be served by the Project and the essentia l public benefits therefrom which will accrue to the City and the general public. During any Option Period(s), if an installment of Annual Fixed Rent is payable for a portion of a six-month period, the amount payable shall be a pro rata share of the instal lment of Annual Fixed Rent otherwise due.

18 28144059/204265.0002
equal to the original interest rate payable on the Bonds.

In cases of a transfer of title of Landlord’s leasehold interest in and to the Leased Premises, or Tenant’s transfer of its leasehold interest in and to the Leased Premises, such new owner or lessee shall execute and deliver an agreement whereby such new owner or lessee assumes and agrees to discharge a ll applicable obligations under this Lease.
