CITY OF MONTEBELLO
CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Raul Alvarez, City Manager
BY: Ramon Figueroa, Director of Human Resources
SUBJECT: APPROVE PROFESSIONAL SERVICES AGREEMENT NO. 4228 WITH ADMINSURE FOR WORKERS’ COMPENSATION THIRD-PARTY
ADMINISTRATION SERVICES
DATE: October 9, 2024
RECOMMENDATIONS:
It is recommended that the City Council:
1. Approve Professional Services Agreement No. 4228 with AdminSure Inc. in the amount that shall not exceed $880,798 over the initial three (3) year term of the agreement; and
2. Take such additional, related action(s) that may be desirable.
FISCAL IMPACT:
Professional Services Agreement No. 4228 with AdminSure Inc. has an initial three (3) year term and includes two (2), one (1) year extension options. If needed, the City Manager will have the authority to increase the yearly expenditure amount by up to $5,000 annually for the duration of the agreement. The total maximum compensation shall not exceed $880,798.
Sufficient funds for this expenditure were budgeted as part of the Fiscal Year 2024-25 budget in Account No. 700-99-6040.11 (Self Insurance Fund - Non-Departmental - Contract Services - Workers Compensation - General). Subsequent fiscal years will include sufficient funding for these services.
BACKGROUND/DISCUSSION:
The City of Montebello operates as a self-insured entity. The City assumes the financial

risk of covering potential liabilities rather than purchasing insurance from an external carrier. This approach allows the City more control over insurance premium costs and the ability to tailor coverage to its specific needs. This approach also allows for potentially reduced costs over time. The City utilizes third-party administrator (TPA) firms to assist with general liability and workers compensation claims and related tasks. The recommended action would approve an agreement with a TPA (i.e., AdminSure)
On Thursday, February 29, 2024, the City issued Request for Proposals (“RFP”) No. 24- 13 for Workers’ Compensation Third Party Administration Services. The RFP was posted on PlanetBids, and notices were submitted to multiple vendors via PlanetBids. The RFP closed on Thursday, April 4, 2024, with seven (7) responses. Bidders provided pricing based on the City’s projected annual consumption of the required services. The following is a list of bidders who responded and their locations (In alphabetical order):
• AdminSure Inc. - Ontario, CA
• Athens Administrators - Concord, CA
• CorVel Corporation - Irvine, CA
• Innovative Claim Solutions – San Ramon, CA
• Intercare Holdings Insurance Services Inc. - Glendale, CA • LWP Claims Solutions Inc. - Mill Valley, CA
• TRISTAR Claims Management Services Inc. - Long Beach, CA
After receiving the responses to the RFP, an evaluation committee was formed to review each proposal submission. The evaluation committee consisted of staff in the Human Resources and Finance Departments. The responses were evaluated based on the following criteria:
• Qualifications (40 points)
• Reputation/Reference Checks (30 points)
• Proposed Fees (30 points)
Upon completing the evaluations of the proposals, the evaluation committee interviewed the top four (4) bidders (based on scoring): AdminSure Inc., CorVel Corporation, Intercare Holdings Insurance Services Inc., and TRISTAR Claims Management Services Inc. Staff recommends awarding an agreement to AdminSure Inc.

RECOMMENDATIONS:
It is recommended that the City Council:
1. Authorize the City Manager to execute side letters of agreement to the Memoranda of Understanding (“MOU”) between the City of Montebello and each of the following employee bargaining units: Montebello City Employees’ Association (“MCEA”); International Association of Sheet Metal, Air, Rail and Transportation Workers – Transportation Division (“SMART-TD”); Montebello Mid- Managers’ Association (“MMMA”); Montebello Supervisors’ Association (“MSA”); Montebello Management Professionals’ Association (“MMPA”); Montebello Police Management Association (“MPMA”); Montebello Firefighters’ Association (“MFA”); Montebello Fire Management Association (“MFMA”); and Montebello Executive Management Association (“MEMA”) modifying City healthcare benefits contribution amounts; and
2. Take such additional, related action that may be desirable.
CITY COUNCIL AGENDA REPORT - MEETING OF OCTOBER 9, 2024
FISCAL IMPACT:
The City’s benefits broker, Nava Benefits, was directed to initiate a Request for Proposal (RFP) process to explore the possibility of finding employee health plan providers that would offer insurance at a savings when compared to CalPERS. Nava Benefits issued the RFP in March 2024 in order to “test the market.” Initial estimates by Nava indicated a potential $400,000 in annual savings in health care expenses. The goal of the RFP process would be to utilize any savings towards increasing the employer contribution towards employee health care premiums
The results of the RFP did not find savings, with the proposals indicating health care costs exceeding those of CalPERS. Staff presented these findings to the City Council in several closed session meetings. Since the City’s contribution towards employee health benefit premiums has not increased since 2008, Staff was determined to find a solution to the increased cost of health benefits impacting employees.
Staff recommended, and received City Council approval, to increase the City’s monthly contribution towards employee health care premiums by $360/month for 2-party and $560/month for Family (3 party+) plans. The annual (12 month), citywide estimated cost of these increases is $773,000. Given the composition of the City’s workforce, 41% of health insurance expenses are borne by the Transit Fund (for Transit Department employees). The remaining 59% is General Fund expenditures.
Health Care premium changes occur January 1 of each year. Therefore, the Fiscal Year 2024-25 estimated cost of increasing the City’s contribution towards employee health care premiums is $386,000 – six months, January 2025 through June 2025. This equates to an estimated $228,000 increase in General Fund related health insurance expenses, with the remaining additional expenses recorded in the Transit Fund.
BACKGROUND/DISCUSSION:
In March 2024, the City authorized its benefits broker, Nava Benefits, to initiate a Request for Proposal (“RFP”) process to explore alternative medical insurance plans outside of medical plans under the Public Employees’ Medical and Hospital Care Act (“PEMHCA”), commonly referred to as CalPERS Medical, which the City has utilized since the 1980s.
The aim was to explore benefits for City employees and retirees that mirrored the design of PEMHCA plans, while limiting options to two (2) Health Maintenance Organization (“HMO”) plans and two (2) Preferred Provider Organization (“PPO”) plans.
The goal of this RFP process was to find insurance providers who could offer health insurance plans for less than what CalPERS was charging. In other words, find insurance providers who would offer cost savings to the City. In turn, these cost savings would be applied towards the employer contribution towards employee health – lower the monthly cost of health insurance for the City’s employees.
The responses obtained through the RFP process were limited and offered rates that did not present savings when compared to CalPERS. The City determined that the best
CITY COUNCIL AGENDA REPORT - MEETING OF OCTOBER 9, 2024
course of action was to continue with CalPERS medical plans.
The City’s employer healthcare contribution amounts have not been adjusted since 2008, leading to a widening disparity between the City’s offerings and those of neighboring municipalities. According to the City’s Classification and Total Compensation Study completed in 2021, the surveyed agencies’ average employer contribution toward family medical insurance plans was approximately $1,600 per month.
Rising healthcare costs have impacted employees’ net income. To address this issue, staff proposes increasing the City’s monthly contribution for 2-Party Health Insurance for full-time employees by an additional $360, raising the total contribution to $1,200 per month. For Family (3 Party+) Health Insurance, staff proposes a monthly increase of $560, resulting in a total contribution of $1,650 per month. No changes are proposed for the 1-Party contribution or the medical insurance opt-out incentive. The proposed contribution increases are intended to take effect with the first paycheck in January 2025, aligning with the 2025 CalPERS medical premium adjustments.
Staff met and conferred with representatives from each affected bargaining unit to discuss the proposed increases to the City’s medical insurance contributions towards employee health plan costs. The bargaining groups agreed to the proposed increased contributions and expressed gratitude for the City’s willingness to address the issue. The goal of the proposed increases is to provide competitive healthcare contributions to meet the needs of employees and their families in a fiscally responsible manner.

SUMMARY:
Premiums under CalPERS medical have been increasing annually by approximately 5% to 12%, while the City’s contributions for 2-Party and Family (3-Party+) coverage have not changed since 2008. Staff recommends the City Council’s approval of the side letters of agreement (see Attachments A through I) to provide the proposed increased healthcare contributions to support the well-being of employees and their families, enhance workforce stability, and maintain competitiveness in recruitment efforts.

CITY OF MONTEBELLO
CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Raul Alvarez, City Manager
BY: Ramon Figueroa, Director of Human Resources
SUBJECT: SIDE LETTER OF AGREEMENT TO THE MEMORANDUM OF
UNDERSTANDING (MOU) BETWEEN THE CITY OF MONTEBELLO
AND THE MONTEBELLO FIREFIGHTERS’ ASSOCIATION
DATE: October 9, 2024
RECOMMENDATIONS:
It is recommended that the City Council:
1. Authorize the City Manager to execute a side letter of agreement to the Memorandum of Understanding (MOU) between the City of Montebello and the Montebello Firefighters’ Association (MFA) for the period of January 1, 2022 through June 30, 2025, modifying Article II, Section B of the MOU; and
2. Take such additional, related action that may be desirable.
FISCAL IMPACT:
Estimating a fiscal impact to the proposed side letter is complicated. The side letter language proposes temporary upgrade pay of seven percent (7%) for employees in the Fire Engineer and Fire Captain job classifications when temporarily serving in the role of radio function paramedic or patient care paramedic. Currently, Montebello Firefighters’ Association (MFA) employees in those job classifications with a paramedic certification receive eight percent (8%) of base pay – compensation for having/keeping a paramedic license.
The proposed side letter would grant the additional seven percent (7%) special pay – for a total of 15% of base pay for serving as a paramedic – only when a Fire Engineer or Fire Captain is temporarily assigned to the role of paramedic.
Accurate costing of this scenario depends on the need for such a temporary assignment
CITY COUNCIL AGENDA REPORT - MEETING OF OCTOBER 9, 2024
in any given shift. The Fire Department has made positive strides in filling vacancies in all public safety classifications. As recruitments continue, and vacancies are reduced, the need for a Fire Captain or Fire Engineer to assume the temporary role of a paramedic will similarly reduce.
Conservative, high-end estimates of the cost of the additional seven percent are in the range of $225,000 per year. However, that is based on the assumption that all Fire Captains and all Fire Engineers with a current paramedic license would receive the temporary upgrade pay. A more likely scenario is only a portion of existing Fire Captains and Fire Engineers would be required to assume the temporary paramedic assignment, bringing the annual estimated cost of the additional paramedic pay in the range of $57,000 to $114,000 per fiscal year.
Should this side letter be approved, staff will monitor any changes to salaries in the Fire Department related to the temporary upgrade pay. If necessary, budget amendments will be recommended at subsequent budget updates.
BACKGROUND/DISCUSSION:
On May 11, 2022, the City Council approved a Memorandum of Understanding (“MOU”) between the City of Montebello and the Montebello Firefighters’ Association (“MFA”) for the term of January 1, 2022 through June 30, 2025. Article I, Section D of the MOU states that the parties may mutually and voluntarily agree to negotiate over matters within the scope of the MOU during the term of the agreement.
The parties mutually agreed to meet and confer regarding employees in certain classifications assigned by the Fire Department to temporary upgrade assignments due to daily fluctuations in staffing levels. Staffing levels may vary on a daily basis due to employees on leaves of absence, calling in sick, vacation, etc. The parties tentatively agreed to the terms in the side letter of agreement to the MOU.
The tentatively agreed to language would modify Article II, Section B of the MOU to provide qualified employees in the classifications of Fire Engineer and Fire Captain to receive temporary upgrade pay of seven percent (7%) for the hours they are assigned to work in an upgraded position of either a radio function paramedic or patient care paramedic. Employees who are working in those upgraded functions are critical to the operations of the Fire Department, and the temporary upgrade pay would provide fair compensation for those qualified employees with paramedic licenses who temporarily work in those specialized assignments.

1. Seek council consensus to have the City Manager return back to the City Council with the cost of establishing a substation at Holifield.
2. Regarding the efforts for the DePaul Center historical preservation, I’d like to ask to give staff direction to return back to City Council with impacts to the housing element and general plan.
3. Requesting a staff report on how much the annual maintenance will be for the new dog park.
1. City Manager Alvarez advised no action was needed as it was being considered for the next budget. Mayor Peralta added that the Council had already agreed to allocate funds for a substation in next year’s budget. City Manager Alvarez further explained that determining the cost involves many factors and will take time. Mayor Pro Tem Melendez requested an update on the cost assessment process, to which City Manager Alvarez responded that a brief status update would be provided during the mid-budget presentation.
2. City Manager Alvarez stated that the historical designation does not impact the General Plan or Housing Element. The property in question is still considered an R-1, single-family residence. The General Plan land use designation for the DePaul Center civic/public/quasi-public in operation civic building and spaces remains the same. As for the Housing Element, identified the DePaul Center as a housing opportunity site, it does not mandate housing development but merely shows potential for housing with densities ranging from 40–60 units per acre. In addition, the plan contemplated a space to be dedicated to open space. City Attorney Noel Tapia recommended that the City post the information on the City's website.
3. City Manager Alvarez stated that no additional maintenance is required. • Georgina Tamayo, Councilmember
• David N. Torres, Councilmember
1. Requesting council consensus directing the City Manager and Chief of Police to redraw police beats so patrol units are dedicated to areas South of the Union Pacific Railway i.e. railroad tracks near Olympic Blvd.
The City Clerk’s Office acknowledged one(1) member of the public wishing to address the City Council. Speaker was provided three minutes to address the City Council and said speaker card is on file at the City Clerk’s office.
Councilmember Torres requested Council consensus to direct the City Manager and Chief of Police to redraw police beats so patrol units are dedicated to areas South of the Union Pacific Railway such as the railroad tracks near Olympic Boulevard. Consensus was rceieved.
