CITY OF MONTEBELLO
CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Raul Alvarez, City Manager
BY: Cesar Roldan, Director of Public Works
SUBJECT: ACCEPTANCE OF THE MONTEBELLO CITY PARK BASEBALL FIELD RENOVATION PROJECT (CP NO. 928) – NOTICE OF COMPLETION
DATE: February 26, 2025
RECOMMENDATIONS:
It is recommended that the City Council:
1. Accept the Montebello City Park Baseball Field Renovation Project (CP No. 928) as completed by California Landscape & Design; and
2. Approve the final contract amount with California Landscape & Design for the construction of the Project in the amount of $969,068 including change orders; and
3. Approve the Final Total Project Budget (Attachment A); and
4. Authorize the City Clerk to execute, verify and file the Notice of Completion (Attachment B) with the Los Angeles County Registrar-Recorder; and
5. Authorize the release of the retention payment of $48,453 due to California Landscape & Design following the mandatory waiting period from the date the Notice of Completion is recorded; and
6. Take such additional, related action that may be desirable.
FISCAL IMPACT:
The final project budget (Attachment A) includes the City Council’s previously approved budget amount of $839,876 for California Landscape & Design and outlines the total project expenditures of $969,068 -- which includes Change Orders #1 through #5. While the additional work exceeded the initial budget, it was necessary to address critical issues discovered once the project commenced.
The deteriorating twelve-foot chain-link fence was replaced to enhance and ensure safety
CITY COUNCIL AGENDA REPORT - MEETING OF FEBRUARY 26, 2025
during recreational use. The brittle irrigation system, which was leaking and lacked sufficient pressure to maintain the field, required replacement and repairs. Additionally, the existing concrete had to be demolished and poured to ensure compliance with the Americans with Disabilities Act (ADA). Lastly, chain-link fence gates were added to the baseball field dugouts for security.
To fund the project, staff allocated $451,150 in Measure A funds (Account No. 221-70- 720-6040.10, Measure A Local Parks & Recreation, Park Maintenance, Other Contract Services), $100,000 in Transportation Development Act (TDA) funds (Account No. 223- 99-7116, TDA Article 3, Improvements Other Than Building), and $288,725 in General Fund appropriations (Account No. 100-70-710-6040.10, General Fund, Parks & Recreation, Other Contract Services) -- $839,876 in total funding. The change orders required an additional $129,192 in funding to complete the project. Staff identified $79,192 in additional Measure A funding and $50,000 in General Fund appropriations to realize the closeout of the Montebello City Park Baseball Field Renovation Project (Attachment A). A budget amendment will not be required as staff had already allocated funds in the Fiscal Year 2024-25 budget that will not be spent and can be allocated to this project.
BACKGROUND/DISCUSSION:
On September 11, 2024, the City Council approved a $799,882 construction contract with California Landscape & Design. Additionally, City Council authorized the Director of Public Works to review and approve change orders within a 5% contingency ($39,994), bringing the total not-to-exceed project budget to $839,876 for the Montebello City Park Baseball Field Renovation Project (CP No. 928). As described above, additional change orders brought the total project cost to $969,068.
This project enhances safety and accessibility at the Montebello City Park baseball field through vital improvements. It revitalized the area by renovating the infield and outfield surfaces and replacing the dugouts, bleachers, irrigation systems, and fencing. The project was deemed to be substantially completed on February 18, 2025. The Construction Manager who was overseeing and inspecting the project determined that the project was completed satisfactorily and in compliance with the contract specifications.
It is recommended that the City Council accept the project as satisfactory and complete pursuant to Civil Code Section 3093. Upon acceptance of the project, staff will file the “Notice of Completion” with the Los Angeles County Recorder’s Office. Thirty-five (35) days after the recordation of the Notice of Completion by the LA County Recorder’s Office, the City will release all applicable bonds and the retention if no Stop Notices are filed.

DO NOT RECORD
REQUIREMENTS AS TO NOTICE OF COMPLETION
A notice of completion must be filed for record WITHIN 10 DAYS after completion of the work of improvement (to be computed exclusive of the day of completion), as provided in Civil Code Section 3093.
The “owner” who must file for record a notice of completion of a building or other work of improvement means the owner (or his successor in-interest at the date the notice is filed) on whose behalf the work was done, though his ownership is less than the fee title.
For example, if A is the owner in fee, and B, lessee under a lease, causes a building to be constructed, then B, or whoever has succeeded to his interest at the date the notice is filed, must file the notice.
If the ownership is in two or more persons as joint tenants or tenants is common, the notice may be signed by any one of the co-owners (in fact, the foregoing form is designed for giving of the notice by only one cotenant), but the names and addresses of the other co-owners must be stated in paragraph 5 of the form.
Note that any Notice of Completion signed by a successor in interest shall recite the names and addresses of his transferor or transferors.
In paragraphs 3, 5 and 6, the full address called for should include street number, city, county and state.
As to paragraphs 7 and 8, this form should be used only where the notice of completion covers the work of improvement as a whole. If the notice is to be given only of completion of a particular contract, where the work of improvement is made pursuant to two or more original contracts, then this form must be modified as follows: (1) Strike the words “A work of improvement” from paragraph 6 and insert a general statement of the kind of work done or materials furnished pursuant to such contract (e.g., “The foundations for the improvements”); (2) Insert the name of the contractor under the particular contract in paragraph 7.
In paragraph 8 of the notice, insert the name of the contractor for the work of improvement as a whole. No contractor’s name need be given if there is no general contractor, e.g., on so-called “owner-builder jobs.”
In paragraph 9, insert the full, legal description, not merely a street address or tax description. Refer to deed or policy of title insurance. If the space provided for description is not sufficient, a rider may be attached.
In paragraph 10, show the street address, if any, assigned to the property by any competent public or governmental authority.
This standard form covers most usual problems in the field indicated. Before you sign, read it, fill in all blanks, and make changes proper to your transaction. Consult a lawyer if you doubt the form’s fitness for your purpose.

CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Raul Alvarez, City Manager
BY: John Soria, Director
SUBJECT: APPROVE AMENDMENT NO. 1 TO PROFESSIONAL SERVICE AGREEMENT NO. 4180 WITH KIMLEY-HORN AND ASSOCIATES, INC.
TO EXTEND THE COMPLETION DATE FOR BUS STOP
IMPROVEMENT PROJECT CONSULTING SERVICES
DATE: February 26, 2025
RECOMMENDATIONS:
It is recommended that the City Council:
1. Approve Amendment No. 1 to Professional Services Agreement No. 4180 (Agreement No. 4180) with Kimley-Horn and Associates, Inc. (Kimley-Horn & Assoc.), to extend the completion date for Bus Stop Improvement Project (BSIP) Consulting Services; and
2. Authorize the City Manager and/or his designee to execute Amendment No. 1 on behalf of the City of Montebello (City); and
3. Take such additional, related action that may be desirable.
FISCAL IMPACT:
The recommended actions do not have a fiscal impact.
BACKGROUND/DISCUSSION:
On February 28, 2024, the City entered into Agreement No. 4180 (Attachment A) with Kimley-Horn & Assoc. to provide the City with Bus Stop Improvement Project (BSIP) Consulting Services. Kimley-Horn & Assoc. is providing an in-depth analysis of Montebello Bus Lines’ (MBL) bus stop infrastructure. This entails conducting a comprehensive survey and inventory of all bus stops within MBL’s transit system, while also providing design and amenity recommendations for potential improvements and
CITY COUNCIL AGENDA REPORT - MEETING OF FEBRUARY 26, 2025
associated costs.
The agreement’s initial term was for one (1) year, ending February 28, 2025. The BSIP includes a comprehensive summary of existing amenity conditions, Title VI methodology, and a demographic analysis across MBL’s system. It also features several custom bus stop typologies, and a section recommending amenity improvements based on the consultant’s analysis. Kimley-Horn & Assoc. structured the project around five (5) key tasks, each marking significant milestones within the project, as follows:
• Task 1: Bus Shelter Inventory
• Task 2: Design Recommendations
• Task 3: Amenity Recommendations
• Task 4: Bus Stop Assessment for BSIP
• Task 5: Plan and Design Development for Construction
Kimley-Horn & Assoc. provided the City with exceptional service throughout this period.
Over the past year, they have completed Tasks 1 – 2, and portions of Task 3. Task 1 consisted of providing MBL with an existing conditions assessment, and analyzing and categorizing current bus stops. This information was placed into a Geographic Information System (GIS) to better visualize and manage the data gathered by field surveyors. Task 2 involved utilizing the data from Task 1 to develop bus stop design standards that integrate into the current fixed route system. Currently, the consultant is working on Task 3, which will offer citywide bus stop enhancement recommendations tailored to each individual stop.
On February 4, 2025, Kimberly-Horn & Assoc. requested a no-cost contract extension (Attachment B) to properly execute the remaining tasks. This will ensure that MBL has a cemented bus shelter build-out plan in place that keeps MBL dedicated to providing superior transportation services. It is recommended that the City Council approve Amendment No. 1 (Attachment C) to Agreement No. 4180. Amendment No. 1 will exercise the option to extend the agreement for an additional four (4) months from February 28, 2025, to June 30, 2025, and ensure the continuity of service for BSIP Consulting Services.

2. Authorize the Director of Recreation and Community Services to conduct all negotiations and execute and submit documents reasonably-necessary for the completion of the awarded project; and
3. Take such additional, related action that may be desirable.
FISCAL IMPACT:
The Outdoor Recreation Legacy Partnership ("ORLP") Grant Program is made available through the National Park Service. Round 8 of the program is currently accepting applications for park acquisition, park development, or park renovations. The City of Montebello would be required to provide a funding match amount of 50% of the total project cost. Staff is estimating the cost of the project to be $1,000,000, thus requiring a possible City match of at least $500,000. All non-federal (state, local, or private) sources are eligible for matching funds. Staff plan to maximize the usage of the City's Measure A Annual Allocation funds towards the required match -- with the possibility that all $500,000 in matching funds could come from Measure A. The goal of finding matching funds will be to utilize a funding source other than the General Fund. Staff will return with a detailed plan to fund the required match and/or request to amend the budget if the grant application is successful.
CITY COUNCIL AGENDA REPORT - MEETING OF FEBRUARY 26, 2025
BACKGROUND/DISCUSSION:
The ORLP Grant Program was established in 2014 and is funded through the Land and Water Conservation Fund. The program is administered through the National Park Service and involves two competitive layers. First, the California Department of Parks and Recreation's Office of Grants and Local Services ("OGALS") competitively reviews applications. Second, OGALS forwards selected applications to the National Park Service to compete in the nationwide competition.
The ORLP Grant Program aims to provide grant assistance to help economically disadvantaged urban communities with limited access to publicly available, close-by, outdoor recreation. ORLP funds can be used for the acquisition or development of new parks, or substantial renovations of an existing park.
Staff is proposing improvements to Reggie Rodriguez Park. Reggie Rodriguez Park is located in a census tract that is identified as a disadvantaged community by CalEPA's SB 535 Disadvantaged Communities tool. Therefore, the location qualifies as an eligible project for this grant program. The project proposal will include installation of a multi- purpose baseball and soccer field on the east side of the park in addition to renovation of existing basketball courts to allow for multi-purpose sports courts. Proposed improvements will additionally include lighting, irrigation, and landscaping.
The Reggie Rodriguez Park Specific Plan was developed as a part of the City's Parks Master Plan. The Specific Plan was developed utilizing community input and includes the recommendation to install a multi-purpose baseball and soccer field. There are currently no designated soccer fields at Reggie Rodriguez Park. The proposed project will allow for growth of current City programs and better accommodate the needs of the Community's Youth Sports Organizations.
Public outreach meetings and surveys completed for the Reggie Rodriguez Park Specific Plan as part of the Park Master Plan process fulfill the requirements of the grant for community outreach and improve the City's chances of being awarded this grant. The development of the Parks Master Plan and Specific Plan included outreach in the form of stakeholder/user group interviews, workshops, and surveys. Four virtual workshops were held, with one workshop focusing specifically on the Specific Plan development. Additionally, a statistically valid survey was mailed out to Montebello residents, an amenities survey was made available online to the public, and a survey specifically for Reggie Rodriguez Park was made available online to the public. Feedback received from all outreach efforts was taken into consideration for the development of the Reggie Rodriguez Pak Site Specific Plan which makes recommendations to install a multi-purpose baseball and soccer field, as well as renovation of the existing basketball courts.

FROM: Raul Alvarez, City Manager
BY: David Sosnowski, Director of Recreation and Community Services
SUBJECT: AUTHORIZATION TO SUBMIT AN APPLICATION FOR THE LA84
FOUNDATION GRANT PROGRAM
DATE: February 26, 2025
RECOMMENDATIONS:
It is recommended that the City Council:
1. Authorize the submission of an application for the LA84 Foundation Grant Program on behalf of the City of Montebello; and
2. Authorize the Director of Recreation and Community Services to conduct all negotiations and execute and submit documents reasonably-necessary for the completion of the awarded program; and
3. Take such additional, related action that may be desirable.
FISCAL IMPACT:
The LA84 Foundation currently has a competitive grant opportunity for learn to swim programming. The City of Montebello could potentially receive up to $15,000 in funding for the City’s aquatics program. The grant does not require any matching funds and would provide registration discounts for swimming lessons to the community.
BACKGROUND/DISCUSSION:
The LA84 Foundation aims to provide every Southern California child the opportunity to learn to swim. The goal of the program is to partner with swim lesson providers and water safety advocates across Southern California to support swimming lessons and educate children and their families on the importance of water safety and the value of learning to swim. The grants being offered are intended to augment existing programming.
CITY COUNCIL AGENDA REPORT - MEETING OF FEBRUARY 26, 2025
The City currently offers aquatics programming in the summer months at the George Hensel Aquatic Center. This includes swim lessons which are offered to all ages at varying skill levels. Lessons are available for morning and evening sessions. Through grant funding, the City aims to make swim lessons more easily accessible to the community by providing Level 1 and Level 2 swim lessons at a discounted rate of $25.00. Swim lessons are normally offered for a rate of $50.00.
In 2023, the City received $7,500 in grant funding from the LA84 Foundation. These funds provided 300 registration discounts to swim lesson participants. In 2024, the City received $10,000 in grant funding and provided 400 registration discounts to swim lesson participants. For the 2025 summer season, the City plans to request $15,000 in grant funding from the LA84 Foundation. This would potentially provide 600 registration discounts.

SUBJECT: APPROVE INCREASING THE TOTAL NOT-TO-EXCEED AMOUNT FOR
BLANKET PURCHASE ORDERS ESTABLISHED WITH WAYNE
ELECTRIC COMPANY, AFTERMARKET PARTS COMPANY, LLC, AND
DARTCO TRANSMISSION SALES & SERVICES INC
DATE: February 26, 2025
RECOMMENDATIONS:
It is recommended that the City Council:
1. Approve an increase to the total not-to-exceed amount, from $60,000 to $80,000, for a blanket purchase order (PO) with Wayne Electric Company (Wayne Electric), to purchase maintenance-related bus parts, for Fiscal Year 2024-25; and
2. Approve an increase to the total not-to-exceed-amount, from $200,000 to $385,000, for a blanket PO with Aftermarket Parts Company, LLC (Aftermarket Parts), to purchase maintenance-related bus parts, for FY 2024-25; and
3. Approve an increase to the total not-to-exceed-amount, from $49,000 to $70,000, for a blanket PO with Dartco Transmission Sales and Service inc. (Dartco), to purchase maintenance-related bus parts, for FY 2024-2025; and
4. Take such additional, related, action that may be desirable.
FISCAL IMPACT:
Sufficient funds are appropriated in the Transit Department's Fiscal Year 2024-25 adopted operating budget. Therefore, a budget amendment is not required as part of the recommended actions to increase not-to-exceed amounts for various blanket purchase orders. The table below details the allocated amounts and corresponding accounts for the purchase orders:
CITY COUNCIL AGENDA REPORT - MEETING OF FEBRUARY 26, 2025
BACKGROUND/DISCUSSION:
On July 24, 2024, the City Council approved establishing blanket purchase orders (PO) with Wayne Electric and Aftermarket Parts (Attachment A). These PO’s were established in accordance with Montebello Municipal Code (MMC) Section 3.20.050 – Conformance with bidding procedures, which outlines exceptions to the standard bidding and procurement procedures. Wayne Electric and Aftermarket Parts have been identified as direct or subcontracted suppliers of specific maintenance-related, original equipment manufacturer (OEM) parts, compatible with the Montebello Bus Lines’ (MBL) fleet of transit buses. In addition, staff conducted an informal quote process for bus transmissions to establish a blanket PO with Dartco under the City Manager’s purchasing authority (Attachment B).
Purchases from these vendors include, but are not limited to, maintenance-related parts as follows:
• Wayne Electric Company: EMP alternators, air conditioning compressors, toggle switches, fan drivers, farebox motors, pumps, and filters • Aftermarket Parts: headlights, fan control modules, clamps, windshield wipers, coolants, airbags, clutches, stabilizers, and thrust washers. • Dartco: bus transmissions
Moving into the latter half of the fiscal year, Transit maintenance is experiencing a steady increase in the demand for additional parts across operations. A key factor in the increase in demand for additional parts is the expanded use of Compressed Natural Gas (CNG) vehicles. Many of these vehicles are reaching the end of their warranty periods, resulting in a higher volume of repairs and maintenance needs. Additionally, inflation continues to push prices higher, as manufacturers face increased production costs and supply chain challenges.
These factors have contributed to an increase in back orders, creating longer lead times and impacting parts availabilities. Some outstanding orders from the previous fiscal year remain pending due to delays in manufacturing and distribution. As a result, it has become necessary to increase the not-to-exceed amounts for each of the aforementioned vendords to better manage the delays and ensure that Transit operations can adapt to the shifting demands and supply chain disruptions.

BACKGROUND/DISCUSSION:
The City of Montebello operates Montebello Bus Lines (MBL) with a fleet of sixty-six (66)
CITY COUNCIL AGENDA REPORT - MEETING OF JULY 24, 2024
transit buses, ten (10) relief vehicles, and four (4) supervisor vehicles that require regular maintenance. The most efficient and cost-effective way to purchase replacement bus, fire apparatus, and vehicle fleet parts is to establish blanket purchase orders with the primary companies that supply these maintenance-related parts. For FY 2024-25, staff will use procurement methods such as sole-source and piggyback to strengthen the City’s financial processes and ensure its competitive and non-competitive contracting practices are in accordance with the Montebello Municipal Code (MMC) Section 3.20 – Purchasing System. The sole-source procurement method will be used to make purchases including, but not limited to, maintenance-related parts as follows:
• Aftermarket Parts: headlights, fan control modules, clamps, windshield wipers, coolants, airbags, clutches, stabilizers, and thrust washers. • American Moving Parts: engines, brake kits, air dryer cartridge kits, cables, filters, transmission drums, wheel linings, and sensor replacements. • Cummins Pacific: spark plug kits, fan supports, ignition coils, engine rods, electronic control modules, engine wiring harnesses, and water pumps. • Inland Kenworth: valves, relays, hoses, seals, cylinder heads, tubes, engine control modules, engine in-frame kits, coil extensions, and sensors. • Wayne Electric Company: EMP alternators, air conditioning compressors, toggle switches, fan drivers, farebox motors, pumps, and filters
MMC Section 3.20.050 – Conformance with bidding procedures, outlines exceptions to the formal and open market bidding and procurement procedures detailed in the MMC.
The vendors listed have been identified as direct or sub-contracted suppliers of specific maintenance-related, original equipment manufacturer (OEM) parts, compatible with both MBL and Fire Department's fleet. Staff recommends that the City Council approve establishing a blanket PO specific to the vendors listed in accordance with MMC Section
3.20.050(B), which allows the procurement of parts and equipment from identified sole- source and/or single source vendors to ensure the continued operation of MBL and MFD.
Once approved, staff will complete a Sole Source Declaration form (Attachment A) as written record for each vendor.
