6 2.0 Introduction

Solid waste hauling in our City is divided into two categories: 1) Residential which includes dwellings of 3 or less units, and 2) Commercial, Businesses and Residential dwellings of 4 units or more. Our City has an exclusive franchise with Athens Disposal for hauling our residential sector. The Commercial portion is handled by the 12 remaining non-exclusive franchisees currently operating in the City.

The City is currently operating a total of 12,128 Residential Accounts. Of these accounts, 9,596 are single -family accounts, 2,464 are multi -family accounts (2-4 units), and 68 are other residential accounts. Based on the Commercial Haulers’ SRRP Reports, the city also counts with approximately 944 Current Commercial Accounts.

The State of California enacted the California Integrated Waste Management Act of 1989 Assembly Bill 939 (AB939), which stipulated that by the year 2000, 50% of all solid waste be diverted. The law addresses the commercial and industrial sector, as well as the residential sector wastes commonly associated with jurisdictional control. AB939 makes the local agency responsible for the entire waste stream generated within its boundaries.

The City would like all of our Solid Waste Haulers to integrate into the City’s overall diversion programs, including compliance with AB341, AB1826, SB1383, Ordinance 2445 which established Chapter 8.13 of the Montebello Municipal Code relating to Organic Waste Disposal Reduction, requirements set forth in Resolution 20 -97 establishing a diversion rate of 75% by December 31, 2021 which was extended administratively to December 31, 2023, and all other applicable state and City requirements.

The criteria for selection of a Solid Waste Management Consultant included experience, qualifications, and understanding of the scope of work in addition to price. We would also require costs breakout in the following categories:

a) Annual Report
b) Waste Reduction and Recycling Program Implementation c) Residential Franchise Agreement Implementation Assistance d) Commercial Hauler Technical Assistance
e) Hauler Audits
f) Evaluation of Commercial Solid Waste Hauler Program
g) CA Beverage Container Recycling Program Administration h) Used Oil Payment Program Administration
i) Additional Tasks

Page 444 of 558 ends

7 Item I identified "Additional Tasks". These other services are available at the City's discretion which can include grant research, diversion studies, workshops and other recycling programs, to name a few.

ITEM # 28

CITY OF MONTEBELLO

CITY COUNCIL AGENDA STAFF REPORT

TO: Honorable Mayor and City Council Members

FROM: Raul Alvarez, City Manager

BY: Ramon Figueroa, Director of Human Resources

SUBJECT: ADOPT RESOLUTION NO. 24-30 APPROVING A MEMORANDUM OF

UNDERSTANDING (MOU) BETWEEN THE CITY OF MONTEBELLO

AND THE INTERNATIONAL ASSOCIATION OF SHEET METAL, AIR,
RAIL, AND TRANSPORTATION WORKERS – TRANSPORTATION

DIVISION (SMART-TD)

DATE: May 8, 2024

RECOMMENDATION(S):

It is recommended that the City Council:

1. Adopt Resolution No. 24-30 approving a Memorandum of Understanding (MOU) between the City of Montebello and the International Association of Sheet Metal, Air, Rail, and Transportation Workers – Transportation Division (SMART-TD); and,

2. Take such additional, related action that may be desirable.

FISCAL IMPACT:

The Fiscal Year 2023-24 budget was built utilizing the updated salary ranges, with estimated increases to base salaries for each classification exclusively represented by SMART-TD, for the purpose of meeting and conferring over wages, hours, and terms and conditions of employment. Staff have costed the various wage and related changes in the proposed MOU (Attachment B), with salary range adjustments and one-time incentive and bonus pays representing the primary costs of the proposed MOU. It is estimated that the full-year cost of the salary range adjustments will be approximately $850,000 -- this estimate includes the two percent (2%) cost of living adjustment in July, 2024. The "incentive buy-out" and "signing bonus" one-time pays represent another $198,000 in expenses.

The FY 2024-25 budget will be built utilizing the new salary ranges, as well as provide sufficient funding for certain other adjustments contained in the MOU such as

Page 457 of 558 ends

CITY COUNCIL AGENDA REPORT - MEETING OF MAY 8, 2024

Page 2 of 3 ends

"certification pay" and increases to the "uniform allowance." No budget adjustment is needed for FY 2023-24 in order to implement the proposed MOU.

BACKGROUND/DISCUSSION:

In FY 2020-21, the City conducted a Classification and Compensation Study (Class and Comp study) to review salary and benefits for all full-time job classifications. Each job classification was compared to an agreed upon comparator group comprised of seventeen (17) similar cities. In Summer 2021, the results were presented to the City Council and shared with all employee groups, with numerous town hall meetings held to explain the study and its conclusions. Using the comparator group of similar cities as the defined market, the study concluded that 83% of the City's job classifications' base pay were more than 5% behind the market, with no position more than 5% ahead of market.

The City has ten (10) separate and distinct employee groups, with nine of the employee groups having a comprehensive MOU that governs salary, benefits, and other aspects of employment (approved since Spring, 2022). The intent of the Class and Comp study was to determine a path forward for labor negotiations that would bring all salary ranges closer to market within three (3) years. In addition, the study created a comprehensive salary schedule with defined ranges and steps for the first time in the City’s history.

The City worked diligently to update MOU provisions that align with new points of agreement and remove any language that was unclear or antiquated to create administrative efficiency and improve internal equity for all employee groups. Moreover, by implementing comprehensive MOUs, the City is better positioned to recruit and retain the most qualified and dedicated employees for all full-time job classifications, including SMART-TD classifications. By standardizing MOU language across all employee groups, it is appropriate to create a comprehensive MOU for the SMART-TD members that includes standard language for wages, hours, terms and conditions of employment, and other “boilerplate” clauses found in the nine (9) MOUs approved by the City Council with each respective employee association.

The City met with SMART-TD board members from December 2021 through October 2023, to discuss proposals for a comprehensive MOU. SMART-TD was provided time to review the proposed MOU and identify questions for clarification and/or craft a counterproposal, with subsequent discussions held to analyze each proposal and counterproposal. In June 2022 and October 2023, an impasse was declared on comprehensive MOU labor negotiations.

ANALYSIS:

On March 29, 2024, the City proactively began impasse resolution meetings with SMART-TD to help facilitate discussion and guide both parties toward a mutually acceptable MOU. By implementing comprehensive MOUs, the City is better positioned

to recruit and retain the most qualified and resolute employees for all full-time equivalent classifications, including SMART-TD classifications (e.g., Bus Operator and Equipment Mechanic A). As a full-service organization, the City depends on the experience, knowledge, and skills of SMART-TD – individually and collectively – to provide superior transportation service to Montebello and the surrounding communities.

On April 12, 2024, the City and SMART-TD held a subsequent impasse resolution meeting and tentatively agreed to a comprehensive MOU. Relevant provisions included in the MOU are as follows:

• Salary increases in accordance with the Classification and Compensation Study (i.e., placing all represented classifications on the appropriate citywide salary schedule)
• Uniform Allowance increases
• One-time signing bonus
• Incentive buy-out bonus
• Creation of Vacation, Sick, and Holiday Leave Accrual Banks

The MOU will be effective upon ratification on May 8, 2024 and run through June 30, 2025.

SUMMARY:

Staff recommends that the City Council adopt Resolution No. 24-30 (Attachment A) approving an MOU between the City and SMART-TD. The term of the MOU would be: upon ratification on May 8, 2024 through June 30, 2025 (Attachment B). Staff have costed the various salary adjustments and one-time bonuses and have determined the Fiscal Year 2023-24 budget includes sufficient funding for these increases. The FY 2024-25 budget will be developed to include sufficient funding for the updated salary ranges as well as other incentives (i.e., uniform allowance) which have been increased and adjusted.
