2023 CITYWIDE SLURRY SEAL PROJECT, CIP 13048

THIS AGREEMENT is made and entered into as of , between the CITY OF MURRIETA, California, a municipal corporation, hereinafter referred to as “CITY," and WESTERN WATER, a municipal water district organized and ope rating pursuant to the Municipal Water District Law of 1911 as set forth in the California Water Code, hereinafter referred to as “WW.” In consideration of the mutual promises and covenants contained herein, the parties hereto mutually agree as follows:

Section 1. Purpose. The purpose of this Agreement is to establish reimbursement to CITY by WW for the cost of adjusting WW facilities (manholes) as shown on the attached bid sheet which are made part of this Agreement as Attachment “A", in conjunction with the improvement of the 2023 CITYWIDE SLURRY SEAL Project, CIP 13048, herei nafter referred to as “PROJECT".

Existing manholes owned by WW must be single adjusted to grade as part of the PROJECT. The quantity of the bid item for “Single Adjust Manhole (WMWD)” is an estimated quantity. Should additional adjustment be deemed necessary by the CI TY and WW during the course of construction, then WW shall be responsible for reimbursing the CITY for the additional adjustments not described on the bid sheet. The facilities to b e adjusted are within the CITY’s right-of-way.

Pursuant to this Agreement, WW agrees to pay for th e adjustments of the manhole facilities that are located in the CITY’s right-of-way and are related to the PROJECT.

Section II. Bid Items. WW shall reimburse the CITY one hundred percent (100%) of the costs (hereinafter referred to as “REIMBURSEMENTS") , for the adjustments of certain WW facilities within the PROJECT area, as detailed in the table below. The costs for the REIMBURSEMENTS to CITY by WW shall include those fa cility items as shown on the attached Bid Sheet in Attachment “A”, which is made a part of this Agreement. The estimated costs for the bid items on the Bid Sheet (“Bid Items”) are provided below based on the engineer’s estimate for the PROJECT. WW shall reimburse the City using the actual bid prices provided by the Bid Sheet plus the cost of any WW-approved change order(s). T he estimated costs for the bid item on the Bid Sheet are provided below based on the engineer’s estimate for the PROJECT.

Section III. Construction and Costs.

a. Bidding. Costs for the construction are based upon the construction bids that will be received for the PROJECT for the Bid Items referenced in Section II as shown on the Bid Sheet for the PROJECT. CITY will evaluate and analyze all bids received and select the lowest responsible bidder for the PROJECT (hereinafter ref erred to as “CONTRACTOR”). Per WW requirements, the CITY agrees that the bid package will require the CONTRACTOR who will perform work on the water items shall have either an “A" or “C34" Contractor’s License.

b. WW Right to Perform. To provide WW the option to pe rform the work identified at Section II as work that is WW’s responsibility, the CITY’s construction bid package shall identify WW’s Bid Items as Additive Bid Items. Upon receipt of the bids and determination of the lowest responsive and responsible bidder for the PROJECT, the CITY shall notify WW of its identified portion of the construction costs for the Bid Items. At that time, WW may elect to perform/construct the Bid Items itself to the same specifications as described in the bid specifications. If WW elects to perform the Bid Items, WW shall bear all costs associated with that work and the CITY shall not include said Bid Items in the contract with the CONTRACTOR. WW shall be given a “construction window" inside the PROJECT traffic control to complete the manhole adjustments. Moreover, WW shall bear all costs associated with the manhole adjustments, included but not limited to, delay to the CITY'S CONTRACTOR or utility coordination effor ts needed as a result of having multiple contractors on site. WW shall provide written notic e to the City Engineer of its determination to perform the Bid Items within fourteen (14) calendar days from the date of receipt of the ClTY’s identification of its lowest responsive and responsible bidder or WW waives any right to construct the Bid Items.

c. Payment. WW shall maintain a contingency amount equal to ten percent (10%) of the total estimated costs of the adjustment of the sewer facilities to account for unforeseen changes to the PROJECT. The CITY shall obtain written approval from WW prior to the approval of any change orders associated with the adjustments of the facilities WW is financially responsible for and authorize the CONTRACTOR to proceed unless failure to act immediately may affect public safety. The cost of any delay in the work due to th e delayed action of WW in connection with PROJECT construction shall be borne by WW. WW shall respond to any PROJECT change orders within fourteen (14) calendar days.

CITY shall make payment to CONTRACTOR for all work performed. Actual costs shall be identified and billed to WW for payment on the following basis:

The CITY shall invoice WW using progress payments or upon completion of the PROJECT, at the discretion of the CITY, for all Bid Items that are the financial responsibility of WW. WW shall remit payment to the city within thirty (30) days of receipt of the approved invoice or the invoices shall accrue interest of 5% per year compounding monthly.

Section IV. Plans, Permits and Contacts.

a. Plans and Specifications. WW acknowledges that it has reviewed and approved all plans and specifications for the adjustments of the sewer facilities as shown on the attached plans and the estimated bid amounts are reasonable.

b. CEQA. The CITY shall be responsible for obtaining a ny and all environmental permits and approvals as may be necessary for the P ROJECT including, but not limited to, compliance with requirements imposed under the Cali fornia Environmental Quality Act (“CEQA”) 309

as may be applicable.

c. Agreement Management. Management and administration of the terms expressed herein shall be performed by CITY for the PROJECT. CITY designates Mr. Jeff Hitch, City Engineer , as the contact for CITY in regard to this Agreeme nt. WW designates Ms. Sonia Huff, PE., Deputy Director of Engineering, as the contact for WW to facilitate the REIMBURSEMENTS identified herein.

Section V. Inspection. WW shall be responsible to inspect the constructio n of all WW facilities, as shown on Attachment “A” and describe d in Section II of this Agreement, and the performance of the involved work by CITY’s CONTRACT OR for compliance with the approved construction plans and specifications and/or for WW’s own work if such work has been undertaken by WW pursuant to Section III(b). WW’s inspection p ersonnel shall have the authority to enforce WW’s construction plans and specifications for the PROJECT, which authority shall include the authority to require that any and all unacceptable materials, workmanship, and/or installation be replaced, repaired, or corrected by ClTY’s CONTRACTOR without cost to WW.

If WW undertakes the performance of the PROJECT’s Bid items shown in Section II under Total Estimated Project Bid Items From Attachment “A,” and if, through the failure of WW to provide access and control of the construction site within the time allotted by the Project Specifications, the CITY’s CONTRACTOR sustains loss which could not have been avoided by the judicious handling of forces and/or equipment, WW shall be li able for that part of the CITY’s CONTRACTOR's actual loss, that was unavoidable in a ccordance with State of California, Department of Transportation Standard Specifications section 8-1.09, RIGHT-OF-WAY DELAYS.

Section VI. Insurance and Indemnity. For the period during which CITY or its CONTRACTOR(s) controls the job site, CITY will prov ide, or cause to be provided, for the entire period of construction, a policy of workers’ compen sation insurance and comprehensive general liability insurance with coverage broad enough to i nclude the contractual obligation it may have under the construction contract and having a combined single limit of liability in the amount of $2,000,000 covering WW’s officers, employees, and agents as additional insureds.

If WW undertakes to perform the PROJECT’s Bid Items shown in Section II under Total Estimated Project Bid Items from Attachment “A" pur suant to Section III(b), WW, prior to commencement of the work and for the period during which WW operates at the job site, will provide, or cause to be provided, for the entire pe riod of construction, a policy of workers’ compensation insurance and comprehensive general li ability insurance with coverage broad enough to include the contractual obligation it may have under the construction contract and having a combined single limit of liability in the amount of $1,000,000 per occurrence with a $5,000,000 aggregate covering the CITY’s officials, officers, employees, and agents as additional insureds.

WW and the CITY each hereby agree to indemnify, def end, and hold harmless the other party and their respective directors, officials, officers, employees and agents from and against any claims, actions, damages and liabilities arising out of or in any manner connected with any act or omission of such indemnifying party, performed in c onnection with such party’s duties and obligations hereunder. This Clause shall survive the termination of this agreement.

Either party may change its address for notices by notifying the other party. All notices given at the most recent address specified shall be deemed to have been properly given.

Section VIII. Amendment. This Agreement may only be amended in writing upon the mutual written consent of both parties.

Section IX. Laws, Venue and Attorney’s Fees. This Agreement shall be interpreted in accordance with the laws of the State of California. If any action is brought to interpret or enforce any term of this Agreement, the action shall be bro ught in a state of federal court situated in the County of Riverside, State of California. In the event of any such litigation between the Parties, the prevailing Party shall be entitled to recover all r easonable costs incurred, including reasonable attorney’s fees, as determined by the court.

Section X. Interpretation and Headings. This Agreement shall not to be construed against the Party preparing it but shall be constru ed as if both Parties prepared it. Headings to paragraph/subparagraphs of this Agreement are for convenience purposes only and are not part of this Agreement.

Section XI. Provisions Binding. This Agreement and the Exhibits attached hereto are binding on the heirs, representatives, successors, and assigns of the Parties of this Agreement.

Section XIII. Authority to Sign Agreement. The undersigned individuals hereby warrant and represent that they each have full legal authority to sign this Agreement and bind the 311

REIMBURSEMENT AGREEMENT

EVMWD FACILITY ADJUSTMENTS FOR
2023 CITYWIDE SLURRY SEAL PROJECT, CIP 13048

THIS AGREEMENT is made and entered into as of , between the CITY OF MURRIETA, California, a municipal corporation, hereinafter referred to as “CITY," and ELSINORE VALLEY MUNICIPAL WATER DISTRICT, a municipal water district organized and operating pursuant to the Municipal Water District Law of 191 1 as set forth in the California Water Code, hereinafter referred to as “EVMWD.” In consideratio n of the mutual promises and covenants contained herein, the parties hereto mutually agree as follows:

Section 1. Purpose. The purpose of this Agreement is to establish reimbursement to CITY by EVMWD for the City’s cost of adjusting EVMWD’s m anholes located in the City’s right-of-way (“PROJECT”), as detailed in Attachment “A,” attache d hereto and incorporated by reference, in conjunction with the 2023 CITYWIDE SLURRY SEAL Proj ect, CIP 13048. Existing manholes owned by EVMWD must be single adjusted to grade as part of the PROJECT. The quantity of the bid item for “Single Adjust Manhole (EVMWD)” is an estimated quantity. Should additional adjustments be deemed necessary after review and mu tual agreement between the CITY and EVMWD during the course of construction, then EVMWD shall be responsible for reimbursing the CITY for the additional adjustments not described on the bid sheet.

Section II. Bid Items. EVMWD shall reimburse the CITY one hundred percent (100%) of the costs (hereinafter referred to as “REIMBURSEMENTS") for the adjustments of certain EVMWD manholes within the PROJECT area, as detailed in It em 54 in Attachment “A” and in the table below. The estimated costs for the bid item on the Bid Sheet (“Bid Item”) are provided below based on the engineer’s estimate for the PROJECT. EVMWD s hall reimburse the City using the actual bid prices provided by the Bid Sheet plus the cost of any EVMWD-approved change order(s).

Section III. Construction and Costs.

a. Bidding. Costs for construction are based upon the bids received for the PROJECT. CITY will evaluate and analyze all bids re ceived and select the lowest responsible bidder for the PROJECT (hereinafter referred to as “CONTRACTOR”). CITY shall not accept any bids over the total estimated EVMWD reimbursement of five thousand two hundred eighty dollars ($5,280.00), as detailed in Section II above without prior written approval of EVMWD. Per EVMWD requirements, the CITY agrees that the bid package will require the CONTRACTOR who will perform work for the PROJECT shall have either an “A" or “C34" Contractor’s License.

EVMWD Right to Perform. To provide EVMWD the option to perform the work for the PROJECT, the CITY’s construction bid package shall identify EVMWD’s Bid Items as Additive Bid Items. Upon receipt of the bids and determinati on of the lowest responsive and responsible bidder for the PROJECT, the CITY shall notify EVMWD of its identified portion of the construction costs for the PROJECT. At that time, EVMWD may elect to perform/construct the PROJECT itself to the same specifications as described in the bid specifications. If EVMWD elects to perform the PROJECT, EVMWD shall bear all costs associated with that work and the CITY shall not include said PROJECT in the contract with the CONTRACTOR. EVMWD shall be given a “construction window" inside the traffic control to complete the PROJECT. Moreover, EVMWD shall bear all costs associated with PROJECT, included but not limited to, delay to the CITY'S CONTRACTOR or utility coordination efforts needed as a result of having multiple contractors on site. EVMWD shall provide written notice to the City Engineer of its determination to perform the PROJECT within fourteen (14) calendar days from the date of receip t of the ClTY’s identification of its lowest responsive and responsible bidder or EVMWD waives any right to construct the PROJECT.

c. Payment. EVMWD shall maintain a contingency amount equal to ten percent (10%) of the total estimated costs of the adjustment of t he sewer facilities to account for unforeseen changes to the PROJECT. The CITY shall obtain writt en approval from EVMWD prior to the approval of any change orders associated with the P ROJECT and issuance of any authorization for the CONTRACTOR to proceed unless failure to act immediately may affect public safety. The cost of any delay in the work due to the delayed ac tion of EVMWD in connection with PROJECT construction shall be borne by EVMWD. EVMWD shall respond to any PROJECT change orders within fourteen (14) calendar days of receipt.

CITY shall make payment to CONTRACTOR for all work performed. Actual costs shall be identified and billed to EVMWD for payment on the following basis:

The CITY shall invoice EVMWD using progress payments or upon completion of the PROJECT, at the discretion of the CITY, for the PROJECT. EVMWD shall remit payment to the CITY within thirty (30) days of receipt of the approved invoice or the invoices shall accrue interest of 5% per year compounding monthly. EVMWD shall notify the CITY of any disputes regarding the CITY ’s invoice within ten (10) days of receipt. Any disputes invoices shall not accrue interest until the dispute is resolved.

Section IV. Plans, Permits and Contacts.

a. Plans and Specifications. EVMWD acknowledges that it has reviewed and approved all plans and specifications for the PROJE CT, attached hereto and incorporated by reference as Attachment “B,” and the estimated bid amounts are reasonable. Should the CITY determine that any changes to these approved plans and specifications are necessary, the CITY shall notify EMVWD with the proposed changes and it s associated costs within ten (10) days.

Such changes shall not be implemented unless EMVWD approves a change-order.

b. CEQA. The CITY, acting as Lead Agency, shall be res ponsible for obtaining any and all environmental permits and approvals as may be necessary for the PROJECT including, but not limited to, compliance with requirements impose d under the California Environmental Quality Act (“CEQA”) as may be applicable.

c. Agreement Management. Management and administration of the terms expressed herein shall be performed by CITY for the PROJECT. CITY designates Mr. Jeff Hitch, City Engineer , as the contact for CITY in regard to this Agreement. Section V. Inspection. EVMWD shall be responsible to inspect the construc tion of the PROJECT, as shown on Attachment “A” and described i n Section II of this Agreement, and the performance of the involved work by CITY’s CONTRACT OR for compliance with the approved construction plans and specifications, as shown in Attachment “B” and/or for EVMWD’s own work if such work has been undertaken by EVMWD pursuant to Section III(b). EVMWD’s inspection personnel shall have the authority to enforce EVMWD ’s construction plans and specifications for the PROJECT, which authority shall include the authority to require that any and all unacceptable materials, workmanship, and/or installation be repl aced, repaired, or corrected by ClTY’s CONTRACTOR without cost to EVMWD.

If EVMWD undertakes the performance of the PROJECT and if, through the failure of EVMWD to provide access and control of the construction site within the time allotted by the Project Specifications as outlined in Attachment “B”, the CITY’s CONTRACTOR sustains loss which could not have been avoided by the judicious handling of forces and/or equipment, EVMWD shall be liable for that part of the CITY’s CONTRACTOR's actual loss, that was unavoidable in accordance with State of California, Department of Transportat ion Standard Specifications section 8-1.09, RIGHT-OF-WAY DELAYS.

Section VI. Insurance and Indemnity. For the period during which CITY or its CONTRACTOR(s) controls the job site, CITY will prov ide, or cause to be provided, for the entire period of construction, a policy of workers’ compen sation insurance and comprehensive general liability insurance with coverage broad enough to i nclude the contractual obligation it may have under the construction contract and having a combined single limit of liability in the amount of $2,000,000 covering EVMWD’s officers, employees, and agents as additional insureds.

If EVMWD undertakes to perform the PROJECT, EVMWD, prior to commencement of the work and for the period during which EVMWD operates at the job site, will provide, or cause to be provided, for the entire period of construction, a policy of workers’ compensation insurance and comprehensive general liability insurance with coverage broad enough to include the contractual obligation it may have under the construction contract and having a combined single limit of liability in the amount of $1,000,000 per occurrence with a $ 5,000,000 aggregate covering the CITY’s officials, officers, employees, and agents as additional insureds.

EVMWD and the CITY each hereby agree to indemnify, defend, and hold harmless the other party and their respective directors, officials, officers, employees and agents from and against any claims, actions, damages and liabilities arising out of or in any manner connected with any act or omission of such indemnifying party, performed i n connection with such party’s duties and obligations hereunder. This Clause shall survive the termination of this agreement.

Either party may change its address for notices by notifying the other party. All notices given at the most recent address specified shall be deemed to have been properly given.

Section VIII. Amendment. This Agreement may only be amended in writing upon the mutual written consent of both parties.

Section X. Interpretation and Headings. This Agreement shall not to be construed against the Party preparing it but shall be constru ed as if both Parties prepared it. Headings to paragraph/subparagraphs of this Agreement are for c onvenience purposes only and are not part of this Agreement.

Section XI. Provisions Binding. This Agreement and the Exhibits attached hereto are binding on the heirs, representatives, successors, and assigns of the Parties of this Agreement.

Section XIII. Authority to Sign Agreement. The undersigned individuals hereby warrant and represent that they each have full legal authority to sign this Agreement and bind th e Parties hereto .

RECOMMENDATION

PRIOR ACTION/VOTE
On June 20, 2023, the City Council authorized entering into agreements for miscellaneous on-call engineering plan check consulting services with Michael Baker International, Inc., HR Green Pacific, Inc., Anser Advisory Management, LLC, and Rick Engineering Company (Vote: 4-0).

On June 18, 2024, the City Council approved purchase orders for on-call engineering plan check services for Michael Baker International, Inc., HR Green Pacific, Inc., Anser Advisory Management, LLC, and Rick Engineering Company (4-0).

BACKGROUND
On June 20, 2023, the City Council approved on-call agreements for engineering plan check, land development review, public works and stormwater pollution prevention plan (SWPPP) inspection, National Pollutant Discharge Elimination Systems (NPDES) inspection, and traffic engineering services with Michael Baker International, Inc. (MBI); HR Green Pacific, Inc. (HR Green); Anser Advisory Management, LLC (Anser); and Rick Engineering Company (REC). and Rick Engineering Company (REC). These companies have been providing ongoing engineering services under the current on-call agreements.

Purchase orders (PO) were approved on June 18, 2024, for MBI, HR Green, Anser, and REC in the amounts and for the terms as indicated in the table below. Staff has prepared estimates for the additional funds needed for the remainder of FY 2024/25 based on a trend analysis of invoices received since the beginning of the fiscal year. The analysis concluded that the plan checking services performed in the first two quarters are more balanced between MBI and HR Green than originally assumed last June resulting in the need to increase HR Green’sPO. Anser’sNPDES services are trending higher to meet the NPDES reporting requirement needs.

The requested increase for REC is based upon their proposal provided in Attachment No. 1. The existing POs and proposed PO increases are presented in the following table.

Funds are available in the Operating Budget Engineering accounts for the HR Green and Anser POs.

However, there are insufficient funds for the MBI and REC POs, resulting in the need for an appropriation of $148,642 from the General Fund Unassigned Fund Balance.

FISCAL IMPACT
Staff recommends amending the FY 2024/25 Operating Budget by appropriating $148,642 from the General Fund Unassigned Fund Balance to GL 1106120-60360 and $50,000 from the National Pollutant Discharge Elimination System Fund Balance to GL 4316120-60640.

With the approval of the additional appropriation, sufficient funds will be available in the FY 2024/25 Operating Budget for the Engineering accounts listed below to accommodate the additional PO requests. Staff recommends that the City Council approve the following POs using the following budgetary accounts and authorize the City Manager to execute the POs.

SCOPE OF WORK

Provide Staff at City Hall one day a week from January 1, 2025 through June 30, 2025. Typical tasks to be performed include:

1. Staff Reports
Assist the Director of Public Works/ City Engineer by preparing staff reports for City Council, Planning Commission, and Public Safety and Traffic Commission meetings. Items to be prepared for staff reports may include signal warrant analysis, all way stop analysis, road closure analysis, traffic calming measures, signal timing analysis, and all backup data needed for the report.

2. Meetings
Attend meetings as necessary for City Council, Planning Commission, Traffic Commission, Development Review Committee, School District, Police Department, developer/applicant meetings, and Project Design Meetings.

3. Traffic Commission
Prepare staff reports for the monthly Traffic Commission meetings, and present the reports on action items and informational items to the Commission on a monthly basis.

4. Work Orders
Prepare work orders for City of Murrieta maintenance staff. Typical work order items include sign installations, curb markings, and pavement markings/striping.

5. Resident Concerns/Inquiries
Respond to residents phone calls/emails requesting traffic analysis within their neighborhoods.

Typical duties include analyzing locations for all way stops, additional signage, sight distance analysis, parking restrictions, and traffic calming measures.

6. Signal Timing
Prepare signal timing sheets for new signal installations, and troubleshoot problems at existing signal locations. Make any timing adjustments deemed necessary.

7. Plan Checking
Review and comment on any traffic signal plans, signing and striping plans, and traffic control plans that are not submitted as part of a separate development plan set, as requested by the City Engineer/Engineering Department.

FEE

Our fee for the work to be performed for the As -Needed Traffic Engineering Services would be based on a fixed fee in the amount of sixty-eight thousand six hundred and forty-two dollars ($68,642.00).

Any printing, title company fees, blueprinting and miscellaneous expenses are included within this agreement. Not included are any items not specifically referred to above.

Fees and expenses will be billed monthly as the work progresses and the net amount shall be due within thirty (30) days from the date of receipt of the invoice in the Client's office.

BACKGROUND
A slope easement for right-of-way purposes was deeded to the City on February 22, 2011, through Instrument No. 2011-081287, by Golden City Land Company, as part of the Whitewood Road capital improvement project constructed by the City. The slope easement at that time was necessary to construct the roadway. Jefferson, Whitewood, LLC, the developer of the parcel on the southeast corner of Whitewood Road and Lee Lane, has requested the abandonment of a portion of the slope easement to allow for development of a multi-family residential project. The portion of the easement areas to be abandoned is legally described in Exhibits “A”and “C” to the proposed Resolution. Plats are provided in Exhibits “B” and “D” to describe the locations.

The original dedication to the City was for a slope easement, but it was legally described as being for right-of- way purposes. Staff has reviewed the requested slope easement and right-of-way vacation and determined that the purpose of the easement is no longer needed due to the proposed development of the parcel. The grading of the parcel by the developer will render the slope easement unnecessary. Since the slope easement was dedicated as a public right-of-way, the City needs to formally vacate the right-of-way to terminate the easement. CALIFORNIA TO ORDER THE SUMMARY VACATION OF AN EASEMENT FOR

WHEREAS, on February 22, 2011, through Instrument No. 2011 -081287, Golden City Land Company granted an easement for right of way and slope purposes (“Subject Property”) to the City of Murrieta (“City’); and
WHEREAS, the City has not utilized the Subject Property and desires to abandon the easement and convey it back to the current underlying property owner, Jefferson Whitewood LLC. (“Applicant”); and
WHEREAS, pursuant to Streets and Highways Code Section 8334, summary vacation may occur when an excess right -of-way of a street or highway is not required for street or highway purposes; and
WHEREAS, the proposed right of way to be vacated is legally described in Exhibit s “A” and “C” to this Resolution (“Vacation”); and
WHEREAS, the Subject Property does not contain public facilities; and WHEREAS, pursuant to Streets and Highways Code Section 8351, when the city vacates an easement, title to the property previously subject to the easement reverts to the owner of the fee free from the easement; and
WHEREAS, the City desires that the Subject Property be summarily vacated and conveyed to the Applicant.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:

Section 1. The recitals above are true and correct and incorporated herein by this reference.

Section 2. The City Council of the City of Murrieta hereby elects to proceed with the summary vacation legally described in Exhibit s “A” and “C” to this Resolution and as represented in the plats attached as Exhibits “B” and “D” respectively.

Section 3. The right of way vacated hereby constitutes an excess right -of-way not required for street or highway purposes because it is unnecessary for the present and prospective public use.

Section 4. That, from and after the date this Resolution is recorded, the City Council does hereby vacate and abandon the rights of way described in Exhibit s “A” and “C” hereto, which right -of-way area is vacated and no longer constitutes a right of way for roadway purposes.

Section 5. That the actions taken pursuant to this Resolution are categorically exempt from the requirements of CEQA pursuant to Section 15305 of the CEQA Guidelines, for minor alterations to land.

Section 6. That City staff is hereby directed to cause a certified copy of this Resolution, attested by the City Clerk under the seal of the City, to be recorded in the Office of the County Recorder of County of Riverside.

Section 7. That upon recordation as provided 6 above, the vacation is complete and the City Manager is authorized to execute any necessary documents to relinquish any easement rights thereon.

In 2004, the City Council adopted Ordinance No. 295-04, providing for municipal elections to be held on the first Tuesday following the first Monday in November of even-numbered years. In 2017, the City Council adopted Ordinance No. 522-17, changing the City Council voting system from at-large to by-district. As a result, the City of Murrieta (City) staggers the City Council Member districts such that either two or three districts have an election each election cycle.

On June 18, 2024, pursuant to provisions under State law, the City Council adopted resolutions calling the November 5, 2024, General Municipal Election (Election) for District Nos. 3 and 4, for a full term of four years, requesting consolidation with the County of Riverside and adopting regulations for candidate statements.

On November 5, 2024, the Election for District Nos. 3 and 4, were conducted. The Riverside County Registrar of Voters (ROV) has concluded canvassing the returns and has certified the Election results. The final official Election results specific to Murrieta are provided as Exhibit 1 to Resolution No. 24-4802.

California Elections Code §10262(b) requires the City Council to certify the Election results no later than the next regularly scheduled City Council meeting following the ROVs' final canvass of the returns. Additionally, California Elections Code §10263 requires that, upon completion of the canvass and before installation of the new officers, the governing body shall adopt a resolution reciting the facts of the election and declare elected the persons for whom the highest numbers of votes were cast for each office. Therefore, the City Clerk is submitting Resolution No. 24-4802 for adoption as required by law.

The election for City Council District Nos. 1, 2, and 5 will be in November 2026.

FISCAL IMPACT
A budget of $120,000 is available for the City Clerk's Department in the Fiscal Year 2024/25 Operating Budget for Election Services in General ledger account number 1102400-63520.

The ROV anticipates providing the invoice for election services to the City by January 2025. If necessary, the City Clerk will return to the City Council with a budget increase request after receiving the final invoice in 2025.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MURRIETA,

CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 2024, DECLARING THE RESULTS OF THE ELECTION

AND RECITING SUCH OTHER MATTERS AS PROVIDED BY LAW

WHEREAS, a General Municipal Election was held and conducted in the City of Murrieta, California, on Tuesday, November 5, 2024, as required by law; and

WHEREAS, notice of the election was given in time, form and m anner as provided by law for candidates; that candidates were nominated to fill the vacancy or vacancies as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the laws of the State of California relating to general law cities; and

WHEREAS, pursuant to Resolution No. 24-4764, adopted June 18, 202 4, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results to the City Council; and

WHEREAS, the results of the election are received, attached and made a part hereof as “Exhibit 1”.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA,

CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

Section 1. That the whole number of ballots cast in the precincts, was 22,231.

Section 2. That the names of the persons voted for at the election for Member of City Council – District Three are as follows:

Lisa DeForest
Michael DeSena
John Nakagawa

That the names of the persons voted for at the election for Member of City Council – District Four are as follows:

Lori Stone
Javier L. Rubalcaba
Frank Madrid

Section 3. That the number of votes given at each precinct and the number of votes given in the City for each of the persons named for Member of the City Council for which the persons were candidates are as listed in “Exhibit 1”, attached hereto.

2 Section 4. That the City Council does declare and determine that:

Lisa DeForest was electe d as Member of the City Council, District Three, for the full term of four years, ending December, 2028; and

Lori Stone was elected as Member of the City Council , District Four, for the full term of four years, ending December, 2028.

Section 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result s of the election, showing: (1) the whole number of ballots cast in the City; (2) the names of the persons voted for; (3) for what office each person was voted for; (4) the number of votes given a t each precinct to each person; and (5 ) the total number of votes given to each person.

Section 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the office of Member of the City Council to which they have been elected.

Section 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

Revised Proposed Resolution and Discussion of Other Actions Opposing the State of California Interfering with the City’s Land Use Authority

RECOMMENDATION
Review, discuss, and consider the adoption of proposed Resolution 24-4799, drafted by Mayor Stone, and revised by staff at the direction of the City Council entitled: A Resolution of the City Council of the City of Murrieta, California, Opposing the State of California Interfering with the City’s Land Use Authority; and Discuss and consider providing staff with additional direction on actions intended to address the State’s interference with City land use authority.

CITY COUNCIL GOAL
Foster and promote an engaged, connected and caring community.

BACKGROUND
At the November 19, 2024, City Council meeting, Mayor Stone requested and received City Council consensus to bring forth for consideration a resolution regarding high-density housing and opposing the State of California interfering with the City’s land use authority.

At the December 3, 2024, City Council meeting, the City Council reviewed and discussed a proposed resolution. The consensus of the City Council was support for the concept presented in the proposed resolution, with direction to revise the resolution to be generic and therefore more easily ready for potential adoption by other cities.

Attachment 1 includes a proposed, revised resolution for consideration of the City Council.

City staff has confirmed with the California League of Cities that a resolution can be distributed through its listserv to identify other Cities interested in passing this resolution or joining in other efforts to preserve local control over land use. Other organizations, such as the Association of CA Cities-Orange County (ACC-OC), which includes 25 of 34 cities in Orange County, have also identified housing as a top priority, indicating potentially significant support for this effort.

RESOLUTION 24-4799

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MURRIETA,

CALIFORNIA, OPPOSING THE STATE OF CALIFORNIA INTERFERING WITH THE CITY’S LAND USE AUTHORITY
WHEREAS, cities and counties in California value having local control over their land use and services, including public safety, to best determine their community’s vision; and WHEREAS, all cities and counties adopt general plan s and zoning code s to establish a blueprint for future housing densities and the necessary infrastructure to plan for the growth outlined in the general plan , as well as to provide a framework for the establishment of public facilities, including parks, libraries, senior centers, other recreational amenities, and police and fire stations; and

WHEREAS, the State of California has concluded that there is not enough housing in the State and has mandated that all municipalities desiring to sell any excess land must comply with the “Surplus Land Act,” which requires the public agency to offer the land for sale to recreational and educational public entities and to housing developers. Under the Surplus Land Act , if any housing developer indicates interest in the land, the public agency desiri ng to sell the land must enter into a good-faith negotiation period with any and all potentially interested developers and comply with rigorous guidelines in doing so. Additionally, the public agency must record a covenant against the land requiring between 15 and 25% of any future housing constructed on the land to be deed-restricted as affordable housing. These requirements apply regardless of the location of the land and, in combination with other newer laws allowing increased density for affordable housing and limiting the discretion public agencies traditionally had in many areas of housing development, potentially allow the development of high-density projects that were never contemplated by the Murrieta General Plan; and
WHEREAS, the State of California, through The Regional Housing Needs Allocation (RHNA) process addressing California’s alleged housing needs, has mandated that cities update the Housing Element of the ir General Plan to demonstrate that the city can accommodate the building of n ew dwelling units , the majority of which are deed -restricted for occupancy or ownership as affordable units, during the 6th RHNA cycle of 2021 through 2029.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:

Section 1. The recitals above are true and correct and incorporated herein by this reference.

Section 2. The City is opposed to being mandated to approve the building of additional housing units with limited environmental review and being required to mitigate 486

the impact of adding a significant number of potential new residents in these units and significantly more vehicles traveling on roads that already exceed their capacity today, along with absorbing the impacts on public safety and other municipal services, public schools, and healthcare facilities.

Section 3. The City hereby encourages all 482 California cities to oppose this unfunded mandate of providing high-density housing to meet unrealistic goals set by the State of California by adopting this resolution under their own city’s name, and collectively meeting with the Governor and legislators to reverse this mandate that will devastate municipal services statewide and reduce the quality of life of all Californians.

Section 4. Should the Governor and legislature ignore and not mitigate the impacts of this mandate, t hen California cities will be forced to take additional actions to represent the interest of our residents and preserve local control.

Section VI. Insurance and Indemnity. For the period during which CITY or its CONTRACTOR(s) controls the job site, CITY will prov ide, or cause to be provided, for the entire period of construction, a policy of workers’ compen sation insurance and comprehensive general liability insurance with coverage broad enough to i nclude the contractual obligation it may have under the construction contract and having a combined single limit of liability in the amount of $2,000,000 covering EVMWD’s officers, employees, and agents as additional insureds.

Either party may change its address for notices by notifying the other party. All notices given at the most recent address specified shall be deemed to have been properly given.

Section VIII. Amendment. This Agreement may only be amended in writing upon the mutual written consent of both parties.

Section X. Interpretation and Headings. This Agreement shall not to be construed against the Party preparing it but shall be constru ed as if both Parties prepared it. Headings to paragraph/subparagraphs of this Agreement are for c onvenience purposes only and are not part of this Agreement.

Section XI. Provisions Binding. This Agreement and the Exhibits attached hereto are binding on the heirs, representatives, successors, and assigns of the Parties of this Agreement.
