Council Regular Meeting, 12/5/2023, Item No. 11., Item Page 27, Packet Page 165 Council
Agenda Report
FROM: Nat Rojanasathira, Assistant City Manager
Anastacia Wyatt, Housing Manager
Mark Ackermann, Management Analyst I
SUBJECT: Amend and Restate Resolution 23-036, Master Fee Schedule to Update Fees for the Community Development Department by Adding Cannabis Retail Application Fees and Rental Inventory Fees, Effective January 4, 2024 (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061)
RECOMMENDATION:

That the City Council adopt a resolution to Amend and Restate Resolution 23-036, the Master Fee Schedule to update fees for the Community Development Department by adding Cannabis Retail Application Fees and Rental Inventory Fees, Effective January 4, 2024.

The attached draft City Council resolution, if adopted, will amend the fee schedule for the Community Development Department.

VALUE DRIVERS:

Serve as stewards of the City’s financial resources through sound economic vitality efforts, streamlining operations, reasonable revenue enhancements, visionary long-term planning, fiscal transparency, and community partnerships.

POLICY IMPLICATIONS:

Proposition 26 applies only to fees that are “imposed” by a government. Determining whether a charge is “imposed” turns on the nature of the service and other factors, such as: whether the charge is in connection with a service that the city is statutorily obligated to provide; whether the charge is in connection with a service for which the city is the exclusive provider within its service territory; whether the charge is in connection with a service, product, or opportunity the city provides in competition with other, particularly private enterprises; or whether the charge is established by voluntary negotiations. League of Cal. Cities, Proposition 26 and 218 Implementation Guide (2019), at p. 58.)
For fees that are subject to Proposition 26, the City bears the burden of proving by a preponderance of the evidence that the fee is not a tax, that the amount is no more than necessary to cover the reasonable cost of the governmental activity, and that the manner in which those costs are allocated to a payor bear a fair or reasonable relationship to the payor’s burdens on, or benefits received from, the governmental activity. (Cal. Const., Art. XIII C §1, subd. (e); League of Cal. Cities, Proposition 26 and 218 Implementation Guide (2019).) This means that all revenue sources are taxes requiring voting approval unless an exception applies.

There are seven enumerated exceptions.

Date: 12/5/2023
Item No.: 12.

Council Regular Meeting, 12/5/2023, Item No. 12., Item Page 1, Packet Page 166 This action is also consistent with the City policy and practice to recover costs reasonably borne to provide regulations, products, or services as set forth in 19-102. “Costs reasonably borne” include direct and indirect costs, including but not limited to maintenance, contracted services, salaries, and supplies. The City’s cannabis consultant, SCI Consulting Group, has completed a Cannabis Cost Recovery Analysis to determine the fully burdened rates of employees working on the Cannabis policy and development efforts, and identify the recommended Cannabis Retail Application Fee.

FISCAL IMPLICATIONS:

The action would update the City’s Master Fee Schedule as seen in Exhibit A. Specific revenue implications are presented per department in the discussion section.

ENVIRONMENTAL DETERMINATION:

The City of Monterey determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA)(CCR, Title 14, Chapter 3 (“CEQA Guidelines”), Article 20, Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.

Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or any reasonably foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.

ALTERNATIVES CONSIDERED:

The Council could choose not to approve these fees, staff does not recommend this alternative.

Allocating direct and indirect costs of providing services incurred by the City is a Government Finance Office Association (GFOA) best practice.

DISCUSSION:

Cost Recovery for Cannabis Retail Applications and Rental Inventory Applications At its meeting on November 21, 2023, the Monterey City Council introduced an ordinance amending Monterey City Code section 19-103, the Schedule of Fees and Services Charges, to Fully Recover the Cost of Administering the Cannabis Business Ordinance and Rental Inventory Ordinance. This Ordinance, which would take effect on January 4, 2024, would set the cost recovery of these two programs at 100%. The proposed fees would take effect on January 4, 2024 to coincide with the Ordinance.

Council Regular Meeting, 12/5/2023, Item No. 12., Item Page 2, Packet Page 167 Cannabis Retail Application Fees
City staff worked closely with SCI Consulting Group to develop a fee analysis for the City’s cannabis retail application fee. The methodology used considered 100% cost recovery on the cannabis regulatory process, fully burdened rates for applicable staff, and estimated staff hours to be spent on each phase of the application process.

An estimate of 15 applications was used to determine the individual fee amounts. This resulted in a total application fee of $9,045 per applicant. In addition to the application fee, applicants will be required to pay $300 per owner for background checks. Fees for each phase of the application process have been itemized to allow applicants that do not complete all four phases to avoid paying the total application fee. Application fees for Phase 1 and Phase 2, along with the fee for the background check, will be due upon submission of the application. The total due for Phase 1 and Phase 2 is $4,845. The fee for the background check is $300 per owner and per employee. For Phase 3, a payment of $1,840 will be due within five (5) business days of the applicant being notified that they have been selected to proceed to the phase. For Phase 4, a payment of $2,360 will be due within five (5) business days of the applicant being notified that they have been selected to proceed to the phase.

Fees for Testing Laboratory Application Review is $2,425; Temporary Cannabis Event Application Review is $1,610, and Out-of-City Retail/Distribution Application Review is $70.

Fees for the ongoing maintenance of the program, including an Annual Cannabis Business Permit, Cannabis Audit, Cannabis Business Permit Renewal, and Zone Clearance, are driven by the actual cost of each item and detailed in Attachment 1. The Annual Cannabis Compliance Fee and Cannabis Business Permit Renewal Application Review Fee total $3,175, while a Cannabis Audit is $6,500 per permittee. In addition, per Monterey City Code section 19-122 et seq., a Cannabis Business License tax must be paid annually.

SCI Consulting Group has advised that the City of Monterey’s proposed application fee of $9,045 per applicant is in a similar range of rates established by other municipalities in California ($10,000 to $15,000 per applicant). Cannabis rates charged in nearby municipalities range from $3,925 for the City of Salinas to $8,000 for the City of Seaside and City of Marina.

Rental Registry Inventory Fees
On October 6, 2023, staff issued and circulated an RFP for Rental Inventory Program Software, which would be the primary cost of operating the rental registry. The RFP requested that the proposer develop a software solution that would include a public-facing portal and a secure database with reporting tools. By the October 30, 2023 deadline, responses were received from six firms. After extensive research, interviews, and reference checks, Tolemi, a Boston-based company, was selected as the firm that can meet the City’s rental inventory management software needs at the least cost, deadlines, and service expectations with their BuildingBlocks and Slate Rental Inventory Program Software. Additionally, 1.50 FTE City staff are estimated to initiate the Rental Inventory program.

Council Regular Meeting, 12/5/2023, Item No. 12., Item Page 3, Packet Page 168 It is estimated that approximately $365,000 in fully burdened rates for applicable staff and software resources are needed to initiate the Rental Inventory program1. The fees for the program are required to have a 100% cost recovery for fully burdened staff recovery and to pay for the software costs to run the Rental Inventory program. It is estimated that there are approximately 8,134 rental units within the City2. It is unknown how many of the City’s rental units are exempt with three (3) or fewer rental units. For this analysis, staff estimates 10% of the rental units may be exempt. It may take Staff at least one (1) year of running the Rental Inventory program to have a more accurate accounting. However, the requirement for cost recovery can only be estimated at this time, and staff intends to adjust the fees based on full cost recovery after the program is in continuous operation after one year.

Total costs estimated to run the Rental Inventory program are $365,000 divided by the estimated 7,321 rentals (8,134 total units, less 10% exemptions), or approximately $50.00 per unit. The Rental Inventory Fees required to be paid by a landlord of a Rental Unit, as directed by the City Council per Ordinance, is recommended to be $50 per unit.

Other jurisdictions’ rental registration fees range from $50 per unit up to $350 per building.

Staff Recommendation
Staff recommends that Council accept the proposed changes to the Master Fee Schedule as presented and adopt a resolution to amend and restate Resolution 23-036.

A RESOLUTION OF THE COUNCIL OF THE CITY OF MONTEREY
AMENDING AND RESTATING RESOLUTION 23-036, THE MASTER FEE SCHEDULE, TO

UPDATE FEES FOR THE COMMUNITY DEVELOPMENT DEPARTMENT BY ADDING

CANNABIS RETAIL APPLICATION FEES AND RENTAL INVENTORY FEES WHEREAS, the City Council adopted Resolution 14-132 to establish a Master Fee Schedule, which has been amended and updated several times, most recently with the adoption of Resolution 23-036 on March 21, 2023, which amended and restated Resolution 22-077; WHEREAS, the City Code calls for a full analysis of costs reasonably borne not less than every five years. Staff conduct cost of services studies to review and calculate the City’s expenditures linked to a particular activity in order to determine the fee amount and cost recovery level. Therefore, from time to time, the Master Fee Schedule has been amended to reflect changes or adjustments to fees as necessary to recover costs pursuant to that policy; WHEREAS, this resolution amends only the Community Development Department fee schedules; it does not alter any other fees previously adopted by the City Council and those are restated along with the amended fees in Exhibit A to this Resolution; WHEREAS, the City provides a variety of services to the public which benefit the entire community, individuals, or businesses. For certain services such as regulatory fees or recreational activities, the City recovers partially or fully the cost of providing these services, which would have been otherwise paid from the General Fund; WHEREAS, where required by law, the amount of the new or increased fees and charges is no more than necessary to cover the reasonable cost of the governmental activity, and the manner in which those costs are allocated to the payer’s burden on, or benefits received from, the governmental activity;
WHEREAS, certain fees in the fee schedule are for government services provided directly to the payor that are not provided to those not charged. Where required by law, the amount of these fees does not exceed the reasonable costs to the City of providing the services. Consequently, pursuant to California Constitution, Art. XIII C, Section 1(e)(2), such fees are not a tax;
WHEREAS, Propositions 13, 218, and 26 have placed both substantive and procedural limits on cities’ ability to impose fees and charges. Collectively these constitutional amendments provide safeguards against taxes being imposed without a vote of the people; and WHEREAS, Proposition 26 contains a requirement that the local government “bears the burden of proving by a preponderance of the evidence that a levy, charge, or other exaction is not a tax, that the amount is no more than necessary to cover the reasonable costs of the governmental activity, and that the manner in which those costs are allocated to a payor bear a fair or reasonable relationship to the payor’s burdens on, or benefits received from, the governmental activity.” (California Constitution, Article XIII C, Section 1); Council Regular Meeting, 12/5/2023, Item No. 12., Item Page 5, Packet Page 170 2 WHEREAS, Community Development Department Cannabis Retail Application and Rental Inventory fees, and advance deposits for other permit application processing are not a tax because the service is provided directly to the payor, it is not provided to those not charged, and the fee does not exceed the reasonable costs of providing the service.
